Motion: Action: Carried Recommendation submitted to Council 2004-02-02 2) REPORTS: a) MW-2004-25 - Ann Street & Waters Avenue . Mr. Wilkie of7150 Ann Street advised Committee that his home was impacted by a pickup truck on December 23,2003. Mr. Wilkie presented a photo album of his home's damage for the consideration of Committee. Mr. Wilkie would like City staff to take appropriate measures to ensure the safety of the residents in this area. -2- . Mr. Ray McAndrews of7160 Ann Street has been a resident on Ann Street for 42 years. Mr. McAndrews advised the Committee of several incidents that have occurred in the area as a result of cars speeding down Ann Street and being unable to manipulate the "L" shaped turn. . Mr. Alex Rizzo of7133 Ann Street has been a resident on Ann Street for eight months. Mr. Rizzo repeated the concern about speeding on the street which is more prevalent in the evening and summer months. Mr. Rizzo is concerned that the children in the area will be struck while bicycling or rollerblading on the street. . Mr. Ron Pullano of 6719 Waters Avenue has been a resident on the comer of Waters Avenue and Dunn Street for more than 30 years. Mr. Pullano is very upset of the lack of effort by the City to resolve the speeding problem in this area. Mr. Pullano has contacted the City and Niagara Regional Police to rectify this situation. Mr. Pullano noted that vehicles are slowing down at the stop sign without making a full stop and continue through the intersection. Following further discussion the following motion was made; IT WAS MOVED BY ALDERMAN CAMPBELL and seconded by Alderman Ioannoni that stop signs with flashing amber lights be installed at Richmond Crescent and Waters Avenue and Richmond Crescent and Ann Street. That the lighting be improved at Ann Street and Waters Avenue and that staff proceed with the Environmental Assessment for speed humps. Further, that the Niagara Regional Police be contacted and additional enforcement be requested. Motion: Action: Carried Recommendation submitted to Council 2004-02-02 b) MW-2004-01 - Kahir Road Parking Review . George Skelding of 4063 Kalar Road advised Committee that he in favour ofthe reports recommendation as it will provide the safety the residents in the area are looking for. . Martha Fleming of 4075 Kalar Road advised Committee ofthe garbage, urination and noise that the residents have experienced. Patrons going to the restaurant are constantly turning around in her driveway as they cannot find a parking space. . Darlene Ingram of 4086 Kalar Road supported her neighbours concern and advised Committee that the street lighting from Thorold Stone Road to Niven Street is poorly lit. Mrs. Ingram also has problems exiting her driveway due to the cars parked on both sides of the road. -3- . Will Vargert of 8319 Vegter Court advised Committee that his cui de sac is very small and does not want to inherit the problems experienced by the residents on Kalar Road. Mr. Vargert expressed concerns with construction and patron vehicles that already park in this area blocking the entrance of his small cui de sac. . Mr. Vacca legal representative for Somebuddy's Restaurant submitted a letter asking Committee for a deferral of the report for a six-month period. The owners of Somebuddy's Restaurant are in the process of negotiating the purchase of an adjacent property for expansion of its parking. Following a lengthy discussion the following motion was made; IT WAS MOVED BY ALDERMAN WING and seconded by Alderman Ioannoni that parking be restricted at all times on both sides of Kalar Road between Thorold Stone Road and Niven Street and that staff reviews the street lighting. Motion: Action: Carried Recommendation submitted to Council 2004-02-02 c) MW-2004-23 - Dorchester Road Environmental Assessment Update De/can Presenting Following a continued presentation by De1can Mr. Bob Rominuk of 5806 Mullen addressed the Community Services Committee with the Trails and Bikeway Committee's concerns. Following a lengthy discussion the following motion was made; IT WAS MOVED BY ALDERMAN MOROCCO and seconded by Alderman Ioannoni that the Dorchester Road EA recommendations be supported and that the Committee authorizes staff to prepare and file the Environmental Study Report. The intention of the investigation is to resolve ongoing parking issues that stem from motorists parking/stopping their vehicles on Coventry Road. Coventry Road is a collector roadway extending in an east/west direction from Kalar Road to Buckingham Drive. Coventry Road is one of two main accesses from Kalar Road into the Westwood Subdivision. The roadway is 8.0 metres in width and consists of a sidewalk and a boulevard on both sides. The study area is residential with entrances to private residential complexes on both sides. The combined school Kate S. Durdan PubliclLoretto Catholic Elementary is located in the same building, on the west side of Kalar Road across from Coventry Road. A Kiss & Ride Program for both schools is operating within the parking lot. Furthermore, a parking lot for the Home For Girls Soccer facility, located immediately north of the schools, is available for parents to pick up their children in the afternoon. Building & By-Law Services T . ~ ow .... February 23, 2004 -2- MW-2004-26 to assist children across Kalar Road at Coventry Road with the assistance of Intersection Pedestrian Signal. During on-site observations staff noted that although parents are utilizing the Kiss & Ride Program, some are still using Coventry Road to pick up and drop off their children. Parents were observed to park their vehicles on the boulevard on Coventry Road to drop off and pick up their children. Furthermore, parents were observed to stop their vehicles in the middle of Coventry Road to let their children out of the vehicle. Based on the above-mentioned observations, the following concerns were observed: . children exiting vehicles in the middle of the road with the presence of through traffic boulevards and existing curbing is deteriorating as a result of motorists parking their vehicles parked/stopped vehicles may impede the unobstructed two-way movement on the road which is one of two main accesses to the subdivision . . Hydro is currently carrying out maintenance work near the entrance of the Home For Girls Soccer facility. Therefore, parents are not able to drop off their children in this area during the morning period due to the construction. However, full access is available in the afternoon to pick up children at the end of the school day. A review of the collision files reveals that collisions involving parked vehicles were not reported on Coventry Road during the previous three year period. Sight investigations on Coventry Road reveal that the available stopping sight distance is in accordance to a guideline outlined in the Geometric Design Guide for Canadian Roads. The proposed stopping restrictions will assure an unobstructed two-way vehicular traffic movement on Coventry Road. The restrictions will also allow emergency vehicles as well as utility vehicles adequate manoeuverability on Coventry Road. The proposed no stopping restrictions will encompass the street adjacent to the side property of 6851 Buckingham Drive. A conversation with the resident revealed that they prefer parking control on Coventry Road. Interviews with representatives from both schools reveal that stopping/parking on Coventry Road is an unsafe method for parents to pick up/drop off their children. Parked/stopped vehicles on Coventry Road impede the passage of through vehicles and in some cases jeopardize safety of their pupils. Therefore, based on the technical studies and observations, staff is recommending that a "no stopping" zone be implemented on both sides of Coventry Road. It is further recommended that a school newsletter inform all parents to utilize the Kiss & Ride Program and/or the parking lot for the Home For Girls Soccer facility to drop off/pick up their children. Staff will coordinate the installation of stopping restriction signs to occur after the conclusion of the maintenance work by the Niagara Hydro at the Home For Girls Soccer facility, or when full access to the facility is available, should the recommendations of this report be adopted. BACKGROUND: In response to a request ttom an area resident, staff conducted an intersection control review at the intersection ofFredonia Drive and Henley Avenue. The concern at this location stems from the fact that traffic control devices are not present at the study intersection. The intersection ofFredonia Driv~ and Henley Avenue is in a "tee" configuration consisting of north, south and east approaches. Henley Avenue is a local residential roadway extending in a north/south direction ttom Church's Lane to Levine Street. The roadway is 8.0 metres in width and consists of a boulevard and a sidewalk on both sides. Henley Avenue curves throughout its length. Fredonia Drive is a local residential roadway extending in a east/west direction ttom Henley Avenue to a point approxnnately 100 metres east, at which the roadway curves to the north and terminates at Levine Street. Fredonia Drive is 8.0 metres in width and consists of a sidewalk and a boulevard on both sides. A review ofthe collision files reveals that collisions were not reported at the intersection of Fredonia Drive and Henley Avenue during the previous three year period. Sight investigations reveal that the available crossing sight distance, to westbound motorists on Fredonia Drive, is below the minimum standard outlined in the Geometric Design Guide for Canadian Roads, in the north direction. The sight line is limited due to the presence of a horizontal curve on Henley Avenue. Therefore, a stop sign is recommended facing westbound motorists on Fredonia Drive at Henley Avenue. The proposed stop sign will adequately allocate the right-of-way and improve safety for vehicular and pedestrian traffic at the intersection of Fredonia Drive and Henley Avenue. On December 23,2003, the City of Niagara Falls was infonned by the Ministry of the Environment ofthe approval of the Main Street Environmental Assessment. All requests for Part n Orders ("bump ups") were denied. Since this intersection is controlled by the Region of Niagara, they have commenced design. They anticipate that the design will not be complete until May, with construction to take place sometime later in the year. Since this date is well past the opening of the Casino, Staff have asked that the Region take some immediate temporary action to improve the safety of the intersection. BACKGROUND: On September 8, 2003, Council awarded the tender for construction of the Casino Roads Contract (Fallsview, Murray, Dunn, Dixon, Portage). At the time of tendering, Council also authorized staff to negotiate with Rankin Construction for the replacement of the bridge over the rail line on Portage Road. In addition, because of the timelines involved, many of the other design questions were not answered prior to tendering. This has required the City to designlbuild many aspects of the project. UPDATE: Schedule - at present there is still a slim possibility of meeting the April 23, 2004-schedule. However, at this point a finn date cannot be given as there are still unknowns. . Portage Road Bridge - to minimize costs, instead of completely reconstructing the Portage Road Bridge a box culvert is being placed within the structure and the old top removed. This allows for construction through the winter and minimize cost. The entire structure will cost approximately $900,000. Fallsview Boulevard Watennain - during construction it became apparent that the watennain on Fallsview Boulevard (from Dixon Street to Main Street) had to be replaced due to its condition. Utility Relocations - Under agreement with various utilities, all necessary, utility relocations were done as part of this contract. This included Bell, Niagara Falls Hydro, Enbridge Gas, Ontario Power Generation and cable. Some of these costs are the responsibility of the utilities. However, the majority is the responsibility ofthe City ( some ofthe City costs are to be recovered from OLGC) . Murray Street Retaining Wall - At the time of tendering the design of the Murray Street retaining wall was not complete. This was due to ongoing changes from the property owners on both sides of the street. The wall design was finalized in January of this year. The quantities required far exceed the amounts in the contract. . Cost - the City has paid a large premium to try to get this work done on time. The contract costs reflect this premium, especially for work that was unknown at the time of tendering. Staff is projecting that the total cost will be approximately $11,000,000 including all engineering and utility relocations. Of that total the City will be recovering approximately $7,500,0000 from various sources (OLGC, Development Charges, Utilities, NPC) . Bonus Clause - the original contract had a bonus clause for up to $100,000 for early completion. The contractor has sent a letter requesting that the City consider paying the bonus at completion. Their argument is that $3,000,000 worth of work has been added to the contract, and it should still be finished on time. Staff will review their request as we get closer to completion and report back to Committee with a recommendation. BACKGROUND: As Committee was made aware during the Environmental Assessment for the Casino Roads, there are still sections where the City has insufficient road right of way to construct the streetscaping component. In most cases we have received permission from the landowners and have proceeded. Helias Enterprises Ltd. owns a section of property fronting on the east side of Falls view Boulevard between Dixon Street and Main Street. Prior to their permission to construct the sidewalk they have asked for certain preconditions ( see letter attached ). Prior to addressing the conditions as set out in the letter, Staff would like to clarify three points: . the property is not required to construct the vehicular portion of the road; . if the owner were to proceed with developing the site, the City has the right to take the required road widening under the Planning Act; and . although desired, the sidewalk is not critical to the pedestrian network at this time. Building & By-Law Services February 23, 2004 MW-2004-31 -2- COMMENT ON CONDITIONS: Staffwill address each of the conditions requested by Helias Enterprises Ltd. 1. In order for the existing sign ( My Cousin Vinney's sign) to remain in the current spot it would have to encroach into the sidewalk by approximately 0.6 m. However, Staff feels that this would be a temporary situation. In time once the site is developed, and the City takes the property free and clear, the sign would then be moved. 2. Helias has asked for a parking lot permit to be immediately issued for the site with 100% lot coverage and no required landscape component. Staff has concerns with this request. Ifthe City permits a parking lot to be constructed without site plan approval, they will be circumventing a public process. This process not only addresses planning issues, such as setbacks, lot coverage, landscape component, but also engineering issues, safe layout, access, drainage, and lighting. Staff does not support this condition. In addition, the placement of parking lots does not conform to the recommended People Mover Parking Strategy. 3. If the work is completed, the property will have to be regraded. This is a normal condition which we are doing as part of the construction. There is a minimal cost to this. 4. The moving ofthe existing driveways on Main Street and Dunn Street can be completed with minimal cost. 5. Helias does not want the streetscaping to be put along their frontage, only the sidewalk. Staff feels that this is unreasonable. The reason for getting the use of the property now, is to construct the streetscaping which includes the sidewalk. Ifwe grant all of He lias conditions there will be a section ofthe street without any streetscaping, including trees, right next to a parking lot with 100% lot coverage and no landscaping. Further, there will be little difference in cost or disruption to construct the missing streetscaping or the missing streetscaping and sidewalk in the future. 6. The widening of the driveway can be accomplished with minimal cost. CONCLUSION: Although it would be desirable to build the sidewalk and streetscaping at this time, it is not critical. Further, the City cannot build as per the Streetscape Master Plan and Class Environmental Assessment. As such, Staff is recommending that Committee turn down the offer by Helias Enterprise Ltd. In response to a request from area residents, staff conducted a parking review on McLeod Road between Beechwood Road and Thorold Townline Road. The intention of the investigation is to resolve parking concerns that stem from trucks idling for long periods of time during the early morning hours on McLeod Road. McLeod Road is an arterial roadway that extends in an east/west direction from Portage Road to Thorold Townline Road. In the study area, the roadway is 7.0 metres in width and consists of a gravel shoulder on both sides. The study area consists of several residential establishments with Diamond Peat Moss and Dans Produce L. T.D businesses located in the area. Parking, stopping and standing restrictions are not present on McLeod Road. The area to the north of McLeod Road right- of-way is zoned as agricultural, while the area to the south is zoned as light industrial. In an attempt to rectify the aforementioned concerns, staff contacted the head office of Diamond Peat Moss and presented the concerns to a representative. Staff was informed that trucks were left idling on McLeod Road due to unusual circumstances. Furthermore, staff was assured that corrective measures will be taken to alleviate this situation. These measures include: more trucks will exit than enter the facility to clear the stockpile of product; staff at Diamond Peat Moss will be instructed to wave all trucks into the yard if they were parked on the road; truck drivers will be instructed not to arrive at the facility prior to the hours of operation; and, Working Together to Serve Our Community Municipal Works. In addition, the residents have recourse by contacting the police to take care of an unsafe situation of a truck being parked blocking a traffic lane. Numerous subsequent observations conducted by staff reveal that trucks were not observed idling on McLeod Road during the early morning hours. Therefore, there is evidence to suggest that the corrective measures taken by the head office of Diamond Peat Moss have alleviated the parking situation. A review ofthe collision files reveals that collisions involving parked vehicles were not reported on McLeod Road between Beechwood Road and Thorold Townline Road during the previous three-year period. Sight investigations reveal that the available stopping sight distance on McLeod Road is in accordance with a standard outlined in the Geometric Design Guide for Canadian Roads. Therefore, it is recommended that no changes be made to the existing parking on McLeod Road between Beechwood Road and Thorold Townline Road. BACKGROUND: Ground Aerial Maintenance Services Ltd. has been providing street lighting services for the City of Niagara Falls for the past 14 years. The last tender, 2001-01 by GAMS, was more than 50% lower than the second bidder and the work performed by GAMS to date, has been acceptable. Due to staffing issues in the Engineering Department, the 2004 tender could not be prepared prior to the expiry date ofthe existing contract. Staffhas met with GAMS to discuss a possibility of a contract extension and GAMS have responded with the request to extend the contract for a minimum of one year. They are prepared to hold their prices to the 2003 rates with the adjusted average annual percent increase ofthe Consumer Price Index for Ontario as prepared by Statistic Canada for January 1, 2004. This rate increase is calculated in March of 2004.
