WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if
the subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act,
2001.
WHEREAS on December 8th, 2020, Niagara Falls City Council will be holding a Closed
Meeting as permitted under s. 239 (2) (c), and (d) of the Municipal Act:
(2) A meeting or part of a meeting may be closed to the public if the subject matter
being considered is;
(b) personal matters about an identifiable individual;
(c) a proposed or pending acquisition or disposition of land by the
municipality or local board;
(d) labour relations or employee negotiations;
(e) litigation or potential litigation ...;
(f) advice that is subject to solicitor-client privilege, including
communications necessary for that purpose;
THEREFORE BE IT RESOLVED that on December 8th, 2020 Niagara Falls City Council
will go into a closed meeting prior to their scheduled Meeting of Council that is scheduled
at 3:00 p.m., to consider matters that fall under section 239 (2) (b)that are personal matters
about an identifiable individual, as well as to consider matters that fall under section 239
(2) (c) of the Municipal Act for a proposed or pending acquisition or disposition of land by
the municipality concerning the Chippawa Town Hall, the Military Museum and potential
Municipal Operations Centre relocation. Council will also consider matters under section
239 (2) (d) of the Municipal Act for matters dealing with labour relations involving a
bargaining update as well as section 239 (2) (e), litigation or potential litigation on an
Interim Control By-law Appeal. Lastly, Council will consider a matter that falls under
section 239 (2) (f) for advice that is subject to solicitor-client privilege regarding Steel Rail
Development.
