I) A two hour "paid parking" zone be implemented on the west side of Main Street from a
point 35 metres south of Allendale Avenue to a point 130 metres south of Allendale
Avenue;
2) A two hour "paid parking" zone be implemented on the east side of Main Street from a
point 95 metres north of Stanley Avenue to a point 112 metres north of Stanley Avenue;
3) A two hour "paid parking" zone be implemented on the east side of Main Street from a
point 122 metres north of Stanley Avenue to a point 134 metres north of Stanley Avenue;

4) A two hour "paid parking" zone be implemented on the east side of Main Street from a
point 141 metres north of Stanley Avenue to a point 170 metres north of Stanley Avenue;

point 30 metres west of Sinnicks Avenue.

d) MW-2004-66 - Corwin Avenue Parking Review
IT WAS MOVED BY ALDERMAN CAMPBELL and seconded by Alderman Kerrio that;
I) Parking restrictions with a setback of 10 metres on the eastside and 20 metres on the
westside of Corwin Avenue at Lundy's Lane be implemented.

2) That parking be restricted in front of the residential homes on Corwin Avenue to "permit
only".
3) That staff investigate and report back to Council with recommendations on a heavy
vehicle restriction on Corwin Avenue.

Oversize / Overweight Load Permit
RECOMMENDATIONS:
It is recommended that:
1. Council adopt the Oversize / Overweight Load Permit, requiring all companies
to complete in order to obtain authorization to move excess loads on City right-
of-way; and,
2. the 'Schedule of Fees for Services' be updated to include a fee of $25.00 for a
single use Oversize / Overweight Load Permit, or $150.00 for an annual
Oversize / Overweight Load Permit.
BACKGROUND:
An Oversize / Overweight Load Permit is a permit for companies wanting to move loads that
exceed Ontario Highway Traffic Act accepted length, width, height or weight limits. Section 110
of the Highway Traffic Act authorizes municipalities to grant permits for the movement of excess
loads within their jurisdiction, upon application in writing, and may specify any conditions deemed
necessary by the Corporation to protect persons or property from injury or damage. At the
present time, companies that request to haul loads in excess of the legal limits are required to
submit written requests to staff. For the most part, requests are similar in nature, however, are
cumbersome considering the staff time required to review and respond to these requests. In most
cases, the applicant does not provide enough information to properly process a request resulting
in several phone calls to obtain additional information or clarification.
Staff is recommending that Council adopt the enclosed Oversize / Overweight Load Permit, which
will provide a standardized form for such requests. It would expedite load requests in a more
efficient manner. General conditions stated on the reverse side of the permit application, such as
insurance requirements, use of private or police escorts, etc. provides the applicant thorough

knowledge of what is expected with their approved permit. Approval of the permit requires the
applicant to conform to all applicable traffic laws, general conditions stipulated on the reverse side
of the permit, and any special conditions as deemed necessary by staff to ensure public safety and
to protect City assets.
Currently, oversize and overweight requests are reviewed and approved free of charge. A review
of practices in and around the Golden Horseshoe where oversize permits are issued reveals the
following:

The Ministry of Transportation provides single use permit at fees ranging from $50.00 to
$500.00, depending on the scale of the excess load. Annual permits are $300.00. Many of the
smaller municipalities in the area co-ordinate their oversize and overweight Load Permit requests
through the Regional body.
Therefore, staff is suggesting a fee of $25.00 for a single use permit, or $150.00 for an annual
permit to cover the service provided. The annual permit is for companies that carry out several
similar oversize moves during the year without them requiring to apply for each move, or to allow
transport ofloads in excess of the weights permitted throughout the year.
Council's concurrence with the recommendations outlined in this report would be appreciated.

Chippawa Parkway
Parldng Large Motor Vehicle - Proposed Restrictions
RECOMMENDATION:
This report be received for the information of Council.
BACKGROUND:
In December 2003, Council approved the following recommendation from the Chippawa Parkway
Parking Review:
"That parking restrictions not be implemented and that the offending vehicle owner be notified in
advance that it will be towed if in violation."
City records indicate that as far back as April 1999, a transport truck has parked repeatedly on
Chippawa Parkway. Staff has always responded promptly, and the vehicle has been ticketed
repeatedly.
The vehicle in question when parked on the south side of Chippawa Parkway has created a site
obstruction to motorists exiting private driveways.
Staff has researched this request and under the Highway Traffic Act, a Municipal Enforcement
Officer, or Police Officer when finding a vehicle that is stopped off the roadway in a manner to
obstruct the sight of oncoming traffic at a distance of at lease 125 metres, may move, or require the
driver or operator ofthe vehicle to move it.

In order to fulfill Council's direction to tow the vehicle, staff, upon receipt of a complaint, or when
observed, must ensure that Municipal Law Enforcement Officers or Police attend immediately to the
sight, take the appropriate measurements, document same, then request the owner to remove the
vehicle. However, it may not be possible for Police to attend due to more urgent priorities. If the
owner is not available, the vehicle at this time may be towed. Parking Control Officers unfortunately
are not authorized to tow vehicles under the Highway Traffic Act
Vehicles when towed, fàll under the Repair & Storage Liens Acts, and all costs incurred in the
removal of the vehicle are charged back to the owner. Our current towing company when solicited
regarding this matter, indicates that they have the equipment available to tow this size of vehicle,
including the trailer.
Parking Control staffhas monitored this area since Council's direction and is pleased to report that
we have not observed this vehicle parked in this area since that time. In addition, no further
complaints have been received regarding this matter.

RECOMMENDATION:
That Council authorize staff to proceed with the City of Niagara Falls Outdoor Water
Conservation and Healthy Lawn Seminar at a total cost of$ 7,125.
BACKGROUND:
City Engineering and Community Services have been in discussions with Niagara Parks and the
Master Gardeners of Niagara over the past six months in hope of hosting a joint event that would
promote the effective of water for the gardening season. Participation in this event is part of an
overall water conservation education plan and strategy presented to Council in report MW-2003-1 12.
The introduction of water metering in the City of Niagara Falls indirectly produced an unexpected
by product in the form of a number of dying or dead residential lawns and gardens due to ineffective
or ill-advised watering techniques. Effective education as to the proper use of water and lawn
products and the true cost of watering would address this issue.
Lawn watering accounts for approximately 50% of the water used outside the home on an annual
basis and as a result is a worthwhile area to target for both homeowner education and conservation
strategies. The Master Gardeners of Niagara in conjunction with Niagara Parks will be holding the
Niagara Flower and Garden Show from June II th to 13" this year at the Niagara Parks School of
Horticulture and Botanical Gardens.
City staff believes that the event fits well in terms of venue, visibility and content with the goal to
bring an effective lawn care seminar to Niagara Falls residents at no direct cost.

The highlights of the proposed two day seminar are as follows:
. Three guest speakers, including Ed Lawrence the head horticulturist at the Gardens
of Rideau Hall in Ottawa and host of the CBC radio garden call in, who will attend
on both days to discuss in an open forum, the following subjects:
. Effective lawn watering and measurement.
. The use and misuse of commercially available fertilizers and
herbicides.
. Drought resistant garden and lawn planning.
. Correct cut height for the residential lawn.
. Mulch versus mow techniques for a residential lawn.
. Open question and answer forum on lawn care topics.
. The distribution of250 free lawn watering gauges to the first 250 attendees on both
days.

This draw will be open to Niagara Falls residents only.
The proposed budget breakdown for this event is as follows:
Advertising support of the Master Gardeners of Niagara $ 2,000
Niagara Flower and Garden Show

promotion ofthe Healthy Lawn seminar
Sound system rental $ 500
Speaker fees for three speakers for two appearances over $ 1,500
two days

Total $ 7.125
In staff s opinion, this event will have a more direct and tangible effect on residential outdoor water
use than conventional methods such as direct mail or advertising. The event also shows the City of
Niagara Falls to be proactive in terms of environmental conservation and stewardship.
This project will be funded from the Utility and Operations Budget already approved by council, line
item "Water Conservation" account #15-3-431000-03-0000.

Re: R-2004-24. Plaque to Commemorate the CIty's Centennial
RECOMMENDATION:
That Council approve the use of the City Crest, wording and installation of a bronze plaque to
commemorate the City's Centennial, and that Council members' names be added to
the plaque.
BACKGROUND:
Shennan Zavitz, City Historian, with the support of Staff is requesting that a plaque commemorating
our Centennial be installed and an unveiling ceremony take place later this Spring. The wording on
the plaque was prepared by Mr. Zavitz (see attached). The plaque will be affixed to the exterior of
City Hall near the ftont entrance. The cost for the bronze plaque is $829.40 including all taxes and
is allocated in the 2004 Operating Budget.

THE CITY OF NIAGARA FALLS CAME INTO BEING ON JANUARY 1, 1904
FOLLOWING AMALGAMATION OF THE TOWN OF NIAGARA FALLS AND THE
ADJACENT VILLAGE OF NIAGARA FALLS.
THE GRAND TRUNK RAILWAY (NOW CANADIAN NATIONAL) WAS THE CHIEF
EMPLOYER IN THE NEW CITY, WHICH HAD A POPULATION OF 7,000. WITHIN THE
NEXT TWO YEARS THREE LARGE HYDROELECTRIC GENERATING STATIONS BEGAN
OPERATING IN THE AREA AROUND THE HORSHOE FALLS. THESE PLANTS,
ALONG WITH THE MANY MANUFACTURING INDUSTRIES THAT WERE
SUBSEQUENTLY ATTRACTED HERE DUE TO THE AVAILABILITY OF PLENTIFUL AND
INEXPENSIVE ELECTRICITY, ENSURED THE CITY'S GROWTH.
TOURISM HAS ALSO PLAYED AN INCREASINGLY IMPORTANT ROLE IN THE
COMMUNITY'S ECONOMY. IN 1963, STAMFORD TOWNSHIP BECAME PART OF
NIAGARA FALLS, AS DID THE VILLAGE OF CHIPPAWA, WILLOUGHBY TOWNSHIP
AND A PORTION OF CROWLAND TOWNSHIP FOLLOWING THE CREATION OF

RECOMMENDATION:
1. That Staff continue to use an after hours mobile private security provider in our parks and
cemeteries systems.
2. That a meeting with representatives of Niagara Regional Police be chaired by the Mayor and
include other interested members of both City and Regional Council. and that CPTED
audits be conduted at key parks.
BACKGROUND:
The issue of vandalism and behaviour related problems in City Parks and Cemeteries is not new.
What is new, is the number of incidents and the degree of damage that is being done. Also, we have
witnessed a significant increase in drug and alcohol related problems.
During the past three summer seasons, staff has responded to an ever incre~ing number of
complaints concerning damaged equipment, graffiti, illegal dumping, noise and intimidation, Our
maintenance staff also has discovered an increased number of empty alcohol containers and
alanningly used hypodennic syringes.
It was with growing ftustration that staff advised Council of its intention to retain a security ftrm to
monitor four (4) to five (5) of our most problematic parks. This pilot proj ect was undertaken during
the summer months from 8:00 p.m. to 4:00 a.m. Council was also advised that the program would
be evaluated at the end of the year and that if it proved successful, that increased funding would be
provided in the 2004 operating budget.

The specific parks that were patrolled on an ongoing basis were: Maple Street, A. J. McKinley, F.
H. Leslie, E. E. Mitchelson, Prince Charles, Chippawa Lions and George Bukator.
Cantec Security was the firm selected to patrol our parks. Their staff was required to complete a .
patrol log book which was reviewed periodically by City staff to gauge the true scope of the
problem. What we found were a large number of young people in City parks at all hours of the night,
in spite of an 11 :00 p.m. curfew. They were consuming alcohol, using drugs, swimming in our
outdoor pools, creating noise and littering. The security officers' presence caused them to disperse.
In some cases, this alleviated the problem. In other cases, the effects were short term as the youth
returned in relatively short order.
Overall, the increased security of our parks proved to be beneficial and because ofthe publicity this
program received, members of the community asked that their parks also be included in the
surveillance program. For the most part, due to a limited budget, the patrols were limited to the
parks previously mentioned. However, in some extenuating circumstances, a patrol was diverted
to another park on a short term basis. Staff can see the benefit of expanding this service, however,
our limited budget will only allow us to maintain the status quo for the coming season. A security
company will again be retained to continue to monitor four (4) to five (5) of our most problematic
parks.
Staff is also recommending that a meeting be held with representatives of Niagara Regional Police
to fully discuss the problems that are occurring in our parks, as a result of inappropriate and illegal
behaviour. Staff is also suggesting that the Mayor chair this meeting and that other members of both
City and Regional Council be invited to attend. In particular, we should include Councilor Bill
Smeaton who is our representative on the Police Services Board. From this meeting, a definite plan
of action would be derived.

RECOMMENDATION:
That Council support the planting of boulevard trees within the Greenways Subdivision with the
exception of Lots 26 and 27.
BACKGROUND:
At the March 24, 2004 meeting of the Environmental Planning & Greening Committee, a report was
presented by Municipal Works which recommended the planting of boulevard trees as part of the
Greenways Subdivision. A survey had been conducted as a result of some residents not wanting a
boulevard tree. A couple of residents who reside in the subdivision attended this meeting and
expressed their concerns. Staff later met with Mr. Steve Kirilovic, who represented many of the
residents who did not want a tree and learned that many residents were not necessarily opposed to
a boulevard tree, but rather wanted input on the type of tree to be planted. Mr. Kirilovic
recommended a Glenleaven Linden which is on the City's list of acceptable boulevard trees.
Upon inspection of the subdivision, it was also determined that two (2) lots located at a comer ofthe
street bulb lack sufficient ITontage for a boulevard tree. It was recommended that these two (2) lots
(Lot 26 and 27) not receive a boulevard tree. This information was shared with the Environmental
Planning & Greening Committee at their April 21 st meeting and they supported the boulevard tree
planting except for Lots 26 and 27. With the endorsement of Council, it is hopeful that the boulevard

trees can be planted this spring. There is sufficient monies as part of the subdivision agreement to
