After a lengthy discussion, hearing from the Niagara Falls Taxi owners, drivers, surrounding hotel owners and the Fallsview BIA. The following motion was made; IT WAS MOVED BY ALDERMAN KERRIO and seconded by Mayor Salci that report MW- 2004-81 be deferred to the Community Services Committee meeting of May 31, 2004. Motion: Carded Action: Recommendation submitted to Council 2004-05-17 c) Spicolli's Pizzeria & Caf~ - Liquor Licenee Application · Mr. Carmen Garofalo advised Committee that his establishment will open as a restaurant serving Italian style foods and ice cream. Mr. Garofalo held an open house for the surrounding residents and Alderman to attend to allow the residents to view the changes made. Mr. Garofalo noted the last tenant made life hard on the residents and his family. Spicolli's Pizzeria & Caf6 will be mn by Robyn Coens (Mr. Garofalo's niece) and will not be a bar. The liquor licence is to allow the patrons the chose of beverage this wish to have with their meal. · Mr. Frank Herman of 6312 Murray Street spoke on behalf the surrounding residents. Mr. Herman was very adamant that residents were not going to stand for another bar establishment to open in this location. During the last eight years with different tenants occupying the building the residents have endured loud music, crime, beer bottles on their lawns, cars parked over sidewalks, boulevards to all hours of the early morning. Mr. Herman's main concern was allowing the restaurant a liquor licence would again attract undesirable clientele. · Many residents spoke in turn reiterating Mr. Herman's statement with their own experiences. Mayor Salci advised Committee and the residents that to object to the liquor licence does not mean the AGCO would not grant it. The residents would be taking a gamble. In order to ensure no matter what business occupies the premises the Mayor advised the residents to impose restriction on the licence. If for some reason Mr. Garofalo's business does ~not succeed and the building is rented to another tenant, the liquor licence stays with the premises not the occupant. After a lengthy discussion the following motion was made; -3- IT WAS MOVED BY ALDERMAN VOLPATT and seconded by Alderman Morocco that staff meet with owner/operator of Spicolli's Caf6 and residents to discuss a compromise for the liquor licence application. BACKGROUND: Council, at it's May 17, 2004 meeting, deferred the recommendation outlined in Report No. MW- 2004-81(attached), to remove all taxi stands along Fallsview Boulevard, to the May 31, 2004 meeting. This deferral would allow the taxi companies time to speak with hotel/business owners about making arrangements to park on their properties. Since then, Staffhave received correspondence from the Sheraton Fallsview (attachment) indicating that they would like the taxi stand located in front of their establishment to remain. In addition, 5-0 taxi contacted Staff, stating that they would like to see the taxi stands along Fallsview Boulevard remain in place and be expanded. Further, staffhave contacted the Fallsview Grand Casino Casino & Resort and they have indicated that they will accommodate 2 taxi spaces per company on site. With the expected traffic volume increases to be realized when the Fallsview Casino opens on June 8, the continued placement of several of the existing taxi stands will impede the flow of traffic. Therefore, it is recommended that the stands located on the west side of Fallsview Boulevard between Murray Street and Robinson Street and on the east side of Fallsview Boulevard between Main Street and Murray Street be removed from a traffic safety/flow perspective. In addition, the new traffic signal installation at Dunn Street and Fallsview Boulevard has forced the elimination of the Bus Loading/Unloading Zone in front of the Minolta Tower. Therefore, this bus loading/unloading zone will be relocated to the taxi stand area in front of the Marriott Hotel, thereby causing the elimination of the taxi stands located there. Please be advised that the Board is requesting to have taxi stands removed from the streets of the Fallsview area. Several Board members had several concerns. In the experience of some Board members which have taxi stands near their properties noticed they have served as a waiting area until a call is received for service at another location rather than a pick up point. The exhaust from idling taxis is unpleasant. The stands can hinder the entranceways of various properties, They have requested the transportation companies contact the individual hotel owners and negotiate a designated ama on said property. This program has allowed the Kiwanis Group to place benches at various bus stops throughout the City on municipal and Regional road allowances. These benches are placed in approved locations and provide advertising revenue to the Kiwanis Group. The City has assisted in the past by way of waiving fees to place the benches, and by also providing up to $10,000.00 per year in poured concrete pads for those benches requiring bases. The Kiwanis Group provided 10 free advertising benches to the City to help offset these costs. Staff has indicated that there is no need to advertise on the benches, however, it is suggested that the City still waive the fees for processing and technical commenting on the placement of the benches. In May 2002, staff met with representatives of the Kiwanis Bus Bench Program to discuss the renewal of their agreement with the City and the Region. In September of that same year, Council adopted the recommendation in a report to enter into an agreement with Kiwanis and the Region. In November 2002, following this report, the Kiwanis Group verbally indicated to staff that they wished to re-negotiate the proposed agreement to reflect additional changes the Group wished to have implemented, as follows; extend the agreement longer than the five-year renewal period, permit the group to have their name and phone number placed on the back of the seat rests. Staff advised the Kiwanis Group to forward their request so that staff could re-submit the report to Council to receive direction on these items, and subsequently, if approved, re-write the agreement. Prior to the receipt of this request from Kiwanis however, correspondence was received by staff from the Regional Municipality of Niagara, noting that; "The Region is not prepared to enter into any agreements at this time relative to revenue generators and opportunities within Regional road allowances. "(See attached correspondence). The Region, has since forwarded correspondence to the City (attached) indicating that they are now willing to enter into a th-party agreement with Kiwanis and the City, for a five-year period. No new bench locations have been approved since this time, however, the Kiwanis Group is anxious to have new benches installed. The Region of Niagara, prior to their April 7, 2004 correspondence, was willing to have this group place benches on their road allowance on an ad-hoc basis by way of a Road Occupancy Permit. They have since approved a report to once again formally enter into an agreement with the Kiwanis Group. Planning staff has indicated that the Sign By-Law Review Study examined the current state of signs in the city, including bench signs. The study found that benches, with their entire backs devoted to advertising space, are of a design that does not improve upon the aesthetics of the street. They further note that benches should be designed in accordance with the Streetscape Master Plan. (See attached examples of recently submitted request for Kiwanis Bus Bench backs as compared to examples submitted for the Fallsview District according to the Streetscape Master Plan). Although there may be some merit in the Region dealing directly with bench companies or advertisers the amount of money generated is small in comparison to the administration and inspection costs. Staff will be recommending that the Kiwanis Club of Stamford be given permission to place benches with advertising on Regional Roads in Niagara Falls in the form of a tri-party agreement with the City of Niagara Fails, the Region and the Kiwanis Club of Stamford. BACKGROUND: On March 18, 2002, Corporate Service Committee approved Report MW-2002-12 which recommended that the parking metres located on the northwest side of Victoria Avenue between Walnut Street and Centre Street be removed and that the sidewalk on the northwest side be widened to create enough space for the establishment of sidewalk cafes. Construction occurred in the Spring of 2002 and the associated costs were paid for by the Victoria/Centre BIA. The Victoria/Centre BIA has made a request to do another sidewalk expansion on Victoria Avenue in order to accommodate Hard Times Restaurant and Subway in installing sidewalk cafes (attached BIA letter). Two (2) of the parking spaces will need to be removed and the third parking space, which is located in front of the Sauer's Drug Store, will be changed from a two-hour metered parking space to a 15 minute metered parking space for prescription pickups. Minimal impacts to surrounding BIA's will be realized by the removal of the two meters, because these are short to medium-term (2-hour) parking meters, meant to service the adjacent businesses only. There are no concerns from the Traffic/Parking Services Section with respect to the removal of the two parking meters. There is adequate and ample parking in the immediate area to offset the loss of these parking spaces. The proposed construction works wilI include the removal of the existing curb and gutter, sidewalks, a catch basin, parking meters, and decorative paving stones. The installation will include new curb and gutter, sidewalks, catch basin and drainage facilities, decorative paving stones, and asphalt restoration. The estimated cost of these works is $15,000.00. Since the present conditions of the sidewalks, curb and gutter, etc., are good and the City has no plans for improvements in this area in the near future, these works will be considered "Out of Phase" and 100% of the cost will be borne by the Victoria/Centre BIA. Since this work will occur in the tourist area of the City, construction should occur in the Fall of 2004. BACKGROUND: In order to meet the levels of service for winter maintenance activities the City rents an additional loader to augment the existing equipment. The equipment supplier, Toromont of St. Catharines, became aware that the existing City loader was scheduled for replacement in 2004. As a result the equipment supplier provided a buy out option for the rented piece of equipment. The buyer option credited the $22,800.00 in lease payments made toward the purchase of the loader. In addition the City was over by 300 hours over the allotted time for the rental and as such would have to pay an additional $12,000.00 over and above the rental rate for the additional usage. The cost of the loader without the rental credit is $176,000.00 plus tax. City staff has gathered information from other Municipalities with respect to recent loader purchases and find this price to be very competitive. Sufficient funds are available in the 2004 budget, Fleet Services transfer to Capital Budget, account number 11-3 -372010-080001 to cover this purchase. Accordingly, it is staff's recommendation that the City proceeds with the buy out of the rental loader. BACKGROUND: In reply to a request, staff has conducted a parking review on Vegter Court. The concern at this location stems from an abundance of parked vehicles on Vegter Court during the evening hours. Vegter Court is a recently constructed residential cul-de-sac extending from Kalar Road to a point seventy (70) metres west of Kalar Road. Currently, Vegter Court consists of four (4) residential establishments. An additional seven (7) lots are proposed for home construction. The intersection of Vegter Court and Kalar Road is in a "tee" configuration consisting of north/south and east approaches. The intersection is currently control by the basic fight-of-way rule. Parking questionnaires were delivered to all current residents on Vegter Court, in addition to the property developer. Through the questionnaire, residents had an opportunity to select the type of parking control that would most benefit their situation. The following comments were received along with the questionnaires: parking on Vegter Court should be available for residents and their guests, not for commercial traffic; · a high parking activity on Vegter Court causes noise, pollution and safety concerns in the area; and, · parked vehicles restrict sight lines to motorists entering/exiting Vegter Court The above mentioned comments reveal that, from the residents perspective, the existing parking situation on Vegter Court is not only inconvenient and is also unsafe. Therefore, based on the responses and comments received from the parking questionnaires staff is recommending that a "permit parking" zone be implemented on Vegter Court. Inspection Joint Public Private Partnership RECOMMENDATION: It is recommended that the City of Niagara Falls enter into an agreement with Pipeflo Contracting Incorporated for the provision of contract sewer t.v. inspection services for a total price not to exceed the budgeted amount for t.v. inspection services of $ 225,000. BACKGROUND: Staff have been researching the long term viability of the sanitary and combined sewer networks for the past year. Current capital funding levels for replacement of these networks are at a level that is not consistent with the serviceable life of the pipes that make up the networks. In order to prevent failures within these systems an accelerated and enhanced inspection program is required in order to extend the life expectancy of the component pipes well beyond their typical useable life span of one hundred years and to prevent service interruptions, basement flooding and overflows to the environment caused by pipe failure. Detailed condition surveys of the wastewater system allow for a more proactive and balanced approach to replacement and rehabilitation programs. The City of Niagara Falls currently owns an operates approximately 377 kilometers of sanitary and combined sewer with a total replacement value in todays dollars of approximately $ 250,000,000. The average age of pipes within the system is 43 years. City staff submitted a 2004 t.v. inspection budget amount that would allow for 20%, approximately 80 km, of the network to be inspected. The camera traverses the pipe on a transport system and videotapes the interior condition of the pipe while the camera operator records significant defects via a personal computer mounted on the inspection vehicle. An example of the type of image collected is shown in figure 1.0 below Fisum 1.0 City staff have employed basically the same type of contractor provided sewer evaluation technology for the past fifteen years. Difficulty arises from the conventional method of survey when a comparative analysis is required for prioritization of the defects found by the operator. The technologypreviously used involved a great deal of subjectivity on the part of the operator and how he or she classified the severity of defects within the pipe. Most of the data collected previously is not suitable for comparative analysis of the entire network. Engineering Services Staff contacted the Centre For The Advancement of Trenchless Technologies .at the University of Waterloo for an opinion on a suitable technology for the proposed five year t.v. ~nspection plan. A suitable technology was recommended by the Waterloo faculty. The said technology had been used extensively in Europe for several years with excellent results. City staff then approached Pipeflo incorporated in Stoney Creek to investigate the possibility of providing the new technology on a contract basis as no other contractor was currently using the Blackhawk inspection system. Negotiations were held at approximately five meetings with City, University of Waterloo and Pipeflo contracting representatives. A draft joint public private partnership was formulated for the provision of contract t.v. inspection services. The draft agreement provides for a cost recovery mechanism over five years for the City provided that it shares in the capital cost of acquiring the new sewer inspection technology. It also provides for lower than market fixed costs for the latter four years of the inspection contract. Staff have researched market costs for contracts in other Ontario municipalities. The proposed financing for year one of the contract is as follows. The City of Niagara Falls will contribute $ 75,000 toward the $150,000 capital cost of the acquisition of the Blackhawk inspection system in year one of the contract. The City will own 50% of the inspection system for the length of the contract. In return the City will be provided with a fixed rate of $2.50 per metre of sewer inspected for five years. Current market rates for conventional hydraulic cleaning and t.v. inspection of sewers are in the area of $2.50 to $4.20 per metre, a market survey of unit rates is attached. The cost saving for the enhanced sewer inspection technology over five years, including the City's capital contribution, is approximately $ 117,000 based on a market average per metre rate of $2.98. May 31, 2004 - 3 - MW-2004-89 In addition City staff have negotiated a cost recovery mechanism where in exchange for the $ 75,000 contribution to the capital cost of the equipment, the city will receive $ 0.35 per metre or 10% of the hourly rate where applicable when the camera is used in the provision of services for other municipalities. Based on average production rates and assuming 60% utilization of the shared equipment by Pipeflo, this rebate could amount to an annual revenue of approximately $16,000. The University of Waterloo staff are currently investigating the possibility of federal funding for the project as it is the first of its kind in Canada. This funding will be used to defer City of Niagara Falls costs and for the evaluation of the City of Niagara Falls sewer network as part of a research project. University staff and a collection of graduate students will interpret the information as it is collected and will formulate a remedial action plan for the wastewater networks in conjunction with City Staff. This project will provide City Engineering Staffwith the information that they require to introduce a pro active replacement and rehabilitation program in order to significantly extend the life of the City's wastewater networks and prevent sewer failure related problems. CATT is committed and excited to work with the City of Niagara Falls for the next five years on this project. Under the direction of Dr. Mark Knight, CATT Executive Director, and Associate Professor at the University of Waterloo, CATT will work with the City and its partners to obtain research grants that will provide funding to support graduates students and to offset some of the City project costs. CATT also agrees to provide to the City of Niagara Falls resources and technical expertise, at no cost, to ensure that the project is developed and per£ormed in the most effective manner. A functional storm and waste water system provide the building blocks upon which healthy, prosperous and safe communities are built. Failure to address the renewal of the aging infi'astmcture will result in significantly increased maintenance, operation, and rehabilitation costs. The proposed City of Niagara Falls project has the potential to place the City of Niagara Falls as a leader in development of a buried infrastructure asset management system. The use of Sewer Scanning Evaluation Technologies (SSET) to inspect the City of Niagara Falls non person entry sewer and storm networks is the first and a critical step in the development ora state-of-the-art asset management program. Given the considerable amount of effort by the Municipal Works section over the past several years, CATT recognizes that this project will provide the last and remaining piece of critical information required for a truly comprehensive asset management system. Sewer Scanner and Evaluation Technology is a relatively new and field tested innovative Japanese technology designed to non-destructively survey and inspect the interior condition of sewer pipelines. SSET uses optical scanning and gyroscopic technologies to produce a detailed digital image and provides an alternative to commonly practiced closed-circuit television (CCTV) inspection methods. Page 1 of 3 SSET provides the following information: · A digitized, forward-looking view · A full-circumference scanned image of the pipe for the total length · A color-coded computer printout of the defects · A written description of defects at each location along the pipe · Horizontal pipe deflections · Vertical pipe deflections · Statistical data One of the greatest advantages of the SSET is the full digital process from the data acquisition and integration of the data with GIS and asset management programs. SSET is reported to provide the following benefits: · The engineer will have more higher quality data to make critical rehabilitation decision. · Defects can be magnified to provide a closer look. · Better documentation of the condition of the pipe is provided. · Horizontal and vertical pipe deflections are measured and illustrated graphically. · Field work is expedited because the technician is not required to assess the defects. · The defects can be color coded for better illustration and analysis. · Statistical data can be generated on the defects. · All of the information is available in addition to the frontal view. SSET has been used in Europe and the United States. This project will be the first in Canada that uses SSET. CATT will work with the City to evaluate the effectiveness of SSET evaluating it performance against CCTV inspections. CATT will work with the North American Association of Pipeline Inspector and other international experts to develop and complete this project. Results from the study will be presented to the City of Niagara Falls and at International and National conferences. Technical papers will also be published. CATT has identified the development of Asset Management Systems for buffed Infrastructure as a pffor/ty research area. In June 1004 CATT will be hosting the 6th International Trenchless Technology research Colloquium at the University of Waterloo. The colloquium involves a small group of invited national and international experts from industry, academia and public sector organizations. The purpose of the colloquium is to promote and accelerate Canadian and International research. Discussions will identify international and national research needs concerning buffed infrastructure asset management. Colloquium participants will be from across U.S.A, Canada, Germany, France, Netherlands, and the United Kingdom. CATT is committed to working with the City of Niagara Falls to ensure that the asset management system developed is state-of-the-art in North America and Europe.
