IT WAS MOVED BY Mayor Thomson, seconded by Alderman Selina Volpatti that
Staff be authorized to pay Niagara-on-the-Lake the invoiced amount of $31,196.55
for maintenance work completed on the above referenced drain and also be
authorized to mail out invoices to all assessed City of Niagara Falls landowners
for payment as set out in the Assessment Schedule prepared by Niagara-on-the-
Lake Drainage Consultant, Wiebe Engineering Group Inc., which represents the
final as-constructed costs.

Alderman Paisley Janvary-Pool advised the Committee that part of the Streetscaping
Plan from EP & G is the beautification of Niagara Falls and signage is one of the major
issues on which they are deliberating. Alderman Janvary-Pool also cautioned the
Committee this report may come back to them. Alderman Selina Volpatti expressed the
concern that companies cannot wait for our beautification policy to be put into effect.

e) R-2000-44 - Contribution to Creative Playground Structure
Mayor Thomson advised the Committee that he had met several times with Mr. McGee
from the St. Catharines Saturn Dealership who explained Saturn's programme of
participating with local school boards and municipalities. It would appear a contribution
from them toward a creative playground structure at the joint school of Kate S. Durdan
and Loretto Catholic School on Kalar Road would satisfy many criteria by providing a

necessary playground structure for two school boards and the neighbourhood children.

City of Niagara Falls contribute $10,000 to the new joint school (Kate S. Durdan
and Loretto Catholic) creative playground structure located on Kalar Road and
that an agreement be entered into with both the District School Board of Niagara
and the Niagara Catholic District School Board to ensure public access and
outline maintenance responsibilities.

the City assume responsibility for converting the four Brock University baseball
diamonds infields from grass to stone dust at a cost of $40,000 and further that
the City enter into a legal agreement with Brock University to ensure that the
diamonds areavailable for both the Nationals and the Provincial SIo-Pitch
Tournaments.

i) RI-2000-49 Site Selection Process and Criteria for Community Centre
Adele Kon reported that the Steering Committee had identified three potential sites for
the Community Centre and that there are other proponents who wish to make
presentations to the Committee. It is the intention of the Steering Committee to receive
these presentations first and then report back to Council at its' August meeting or
possibly the September meeting with regard to a recommendation based on the
Committee's criteria.
Alderman Volpatti questioned whether Council would receive just the recommendations
of the committee without the supporting presentation and what would happen should an
eliminated proponent wish to appeal the selection Committee's recommendation.
Adele advised the Committee that the actual report of the recommended proponent
would be provided to Council for their information and that unsuccessful presenters had
the option of appealing to Council for an opportunity to make another presentation.
Alderman Volpatti asked for and received the assurance of staff that Council would be
the final authority in the selection process.

m. R-2000-53 Millennium Trail Licence Agreement
Alderman Volpatti asked the Committee if the City should have any concerns regarding
an agreement with the Niagara Power Generation Company. Alderman Janvary-Pool
assured the Committee that there is a good relationship between the two parties and
we have been assured by the local director for Niagara Power, Mr. Bob Osborne, that
they will go forward with this agreement.

that the Mayor and Clerk be authorized to sign the License Agreement for use of
the Niagara Power Canal lands (Phase 1) upon receipt of the Agreement and the

Alderman Janvary-Pool recommended that this information be circulated to the general

Alderman Puttick circulated photographs of an empty swimming pool, overgrown
with weeds. The matter of this complaint had been brought to Alderman
Puttick's attention by the owner of the property next to the property with the pool.
Because it was found that the government policies covering weeds did not apply,
to this matter, Alderman Puttick brought it to the Committee's attention.

investigate and return with a suggested resolution to the matter of weeds
growing out of a swimming pool on Pettit Avenue.

Update Report on Traffic Issues
RECOMMENDATION:
It is recommended that this report be received for the information of the Committee.
BACKGROUND:
In 1996, an all-way stop control was installed at the request of area residents to alleviate a
speeding problem on O'Neil Street in the vicinity of Marlborough Place. Subsequently, a
petition was received for the removal of the stop signs on O'Neil Street in 1999. Prior to the
removal of the stop signs, the Community Services Committee requested the Traffic and Parking
Services Section to undertake a neighbourhood traffic study on O'Neil Street. The following is a
status of the neighbourhood traffic study.
Wor& Completed to Date:
Three radar studies were carried out with the radar board. Results of the
studies indicate that a speeding problem exists on O'Neil Street.
License plate numbers for motorists exceeding the speed limit by 12 km/h or
more were recorded and forwarded to the Niagara Regional Police. The Niagara
Regional Police have sent out a warning letter to the registered owner of the
vehicle.
24-hour traffic volume data has been collected from automatic traffic recorders
for a two-week period on O'Neil Street and Marlborough Place.
A collision review was undertaken for O'Neil Street. There have been 13
collisions on O'Neil Street in the previous three years. Nine collisions occurred
near A.N. Myer Secondary School and three collisions have occurred at the all-
way stop control.
An inventory of existing property usages have been identified. There is a total
of 84 residences (including 23 apartment units) fronting O'Neil Street. Several
commercial/institutional buildings front O'Neil Street near Portage Road. An

inventory of surrounding property usages is included in the attached study area
drawing.
Recent traffic data collected has been compared to previous studies carried out
on O'Neil Street.
Questionnaires, letters and diagrams for a public workshop are in the process of
being prepared.
Next Phase of Study:
A public workshop will be setup to take place, preferably at A.N. Myer
Secondary School in the fail. Area residents will have the opportunity to
provide input regarding traffic issues on O'Neil Street that they are concerned
about.
A second workshop will be held approximately one month later to discuss the
results of the first meeting and to give residents the oppommity to vote on
preferred solutions.
A report to the Municipal Parking and Traffic Committee and the Community
Services Committee will be prepared following the second meeting
recommending preferred solutions with detailed drawings.
The Committee' s concurrence with the recommendation outlined in this report would be
appreciated.

RECOMMENDATION:
That Committee consider the additional information gathered concerning the request for removal of
a large maple tree in front of the residence at 6302 Taylor Street.
BACKGROUND:
As Committee will recall, staff was directed at a previous meeting to carry out an inspection of the
residence at 6302 Taylor Street to determine the extent of damage being caused by an existing tree.
A Building Inspector had carded out a superficial inspection of the property and prepared a memo,
of which a copy is attached.
Based upon the memo, there is no evidence that the tree in question is causing any structural damage
to the basement or foundation of the residence. The recent repair of the nearby sidewalk has been
the result of age of the sidewalk and is similar to what is found in many areas throughout the City.
Since the tree is healthy and in a safe condition, it is difficult to support the removal of the tree.
It is recognized that the tree in question is quite large and the residence at 6302 Taylor Street is
relatively small. Therefore, the tree appears to be out of character for the area. This is an older
section of the City and there no longer exists any trees of similar size in the vicinity of the property.
Trees that have been removed in the past have been the result of dying or diseased trees.

Mr. Radonie remains adamant that the large tree is causing damage to the foundation of his
residence. Since City staff does not have the expertise to determine more precisely the effect of the
tree on the residence, Mr. Radonic has been requested to obtain an independent opinion from a
qualified engineer. Mr. Radonic has refused to seek the independent opinion.
In conclusion, it is difficult to support the removal of the subject tree because it is healthy and in a
safe condition and does not appear to be causing any structural damage to the nearby residence. Mr.
Radonic has further refused to seek the services of a qualified engineer.

In December 1999, a complaint was received from the owner of the above property that, in his
opinion, the roots of a tree on City property were damaging the basement walls of his house.
A Building Inspector attended the property on December 7, 1999 and made a superficial inspection
of the basement. Them was no concrete floor in the basement and some root tendrils were observed.
This is not unusual under the circumstances. However there was no evidence or indication that any
damage had been caused to the basement or foundation, by the roots of the tree.
If the owner disagrees with the above assessment he has the option of retaining the services of an
independent registered professional engineer, at his own expense.
The owner has been advised accordingly.

RECOMMENDATION:
That the City not enter into a lease agreement with the Friends of the Lundy's Lane Battlefield for
all or any part of the Lundy's Lane Battlefield site.
BACKGROUND:
Staff met with Executive Members of the Friends of Lundy's Lane Battlefield, and representatives
from both the Trillium Foundation and the Ministry of Citizens Culture and Recreation. The
purpose of the meeting was to review the various grant programs and their criteria concerning a lease
requirement. It appears that a lease would not put the City in a position to leverage additional funds.
Staff also conducted a review of the agreement with Miss Redmond that raised concerns about a
potential lease agreement. Following the meeting and the staff review process, staff is
recommending that a lease not be entered into with the Friends of the Lundy's Lane Battlefield.
Staff will proceed with an application to the Heritage Challenge Fund for Fralick's Tavern and the
Friends of Lundy's Lane Battlefield will apply for Tritlium Funding under the non capital grant
program.

RECOMMENDATION:
That the London Plane Trees not be removed.
BACKGROUND
A letter was received from Patricia Folino requesting that the trees in front of her home and those
of her neighbours be removed. An accompanying petition from 9 homes stated that the City
trees adjacent to their homes have not been maintained. Both the letter and petition are attached.
The area of concem is primarily one block on Warden Avenue between Dunn Street and Margaret
Street. There are 13 healthy large London Planes growing on the City's boulevard. The London
Planes have a tendency to shed a portion of its bark each year and approximately every 4 years the
tree sheds its entire bark and produces a new bark. The shedding of bark does create additional
maintenance for the adjacent homeowners. As with all trees in the City there are little twigs and at
times branches do die and fall to the ground.
There are approximately 500 London Planes on the City's boulevards growing throughout the City.
Some of the streets with this tree are: McMillan Drive, Gunning Drive, Mitchell Avenue,
Meadowvale Drive, Fairlawn Crescent, Dorchester Road, Ussher Street, Maywood Street,
Woodington Road, Pettit Avenue, and Freeman Street. The removal of healthy London Planes
would set a precedent and raise the potential of other healthy London Planes also being removed.
The entire block in question was trimmed in 1992. Since that time, two trees received an additional
trimming and one branch was picked up. In the last three years, staff has not received any phone
calls regarding maintenance problems such as leaf mess. We have experienced an unusual wet
spring and the London Planes developed a fungi problem (Sycamore Anthracnose). This resulted
in a large loss of leaves. However, the trees have since produced new leaves and are again healthy.

Information regarding the fungi problem was provided to Mrs Folino when she called on June 8,
2000 requesting that the tree in front of her home be removed. Staff at that time denied her request
because they were aware that the problem would be corrected. However, her concern over the
sidewalk lifting was referred to the appropriate staff. This is a common occurrence with some of the
old sidewalks. Staff has since taken remedial action and some of the sidewalk was removed and
other portions were ground down to remove the raised areas.
Conclusion:
The trees in question are healthy London Planes and therefore staff is recommending that they not
be removed. As in the past, staff will respond to any calls requesting maintenance of City trees.

Dear Mayor Thompson,
I am writing to you concerned about the well being of my neighbors and myself.
We have leaves, branches, bark and other ~things that may-come from -the trees all over the
place.
From the tirst of June all the way to the end of fall, our yards are disgustingly
messy. Ifthat's not bad enough, the bark from the trees start shedding at the begimfing of
July. It makes our property look terrible. It is very unappeallng. It also lowers the value
of our property.
In from of some houses, including mine, the trees have grown to massive
proportions. The roots are getting so big, that they are lifting the sidewalk. I don't want
my children to roller blade on the street, but they have to because of the lifang of the
sidewalks n~akes it unsafe to do so on the sidewalk.
The leaves fall plenty. It is unbelievable. I have to rake a few times per week. We
are only allowed four garbage bags per week, but I always have much more because of
the leaves. The wind blows the leaves into my backyard and into my pool. ffit's not bad
enough that I have to rake my fi'ont yard in the middle of June and July, I also have to
clean out my pool several times a week. The leaves are also dogging eavesdrops on the
house, making cleaning them a frequent task. It is very h_a78rdous.
Lots ofbraches fall from the trees. Sometimes they are small, but other times they
are quite large. When kids walk by, they pick up the braches and walk with them. I try to
stop them, but they run away. Who knows what happens with those branches as the kids
walk home. Two years ago, a'branch fell on one of my neighbors' cars, and it dented it. I
am so seared that one day someone will get a branch falling on his or her head. It could
really hurt ~hem. Is it going to take someone who gets seriously hurt to get_rid of the
trees? We shouldn't have to be scared to walk on the sidewalks in our own neighborhood,
or sitting ~ our front yard. Shouldn't we have the right to choose the trees in front of our
~jn~pho~mfth~ath~s,

The undersigned citizens have requested in past by phone calls to have our trees trimmed
and maintained. Lack of this maintenance is causing the following hazards: falling limbs,
falling bark, failing leaves starting in June right through till November. This is also
depreciating the value of our properties. We ask the Mayor's office to see that this work
is scheduled as soon as possible.

RECOMMENDATION:
That Members of Council receive and file the landscape plans for Lundy's Lane Battlefield
Park.
That staff is directed to hold a public meeting of all stakeholders for both input on the
landscape plan and to share information conceming the restoration of Fralick's Tavern.
That staff report back to City Council on the input gathered from both the public and various
organizations and for final approval of the landscape plan.
BACKGROUND:
Carl Bray who authored the Master Plan for the Battlefield site prepared the landscape plan. As
Members of City Council will recall, the Plan was approved in principle in the fall of 1998. Staff
requested that Mr. Bray take his vision of the property as expressed in the Master Plan one step
further and prepare landscape drawings.
Staff will provide a brief overview of the plan at the Community Services meeting. However,
Members of Council should be aware that the most contentious issue of the plan is the two proposed
parking lots, one on the former Holman Property, and the second on Coronation Park. One of the
biggest challenges we face with developing the property as a major tourist attraction is to find areas
for public parking. According to the legal agreement with Miss Redmond, her property cannot be

used for parking. The area surrounding the Battlefield is developed and therefore, purchase of
sufficient property will be costly. The parking problem must be addressed and therefore, staff is

A by-law to authorize the execution of a supplemental agreement with Canada Mortgage and
Housing Corporation respecting the Residential Rehabilitation Assistance Program (R.R.A.P.).
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
A supplemental agreement effective June 30, 2000 terminating March 31, 2001
between Canada Mortgage and Housing Corporation, Hamilton Office and the
Corporation of the City of Niagara Falls, in the form attached hereto, providing for,
inter alia, the City to act as agent for Canada Mortgage and Housing Corporation in
the processing of loans for the repair, rehabilitation and improvement to family
housing units within the boundaries of the City of Niagara Falls, upon the terms and
conditions as set out therein, his hereby approved and authorized.
The Mayor and Clerk are hereby authorized to execute the said agreement and the
Clerk is hereby authorized to affix the corporate seal thereto and to deliver the said
supplemental agreement

SUPPLEMENTAL AGREEMENT
This agreement is a supplement to the standard Agency Agreement negotiated by this office for the
Residential Rehabilitation Assistance Program.
This agreement is written understanding between CMHC Hamilton Office and City of Niagara
Falls' existing agreement, and the delivery requirements of the agent's.
TERMS OF AGREEMENT
A. RESIDENTIAL REHABILITATION ASSISTANCE PROGRAM
1. This agreement is effective June 30, 2000, and will terminate on March 31, 2001.
The agent acknowledges and concurs with, that all RRAP approval packages to fully
commit their budget allocations for the 2000/2001 delivery year are to be received in our
office by August 31, 2000.
In the event the above date is not met, CMHC will consult with the current Delivery Agent
prior to redistribution of those funds to Delivery Agents who have confimied their need for
additional Budget.
3. Delivery Strategies
i) Delivery Agent must conform to the delivery strategy previously submitted as part of
their proposal package to CMHC.
ii) Delivery Agent must ensure that their responsible territory is serviced in a fair and
equitable manner.
iii) Any advertising must have prior CMHC approval.
The Delivery Agent acknowledges, and is in agreement, that all work items on the work
description be completed, inspected, and a requisition for funds be received in our office no
later than March 31, 2001.
5. The Delivery Agent is in agreement with the amended Guidelines and Procedures as
follows:
RRAP
a) The RRAP work must commence within two (2) months of the loan approval date.
b) The RRAP work must be completed within six (6) months of the loan approval date, or
March 31,2001, whichever comes first.
c) Applications dealing with emergency health and safety problems are considered highest
priority, and will be processed immediately.
d) For the purpose of this agreement, the Delivery Agent will also obtain an invoice with
appropriate documentation from contractors, and forward it to the CMHC Office when
requesting payment of RRAP funds. An acceptable invoice ~ include the contractor's,
and all subcontractor's names and addresses, identification numbers (such as a
Business number, GST Registration number, corporation number or Social Insurance
Number), and the total amount of the contract payment. If an acceptable invoice is
not collected and submitted, 15% of each advance on the RRAP loan will be withheld.
The Delivery Agent and CMHC agree that upon successful completion of the service by
the agent, fees will be paid in accordance with the levels established under the most current
program policies.
7. Any changes to the present Municipal structure should be reported to CMHC immediately.
8. The Delivery Agent must be available during core business hours.
9. CMHC has the right to cancel the Agency Agreement immediately, in the event that a
proven conflict of interest exists.
10. Budget allocations and commitment infomtation is outlined in the attached Schedule "A".
11. Operational Audits and Monitoring Reviews will be completed by CMHC on a yearly
basis and the results will be reported to the Delivery Agent and the CMHC Assisted
Housing Centre prior to the next delivery year.

The Residential Rehabilitation Assistance Program has a Native content percentage as set
out in the annual provincial planning process. For the purpose of this agreement, it is
planned that 11% of the budget will be delivered to Native clients. This targeted
percentage is a planned figure only and should be recognized by the Delivery Agent as
important in meeting the overall planning objectives of the program. Therefore, the
Delivery Agent will give native applicants priority only until the target is met, and will
proceed with other applications in your office on a first come, first served basis.
Applications dealing with emergency health and safety problems are considered highest
priority, and will be processed immediately.
EMERGENCY REPAIR PROGRAM
(for Delivery Agents who agree to deliver this program)
a) The agent acknowledges and concurs with, that all ERP approval packages to be
submitted to CMHC for commitment by December 31, 2000.
b) Repairs under the ERP program must be started immediately and completed within 90
days from the date of approval or by March 31,2001, whichever comes In'st.
**Failure to meet the above conditions may result in cancellation of the ERP loan.***
Failure to meet any of the above criteria could result in reduction of allocations,
re-testing, service of additional probation time or dismissal of the agent. This decision
would be made at the discretion of CMHC upon review of the individual situation.

Request for Variance to Fence By-law
10683 Sodom Road
RECOMMENDATION:
That the Committee approve a maximum eight foot six inch (8'6") high fence along the side property
lines in the front yard of 10683 Sodom Road to a point not less than sixty-eight feet (68') from the
centre line of Sodom Road, and that the balance of the fence height in the front yard be no greater
than four feet (4') from that point to the front lot line.
BACKGROUND:
In a letter dated July 12, 2000 Christine Tothpal has requested that an amendment be made to the
City's Fence By-Law No. 77-75 to allow them to erect an eight foot six inch (8'6") high fence on
their front yard.
Ms. Tothpal's house is set back one-hundred and eighteen feet (118') from the front lot line, adjacent
to Sodom Road. In accordance with the City of Niagara Falls Zoning By-Law, a building in this
location must have a minimum set back of sixty-eight feet (68') from the centre line of the street.
Although the fence is not classed as a building, we feel that this requirement will provide the owner
with an adequate amount of privacy, and maintain the intent of the requirements of the Fence By-
Law.
According to our Fence By-Law a from yard fence may be no greater than four feet (4') high. It also
states that the maximum height for a rear or side yard fence is eight feet six inches (8'6"). The eight
foot six inch foot (8'6") high fence variance if approved, would not interfere with the site line of
traffic at this property, nor impede the view of the neighbour's vehicle entering or exiting their
driveway.

That the variance for a ground sign having an area of two-hundred and fifty (250) square feet for Jain
Imports at 4080 Montrose Road, Niagara Falls, Ontario be appmved.
BACKGROUND:
An application was received for a variance to the City of Niagara Falls Sign By-Law No. 6661, as
amended, for a ground sign to be located at 4080 Montrose Road, in the rear of the property, facing
the Queen Elizabeth Highway. The sign by-law permits one ground sign to have a maximum area
of 25 square feet with a six foot side yard set back. The applicant has requested a variance to this
by-law to allow the second ground sign, in the rear of this property for a two-hundred and fifty (250)
square foot sign, which will be seventeen feet (17') high.
Last August, Council approved a variance to the ground sign at the front of the property, as the
property only has a frontage on Montrose Road of thirty (30') feet, which according to the sign by-
law, only allows one ground sign of twenty-five (25) square feet. The mar lot line, facing the Queen
Elizabeth Highway, has a frontage of one-hundred and seventy-five feet (175') and a property depth
of nine-hundred and eighty-five (985') feet.

RECOMMENDATION:
That the Manager of By-law Enforcement be authorized to retain a towing company forthwith to
remove the unlieensed vehicles and various debris which Luigi Marcone was ordered to carry out
under an Order of the Property Standards Officer.
BACKGROUND:
The subject property has been inspected by the Property Standards Officer on numerous occasions
over the past year and a half. It has been determined that the above noted property is in
contravention of the City of Niagara Falls' Property Standards By-Law No. 98-50. The owner of
the property, Mr. Luigi Marrune has been advised by letter in February of this year to remove the
unlicensed vehicles, car parts, engines and tires. Mr. Marrune has requested numerous extensions
to this request, and the City of Niagara Falls has agreed to allow Mr. Marrune the required time to
effect repairs.
On June 23, 2000 it was confirmed that no work had been started, accordingly verification of
ownership by title search was obtained and an Order of the Property Standards Officer was issued
on July 28, 2000. The Order became final and binding on August 18, 2000 as no appeal had been
received.

Section J. 205 of the Property Standards By-Law No. 98-50 states that "Where an Order of an
officer under section 192 has become final and binding as provided in section 204 of this by-law and

demolished in accordance with the Order ". The cost of these romedies will be charged back to the
owner as real property taxes.

BBS-2000-07 Variance to Sign By-Law
Mount Carmel Plaza, Phase III
RECOMMENDATION:
That Council approve the variance for a forty (40') foot high ground sign at 3770 Montrose Road for
Mount Carmel Centre Plaza, Phase III as shown on the attached schedule "A".
REPORT:
River Realty Development has submitted an application for a ground sign at 3770 Montrose Road. The
Sign By-Law currently states that ground signs shall not exceed twenty-five (25) feet in height, and that
a variance may be requested if the frontage of the property exceeds one-hundred and fifty (150) feet.
The lot frontage on this property is six-hundred and ninety (690) feet. The sign variance is requested
to allow the large number of individual tenants enough space to advertise. A Mount Carmel Plaza Phase
IV will be added and additional tenants will add to this. The height extension will provide sufficient
clearance between the bottom of the sign and the ground to maimain site lines of traffic.
The variance requested is consistent in size and nature with the existing advertising and would not
adversely affect the surrounding area.

I am writing on behalf of myself and my neighbours, Mr. and Mrs. S. Oprendek, of 2610 Noella
Crescent; Mr. and Mrs. R. Birrell, of7017 Woodington Road; and Mr. and Mrs. G. Barrett, of 7009
Woodington Road.
On Friday, July 29, 2000, the basements of all these homes were flooded because of the inability of
the storm sewer system in our neighbourhood to handle the runoff from a sudden severe
thunderstorm. We all sustained damage of varying degrees, and notwithstanding washing out the
basement floors with bleach, the smell remains. This is the second time this has happened on this
street in the past nine months. It is our belief that more and more connections are being made to the
storm sewer system so that the system can no longer cope with sudden flood waters, causing those
waters to back up into our basements.
It is not reasonable to expect people to have to endure such flooding and damage which could be
much worse if it occurred while people were away for any length of time. We are therefore seeking
an immediate commitment from the City that the storm sewer system in our area will be upgraded
to the point where it can do the job required.
When you have had a chance to discuss this matter with your fellow counsellors and the appropriate
city department, we would appreciate an early and favourable reply to our request.

SUBJECT: Proposed Sidewalks
We the undersigned are against the proposed sidewalks that will be going in on our
Street.
We understand that there is a City Bylaw where you cannot park over a sidewalk and
because of this we will loose access to our parking. Also, in the winter time it is hard
enough to find time to clear our driveways and porches of snow, and we know that there
is another Bylaw that requires you to keep the pathways clear of debris. Silvan Street is
not a through Street so there isn't going to be heavy traffic to warrant a sidewalk.
