Mr. Don Ede, Village of Chippawa Citizens Committee would like to see Cummington Square designated a Historical Site therefore guaranteeing the Square will be there for generations to enjoy. BACKGROUND: On September 20, 2004, residents living in the neighbourhood surrounding 6383 Drummond Road attended the Community Services Committee meeting to express their concerns about the use of the property. As a result, staff was asked to prepare a report on the parking requirements of the proposed use and whether there is sufficient parking to support the associated outdoor patio. The subject property is currently zoned Neighbourhood Commercial (NC) by Zoning By-law No. 79-200. Previous uses of the building on the property have included an office, a retail store and several restaurants all requiring 13 parking spaces. The property has legal non-conforming status regarding the provision ofparking. Only 3 parking spaces could physicallybe provided on-site. The 10 parking spaces currently being used for the site are located partially on the subject property and partially on the Murray Street road allowance which is contrary to the Zoning By-law. Based on the previous use of the building, a restaurant having 69 seats would be allo~ved to be established on the property. With respect to the outdoor patio, the Committee should be advised that the Zoning By-law does not require parking spaces for unenclosed outdoor seating areas. Numerous restaurants and bars throughout the City have u~ed this to their advantage. BACKGROUND: In reply to a motion passed at Council's September 20, 2004 meeting, staff has investigated the parking situation on Murray Street between Drummond Road and Franklin Avenue. The intention of this investigation was to determine the most adequate parking control in the study area, acknowledging the possibility of Spicoli's Pizza & Caf6 generating additional on-street parking. Murray Street is a collector roadway extending in an east/west direction from Franklin Avenue to Niagara Parkway. In the study area the roadway is 7.0 metres in width, consisting of a sidewalk and a boulevard on both sides. Currently, parking is restricted on the north side of Murray Street between a point 60 metres west of Drummond Road and a point 182 metres west of Drummond Road to ensure that adequate visibility and maneuverability is available to motorists approaching the horizontal curve on Murray Street, located approximately 145 metres west of Drummond Road. Furthermore, parking is restricted on the south side of Murray Street between Drummond Road and a point 72 metres, west of Drummond Road to ensure adequate maneuverability to motorists approaching the above-mentioned intersection, and attempting to enteffexit Spicoli's Pizza & Caf6 parking lot. Sight investigations reveal that notwithstanding the aforementioned horizontal curve, the alignment of Murray Street is straight and level, and therefore, stopping sight distance is adequate. Parking questionnaires were delivered to all residents and commercial property owners on Murray Street between Drummond Road and Franklin Avenue. Through the questionnaires, residents had an opportunity to comment on the parking control that would most benefit their parking needs. The following results were obtained from the questionnaires: Murray Street between Drummond Road and Franklin Avenue Number of questionnaires delivered: 60 Number of responses received: 16 27% Number of responses not received: 44 73% Number of responses received: 16 Prefer to maintain the existing parking control: 7 44% Prefer implement permit parking control: 3 19% Prefer to restrict parking on both sides: 6 38% The results obtained from the questionnaires reveal that a statistical consensus was not established. The obtained response rate (27%) is significantly below the minimal rate (50%) required to establish a statistical consensus. Furthermore, of the responses received, a preferred pattern was not established. However, detailed analyses of the obtained responses reveal that; of the respondents residing in close proximity to Spicoli's Pizza Cafe, the majority have opted to either restrict parking on both sides or implement a permit parking control. Furthermore, the majority of the respondents residing on Murray Street west of the horizontal curve had opted to maintain the existing parking control. Therefore, based on the above information it is recommended that permit parking be implemented on the south side of Murray Street between a point 72 metres west of Drummond Road and a point 185 metres west of Drummond Road. This restriction will encompass the following residential establishments; 6272, 6284, 6294, 6304, 6312, and 6328. Of the residents residing in above-mentioned houses, no one had opted to maintain the existing parking control. The proposed permit parking zone ~vill deter patrons of the Spicoli's Pizza Caf~ from parking on the south side of Murray Street in close proximity to Drummond Road, while maintaining on- street parking for the area residents. Furthermore, it may alleviate the potential parking activity at the curve, thus maintaining adequate visibility. Residential and visitor parking permits are issued to homeowners that directly abut the permit area at no charge. As mentioned previously, a "no parking" zone is currently present on the north side of Murray Street in the study area. Patrons of the Spicoli's Pizza Caf~ may park their vehicles on the north side of Murray Street between Drummond Road and the existing "no parking" zone, in the area encompassing the road adjacent to the rear property of a condo building on Ash Street. BACKGROUND: In reply to a request, staff has conducted an intersection control review at the intersection of Morrison Street and Ontario Avenue. The concern at this location stems from the available visibility for motorists traveling in the east and west directions on Morrison Street. The intersection of Morrison Street and Ontario Avenue is in a "Cross" configuration and consists of north/south and east/west approaches. Currently, this intersection is controlled by a stop sign facing eastbound and westbound motorists on Morrison Street. Morrison Street is a collector roadway extending in an east/west direction. In the study area, Mordson Street is 9.5 metres in width and consists of sidewalks on both sides. Ontario Avenue is also a collector road extending in a north/south direction. In the study area, Ontario Avenue is 12.5 metres in width consisting of a sidewalk on both sides and parking meters on both sides north of Morrison Street. Working Together to Serve Our Community Municipal Wu/ks · Fire Services · Pad~s, Recreation & Culture · Business Development · Building & By-Law Services November 15, 2004 - 2 - MW-2004-168 To determine whether The City of Niagara Falls Residential All-Way Stop Warrant is fulfilled, the following technical studies were carried out at the intersection of Morrison Street and Ontario Avenue: 8 hour turning movement count sight investigations collision analysis residential petition form · technical observations The results obtained from a turning movement count reveal that Morrison Street and Ontario Avenue carry similar traffic volumes. The following results were obtained: · the total vehicular traffic volume on Morrison Street is approximately 131 motor vehicles per hour the total vehicular traffic volume on Ontario Avenue is approximately 114 motor vehicles per hour · approximately 95 total pedestrians utilize this intersection Sight investigations reveal that due to the presence ora mature tree on the southwest comer of the intersection, and parked vehicles on the east side of Ontario Avenue north of Morrison Street, the minimum crossing sight distance is not fulfilled. A review of the collision flies reveals that five reportable collisions occurred at the study intersection during the previous three year period. Of the five collisions, all were right angle collisions ~vhich are considered to be susceptible to correction through the installation of an all-way stop control. The residential portion of the All-Way Stop Warrant, was not fulfilled. Of the 23 residential establishments and one non-residential establishment (Niagara Regional Police) petitioned, only 5 (21%) were returned. Of the five, four including comments from the Niagara Regional Police, were in favour of the control. During staff's field observations motorists in all directions were noted to stop at the intersection on occasion. This included motorists traveling in the north and south direction on Ontario Avenue which is the through road. Alternately, on occasion, it appeared that motorists on Ontario Street took extra precautions prior to proceeding through the intersection, unsure as to whether motorists on Morrison Street were expecting them to stop. The confusion may he partially attributed to the fact that the traffic volumes on both roads are similar. Based on the results obtained from all the technical studies and observations, staff has determined that the all-way stop control is warranted at the intersection of Morrison Street and Ontario Avenue based on the sight investigation, and the volume split of traffic utilizing the intersection. The proposed all~way stop control will adequately allocate the right-of-way to conflicting traffic flows of motorists at this intersection. The placement of an all-way stop control at Morrison Street and Ontario Avenue may affect the operation at the intersection of Huron Street and Ontario Avenue, located one block to the north. As them is also an all-way stop control at Huron Street and Ontario Avenue, north and southbound motorists traveling between Park Street and Morrison Street would be required to stop at each intersection for four consecutive blocks, Park Street, Queen Street, Huron Street and November 15, 2004 - 3 - MW-2004-168 Morrison Street. A review of the Huron Street and Ontario Avenue intersection operations indicate that an all-way stop control is not warranted. Based on the above technical study, an all-way stop control is recommended to be installed at Morrison Street and Ontario Avenue, and the all-way stop control at Huron Street and Ontario Avenue is revised to reflect a stop sign on Huron Street, and no control on Ontario Avenue. Council at its September 20, 2004 meeting requested that staff immediately paint bicycle lane markings on the east side of Dorchester Road, north of Thorold Stone Road. In addition, staff was asked to investigate other methods of discouraging traffic from utilizing the paved shoulder to drive around left turning vehicles. In response to this request, staff had the bicycle symbol, along with the wording "Only" painted at approximately 50-75 metre intervals as per the Ontario Traffic Manual - Book 11, Pavement, Hazard and Delineation Markings. As well, Staff investigated other options such as installation of flexible delineators and concrete barriers. Further, it would impede the residents entering and exiting their driveways. In addition, the placement of any type of barrier would create problems with snow removal in the winter time. Another option would be to remove the asphalt boulevards and replace them with grassed boulevards. Currently, the painted symbol is considered to be information only as it would require an accompanying by-law and signing to make it legal, furthermore, it would require the elimination of parking in front of the residences along Dorchester Road from Isaac Street to Riall Street. In accordance with our policy, a questionnaire would have to be sent to the affected residents to determine if they are in favour ora parking restriction. The presence of parked vehicles would most likely assist in deterring drivers from driving around left turning vehicles becanse they would not have the space to drive around the vehicle. In addition, without the presence ora physical barrier to stop drivers from utilizing the paved shoulder, Staff is uncertain as to whether the by-law designating the bicycle lane would stop drivers from using the lane or not. It would then become a police enforcement matter and available manpower to deal with this issue. Finally, to further enhance the edge line, a second line will be painted adjacent to the existing line. It is recommended that no further physical works be done at this time. The purpose of this reconstruction is to try to physically bar illegal left- hand tums into and out of the subject property. For the purpose of estimating a construction cost, we have used the configuration as found in the Dorchester Road Environmental Assessment. Staff would recommend that we construct the work to that design to minimize any throw away costs when we reconstruct the entire road. The reconstruction of the entrance requires the relocation of sidewalk, street lighting and curbing, both on the street and in the parking lot. To do this work the City must acquire 740 square meters of property from Zehrs. The estimated construction cost is $37,860. Wright Park Development RECOMMENDATION: It is recommended that Tender TR28-2004 for the landscape development of C.B. Wright Neighbourhood Park be awarded to Touchstone Site Contractors of St. Catharines, Ontario, for a cost of $158,698.85 plus GST. BACKGROUND: Parks, Recreation & Culture staff, through the Supply & Services Section, issued a tender for the complete landscape development of C.B. Wright Neighbourhood Park. Proposed works include paved pathways, a hard surface basketball/play court, benches, storm drainage systems, planting, seeding and sodding. The creative playspace equipment will be supplied separately through a contract with Belair Recreational Products, which is being recommended for approval by Council in Report R-2004-74. As a result of the public meeting for this park held on June 7, 2004, it was requested that the park pathway and the play equipment be lighted for safety reasons. Lighting is not normally included within City neighbourhood parks, however, City staffhas included a separate price for this lighting cost and is reflected in the prices shown in this report for Council's review and consideration. Council should be aware that additional funds for park lighting was not included in this development budget. Through the Supply & Services Section of the Clerk's Department, seven (7) companies picked up the tenders and three (3) bids were received by the Clerk's Office. The tender opening occurred in the presence of the City Clerk and Manager of Supply & Services on Monday, November 8, 2004. }Forking Together to Serve Our CommuniO?
