RECOMMENDATION:
That Council pass the by-law appearing on tonight's agenda adopting the attached schedule for 2005.
BACKGROUND:
Based on the Council's comments as a result of consideration of CD-2004-24, 2005 Council
Schedule, staff has come back with a revised schedule for consideration. For your information:
et Meetings have been added in May, July, August and December.
et Staff attempted a bi-weekly schedule, with some exceptions usually caused by holiday
Mondays.
/ The biggest gap between meetings is three weeks.
et Although not a holiday, staff avoided a meeting on Halloween
/ Despite the additional meetings, staff has been able to maintain a schedule that prevents back
to back meetings, with the exception of the last meeting in December (which is traditionally
for budget and minor items only).
et As previously mentioned, with weekly meetings, staff s time is almost solely comprised of
Council report and agenda activities, leaving little time for other responsibilities or strategic
planning.
et The bi-weekly schedule model allows staffto get Council their packages in advance. The
weekly schedule meant packages would only be available the Friday before the meeting.

Resolution
RECOMMENDATION:
It is recommended that the attached resolution be adopted.
BACKGROUND:
The Governments of Canada and Ontario are partnering with eligible rural and small urban
municipalities in enhancing and renewing aging public infrastructure. This is similar to the
Superbuild initiative from which the City of Niagara Falls received funding for several projects,
however with the COMRIF funding, the City can only apply for one project. In order for the
application to be considered, Council by resolution, must commit to this project being the top
priority.
On December 6, 2004, Committee was presented with a report showing infrastructure that
needed immediate repair. As part of this review it was noted that the sewer water and roads in the
area north of Morrison Street, between Victoria Street and Stanley Avenue currently require
mai or improvements. In the budget, Staff has recommended spending $ 8,200,000 over the next
five years (Bridge Street Storm Separation and Watermain Replacement) in this area. In the
opinion of Staff, this project meets all the requirements of the COMR~ Funding Guidelines and
is recommending that we apply for funding.
Staff has prepared the required resolution which must accompany the funding application. It is
attached for Council's approval.

WHEREAS the City of Niagara Falls is committed to enhancing and renewing aging public
infrastructure; and
WHEREAS the Governments of Canada and Ontario are partnering with eligible municipalities
to invest in local infrastructure; and
WHEREAS the City of Niagara Falls is applying for funding for the Bridge Street Sewer
Separation and Watermain Replacement Project under this partnership through the Canada -
Ontario Municipal Rural Infrastructure Fund (COMRIF).
THEREFORE BE IT RESOLVED THAT the Bridge Street Sewer Separation and Watermain
Replacement Project is the highest infrastructure renewal priority within the City of Niagara
Falls.

RECOMMENDATION:
It is recommended that Council endorse this report which outlines the steps to be taken and timelines
for the processing of the proposed Official Plan amendment application submitted by the Victoria
Avenue BIA.
BACKGROUND:
The City's Official Plan sets out a detailed policy framework which is used to coordinate tourism
growth and development and the provision of infi-astructure throughout the Clifton Hill, Fallsview
and Queen Victoria Park subdistricts which comprise the Central Tourist core. The Plan is
predicated on five fimdamental building blocks, namely:
1) Park in the City
2) An Integrated People Mover
3) A Grand Boulevard on the Railway Corridor
4) New Casino Development; and
5) Building Quality and Energy Skyline
Council adopted its tourism policies in August 1999. A reaffirmation of said policies was made in
May of this year with Council's adoption of the Tourism Policy Review study conducted by the I13I
Group.
As Council is aware, the Victoria Avenue BIA has recently filed an Official Plan amendment
application which proposes to delete the Grand Boulevard as one of the five building blocks set out
in the Official Plan. Given the significance of the proposed amendment and its implications to other
stakeholders and the community as a whole, it is recommended that a public consultation programme
be established to provide opportunities for public input and to weigh the merits of the proposed
Official Plan change. In this regard, it is recommended that a general public meeting be held in

January 2005 to initiate the public consultation process. Staff has tentatively scheduled this meeting
at the Public Library on January 25, 2005. Staff, with the assistance of the City's transportation and
urban design consultants, will prepare altemative design concepts for the Grand Boulevard for
presentation at the public meeting. It is anticipated that three alternatives will be presented for
discussion purposes.
1) the Grand Boulevard as presently envisioned in the City's Official Plan;
2) the deletion of the Grand Boulevard as proposed by the Victoria Avenue BIA; and
3) the current status quo - pedestrian promenade and future people mover transit route.
Input received from the general public meeting forum would provide a basis for measuring the
community's support for the proposed Official Plan change or other possible alternatives. Staff
would report to Council regarding the input received and a formal public meeting under the Planning
Act could then be held.
It is anticipated that the Council public meeting would be held by Council at its second meeting in
February. A full staffreport would be available at this time. Said report would discuss the technical
merits of the Official Plan change and the other alternatives, together with a summary of the public
input received. The public would be invited to attend the Council meeting to make presentations and
express their opinions. A staff recommendation would be made as part of the Council report.
CONCLUSION:
With Council's endorsement of this report, the Niagara Falls Community will be invited to express
their views on the Grand Boulevard issue. Resolution of this issue is important to provide proper
direction to the development community, particularly those whose development proposals abut the
Grand Boulevard right-of-way, to properly integrate new development with this important
infrastructure component.

RECOMMENDATION:
That this Report be received for the information of Council.
BACKGROUND:
By-law No. 2001-58, passed by Council on March 19, 2001, with respect to inspections and permits,
sets out a scale of fees for various classes of permits.
Section 14 of Schedule A of the above Byqaw stipulates that the fees shall be indexed annually, on
each January 1, thereafter without further amendment to the By-law in accordance with the StatsCan
Quarterly Construction Price Statistics Catalogue and this has been applied since the passing of the
By-law.
The above index has increased by 6.95% since the last adjustment and the permit fees for 2004 have
been adjusted accordingly and are shown in the attached summary.

The fees above, calculated on a sq. ft./sq, m. basis, include new floor area either in a new building or an
addition to an existing building.
For categories of construction not listed above (including swimnUng pools), the permit fee shall be $70.00
for the initial $5,000.00 of valuated cost, or portion thereof, plus $10.00 for each additional $1,000.00 of
valuated cost, or portion thereof. Fees are payable at time of application.

Other applicable fees may be payable for servicing, deposits, development charges, park dedication, etc.
The fee for fast tracking a permit (when available) is 1.5 times the applicable rate, above.
Notwithstanding, where construct/on or installation has occun'ed prior to the issuance cfa permit, then the
permit fee shall be double the amount listed above.
NOTE: Permit fees are indexed to the StatsCan Construction Price Statistics, and are adjusted
annually. The increase from 2004 to 2005 was 6.95%

Equipment & Software Purchase
Water Department Valve Turning Program
RECOMMENDATION:
It is recommended that the purchase of a Trailer Mounted Valve Operator complete with Data Transfer
Capabilities be awarded to Wachs Canada Ltd. in the mount of $48,093 including taxes.
BACKGROUND
The City is implementing a Valve Turning Program beginning in the Spring of 2005. Staff
recommends that a "Trailer Mounted Valve Operator" complete with "Data Transfer Capabilities" be
purchased to make this operation possible.
Two types of equipment were demonstrated. The equipment from Wachs Canada Ltd. meets the
necessary specifications. It is also noted that Wachs Canada Ltd. is the sole supplier of this equipment.
The cost of this expenditure is budgeted in our Water Department budget.

Fuel Tender
RECOMMENDATION
It is recommended that the purchase of fuel be awarded to Wright Fuels Niagara Inc. of St. Cathahnes
as outlined in the Niagara Public Purchasing Committee Tender issued by the Regional Municipality
of Niagara.
BACKGROUND
The Region has just completed the tendering process for fuels. The contract period is for an initial
period of 36 months with two 12 month extension periods allowed.
The bid documents were sent to seven companies. Three companies, Shell, Esso and Wright Fuels
responded. Following a review of the bids, the solicitor for the Region advised that Wright Fuels
Niagara Inc. has submitted the only compliant bid. The Niagara Public Purchasing Committee, at its
meeting of November 24, 2004 agreed with this opinion and motioned to accept this bidder for the
supply of fuels for at least the next three years.
Wright Fuels has been the supplier of fuels to the City of Niagara Falls for the past several years.
The cost of this expenditure is covered in the annual budget.
