NEW BUSINESS Niagara Car of Niagara Falls( Canada His Worship Mayor Ted Salci and Members of the Municipal Council City of Niagara Falls, Ontario Members: RECOMMENDATION: It is recommended that: 1) the Garner Estates Phase 5 Plan of Subdivision be draft approved subject to the conditions in the attached Appendix; 2) the Mayor or designate be authorized to sign the draft plan as "approved" 20 days after notice of Council's decision has been given as required by the Planning Act, provided no appeals of the decision have been lodged; 3) draft approval be given for three years, after which approval will lapse unless an extension is requested by the developer and, subject to review, granted by Council; and 4) the application to amend the Zoning By -law be approved as detailed in this report to provide the necessary land use regulations to guide the development of the subdivision. 5) that the developer provide 6 -foot high chain -link fencing along the west limit of Lots 4 to 10 (inclusive) that abut the German Village Club soccer field. The applicant proposes to subdivide a 7.93 hectare (19.59 acre) site into 101 lots for single detached dwellings and one lot for a semi detached dwelling. The property is located between Garner Road and Kalar Road, north of McGarry Drive as shown on Schedule 1. The road pattern includes extensions to Westport Drive and St. Michael Avenue which terminates at the north limit of the plan to be continued on abutting land in the future. There is one single detached lot proposed with direct access to Garner Road. Schedule 2 illustrates the subdivision layout. Working Together to Serve Our Community Clerks Finance Human Resources Information Systems Legal Planning Development January 17, 2005 2 PD- 2005 -05 The site is currently zoned Development Holding (DH) by Zoning By -law No. 79 -200. The applicant has requested the zoning of the land be changed to the Residential Single Family 1E Density (R1E) category for the single- detached lots with a reduced front yard dwelling setback for the lot on Garner Road, and to the Residential Single Family and Two Family (R2) zone for the semi detached lot. Public Consultation The Planning Act requires that a Public Meeting be held to receive input on subdivision proposals prior to making a decision. Council held the Public Meeting for this plan on April 19, 2004. The review of the application has been on hold for several months due to an examination of school requirements in the area. The City has received comments regarding servicing in the area and the German Village Club abutting to the west requested that fencing be provided between the proposed lots and the soccer field on their site. The required Public Meeting for the zoning amendment is satisfied through tonight's meeting and provides another opportunity for public comment. Planning Review Various matters were considered in assessing the proposed plan of subdivision and zoning amendment. Based on this analysis, approval is recommended subject to a lot boundary revision and detailed conditions of approval for the subdivision and with modifications to the requested zoning amendment. The review of the applications is addressed under the following headings. Official Plan The City's Official Plan designates the property Residential which permits a variety of housing types. A compatible mix of housing types, lot sizes and densities is promoted by the Official Plan to provide a full range of housing opportunities. The subdivision abuts vacant land to the north approved for the Garner Village draft plan of subdivision that proposes a mix of single- detached, semi detached and on- street townhouse dwellings. There is a stormwater area/recreational trail and single- detached housing to the east within the Garner Estates Phase 3 subdivision. Lots for single detached homes and a future park in the Gamer Estates Phase 4 subdivision are located to the south. The Futino Estates draft plan of subdivision approved for single- detached homes and the soccer field of the German Village Club are to the west. The northwest section of the plan abuts two existing residential properties and Garner Road (Urban Area Boundary). This subdivision is an extension of the previous phases of development in the neighbourhood and the moderate frontage single detached lots are a reflection of the strong market for this type of housing. The development will be compatible with the existing and future surrounding uses. Garner Neighbourhood Secondary Plan The policies of the Official Plan are refined through the Garner Neighbourhood Secondary Plan which provides a framework to guide development in this new growth area west of Kalar Road. A variety of housing types are encouraged to accommodate the needs of different age groups, family sizes and incomes. The subdivision application meets the general land use objectives of the Secondary Plan. However, a specific policy indicates a target housing mix of 70% single /semi- detached units and 30% multiple residential units in the overall Garner Neighbourhood. Multiple family housing is to be integrated in a compatible manner in locations adjacent to schools, parks, open space and other community facilities. January 17, 2005 3 PD-2005-05 The first three phases of the Garner Estates development were approved for single detached housing, in part, to provide separation between future townhouse and/or apartment sites within the Garner area and the numerous multiple unit developments on the east side of Kalar Road. The locations of the main roadways in the current Phase 5 plan have been established through earlier subdivisions. Semi detached dwellings and on- street townhouses are not encouraged on collector roads and the property is not conducive to block townhouse development. Subdivision proposals north of the hydro corridor will need to include multiple residential sites in keeping with location criteria to achieve the housing mix target of the Secondary Plan. Provincially Significant Wetland There is a woodlot/wetland in the northwest area of the plan (extending over Lot 1) that is designated a Provincially Significant Wetland (PSW). Development is prohibited in such areas and Provincial policies only allow development on adjacent lands (within 120 metres) where it is demonstrated that there will be no negative impacts. The applicant submitted a required Environmental Impact Study (EIS) that was reviewed by the Region. The EIS proposes mitigation measures that include a 30 metre (98.4 foot) setback for all structures from the PSW boundary. The Region recommends that the PSW should be zoned as an Environmental Protection Area to preclude development. The land containing the Provincially Significant Wetland is to remain in private ownership. Therefore, in addition to typical planning mechanisms to protect the wetland such as lot design and zoning requirements, the use of a "conservation easement" is recommended for the PSW. This easement is a document registered on title between the landowner and City that provides protection for the environmentally sensitive features on the property. The application of such conservation easements is being examined for lands throughout the municipality. Subdivision Design Development of the long strip of land shown as Lots 1 and 2 is restricted due to the Provincially Significant Wetland and buffer area. Although the deep lot design is inefficient for urban land, there are limited development opportunities given the natural features. The boundary between Lots 1 and 2 has been shifted to the east by staff to contain the required environmental protection measures wholly on Lot 1. Extra depth is maintained for Lot 2 as desired by the developer. The building envelope on Lot 1 along Garner Road is restricted but there appears to be sufficient area to construct a dwelling considering zoning setbacks and the PSW buffer distance. There are no sanitary sewers on Garner Road. The Municipal Works Division has accepted a proposed special low pressure sewer pipe system that will connect with the municipal sewer on McGarry Drive to the south. This will be a municipally -owned service subject to approval of the Ministry of the Environment. The applicant and developer of Futino Estates, or future individual property owners, may wish to consider a possible land exchange at the rear of Lot 17 to create an additional building lot in Garner 5 and improve the lot configuration. Lot 45 is a large frontage parcel proposed for semi detached use but it is understood that the width is to accommodate a special 1- storey dwelling design. Sidewalks are to be provided in accordance with municipal policy and a widening of Garner Road is required. Parkland dedication requirements of the applicant have been addressed through earlier subdivision phases. Fencing along the east boundary of the plan (stormwater /trail) is required. The developer of Futino Estates agreed to install chain -link fencing abutting the German Village Club soccer area. However, the applicant does not wish to provide similar fencing abutting the soccer field at the west boundary of the plan as they feel individual property owners will install a fence if desired. It is not normally a municipal requirement to fence adjacent to private property, however, the recreational use warrants the fencing to minimize any impacts of the activity. January 17, 2005 4 PD- 2005 -05 Zoning Amendment The requested R1E zone for the single- detached lots is the same category as the majority of lots in the neighbourhood. The proposed single- detached lots exceed the minimum lot area of 370 square metres (3,983 square feet) and minimum frontage of 12 metres (39.4 feet) of the zone. The proposed semi detached lot also exceeds the minimum lot size standards of the requested R2 zone. The portion of revised Lot 1 containing the Provincially Significant Wetland is recommended for an Environmental Protection Area (EPA) zone. The buildable area of Lot 1 at the Garner Road frontage will be zoned R1 E and provide a minimum 30 metre (98.4 foot) setback from the EPA boundary for all buildings and structures. The requested relief from a special Garner Road setback is not needed since the desired road allowance width will be obtained by a 3.05 metre (10 foot) road dedication. Regional and Agency Comments The Regional Planning and Development Department notes that the majority of the subdivision contains moderate sized single- detached lots that contribute to the range of housing in the area. The Regional Public Works Department has requested standard servicing conditions. Regional Planning also reviewed the subdivision with regard to Provincial policies. The recommendations of the EIS for the Provincially Significant Wetland are to be implemented through the subdivision agreement and zoning. A condition for the review and approval of stormwater management, lot grading, drainage and sedimentation and erosion control plans is also included. Canada Post advises that the residents will be served by Community Mailboxes. In addition, the developer will be required to enter into separate agreements with several utility companies. CONCLUSION: The Garner Estates Phase 5 Draft Plan of Subdivision is an appropriate development of the site. The application complies with the policies of the Official Plan and Garner Neighbourhood Secondary Plan. The recommended Zoning By -law amendment will provide suitable regulations for the construction of the dwellings and ensure land use compatibility. Approval applies to the Garner Estates Phase 5 Draft Plan of Subdivision prepared by Upper Canada Consultants, dated April 19, 2004 and revised by the City on January 17, 2005, showing 101 lots for single detached dwellings and one lot for a semi detached dwelling. 2. The developer enter into a registered Subdivision Agreement with the City to satisfy all requirements, financial and otherwise, related to the development of the land. Note: Should any other body wish to have its conditions included in the Subdivision Agreement, they may be required to become party to the Subdivision Agreement for the purpose of enforcing such conditions. 3. The developer submit a Solicitor's Certificate of Ownership for the subdivision land to the City Solicitor prior to the preparation of the Subdivision Agreement. 4. The subdivision be designed and constructed in accordance with City standards which, in part, includes the following: a) construction of 9.15 metre wide pavement on St. Michael Avenue and 8.0 metre wide pavement on the remaining roadways; b) dedication of appropriate daylighting triangles at all intersections; c) dedication of the road allowances to the City as public highway and the streets named to the City's satisfaction; d) dedication of a 3.05 metre (10 foot) road widening to the City along the east side of Gamer Road abutting Lot 1; e) provision of water distribution, sanitary sewer and storm sewer systems; f) weeping tile flow to be directed to the storm sewer by use of sump pumps; g) provision of an overland stormwater flow route; and h) application of the City's Lot Grading and Drainage Policy. 5. The developer construct sidewalks to City standards on both sides of St. Michael Avenue, the north side of Westport Drive, the east and north side of Shannon Drive and the south and east side of Courtney Crescent. 6. The developer dedicate a 0.3 metre reserve (Block 103) to the City at the north terminus of St. Michael Avenue which is to be continued in the future. 7. The existing 0.3 metre reserves at the present terminus of Shannon Drive and St. Michael Avenue (Blocks 114 115, 59M -324) and Westport Drive (Block 102, 59M -315) be dedicated to the City as public highway. 8. The developer pay the Development Charges in force at the time of execution of the subdivision agreement. 9. The developer grant the City and Public Utilities any easements required to service the subdivision. January 17, 2005 6 PD- 2005 -05 10. The developer enter into an agreement (Letter of Understanding) with Bell Canada complying with any underground servicing conditions imposed by the municipality, and if no such conditions are imposed, the developer shall advise the municipality of the arrangement made for such servicing. 11. The boundary between Lots 1 and 2 be shifted approximately 47 metres to the east (generally as shown on the revised plan) in order to locate Lot 2 outside of the required 30 metre buffer from the Provincial Significant Wetland (PSW). The specific boundary of the PSW is to be determined in the field to the satisfaction of the Region and Ministry of Natural Resources. 12. A conservation easement to the City be established for the Provincially Significant Wetland (and possibly buffer area) located on Lot 1. 13. The developer provide 6 foot high chain -link fencing along the east boundary of the plan abutting the overland drainage route /recreational trail. 14. The developer provide boulevard trees in accordance with City policy. 15. The developer receive final approval from the City to the zoning by -law amendment to provide land use regulations to guide the development of the subdivision. 16. The developer provide three calculated plans and a letter prepared by an Ontario Land Surveyor to Planning Development confirming that all lots comply with the Zoning By -law. 17. The developer provide five copies of the pre registration plan to Planning Development and a letter stating how all the conditions imposed have been or are to be fulfilled. 18. The detailed design drawings for the water, sanitary sewer and storm sewer facilities for this plan be submitted by the developer to the Regional Public Works Department for review and approval. 19. The developer obtain Ministry of Environment Certificates of Approval to the satisfaction of the Regional Public Works Department for the necessary servicing for this development. 20. Immediately following notice of draft plan approval, the developer submit a letter to the Regional Planning and Development Department acknowledging that draft approval of this subdivision does not include a commitment of servicing allocation by the Region. Servicing allocation will be assigned instead at the time of final approval of the subdivision for registration purposes, and a similar clause be inserted in the subdivision agreement between the developer and the City. 21. Immediately following notice of draft plan approval, the developer provide the Regional Planning and Development Department with a written undertaking that all offers and agreements of purchase and sale which may be negotiated prior to registration of this subdivision shall contain a clause clearly indicating that a servicing allocation for this subdivision will not be assigned until the plan is granted final approval for registration. January 17, 2005 7 PD- 2005 -05 22. Prior to approval of the final plan or any on -site grading, the developer submit two copies of a detailed grading and drainage plan for stormwater management designed and sealed by a suitably qualified professional engineer and incorporating erosion and sedimentation control measures, to the Regional Planning and Development Department, and that the approved plan be implemented through provisions in the subdivision agreement. The professional engineer must also provide a letter, with seal, advising that the grading and drainage has been prepared in accordance with the Stormwater Management Plan prepared by Upper Canada Consultants, dated May 2002, for this portion of the Garner Road neighbourhood. 23. The subdivision agreement between the developer and the City of Niagara Falls contain provisions whereby the developer agrees to implement the recommendations of the approved Stormwater Management Plan prepared by Upper Canada Consultants, dated May 2002. 24. The recommendations of the Environmental Impact Study prepared by L. Campbell Associates, dated June 2004, be implemented through appropriate provisions in the subdivision agreement and the zoning by -law amendment to the satisfaction of the Regional Planning and Development Department. The objectives of the APR panel are. to provide independent urban design advice on a particular development project; to provide an independent opinion on the extent to which the planning and design objectives of the Tourist Area Development Strategy are being met; to make suggestions to any urban design changes which might better meet the planning and design objectives of the Tourist Area Strategy; and to provide the Director of Planning and Development, and City Council with an Architectural Peer Review Report for consideration in the review of the development application. The recent Tourism Policy Review, undertaken by the IBI Group, recommends a more expanded role of the APR panel. The Implementation Handbook contains seven urban design principles that are to be used by the APR panel to evaluate future development proposals. Within each principle are several urban design objectives and requirements that are to be met in order to ensure that there is conformity with the Official Plan. The APR panel has issued its report (attached) on the revised plans. Michael Kirkland, chair of the APR panel, will be in attendance to elaborate on the report should Council have any questions. This report can be summarized as follows: Although the tower design appears satisfactory, the site layout and composition fail with respect to appropriate urban design for the tourist core as stated in the Implementation Handbook. Notably, the tower should be located further east and be provided with a more significant podium to lessen impacts on the abutting Clark Street properties and better engage the Grand Boulevard frontage. Moreover, the extensive amount of surface parking and minimal landscaping is not an acceptable design solution when a dense compact urban form is being encouraged. Improvements to the tower design in terms of massing, exterior facade treatment and roof structure have been made. The tower dimensions and configuration essentially comply with the Implementation Handbook Guidelines. As there are conformity issues with several of the urban design principles that are contained within the Implementation Handbook that require resolution, the APR panel is not able to recommend the development proposal at this time. The areas of concern raised by the APR respecting site design, building locations, view corridors and microclimate are significant. These concerns and the lack of engagement of the Grand Boulevard illustrate that the proposed development does not comply with the Official Plan. On November 1, 2004, a public meeting was held to consider the subject application which proposes the construction of a 30- storey hotel at 5950 Victoria Avenue, as shown on Schedule 1. Details are shown on Schedule 2. At the public meeting, Council deferred its decision on the application due to the question of the completeness of the Architectural Peer Review. Staff reported back to Council on November 15, 2004 wherein Council was advised that the Architectural Peer Review of the application was incomplete. The applicant's solicitor acknowledged that this was the case and requested a deferral of the application until January 17, 2005. Since then, the applicant submitted revised plans in an attempt to satisfy the issues raised in the preliminary report of the APR panel. Two meetings were held by the APR panel to review the revised plans, firstly with the applicant, proj ect architect and staff in attendance and secondly, with staff. The Official Plan requires that all high -rise buildings over 10 storeys complete Architectural Peer Review. Grand Boulevard It is notable that the Grand Boulevard concept was conceived in TADS, underwent a rigorous public review process and was approved (without appeal) as part of OPA #26. The Grand Boulevard is one of five fundamental pillars of the new Official Plan and was recently reaffirmed by Council through the adoption of the IBI Group's Tourism Policy Review. The Grand Boulevard is at the heart of creating a world -class tourist destination in Niagara Falls. It is the spine which interconnects all the tourist districts by ensuring linkages to improve movements of pedestrians, vehicles and the people mover. Fundamental to the vision of the Grand Boulevard is the desire to untie the urban gridlock which exists on any summer day at the convergence of Clifton Hill and Fallsview with Victoria Avenue/Ferry Street/Lundy's Lane. Transportation engineers now recognize the need to address the traffic issues in the core area. The design of the Grand Boulevard should dictate the way in which development engages it rather than have development predetermine the form and function of the Grand Boulevard. The development, as proposed, does not comply with the Official Plan. The Official Plan and TADS Application Guidelines contain clear policies and criteria, respectively, of how private developments are to relate to the Grand Boulevard. These are the "rules of the day" with which there has to be conformity. Although the applicant has submitted a future concept, which is discussed further below, the fact remains that there are no guarantees that the developer will build the future concept. Thus, the 30- storey application, as proposed, does not comply with the Official Plan's policies respecting the Grand Boulevard. 3. Future Grand Boulevard Considerations In response to an application from the Victoria Avenue BIA, City Council is currently processing an application to amend the Official Plan proposing to remove policies pertaining to the Grand Boulevard. An open house has been scheduled for January 25, 2005 with a public meeting under the Planning Act to occur at the end of February. Depending on the outcome of the Grand Boulevard amendment, there could be significant implications for this application. The applicant submitted a future concept plan (Schedule 3) that shows how commercial buildings could be developed adjacent to the Grand Boulevard. This plan was produced as an afterthought to concerns regarding engagement of the Grand Boulevard. This plan represents a superficial collage of buildings that have no internal relationship to the existing Marriott Courtyard or the proposed 30- storey tower. The "out buildings" are not integral to the site design, unlike a properly designed podium -based building. A more comprehensive, holistic site design should be submitted that show integration of the hotel buildings and the Grand Boulevard contributing to a high quality public realm. It is significant to note that in 2003, Council approved a development proposal for a 10- storey hotel on the subject lands that had the hotel, with a podium, set against the Grand Boulevard in accordance with the Design Criteria. In 1999, when the Marriott Courtyard was proposed, staff requested a build -out plan showing how the subject lands would satisfy the policies and design criteria respecting development January 17, 2005 4 PD- 2005 -02 CONCLUSION adjacent to the Grand Boulevard. Schedule 4 illustrates this build -out concept that includes two public squares with landscaping and public art, a significant entrance avenue into the development and a 30- storey hotel with an extensive podium that engages the Grand Boulevard. These plans are far superior to that which have been submitted with this application and represent a mature, intense urban form that are respectful of the public realm objectives embodied in the Official Plan. Returning to the applicant's notion of constructing future outbuildings, there are several technical shortcomings associated with this proposal Conformity with Official Plan policies cannot be addressed through any promise to comply, undertaking or letter of credit. Even the inclusion of drawings within a site plan or building permit application cannot guarantee the actual construction of such outbuildings. The outbuildings are shown as a conceptual future phase. Underlaying this concept is a large surface parking area with minimal setbacks along the Grand Boulevard frontage and no provisions for landscaping, buffering and amenity areas. Because an Official Plan amendment for the Grand Boulevard is currently being processed, consideration of section 37 contributions attributable to the Grand Boulevard are very difficult to calculate at this time. However, if the streetscaping costs for Fallsview Boulevard were applied, the applicant would have to make a cash contribution of at least $165,000. Given that Fallsview Boulevard could not be provided with extensive streetscaping due to a constrained right -of -way width, it is very likely that, should Grand Boulevard develop as anything other than a people mover corridor, the streetscaping costs will be higher. Given that the assessment of the Boulevard through an Official Plan amendment application is now underway, consideration of the proposed development is premature. To summarize, the plan on Schedule 3 is essentially a step backward which requires a complete reassessment and redesign on the part of the applicant. The consideration of large -scale developments requires careful assessment. In two notable cases, the recent Hilton expansion and the proposed hotels on either side of the Skylon Tower, the Architectural Peer Review process was lengthy, with significant dialogue and plan revision. Both development proposals culminated in thorough, comprehensive designs that were accepted by the APR panel and recommended by Planning staff. Significant and complex developments require more review and assessment on the part of the panel and staff. Decisions respecting approval should not be hastened because of a developer's self serving agenda. The broader public interest must prevail. In this regard, the creation of a viable and attractive public realm is an essential component of the City's long -term vision. This vision must be the driver for determining how new building development is to occur, not the other way around. January 17, 2005 In conclusion, staff is recommending deferral in order to allow for the resolution of the peer review and Grand Boulevard issues. The project, is at this juncture, not in conformity with the Official Plan. As such, staff would not be able to recommend approval unless these conformity issues were satisfied by the applicant. Conclusions December 22, 2004 Project No 03 -2591 The following are the findings of the Architectural Peer Review Panel for a 31 storey Marriott Hotel building proposed for 5960 Victoria Avenue. A formal session was conducted on December 8, 2004 in which the proponent presented its proposal; a Peer Review Panel meeting was held on December 15, 2004 at City Hall. 1. Background The proposal is for a second hotel building on a trapezoidal property bound by Victoria Avenue and Ferry Street; the Grand Boulevard; a private property owned by the Skylon; and properties separating the site from Clark Avenue. The intent is to join the existing and proposed Hotel with the new hotel, depending upon the existing building for check -in and administration. Because the building exceeds 30 storeys in height it would require an OPA and is eligible for Section 37 contributions for additional height. The Peer Review Panel relies upon OP 26 and the TADS Guidelines as amended by the Implementation Handbook (2004). 2. Building Location Unlike a previous application for the site with new buildings placed along the Grand Boulevard corridor, the proposed thirty -one storey building has been located in an extreme westerly position on the site. In addition to bearing no relationship to the Grand Boulevard or a street, the building position poses major problems for the viability of building parcels along Clark Avenue. The building's 140 foot long west facade is as close as 10m. to the adjoining property line of the three quite shallow properties along Clark Avenue. This juxtaposition is very problematical for those parcels and would radically undermine the prospects for their redevelopment. Those properties should be assembled as part of the site or the building should be relocated to a more easterly position on the site. "It is important that development proposals clearly define the street wall or podium level, and illustrate how the proposed development addresses adjacent development on neighbouring blocks" Implementation Handbook, Pg. 13 The long building facade opposite the Clark Street properties creates substantial privacy and view problems and blocks the moming sun. There is also a potential serious micro climate problem identified in the proponents consultant (RWDI) report for the westerly facade of the building. "High wind activity is likely on the west side of the development, which includes two secondary exits/entrances and a service area. It is likely these areas will not be frequented by public and, therefore, higher speed winds am not a serious concern." RWDI, Pedestrian Wind Study, Pg. 7 The report does not analyze or comment on the effect on the close -by rear yards of neighbouring properties. The RWDI report would seem to suggest poor wind effects on these properties. 3. The Positive Building Base Principle "Recognizing that taller buildings will continue to be developed within the tourist district, all development proposals should have a clearly defined building base designed to animate and define public streets with active uses, such as retail store fronts, galleries, hotel lobbies, high quality landscaped courtyards, mid -block connections, and provide activities that contribute positively to the success of the adjacent street" Implementation Handbook, Pg. 13 Because the building is not related to either the Grand Boulevard or any street it does not fulfill these guidelines. The proposal provides a drawing concerning a potential future phase of development along the Grand Boulevard. The problems with this proposal, which on the face of it are quite positive, are two -fold: 1. The Grand Boulevard is currently the object of an OPA application by Victoria Avenue retailers to remove both the Grand Boulevard as a street and retail related to it. The absence of a street frontage would seriously jeopardize the viability of such a retail frontage, and would probably cause the phase two plan to be delayed, cancelled, or remain theoretical. 2. There would have to be a city/developer secured development agreement with implementation schedule for such an idea to have status. It is premature to assume the Grand Boulevard is other than that described in TADS, OP 26, and the Implementation Handbook; one of the five "City Building Pillars 4. The Positive Public Realm at Grade Principle "High quality private developments which compliment and enhance the public realm should be encouraged. To do this council shall establish a set of built -form regulations consistent with Section 4.1.21 of this plan" OPA 26 Policy 4.4.1 "New developments located along the Grand Boulevard should contribute to the vitality of the street by: (excerpts) 1 Creating building bases that are built to the street line. 2 Placing retail uses, cafes, outdoor gardens and other facilities along the street. 3 Fully screening any parking, loading or service areas." TADS Guidelines Design Criteria for the new Grand Boulevard The above and similar language in the Implementation Handbook require that the public realm be defined by buildings which screen parking and service areas. The proposal produces no street wall, outdoor garden or screening of parking and service areas. The properties' fagade on the Grand Boulevard is comprised of an open parking lot. 5. The Sky View Principle The proposal would be the first "tall" tower within its area. The size of the site would assure continued sky view if the building is setback adequately from its western and southern property lines. The current tower position could create significant problems in the future for properties on the Clark Avenue east frontage opposite the building. Given its context, its moderate extra width over the 40m. maximum above 15 storeys (TADS) does not pose a substantial problem. The maximum building width would be approximately 42.5m. to permit 10 rooms on the easterly face. The floor plate proportions are also essentially in compliance with the 1:1.5 rule (1:1.7) in the Implementation Handbook. 6. The Skyline Height Principle The building, by virtue of its being the first "tall" tower in its area, meets the ambition for a variable skyline. Future buildings along the escarpment will not gang up or appear with this building to be of uniform height as seen from the Niagara Parkway. 7. Niagara Falls Views and Vistas Principle The buildings' position in the most westerly portion of its site provides, according to the proponents, the only views of the Falls. No Evidence of this was submitted as part of the application or what views would exist if the tower was better positioned; to a more internal location on site. It is evident, however that the position of the building would block views of both falls for the adjacent property along Clark Avenue. The proposed tower position compromises their development potential in every scenario except acquisition by the proponent. 8. Positive Micro Climate Principle "Wind speeds in an open parking level may be elevated, due to openness." "Note that the two storey structure is a positive feature for reducing wind impact on the ground level. Without this structure wind conditions in the area immediately north of the proposed 30 storey tower would be uncomfortable and severe during the winter." RWDI Consultants Report, proponents Wind Study The proponents report anticipates severe wind conditions in various places in the site and proposes a series of tactics to solve the problem. The absence of a more extensive podium system as recommended in TADS greatly exacerbates the problems. 9. Parking and Circulation The project constitutes a substantial completion of major built form on the site. Under comprehensive site development, "...new development should concentrate parking in structured lots or underground." Implementation handbook, Pg. 51 In this development the entire space between the proposed and existing buildings and the Grand Boulevard is occupied by surface parking. This is an unacceptable outcome. It is also unnecessary since the proponent has arranged a special permission with City Council to provide its hotel parking off -site in a residential area. With the exception of a small amount of temporary parking, the project should either a) be in compliance with the above standard or b) be in compliance with the special arrangement negotiated with the city. If the parking is located as agreed, in a remote location, the additional traffic induced may put into question the validity of Delcan's traffic analysis. We recommend that the report be reconsidered in light of off -site valet parking, since such a parking arrangement will rpoduce additional traffic as a product of valet shuttling.. 10. Building Design The architectural design of the building, though characterized by its architect as preliminary, is a substantial improvement over previous versions. It manages to provide a consistent language and is articulated materially in a manner which reduces the slab quality resulting from its high base. It is partially a double loaded structure so that a bland "back" facade is avoided. Cornices and some banding articulate large surface areas. The perspective showing the building from the east does not accurately represent the site plan and parking proposal. 11. Conclusions 1. The panel does not recommend the proposal as submitted at this time. 2. The Grand Boulevard is currently under review. The current proposal is not in compliance with design requirements related to the Boulevard. This proposal may be untimely since a revised plan for the Grand Boulevard may or may not be easier for such a proposal to comply with. 3. The tower position is not acceptable and should be moved to the east as part of a revised site plan. 4. No at grade parking should be permitted on site except a limited amount related to drop off and valet activities. If the proponent wishes to maintain a substantial parking facility on site it should be in the form of an underground facility or a structure above grade which helps solve micro climate problems. An above grade parking structure with a ground floor addressed to the Grand Boulevard may allow future used which animate that frontage as required by the OP 26, TADS, and Implementation Handbook. 5. If the proposal were to rectify the other problems identified in this report and was deemed acceptable with its second phase built out along the Grand Boulevard corridor, that proposal should be secured under contract with the City of Niagara Falls. 6. The Peer Review Panel is available to assist the proponent to achieve an acceptable development proposal for this site which could include a hotel tower of the type proposed, in a modified form. J. Peggy Erwin has requested an amendment to the Zoning By -law for a 1555 square metre (0.38 acre) parcel of land known as 4145 Main Street, as shown on Schedule 1. The land is owned by the City and leased to the applicant forseasonal use. The applicant is proposing to build a 63 square metre (678 square foot) addition to the existing dwelling on the land, as shown on Schedule 2. The land is zoned Hazard Land (HL) which prohibits any building expansion. The applicant is seeking a site specific amendment to these provisions to allow the proposed addition. Working Together to Serve Our Community Clerks Finance Human Resources Information Systems Legal Planning Development January 17, 2005 2 PD- 2005 -08 As the land is an unopened road allowance owned by the City, which is subject to a 40 -year lease in favour of the applicant, Peggy Erwin approached Council at its September 20, 2004 meeting seeking authorization to apply for the subject Zoning By -law amendment. Council granted this request subject to staff looking into the lease and a public easement for the purpose of a possible recreational trail. Staff had recommended denial of this request because the expansion of the dwelling would entrench a private use on publically owned lands and erode the potential of promoting future public recreational uses along the Welland River waterfront. A copy of Staff Report PD- 2004 -84 is attached for reference. Surrounding Land Uses The Welland River lies to the north of the property. Immediately to the east there are some undeveloped lands. A parking lot lies to the west of the property while lands to the south are developed for mainly residential uses. Circulation Comments Building By -law Services No objections. Municipal Works Grading of the property will be subject to the standards of the Niagara Peninsula Conservation Authority. Parks, Recreation Culture Protection of Waterfront Lands in Other Municipalities Adequate services are available to service the land. It is unclear if citizens will have the right to cross the subject lands when traveling along the shore of the Welland River. Regional Municipality of Niagara The development abuts environmental lands and a fish habitat and must not adversely affect these natural resources. Regional Staff accept the conclusion of the Environmental Impact Study (EIS) and indicate impacts should be minimal, provided the recommendations of the EIS are implemented, grading is done to direct storm drainage away from the river and construction is completed in the late spring/summer, with disturbed areas revegetated immediately. To implement the above points, development needs to be subject to site plan control or a development agreement. It is common practice for municipalities to preserve waterfront areas for public use. Locally, municipalities with waterfront exposure, such as St. Catharines and Fort Erie, have policies ensuring January 17, 2005 3 PD- 2005 -08 public access to the waterfront is provided through the development process. The City of St. Catharines pursues, where appropriate, the acquisition of natural lands through the development process and facilitates public access for recreational use. The Town of Fort Erie has policies to increase public access to the waterfront and to reserve unopened road allowances abutting Lake Erie for public access and enjoyment. Ensuring the opportunity for public waterfront uses along the Welland River should take precedence over any application which proposes to entrench aprivate use. Planning Review 1. Entrenching a private use on this property is not in the public interest. The land is designated, in part, Environmental Protection Area (the area roughly between the house and Welland River) and, in part, Residential (the dwelling and the balance of the land). The Environmental Protection Area limits the use of lands to conservation, forestry, wildlife management and flood control and ancillary uses and structures. Environmental lands are encouraged to be acquired and maintained under public ownership. The Official Plan also encourages providing and maintaining public accessibility to natural resources, such as the Welland River. The entrenchment ofprivate uses on environmental lands or where such uses would undermine the objectives of public accessibility should not be permitted. Council granted a 40 -year lease on the property, for a lump sum payment of $25,000, to allow for the continued use of the existing seasonal cottage (Staff Report L- 2002 -10). The proposed addition would change a seasonal use to a year round dwelling. As such, the private use of this public property would be further entrenched and could compromise a future Council's ability to have the dwelling removed, as well as hindering the intent of the Official Plan to secure the Welland River waterfront for public recreational use. Approval of this application may set a precedent for redevelopment and entrenchment ofprivate uses on the other unopened road allowances leased in Chippawa, thus further reducing the future recreational use potential along the Welland River waterfront. Approval of this request is not in the public interest. 2. Should Council wish to approve the application, continued public access over the property should be secured first. Should Council wish to support this application, it should be conditional on the lease being renegotiated to ensure public access over the land for future public uses such as a waterfront trail. The City's Trails and Bikeway Master Plan identifies a multi -use trail running along the south side of the Welland River west of Lyon's Creek. A future trail running east from Lyon's Creek is to be further studied. As can be seen in Schedule 3, most of the land along the Welland River remains in public or semi public ownership (City, Niagara Parks Commission and Ontario Power Generation). The opportunity to develop apublic multi -use waterfront trail through Chippawa for community enjoyment would exist provided public use rights or easements were maintained. In this regard, the lease agreement with the applicant should be renegotiated. In addition, the lease agreement should contain clauses specifying the method and responsibility of demolishing the dwelling at the end of the lease period. January 17, 2005 4 PD- 2005 -08 3. Environmental Impact Study The Official Plan requires development proposals adjacent to significant natural features, such as the nearby Welland River Provincially Significant Wetland (PSW), to be accompanied by an Environmental Impact Study (EIS). This EIS is to evaluate potential impacts on environmental lands and determine methods to mitigate any negative effects. Approval of this application should be conditional on the implementation of the recommendations of the EIS supplied with the application. This study states this development should not have an adverse impact on the Welland River and the nearby complex, subject to the following conditions: The addition is maintained at the same distance from the Welland River and the PSW complex as the existing dwelling. Limits of work fencing and silt fencing be placed along the river side of construction. Fill placement be limited to areas away from the river or removed from the site. Construction in winter or summer to reduce erosion and sedimentation. Building setbacks could be addressed in an amending by -law. To address the other points listed above and Regional requirements, site plan control is recommended. The site plan process would define measures to protect the environment in an agreement and would secure a site plan deposit to ensure works are completed. 4. Expanding the dwelling does not meet the intent of the Zoning By -law. The land is zoned Hazard Land (HL). This zone does not permit expansion of the existing building, with the intent of prohibiting further entrenchment of uses that are not compatible with the environment. Approval of this application would compromise this intent of the Zoning By -law. Should Council wish to support the application, site specific provisions permitting the addition would have to be added to Zoning By -law No. 79 -200. These provisions should restrict the size of the addition to what is proposed and should ensure the setback of the addition from the Welland River is consistent with that of the existing dwelling. CONCLUSION: The application represents an entrenchment of a private use on publicly owned land that may hinder public accessibility and future waterfront development. Staff is of the opinion that the application is contrary to the intent of the Official Plan, and is not in the public interest, therefore, the request should be denied. Schedule 1 shows the locations of the subject lands. The road allowances are owned by the City but are leased to Ms. Erwin and Mr. Terrio under 40 -year agreements approved by Council last year. Mrs. Erwin proposes to construct a 612 sq. ft. addition to her existing 552 sq. ft. cottage, which would result in a 1,224 sq. ft. house. The intention is to create her year round permanent residence there. Mr. Terrio proposes to build a 532 sq. ft. living area addition to his 377 sq. ft. boathouse, resulting in a 909 sq. ft cottage. The proposals are shown as Schedules 2 and 3. The lands along the Welland River are zoned Hazard Land (HL) by Zoning By -law 79 -200. The HL zone recognizes existing dwellings (at the time of passage) but does not permit the conversion, extension or enlargement of the dwellings. Mrs. Erwin and Mr. Terrio are seeking Council's permission to submit an application to rezone the lands to allow for the enlargement of their buildings. This authorization is being sought because the City owns the lands. An earlier report on this matter was deferred from the July 12, 2004 Council meeting at the request of the applicant. Around 1980 my parents made upgrades to the building and amenities. Presently, the cottage is 550 square feet in size, fully insulated with energy efficient windows, electric heat, a new roof, cedar siding, and a contemporary cottage interior. The foundation' is concrete block piers to grade level and the cottage has City services for sewer and water. The building was appraised in 2000, and was described as "well maintained and in good condition Proposed Addition The addition we are proposing will be approximately 670 square feet and will be primarily located on the north -east side of the existing structure. There will be no demolition to the structure and we do not intend to add a basement. Attached are two suggested outside building elevations (Attachment 2), which we believe will fit nicely with the historic character of the neighbourhood. We have contacted a building design consultant and architect, who will work with us to design an attractive, unpretentious addition that will enhance the natural setting. ADDRESSING YOUR CONCERNS Legal Department We are willing to meet your conditions to provide Builders Risk Insurance and will acknowledge the demolition of all buildings or structures at our expense, at the termination of lease. We are willing to discuss other amendments to the lease that you feel may be helpful. Zoning Since this is an extension to the existing dwelling, we are prepared to make application to the Committee of Adjustment for a minor variance. We have decided to rescind our original proposal for a detached garage, and it will therefore not be necessary to pursue a Zoning By -Law Amendment. Other Agencies We have spoken to and recently written the Niagara Peninsula Conservation Authority, the Regional Municipality of Niagara and the Ministry of Natural Resources to ensure our plans to do contravene their legislation. At the recommendation of the NPCA, we acquired an amended land survey to indicate the flood plain contour. Accordingly, we have received verbal approval for our plans and are awaiting a written response to present to your office. As interested and affected parties we have several issues and questions that we feel need addressing. The land in question is zoned Hazard Land (HL), which prohibits an expansion of the existing dwelling. Can you elaborate on the Hazard Land designation? Are the concerns environmental? Is erosion, sewage or other waste, water usage, etc. the concerns? Are hazardous materials, or likely hazardous materials, buried in the area or on the proposed site? Are these, or are some other issues responsible for council's original decision to designate these lands, Hazard Land and prohibit just such an expansion? If the application is approved and the Hazard Land designation is amended to allow construction and expansion of the existing cottage, does this then set a precedence that permits others to exploit this amendment and construct and expand immediately on the riverside? If so, then we would truly face a Hazard Land situation, which the standing Zoning By -Law was in part enacted to prevent. If the Hazard Land designation was made in council for environmental aspects that accompany construction and expansion, or because of fears of exposure to some hazard then amending the By -Law defeats the intent of the original designation, and the area residents up and down the river stand to suffer any consequences that may result Is the land in question designated Hazard Land because the property is on the end of Sodom Rd. and as such is in hazard of being hit by bewildered drivers who attempt to go straight for the river at the intersection of Main St and Sodom Rd? if this is true does expanding the likely hood of some errant driver striking the dwelling by doubling the target size make sense? In the accompanying map attached to the Notice Of Public Meeting letter, identified as SCHEDULE 2, there are clear encroachments by the applicant both depicted and un- depicted or identified on the drawing. There is a storage shed, which is identified on the Schedule 2 Survey as in excess of 9 feet over the property line identified as City Lot 191, the North end of the shed encroaches on to the lands of Ontario Hydro. The entrance to the driveway encroaches more than 10 feet over the property line and on to the adjacent lot as identified on the Schedule 2 survey. More than fifty-two feet of the driveway lane, encroaches on to Lands Of The Ontario Hydro. The West corner, of the front deck, attached to the cottage at 4145 Main St, is given in the survey Schedule 2, as 3 feet from the adjacent Lands Of The Ontario Hydro currently under lease to a dock owner and area resident. The applicant has laid, or caused to be laid, 2 cedar Hydro Poles in excess of forty feet. This would effectively block the view of the river from various angles for many of the surrounding neighbours. If the amendment to the existing By -Law is allowed by City Council does the applicant and family intend to make this their fulltime year round residence? Although it is clear to see why the applicant is eager to see this amendment, given the applicants demonstrated light regard for the property line and zoning by -laws, it is a mystery as to why Council would be willing to grant such an amendment City Council made the Hazard Land Zoning By -Law designation prohibiting expansion at 4145 Main St in an informed and insightful decision, which was intended to prevent many of the issues discussed herein. We the undersigned see no reason to amend the Zoning By -Law and are opposed to the applicant's amendment proposal. We request to be notified if City Council approves, revises, or attaches conditions of the proposed amendment. The Hazard Land zoning recognizes the existing dwelling but would not permit its enlargement. A zoning amendment with site specific provisions is being proposed in order to allow the addition to the dwelling. These lands are located within the Regional Urban Area Boundaries for the City of Niagara Falls. The Regional Policy Plan also identifies tha Welland River and the immediately abutting lands as an Environmentally Sensitive Area. The Niagara Falls Official Plan designates these lands as "Residential" and the Welland River and its banks as "Environmental Protection Area The policies o'` both Plans would allow residential development provided any environmental issues can be addressed. The Niagara Peninsula Conservation Authority has indicated that the existing dwelling and the proposed addition are outside the Welland River flood plain and the registered fill line as mapped for the Conservation Authority. However, the Welland River and its banks in this area have been identified by the Ministry of Nato 'al Resources as a Type 1 (Critical) Fish Habitat and as a Provincially Significant Wetland. Therefore, any development must not have adverse environmental impacts on the fish habitat or the wetlands. At our request, the applicant has submitted an Environmental Impact Statement (EIS) prepared by L. Campbell and Associates to evaluate the potential environmental impacts of the proposed dwelling expansion. TA,INCIL MEETING JAN 1 7 2005 y Regional Planning staff accept the conclusions of the EIS report that indicate that the impacts of the proposed dwelling addition should be minimal provided certain measures are implemented. Therefore, Regional Planning staff are not opposed to the adoption of the proposed zoning amendment as long as the following measures are implemented: that any structural addition be no closer to the Welland River than the existing structure, that limits of work fencing and silt fencing be placed between the structure and the River in line with the existing deck, that no fill be placed on the river side of the existing and proposed structures, that grading and drainage plans to ensure that storm drainage is directed away from the Welland River be approved by the City, and that construction take place during the late spring or summer and that any disturbed areas be revegetated immediately after construction is completed. The implementation of these measures will require more than just the adoption of the proposed zoning amendment, A site plan control agreement, a development agreement and /or an amended lease agreement may be appropriate procedures to ensure that these measures are satisfied. Planning Review 2. The proposed zoning amendment is appropriate. Given the size of the plaza and its function as a local convenience commercial centre, the proposed change should not compromise Regional or Provincial planning interests. There are no objections from a Regional planning perspective. Municipal Works No objection. A 12 metre by 12 metre daylight triangle dedication at the intersection of Thorold Stone Road and Dorchester Road will be required if the property is redeveloped. In addition, a letter from a resident is included on the agenda. The resident does not object to the proposal but does not want the vacant, residentially zoned lands to the south to be used in the future for plaza parking. 1. The proposal complies with the intent and purpose of the Official Plan. The land is designated Minor Commercial in the Official Plan. A wide range of retail outlets, personal service shops and limited offices are permitted under this designation to serve a segment of the population. The current designation for the land was established in 1993 with the adoption of the current Official Plan. Prior to this, the land was designated Residential with a special policy to permit the current commercial uses and guide the construction of the subject plaza. The Minor Commercial designation permits retail uses at the scale being contemplated in the requested Zoning By -law amendment. The proposed zoning will harmonize the zoning of the land with the current Official Plan designation. The land is zoned Neighbourhood Commercial (NC -270). This zoning, established under a previous Residential Special Policy Area designation, limits retail uses to 325 square metres (3,497 square feet). There are no limits placed on other uses permitted under this zoning, such as restaurants, offices, banks and personal service shops. Lifting of the cap on retail uses is appropriate given the current designation of the land. January 17, 2005 3 PD- 2005 -04 Minor Commercial nodes are typically zoned General Commercial which does not limit the size of commercial units. Recently, Council approved a zoning amendment for a nearby NC zoned property at 6754 -6788 Thorold Stone Road to increase the maximum floor area allowed per use to 450 square metres (4,844 square feet). This new cap reflects a limit above which area an increased parking standard is applied by the by -law. The property at 6754- 6788 Thorold Stone Road has parking constraints that the subject land does not have. Currently there are approximately 20 surplus parking spaces on the subject land that would enable more intensive commercial uses to establish. Furthermore, the size and configuration of the plaza should limit the size of uses to a scale consistent with commercial units in this node. Therefore, there is no need to introduce a cap on unit sizes in this development. The current and proposed zoning does not permit expansion of the plaza nor parking or driveways onto the vacant residentially zoned lands to the south of the plaza. CONCLUSION: The amendment can be supported for the following reasons: The proposed lifting of the cap on retail uses is within the intent of the Minor Commercial designation of the lands; Other uses permitted in this site specific zone are not restricted by size, therefore, it is Andrew Bryce Planner 2 appropriate to lift the cap on retail uses; and The amending by -law on tonight's agenda implements the above recommendation. Join Four Lots into One Parcel for the Purpose of Providing Required Parking It is recommended that Council approve the Zoning By -law amendment application to join the four lots into one parcel for the purpose of providing the required parking for the existing development and to formalize the earlier approved variances. Niagara Artcraft Woodworking Company Ltd. has requested an amendment to the Zoning By -law for the lands known as 4395 and 4417 Kent Avenue, as shown on Schedule 1. The firm's buildings and parking exist on all four lots, as shown on Schedule 2. The applicant is seeking to join or "marry" the lots into one parcel for the purpose of providing the required parking for the existing development. The lands are zoned Light Industrial (LI). Site specific provisions are requested to allow required parking for the development to be located on any of the four lots that constitute the subject lands. In addition, previous variances that were approved for the lands are proposed to be recognized in the amending by -law. As the owner needed to proceed quickly with the current expansion, parking arrangements outlined in this report were approved by the Committee of Adjustment earlier this year. The requested housekeeping zoning amendment will fulfill the condition of the Committee of Adjustment to formalize the arrangement in the Zoning By -law. Circulation Comments Municipal Works No objections. Parks, Recreation Culture No objections. Planning Comments 1. The proposal complies with the intent and purpose of the Official Plan. The lands are designated industrial in the Official Plan which permits the current industrial use. The Official Plan encourages high quality development and a strong corporate presence along the Q.E.W. which has occurred in part through the ongoing redevelopment of the subject lands. The requested zoning amendment will recognize several minor variances that allowed this redevelopment to proceed. 2. The proposed zoning amendment is appropriate. Although the lands currently function as one property, legally they are four separate lots. Three of the lots are encumbered with buildings. All four lots are needed to provide the required number of parking spaces. The proposed zoning amendment is a technical change that will recognize that required parking for the factory can be provided anywhere on the subject lands. "Marrying" the parcels through a by -law will prevent a situation where a lot(s) is separated from the rest of the lands, leaving insufficient parking. In addition, the proposed by -law will incorporate other earlier variances approved by the Committee of Adjustment with respect to the existing development. The following minor variances are proposed to be incorporated into the site specific zoning: Reduction of the required rear yard setback from 7.5 metres (24.6 feet) to 6.1 metres (20 feet). Reduction of the required southerly side yard setback from 3.5 metres (11.5 feet) to 1.5 metres (5 feet). Lot coverage requirements to be applied across the lands rather than the individual parcels. Incorporation of these earlier Committee of Adjustment approvals into a single site specific zoning by -law is another housekeeping matter that will make interpretation of the applicable zoning standards easier to decipher for any interested parties. January 17, 2005 •3 PD- 2005 -03 CONCLUSION: Formalizing the earlier Committee of Adjustment approvals with respect to parking, building setbacks and coverage through a housekeeping amendment meets the intent of the Official Plan, will ensure sufficient parking is provided for uses on the land and will make applicable zoning standards easier to understand. We are asking you to join us in pressing the Ontario and federal governments to move quickly in creating a new national child care program. We have two actions that we are asking you to take. First, we hope that, if your council has not already done so, you will join with the municipalities that have approved motions calling on federal, provincial and territorial ministers to use their January meeting to forge a deal based on: 1. a publicly funded, sustainable system for quality child care 2. a Child Care Act that guarantees standards and the principles of quality, universality, accessibility, developmental programming and inclusiveness 3. public accountability tied to provincial and territorial five -year plans that contain goals, timelines and targets as well as a way to measure real progress in developing comprehensive family- and centre -based child care services 4. a commitment to a transition plan that moves to public and/or not- for -profit delivery of child care services. For more information about how such a child care program could be put into place, please refer to the Ontario Coalition for Better Child Care policy paper To Boldly Go Towards a comprehensive child care system in Ontario, available at childcareontario.org. Secondly, we are asking that you write to Premier Dalton McGuinty and Children and Youth Services Minister Marie Bountrogianni to request and meeting with child care stakeholders, including municipalities, labour, the child care coalition and others to discuss how Ontario can help move the federal agenda forward in a direction that will work for families in this province. In particular, our communities want to ensure that public money is going to children and not to profit. A recent legal opinion obtained by CUPE shows just how important this issue is as a new system is developed. According to that opinion, if the federal government allows for profit child care as part of a pan- Canadian program, the entire child care system is more likely to fall under very restricrtive rules imposed by NAFTA and GATS. Once a public service or program falls into corporate hands, both deals make it virtually impossible to reverse that decision. The Cost Analysis Schedule, attached as Appendix "1 compares the 2004 and 2005 annual premiums and indicates an increase of approximately 1.9% or $13,025.00. Increasing Deductible for all Licensed Vehicles Frank Cowan Company has recommended that consideration be given to increasing the limits of the deductible levels with respect to all licensed vehicles as follows: Third Party deductible to be increased from nil to $10,000.00 Direct Compensation deductible to be increased from nil to $10,000.00 Attached as Appendix "2 "is a copy of the Cost Comparison of Optional Deductible Levels. The City's past 5 year claims history indicates that the Third Party claims cost to the City has been $3,738.00 and the Direct Compensation claims cost to the City has been $6,529.00. The total annual premium paid for licensed vehicles is $97,175.00. Therefore, the annual premium, plus claims cost to the City totals $107,442.00. Incorporating a deductible for all licensed vehicles with respect to Third Party and Direct Compensation claims, would result in a decrease to the insurance premiums of $19,478.00. The annual premium for licensed vehicles would then total $87,964.00. Changing Replacement Cost to Actual Cash Value for Light Vehicles In the past, premiums have always included Replacement Cost coverage for light vehicles and trailers. Through a review of the type of coverage, it was determined that as part of the yearly rate for vehicles, approximately $2,000.00 is included for the replacement of the vehicle at the end of its Life. Therefore, the City has in a sense been paying for the replacement cost twice and the need for Replacement Cost coverage is no longer necessary. By changing coverage for light vehicles and trailers from Replacement Cost to Actual Cost Value there would be a premium savings of approximately $3,000.00 annually. REVIEW OF SCHEDULES TO VARIOUS POLICIES As of 2004 Legal Services has the responsibility of negotiating and finalizing the insurance premiums for the City's insurance policies with Frank Cowan Company. It was decided that a full review of the City's assets should be undertaken to determine if the City's property insurance was adequate. Staff reviewed the insurance coverages and the applicable Schedules that apply to each policy for accuracy and determined that various coverages for buildings and contents were too low and required to be increased. January 17, 2005 5 L- 2005 -03 Service Centre and Recreation Building Contents It should be noted that there is no coverage for office contents at the Service Centre, at this time. It should also be noted that there is no coverage for office contents at the Recreation Building on Lundy's Lane. However, as construction of the Community Centre is underway contents coverage can be implemented for the new Recreation department in the near future. Data Processing Data processing is presently insured for a value of approximately $1,000,000. Information Systems has advised that the City's data processing equipment is presently valued at approximately $3,000,000. Therefore the City's present coverage of $1,000,000 will need to be increased to $3,000,000. Copiers It has been determined that the Schedules for copiers are out of date and no longer reflect the appropriate coverage. Pursuant to our Lease Agreements the City is obligated during the term of the Lease to keep the equipment fully insured for its full replacement cost against loss by damage, fire, including extended coverage, theft, collision and all other losses and against liability arising from damage to property of others and bodily injury or personal injury, naming the Supplier as the first loss payee. Therefore the City's present coverage of $211,000.00 will need to be increased to $475,000.00. In an effort to bring the premiums down, future Lease Agreements should be negotiated to include insurance coverage on equipment for actual cash value. Recreational Parks It is determined that there are approximately 50 playgrounds in the City. The value for each playground is approximately $25,000. Although the insurers are not in favour of a limited coverage for playgrounds, they have agreed to permit a limited coverage to the City of Niagara Falls. The coverage on the playgrounds is set at a limit of $77,300 at any one location for any one loss. Coverage for recreation floodlighting will be increased to $330,000.00. This will insure that parks containing dual lighting systems such as Girls Home for Soccer on Kalar Road, will have sufficient coverage. Although the insurers are not in favour of a limited coverage for floodlighting, they have January 17, 2005 agreed to permit a limited coverage to the City of Niagara Falls. BACKGROUND: Mr. William Amadio of Broderick and Partners, requested on behalf of his client, The Niagara Catholic District School Board the conveyance of the subject lands from the City. Attached as Schedule `B" is a copy of the letter received by Mr. Amadio, dated November 4, 2004. The School Board owns all the lands abutting the subject lands, as shown in heavy outline on Schedule "A" attached. St. Ann Elementary School is currently situated on the abutting lands. The subject lands are triangular- shaped and are approximately 20 metres, by 14 metres, by 14 metres, being 98 square metres (1,054 square feet). The subject lands are presently landlocked. The subject lands were conveyed to The Corporation of the City of Niagara Falls on February 9, 1962, for the purpose of The Hydro- Electric Commission of the City of Niagara Falls "Hydro servicing abutting lands via underground distribution lines from the corner of Lewis Avenue and Magdalen Street, by way of an easement in favour of Hydro. The easement connects to the subject lands. Niagara Falls Hydro has confirmed that the Electrical Distribution Plant in that area has since been upgraded and the old plant has been abandoned. The adjacent lands are now serviced from a dedicated overhead distribution pole line. Hydro has confirmed that it will release its interest in the easement and therefore, the connection to the subject lands is no longer required. A second easement which is "T" shaped, as shown on in heavy outline on Schedule "A "attached, was conveyed to The Corporation of the City of Niagara Falls on January 22, 1969, for the purpose of the City maintaining a watermain along the former Lincoln Street and Slater Avenue. Municipal Works has confirmed that it has implemented new infrastructure at the intersection of Lewis Avenue and Forsythe Street that now feeds the abutting lands. All watermains on the easement lands have been disconnected and abandoned, which eliminates the requirement for the easement over the easement lands. January 17, 2005 Staff has no objections to conveying the subject lands and recommends that the subject lands should be offered for sale to the School Board, for nominal consideration. BACKGROUND: In February 1987, City Council adopted a strategy to address chronic flooding problems in the rural area by establishing a number of Municipal Drains under the authority of the Drainage Act. In a report prepared by J. Bryon Wiebe Ltd., Consulting Engineers and Planners, twelve (12) areas were identified based on complaints received from the Public and feedback from the Road Supervisors. The recommended strategy has been slowly implemented to date largely due to limitations to available funding in the Capital Works Budget. A summary of the status of these projects is shown in Appendix "A" entitled, "1987 Report on Rural Drainage Problems." Municipal Works staff would like to confirm their support for the use of the Drainage Act because it allows us to secure property outlets that traverse private lands and gain access for the purposes of timely maintenance and inspection. Without a formal easement or Municipal Drain status, the City exposes itself to considerable liability and risk when working on private property. The 1987 report also included some helpful information which has been copied and included in Appendix "B" of this report. This information entitled "Common Law Aspects of Drainage" is a valuable resource in understanding the rights and obligations of municipalities and landowners with respect to drainage matters. Notwithstanding the City's efforts to address these problem areas, Municipal Works staff continues to receive complaints and requests for localized ditching. It is critical that any drainage works allow storm water to reach a proper outlet so that we are not just relocating the problem. Working Together to Serve Our Community Municipal Works Fire Services Parks, Recreation Culture Business Development Building By -Law Services January 17, 2005 MW- 2005 -06 Municipal Works staff is currently completing the design for the Union Marsh Drain, (see Appendix "C and expect to proceed to construction this summer. Once the outlet has been cleaned and proper culverts constructed, a considerable area south of Chippawa, including the roadside ditches, will drain more efficiently. The ditching program for 2006 will target this area specifically. The Municipal Works department spends approximately $100,000 per year on routine ditching, however, its effectiveness is limited to the availability of the outlet. It is recommended that funding be increased to $135,000 per year once the downstream works are completed in each watershed. Due to the fact that it takes approximately three years to initiate and complete a Municipal Drain project, staff is recommending that we commence the engineering phase for Hunter's Drain in 2005 and Boyer's Creek Drain in 2006. The costs of these projects are dependent on the scope of work involved, however, the benefitting landowners will be issued an assessment in accordance with the Drainage Act thereby reducing the City's share. Engineering costs for proj ects of this magnitude will be in the $50,000 $75,000 range and are included in the 5 -year Capital Budget. Common law is largely a matter or precedent and naturally precedents can be modified as customs change and new practices arise. Natural Water Courses Almost all of the law governing natural water courses is founded on the phrase that "water flows naturally and should be permitted thus to flow Generally the definition of a natural water course is that it is a stream of water which flows along a defined channel, with bed and banks, for a sufficient time to give it substantial existence. This also includes steams that dry up periodically. Natural water courses do not cease to be such if at a certain point they spread out over a level area and flow for a distance without defined banks before flowing again in a defined channel. Riparian Rights A riparian owner is on whose land is in actual contact with the stream of water. A riparian landowner has the unique right to drain his land into that water course. Where a road allowance crosses natural water course, the owner of that road allowance acquires riparian rights and may therefore drain the road allowance into the natural water course. Natural Drainage Rules The Fisheries Act Appendix `B" MW- 2005 -06 The following are some natural drainage rules based on Common Law: a) a natural water course must not be obstructed or diverted; b) surface water must not be collected and diverted to land that would not naturally receive it; c) the point of entry of surface water on lower land must not be changed; d) water must not be brought in from another watershed; e) landowners cannot accelerate the flow of water to the material damage of lower land; t) low land may be filled and the water forced out into natural channels; and g) municipalities must not drain into private drains. When a stream becomes by natural causes, silted up or choked by weeds, and as a result overflows adjoining lands, there is no common law liability on the owner to clear the channel or to compensate adjoining landowners who ma be damaged. The extent of the obligation imposed upon the owner of the lower land is not to alter the condition of the natural water course. If any person above or below makes any change to the natural flow of a steam to the material injury of owners situated upon the stream, that landowner is liable for the damage that he may cause. The principle of the Common Law is that it is the duty of anyone who interferes with the course of a natural stream to see that the works which he substitutes for the cannel provided by nature, are adequate to carry the water which may be brought around even by an extraordinary rainfall event. The principles of the Drainage Act follow very closely this principle of Common Law. Once a natural water course becomes part of an artificial drainage system, it is no longer immune under the law, i.e. the entire system must have a safe and proper outlet. Any ditching or excavating work that has the potential to destroy fish habitat must be reviewed and approved by the Ministry of Natural Resources on behalf of Fisheries and Oceans Canada. Fish habitat is described as "spawning grounds and nursery rearing, food supply, and immigration areas on which fish depend directly or indirectly to carry out their life processes Areas which may not be considered Canadian fisheries include private ponds, stormwater management ponds, and those roadside ditches which are not connected to fisheries waters. The Niagara Peninsula Conservation Authority provides technical advice and coordination with the Ministry of Natural Resources and is the best point of first contact. The following matter was recently discussed by the Municipal Heritage Committee and is being brought forward for Council's consideration. City of Niagara Falls Cemetery Services is responsible for the administration and operation of the Columbarium located within the Old St. John's Church. Cemetery Services is making a request to install a permit access system for visitors to the Columbarium via a card reader and to provide a system of closed circuit video surveillance and recording. Cemetery Services states it will provide a system that is sensitive to the heritage aspects of the structure. By -law No. 78 -24, reasons for designation, states the limestone building with stuccoed facade is a good example of early Nineteenth Century Canadian Vernacular architecture. The St. John's Anglican Church is one of the oldest surviving churches in Ontario. It was restored in 1985. The Committee was able to determine that the installation of the card reader on the outside of the door frame would not damage the character or integrity of its designation as a Cultural Heritage Property. In conclusion, the addition of the card reader and video surveillance camera do not affect the reasons for designation. In a letter dated November 29, 2004, the applicant's solicitor submitted a request to remove this property on the northwest corner of McGarry Drive and Joseph Court from Part Lot Control (see attached letter and Schedule 1). This process enables the division of lots or blocks within a registered plan of subdivision. The general intent of removing Part Lot Control is for the minor redesign of subdivision lots or the separation of semi detached or on- street townhouse units. The subject land is a large lot within the Garner Estates Phase 4 plan of subdivision that was registered in September 2004. The division of this property into more typical -sized lots was contemplated in the review of the original subdivision application. The installation of services for the subdivision provided three sets of laterals to the lot in anticipation of its further separation. The attached draft Reference Plan (Schedule 2) shows the proposed division of Lot 108 into three parcels. Parts 1, 2 and 3 on the Reference Plan are to be added to Blocks 24, 25 and 26 within the Futino Estates draft plan of subdivision to the north. This abutting subdivision was recently approved with these blocks to enable the creation of the additional lots. Lot 108 and the blocks are zoned Residential Single Family 1E Density (R1E) through Zoning By -law No. 79 -200. These merged properties exceed the minimum zoning lot size requirements and will be compatible with the surrounding development. Approval of the Part Lot Control by -law is required to legally create new property lines on Lot 108. Presently, the City of Niagara Falls, in partnership with Healthy Living Niagara are planning a series of community-based physical activities to take place during the winter months of January, February and March. Activities include free public swimming at the YMCA and Boys and Girls Club, as well as tobogganing and free public skating. As you may know, the health and quality of life of close to two- thirds of the people in Niagara are threatened by physical activity. According to the Canadian Physical Activity Guide, adults need to accumulate 30 -60 minutes of moderate physical activity every day to improve health, and children require approximately 90 minutes. The goal of Winter Active 2005 will be to assist families in Niagara Falls to meet the recommendations set out by Health Canada. As well, the event will focus on providing families in Niagara Falls the opportunity to participate in fun, healthy and enjoyable activities during the winter months. That Council approve the establishment of an Operations and Services Committee. 2. That Council direct staff to prepare a by -law to establish an Operations and Services Committee. 3. That Council dissolve the current Steering Committee that was created by Council to plan, develop, and implement the Community Centre. City Council delegated the responsibility to plan, develop and implement the Niagara Falls Community Centre to a Steering Committee. This Committee was formed in 2000 and includes seven (7) members representing the three (3) primary Participants, being the City (3), the Niagara Falls Library Board (2), and the YMCA of Niagara (2). The Committee was structured to reflect and build upon the co- operative spirit that exists between the partnering agencies in the Community Centre. The Steering Committee has served Council and the community well, guiding a complex project and dealing with project issues. Since its inception, Alderman Pietrangelo has Chaired the Steering Committee. Council reaffirmed the continuing leadership of the Steering Committee by Alderman Pietrangelo as it made its transition from planning and development to operations and services in the new Centre. The Steering Committee considered the roles and responsibilities of an Operations and Services Working Together to Serve Our Community Municipal Works Fire Services Parks, Recreation Culture Business Development Building By -Law Services January 17, 2005 R- 2005 -02 Committee in a Discussion Paper they (Steering Committee) approved on April 8, 2004. The Steering Committee recommended the establishment of an Operations and Services Committee prior to the opening of the Community Centre and that it provide for equitable representation from the three (3) principal Participants. The proposal to create an Operations and Services Committee for the new Centre has been further reviewed by senior staff and the partnering organizations. The operation and management of the Community Centre will be a shared responsibility among the three (3) principal Participants (City, Library, YMCA). The nature of the relationships and the obligations of the Participants will be fully established in agreements between the City and the other two (2) Participants. The Agreements will meet the needs of all Participants for the autonomous management of their operations and allow for the sharing of costs and management responsibilities, where such sharing is in the best interests of all concerned. It is felt that the current Steering Committee, which was designed to facilitate the planning and development of the project by building on the strengths and co- operative objectives of the principal partners, is best suited for the continued facilitation of agreements between participants' role and hereinafter should be referred to as the Operations and Services Committee, responsible for the continuing operations of the Community Centre. Conclusion By extending the mandate of the Steering Committee and allowing for its transition into an Operations and Services Committee, Council will effectively allow the partners in the Community Centre to move on with a number of new planning initiatives such as: 1. Lease and operating agreements for the Participants and tenants; 2. The 2005 annual operating budget and five (5) year capital construction program; 3. Design decisions on matters such as external and internal signage, donor wall details and Community Centre finishes; and 4. Preparation of a Community Center operating policies and procedures manual. Having regard for the need to work together with the other Participants and tenants, it is Staff's conclusion that an Operations and Services Committee as described herein will best serve the City and our community.
