WHEREAS the Minister of Justice and Attorney General of Canada and the Minister of
National Health and Welfare of the Government of Canada established the Committee on
Sexual Offences Against Children and Youths with a mandate "to inquire into the
incidence and prevalence in Canada of sexual offences against children and youths and
to recommend improvements in laws for the protection of young persons from sexual abuse
and exploitation" with instruction to obtain "comprehensive factual information" about
these issues and also to "examine the problems of juvenile prostitution and the
exploitation of young persons for pornographic purposes";
AND WHEREAS during the century following Confederation in 1867 there was no major
revision of the complete legal framework of the Canadian criminal law of sexual offences,
however since the beginning of the 1980's several significant legislative amendments and
proposals have been brought forward in response to a growing public concern about the
need to provide better protection against these crimes;
AND WHEREAS the Committee's mandate was to determine the adequacy of the laws and other
means used by the community in providing protection for children against sexual offences
and to make recommendations for improving their protection;
AND WHEREAS the Committee submitted its voluminous Report dated August 1984 entitled
"Sexual Offences Against Children" to the Federal Minister of Justice and Attorney
General of Canada and the Federal Minister of National Health and Welfare which
contains 52 Recommendations under the following titles:
Office of the Commissioner (Recommendation 1)
Education for Protection (Recommendation 2)
Reform of the Sexual Offences ( Recommendations 3-17)
Principles of Evidence (Recommendations 18-27)
Strengthening the Provision of Services (Recommendations 28-34)
Information Systems (Recommendations 35-38)
Research (Recommendations 39-40)
Juvenile Prostitution (Recommendations 41-48)
Pornography (Recommendations 49-52)
THEREFORE BE IT RESOLVED that the Council of the City of Niagara Falls petition the
Government of Canada and the Government of Ontario to seriously consider the implementation
of the 52 Recommendations contained in the August 1984 Report of the Committee on Sexual

WHEREAS the Regional Municipality of Niagara has placed a
control order on eight industries in the City of Niagara
Falls to enforce the improvement of their sewage effluent;
AND WHEREAS the industries have provided documentation
which collectively supports a total cost of $3,237,000.00
for pollution control equipment;
AND WHEREAS the Province of Ontario, through the Ministry
of Treasury and Economics, offers a program entitled The
Community Economics Transformation Agreement, which is a
fund to assist in job creation projects and enterprise
development particularly involving the private sector;
NOW THEREFORE we hereby petition the Province of Ontario
through the Region of Niagara for funding to assist these
industries in an amount of 50% of the total cost or
$1,618,500.00.

been successful in obtaining an Order from the Supreme Court of British Columbia
prohibiting persons from engaging in prostitution in certain public areas of the
City of Vancouver;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls deems it
desirable to request the Attorney General of the Province of Ontario, the
Honourable Roy McMurtry, to seek a similar remedy in the Supreme Court of Ontario
to prohibit persons from engaging in prostitution upon streets in the City of
Niagara Falls;
NOW THEREFORE BE IT RESOLVED:
1. That the Council of the Corporation of the City of Niagara Falls hereby
requests the Attorney General of the Province of Ontario, the Honourable Roy
McMurtry, to make application to the Supreme Court of Ontario for an order in the

The Queen Street Business Improvement Area consists of most of the core of the C.B.D.
with all the blocks having frontage on the main thoroughfare, Queen Street. The boundary is
as follows: North-Park Street, East-Conrail (main line), South-Huron Street, West-property
lines adjacent Victoria Avenue (see attached Map A).
The Board of Management has actively either initiated or taken part in moves toward
Downtown Revitalization, improving the River Road entrance, increased liaison with Chamber
of Commerce and Visitor & Convention Bureau, promoted the Farmers' Market, surveyed attitudes
of merchants, created free parking at merchants' expense, actively (and with success) found
tenants for some vacant stores, pressed for more uniform store hours and created themes for
various promotions (advertising and event).
All the foregoing items are already documented more fully and can be made available
should they be required. For specific activities of 1984 and a letter of support, see

People brought in through increased visitor/tourist traffic in the downtown from both the
improved River Rd. and Erie Ave. entries should immediately decide to stay downtown for some
shopping and viewing because of improvements to this very visible high traffic part of the
CBD (Civic Centre & major department store). The improvements will provide an adequate &
attractive parking area which should attract businesses to the adjacent vacant buildings,
some of which will have been encouraged to upgrade their premises (front & back) in keeping
with their new surroundings. Some owners could renovate upper levels to attract either com-
mercial or residential uses.The B.I.A.members will be encouraged by this activity to put more
emphasis on downtown beautification in their budget. Their effort of beautification in the
remaining 11 BIA blocks will complement the beautification and upgrading which the City
intends to undertake under the Province's CAIP initiatives.

Recommendation:
That Council consider the allocation of an'amount of approximately
$10,000 from the Planning Department study reserve fund carried over from
the 1983 budget to obtain consultant's services for preparing City-wide
Community Improvement policies required under the new Planning Act.
Background:
Following Council's instructions of January 9, 1984, staff has
prepared a detailed application for Provincial C.A.I.P. funding, focussing
on the improvement of municipal services and streetscape aesthetics
associated with several downtown blocks in the vicinity of Queen Street and
River Road.
The proposed C.A.I.P. application is covered by a separate report
appearing on tonlght's agenda. This report addresses one specific matter
of the application, namely question l(a):
"Does your municipality have an approved Official Plan with
policies relating to Comnunity Improvement?"
As Council has been informed previously, the new Planning Act
requires the preparation of comprehensive OFFICIAL PLAN POLICIES and the
establishment of a~ea by area IMiDROVEMENT PRIORITIES as a prerequisite for
any future Provincial funding programme such as C.A.I.P. (Ccmmercial Area
Improvement Program). The new legislation causes a considerable workload
for the required planning studies but the Province rationalizes this by its
opinion that such studies will ensure that the greatest economic benefit is
achieved when public funds are used to improve community services and
facilities in older areas. (The need to integrate Community Improvement
policies with the overall municipal plannLng and financial planning process
Js further explained in the attached Planning Act Guideline.)
Council was advised in a previous report, PD/94/83, that an
application for C.A.I.P. funding could be subcn[tted for part of the Clty's
downtown wiFhout the need to prep.~re co~prehensll;e Community Improvement
Policies as the area had alre~d7 been desLgnated as a Redevelopment Area
under the former Planning Act. Neverrheiess, as part of the application
(Quest[on l(a)) the Province requires ~ item c{,mrnitment on the part of the

been specified as the date when Community improvement policies will be
completed.

The. need to prepare Community improvement policies at an early
date is not only important for the present C.A.I.P. application, but is
also a mandatory requirement for any future O.N.I.P. pro~ects or subsequent
Commercial or Industrial Area Improvement projects. For example, the
Building Department will be processing an O.N.I.P. application to be
considered within the next month or so.
From the foregoing, it is essential for the municipality to
clearly establish its needs, improvement priorities and strategies for
overall co~munity improvement as part of its Official Plan and to
realistically co-ordinate same with the municipality's financial ability to
pay relative to other demands on taxes· In view of the comprehensive
nature of the Community ImproVement policies which are required under the
new Planning Act legislation and the urgency for their preparation, it is
recommended zhat serious consideration be given to obtaining the services
of a planning consultant familiar with the development of these new types
of community improvement strategies and cost/benefit analysis. Planning
staff would, of course, undertake detailed information gathering with
respect to identifying the adequacy of community services and facilities
throughout tka City. The services of a consultant would be concentrated on
analysis and policy formulation. Staff have ascertained that the cost of
this work would approximate $10,000. If acceptable to Council, funding for
this project could be taken from the Planning Department study reserve fund
carried over from 1983 and which was part of the monies budgetted for
Secondary Pla~niDg work for the Clifton Hill area.
Conclusion:
The need to prepare comprehensive Official Plan policies for
Community Improvement under the new Planning. Act is considered as a
priority project for the reasons identified in this report. The policies
will benefit Council's decision-making process in applying for future
Provincial assistance under programs such as C.A.I.P. and O.N.I.P. as all
potential Cor~unity Improvement areas will be identified on a priority
basis. Th~s will be invaluable in the City's financial priority planning
process as the need for community improvements from one area to the next
will be kno~ at the. outset and lone range budgettinS can be co-ordinated
with the priorities established by Official Plan policies and with other
needed expenditures on public works.
Council's serious consideration of the recommendation contained in
this report is respectfully requested.

DOWNTOWN REVITALIZATION - SUPPORT DOCUMENTATION
FOR CHOOSING THE C.AoI.P. PROJECT AREA
The area chosen as the C.A.I. Programme Project Area has been identified as a
priority redevelopment area in previous studies prepared for downtown revitalization
purposes. Various consultant reports, some dated as early as 1966, indicate that the
primary access points to the City's Central Business District should be considered for
upgrading and improvement. The increased visibility and the attraction of tourists
has been a conenon element of most of the downtown revitalization proposals. The need
to improve particular entries to the City's Central Business District is demonstrated
by the following excerpts.
(1) Excerpts from The Setting: ~olume 1 - Acres Urban Renewal Study 1967:
"The outlined accessibility problems are detrimental to downtown trade
and inconvenient to the Niagar~ Falls community that uses the downtown
concentration of stores, civic, governmental and con~nercial services.
This has been recognized and dealt with in the City's development policy
and traffic planning framework which in a 15 to 20 year programme con-
tains all the elements that are necessary to fully develop downtown
accessibility.
The Official Plan indicates that 'major emphasis will be given to the
importance of improving the vehicular access to the C.B.D. from the
rest of the city'."
(2) Excerpt from Alexander V. Crate Consultants Final Report (August 1, 1980):
"Traffic - It is recommended that every consideration be given, as well
as priority, to improving the access to and visibility of Queen Street
from the major residential areas of the City as well as from River Road
inasmuch as visitor and area traffic is concerned. The improvement of
accessibility and profile of Queen Street may include street closings,
widenings, improved signing, traffic regulation, parking and landscaping.
Other steps should also be explored as will tend to attract and facilitate
an increased volume of shoppers into the central business district and
expedite their movement."

,,Your downtown is accessible by public and private transportation to the local
citizens. However, its very existence is a well kept secret, and it is
hidden from the rest of the world. Notwithstanding its existence, your
downtown is often perceived as a second class area by your own local citizens
and, as such, it behaves, looks and is that way.. As a result of previously
produced studies, you started to group your governmental services (police,
civic administration, courts, post office). But-few local citizens and fewer
visitors have any reason to physically be at any of them. Although you use
an auditorit~n for music and theatre in a local high school, there is no
public transportation nearby, no parking for private autQ~obiles, no nearby
restaurant facilities, and it is totally invisible to any visitor, being
completely surrounded by single family housing. You have no art gallery, no
real specialty shopping, no outdoor cafes or artisan ateliers. All of these
are a portion of the soul necessary in the urban fabric. Your New Downtown
area accessible to all by public and private modes of transport, is the
natural historical and necessary place for all of these to happen. Further,
a downtown must be perceived to be a core, a heart, truly necessary and must
be totally embraced by the citizenry at large.
Without such an approach, the city of Niagara Falls will no doubt continue to
be a focus of the tourist industry for the people who wish to see the Falls
themselves, but will never achieve true greatness, and will slowly start to
atrophy, decline and diminish in the sad way proven by history.
The team felt that perceptions and jealousies must be replaced by a
singularity of purpose for a renaissance to occur. Attitudes of
self-interest have to be replaced by mutual respect and support. It is an
old aphorism, but true ,- the whole is larger than the sLmn of the individual
parts. ,,
With the assistance of Provincial funding through C.A.I.P., greater progress
can be made toward the ultimate objective of improving the economic viability of
the C.B.D.

Activities of Queen Street Business Improvement Area - 1984
PROMOTION
The Promotion Committee of the Downtown Board of Management plans
and executes all advertising and special events for each calendar
year. The one full-time staff member - the Downtown Coordinator
- assists with promotional activities. The Downtown Board
received a Summer Canada: Community Projects grant from May to
August 1984 under which three students were hired. The students
spend approximately 60% of their time assisting with promotional
events and advertising.
The majority of the 1984 promqtiOn budget ($17,000 total) is
utilized for newspaper and radio advertising ($6,000 radio and
$6,000 newspaper). The remaining $5,000 is used to fund special
events throughout the year. As in 1983, the greatest expenditure
will take place during the Christmas season.
A majority of the advertising is targeted at the local Niagara
Falls market. The favourable U.S. dollar exchange rate has also
provided incentive to occasionally advertise in the Niagara Falls,
New York newspaper.
The Downtown Promotion Committee is especially interested in
greater involvement from local community groups. This isevident
in the following outline of the 1984 Promotion Calendar.

The area is marketed to new business prospects with the use of
a booklet prepared in 1983 - Downtown Information Profile.
The Downtown Board will again be promoting the area as a viable
business district at the Annual Hi-Tech Business Show in October.
Staff and budget constraints have not allowed a competitive
marketing program to be fully developed.
BEAUTIFICATION
The planting of annuals is again taking place in 1984. Numerous
planters and street furniture items are being repaired or replaced
due to a lack of maintenance over the years. An agreement has
been made with a local vocational high school to produce new
street furniture and repair existing items in return for providing
meaningful work experience.
Winter beautification efforts will see further B.I.A. involvement
with the Niagara Falls Festival of Lights. Refurbished lighting
units were completed in 1983 at a cost of approximately $5,000.
Additional units are now being refurbished.
The students hired for the summer of 1984 will spend approximately
40% of their time on B.I.A. beautification. General maintenance
of B.I.A. - owned street furniture and planted areas will be
undertaken.

OTHER MAJOR UNDERTAKINGS
C.A.U.S.E. The Community Assist for an Urban Study Effort
program of the Ontario Association of Architects visited the
B.I.A. jn the spring of 1984. The local Steering Committee js
now joining with City representatives to form an Implementation
Committee. This group will evaluate the C.A.U.S.E. recommendations
and their relationship to the C.A.I.P. funded area within the B.I.A.
The B.I.A. Board of Management is presently assisting the local
C.A.U.S.E. (Community Assist for an Urban Study Effort) Steering
Committee and the Municipality (Planning, Engineering) with
forming an ImplementationCommittee. This new Committee will fully
evaluate the C.A.U.S.E. report recommendations and their relation-
ship to the C.A.I.P. funded area in the B.I.A.
The B.I.A. Board of Management involvement is essential at this
time as eleven blocks remain jn the B.I.A. that are on the perimeter
of the C.A.I.P. funded area. The Board of Management plans to
encourage the continuation of street improvements (functional and
aesthetic) into these blocks. A uniform plan agreed upon by all
involved groups and jndjvjduals is desirable throughout the B.I.A.

English and French;
AND WHEREAS it is therefore the unquestioned goal of this Country that Canadians
of either language be permitted to use their mother tongue freely throughout
Canada;
AND WHEREAS Federal and Provincial Statutes, as they are proposed and enacted,
should serve to encourage rather than restrain the free use of the two official
languages;
AND WHEREAS the present government of the Province of Quebec, by its statutes,
is both forbidding and penalizing the use of the English language in certain
circumstances;
AND WHEREAS this is clearly an infringement upon the language rights of many
Canadians resident in the Province of Quebec;
BE IT THEREFORE NOW RESOLVED that the Corporation of the City of Niagara Falls,
Ontario, calls upon the Leader of the Official Opposition, Mr. Brian Mulroney,
M.P., the Leader of the New Democratic Party, Mr. Edward Broadbent, and the
several candidates campaigning for the leadership of the Liberal Party of Canada,
to make now a public statement as to how they propose to redress this injustice
if they become the Prime Minister of Canada following the next Federal general
election;
AND that this resolution be circulated amongst the municipalities of Ontario
having a population in excess of 50,000, for their possible endorsement;

Extra Item - Additional Resolution to be Passed by Council
At the meetings of Council on December 5th, 1983 and January 16th, 1984 Council
adopted 2 reports and passed several by-laws in connection with the proposed closing and
sale of Walkway 13(5) between Green Boughs Road and Woodgate Street.
A by-law to authorize an application to the County Judge for an Order closing that
part of the walkway within Registered Plan 59M-97 (Mount Forest Extension II) has already
been passed. One of the documents required in connection with the application to the
County Judge is the consent of the Minister of Municipal Affairs and Housing. The draft
resolution attached is merely to authorize a request to the Minister for his consent to
for City Solicitor.

is required, has resulted in increased staff time; and
WHEREAS there is presently no charge for this service;
NOW THEREFORE BE IT RESOLVED that the Buildings and Inspections Department of
the City of Niagara Falls be authorized to charge a fee of Thirty Dollars
($30°00) for providing written confirmation as to compliance with the Plumbing
Code for the obtaining of a Liquor Licence Board of Ontario licence or for the
