ORR JANVARY October 3rd 19 83 RFSOLVED that WEEAS the Minister of Labour has already served notice that the specifications of the Ontario Code for the Head Protection of Fire Fighters be mandatory effective June l, 1983; AND WHEREAS the Province of Ontario is considering more regulations under the Occupational Health and Safety Act respecting protective equipment to be used by firefighters; AND WHEREAS the proposed regulations, if approved, will require new equipment for face~ hand and foot protection, turn-out coats and turn-out pants, and respiratory equipment and other such protective equipment; AND WHEREAS the cost of implementing the proposed regulations for the City of Niagara Falls alone would amount to over $150,000.00; AND WHEREAS there are several thoussmd permanent and volunteer firefighters in Ontario; NOW THEREFORE BE IT RESOLVED that the Province of Ontario be petitioned to assist municipalities with the financial burden for the cost of chaD~eover to the equipment proposed under the new Regulations; AND, that a copy of the Resolution be forwarded to The Honourable William Davis, Premier of Ontario and The Honourable R. ', i, MTAIT7 (416) 965-4101 TO: Fire Chiefs Fire Fighters Municipal Clerks I am pleased to be able to send you a copy of the regulation that specifies the requirements for head protection to be used by fire fighters in Ontario where they are exposed to the hazard of head injury when on an emergency call. This regulation will come into force on June 1, 1983. Effective June 1, 1983, all helmets purchased for use by fire fighters must meet the specifications in the Ontario Code for the Head Protection of Fire Fighters dated February 9, 1983. Effective January 1, 1986, all fire fighters must use helmets that meet the specifications in the Code. Helmets in use on May 31, ~.983 which do not meet the specifications in the Code may continue to !be used until January 1, 1986 provided they meet the requirements specified in the Regulation. This is the first regulation made in Ontario under the Occupational Health and Safety Act which addresses protective equipment to be used by fire fighters. Consideration is being given to the making of regulations for face, hand and foot protection, turn-out coats and turn-out pants and respiratory equipment and other such protective equipment. Stan_ds~ds Under Co~sideratioa For Protective Equipment For Fire Fighters The following standards are presently being considered by the Occupational Health and Safety Committee for Fire Fighters: (a) (i) . turn-out coats and turn-out pants - Ontario Research Foundation Standard for Turn-out Coats and Bunker Pants for Use in Structural Fire Fighting; (ii) foot protective equipment - Canadian Standards Association Standard Z195/81 supplemented by the following requirements: toe caps (125 joule), puncture resistant soles (1335 newton), water resistant construction and material and with the top of the boot below the knee. Through the response tD this proposed initiative, it became clear to me that such an approach would have a considerable immediate econcmic impact for municipalities. Accordingly, I decided to modify the approach to prescribing protective equiFment for fire fighters in two ways. First, a period of time will be allowed by any regulation before a particular standard beccmes mandatory. Second, the implementation of new requirements for protective equi~nent will be staggered, for eFample, new helmets will be required in 1986, new turn-out clothing will be required after the helmets, new respirators subsequent to the turn-out clothing, and so on. Consequently, the econcmic impact on municipalities of acquiring new protentive equignent will be spread out over a con- siderable period of time. - 2 - It is my belief that this approach will allow municipalities to anticipate and budget for the protective equipment which all parties agree is needed by the fire fighters in Ontario. I appreciate receiving your views on this subject. BACKGROUND: On a number of occasions, my office has been in touch with the Premier of Ontario and representatives of the Ministry of Energy regarding applica- tions of Cyanamid Canada before the Ontario Energy Board. I have now been informed by representatives of Cyanamid that the escalating price of natural gas and depressed market places could result in the shutdown oft hose facilities producing products which involve the high use of natural gas. Of the fourteen products now produced locally by Cyanamid, eleven fit within this category. As foreign imports can now be delivered in Ontario at prices considerably less than Cyanamid's manufacturing costs, the firm has applied to the Ontario Energy Board for what is called a Natural Gas Feed Stock rate. The Welland works of Cyanamid has a natural gas bill in excess of $30,000,000 per annum, of which approximately 55 percent is in the form of royalties or taxes. The application for the Feed Stock rate will provide sufficient relief inthe natural gas cost to insure continuing operation of the nitrogen facilities. Cyanamid employs approxiately 740 people locally with an annual payroll in excess of $20,000,000. Faced with the statistics of unemploy- ment that currently affect our area, I think it is incumbent upon the City Council to support Cyanamid in their request for a gas rate that will allow them to remain competitive. I would recommend that Council's support of Cyanamid's application be sent to the Ontario Energy Board, the Minister of Energy, Mr. Vince Kerrio, Mr. A. MacBain and Premier Davis. JANVARY RESOLVED that WHEREAS it has recently been announced that the Canadian Assets of the United States based Consolidated Rail Corporation are to be sold, and that Conrail has taken the first steps towards selling these assets to CN-CP RAIL; AND WHEREAS the proposed sale of the Conrail assets to CN-CP could result in a substantial reduction in the existing Canadian work force of Conrail once the purchase is completed and the termination of the existing American pension plan which is based on 30 years of service; AND WHEREAS Cantunn Inc., a privately owned Detroit based firm has been established to purchase the Conrail assets, and it has Been stated that the company will be Canadian funded and controlled; AND WHEREAS the Cantunn firm has indicated that it will retain the existing 250 employees in Canada if the purchase proceeds, and possibly increase employment as a result of further development to be undertaken in donjunction with the purchase of the Conrail assets; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of Niagara Falls endorses the concerns raised by the Canadian employees of Conrail, and supports the purchase of the Conrail assets by Cantunn Inc. in order. to retain these jobs during the current high unemployment situation in this area; AND BE IT FURTHER RESOLVED that this Council's support be conveyed to the Chairman of the Rail Transport Committee of the Canadian Transport Commission and to the appropriate Federal and Provincial Ministers; AND the Seal of the Corporation be hereto affixed. MERRETT RFsOLVED that whereas the harnessing of the Niagara River for hydro-electric purposes has created a multi-laterial problem for the City of Niagara Falls having its effects on both economic and aesthetic spheres; and WHEREAS the Chippawa-Queenston Power Canal displaces hundreds of acres of choice residential and industrial-commercial lands, disfiguring and devaluating the area in general and particularly those properties along its entire nine mile length; and WHEREAS apart from a cost-sharing arrangement for the provision and replacement of certain bridges, the said agreement being entered into in conjunction with and subsequent to the original construction of the Chippawa-Queenston Power Canal in 1918, Ontario Hydro has no further obligation to participate in a sharing of the cost of structures required to bridge its facility requiring therefore that the ratepayers of the City of Niagara Falls must assume a cost which should be equitably borne by all consumers of Ontario Hydro; and WHEREAS the Government of Canada and the Province of Ontario, through its Urban Trans- portation Assistance Program (U.T.A.P.) participate in cost-sharing arrangements when structures are required to bridge railway facilities; NOW THEREFORE BE IT RESOLVED that the Government of the Province of Ontario request Ontario Hydro to participate in cost sharing agreements where structures are required by a local municipality to bridge facilities owned or operated by Ontario Hydro; AND BE IT FURTHER RESOLVED that a delegation of elected and appointed officials of the City of Niagara Falls be authorized to approach the Honourable Robert Welch, Minister of Energy for the Province on this matter; AND the Seal of the Corporation be hereto affixed.
