funds required by the Niagara Falls Hydro-Electric
Commission for the construction and extension of works

mons of Canada, enacts as follows:

I. This Act may be cited as the Air Space
over Niagara Falls Act.
2. In this Act,
· "aircraft" includes a helicopter and a light-
er-than-aLr aircraft;
"Minister" means such member of the
Queen's Privy Council for Canada as is
designated by the Governor in Council as
the Minister for the purposes of this Act;
"pemit" means a permit issued under see- 10
lion 3;
"restricted zone" means the area in the
cinity of Niagara Falls described in the
Schedule.

height of less than 750 m over the restricted
zone, except under the authority of a permit
issued by the Minister.

WHEREAS The Criminal Code makes it a criminal offence to procure illicit
sexual intercourse, live off the avails of prostitution, and solicit or
communicate in a public place for the purposes of prostitutiofi;.
AND WHEREAS the Criminal Code makes the offences of procuring and living
off the avails of prostitution an indictable offence;
AND WHEREAS the Criminal Code makes the of~ence of soliciting or communicating
in a public place for the purposes of prostitution a summary conviction
offence;
AND WHEREAS the Minister for Justice and the Attorney General of Canada are
responsible for the Criminal Code of Canada;
AND WHEREAS the Attorney General for Ontario is responsible for prosecuting
and setting down the guidelines for Provincial Crown Attorneys in respect of
the sentencing of offenders for prostitution related offences;
AND WHEREAS the City of Niagara Falls has one of the highest incidence of
prostitution in Canada;
AND WHEREAS City Council and local residents have concerns about the damage
this type of activity has to their City and businesses;
AND WHEREAS City Council and local residents have further concerns about the
ability of the Criminal Code to control this behaviour;
AND WHEREAS the Niagara Regional Police Force would appear to be frustrated
in their attempts to control or eliminate this activity;

NOW THEREFORE BE IT RESOLVED that the City of Niagara Falls request the
Minister of Justice and the Attorney General for Canada to review the
existing legislation and make such amendments as are necessary to make
the offence of soliciting or communicating in a public place for the
purposes of prostitution an indictable offence, and such other amendments
that would improve the control or eliminate the presence of ~rostitutes
in Canada;
AND FURTHER that the Attorney General for Ontario amend the guidelines
provided to Crown Attorneys such that repeat offenders are dealt with
more severely and that a term of imprisonment be requested.
AND FURTHER that Rob Nicholson, M.P. be requested to assist the City of
Niagara Falls in this matter.

WHEREAS The Aeronautics Act, The National Transportation Act, Air
Regulations, Air Transportation Regulations and other Federal legislation
control virtually every aspect of a proponent's helicopter operation;
AND WHEREAS the existing Federal legislation allow the helicopter
operator, who holds a valid Operating Certificate, to pick up and
discharge passengers anywhere in Canada provided .that there is no breach
of the Low Flying Regulations;
AND WHEREAS most rural areas of Canada are not covered by the Low
Flying Regulations;
AND WHEREAS these uncertified locations, known as-"points of call"
can be used by helicopter operators as staging areas to fly passengers
over urban areas;
AND WHEREAS municipal councils and residents in the urban areas, who
are impacted by helicopter flights, have no input into this type of an
operation.
NOW THEREFORE BE IT RESOLVED that the City of Niagara Falls is opposed
to the existing regulations whereby a helicopter operator can pick up and
discharge passengers at locations other than at those that have an
Operating Certificate;
AND FURTHER that the Minister of Transport, The Honourable Jean Corbeil,
be requested to review the existing legislation and to amend it so that
"points of call" cannot be used in rural areas to pick up or discharge
passengers if the helicopters will be flying over urban areas, unless the
"points of call" have a valid Operating Certificate.
AND FURTHER that Rob Nicholson, M.P. be requested to assist the City

RESOLVED that'whereas this Council has received a submission from a concerned citizen,
respecting an accident involving a bus, carrying school children, which occurred in November and which
resulted in injuries being sustained by several children;
AND WHEREAS this citizen has requested the support of the City Council in backing a suggestion that seat
belts be required on all buses;
AND THAT future construction of new school buses remove the steel bar on the back of the seat and add
additional padding to the back of the seat, in order to provide a restraint safety measure in the event of a
traffic accident, for passengers, particularly children;
AND WHEREAS this Council is of the opinion that this suggestion has merit and is worthy of support;
AND WHEREAS the Council of the Corporation of the City of Niagara Falls requests the support of the
Niagara South Board of Education and the Wellan& County Roman Catholic Separate School Board in this
matter;
NOW THEREFORE BE IT RESOLVED that a copy of this Resolution be forwarded to the Association of
Municipalities of Ontario, and to the Niagara South Board of Education, and to the Welland County Roman
Catholic Separate School Board, requesting their support in the matter and asking that they submit to the

Citizens and business leaders are now recognizing environmental
protection and resource conservation to be essential
prerequisites to sustainable development; and
Cities have many critical environmental responsibilities,
including land use planning, management of transportation
systems, solid and liquid waste management; and
Almost twenty years ago, millions of people joined together on
Earth Day to express an unprecedented concern for the environment
and their collective action resulted in the passage of sweeping
laws to protect our air, our water, and the lands around us; and
Citizens and their governments must again renew their commitment
to meet the global environmental challenge and stand up together
in cities, counties, towns and villages around the world for a
day of collective action to declare our shared resolve;
NOW THEREFORE BE IT RESOLVED that by and with the approval of the Council
of our City, the day of April 22, 1992 is hereby proclaimed as Earth Day 1992
in the City of Niagara Falls;

Information System (CRIS) to enable visitors to Ontario to phone one number to reserve
accommodations throughout the Province; and
WHEREAS the City of Niagara Falls is a leading City in tourism; and WHEREAS it is anticipated
that a fully functional, fully upgraded CRIS managed largely by the industry, will be available
Province wide by 1995; and WHEREAS the Central Reservation and Information System will
require office.space;

Dear Minister:
The City of Niagara Falls has learned that the Province is developing a
new Central Reservation and Information System (CRIS) that will ultimately
enhance customer service and boost tourism in Ontario. We congratulate you
and your Ministry along with those from the tourism industry for developing
such an original system.
By way of the attached Resolution, the Council of the City of Niagara
Falls requests that the CRIS centre be located in Niagara Falls. Since Niagara
Falls is a world wide attraction visited by most tourists visiting Ontario, it seems
natural that the CRIS centre be located here.
Our City Staff are most anxious to work jointly with you and the tourism
industry to ensure that the entire industry and all visiting tourists are treated
appropriately.
To work towards this end we would like to meet and discuss our request
at your earliest convenience.

Whereas the Council of the Corporatio~ of the City of Niagara Falls at a public meeting
to discuss Region-Wide Market Value Based Assessment reviewed a presentation from the Regional
Assessment Commissioner;
AND as a result of the review, it can be determined that a more equitable and fair assessment across
the Region can be achieved through Market Value Based Assessment by Property Class and:
WHEREAS the City of Niagara Falls may be the beneficiary of a more fair system, where those other
municipalities within Regional Niagara currently do not have Market Value Based Assessment by
Property Class appear to be subsidized in part, by the municipality of Niagara Falls and;
WHEREAS Market Value Based Assessment by Property Class is deemed to be a more fair,
understandable, equitable and defensible means of assessment for use in apportioning Regional and
School costs.
THEREFORE BE IT RESOLVED that the City of Niagara Falls Council endorses Region-wide Market
Value Based Assessment by Property Class and that a Province-wide implementation of this system
be initiated by the Provincial Government and that this resolution be forwarded to the Regional
Assessment Commissioner, the Regional Municipality of Niagara, the Treasurer of Ontario, the Hon.
Floyd Laughren, for their support and endorsation.

RESOLVED 'that WBEREAS The Niagara Falls Non-Profit Housing Corporation
provides assisted housing for local area residents who can not otherwise find
or meet affordable housing criteria within the City and that there success in
the area is apparent through the number of existing projects, which this
Council supports.
~ WMMREAS, The Municipal Non-Profit Board is very concerned at the amount
of Government Assisted Housing which is being funded in the South Part of the
City in that the impact upon local neighbourhoods could prove to be negative
in terms of providing housing diversity and that the Board wish to bring this
to the attention of local staff, and politicians at all government levels.
~ wMMREA~ It appears to the Municipal Non-Profit Housing Corporation Board
that concentration of this form of housing cannot be satisfactorily controlled
through zoning By-laws and that the only way in which future government funded
housing can be more properly spread over other parts of the City is to have
the Provincial and Federal Governments who provide funding for such types of
housing to pay special attention to the locations of future proposals for
funded housing developments;
Therefore BE IT RESOLVBD as follows: That the Provincial And Federal
Governments be advisor of the City's Non-Profit Housing Corporation concerns
and ask that the appropriate Provincial and Federal Government Agencies
responsible for funding for Non-Profict Housing Projects conduct a review of
location criteria in terms of other projects of similar nature which maybe in
operation within the same neighbourhood or geographic radius.

It is recommended that:
The by-law appearing on tonighfs agenda be passed, authorizing the temporary road
closure of McDougall, Cookman and College Crescents, commencing on March 2,
1992 for a time period as required to allow construction to progress expediously and;
The unit prices submitted by the low tenderer, DeRose Bros..-General Contracting
Ltd. be accepted and the contract awarded to this firm subject to the above
temporary road closure being approved.
$30,000 be authorized for inclusion in the subsidized roadway account 416 of the
1992 Operating Budget, prior to Council's approval of that budget, for the
reconstruction of that portion of College Crescent between McDougall Crescent and
Eastwood Crescent.
BACKGROUND:
(I) Temporary Road Closure
The reconstruction of McDougall, Cookman and College Crescents is scheduled to begin
on March 2, 1992. To pentdt the efficient and expeditious installation of these works, it will
be necessary to close these streets at certain locations at certain times. The scope and time
periods of such road closures will be kept to a minimum.

The Tenders Opening Committee, in the presence of the Deputy City Clerk, Mr. Gary
Atack, opened tenders on Tuesday, February 11, 1992 at 1:30 p.m. for the above referenced.

The engineer's estimate of construction for this contract was $700,000.00 and based on the trend in the local
construction industry where the tender prices are 10 - 20% lower than the construction cost estimates, we believe
that the low bidder's price is fair and reasonable and well within the engineer's estimate.
The low bidder, De Rose Bros. General Contracting Ltd., has undertaken many projects in the City of Niagara Falls
and in the Niagara Region throughout the last few years and have generally performed well. It is therefore
recommended that the construction contract for Contract No. 91-107, McDougall Crescent, College Crescent
and Cookman Crescent Reconstruction be awarded to DeRose Bros. General Contracting Limited in the total
tender price of $611,052.43.
The original tenders, including the Agreements to Bond, are returned herewith.
We trust you are in agreement with our recommendation; however, should you require any clarification or

RESOLVED thatW~REAS General Motors of Canada is a major employer in this
Region and its importance to the City of Niagara Falls citizens, the Auto
Parts businesses and other services and suppliers, cannot be overstated by
this Council;
A~M) WMEREAS, if the St. Catharines Plants closed, jobs could belost through
out Niagara and the surrounding region in the Auto Parts and related service
sector which would have a major negative impact on the economic health and
well-belng of the City of Niagara Falls, its businesses and citizens; would
directly increase the costs for unemployment insurance, welfare, counselling,
retraining; would generate stress and related health problems which, in~urn,
would alsoLgenerate additional costs and pressure on the health care delivery
system;
~ WMRREAS General Motors has been an excellent corporate citizen to Niagara
for many years and this Council wishes to strongly support and encourage the
maintenance of General Motors, St. Catharines facilities;
AND WMMRRA~ this Council believes that it is extremely important that the
Governments of the Province of Ontario and Canada take ]mn~diate action to
generate a positive business climate in this Province, especially at this time
as it relates to the Auto industry; ~'
BE IT RESOLVED as follows:
THAT Mr. George Peapples, President of General Motors of Canada, be advised:
(i)
That the General Motors, St. Catharines operation is of great importance
to the economic health and well-being of the City of Niagara Falls, the
Auto Parts businesses and other services and suppliers in Niagara, as
well as its citizens at large, and is highly valued for its excellent
corporate citizenship displayed over the years to the people of this
community;
(2)
That there is a strong dependence by the various associated industries
and associated employment on the continued operation by General Motors
of its St. Catharines Plants=

That this Council is prepared to do anything within its jurisdiction to
help maintain operation of the General Motors Plants in St. Catharines;
That this Council will make urgent representation to the Government of
Canada and the Government of Ontario requesting that imva~diate action
be initiated through legislation to generate a positive business climate
in this part of the Province of Ontario, especially at this time as it
relates to the Auto industry;
That the members of the Federal and Provincial Parliaments representing
this area will be urged to arrange an immediate and urgent meeting
between the Prime Minister of Canada, the Premier of Ontario and
General Motors and that such meeting determine what initiatives or
action the Governments may take to retain operation of the General
Motors St. Catharines Plants;

That this Council believes very strongly that in the event of Plant
closures, the bank of skilled trade expertise and skills affecting
other employment in the Automobile industry as well as the investment
incurred by General Motors to develop these skills will have been lost
in this area. These skills have been acquired over the several
generations that the Automobile industry has flourished in this area and
in the event of a down-sizing of this particular Company, the people
possessing these skills will be compelled to seek employment elsewhere.

That a copy of this resolution be forwarded to the following persons
advising them of the contents of this resolution: M.P.P. Shirley Coppen,

General Motors, the lay-offs which are taking place and the ultimate future of the
automotive industry. Many people are of the opinion that this is a St. Catharines
problem, but a large portion of the work force at General Motors resides in
Niagara Falls, and the economy of our community will definitely be affected.

convenience, to discuss this very important matter with a view to doing whatever
is possible to at least keep the present jobs intact.

RF-qOLVED that that WHEREAS the Councils of Municipalities
across the Province of Ontario have pleaded with the Province to
examine the legislation affecting police costsi welfare costs, and
costs of Ontario Waste Management;
AND WHEREAS taxes at all levels of government are steadily
increasing;
AND WHEREAS the existing system of Regional Government creates and
fosters duplication of services within the Regional and local level
of government;
AND WHEREAS the Province's review of disentanglement, as suggested
in the Kitchen report, does not appear to be progressing;
AND WHEREAS the question, "Are you in favour of the elimination of
Regional Government in Niagara", was voted on in the 1991 Municipal
election by the citizens of Niagara Falls with the results: Yes -
13,635 and No - 5,990;
NOW THEREFORE BE IT RESOLVED that these concerns and the results
of the vote be forwarded to' the Province of Ontario with the
endorsement of the City Council, that we support and urge the
elimination of Regional Government in Niagara;
AND BE IT FURTHER RESOLVED that this motion be circulated to all
Municipalities in the Regional Municipality of Niagara, requesting
their support.

several concerned citizens, respecting the NDP Government's announcement for
universal daycare;
AND~HEREAS these citizens have requested the support of the City Council in that
the Provincial Government be requested to reconsider its decision respecting
conversion of for-profit child care service to non-profit status;
AND HHEREAS the Council of the Corporation of the City of Niagara Falls requests
the support of the Region in that the Region request fair and equal treatment for
co~mnercial daycare centres; that the Region not allow discriminatory practices
in parental choice (re: directing parents that are approved for subsidies to only
the non-profit daycare centres);
NOW THEREFORE BE IT R~SOLVED that a copy of this Resolution be forvarded to the
Regional Council and that the Municipalities unite and help the Commercial
Daycare operators to be treated equal to not-for-profit daycares, allow them to
continue to operate and keep the government from using millions of tax payer's
dollars to take over a quality system that already exists.

purposes intended and the remainder of the said contract cannot be completed
expeditiously;
AND FURTHER that the said contract be declared to be substantially
performed and a certificate to that effect be published in accordance with
the Construction Lien Act, 1983;
AND FURTHER that the holdback of $97,065.99 be released to Volsci
Construction after 45 days of publication of the said certificate and in
accordance with the Construction Lien Act, 1983, provided Volsci Construction
delivers to the City, an indemnification and Letter of Credit in the amount
of $97,065.99, in a form satisfactory to the City Solicitor. Because of the
unusual circumstances in this matter, costs up to $400.00 for the Letter of
