WHEREAS the Council of the Corporation of the City of Niagara Falls
supports the recommendation of the City's Parking and Traffic Committee to streamline the
approval of traffic by-laws;
AND WHEREAS the Council recognizes the Regional Municipality of Niagara has authority to
approve the City's traffic by-laws and the approved by-law generally follows the original
submission of the City without change;
AND WHEREAS this additional approval step facilitated by a motion of Regional Council
necessitates a slowing of traffic by-laws being placed in effect;
AND WHEREAS any change to streamline the process will require an amendment to the
Regional Municipality of,Niagara Act to permit the City of Niagara Falls to pass traffic by-laws
without the Regional Municipality of Niagara's approval;

THEREFORE BE IT RESOLVED THAT the Corporation of the City of Niagara Falls requests
the Regional Municipality of Niagara to petition the provincial legislature to amend the Regional
Municipality of Niagara Act to permit the Corporation of the City of Niagara Falls to pass traffic
by-laws that would be expressly for Niagara Falls without the consent of the Regional
Municipality of Niagara.

COUNCIL CHAMBER
December 6, 1993
WHEREAS the Ford Motor Company has partially closed its glass-making plant
in Niagara Falls, Ontario;
AND WHEREAS the Ford Motor Company will completely close the said plant in January
1994;
AND WHEREAS about 250 workers are employed at the said plant, the majority of whom live
in the City of Niagara Falls, Ontario;
AND WHEREAS the workers of the said plant have been offered and accepted new jobs at a
Ford Motor Company plant in Oakville, Ontario;
AND WHEREAS the workers of the said plant desire to commute from Niagara Falls to
Oakville by a car-pool program, rather then by individual cars;
AND WHEREAS the workers of the said plant have organized a car-pool program to commute
to their jobs in Oakville that will allow them to keep their existing homes;
AND WHEREAS a car-pool program will reduce the effects of automobile emissions from the
cars into the environment;
AND WHEREAS there is no car-pool parking lot along the Queen Elizabeth Highway in or near
the City of Niagara Falls;
AND WHEREAS CAW-Canada Local 1054 supports a car-pool parking lot at the interchange
of Mountain Road and the Queen Elizabeth Highway;
AND WHEREAS numerous other persons commuting from Niagara Falls to other cities as far
away as Toronto would have the opportunity to use the car-pool parking lot at the said
interchange.
NOW THEREFORE BE IT RESOLVED that Council for The Corporation of the City of
Niagara Falls requests that the Minister of Transportation for Ontario provide a car-pool parking
lot along the Queen Elizabeth Highway near the interchange of Mountain Road and the Queen
Elizabeth Highway at the expense of the Ministry;
AND FURTHER that Margaret Harrington, M.P.P., and Shi~ey Coppen, M.P.P., be given
copies of this resolution and be requested to assist the City of Niagara Falls and the workers in
this matter.
AND FURTHER that Wayne Hardwick, President of CAW-Canada Local 1054, and Mike
McAra be given copies of this resolution.

WHEREAS over 200 people, mosdy children, came into contact with a rabid pony at a Petting
Zoo in Pelham between November 1-10, 1993;
AND WItEREAS approximately 65 people will be required to receive and-rabies injections;
AND WItEREAS there are at present no federal, provincial or municipal regulations covering
Petting Zoos;
AND WHEREAS both children and adults are at risk of coming into contact with a rabid animal
at a Petting Zoo;
AND WHEREAS there is the potential for a major health disaster.
NOW, THEREFORE BE IT RESOLVED,
THAT the Minister of Municipal Affairs be requested to amend the Municipal Act to give
Municipalities the power to prohibit, regulate, govern and license Petting Zoos;
AND THAT the Minister of Health be requested to amend the Health Protection and Promotion
Act to provide for mandatory vaccinations of animals in Petting Zoos to protect against rabies
and other serious infectious diseases and to empower Health Units and Boards of Health to
ensure that Petting Zoos are safe to the public.

marion administration, for the reasons set forth ~erein.

the Prime Minister of Canada, The Rt. Honourable Jean Chretien; The
Minister of National Revenue, The Honourable David Anderson; the area
municipalities within the Region of Niagara and to municipalities at border

THEREFORE BE IT RESOLVED THAT the Federal Government, the Department of Industry,
is hereby respectfully requested to reconsider this position and reinstate the grant' to the Niagara
Falls Visitor & Convention Bureau to assist in the promotion of Tourism in Niagara Falls.

APPENDIX 'A'
Terms and Conditions
Conditions Io the agreement between Her Majesty the Queen in fight of Ontafio as represented by the Minister of the Environment and
Energy and Ihe municipality referred to herein.
1. Except as provided hereafter, the Applicant shall only use funds provided hereunder in accordance with conditions of the grant and the
ptograro guidelines issued by the Province. Changes to the Project shall only be made subject to prier wfiut:n consent of the Province.
2. in the event of dispute between the Province and the Applicant, the decision of the Province shall prevail.
3. The Applicant shah comply with all applicable laws and shall ensure that all necessary certificates, liceaces, permiLL and approvals
required are obtained prior to the commencement of the Project, or where the Project is conducted in stages, prior to the
comm~.neement of each singe. This Agreement is not and shall not be construed to be an approval under Part V or section 9 of the
Envitomn~ntal Prot~.lion Act
4. Any limits imposed by' this agreement on the service area this contract relates to: the time within which any matter may be done; any
amount of money which the Province may provide for any purpose and the description of work listed on ,,.he sppliention form, may be
extended by the Director of the Waste Reduction Of~ee.
5. The Applicant, and any contractor or sub-contrsctor shall maintain all records relating to the Project for at least five years after
fuel payment is made by the Province under this Agreement.
The Provim:e, or auditors appointed by the Province may audit any financial or other records of the Applicant or any persons carrying
out the Project or paris of the Project for the Applicant, and the Applicant shall provide for such audit in any eontraets with
contractors, sub-eontrsctors or others who will be carrying out the Projent or parts of the Project for the Applicant.
The grant amount at the level of suppo~ (%) specified represents a maximum available commitment only and is subject to adjustment
a0tr receipt of documentation of actual costs. Paymenu shall be made upon receipt, review. acceptance and/or adjustments by the
Ministry of the completed RFP forms.
The Province may withhold all or part of any payment if the Applicant has not complied with any provision of this Agreement; if the
Province has given notice that the Province is dissatisfied with the progress of the Project and the Applicant has not taken steps
satisfactory to the Province to remedy the cause of the dissatisfaction; or pending satisfactory submission of any outstanding repofis; or
pending the resolution of outstanding items following any audit.
The Province shall not be obligated to make any paymenu hereunder except to the extent that sufficient funds am provided in the votes
and estimates in the Ministry of the Environment and Energy and allocated for such purpose.
10. The grant commitment is only for the Ministry's fiscal year noted in the Minister's approval letter. Any portion of the grant which is
not used by the Applicant within this timeframe shall remain the property of the Province.
11.
In the event of overpayment, as deemed by the Province, the amount of overpayment shall be credited to future payments hereunder,
or repaid to the Province as determined by the Province, in the Province's sole discretion. The Province reserves the right to demand
interest on any amount owing by the Applicant to the Province at the then-current interest rate charged by the Province of Ontario on
aecounLs receivable.
12.
The Applicant shall at all times indemnify and save harmless the Province, the employees and agents of the Province and their heirs
and assigns fzom and against all claims, demands, losses, costs, damages, actions, suits, or other proceedings, by whomsoever made,
sustained, brought or prosecuted that are in any manner based upon, nccasioncd by, or antibutable to, anything done or omitted to be
done by the Applicant, its council members, employees, independent contractors. sub-contractors or egents in connention with services
performed, purportedly performed, or requit-.xt to be performed by the Applicant under this Agreement.
13.
The Province shall not be liable for any injury or damage (including death) to the person of any council member, employee,
contractor, sub--contractor or agent of the Applicant, or for the loss of, or damage to the property of the Applicant, its council
members, employees, contractors or sub-contrsntors or agents in any manner based upon, eceasinned by, or in any way attributable to,
the Applieant's participation under this Agreement, unless the injury. loss. or damage is caused by the negligence of an officer or
employee of the Province while acting within the scope of his or her employment. '
14. The nmnlcipality's confirmation, by resolution of council, to undertake the work as described in the grant application form under the

15. A Mifister's letlet, allocating funds for the work described on the reverse side of this form, together with the grant application and
assessment forms, and these conditions, will constitute the agreement under which the grant will be administered.

Niagara Falls from the Retail Business Holiday Act for Victoria Day, Canada Day and Labour
Day and purported to include the hours of operation from 10:00 a.m. to 6:00 p.m. local time;
AND WHEREAS Council is of the opinion that these hours would severely impede businesses
in the City of Niagara Falls;
NOW THEREFORE BE IT RESOLVED that the Regional Municipality of Niagara is hereby
requested to amend By-law No. 7275-93 by the deletion of the hours of operation;
AND THAT the same deletion be considered for By-law Nos. 7276-93 through 7288-93 both
inclusive.

RESOLVED that
NOVEMBER 22, 1993
WHEREAS the Honourable Ed Philip Minister of Municipal Affairs has recently
announced on behalf of the Government of the Province of Ontario that the plan
approved by the Municipality of Metropolitan Toronto to remove inequities in
their property assessments would not be approved and that no further changes to
their system would take place until after the Fair Tax Commission had concluded
its hearings and reports; and
WHEREAS it has been determined that the City of Niagara Falls and the Town
of Niagara-on-the-Lake are the victims of severe inequifies in the system of
assessment within the Regional Municipality of Niagara in relation to their
contribution to the cost of regional government and public education; and
WHEREAS based upon 1988 values these inequities cost Niagara Falls taxpayers
in excess of $4 million annually and have contributed greatly to the economic
recession within the City of Niagara Falls and attendant nationally high rates of
unemployment and welfare and the rapid depletion of its' tax base through the
exodus of industry; and
WHEREAS the Government of the Province of Ontario is the creator and
principal of Regional government in the Province and has a moral and legal
obligation to ensure that inequities in the local tax systems are not perpetuated;
and
WHEREAS the City is presently working with the Town of Niagara-on-the-Lake
and other area municipalities within the Region to reform the current inequitable
and unfair assessment regime in Niagara by implementing a market-based region-
wide system; and
WHEREAS in the event the City is successful in having its' proposal adopted by
the Regional Council it would not want the Province of Ontario to refuse to allow
the change to be put into place, moreover, in the event that its' proposal was not
approved by Regional Council it would expect the Province to intervene to put
into place immediately an equitable and fair system of assessment within Niagara
Region.
NOW, THEREFORE BE IT RESOLVED THAT:
1. The Council of the Corporation of the City of Niagara Falls demands that the
Government of the Province of Ontario not prevent the City and other
municipalities within the Niagara Region from reforming the present inequitable
and unfair system of property assessment within the Region and that it intervene
on behalf of the City and the Town of Niagara-on-the-Lake in this issue
immedately and not defer the issue to the Fair Tax Commission for resolution.
2. Copies of this resolution be forwarded to the Honourable Bob Rae, the
Honourable Ed Philip, the City's local MPPs, Margaret Harrington and Shirley
Coppen as well as the Regional Chairman and Mayors of all of the area
Municipalities within the Region.

to reconsider the abandonment of the Ontario Home Renewal Program

to bring their dwelling units up to a minimum standard; and
Whereas the maximum loan available under the program is $7500.00 for homeowners or
$9,500.00 for physically disabled homeowners or homeowners with physically disabled
relatives residing permanently.with them; and

Whereas the maximum loan has remained in effect since the program inception in 1974
and is now in may cases an insufficient amount needed to upgrade homes to a minimum
standard;
Now therefore be it resolved that the AMO petition the Minister of Housing to raise
the limit of the maximum loan available under the program to $15,000.00.

Supplementary Information:
The Ontario Home Renewal Program (OHRP) was introduced in 1974 to assist
homeowners in undertaking necessary repairs to their housing units. Municipalities
participating in the program were required to establish an account fund of OHRP and to
deposit in the fund all provincial advances, all moneys received in repayment of loans,
and all interest accruing. This would result in a revolving fund which would enable
municipalities to continue participation in the program for years to come.
Despite the success and popularity of the program, and the continuing demand for
additional funds, the province began reducing advances to municipalities by 50% or
more from 1980 until funding was discontinued in 1983-84. At that time, AMO
reacted strongly to the discontinuing of funding and requested an additional $60
million in funding. AMO further recommended that the province review the maximum
income requirement to be eligible for an OHRP loan and the maximum income
requirement to be eligible for an OHRP grant. Since funding was discontinued, a
situation developed whereby some municipalities exhausted their revolving funds
while others had accumulated fairly large reserves. Municipalities with large
reserves curtailed or cut off the grant portion of their loans in order to ensure a
viable revolving fund. In 1985, the Association adopted a resolution requesting
redistribution of cash balances established under the OHRP Program to those
municipalities in need of additional funding. The Housing Ministry later announced
that it would redirect funds already allocated under the OHRP from inactive to
active municipalities.
In February of this year, ihe MiniS?r9 of Housing released "Ontario Home Renewal
.Program Guidelines Review: Discussion Paper". The discussion paper recommends an
~ncrease in the maximum loan amount to $12,000.

To All Heads of Council:
As you are aware, on May 19th, the Minister of Finance announced
the Province's intention to discontinue the Ontario Home Renewal
Program (O.H.R.P.) and recover unused funds from participating
municipalities. The monies recovered from O.H.R.P. trust funds,
approximately $40 million in 1993 alone, will'be applied to the
important task of reducing public sector debt in Ontario.
An amendment to Ontario Regulation 641 (formerly O.Reg. 506) of
the Housinq Development Act which deals with the wind down of
O.H.R.P., will come into effect July 16, 1993. As of this date, the
Ontario Home Renewal.Program will end and no further loans will be
issued under the program.
Participating municipalities will be required to report outstanding trust
accbunt balances to the Province within ninety days of July 16, 1993
and remit these funds before March 1, 1994.
If your municipality is still active in the program, it is important to note
that homeowners who have O.H.R.P. loans will not be affected by
the cancellation of the program. Their terms of repayment remain the
same. The municipality will be compensated an additional 5 percent
on outstanding loans collected and remitted to the Province after
March 1, 1994. As well, any interest earned on O.H.R.P. trust fund
balances in the year before repayment, may be retained, for 1994 and
ensuing years.

The Government recognizes that the Ontario Home Renewal Program
has provided a worthwhile benefit to individual homeowners in
communities across the province over its 20 year lifespan. In view of
serious budgetary pressures, however, the Province has had to take a
close look at each and every one of its services and programs,
including transfer payments. The recall of inactive O.H.R.P. funds is
viewed as one of the least painful means of reducing the burden of
debt that impacts on all Ontario taxpayers.
I am seeking your municipality's cooperation in working with Ministry
officials in the 'return of inactive O.H.R.P. funds.
Over the next few weeks, my staff will be providing more details
about reporting and repayment requirements under the new
regulation.

AND WHEREAS the Provinces and States surrounding the Province of Ontario permit the sale
of liquor beyond 1:00 a.m.;
AND WHEREAS the owners of establishments, who sell liquor in the Province of Ontario that
border on the said Provinces and States, are at a competitive disadvantage with respect to the
establishments located in the said Provinces and States;
AND WHEREAS the competitive disadvantage results in a loss of business to the Ontario
establishments and thereby creates fewer jobs and business opportunities for the Ontario
establishments and the local economy relying upon the said establishments;
NOW THEREFORE BE IT RESOLVED that the Council for the City of Niagara Falls request
that the Association of Municipalities of Ontario adopt this resolution and the recommendation
contained herein and forward copies to the Minister of Consumer and Commercial Relations and
the Chair of the Liquor Licenee Board of Ontario.

hours for the sale and service of liquor to 3:00 a.m. in the Province Of Ontario with a local

the transfer of the airport to the Town of Niagara-on-the-Lake with a subsequent lease between
the Town and the Airport Commission. Council believes that the ultimate ownership of the
airport should rest with the Regional Municipality of Niagara as the Niagara District Airport
should develop as a truly Regional facility supplying airport related facilities to the benefit of
all the Municipalities located within the Region.
It is recognized that the provision of a truly Regional facility is a costly
endeavour which requires the support of not only the Federal and Provincial governments but
that of the Region and all area municipalities as well, and with the ownership of the lands resting
with the Regional Municipality of Niagara, the co-ordination of this support can be more readily
achieved.

these obvious inequities in distribution of Funding and Projects across the Province

to reduce the provinciai deficit;
AND WHEREAS a merger and relocation of the East Niagara Housing Authority may result

Falls, and an increase of costs for the management of the housing projects.

WHEREAS pensions for municipal elected officials in Ontario were first made
available in 1972 by amendments to the Ontario Municipal Employees Retirement System Act,
which plan was based upon the existing OMERS employee pension plans;
WHEREAS the careers and pension plan needs of elected officials are ,totally
different from those applicable to municipal employee groupS; - '
WHEREAS this difference in careers and pension planning needs was clearly
recognized by the Ministry of Municipal Affairs in 1988 and by the implementation of improved
pension legislation for Metropolitan Toronto, its constituent area municipalities and the City of
Mississauga and the Town of Markham;
WHEREAS AMO has developed a proposal for long term pension plan
improvements to be available to all individual municipal elected officials who opt to participate;
NOW THEREFORE BE IT RESOLVED that the Council of the City of Niagara Falls, hereby
endorses the 1992 revised Councillors' Pension Plan Repoi't adopted by the Board of Directors
of AMO on November 27, 1992 and direct that this endorsement be communicated to the
Honourable Ed Philip, Minister of Municipal Affairs and the Association of Municipalities of
Ontario.

WHEREAS the vacancy rate in Niagara Falls is at 4.0 percent and the supply of market rent
units is considered to be saturated; and
VerlEREAS the Province of Ontario has announced Jobs Ontario - Homes to assist with the
construction of assisted housing units and the program design is currently being developed; and
WHEREAS the program should be responsive to local conditions including overall municipal
vacancy rates, opportunities for conversion of existing vacant rental stock, and ongoing
operations costs; and
WHEREAS there is a need te expand the Rent Supplement Program and the Shelter AlloWance
program to fill existing market rent units; and
'WHEREAS a Central Housing Registry system would provide a single source of data on housing
need and should be identified as a funding priority under the 1993-94 Partners in Housing
program; and
WHEREAS a review of the Assessment Act is necessary to ensure a fair and equal system of
assessment is provided for all multiple-unit housing projects in Ontario;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of
Niagara Falls petitions. the Minister of Housing to address these concerns in the design criteria
and present and future programs of the Province of Ontario and that a copy of this resolution
be forwarded to Margaret Harrington, MPP Niagara Falls.

library programs, services and publications have been highly appreciated;
WHEREAS she has served on the executives of many library associations' and on library
advisory committees of Niagara College and the Niagara Regional Library System and with
many community organizations in Niagara Falls;
WHEREAS she has made many contributions to the work of the City Historian and the Niagara
Falls Heritage Foundation in the recording and publishing of the history of the City of Niagara
Falls, the Niagara River and the Niagara Area;
WHEREAS Miss Van Slyke is retiring effective February 281h, 1993;
NOW THEREFORE be it resolved and it is hereby resolved that the Council of 'the City. of

AND WHEREAS the Niagara Region has had the highest i'ate of unemployment in Canada for
18 of the last 24 months and Ontario has had the highest unemployment rate in Canada for the
last 22 Of 24 months;
AND WHEREAS cross border shopping has had a devastating impact on the retail sector of
Niagara;
AND WHEREAS municipalities in the Niagara Region are experiencing tax arrears in the 46
million dollar range;
AND WHEREAS the tourist industry in Niagara is experiencing occupancy and revenue levels
decreased by 40%;
AND WHEREAS both the Provincial and Federal Governments have in the past and still do
offer financialincentives in areas which are considered to be economically depressed;

AND WHEREAS it can be shown by the previously noted statistics, that the number of plant
closures and jobs lost are due to the falling economy of the Region;
NOW THEREFORE BE IT RESOLVED that the Council of the City of Niagara Falls strongly
urges the Provincial and Federal Govemments to immediately declare the Niagara Region an
economically depressed area and to make it eligible for any and all financial incentives available
to Municipalities, Business and Industry, to assist in overcoming the serious economic
difficulties which exist in Niagara;
AND FURTHER that all municipalities in the Regional Municipality of Niagara be urged to
support this request to the Provincial and Federal levels of Government;
AND FURTHER that the Regional Municipality of Niagara be urged to take the lead in a co-
ordinating role in this request.

WHEREAS the Ford Motor Company of Canada has seen fit to announce
their decision on January 7, 1993 to close the Niagara Glass Plant;
WHEREAS the negative economic impact will not only affect the workers of the Niagara Glass
Plant but also the Citizens of Niagara Falls through loss of a local job base, and loss of
commercial tax revenue which will ultimately cost residents more tax dollars;
WHEREAS local businesses will also suffer this loss through lower revenues because of a
"domino effect" of job loss which eventually may create an economic downturn;
WHEREAS in these tough economic times we can ill afford another plant closure in the Niagara
NOW THEREFORE BE IT RESOLVED THAT this City Council of Niagara Falls fully support
the efforts of the Canadian Auto Workers Local 1054 and their Fight Back Campaign to keep
the Niagara Glass Plant open and to secure jobs for a working future in this Community.

WHEREAS United States Senator Moynihan has indicated that he intends to hold hearings on
whether or not to merge the Ni_mgara Falls Bridge Commission with the Buffalo and Fort Erie
Peace Bridge Authority; and
WHEREAS the Niagara Falls BridSe Commission since its inception in 1939 has perfor,ned an
outstanding service for the public m Canada and United States and has fulfilled its corporate
purpose to provide international crossings for the transportation of people and goods at
reasonable toll rates between the United States and Canada, thereby assisting our area's
economic well-being; and
WHEREAS the Bridge Commission has maintained and operated the bridges in accordance with
professional engineering excellence, and is well restP~ted in the international bridge community;
and
WHEREAS the Bridge Commission has received this Council's support in principle for its
substantial plan for renovation; and
WHEREAS them does not appear to be any basis for merging the two bridge auffiori~cs;
NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of
Niagara Falls be on record as being opposed to any such merger and that copies of this
resolution be forwarded to all appropriate persons including Senator Moynihan.

considered Report R-92-41, recommending that Council support the petitioners' request to
declare the Weaver Cemetery abandoned whereby the City would assume responsibility for the
cemetery's care and maintenance; AND FURTHER that this action b'e deferred until 1994 due
to budget restraints;
AND WHEREAS on December 7, 1992, Council for the City of Niagara Fails resolved that the
first recommendation be received and adopted; AND FURTHER that the timing of
implementation be deferred to the 1993 budget discussion;
AND WHEREAS the timing of implementation has been referred to the 1993 budget
discussions;
NOW THEREFORE BE IT RESOLVED that the City Solicitor be authorized to commence legal
action to declare the Weaver Cemetery abandoned and to take all necessary steps in that regard.

WHEREAS the Transfer of jurisdiction for Waste Management from the local
Municipalities to Regional Niagara is the "preferred approach";

AND WHEREAS under present legislation, the Region has no jurisdiction for Waste
Management;
AND WHEREAS if jurisdiction for Waste Management is to be transferred to
Regional Niagara, it must begin with a request from the local Municipalities;
AND WHEREAS the Region is prepared to accept the jurisdiction for Waste
Management, if so requested;
NOW BE IT THEREFORE RESOLVED that the City of Niagara Falls endorses, as
the "preferred approach", the transfer of Waste Management jurisdiction (as it relates
to waste disposal and processing of diverted wastes) to Regional Niagara;
AND FURTHER that the eleven (11) other local Municipalities in Regional Niagara
be requested to support this position;
AND FLIRTHER that the current Boards of Waste Management in Regional Niagara
be requested to support this position;
AND FURTHER that the City of Niagara Falls is prepared to co-ordinate the
initiative culminating in a request being submitted, on behalf of the local
Municipalities, to Regional Niagara for it to assume jurisdiction for Waste
Management (as it relates to waste disposal and processing of diverted wastes);
