WAGG CITY CLERK WAYNE THOMSON MAYOR The Cicy of Niagara Falls, Ontario Council Chambers No. 80 Moved by Alderman FISHER December 8, 1997 Seconded by Alderman FEREN WHEREAS the Niagara Falls Interim Casino has exceeded all expectations since its opening on December 9, 1996, creating needed employment as well as significant positive economic benefits throughout the Niagara Region; AND WHEREAS recently the Minister responsible for casinos in Ontario, the Honourable A1 Pallidini, has suggested the possibility of leaving the Interim Casino open after the opening of the Permanent Casino in order to further stimulate economic activity and tourism; NOW THEREFORE BE IT RESOLVED THAT THE COUNCIl, OF THE CORPORATION OF THE CITY OF NIAGARA FALLS hereby supports the position taken by Minister Pallidini to leave open the Interim Casino as referred to above, subject to the provision of an appropriate business case analysis. Janvary Seconded by :Alderman S.Fisher November 24, 1997 WHEREAS the Ministry of Consumer and Commemial Relations through the local Regional Assesssement Office is responsible for the preparation and delivery of the voters list used for municipal elections; AND WHEREAS the enumeration for the list prepared for use in the 1997 municipal election was contracted to a third party and conducted by mail at a time that conflicted with the enumeration being taken for the Federal Election in the Spring of 1997 and thereby causing some confusion among the electors in the municipality; AND WHEREAS the Province as a cost saving measure eliminated their sending of the Voter Identification Notice to voters; AND WHEREAS the only notice that voters received to check the voters list was by way of newspaper advertisements and public notices posted at the library and other public places thereby resulting in the omission of the names of numerous voters who had resided at their current address for many years and who, in fact had been on previous voters lists at the address; AND WHEREAS this caused a great degree of inconvenience to the voters, candidates and to election and municipal staff; AND WHEREAS the Council of the Corporation of the City of Niagara Falls finds this situation to be totally unacceptable; NOW THEREFORE BE IT RESOLVED that the Council of the Corporation of the City of Niagara Falls requests the Minister of Consumer and Commercial Relations to take immediate and appropriate steps to rectify this problem and further that a full explanation be provided to this and to all municipalities as to why such an unacceptable list was provided for use in the municipal elections. WAGG CITY CLERK TnO~~'SON MAYOR The City of Niagara Falls, Oncario Council Chambers No. 64 Moved by Alderman HENDERSHOT Seconded by Alderman CUMMINGS September 22, f997 WHEREAS Canada and the United States have the longest, undefended border in the world; AND WHEREAS the North American Free Trade Agreement(NAFTA) has eased the passage of goods and individuals between the two countries; AND WHEREAS Canadian citizens have historically enjoyed free entry to the United States for as much as six months without formally applying for a visitors visa; AND WHEREAS U.S. Congress recently passed the I/legal Immigrant Reform and Immigrant Responsibility Act; AND WHEREAS this Act will require a~ visitors, including Canadian citizens and residents, to file formal entry and exit documents to travel to the United States; AND WHEREAS the result of these requirements will lead to long traffic lines leading up to the 3 International bridges in Niagara Falls. NOW THEREFORE BE IT RESOLVED THAT through our local member of Parliament, the Federal Government be requested to pressure the United States government to exempt Canadians from the visa requirements of the Illegal Immigrant Reform and Immigrant Responsibility Act. Carried Unanimously CITY CLERK ~OMSON MAYOR The City of Niagara Falls, Ontario Council Chambers No. 63 Moved by Alderman PUTTICK Seconded by Alderman HENDERSHOT September 8, 1997 WHEREAS the Province of Ontario allowed Sunday opening of the Liquor Control Board of Ontario outlets and Brewers Retail outlets on a trial basis throughout the summer months; and WHEREAS it has been shown that these Sunday openings, although profitable for the Liquor Control Board of Ontario and Brewers Retail outlets, have had a substantial detrimental impact on micro brewery operations in the Province; NOW THEREFORE BE IT RESOLVED THAT the Corporation of the City of Niagara Falls requests the province to not allow the opening of Liquor Control Board of Ontario and Brewers Retail outlets in communities where micro brewery operations exist. WAGG CITY CLERK MAYOR The CRy of Niagara Falls, Ontario Council Chambers No. 58 Moved by Alderman FISHER Seconded by Alderman CAMPBELL August 11, 1997 WHEREAS Ontario's Ministry of Economic Development, Trade & Tourism has commenced an initiative to provide tourism signage on the Province's highways; AND WHEREAS under current regulations, Duty Free Shops are unable to participate in the program; AND WHEREAS Duty Free shops are tourist-oriented services geared toward the travelling public, who may not be aware of the location of these shops; AND WHEREAS tourism signage indicating the location of Duty Free Shops will lead to revenues remaining in our City and Province; NOW THEREFORE BE IT RESOLVED THAT the Ministry of Economic Development, Trade & Tourism be requested to allow Duty Free Shops the opportunity to participate in the tourism signage program on the Province's highways. CARRIED UNANIMOUSLY CITY CLERK MAYOR The City of Niagara Falls, Ontario Council Chambers No. 57 Moved by Alderman JANVARY Seconded by Alderman CAMPBELL August 11, 1997 rapidly; WHEREAS the downloading from the Province to Municipalities has progressed AND WHEREAS relief from liability is necessary to help offset the cost of downloading from the Province; AND WHEREAS relief from liability for municipalities is in the greater public interest; NOW THEREFORE BE IT RESOLVED: THAT the Premier of the Province of Ontario, the Honourable Michael Harris and the Minister of Municipal Affairs, the Honourable A1 Leach be requested to take such steps as are necessary, including statutory reform, to relieve municipalities from liability in the areas of building inspections, occupiers liability and joint and several liability, as suggested in the attached material. -2- THAT all municipalities within The Regional Municipality of Niagara be requested to endorse this resolution. Relief from liabilit~ was to help offset the downloading but recently there has been silence at Quccn's Park and the process of making that relief a reality may have gone off the rafts. If municipalities do not voice their concerns immediately to A1 Leach or at least before the AMO Conference in August, the opportunity for further Municipal Statutory Reform could be lost. THE PROBLEM WITH OCCUP~ LIABILITY · the duty of care in the Occupiers' Liability Act is unreasonable for municipalities; · the Act does not distinguish the different uses of municipal property; ' · the same legal obligation to keep property in reasonable condition that applies to a thousand square foot back yard in a city home, applies to a murticipality which may have many acres of vacant land; · the reality is that municipalities never had the resources to meet this obligation, and will have fewer resources in the future. PRAC'I'ICAL SOLUTION · the Occupiers' Liability Act should be modified to reflect a reasonable standard of care for the different types of property for which a municipality is responsible. 3. WAGG CITY CLERK MAYOR The City of Niagara Falls, Ontario Council Chambers No. 41 Moved by Alderman HENDERSHOT June 9, 1997 Seconded by Alderman CUMMINGS WHEREAS Highway 420 from the QEW to the Rainbow Bridge is in need of reconstruction and has been in need of reconstruction for several years; and WHEREAS the Highway 420/Victoria Avenue Interchange is now in need of improvement to accommodate increased visitation to the City of Niagara Falls, and these improvements should have been completed before this tourist season (i.e. summer 1997); and WHEREAS MTO's deferral of these necessary works will have a significant adverse impact on visitors to the City and therefore to the tourism sector; and WHEREAS the Province realizes extraordinary direct revenues from the tourism industry in the City of Niagara Falls (approximately $83 million); and WHEREAS the Province realizes additional extraordinary direct revenue from Casino Niagara (approximately $120 million annually - projected) -2- THEREFORE BE IT RESOLVED that further delay in these road improvements is unacceptable to the City of Niagara Falls and therefore the Province is herein petitioned to begin these road improvements immediately, and further that the Ministers of Transportation (Honourable AI Palladini) and Economic Development Trade and Tourism (Honourable William Saunderson), MPP Bart Maves, and the Ontario Casino Corporation be advised of the City's dissatisfaction and frustration with this matter. WAGG CITY CLERK MAYOR The City of Niagara Falls, Ontario Council Chambers No. 30 Moved by Alderman CRAITOR Seconded by Alderman CAMPBELL April 7, 1997 WHEREAS Workers' Compensation started in 1914 with workers giving up their right to sue for just compensation when injured as a result of their work; AND WHEREAS WCB is funded by employers and as group, Ontario's employers enjoy WCB assessment rates in the bottom third of North American employers, about two percent of payroll; AND WHEREAS the unfunded liability is a non-issue because WCB has 6.8 billion in reserve. In 1995, WCB had a surplus of 510 million, non collected employer's debt of 175 million at the same time the WCB paid back the employers 359 million. The amount paid to injured workers was only 337 million; AND WHEREAS the Provincial Government's proposed Bill 99 introduces drastic changes to WCB and to the Occupational Health and Safety Act and does nothing to prevent workers from being injured. This Bill will dramatically reduce the living standard of injured workers and their families by cutting their WCB benefits 5 % and by recalculating the indexing of their benefits will further shrink the injured worker's income by 40% over the long term; AND WHEREAS proposed changes to the Health and Safety Act will produce more unsafe work places; procedures, and more injured workers; AND WHEREAS Bill 99 limits or outlaws compensation for certain work related disabilities compensated under the current act; AND WHEREAS the Provincial Government's Proposal also allows employers the right to confidential medical information greatly infringing upon the privacy of injured workers; IIII [ I1[ IIIll~ ] ............... AND WHEREAS the financial adjustments to be introduced through Bill 99 only benefit the employers by giving them a 5 % rebate at the expense of injured workers, many of whom will be forced onto Public Health and Social Assistance Systems. Already 9,488 injured workers receive WCB benefits so low that they rely on Public Assistance in order to survive; AND WHEREAS there is no way of knowing how many injured workers there will be in the coming years and what will be the cost to the municipal tax-payers; THEREFORE BE IT RESOLVED THAT the City of Niagara Falls informs the Provincial Government that the off-loading responsibility of caring for the injured workers from the employers to municipal tax payers is unacceptable; BE IT FURTHER RESOLVED THAT the City of Niagara Falls informs the Provincial Government that the working citizens of their municipality deserve to be treated with fairness and respect; AND BE IT FURTHER RESOLVED THAT the City of Niagara Falls informs the Provincial Government not to dismantle the WCB and the Occupational Health and Safety Act, but rather improve it so that injuries and diseases will be eradicated from the workplace and when an injury occurs the worker's dignity is not undermined, proper care is available and the worker's income is not adversely affected; BE IT FURTHER RESOLVED THAT public hearings on Bill 99 be held in the City of Niagara Falls in order that all our citizens and organizations who have an interest in these important changes have an opportunity to be heard. WHEREAS Bill 75, the Alcohol, Gaming and Charity Funding Public Interest Act, 1996 provides for the introduction of Video Lottery Terminals (VLTs) in establishments licensed to serve alcohol; AND WHEREAS the City of Niagara Falls is concerned about the social and economic costs of widespread introduction of VLTs into our communities; AND WHEREAS the City of Niagara Falls is concerned about the lack of reference to local Government consultation with respect to the placement of VLTs; AND WHEREAS the introduction of VLTs will have a major negative impact on charitable gaming revenue for charities which allows them to carry our their work within the municipality; AND WHEREAS the legislation does not guarantee that the revenue losses suffered by charities in our communities will be made by revenue from VLTs; AND WHEREAS the legislation does not guarantee that the municipality will be compensated for the related losses in revenue from lottery licensing; AND WHEREAS the local municipality will be required to support additional policing and social service costs resulting from the widespread introduction of VLTs; BE IT RESOLVED THAT the Council of the City of Niagara Falls is opposed to the extension of Video Lottery Terminals beyond race tracks and charity casinos and is proud to become part of the movement that says "NO" to Video Lottery Ternfinals in our community.
