NEW BUSINESS
Alderman Campbell requested staff investigate Dorchester Road near Cherrywood Road and
Pettit Avenue for possible erosion as this section of Dorchester Road has sunk in the past. The
Director of Municipal Works requested further details of the location from Alderman Campbell
for staff to investigate.
Alderman Volpatti requested a City map showing which roads where Regional and which roads
were scheduled for improvements in 2005. The Director of Municipal Works advised
Committee that Municipal Works and GIS staffcould fulfil this request as soon as possible.
Alderman Pietrangelo reminded staff that approximately a year ago he made a suggestion that
signs indicating property numbers be added to the street signs and requested an update. The
Director of Municipal Works advised that staffwas looking at incorporating this when new signs
were being installed.

RECOMMENDATION:
It is recommended that:
1) the request from Russeli Associates to waive the $I,350.00 costs the City will incur to
hcilitate this event, be denied; and
2) a temporary exemption to the zoning by-law at 4253 Momingstar Road to accommodate
overflow parking if required at the event, be approved.
BACKGROUND:
Russell Associates Inc. has made a Special Event application to the City of Niagara Falls to host an
Air Show on June 3, 4, 5, 2005, "Friendly Foes over the Falls." City staff has been involved in the
planning process as well as representatives from the Niagara Region, Niagara Regional Police,
Ontario Provincial Police and the Ministry o£Transportadon. Approval for the Air Show itseI£is
dependant upon Transport Canada and satisfying concerns of the above-mentioned agencies. The
City will issue a special event permit subject to the above agencies approvals.
The Russell Group is required to comply with identified requirements from these agencies to ensure
that appropriate emergency, fire, policing, traffic impacts and parking matters are in place prior to
the show. Event organizers anticipate approximately 2,500 cars per day. The Russell Group has
identified that their property will be able to accommodate this number o fvehicles. As a contingency
plan, 4253 Morningstar Road has been leased by the Russell Group to provide off' site, overflow
parking on a temporary basis. As this site is located approximately two (2) kilometers away from
the main entrance of the airport, the Russell Group has assured the Region that a shuttle service will

be provided by the local double deck tour bus company, located on Bossert Road.
Planning staff has indicated that the Momingstar lands are not zoned to permit the parking of
vehicles. Traffic & Parking services have identified that in the case of inclement weather, vehicles
may become hampered in movement on these lands as they are grassed fields that are not improved
for the parking of vehicles. The Russell Group as part of a contingency plan will ensure that a
towing company will be on standby to assist motorists. To compound this problem vehicles may
park on adjacent roads, hence the requirement that Sommerville, Sherk, Bossert and Sodom Road
will be posted "No Parking" and "No Stopping" to ensure the safe movement of' vehicles (see
schedule "A"). The Cily's cost for the installation and remoYal of these temporary signs is
approximately $650.00. Organizers have advised that if'the weather is inclement, attendance will
more than likely be reduced.
To Facilitate parking on site at 12761 Sodom Road, it's been identi fled that the dirt portion o fBossert
Road, west of Sodom needs to be improved for vehicles for approximately sixty (60) feet. This will
permit vehicles to access the site front the northern end of the property. The cost to up.adc this
portion of the road is approximately $700.00. The organizers are requesting that these fees be
waived so that a larger part of'the profit front the show m%¥ be donaLed to the Air Cadet Squadron
to provide flying time to them.
The Committee's concurrence with the recommendation outlined in this report would be appreciated.

RECOMMENDATION:
It is recommended that stopping be prohibited on the south side of Brock Street between St.
Andrew Avenue and St. George Avenue from Monday to Friday between the hours of 8:00am
and 4:30pm.
BACKGROUND:
In reply to a request from an area resident, staff has conducted a parking review on Brock Street,
between St. Andre~v Avenne and St. George Avenue, to determine the feasibility of installing
parking restrictions. The concern at this location stems from motorists not having adequate
manoeuverability space when vehicles are parked on both sides of this section of Brock Street.
This usually occurs during school drop-off and pick-up hours at Martha Cullimore Public School,
located on St. Andrew Avenue, the roadway crossing the western end of Brock Street.
Brock Street is a residential roadway extending in an easdwest direction between St. Paul
Avenue and St. Andrew Avenue. The study section of Brock Street is 140 metres in length
extending between St. Andrew Avenue and St. George Avenue. The roadway is only 7.5 metres
in width and consists ofsidewalks on both sides. Cu.wently stopping is prohibited on both sides
of Brock Street from St. Andrew Avenue to a point 22 metres east of St. Andrew Avenue from
Monday to Friday bet~veea the hours of 8:00am and 4:30pm. These restrictions serve to prevent
motorists from stopping their vehicles on or near the comer of the intersection, where they would
impede visibility to other motorists during hours of heavier traffic flows.
Parking questionnaires were delivered to residents in the study section of Brock Street to
determine whether residents would like to implement some kind of restriction. Through the
questionnaire, residents had an opportunity to comment on the type of parking control that would
most benefit their situation. The following results were obtained from the questionnaires:

Martha Cullimore School was also petitioned as the parking concern is a result of parents
of the school's children parking their vehicles on Brock Street.
The questionnaires delivered to residents of Brock Street reveal that a large number of residents
are in favor of the installation of some kind of parking restrictions. Of the 14 questionnaires
delivered to homeowners residing in the study section of Brock Street, 10(71%) were returned, of
which 8(80%) were in favour of some kind of parking restriction.
Initially staff's observations during the winter period when snow was present revealed that
motorists park their vehicles the study section of Brock Street then proceed to Martha Cullimore
School to escort their children back to their vehicles. However, further observations reveal that
with the weather improving motorists stop and wait in their vehicles for children to arrive. It is
therefore recommended that stopping restrictions be implemented despite the petitions inquiry
for parking restrictions. The parking restriction prohibits parking, but allows motorists to stop
their vehicles for short periods of time provided they do not exit and leave their vehicle
unattended. The no stopping restriction prohibits motorists from stopping their vehicles in the
area unless the vehicle experiences mechanical problems and is unable to be driven from the
area. Although this prohibition is more restrictive, it is felt that the current problem experienced
on this section of roadway will be corrected properly with the use of stopping restrictions,
thereby eliminating obstruction caused by cars parked or stopped on both sides. It should also be
noted that all residences in the study section of Brock Street are able to accommodate parking for
at least two motor vehicles on their own property.
Based on the results obtained from the technical studies and the responses received from the
questionnaires, it is recommended that stopping be prohibited on the south side of Brock Street
between St. Andrew Avenue and St. George Avenue from Monday to Friday between the hours
of 8:00am and 4:30pm. Staff's review of the study section of Brock Street suggests those
stopping restrictions are necessary on at least one side of the roadway to allow ample room for
adequate vehicle manoeuverability. As the width of this section of Brock Street is only 7.5
metres, vehicles parking on both sides greatly reduce the amount of maneuvering space available
to other motorists. The implementation ora stopping restriction on the south side of Brock Street
would provide additional maneuvering room for motorists traveling on Brock Street during peak
hours of operation, ~vhile providing on-street parking for local residents on the north side of the
roadway. In addition, the restrictions shall provide vital maneuvering space required for larger
vehicles such as emergency and maintenance vehicles.
Fire Services has indicated that they would prefer to see both sides of Brock Street restricted to
parking.

Additionally, in the past staff has met with the principal of Martha Cullimore Public School and
School Board representatives with respect to the implementation of a Kiss & Ride pro,am for
Martha Cullimore Public School. Although several Kiss & Ride scenarios were evaluated and
proposed, no further information ',vas provided by the school or the School Board with respect to
the program. With the implementation of further parking or stopping restrictions in the area of
the school however, on-street parking will become limited for parents who choose to drive their
children to and from the school. Staffwill therefore inform the School Board to once again
consider the implementation of this safe and efficient program in hopes of providing additional
oft-street space where vehicles can be stored, predominantly during the schools pick-up times
when traffic congestion is high. Should the program be implemented, it ,,viii alleviate some on-
street parking concerns currently being experienced.
Staff has also been requested to investigate the possibility of widening this section of Brock
Street. In response, Engineering staff has been in contact with the petitioner and provided the
information necessary to initiate this process. To date no additional information has been
provided by the resident.

Kiwanis Bus Bench Program Update
RECOMMENDATION:
It is recommended that:
1) Council consider the request to for the City to install four (4) new concrete pads in 2005, at

BACKGROUND:
A tri-party agreement for the Kiwanis Bus Bench Advertising Pro.am between the City, Region of
Niagara and Kiwanis has been in place since 1997. This pro.am has allowed the Kiwanis Group
to place benches at various bus stops throughout the City on municipal and Regional road
allowances, These benches are placed in approved locations and provide advertising revenue to the
Kiwanis Group,

The City has assisted in the past by way of waiving fees to place the benches, and by also providing
up to $10,000.00 per year in poured concrete pads for those benches requiring bases. The Kiwanis
Group provided i 0 free advertising benches to the City to help offset these costs. Staff has indicated
that there is no need to advertise on the benches, however, it is suggested that the City still waive
the fees for processing and technical commenting on the placement of the benches, but not bear the
cost for the installation of the concrete pads.
The Community Services Committee at its meeting of January 31, 2005, deterred the matter of the
Kiwanis Bench pro,am, until such time that the Kiwanis ~oup cmdd provide the number of bench
locations requiring the construction of concrete pads, for 2005 (potential locations attached).
Furthermore, there ,,,/'ere questions concerning what activities that the Kiwanis group participated in
(background attached).
Should Council consider funding the installation of the concrete pads, then, a review of the City's
cost to construct the concrete pads indicates that it would cost approximately $1,500.00 per pad,
therefore, if approved, the cost to install four pads would be approximately $6,000.00.
It should be noted that it has been recommended in the Sign By-law Review Study tha~. the new sign
by-law prohibits signs on benches.

Re: Request to instal concrete pads at Kiwanis Bus Benches
The Kiwanis Club of Stamford Bus Bench Advertising Committee would like to propose that the
following bus bench locations receive concrete pods this summer.
1. McLeod Rd. (south side) in front of new McDonalds.
2. McLeod Rd. (north side) in front of entrance to Millenium Trail.
3. Dorchester Rd. (wast side) south of Thorold Stone Rd.
4. Dorchester Rd. (west side) near Dolphin St.
It would be most appreciated by the K~wanis Club, and the residents who use these benches, if
the City could pour pads at these locations this summer.
Please let us know whether the pads can be poured this year, and if so, when they would be
done.

RE: KIWANIS BUS BENCH PROGRAM
The Kiwanis Club of Stamford have made presentations to the Committee for the
renewal of our Bus Bench Contract on several occasions. A few questions that have
been raised by Members of the Committee and we felt that we should write to
summarize our position regarding the renewal of the Agreement.
The odginal Agreement between the City of Niagara Falls and Stamford Kiwanis began
in 1986. Since that time renewals of the Agreement have been done at their expiration.
It has now been approximately three (3) years since our Agreement expired and we
have been attempting to have it renewed. As you are aware it was held up for over
two (2) years with the Region and now they have given their blessing for the renewal.
It is a large undertaking for the Kiwanis Club of Stamford to convert the existing bus
benches to the new design which we agree would be much more aesthetically pleasing
then the existing bus benches. It will take a number of years before all of our benches
are converted to the new design. We are however willing to embark on this program
immediately. The additional cost for these benches will ultimately mean that some of
the money that we have been donating to the community will be used for upgrading
these benches.
As a result of the long term commitment that we are making we would like to have a
five (5) year with a five year renewable option in our Agreement from the date when
the City approves same.
A number of years ago the City indicated to us that they would prefer to see the
benches sitting on concrete pads rather than the ground and the City offered to spend
up to $:[0,000.00 a year for these pads. The selection of the locations has been a
combination between the City, Niagara Transit and the Kiwanis Club. It is our
understanding that at no time has the contribution from the City exceeded or even
come close to the $10,000.00 per year. We agree with the City that the benches would
be more pleasing to the eye if they were sitting on concrete pads rather than on the
ground or patio stone type installations. With the purchase of new benches it would be
virtually impossible for us to also embark on a program of installing concrete pads in
these areas as our expenses would then possibly exceed our revenue.
At the time the City requested and proceeded to install the concrete pads, we offered to
allow the use of ten (10) benches for advertising as we had surplus benches available
over and above those that had paid advertisers. As a good will gesture we are still
willing to allow the City to advertise on 10 benches if the City will install pads up to a
maximum cost of $10,000.00 per year.
We have always worked with Niagara Transit and the City in setting up the locations for
the bus benches and will continue working with them in this program.
It appears that these are two (2) final steps in order to have our Agreement finalized
and your consideration of these two points would be appreciated.
A question was also raised at one of the recent meetings as to what happens to the
funds earned by the Kiwanis Club and we would like to list some of the projects which
we participate in, in the community:

On Monday, May 9, 2005 a meeting was held with iMr. David Javonovic owner of the Lincoln Motor
Inn in regards to concerns with the condition of Main Street between Stanley Avenue and Murray
Street. These concerns were raised as a result of restoration works that were being carried out in
front of his property as a result of the construction taking place on Stanley Avenue. Mr. Javonovic
requested that rather than restore the asphalt that existed along the frontage of his property that a
concrete sidewalk be installed and in addition that the overhead street lighting on this section of
Main Street be replaced with under ground wiring and the street li*~hting upended.
Staff has agreed to install the concrete sidewalk along the frontage of his property which will
coincide with the concrete sidewalk that was terminated at Stanley Avenue and Main Street at his
property line. The request to upgrade the street lighting was denied as the future of this section et'
Main Street was still unclear.
On April 7, 2003, Community Services Committee considered report MW-2003-66 Main Street
Environmental Assessment where as the following motion was passed, "It was moved by Alderman
Puttick, seconded by Alderman Volpatti that the Committee authorizes staffto prepare and file an
environmental study report with option #6 as the preferred alternative and that the City proceed as
soon as possible in reviewing Main Street from Stanley Avenue to Murray Street."

The review of this section of Main Street was to take place once the reconstruction of the Stanley
Avenue/Main Street intersection ',vas carried. One of the options to be considered in this review ,,vas
the actual closure of this section of Main Street as suggested by Mr. Javonovic. In a letter dated June
2, 2003 to the Ministry of the Environment when Mr. Javonovic requested a bump up on the Main
Street Envirorm~ental Assessment, one of the alternatives that Mr. Javonovic,,,,,anted considered was,
~I requested that the City consider, which included such things as, the total closure of Main Street
from Murray/Allandale to Stanley and the conveyance of ail or part of Main Street road allowance,
so that our property would have oar frontage extended to Stanley Avenue." Accordingly, City staff
has been reluctant to expend any dollars on this section of Main Street until the review is carried out.
At the meeting of'May 9, 2005 Mr. Javonovic suggested that there is the possibiiity that rather than
proceed with another environmental assessment for this section of blain Street, which would be
required iPwe were to close it, he would prefer that the road be reconstructed to match the works that
have been carried out in the area. The cost to carry out the road reconstntction which includes the
street scaping is estimated to be $1 million. It should be noted that members of'the Fallsview BIA
have also requested that Murray Street from Stanley Avenue to Allendale Avenue also be
reconstnlcted.
On confirmation from Mr. Javonovic that he wishes to proceed with the reconstruction o£this section
of Main Street it is staff's recommendation that this project be considered for the 2006 budget.
Committee's concnrrence with the above recommendation would be appreciated.

RECOMMENDATION:
It is recommended that sta±Y continue its efforts to confirm the storm drainage system constructed
for the Orchard Grove Extension Subdivision is functioning in accordance with the approved
engineering desigm and undertake the necessaW repairs, as required.
BACKGROUND:
The purpose of this report is to provide City Council with a general overview of the drainage
concerns raised by the owners of' the subject property (Mr. & Mrs, Gerald Turner) and to intbm~
Council of the stafff's efforts to date.
The Process
The Orchard Grove Extension subdivision was approved and constructed in 2000-2001 and included
a unique lot configuration as shown on the attached plan (see Schedule "A"). The lot grading and
stormwater management system was designed to include a series o~' swales and subdrains which
collects surface runoff and discharges it under controlled conditions into the ponds located at Larry
DeLazzer Park which were built in the first phase of the adjacent development.
The development review process requires the proponent to submit a Master Grade Contro[ Pian
which sets out approximate ~ades and drainage flow patterns that are to be used by builders to
ensure the storm drainage system fanctions the way it was designed. The Master Grade Control Plan
includes approximate future elevations of the grade around the building envelope to ensure positive

drainage away from the building foundation. These elevations are used as a guideline because at this
stage the actual building design and configuration on the lot is unknown. The final lot grading is
verified in what is essentially a three-step process.
1. Prior to construction the owner's surveyor locates the building on the property and shows
existing and proposed ground elevations.
2. Staff in the City's Building Department review the proposed grades and check them against
the Master Grade Control Plan to ensure general compliance prior to issuing a Building
Permit.
3. The owner's surveyor confirms the actual grades on the site after the home is constructed and
must advise in writing that the intent of the Master Grade Control Plan has been met. When
the City's Building Inspector is satisfied that this is the case the builder's lot grading deposit
is returned.
The City has accepted the lot grading on all lots within this subdivision and will shortly be in a
position to assume all of the works.
The Issue
The Turner's purchased the lot at 5715 Magnolia Drive (see Lot 32 on Schedule "B") and
subsequently hired a builder to construct their custom home on this site. The orientation of the home
places the driveway along the existing swale/storm sewer system. The Turners' have expressed
concerns, since the outset, that their driveway is inundated ~vith surface water on a regular basis and
that runoff from adjacent lands has been permitted (through the City's lot grading approval process)
to exacerbate their problem. Mr. Turner also has concerns that the sewer system under the swale was
not constructed in accordance with the original approved drawings and as a result is contributing to
the wet conditions in his driveway.
Staff Response
Municipal Works staff has visited the site a number of times and has confirmed through video
inspection that the piping has been installed according to the original design and is functioning ~vell.
YVhat cannot be confirmed, to Mr. Turner's satisfaction, without excavation is the integrity of the
filter cloth and depth of the granular backfill. It is important to understand that this collection system
also has the ability to surcharge within the system and exfiltrate back into the subsurface. This
explains why this area is ~vet even afier 2-3 days of dry weather.
It is the staff position that the collection system should not have to be redesigned to accommodate the
site specific layout of the new home and have made suggestions to Mr. Turner to take action to
mitigate the impacts by undertaking minor improvements such as:
· removing his sump pump discharge pipe to another downstream location,
redirecting two downspouts that discharge onto the driveway,
· raising the depth of the gravel in the driveway (or paving it), or
· building a retaining wall along the edge of the driveway (as done by the owner on Lot 31).
After a series of meetings with staff, aldermen, the developer, the builder, the contractor and
neighbours the matter is still unresolved.

In the spirit of cooperation, Municipal Works staff arranged with the contractor to complete some
exploratory excavation and reinstatement in January of this year. A letter outlining the scope of the
works was provided to Mr. Turner as a courtesy (see Schedule "D"). Mr. Turner contacted staff
shortly before the commencement of the works and asked staff to modify the specifications. Staff
were not convinced that the changes Mr. Turner asked to have included wot~ld resolve his concern
and postponed the work. Staff has not rescheduled the completion of this work, given the other
priorities it is currently managing, but hope to get this matter resolved sometime this summer. The
estimated cost of the work should not exceed $5,000 which would be funded from the Municipal
Works Operations Budget.
This report has been prepared in anticipation of a request by Mr. Turner to approach City Council
regarding his concerns. Please note staffs intentions to continue to work toward a resolution to this
matter unless directed to do otherwise by City Council

Further to our brief site meeting, held on January 5, 2005, the City of Niagara Falls requires your
assistance in conducting an investigation and modification to the remyard storm water collection
system originally installed during the underground servicing for this subdivision.
The scope o f this project will include the following key procedures:
1. Pre.construction photographs (dlgital) of the existing swale that show the
condition of the surface and limits tithe gravel driveway and sodding on the
adjacent rear lots.
2. Removal of the top layers of material, exposure of the filter doth that
surrounds the pipe, verification of existing perforated pipe~ and granular
material as per specification (see attached).
3. Reinstate of the existing ~ter cloth and baclcfill the trench with dear stone
to an elevation that allows proper drainage from the properties on both sides
of the trench. (Note: This grade will have to be determined in the field by
City personnel).
4. Restoration of uny damaged sod or driveway materials that were disturbed
during the project.
5. Post.construction photographs (digital) of the new swale.

Based on our discussion, you were going to monitor the weather conditions and complete these
w°rks when dismpti°n and inconvenience could be minimized to the adjacent property owners. We
would appreciate 48 hours notice so that we can arrange to have a City inspector on site and provide
notice to the affected homeowners.
