RECOMMENDATIONS:
it is recommended that:
1) the existing intersection control at the intersection of Forest Glen Drive at
Glenoaks Avenue be maintained;
2) a stop line be applied at the existing stop sign facing northbound motorists on
Glenoaks Avenue at the intersection of Forest Glen Drive and Glenoaks Avenue;
and,
3) a crosswalk be applied across the south approach at the intersection of Forest Glen
Drive and Glenoaks Avenue.
BACKGROUND:
On April 18, 2005, further to report MW-2005-34, Council passed a motion for staff to
investigate the feasibility of installing an ail-way stop control at the intersection of Forest Glen
Dhve and Glenoaks Avenue. As part of the above-mentioned report, staff recommended the
installation of a stop sign facing northbound motorists on Glenoaks Avenue at the uncontrolled
intersection of Forest Glen Drive and Glenoaks Avenue. The concern at this location stems from
a possibility of a conflict occurring between motorists and school children walking to/from St.
Vincent de Paul Catholic Elementary School.
The study intersection is in a "tee" configuration consisting of a south and east/west approaches.
The west approach is only approximately 25 metres in length terminating at the rear pedestrian

entrance to St. Vincent de Paul Catholic Elementary School. As mentioned previously, the study
intersection is controlled by a recently installed stop sign facing northbound motorists on
Glenoaks Avenue.
Forest Glen Drive is a short residential roadway extending in an east/west direction from
Oakridge Drive to a point approximately 25 metres west of Glenoaks Avenue. In the study area
the roadway is 9.5 metres in width and consists of a sidewalk on both sides. Glenoaks Avenue is
a residential roadway extending in a north/south direction from Thorold Stone Road to Forest
Glen Drive. In the study area the roadway is 8.0 metres in width and consists of a boulevard and
a sidewalk on both sides.
In order to determine whether the all-way stop control is warranted at the study location, The City
of Niagara Falls Residential All-way Stop Warrant was completed. As part of the warrant the
following studies were conducted:
turning movement count
· review of collision files
· visibility studies
· technical observations
residential petition form
The results obtained from the turning movement count reveal that vehicular traffic volumes at the
study intersection are low. In fact, only approximately 50 motor vehicles per hour in total utilize
the study intersection. Of the motorists traveling at the study intersection, the overwhelming
majority were northbound right tums from Glenoaks Avenue onto Forest Glen Drive, and
westbound left tums from Forest Glen Drive onto Glenoaks Avenue. Parents who were
transporting their children to/from St. Vincent de Paul Catholic Elementary School were
observed to be the only motorists utilizing the west approach. The majority of children utilizing
the study intersection crossed the south approach which is controlled by a stop sign. In total,
over 100 children were observed crossing the south approach of the study intersection on a
typical summer day.
A review of collision files reveals that a collision problem was not present at the intersection of
Forest Glen Drive and Glenoaks Avenue in the past. Sight investigations reveal that adequate
visibility is available to motorists traveling in all directions. The results obtained from the
residential petition form revealed that only one resident was in favour of an all-way stop control,
therefore, a minimal response rate (80%) required to warrant this section of the All-way Stop
Warrant was not attained.
Based on the results obtained from all above mentioned technical studies, The City of Niagara
Falls ResidentialAll-way Stop Warrant is not fulfilled. It was determined that the existing stop
sign is the most feasible intersection control. Therefore, it is recommended to maintain the
existing intersection control at the intersection on Forest Glen Drive and Glenoaks Avenue.
However, to further encourage northbound motorists on Glenoaks Avenue at Forest Glen Drive
to complete a fully legal stop, a stop line is recommended to be applied. Furthermore, to
delineate the crossing path for students utilizing the study intersection, a crosswalk is

recommended to be applied across the south approach.

RECOMMENDATIONS:
It is recommended that: The traffic control measures recommended in the staff report be
implemented at the intersection of Cardinal Drive at Oakridge Drive.
1) the existing yield sign facing eastbound motorists on Oakridge Drive at the intersection
of Cardinal Drive and Oakridge Drive be replaced by a stop sign;
2) a stop line be applied at the proposed stop sign facing eastbound motorists on Oakridge
Drive at the intersection of Cardinal Drive and Oakridge Drive; and,
3) a crosswalk be applied across the west approach at the intersection of Cardinal Drive and
Oakridge Drive.
BACKGROUND:
In reply to a concern from a representative of St. Vincent de Paul Catholic Elementary School,
staff has reviewed traffic operations at the intersection of Cardinal Drive and Oakridge Drive.
The concern at this location stems from a possibility of a conflict occurring between motorists
and children walking to/from St. Vincent de Paul Catholic Elementary School.
The study intersection is in a "tee" configuration consisting of a north/south and west
approaches. As mentioned previously, the intersection of Cardinal Drive and Oakridge Drive is
currently controlled by a yield sign facing eastbound motorists on Oakridge Drive.
Cardinal Drive is a collector roadway extending in a north/south direction from Thorold Stone
Road to Monastery Drive. In the study area, the roadway is 9.5 metres in width consisting ora

sidewalk and a boulevard on both sides. The roadway consists of several curves and therefore, a
portion of Cardinal Drive actually extends in an east/west direction. Oakridge Drive is a short
residential roadway extending in an east/west direction from Glenoaks Avenue to Cardinal Drive.
In the study area, the roadway is 8.0 metres in width consisting of a sidewalk on the south side
only. Oakridge Drive also consists of two horizontal curves and therefore, a portion of the
roadway actually extends in a north/south direction.
A review of collision files reveals that there were no collisions reported, at the study intersection,
during the previous three-year period. Technical observations reveal that the majority of children
utilizing the study intersection were observed to cross the west approach. In total, over 40
children were observed crossing the west approach of the study intersection on a typical summer
day. Therefore, based on this information, it is recommended to implement a more restrictive
intersection control device at the study intersection. Legally, a stop sign requires each motorist to
complete a full stop prior to proceeding through the intersection. Since children are crossing the
west approach, a stop sign facing, eastbound motorists ~vould reduce the possibility of a conflict
occurring between motorists and pedestrians by adequately allocating the right-of-way. A stop
line is recommended to be applied at the west approach to further encourage motorists to
complete a full legal stop. A crosswalk is also recommended to be applied at the west approach
to delineate the crossing path.
The Committee's concurrence with the recommendations outlined in this report would be
appreciated.

Stanley Avenue Business Park Directory Sign
RECOMMENDATION:
That signage for Micron not be allowed on the City's Stanley Avenue Business Park directory sign.
BACKGROUND:
At the July 15, 2002 Council meeting, report MW-2002-88 Stanley Avenue Business Park was
approved. This report (attached) recommended that way-finding signs be installed along McLeod
Road, Stanley Avenue and Marineland Parkway for directional purposes to the Industrial Park. In
addition, a directional sign for Niagara Clock and Giftware could be installed on the City's Stanley
Avenue Business Park directory sign, in order to assist Niagara Clock and Giftware with its business.
This sign was installed as a result of Niagara Clock and Giftware's letter of June 6, 2002 (attached).
The removal ofsignage that was illegally installed on Stanley Avenue resulted in the loss of business
for Niagara Clock & Giftware.
At the Stanley Avenue Business Park Association (SABPA) meeting of June 4, 2003, it was
indicated that Niagara Clock and Giftware had moved out of the Stanley Avenue Business Park. As
a result, the Association approved the motion that the Niagara Clock & Giftware sign be removed
from the business park directory sign on Stanley Avenue as soon as possible. There had been
concerns expressed by Association members at previous meetings concerning the look of the sign
as compared to the business directory and giving unfair advantage of one business over another. At
the SABPA meeting of September 3, 2003, Ron Lefebvere indicated that Micron had purchased the
sign from Niagara Clock and was in the process of having a Micron sign inserted into the frame.
Following some discussion on the matter, the Association agreed to defer the matter until the next
meeting of the Association. At the January 8, 2004 meeting, considerable discussion took place

regarding the matter which included ownership of the sign and proper protocol in requesting that a
sign be installed. During this discussion, it was suggested that this matter be directed to the City and
Micron to resolve. Also, during the meeting, the Association approved the motion that the SABPA
be provided the right to review and comment, when any further signage is proposed for the Industrial
Park.
The matter was reviewed by City staff which resulted in an opinion from the City's solicitor
indicating that the Micron sign was illegal and could be removed by City forces. Accordingly, on
August 31, 2004, a letter dated August 31, 2004 from By-law Enforcement was sent to Micron
indicating that the sign had to be removed. In response Mr. Hess requested that this matter be
brought to the attention of Council.
Accordingly, on September 20, 2004, Committee considered report BDD-2004-01 (attached). As
indicated in the report, it was recommended that the SABPA be requested to provide comment on
the matter. At the September 29, 2004 meeting of the SABPA, Mr. Lefebvere made a motion
requesting the members support allowing the Micron sign to remain. This motion was not carded.
A motion was then made and approved that a ballot card be sent to all the businesses in the Stanley
Avenue Business Park for their comment and vote on whether they felt the Micron sign should be
allowed to remain attached or that it should be removed.
On November 2, 2004, the results of the ballot were forwarded to the Mayor and Members of
Council (attached), which indicated that the sign should be removed. In response, a letter dated
November 5, 2004 from Micron was forwarded to Mr. David Allan, Chair, SABPA, with concems
regarding the balloting. At the April 20, 2005 SABPA meeting, Mr. Hess moved that the ballot
process be investigated. There was no seconder to this motion and no subsequent motions were
made.
Based on the above it is staff's recommendation that the sign not be allowed.

RECOMMENDATION:
It is recommended that Council endorse the installation of signs on the rail bridge on
McLeod/Madneland Parkway with the wording "Stanley Avenue Business Park Factory Outlets"
and the smaller signs on Stahley, McLeod, Marineland Parkway. for directional purposes to the
industrial park, subject to Regional approval for all the signs.
BACKGROUND:
Business Development Staff has worked with the Stanley Avenue Business Association for the last
several years. Directional signs to the Park are an ongoing concern to businesses in the Park. In
response to Niagara Clock & Giftware's request letter to Council on June 17th to install directional
signs to find their business located in the Stanley Avenue Business Park.
On June 26, 2002, Staff from Business Development, Building & By-Law and Municipal Works
met to discuss the matter. Staffwas in agreement that the directional signs to the industrial park
along McLeod, Stanley and Marineland Parkway were in need of updating. Staffwas in agreement
to work with the Stanley Avenue Business Park Association and with the Region to install one sign
on the east side of the rail bridge and to update the smaller signs on Stanley & McLeod. The signs
would be designed similar to the other Tourism Destination signs posted throughout our community.
Municipal Works Staffhas estimated the cost of the signs to be approximately $2,000.00 and would
be the responsibility of the private sector to pay for the signs. Staff agreed that Niagara Clock &
Giftware could attach a directional sign to the already existing Park sign on Progress Street at their
own expense and subject to design approval by both the City and the Region.
Business Development Staff invited the businesses in the Stanley Avenue Business Park to attend
a meeting to discuss direction signs to the Park. The meeting took place on Wednesday, July 3,
2002 at 11 a.m. in the board room of Oneida. In attendance was Business Development Staff, Doug
Clancy, Oneida Canada, Anthony & Lorraine Bolgar, Niagara Clock & Giftware and regrets were
received by Micron. Business Development Staff presented the recommendation to the two

interested businesses. Both Oneida Canada and Niagara Clock & Gifiware have agreed to the sign
design, suggested locations and to share the cost of the signs. Niagara Clock & G-iftware has agreed
to pay the entire cost, design and installation ora sign attached to the existing Park sign on Progress
St. (Attached are letters from Oneida Canada and Niagara Clock & Gifiware.)
All the signs installations are dependent upon Regional approval.

This letter is in response to our meeting with Wendy Canavan at the Oneida office in Niagara
Falls on Wednesday July 3, 2002.
Please be advised that Niagara Clock & Giflware would be willing to share the costs for the
installation of a directional sign at Marineland Parkway railroad crossing for the Stanley Avenue
Business Park Community that includes the r~ferance to Factory Outlets.
In addition, Niagara Clock & GiRware proposes a directional sign that would become part of the
existing community sign, located at the comer of Stanley Avenue South and Progress Street.
This sign would be constructed to be identical to the existing business park sign. Niagara Clock &
Gifovare further proposes that the sign be made and installed by Niagara Clock & ~are to
reduce the cost. However, if the city wants to handle the construction and installation, that of
course would be acceptable.

Niagara Clock & ~are is a family owned/operated small business manufacturer
located in the Stanley Avenue business park. We produce fine docks and giftware which
are sold wholesale, as well as to consumers from our manufacturer's factory
outlet/showroom. Complete repair service is provided to round out the overall services to
OUI' gustomeI3.
Our manufacturing operation has been successful in the past several years. One primary
reason for this is due to the directional signs located on Stanley Avenue to direct
businesses and consumers to find our location in the park. Many business representatives
have discovered our facility via the directional signs while in the Stanley Avenue area,
resulting in orders being placed. Last week City Staff requested the removal of our
temporary signs along Stanley Avenue. Within the first week the results have indicated
that our customers cannot find out where we are located. If this continues it will force our
business to dose, resulting in the loss of two full time and two part time positions.
We are requesting City Council to consider our special sign permit for directional signs to
be placed along Stanley Avenue. See our attached sign drawings.
.There would be no cost to the city, as we would fabricate, install and maintain these
signs. We also pledge to work with city officials necessary to make sure that everything
meets the city's approval.

Stanley Avenue Business Park Directory Sign
RECOMMENDATION:
1) That Micron submit in writing an application for a sign p,mfit which would allow their
business sign to be affixed to the City's Stanley Avenue Business Park Directory Sign at
the comer of Progress Street and Stanley Avenue, and
2) That Micron's request be forwarded to Stanley Avenue Business Park Association for
consideration and comment at its next meeting, scheduled to be held on September 29,
2004.
BACKGROUND:
In 2002, Council granted permission to Niagara Clock to affix a small sign to the Stanley Avenue
Business Park Directory sign on Progress Street. No such pe~'mission was granted to Micron.
The Stanley Avenue Business Park Association has discussed thc Park's directory signs many times
over the past few years. In 2003, after Niagara Clock had relocated outside of the industrial park,
the Association requested that the City remove ma affixed sign from the City's Stanley Avenue
Business Park Directory Progress Street sign. The sign was removed, but the steel frame remained
attached to the sign.
Over thc past several years, Staff reviewed the sign process with Micron to request their own sign
to be affixed to the Stanley Avenue Business Park Directory sign. Micron representatives discussed
the matter several times over 2003-2004 with the members of thc Stanley Avenue Business
Association during their meetings.

M. icron representatives informed the City and the Association members that they had purchased the
sign from Niagara Clock in September 2003. The matter was deferred until Ma'. Hess was able to
attend a meeting. Prior to the next Association meeting, November 2003, Micron installed a sign
affixed to the Progress Street Business Park sign without the necessary approvals. The matter was
brought forward to the Association's, January2004, meeting where Mr. Hess was in attendance. The
Association members did not want to comment on the sign until the ownersttip issue was resolved.
The members did make a motion to request that any future sign requests be sent to the Association
for its comments. Staffeonsulted with Legal Services and confirmed that the Micron sign is illegal.
On August 3l, 2004, a letter was sent to Mr. Hess, Micron Installations Limited, to make the
necessary arrangements to remove their sign.
Mr. Hess upon receipt of this letter contacted Building & By-Law Services staff requesting to
address Council on this matter.
To date, the City has not received a written application/permission request from Micron to affix its
sign and therefore has not brought the matter back to the Association members for comment.

It is recommended that Council endorse the installation of sjgnn on the rail bridge on
McLcod/Marineland Parkway with the wording "Stanley Avenue Business Park Factory Outlets"
and the srnaller signs on Staifley, McLeocl, Marineland Parkway. for directional purposes to the
industrial park, subject to Regional approval for all the signs.
BACKGROUND:
Business Development Staffhas worked with the S~anley Avenue Bus/ness Association for the last
several years. Directional signs to the Park are an ongoing concern to businesses in the Park. In
response to Niagara Clock & Gi/~cware's request letter to Council on June 17t~ to install directional
signs to find their business located in the Stanley Avenue Business Park.
On Jtme 26, 2002, Stafffrom Business Development, Building & By-Law and Municipal Works
met to discuss the matter. Staff'was in agreement that the directional signs to the industrial park
along McLeod, Stanley and Marineland Parkway were in need of updating. Staffwas in agreement
to work with the Stanley Avenue Business Park Association and with the Region to install one sign
on the east side of the rail bridge and to update the smaller signs on Stanley & McLeod. The signs
would be designed similar to the other Tourism Destlnation signs posted throughout o~r cemrau~ity.
Municipal Works Staffhas estimated the cost of the signs to be approxim ately $2,000.00 and would
be the responsibility of the private sector to pay for the signs. Staff agreed that Niagara Clock &
Cfi_eo~are could attach a directional sign to the already ex~iug Park sign on Progress Street at their
own expense and subject to design approval by both the City and the Region.
Business Development Staff invited the businesses in the Stanley Avenue Business Park to attend
a meeting to discuss direction signs to the Park. The meeting took place on Wednesday, July 3,
2002 at 11 a.m. in the board room of Ondda. In attendance was Business Development Staff, Doug
Clancy, Oneida Canada, Anthony & Lorraine Bo[gar, Niagara Clock & Giflware and regrets were
received by Micron. Business Development Staff presented the reqommendation to the two

interested businesses. Both Oneida Ca~ada and Niagara Clock & Oiftware have agreed to the sign
design, suggested locations and to share the cost of the signs. Niagara Clock & Giftware has agreed
to pay the entire cost, design and installation of a sign attached to the existing Park sign on Progress
St. (Attached are letters from Oneida Canada and Niagara Clock & Giftware.)
All the signs installations are dependent upon Regional approval.

The Stanley Avenue Business Park Association (SABPA) reviewed the above noted item of business at
our 3rd quarterly meeting on September 2, 2004. Upon discussion, our membership elected to provide
comment to the City's Community Services Committee to assist in bring/ng a resolution to this matter.
In the interest of obtaining a fair and democratic opinion, a motion was carried to poll all members in our
Association via a ballot voting card. Ballots were distributed to membership and the results of the polling
process indicate that members feel the sign should be removed in order to have equal representation to
all businesses within the Industrial Park.
Going forward, members respectfully request the opportunity to review and comment to Council on any
future sign requests.

Horse-drawn Carriage Service - Portage Road
RECOMMENDATIONS:
It is recommended that: That the alternative routing and conditions for the horse-drawn carriage,
utilizing Fallsview Boulevard, Murray Street, Stanley Avenue and Main Street, as outlined in the
addendum dated June 27, 2005, be.approved. .
1) the trial operation, request by Sentineal Carriages Inc. and thc Embassy Suites Hotel, for
horse-drawn carriages on Portage Road, not be approved; and,
2) representatives of the Embassy Suites Hotel, Sentineal Carriages and Staff meet to review
other safe and viable aRematives for the trial operation of a home-drawn carriage service
in the area.
BACKGROUND:
Staff has been requested by Scntincal Carriages Inc. and thc Embassy Suites Hotel, to investigate
the possibility of starting a horse carriage route along Portage Road, on a trial basis, for a one
month period. Should it be successful, they are seeking approval for a permanent service, for the
operation of two carriages.
The proposed route would begin at the Embassy Suites Hotel located on the southeast comer of
the intersection of Portage Road/Main Street and Fallsview Boulevard, and travel east toward
Casino Service/Bus Entrance and then continue south to the Niagara Parks Commission parking
area, located across the street from the Historic Mount Carmel Chapel building, on the east side
of Portage Road, where the home drawn carriage would turnaround and return to the Hotel.
Loading and unloading of passengers would take place on the property of the hotel and would
need to be shared with the loading and unloading of buses/cam. The proposed hours of operation
of the carriages are between 11:00am and 4:00pm, Monday to Friday excluding holidays.
Staffhas undertaken a review of the area to determine whether it is safe to operate horse drawn
carriages on Portage Road in the subject road section. The review included; a traffic volume
count review, road measurements, a pavement marking review, a collision review, a passing sight

distance review and general observations of the area.
The east/west road section of Portage Road consists of sidewalks on both sides and two traveled
lanes, with additional turning lanes at the signalized intersections at the Casino and at Fallsview
Boulevard. The north/south road section of Portage Road between the Casino Service/Bus
entrance and McLeod Road is rural in nature, consisting ora sidewalk on the east side of the
roadway only up to the turnaround point. There are minimal shoulders in the subject road
section. As well, there are utility poles, delineated by hazard makers, situated on the west edge
of the traveled lane in southbound direction. The width throughout the majority of the subject
area is 7 metres. The posted speed limit of Portage Road is 50 km/h.
A review of the most recent traffic volume counts was conducted on the study section of Portage
Road. These counts were conducted for a 24-hour period during the fall and summer cycles.
The traffic volumes dated November 29, 2004 (fall cycle) reveal a total of 2810 vehicles. The
peak hour periods of this count occurred at 12:00pm with 180 vehicles and at 4:45pm with 220
vehicles. A count dated June 29, 2004 (summer cycle) reveals a significant increase in traffic
volume as a total of 3731 vehicles were counted. The peak hour periods of this count occurred at
12:00pm with 244 vehicles and at 5:15pm with 289 vehicles. The volume split on the roadway
indicates that 1861 vehicles traveled northbound during the summer cycle, 1870 vehicles traveled
southbound during the summer cycle, 1365 vehicles traveled northbound during the fall cycle
and 1445 vehicles traveled southbotmd during the fall cycle.
Measurements of the roadway surface were also conducted throughout the study section of
Portage Road. As previously mentioned, the roadway width of the subject road section is 7
metres with a lane width of 3.5 metres. Measurements also reveal that the roadway expands
slightly to 7.5 metres near the proposed tumaround area located opposite the Historic Mount
Carmel Chapel building. The width of proposed carriages are !.9 metres.
A collision review for the study section of Portage Road was also conducted. A review of
collisions for the previous three year period reveals that there have been eight collisions in the
section of Portage Road between Fallsview Boulevard and McLeod Road. Various types of
collisions were identified including three single motor vehicle collisions, one head-on collision,
one sideswipe collision, one angle collision, one rear collision and one turning movement
collision. Four of these collisions occurred during the summer period. One collision occurred
during the proposed operating times of the carriages.
Observations at the location were also carded out. During observations it was noted that a 450-
metre portion of Portage Road is sloped. This section is located between the curve of Portage
Road near Embassy Suites Hotel to a point 450 south. Also, several curves in the roadway were
noted throughout the length of Portage Road in the study section. Trees on each side of the
roadway were also observed to overhang the roadway creating additional visibility concerns on
sections where the roadway curves and/or begins to slope and as previously mentioned, there are
utility poles, delineated by hazard makers, situated on the west side edge of the traveled lane in
southbound direction.
Measurements and calculations were conducted to determine the minimum allowable passing
sight distance for motor vehicles traveling on Portage Road. Calculations to determine the
amount of distance required to overtake a vehicle traveling approximately 6 km/h were
conducted revealing that a minimum of 193 metres of space is necessary to carry out this
manoeuver safely, provided it requires a time frame of four seconds to overtake the vehicle. The

minimum passing sight distances in the southbound direction were recorded to be 2 ! 6 which
meets minimum criteria. The distances measured in the northbound direction do not meet
minimum criteria, as the lowest distance measured in the northbound direction for passing sight
distance is 169 metres.

Based on the above information, Staff have the following safety concerns with the operation ora
horse dra~vn carriage in the subject road section:
1) The numerous horizontal curves along the proposed route make it difficult motorists
wishing to pass the slow-moving horse-drawn carriage in a safe manner;
2) The narrow road section does not offer the opportunity for the horse-drawn carriage pull
over to allow motorists to pass in a safe manner;
3) Impatient drivers may choose to pass the carriage in an unsafe manner, due to the fact that
the passing sight distance in the subject area is below standard;
4) Motorists who do not overtake slow-moving vehicles, are forced to travel behind the
slow-moving vehicle, thereby, long traffic queues may occur; and,
5) There are potential conflicts with tour buses and commercial vehicles destined for the
Portage Road Casino entrance.
The current horse-drawn carriage operation in the Niagara Parks offers opportunities for vehicles
to pass the slower moving horse-drawn carriages safely, this is due to the fact that they are
operating on two plus, traveled lanes of traffic in each direction.
Staff recognizes that horse drawn carriages are popular with tourist and locals alike and generally
have the support of the business community. However, based on the above information
concerning the safety of the motoring public, the carriage operators and the passengers, the
proposed routing cannot be supported. Therefore, it is suggested that the representatives of the
Embassy Suites Hotel, Sentineal Carriages and Staff meet to review other safe and viable
alternatives for the trial operation of a horse-drawn carriage service in the area.
The Committee's concurrence with the recommendations outlined in this report would be
appreciated.

BACKGROUND:
On June 13, 2005, Council directed Staff not to proceed with the full design of Dorchester Road and
Morrison Street. There were concerns raised with respect to the Environmental Assessment and the
timing of the design. On June 23, 2005 Staff received notification from the Mini. stry of the
Environment that all Part II Order requests were denied and the Environmental Assessment was
approved (see attached correspondence).
DESIGN
Staffare recommending that we proceed with the entire design at this time for the following reasons:

· The City will be able to determine the exact impact on all the properties within the effected
area. At present, discussions with all the property owners are based on the drawings prepared
for the environmental assessment. The detailed design may show that the property
requirements can be minimized or eliminated and the concerns of the residents addressed.
· The design will be completed in accordance with the approved Environmental Assessment.
The City has committed to working with the effected property owners during the design and
only taking the minimum property required to construct the works:
· There is an economy of scale in doing the entire design. Doing the design in pieces will
increase the overall cost of the design.
· The City will be able to determine the location of the curbs in front of Mr. Redekop at 3855
Dorchester Road. The City can then place the curbs in the ultimate location and minimize
throw away costs in the future.
· It will minimize the chances that cross issues will be missed by different consultants doing
the different phases of the design.
In addition to proceeding with the entire design, Staff are recommending the Morrison Hershfield
be awarded the design project (see attached report MW-2005-83 which was deferred).
OPERATIONAL REVIEW
Several property owners have the opinion that the work between Morrison Street and Thorold Stone
Road will not be required once the other phases have been constructed. To address this issue, Staff
are recommending that the City complete an operational review once the Phase 1 works are
complete. Obviously, if the traffic patterns change as a result of the Phase 1 works and the additional
phases are not required, Staff will be recommending not to proceed with them.
Committee's concurrence with the recommendation made is requested.

Between September 12 and October 21, 2004, I received several requests from members
of the public that the City of Niagara Falls be required, to prepare an individual
environmental assessment for the proposed Dorchester Road and Morrison Street
Reconstruction (Project), located in the City of Niagara Falls.
I am taking this opportunity to inform you that a decision has been made that an
individual environmental assessment is not required. This decision was made after giving
careful consideration to the issues raised in the requests, the Project documentation, the
provisions of the Municipal Engineer's Association Municipal Class Environmental
Ass~sment (Class EA), and other relevant matters required to be considered under
subs. ection 16(4) of the Environmental Assessment Act. The reasons for my decision may
be found in the attached letter to the requesters.'
With this decision having been made, the City of Niagara Falls may now proceed with the
Project, subject to any other permits or approvals required. The City of]Niagara Falls
must implement the Project in the manner it was developed and designed, as set out in the
ESR and inclusive of all mitigating measures and environmental and other provisions
therein.

I would like to re. mind you that, as a result of the requests for an individual environmental
assessment having been made, applications for approval under the Ontario Water
Resources Act (oWt ) and tho Safe Drinking Water Act (SDWA) for works associated
with the Project will not be reviewed under the ministry's Transfer of Review program.
The Transfer of Review program allows the City of Niagara Falls to condact the
administrative and teelmical review of certain types of municipal water and sewage works
under the OWRA and SDWA. All applications and supporting documents for sewage,
stormwat'er, and water works to be constructed in the City of Niagara Falls, which are part
of the above-noted Project, must be made as direct submissions for review and approval
by this ministry.
Lastly, I would like to ensure that the City of Niagara Falls understands that failure to
comply with the Environmental Assessment,4ct, the provisions of the Class EA, and
failure to implement the Project in the manner described in the ESR, are contraventions of
the Environmental,4ssessment Act and may result in prosecution under section 38 of the
Act.' I am confident that the City of Niagara Falls recognLA, es the importance and value of
the Environmental AssesSment.dot and will ensure that its requirements and those of the
Class EA are satisfied.

Appointment of a Consulting Engineer
Dorchester Road Detailed Design
RECOMMENDATION:
It is recommended that the City of Niagara Falls enter into a Consulting Services Agreement with
Morrison Hershiield for $321,200.00 excluding GST for the detailed design of Dorchester Road and
Morrison Street.
BACKGROUND:
The Cityo fNiagara Falls advertised for qualified consultants to submit proposals for the preparation
of the detailed design for Dorchester Road and Morrison Street. The proposals were ranked on work
program, project team, work schedule and price by a committee of four staff members. The
consultants are listed below in order of there ranking:
1. Morrison Hershfield
2. Delean Corporation
3. Matrix Innovations Inc.
4. Earthtech Canada
5. Totten Sims Hubicki

Momson Hershfield has completed similar projects for the Ministry of Transportation and several
other municipalities. Staff have checked their references and are confident they will be able to
successfully complete this project.
This project was approved in the 2005 Capital Budget and $450,000 was allotted for the detailed
design.
Council's concurrence with the recommendation made is requested.
