His Worship Acting Mayor Vince Kerrio and Members of the Municipal Council City of Niagara Falls, Ontario July 25, 2005 Re: PD- 2005 -49, Official Plan Zoning By -law Amendment Applications AM- 06/2005, 3965 Oliver Street Applicant: Ralph Terrio Agent: Wayne Thomson Expansion of a Dwelling Located within an Environmental Protection Area Designation and within a Hazard Land Zone It is recommended that Council not approve the requested amendment applications which would allow for the expansion of an existing dwelling in an Environmental Protection Area and a Hazard Land zone. BACKGROUND: Proposal Ralph Terrio has requested an amendment to the Zoning By -law for a 413 square metre (0.1 acre) parcel of land on the north side of Bridgewater Street opposite Oliver Street, as shown on Schedule 1. The land is owned by the City and leased to the applicant. The applicant is proposing to convert the existing boat house into a dwelling and add a 2- storey, 130 square metre (1,400 square foot) addition resulting in a 165 square metre (1,777 square foot) dwelling. Details are shown on Schedule 2. The subject land is currently designated Environmental Protection Area in part and Residential in part in the Official Plan and zoned Hazard Land (HL). Expansion of the existing building and its proposed use as a dwelling are prohibited by both the Official Plan and Zoning By -law. The applicant proposes to add special policies to the Official Plan to permit the use and expansion of the existing building for a dwelling unit. A corresponding zone change to permit the proposal is also being sought. The land is an unopened road allowance owned by the City, which is subject to a 40 year lease in favour of the applicant. Ralph Terrio approached Council at its September 20, 2004 meeting seeking authorization to apply for the subject Zoning By -law amendment. At that time, a 49 square metre (532 square foot) addition was proposed which would result in an 84 square metre (909 square foot) cottage. Council granted this request. Staff had recommended denial of this request because the expansion of the dwelling would entrench a private use on publicly owned lands. A copy of staff report PD- 2004 -84 is attached for reference. Working Together to Serve Our Community Clerks Finance Human Resources Information Systems Legal Planning Development TT- July 25, 2005 2 PD- 2005 -49 Staff report PD- 2004 -84 also deals with authorization of a Zoning By -law amendment application for Mr. and Mrs. Erwin, who similarly lease the unopened Sodom Road road allowance abutting Welland River. Council approved the Zoning By -law amendment application submitted by Mr. and Mrs. Erwin earlier this year. The Erwin application differs in several respects from the Terrio application as follows: an Official Plan amendment was not required; an EIS submitted with the application indicated no adverse impacts; and the Region and NPCA did not object to the application. Although Mr. Terrio describes the building on the subject lands as an existing dwelling, it is understood by staff that the building is a boat house which has been used as a seasonal private use. Municipal water and sewer services were extended to this boat house in 2002, but no building permits have been issued that would see this boat house converted to a dwelling. As such, it has been confirmed to the applicant that this application involves the establishment of a new dwelling unit. Surrounding Land Uses The Welland River lies to the north of the property. To the east and west are undeveloped lands owned by the City and Ontario Power Generation, while to the south, on lands designated and zoned for residential uses, there are dwellings. Circulation Comments Regional Municipality of Niagara Welland River has been identified as a Type 1 "Critical" Fish Habitat by the Ministry of Natural Resources that could be sensitive to environmental disturbances. A 30 metre vegetated buffer is normally required adjacent to such water courses, on the subject property the addition would be constructed only 5 metres from the water course, therefore having a high potential of adversely impacting the fish habitat. The boat house and dwelling addition are within the regulatory flood plain. The new Provincial Policy Statement states that development and site alternations shall not be permitted within a flood plain. Therefore, the proposed development would be contrary to the Provincial Policy Statement and would result in a higher risk to public safety and property damage. Regional Planning staff is unable to support approval of the proposed amendments. Niagara Peninsula Conservation As Welland River is a Type 1 "Critical" Fish Habitat, Authority (NPCA) with sensitive species and/or habitat, a 30 metre vegetated buffer is required. The application does not provide this buffer. July 25, 2005 3 Municipal Works PD- 2005 -49 The dwelling falls within the regulatory flood plain (set at the maximum permitted water levels on this river, as controlled by Ontario Power Generation) and most of the lot lies within the fill regulated area. NPCA's regulations do not permit a new dwelling in a flood plain. NPCA does not support this application. An existing City stormwater sewer runs through the property, this sewer needs to be plotted on the plan to ensure the new dwelling does not affect this sewer. A future road widening allocation of 2.4 metres along Bridgewater Street needs to be provided. Parks, Recreation Culture If Council approves the application, it should be conditional on a recreational trail being allowed through the land. Any tree removal on the property is subject to City approval. Environmental Impact Study Pursuant to the Official Plan and agency requirements for development in Environmental Protection Area designated lands, the applicant retained a consultant (Lisa Campbell and Associates) to conduct an Environmental Impact Study. This study concluded that construction of the addition would likely result in a harmful alteration, disruption or destruction of fish habitat in Welland River and/or shoreline areas due to the proximity of the construction to the river. Authorization from the Department of Fisheries and Ocean would be required. The consultant also indicated certain mitigation measures, such as limit -of -work fencing and silt fencing to protect the shoreline and river and enhancement of overhanging of vegetation along the shoreline to improve the habitat of fish, if this development is approved. Planning Analysis Due to the public safety concerns caused by building a dwelling in a flood plain, the potential negative impacts on environmental areas (Welland River and the shoreline) and the lack of conformity with the City's Official Plan policies, this application cannot be supported. The following is a summary of the planning analysis. 1. The requested Official Plan amendment does not meet the criteria to consider an Official Plan change. Amendments to the Official Plan may be considered subject to a set of criteria outlined in Part 4, Section 2.6. The application does not meet the relevant criteria as follows: a) The conformity of the proposal to the general objections of the Plan. The portion of the land below the Regional flood line is designated Environmental Protection Area, while the balance of the land is designated Residential. Environmental Protection Areas are lands that have high quality plant and animal communities and unique July 25, 2005 Plan PD- 2005 -49 fish, plant and wildlife habitats that are to be protected, or are lands subject to flooding where development may pose a risk to occupants or properties. Use of land is restricted to conservation forestry, wildlife management and flood and erosion control. Buildings and structures within Regional flood lines are prohibited unless approved by the NPCA. In addition, Environmental Protection Area lands along Welland River are intended to be acquired or maintained under a public agency. Residential lands are intended to be used primarily for a variety of dwelling units. Due to its location entirely within the Environmental Protection Area and within the flood plain, the proposed dwelling cannot be considered in conformity with the general objectives of the Official Plan. Although water levels on the Welland River are regulated by Ontario Power Generation at the intake to the power canal, the water levels are permitted to rise to a level that will affect this dwelling. The NPCA has specifically noted their regulations do not permit this dwelling, due to the potential risk to Life and property and the potential negative impacts to Welland River (as outlined in the report by the applicant's consultant). With NPCA's opposition, and the risks to public safety on private property, this application cannot be supported. The policies also indicate the land is intended to be maintained under public ownership. Entrenching a private use on the land does not conform to the Environmental Protection Area policies. Council granted a 40 -year lease on the property for the continued use of the existing boat house (Staff Report L- 2002 -10). Instead a substantial permanent dwelling will be created with this application. This proposed building has doubled in size from 84 square metres (909 square feet) to 165 square metres (1,777 square feet) since Council authorized the leasee to pursue development approvals to permit the expansion. Council's ability to have the dwelling removed and to ensure the Welland River waterfront is maintained for public recreational use will be compromised. b) Suitability of the site for the proposed use, especially in relation to other sites or areas of the City. As the site of construction is located entirely within a flood plain and has the potential of adversely impacting fish habitat, the site is not suitable for residential development. A large inventory of residential land is available in the City for housing as opposed to building in flood plain areas. c) Compatibility of the proposed use with adjacent land use designations and natural resources and its impact on the natural environment. The study completed by the applicant's environmental consultant concludes the development would appear to have an adverse impact on the fish resources and habitat in the Welland River. Although the consultant has recommended mitigation methods, adverse impacts on this resource is probable. The NPCA and the Regional Planning staff share this opinion and recommend the application not be approved. Although a single detached residence would not be out of character with the existing low density residential uses on the south side of Bridgewater Street, the intent of the Official Plan is that lands along Welland River are to be maintained under public ownership wherever possible so that they can provide passive recreational opportunities for the residents of Chippawa. Entrenching a private use on publicly owned land, particularly in a designated Environmental Protection Area, runs contrary to the intent of the Official July 25, 2005 2. Expansion of the boat house to create a new dwelling does not meet the intent of the Zoning By -law. The land is zoned Hazard Land (HL). This zone does not permit expansion of the existing building, with the intent of prohibiting occupancy where there is a safety risk to the public and to private property and where there is a potential impact to the natural environment. Approval of this application would compromise the intent of the Zoning By -law. Peggy Erwin and Ralph Terrio wish to erect additions to the buildings they have constructed on lands they lease from the City which are, respectively, the ends ofthe Sodom Road and Oliver Street road allowances next to the Welland River. Schedule 1 shows the locations of the subject lands. The road allowances are owned by the City but are leased to Ms. Erwin and Mr. Terrio under 40 -year agreements approved by Council last year. Mrs. Erwin proposes to construct a 612 sq. ft. addition to her existing 552. sq. 11. cottage, which would result in a 1,224 sq. R. house. The intention is to create her year round permanent residence there. Mr. Terrio proposes to build a 532 sq. ft. living area addition to his 377 sq. ft. boathouse, resulting in a 909 sq. fl. cottage The proposals are shown as Schedules 2 and 3. The lands along the Welland River are zoned Hazard Land (HL) by Zoning By -law 79 -200. The HL zone recognizes existing dwellings (at the time of passage) but does not permit the conversion, extension or enlargement of the dwellings. Mrs. Erwin and Mr. Terrio are seeking Council's permission to submit an application to rezone the lands to allow for the enlargement of their buildings. This authorization is being sought because the City owns the lands. An earlier report on this matter was deferred from the July 12, 2004 Council meeting at the request of the applicant. Around 1980 my parents made upgrades to the building and amenities- Presently; the cottage is 550 square feet in size, fully insulated with energy efficient windows, electric heat, a new roof, cedar siding, and a contemporary cottage interior. The foundation is concrete block piers to grade level and the cottage has City services for sewer and water. The building was appraised in 2000, and was described as "well maintained and in good condition Proposed Addition The addition we are proposing will be approximately 670 square feet and will be primarily located on the north -east side ofthe existing structure. There will be no demolition to the structure and we d� not intend to add a basement. Attached are two suggested outside building elevations (Attachment 2), which we believe will fit nicely with the historic character of the neighbourhood. We have contacted a building design consultant and architect, who will work with us to design an attractive, unpretentious addition that will enhance the natural setting. ADDRESSING YOUR CONCERNS Legal Department We are willing to meet your conditions to provide Builders Risk Insurance and will acknowledge the demolition of all buildings or structures at our expense, at the termination of lease. We are willing to discuss other amendments to the lease that you feel may be helpful. Zoning Since this is an extension to the existing dwelling, we are prepared to make application to the Committee of Adjustment for a minor variance. We have decided to rescind our original proposal for a detached garage, and it will therefore not be necessary to pursue a- Zoning By -Law Amendment. Other Agencies We have spoken to and recently written the Niagara. Peninsula Conservation Authority, the Regional Municipality of Niagara and the Ministry of Natural Resources to ensure our plans to dei contravene their legislation. At the recommendation of the NPCA, we acquired an amended land survey to indicate the flood plain contour. Accordingly, we have received verbal approval for our plans and are awaiting a written response to present to your office. Chippawa (June 11/05 Niagara Falls Review) As a life time resident of Chippawa 1 am opposed to the rezoning of the above mentioned property which sits along the Chippawa River Bank. This property belongs to the City and should be available for use to all residents of Chippawa. The Boat House that is now standing on this property, does nothing to beautify the creek side and should be taken down, not expanded into a private residence. This area could be utilized by locals or visitors instead of just one family. I don't feel the person leasing this parcel of land has the rights to expand on the property for their own personal use or personal gain, as this property belongs to the City and the Tax Payers. Most of the property along the Creek is owned by Hydro and it is leased out or used by residents who have homes across the road from the riverbank. This property has become an endless row of signs stating "no trespassing" or "private property when if fact the property should be accessible to all residents. I strongly feel that Council should not allow anyone to build any large structures on the Riverbank other than the already small boat docks which are in place currently. Disfiguring Chippawa's' beauty with this type of recommendation for rezoning this land is opening up a can of worms for more development along this area. By rezoning, long term leasing or building this type of structure on this stretch of land.... What becomes of the property in the future? I therefore have to register my objection to these plans as not only detrimental to my continued enjoyment of my property but the potential negative effect this could have on my property value. In addition, I as well as every neighbour I have discussed this application with, also feel this will be in violent opposition to the intent of the current zoning as Environmental Protection Area since this is a GREEN SPACE we and many of the residents of Chippawa, as well as Niagara Falls residents and tourists enjoy for walking and biking as well as just watching the river and wildlife it affords. We are all very concerned any alteration to the zoning will set a dangerous precident and lead to further development along both sides of the river much to the esthetic loss of this GREEN SPACE forever to everyone. We have all seen where a minor ammendment to the hight by -laws has led with the high -rise hotel towers we now have. Therefore, amendments to both the City's Official Plan and Zoning By -law are required to facilitate the proposed development. The Welland River has been identified as a Type 1 °Critical" Fish Habitat by the Ministry of Natural Resources. Based on this classification, the River contains fish species and /or habitat that could be sensitive to environmental disturbances. The guidelines specify a minimum 30- metre vegetated buffer abutting the watercourse in order to protect Type 1 Fish Habitats. The proposed dwelling addition would be constructed approximately 5 metres from the River. Therefore, the proposed development potentially could have a high potential to adversely impact fish habitat. The Niagara Peninsula Conservation Authority has an agreement with the Federal Department of Fisheries and Oceans (DFO) regarding the review of fish habitat issues. Therefore, the City should refer to the more detailed comments of the Conservation Authority on this matter. A Regulatory Floodpiain and a Fill Regulated Area have been established for this section of the Welland River. The boathouse and the proposed dwelling addition fall within the Regulatory Floodplain. Most of the property lies within the Fill Regulated Area. As a result, the proposed building site should be considered hazard land because of its susceptibility to flooding. The primary objective of the Regional Policy Plan for hazard lands is to reduce potential property damage and loss of life. This objective is to be implemented through local official plans and zoning by -laws which should restrict new residential and institutional development on hazard lands. However, the proposed addition will be much more substantial than the existing structure and will introduce a new use, a dwelling, which will result in a much higher risk to public safety and property damage than the existing boathouse. Therefore, the proposed development should be considered a new use rather than an extension of an existing structure. In conclusion, the establishment of a dwelling on hazardous lands is contrary to the provisions of the Provincial Policy Statement and the Regional Policy Plan, and to the Conservation Authority's Fill Regulations. The applicant is requesting site specific provisions to recognize the use of the property. The existing development on the subject property is not out of character with the surrounding area. The proposed rezoning does not appear to compromise any Regional or Provincial planning interests, however, there may be some local site planning issues such as the relocation of parking to the rear yard and fencing. No objections. The applicant will be required to dedicate a 3 metre (10 foot) wide road widening along the Drummond Road frontage, which is consistent with other road widenings dedicated along Drummond Road. No objections. The property was recently inspected and the dwelling units appeared to be in compliance with applicable fire safety requirements. However, compliance with fire safety requirements does not constitute a legal use. Building By -law Services The cellar dwelling unit is contrary to the Property Standards By -law, which does not permit cellar dwelling units for reasons of safety and living conditions. Planning Analysis Due to the presence of a cellar dwelling unit which is contrary to the Property Standards By -law and the limited amount of amenity space, recognizing a total of four (4) dwelling units on the property including the cellar dwelling unit cannot be recommended for approval. However, three (3) dwelling units on the property without a cellar dwelling unit can be supported. The following is a summary of the review of the application: 1. The requested four (4) dwelling units on the property are not in conformity with the Official Plan. The land is designated Residential in the Official Plan. A variety of housing forms are anticipated subject to specific locational criteria. Lands lying along this part of Drummond July 25, 2005 3 PD- 2005 -52 Road can be considered for low -rise apartment developments up to a density of 75 units per hectare (30 units per acre) as access to the arterial road system is provided and the area is close to schools, parks and commercial facilities. However, development up to this density should be accommodated on lots that are large enough to provide adequate space for landscaping and parking. In addition, amenity areas to ensure pleasant living conditions and an adequate quality of life are to be provided. The four dwelling units on the property constitute a density of 56 units per hectare (23 units per acre). Although this density is within the parameters of the Official Plan, development at this density has mainly occurred on larger lots where ample landscaping and amenity space can be provided. Most of the apartment dwellings in this neighbourhood have their front yards Landscaped, save and except for access driveways. This landscaping helps to blend these dwellings in with the predominantly single detached dwellings in the neighbourhood. In addition, there is generally an allocation made for amenity space on the apartment dwelling sites to maintain the quality of life of residents, including balconies or green space in the side or rear yards. A reduction in the number of units on the land from four to three would reduce the parking requirements down to four spaces, thereby freeing up space for additional landscaping and amenity space. Specially, the parking should be retained in the rear yard and the front yard landscaped to be consistent with other multiple family developments in the neighbourhood. A reconfiguration of the rear parking area could free up amenity space for the residents. In addition, the removal of the cellar dwelling unit would be consistent with the Property Standards By -law. Should Council approve four dwelling units on this property, it should be based on requiring the entire front yard to be landscaped (except for a driveway) with all the parking contained to the rear yard. These measures would better reflect the character of this neighbourhood. 2. The cellar dwelling unit does not conform with the Zoning By -law or the Property Standards By -law. Both Zoning By -law No. 79 -200 and the Property Standards By -law prohibit dwelling units in a building cellar. A cellar is defined as a portion of a building which is below at Least 50% of the average adjacent grade level. The subject cellar is indicated by the applicant to be 63% below grade. These provisions are intended to ensure fire safety is maintained and an adequate quality of life is provided. As can be seen by comments from Fire Services, it is possible that other methods of fire prevention may be used to protect residents. However, quality of life remains a paramount concern in a cellar unit as the reduced amount of light and ventilation in a cellar may impact on a resident's quality of life. Although the Planning Act contains regulations that allow for amendments to zoning by -laws, there are no such provisions available for amending a Property Standards By -law. Any approval of a zoning by -law would still be contrary to the City's Property Standards By -law. July 25, 2005 PD- 2005 -52 3. A Zoning By -law amendment for two (2) above ground units in the main converted dwelling and one (1) unit in the accessory building is appropriate. The site is zoned R1E. The applicant has requested site specific provisions to recognize the four existing dwelling units including the cellar dwelling unit. While staff cannot support this proposal for the reasons set out in this report, three dwelling units would be appropriate. In this regard it is recommended that site specific zoning standards be developed to recognize three dwelling units and provide ample landscaping and amenity space. To be consistent with the existing residential development in the area, the amending by -law should require that all parking be contained in the back and the front developed for landscaping and a single driveway only. 4. Site plan control should be applied. Development under an RIE zone is generally in the form of single detached dwellings and is normally not subject to site plan control. However, three unit dwellings generally occur under a multiple family residential zone that is subject to site plan control. The proposal entails the development of a parking lot in the rear yard. Drainage from the parking lot may adversely affect neighbours if it is not designed and constructed with adequate drainage works. In addition, Municipal Works requires a 3 metre (10 foot) road widening along Drummond Road, consistent with other recently approved developments in this area, to accommodate future transportation needs. Details of landscaping and buffering would also be determined through site plan control. Site plan review and a site plan agreement registered on title would ensure the works are properly designed and get completed, and would provide a mechanism for acquiring a road widening. To place the land under site plan control, an amendment to the Site Plan Control By -law (No. 2001 -103) would need to be passed to add these lands to the site plan control area. This by -law amendment should be passed concurrently with the amending zoning by -law. CONCLUSION: 1) Recognition of the existing four (4) units on the property, including a cellar dwelling unit, cannot be recommended for approval for the following reasons: insufficient landscaping and amenity space would be provided, which is not in keeping with the Official Plan and is out of character with the neighbourhood; and a cellar dwelling unit is contrary to the Property Standards By -law and does not provide the quality of the life envisioned in the Official Plan. 2) Approval of three (3) units on the property, without the cellar unit, should provide for a development that has the density intended by the Official Plan and can provide landscaping and amenity space that is compatible with the neighbourhood. 3) The amending by -law, recognizing the three (3) units, will contain provisions recognizing the development, restricting parking to the rear yard and providing for adequate landscaping. July 25, 2005 4) Site plan control should be provided to ensure proper site development including parking lot drainage and landscaping and provision of road widenings. 5) Notwithstanding staff's recommendations, should Council wish to support the proposed application, it should do so subject to recommendations 3 and 4 outlined in this report. My late mother ANNA GUALTIERI, was an independent women whom maintained her own business affairs. It was unknown to me other than some of the first names of her tenants or whether she declared her rental income. I was never involved in her financial affairs I do recall that since the early 1970's, she rented her apartments to numerous persons. She remayhed independent until the day she suffered a major stroke in yr 9 Shortly after she suffered her stroke, she was unable to care for herself and subsequently placed into a senior permanent care facility. At that time I was an executor to her estate along with my "late" brother, ROCCO GUALTIERI. During her permanent care we maintained her apartment house. We had continually rented her apartment house and estate to support her permanent long -term care. In August of 1995, my son ENZO MURACA, along with his wife MARIA, purchased the house from the estate. At that time he also continued with its use as an apartment house. I remember that at the time of the purchase the house was in a "state of disrepair." Over the years I have watched my son ENZO MURACA spend a great deal of money to repair every inch of the house. He has made it once again look new, clean and safe. He has always continued with its use as an apartment house. BACKGROUND: 647802 Ontario Limited (Souvenir City) has requested an amendment for the land known as 4199 River Road (Parcel 1) and 4214 May Avenue (Parcel 2), as shown on Schedule 1. Souvenir City exists on Parcel 1. The amendment is requested to permit the construction of a 362 square metre (3,896 square foot) addition to Souvenir City on Parcel 2, as shown on Schedule 2. The addition is proposed for storage and recycling. Originally, the addition was incorrectly indicated to be 692 square metres (7450 square feet) in the public notice, the architect has since conformed the addition Parcel 1 is zoned a site specific Tourist Commercial (TC -560) zoning that allows the current Souvenir City development, while Parcel 2 is zoned Tourist Commercial (TC). A new site specific TC zone is requested to be applied over both parcels to permit the proposed addition. The zoning, which has site specific car and bus parking requirements that apply to Souvenir City, was implemented by Council in 2001. At that time there was an extensive Council review and neighbourhood consultation to address the concems of the residents about the proposed development, including concerns about the infiltration of bus traffic into the residential areas. The design of Souvenir City appears to have significantly reduced such infiltration by restricting bus traffic to River Road. At that time there was an extensive Council review and neighbourhood consultation to address the concerns of the residents about the proposed development, including concems about the infiltration of bus traffic into the residential areas. The design of Souvenir City appears to have significantly reduced such infiltration by restricting bus traffic to River Road. Surrounding Land Uses The land immediately to the south of 4214 May Avenue is vacant. Other lands to the north and south along River Road, east of May Avenue, are used mainly for a variety of tourist commercial uses, with some single- detached dwellings. To the west of May Avenue are predominantly single detached dwellings. Circulation Comments Regional Municipality of Niagara 2 PD 2005 54 Niagara Parks Commission No objections. Parks, Recreation Culture Planning Analysis No objections. The development is minor from a Regional perspective and should not compromise Regional or Provincial planning interests. However, the volume of delivery truck traffic on May Avenue may be a local issue. No objections. Development is subject to the City's 2% cash -in -lieu of parkland dedication. Municipal Works No objection to the rezoning. The developer should meet with City staff to discuss details of construction as it impacts on the adjacent Muddy Run sewer system. Preventative measures should be put in place to avoid damage to existing infrastructure. Any storm services connecting to the Muddy Run sewer should be disconnected. As 4214 May Avenue is already zoned Tourist Commercial, the proposed rezoning is largely a technical exercise to include 4214 May Avenue under the same site specific provisions that apply to Souvenir City at 4199 River Road, in order to permit the subject storage and recycling expansion. The following is a summary of the planning analysis: July 25, 2005 PD- 2005 -54 1. The proposal complies with the intent and the purpose of the Official Plan. The lands are designated Tourist Commercial under the Official Plan and are part of the Whirlpool Satellite Tourist District. A variety of tourist commercial uses are permitted provided they are developed at a scale and character compatible with the adjacent residential uses. The existing Souvenir City development and the proposed addition are at a scale that is compatible with adjacent residential areas. The architect has indicated the addition is proposed to be approximately 6 metres (19.8 feet) in height which is of a scale compatible with adjacent single- detached dwellings. In addition, the current design, reviewed by Council and subject to an extensive neighbourhood consultation when it was originally proposed in 2001, directs most traffic out to River Road and away from residential streets. If 4214 May Avenue were developed separately under the Tourist Commercial provisions, all parking, loading and pedestrian functions would need to be accessed from May Street, causing some infiltration into the residential neighbourhood. Incorporating this property into the overall Souvenir City development should assist in keeping the tourist traffic off of local residential streets. Approval of this proposal is subject to a traffic and parking demand analysis to the satisfaction of Municipal Works, to ensure the storage and recycling facility does not lead to a significant increase in truck traffic on May Avenue. 2. The proposed Zoning By -law amendment is appropriate. The subject land at 4214 May Avenue is zoned TC while the Souvenir City parcel is zoned TC -560. The applicant is requesting the site specific provisions that apply to Souvenir City be extended to apply to 4214 May Avenue, to permit this property to be used as storage and recycling space for Souvenir City. This would be accomplished bypassing a new by -law that would apply the TC -560 provisions to both Souvenir City and to 4214 May Avenue. Site specific provisions will be added to reflect the building addition configuration and maintain landscaping along May Avenue. The TC -560 zone contains provisions that provide for highway bus and mini -bus parking spaces in lieu of car parking spaces. These provisions were implemented based on a parking and traffic study submitted by the applicant. This study indicated that this development was partially geared toward bus tour traffic and that the amount of required parking for cars could be reduced and substituted with highway bus and mini -bus parking stalls. The amending zoning by -law passed by Council (By -law No. 2001 -213) implemented the bus parking and reduced car parking requirements. As the floor area of Souvenir City is being expanded with the addition of the storage and recycling area and no new parking is being added, the parking and traffic demand analysis should confirm, to Municipal Works satisfaction, that the site specific parking requirements for Souvenir City will also be adequate for these building additions. Any mitigation measures recommended by the traffic consultant should be implemented through site plan control. July 25, 2005 PD- 2005 -54 CONCLUSION: 1. As the proposed additions conform to the intent and purpose of the Official Plan with respect to the Whirlpool Satellite Tourist District and would provide development that is compatible with adjacent residential areas, the requested amendment can be supported. 2. The amending by -law will place the existing Souvenir City development and the additional lands (4214 May Avenue) under a single by -law containing the same site specific provisions that apply to Souvenir City. 3. To ensure adequate parking is provided and there are no significant increases to truck traffic on May Avenue, a parking and traffic demand analysis should be submitted to the satisfaction of Municipal Works. All buildings, structures and facilities necessary for the development, including fire route and the drive through, are to be set back from the Ministry's property line (which includes McLeod Road). Ministry building and land use permits are required for buildings for this development. Municipal Works No objections to the rezoning. Sanitary sewer and water services are adequate to service the development. Stormwater management practices to be put in place to control post development runoff. The developer is responsible for constructing a municipal sidewalk in front of his development. Parks, Recreation Culture No objections. The development will be further reviewed by the City's Landscape Architect at the site plan stage. Planning Analysis The proposed new car agency, being proposed as part of a comprehensive development that includes a stand -alone financial institution, complies with the intent of the Official Plan and is compatible with surrounding land uses. The following is a summary of Planning staff's analysis of this application. 1. The proposal complies with the intent and the purpose of the Official Plan. The lands are designated Major Commercial and are part of the Niagara Square Retail District. The lands are intended to be developed for a variety of uses, including small to medium sized retail and service commercial uses, that enhance and complement the function of Niagara Square as a major retail and service commercial development. July 25, 2005 PD- 2005 -50 The addition of a new car agency meets the intent of the Official Plan as follows: A new car agency, with ancillary automobile service functions, is a small scale retail and service commercial use that will complement the overall function of this district. A new car agency is a specialized retail use that does not compete with Niagara Square. This site provides exposure onto major roads and highways that a new car agency needs. This visibility in turn may bring additional customers in to support Niagara Square. New car agencies generate significant traffic, including truck traffic, that may disrupt sensitive land uses such as residential uses. The subject site offers easy access to the arterial street network and the Q.E.W. without impacting on any sensitive land uses. 2. The proposed Zoning By -law amendment is appropriate. The land is zoned TC. Although this zone was originally established to allow tourist operators to take advantage of easy access to the Q.E.W., the Official Plan has since designated the lands as Major Commercial to support the major retail function of Niagara Square. As the use conforms to the Official Plan, it is appropriate to site specifically amend the TC zone to add a new car agency as a permitted use. The amending by -law will also add provisions securing the proposed landscaping strips and building setbacks to ensure an attractive development occurs. The Ministry of Transportation has indicated that certain facilities on the land, such as the banking drive -thru and the fire route, need to be relocated out of the 14 metre setback from McLeod Road to conform to their requirements. This may require some redesign of the site at the site plan stage. As there is a surplus of parking required and the new car agency should not be impacted, these requirements do not impact staff's recommendation. Although no written comments have been received due to a late submission of a traffic report, the Regional Municipality of Niagara has indicated there may be concerns with the access points proposed on Montrose Road (under Regional jurisdiction). This concern deals more with site design than the uses being proposed. To allow for resolution of any potential access concerns, passage of the by -law should be subject to a satisfactory review of the traffic study by the Region. Any design changes can then be incorporated at the site plan stage. CONCLUSION: 1. The requested amendment can be supported for the following reasons: the proposed new car agency conforms with the intent and purpose of the Official Plan with respect to uses that would complement Niagara Square; and the high visibility and easy access to major roads and highways the site offers makes it an appropriate site for a new car agency. The purpose of the proposed rezoning is to facilitate the development of the property for a new car dealership (Hamburg Honda) and a credit union building, the latter being a use currently permitted by the by -law. The Niagara Square Shopping Centre is situated to the south on the opposite side of Montrose Road. The Niagara Falls Community Centre is being completed on the north side of McLeod Road. The proposed new car dealership would be consistent with existing and expected future commercial development in this area. Montrose Road which is a Regional road will provide access to the proposed development on these lands. This development proposal could have significant traffic implications for this section of Montrose Road, not only because of the increased traffic generation, but especially because of the applicant's proposal to remove part of the centre median on Montrose Road for access purposes. The Region has recently received a traffic impact study prepared by the applicant's consultant, Paradigm Transportation Solutions Ltd. However, Regional Public Works staff have not had sufficient time to review the traffic study and to determine if any access design changes are necessary. The applicant's proposal to remove the centre median on Regional Road 98 (Montrose Road) will require careful evaluation and there is no guarantee that LEI the Region will agree to its proposed removal. Although Regional Planning staff are not opposed to this application from a land use perspective, access issues could have significant implications for this development. Therefore, it may be desirable to defer a decision on this rezoning application or defer the passing of the amending zoning by- law until the traffic issues are resolved. 2 Please send notice of City Council's decision on this matter when it is available. The property is located on the west side of Montrose Road, north of Alpine Drive (see Schedule 1). The land is described as Block 222, Registered Plan 59M -129 (West Meadow Subdivision). The proposed condominium layout is illustrated on Schedule 2. The application for plan of condominium subdivision will permit the individual ownership of each unit of land in the development with the driveway, visitor parking and perimeter landscaped areas shared by the condominium corporation. The site was originally a planned multiple residential block within the existing subdivision that was registered in 1987. The applicant received draft plan approval in 1997 to subdivide this block into 11 single- detached dwellings on a cul -de -sac and the land was zoned for that use. The property was subject to a rezoning application to permit the townhouse proposal (AM- 57/2004) that was approved in principle in March 2005. Zoning By -law No. 2005 -100 was passed by Council on June 13, 2005 to zone the land Residential Low Density, Grouped Multiple Dwellings (R4) with special provisions. The by -law was circulated to area residents and no appeals were received. The project has been designed for compatibility with surrounding land uses and contributes to the mix of available housing types in the area. The vacant land condominium process is a relatively new method of dividing property into "units" of land. When the plan is registered, the units are then sold much like lots or blocks in a typical plan of subdivision and building permits can be issued. Conditions of Approval Several development matters for the land were addressed through the underlying subdivision plan. However, there are site specific issues for the condominium proposal. Approval of plans for servicing, the private driveway and landscaping/fencing are required. The designation of a fire access route through the development, if required by Fire Services, is requested as a condition. The future construction of the townhouse dwellings will need to satisfy zoning regulations. With the approval of the recent zoning by -law and this condominium application, the developer should formally abandon the existing draft plan approval for the 11 -lot subdivision on the land. Regional conditions are requested relating to Montrose Road (entrance design/permits and noise attenuation construction features, fencing and warning clauses) as well as a typical servicing review. The internal driveway design does not meet Regional access requirements for waste collection vehicles and it appears alternate private garbage pick -up is intended. Hydro One has requested standard conditions as the development abuts a hydro transmission corridor to the south. CONCLUSION: The proposed Draft Plan of Vacant Land Condominium will allow the separate ownership ofthe land units for the construction of townhouse dwellings in the future. The developer submit plans to Planning Development indicating the dimensions of the driveway and visitor parking areas in order to confirm compliance with zoning regulations. The developer provide five copies of the pre- registration plan to Planning Development and a letter stating how all conditions imposed have been or are to be fulfilled. 14. The developer agree in the condominium agreement to obtain the appropriate Regional permits (Construction Encroachment and /or Entrance Permits) from the Regional Niagara Public Works Department prior to any construction within the Regional road allowance. 15. The developer agree in the condominium agreement to restore the Regional road allowance to "as good as or better condition" upon the completion of any construction and to protect survey evidence adjacent to the Regional road allowance. 16. The developer dedicate to the Region a 0.3 metre (1 foot) reserve along the Montrose Road frontage of the plan (except for the entranceway access), free and clear of any mortgages, liens or other encumbrances. 17. The developer agree in the condominium agreement to construct the townhouse units backing onto the Regional road allowance with noise attenuation features: brick exteriors facing the road, double glazed windows and the provision for air conditioning; and to construct a noise attenuation/privacy buffer parallel to Montrose Road on the condominium property. A low -rise berm with a solid fence on top for a total height of 1.8 metres would be an acceptable form of buffer. Furthermore, the condominium agreement require the registration on title and the inclusion in all offers of purchase and sale of a noise warning clause for those units backing onto Montrose Road as follows: "Purchasers are advised that despite the inclusion of noise control features in the development and within the building units, sound levels due to increasing road traffic may occasionally interfere with some activities of the dwelling occupants." 18. The condominium agreement include a statement that Regional curbside waste collection will not be provided. Alternatively, if the internal roadway is redesigned so that Regional curbside waste collection can be provided, the developer comply with the Regional Municipality of Niagara's "Collection of Waste By Way of Entry on Private Property" Policy (PW2.W07) and enter into an Indemnity Agreement with the Regional Municipality of Niagara to the satisfaction of the Regional Niagara Public Works Department. 19. The developer submit to the Regional Niagara Public Works Department for its review and approval a set of detailed drawings showing access design, piped servicing, lot grading, and buffering and fencing along Montrose Road. 20. The developer submit a copy of the lot grading and drainage plan, showing existing and final grades, to Hydro One for review and approval. BACKGROUND: On May 31, 2004 Council adopted the Tourism Policy Review study prepared by the IBI Group and directed staff to proceed with the implementation of the consultant's findings and conclusions. In addition, Council passed a motion "that staff review the Architectural Peer Review process, its selection, the experience for its operators and any suggestions it would have for its panel and report back to Council Architectural Peer Review (APR) was the subject of two Council ad hoc committee meetings on February 1, 2005 and March 7, 2005. Both meetings involved lengthy discussions of the APR process, including such topics as the number of projects which have conformed with the City's guidelines, incremental development approvals, the role of the Architectural Peer Review Panel, format of panel reports, panel composition, conflict of interest, application processing and complete applications. The ad hoc committee suggested that a staff report regarding Peer Review improvements be prepared for Council' s consideration and that stakeholders' comments be obtained. This report has been prepared to advise Council how the Niagara Falls Peer Review process compares with other municipalities, together with staff suggestions on how the process may be improved. The report will also serve to provide technical background for the purpose of inviting stakeholder comments. A municipal survey was conducted to identify how the Niagara Falls experience with architectural peer review compared with other municipalities. It was found that, across Canada, most mid -sized to large municipalities had in -house urban design staff in place to review development applications from an urban design perspective. Many municipalities including Vancouver, Ottawa, Toronto, Working Together to Serve Our Community Clerks Finance Human Resources Information Systems Legal Planning Development July 25, 2005 Markham and Mississauga had also developed or were in the process of developing procedures utilizing appointed experts to conduct independent urban design reviews on projects as part of the planning approval process. The approach used in Niagara Falls is similar to the examples cited. It is interesting to note that the Toronto Waterfront Revitalization Corporation is presently using Niagara Falls as a model for establishing its own design review procedures. The promotion of high quality public and private development is the primary focus for the appointment of design panels. Standards for new development are set through the adoption of urban design guidelines (e.g., TADS) and Official Plan policies (e.g., OPA #26). Where used, a Design Review Panel is appointed by Council to review the merits of development proposals and their conformity with the standards set by Council. Once the Design Review Panel and the proponent agree on an acceptable design, the application is deemed complete and is processed through the typical land use protocol. More recent high -rise development applications such as the expansion to the Hilton Hotel, the Rainbow Tower and HOCO's midway/hotel development serve as good examples of successfully completed peer reviews. These applications represented some of the most significant and challenging development projects Niagara Falls has experienced to date. All of these applications were the subject of extensive discussion and negotiation of design principles culminating in positive panel reports and staff recommendations. Based on the experience gleaned through the processing of these applications, together with the information derived from other municipalities, staff is suggesting several areas of improvement regarding the functioning of the current peer review process. 1) Improved Consultation 2) Refinements to the Peer Review Structure 2 PD- 2005 -55 Municipalities engaged in the peer review process place a significant amount of weight on urban design and architectural quality in the overall review of development applications. These municipalities view urban design and the adherence to design guidelines as being fundamental to achieving the goals, objectives and the vision of the official plan. Design guidelines are developed within a public process with input and acceptance of the development community. Urban design review, together with land use planning review, is conducted with preconsultation and dialogue between the urban design review team (either peer review or staff), municipal planners and the developer, in order to resolve issues and to obtain an acceptable design prior to the application entering the public circulation and meeting process. The three developments noted above followed a similar protocol with extensive preconsultation and dialogue occurring at the project's preliminary design phase. Based on the success of these projects, it is suggested that the City fine tune its processing procedures placing greater emphasis on preconsultation between the developer, the developer's architect, staff and the peer review panel prior to formal applications being submitted. Staff would welcome the input of the development community, the NPC and other agencies in working out an improved protocol for preliminary design review. Staff has reviewed the composition and mandate of various operating peer review processes in municipalities across Canada. Municipalities such as Vancouver and Ottawa have a pool of design professionals from which to draw upon in setting up a panel for an individual July 25, 2005 PD- 2005 -55 project. Niagara Falls has a three- member panel, an architect and a landscape architect representing the City and an architect representing the Niagara Parks Commission. The three member panel composition seems to work well for Niagara Falls given the limited number of projects that need to be reviewed on an annual basis, the costs of operating such a system and the time required to undertake reviews. Niagara Falls, however, could benefit from the appointment of additional panel members who would serve as alternates to the existing members. Alternates would be called upon when existing members are not available or when a panel member declares a conflict. In this regard, it is recommended that City Council and the Niagara Parks Commission consider the appointment of alternates to the current panel composition. A second matter that requires attention is the mandated role and function of the City's Architectural Peer Review Panel. The panel currently derives its mandate from the Council approved Tourism Policy Implementation Handbook and the former Tourist Area Development Application Guide. What is lacking in both of these manuals is an actual terms of reference for the panel itself. Staff has prepared a draft terms of reference which covers such matters as remuneration, duties and responsibilities, declaration of conflicts, how design review teams are selected and so forth. It has been modeled from the terms of reference for the Municipal Heritage Committee and clearly sets out the panel's mandate, responsibilities, membership and procedures and protocol. It is recommended that Council consider approving the attached draft terms of reference as an improvement to the current panel operation. A third area of refinement recommended by staff focuses on the actual name of the panel. Staff is of the opinion that the Architectural Peer Review Panel is a misnomer given that the panel's assessment of projects is largely based on urban design principles rather than strictly architecture. It is recommended that the name of the panel be changed to the Urban Design Review Panel, the name commonly used by other municipalities. This name change should also clarify some confusion within the development community that the peer review panel only comments on building architecture. Urban design includes such matters as building orientation, relationships with surrounding land uses, contextual compatibility, microclimate effects and public realm amenities, all of which are described in TADS and the Tourism Policy Implementation Handbook. 3) Adherence to the Guidelines The City has experienced a myriad of development applications, some partially complete, some lacking in the fulfillment of requisite studies, some in conformity with the City's design guidelines, some others not. Through Council's adoption of the Tourism Policy Review study in May 2004, steps have been taken to promote a more consistent approach to design review and application processing procedures. i) By virtue of adopting the Tourism Policy Review Implementation Handbook, Council has more clearly enunciated its design objectives and has provided greater flexibility in the interpretation of OP policies. ii) Council has instructed the Architectural Peer Review Panel to structure their reports according to the seven design principles set out in the Implementation Handbook in order to ensure that the purpose and intent of the City's tourism policies are being realized. July 25, 2005 4 PD- 2005 -55 Approved by: DD:tc Attach. iii) Council now requires all requisite contextual plans and studies to be submitted in order to constitute a complete application for plan review and processing. iv) Council has confirmed that a "complete application" includes a report from the Architectural Peer Review Panel. v) Council should note that staff is working on combining the TADS Application Guideline and the Implementation Handbook into one concise document that will provide a consistent design guideline to the development community. Recent applications have been processed in keeping with the above noted improved procedures. This is consistent with the practices of other municipalities. CONCLUSION: Peer Review has proven to be quite a successful tool in the review of high -rise developments. Particularly of late, significant projects have been approved which are well designed and are in conformity with the intent of Council's design objectives and Official Plan policies. Continuation of the peer review process is a critical element for the progressive implementation of the City's world -class vision and image. The City does not have in -house design staff that can perform the role and function of an appointed peer review panel. The refinements to the peer review process suggested herein, together with the input received from other stakeholders, should serve to enhance the effectiveness of the panel and the process itself'. PREAMBLE The City of Niagara Falls Official Plan envisages the creation of a world -class tourism destination for Niagara Falls the establishment of an attractive and engaging pedestrian environment with a high quality skyline set amidst one of the country's most recognizable natural features. To achieve this, the Official Plan requires that high -rise buildings over 10 storeys in height undergo Architectural Peer Review in order to ensure that the urban design goals and objectives of the Official Plan are being met. 2. MANDATE The Urban Design Review Panel is a commenting body providing assessment, advice and assistance to Planning and Development Division and Council, concerning matters of urban design as they relate to development proposals on private land or within the public realm. 3. RESPONSIBILITIES The panel's responsibilities will generally relate to the following: (a) to provide independent urban design advice on a particular development project; (b) to provide an independent opinion on the extent to which the planning and design objectives of the Official Plan are being met; (c) to make suggestions to any urban design changes which might better meet the planning and design objectives of the Official Plan; and (d) to provide the Director of Planning and Development, and the City Council with an Urban Design Review Report for consideration in the review of the development application; 4. MEMBERSHIP AND CHAIR (a) A pool shall be created that consists of six members; four architects who are members in good standing with the Ontario Association of Architects and two landscape architects urban designers who are members in good standing with either the Ontario Association of Landscape Architects or the Ontario Professional Planners Institute. Council shall approve the membership of the pool. (b) CITY OF NIAGARA FALLS URBAN DESIGN REVIEW PANEL TERMS OF REFERENCE The Director of Planning and Development shall appoint a panel from the pool for each development proposal. At least three panel members will be appointed for high rise or complex proposals. A panel of less than three members maybe appointed for proposals for minor developments. 2 (c) Panel members will not be excluded from bidding on and carrying out work on developments and projects in the tourist areas. In such circumstances, panel members will be required to declare a conflict and not participate in the review. The Director of Planning and Development shall then appoint an alternate panellist. 5. PROCEDURES AND PROTOCOL (a) Authority The panel has the authority to comment and adjudicate on and recommend changes to the urban design of any development proposal in order to ensure that the development proposal satisfies the goals, objectives and policies of the Official Plan. The panel also has the responsibility to comment with respect to urban design matters that may impact on lands under the jurisdiction of the Niagara Parks Commission. (b) Decision Making The panel shall endeavour to achieve an overall consensus among its members regarding a proposed development. Its recommendations shall be based on the professional opinion ofthe majority ofthe panellists. Any panellist not agreeing with the majority opinion has the opportunity to submit a dissenting opinion. Council shall have overall decision making and approval authority over urban design. (c) Meetings At least two meetings, one of which shall include the applicant and the project architect, shall be held with one or more members of the panel. There shall be a preliminary meeting prior to application being made. The second shall be held prior to submission of the panel's final report. Meetings of the panel are to be organized by the Planning and Development division with a staff planner in attendance. (d) Reporting Reports issued by the panel shall detail the assessment of the proposal against each ofthe seven urban design principles of the Tourist Area Design Guidelines. The final report shall also contain an executive summary with the panel's recommendations. The panel shall report directly to the Director of Planning and Development. The panel shall issue at least two reports. The first shall be a preliminary report identifying architectural and urban design issues with recommendations regarding any design changes in order to achieve compliance with the policies of the Official Plan and conformity with the Tourist Area Design Guidelines. A final report shall be submitted at the completion ofthe panel's assessment ofthe development proposal which details its analysis of the proposal and provides a recommendation to the Director of Planning and Development. Given this and the sensitivity of the Falls, the Niagara Gorge and Queen Victoria Park, the NPC may appoint one or more panel members to represent its interests. 7. It was on August 9, 1974, that a clearly identifiable United Nations Buffalo transport aircraft was shot down by insurgents while flying relief missions to Lebanon with the loss of all nine Canadian Peacekeepers aboard that this date has been declared. Ontario was the latest of nine Provinces and three Territories to enact this Legislation. A similar petition to the National Assembly of the Province of Quebec is in progress. Several cities and towns in Canada have also designated Aug 9 as a day of Remembrance for Peacekeepers in their particular areas. Bradford, West Gwillimbury was the first municipality in Ontario to proclaim Peacekeeper's Day and did so in 2004 by flying the United Nations Flag over the Town Hall in Bradford. The Lincoln Welland Regiment, based in St. Catharines, has a long and storied history of service to Canada, both in wartime and as Peacekeepers with over 125 Peacekeeping Missions since 1947. Also, local Regional and Provincial police force personnel and many civilian volunteers of varying vocations have represented Canada abroad on such missions. Since 1947, the United Nations Forces have performed Peacekeeping duties worldwide. Canada has played an important role from the beginning and to date, more than 250,000 Canadians have worn the `blue beret'. More than 162 have died "in the Service of Peace." In 1978, the Nobel Peace Prize was awarded to all United Nations Peacekeeping personnel worldwide. In recognition of this award, the Federal Government of Canada has presented the Canadian Peacekeeping Service Medal to any citizen, military or otherwise, who has served with the UN Forces throughout the world. Our Prime Minister of the day, the Rt. Hon. Lester B. Pearson, was also awarded the Nobel Peace Prize for his suggestion of establishing a United Nations Peacekeeping Force. Unlike World Wars I and II and the Korean War, Peacekeepers do not know who their enemy is. Insurgents and combatants do not wear uniforms identifying their particular ideologies and nationalities. They drive ordinary cars and wear indigenous clothing. A terrorist could be your next -door neighbour. Therefore, the stress and strain on a Peacekeeper who may or may not be armed in self defence, is enormous. Korean War Veterans and the Merchant Mariners of Canada suffered between 40 and 50 years for their contributions to Canada's war efforts to be finally recognized by Canadian governments of all levels. This is probably due to the fact that during these hostilities, no Canadians lost their lives in combat on Canadian soil, although the same statement cannot be said for the Merchant Mariners. It is hoped that a similar oversight will not befall Canada's Peacekeepers. It is with the foregoing in mind that this letter contains a plea for the City of Niagara Falls to declare August 9 of every year, commencing with the year 2005, as "PEACEKEEPER'S DAY" and fly the United Nations Flag over city hall on that date. BACKGROUND: This report is provided as an information update to Council. As Council is aware, Claws Paws is a nonprofit organization that has been described as "a nonprofit charitable organization that houses abandoned and unwanted animals. It also babysits pets for seniors moving into nursing homes or people going out of town." In November 2004, a rezoning at 9304 McLeod Road to add animal shelter as an additional use in a light industrial zone, was approved by Council. The approval was contingent upon Claws Paws receiving an amendment to the City's Animal Control By -law to permit more than three cats A report related to the Animal Control By -law amendment was brought forward at the March 21' Council meeting. Staff recommended denial based on charges that had been laid and the concerns articulated by the Humane Society and a veterinarian, who inspected the property. Resolution of Outstanding Issues The Humane Society was informed of Council's direction. As the attached letter indicates, the Humane Society felt that it would not be appropriate for them to participate in any dialogue with the criminal charges unresolved. Unfortunately, and not surprising, the justice process often takes time. The criminal charges have yet to be heard and if a trial does go forward it will probably be late this year or early next year before the matter is heard. It would probably not be appropriate to defer the by -law amendment for such a length of time. The writer has spoken to legal counsel retained by Claws Paws on the criminal charges. The lawyer has advised staff that a pre -trial is scheduled in August. It was explained that at a pre -trial a judge will often urge the parties to work out a compromise to avoid the cost and time of a trial. Also, the lawyer for Claws Paws is going to suggest that mediation is a more appropriate course of action; therefore, Council's direction to have all parties work together to resolve the outstanding issues may still occur. As a result, staff is recommending that we wait until August to see what the result of the pre -trial is. Other Timing Issues As has been indicated in previous reports, staff do not purport to be animal welfare experts. In light of the Humane Society's reluctance to get involved, staff will have to seek outside opinion on issues such as appropriate numbers and appropriate cage sizes if no mediation or compromise results from the pre -trial hearing. Also, it has been staff's practice to advertise to the public any amendments to the Animal Control By -law; therefore, notification will have to be given. Despite the foregoing timing issues, staff will advertise and bring back a report to the September 19t Council Meeting. Enforcement Staff has no intention of "going after" Claws and Paws, under our Animal Control By -law, regarding their number of cats and dogs; therefore, dealing with the matter in September should not have a detrimental effect on Claws Paws request for an amendment (i.e., no enforcement related to numbers will happen in the interim). It should be stressed that the Humane Society do not enforce the City's Animal Control By -law. The Humane Society, however, still has authority to take action if they feel an animal is not being properly cared for or is under distress. Staff has warned Sharon Allen, the proponent, of having fund- raising events on her property. Staff feel, however, that once the animal control issues have been resolved we will be able to work with Claws Paws on some other fund- raising options. July 25, 2005 CONCLUSION: Staff appreciates that Claws Paws would like to see a final resolution on these matters (approval of the zoning by -law and amendment to the animal control by -law) and agree that a decision should not wait until the final resolution of criminal charges that may still take some time. Nonetheless, there is still the necessity to notify the public and receive additional input to prepare an appropriate report related to amendments to the Animal Control By -law. The Niagara Falls Humane Society was to respond to the City Clerk in writing after our presentation to City Council. After repeated contacts with the City Clerk and other staff, the process has stalled which as prevented Claws Paws from pursuing their objective of construction of a new facility for our animals. The original charges laid by the Humane Society have been remanded several times and will not be heard until at least September. We also have had considerable difficulty in our attempts to determine the appropriate square footage that would be required per animal in the new shelter. The building department and Niagara Falls Humane Society have been unable to provide a standard or opinion on this crucial requirement. We have therefore concluded an appropriate size would be 4 sq ft per animal, which is the approximate size of a cage. It is the hope that this matter could be brought before council early in June to pass the zoning By Law and Animal Amendment so we can satisfy any concerns with respect to the facilities at Claws Paws. We would respectfully request an opportunity to appear at Council to make a presentation and respond to any questions or concerns as soon as possible. Burden Director Annually, Staff provides financial information for the previous year's performance concerning the investment of the City's Reserve Funds and Trust Funds Scotia Cassels is engaged by the City to manage the two investment accounts respective to the two funds. On January 1, 2004, the opening balance in this investment account was $15,551,970. In accordance with the City's investment policy, the funds were invested in Government treasury bills, Government and Canadian Corporate issues ofbonds, bankers' acceptance, term deposits and similar investments. During 2004, the investment income was $734,857. Management fees of $50,555 were paid to Scotia Cassels for their services. As at December 31, 2004, the closing balance in this investment account was $16,236,272. The annualized rate of return for 2004 was 4.83 On January 1, 2004, the opening balance in this investment account was $1,898,784. BACKGROUND: In the determination of the 2005 Municipal Utility Budget, City Council approved the Low Income Seniors' Water Rebate for the 2005 year. This rebate provides qualifying seniors a rebate of $100. City staff is now prepared to take applications from seniors that may qualify. The current CAD called "Crisys" was purchased in 1994. At the time it was the most up -to -date system available. Since that time the design technology has changed considerably. The flexibility and speed for these types of systems have always been prime considerations. Crisys was a very proprietary system which limited our ability to change response parameters and extract data to import to a report program. At the time of purchase, there was a promise that there would be many future upgrades to the system. [Niagara Falls and various other departments using the system were requested to provide input on improvements. Unfortunately when these improvements were made available, there was usually an unexpected cost attached for either development or hardware upgrades or both. Crisys is currently releasing an upgrade which will cost approximately $40.000.00, not including required hardware upgrades and training. (These are estimated at an additional $60,000.00 or $100,000.00 total.) While the improvements being made by Crisys in this upgrade release are substantial, they still fall short of the full flexibility needed to meet all of the needs of the service.] For about one year a review has been conducted of the various CAD's on the market. All have their own nuances and there is a wide spectrum of costs. The system which we believe will be best suited for Niagara Falls is provided by Symposium Technologies in Toronto. Information Systems has looked at the system and supports its platform and integration capabilities with the Corporation's Working Together to Serve Our Community Municipal Works Fire Services Parks, Recreation Culture Business Development Building By -Law Services n July 25, 2005 2 FS- 2005 -06 various systems and programs. This new system is very flexible and allows modification of all fire related response and apparatus data by the user. This is a feature that has not been available through Crysis. This is a logical time to change systems due to the high costs of upgrades for the older system. The Symposium system is currently in use in Barrie (two years) and Halton Hills (six months) Ontario. Both Fire Departments report the system is working as intended and meets all their expectations. Currently, a number of other cities across Canada are also considering the Symposium Technologies C.A.D. Symposium will be responsible for the complete installation of the system and will be contracted for maintenance and technical support purposes (included for the first two years). They will be providing training for dispatch and Information Systems personnel, included in the price. As opposed to being a "COTS" (Commercial Off The Shelf) system, this system is instead specifically and comprehensively customized to reflect the unique needs of Niagara Falls, and incorporates the specific business rules and added software functionality that is required to optimize dispatch and response within the area of the service's jurisdiction. The system while custom is built using standard non proprietary software design protocols, meaning that it is "open and easily integrated with other systems. Fully Self- Contained Unlike any other system, the Symposium CAD can be extensively self- customized by the client on an ongoing basis to reflect any changes or evolutions in need that may arise. This capability also enables Niagara Falls to be fully self- contained in terms of system maintenance, without having to rely upon a vendor or other outside agency. Symposium's system is the only one on the market which provides clients with this very important capability. Flexible License Terms Providing for Unlimited Seats Moat systems are priced on a per -seat basis. Symposium pricing instead allows for any number of seats. This allows Niagara Falls to quickly, and easily increase the number of workstations, as required, without additional costs. Supports Existing Mutual Aid Agreements The Symposium system is the only one which already incorporates mutual aid mapping and GIS data for all mutual aid areas, without additional expense. This enables the departments to more easily and effectively handle any required mutual aid dispatch throughout the region, and in accordance with existing agreements. This feature is available in advance of, and independent of, this GIS data being made available through the City or County and, as stated previously, is already incorporated. Works with Niagara Falls Paging/Text Message Systems The Symposium system already integrates with the paging system used by Niagara Falls fire services. This greatly streamlines notification and dispatch of volunteers and other off -site personnel, by sending all relevant incident information (location, type, etc.) to their pagers in text form. Works with City's Existing Radio Infrastructure Symposium's is the only CAD system on the market that integrates with MaxTel wireless to provide mobile data capability. Symposium and MaxTel already have a live mobile data installation in St. John's, NF that delivers rich functionality and advanced capabilities to the client. This is very important down the road in enabling Niagara Falls Fire to move ahead with GPS, in- vehicle computing, and other powerful technologies, while avoiding a number of additional costs that would have to be incurred with any other system. Works with Niagara Falls' RMS System The Symposium system is also the only CAD system that integrates with the FirePro Record Management System the system chosen by Niagara Falls for incident reporting, inspection, and other tasks. This ensures that critical data collected and stored in FirePro is available to dispatchers and responding personnel, and avoids additional costs that would be incurred with any other system. All Inclusive Proposal includes 24/7 Support, Training, and Future Upgrades The Symposium proposal is all- inclusive. The proposal includes all aspects of customization, installation, integration, training, and technical support. Ongoing technical support is included in the cost of licensing, and is available on a year -to- year basis thereafter for one transparent, all- inclusive, and guaranteed fee. The Symposium proposal is superior to others in that it provides not just for routine maintenance, but for any and all enhancements in capability, including new system components, upgrades, and any other advances in functionality developed by Symposium Technologies. Symposium Technologies are also very flexible in providing additional custom features on an ongoing basis, as part of the service contract fee. This saves a great deal of money in the medium and long term, while ensuring the system will remain modern, capable, and effective far into the future. The City's share of the cost for this project is 50% or 68,800 by virtue of a cost sharing agreement with the Regional Municipality of Niagara. The City of Niagara Falls in conjunction with the Regional Municipality of Niagara issued a request for proposal to four consulting engineering firms for the provision of a pollution control plan and combined sewer overflow study document. The pollution control plan is intended as a long range financial and strategic plan to ensure sustainable and appropriate customer service levels while allowing for new development. A long range plan to address the City's thirteen combined sewer overflows will also be presented. A long term strategic plan to address basement flooding and sewer overflow issues is required approximately every five years to ensure compliance with various provincial legislation and to prevent adverse impacts to the environment. It has been approximately ten years since the previous update. On Friday, July 8, 2005 a group of City and Regional staff rated the four proposals on their technical merit and cost. The winning proposal based on both technical merit and cost was submitted by CH2MHILL Canada Limited at a total cost of 137, 616.
