Motion: Carried It was ORDERED on the motion of Alderman Campbell and seconded by Alderman Ioannoni, that the November 7, 2005 minutes be approved. Motion: Carried Action: Recommendation submitted to Council 2005-11-21. DEPUTATION Vince Hockton of Hockton Automotive addressed Committee and questioned if Loblaws should begin construction prior to the road improvements being completed on Dorchester Road which would be contrary to Mr. Pfiamo's statement at the October 18, 2005 Council meeting. Would that constitute a lie? Staff advised that the City could not speak on behalf of the Loblaws Corporation but noted that the Dorchester Road improvements should be completed by late Spring,2006. The Director of Business Development advised that Loblaws is not looking to begin construction until Spring 2006 which should coincide with the completion of the road improvements. Again, Mr. Hockton questioned if Loblaws begins construction prior to completion of the road improvements does that constitute a lie. As Alderman and Staff could not speak on behalf of Loblaws the following motion was made. a) It was ORDERED on the motion of Alderman Ioannoni and seconded by Alderman Diodati that staff contact Loblaws to request clarification of Mr. Primo's statement from the October 18, 2005 Council meeting with regards to no works beginning until after road improvements take place on Dorchester Road. REPORTS a) MW-2005-127 - High Street Parking Review It was ORDERED on the motion of Alderman Ioannoni and seconded by Alderman Morocco that the existing no parking at all times on both sides of High Street bem, een Highland Avenue and a point 20 metres west of Higland Avenue be extended to Glenholme Avenue. Motion: Carried Action: Recommendation submitted to Council 2005-11-21. b) MW-2005-135 - May Avenue Parking Review It was ORDERED on the motion of Mayor Salci and seconded by Alderman Diodati that the existing "parking restriction" on the east side of May Avenue between Buttrey Street and a point 43 metres north of Buttrey Street be extended to Terrace Avenue. Motion: Carried Action: Recommendation submitted to Council 2005-11-21. c) MW-2005-136 - Oft Road Closure Review It was ORDERED on the motion of Alderman Morocco and seconded by Alderman Ioannoni that report MW-2005-136 be deferred and staff to investigate all unimproved roads for possible closure and constructing a gate across Ort Road. Motion: Carried Action: Recommendation submitted to Council 2005-11-21. d) MW-2005-126 - Space Needs - City Hall It was ORDERED on the motion of Alderman Ioannoni and seconded by Alderman Wing that the request to lease space at the Acres Building be denied and staffto move forward with renovating the Old City Hall. BACKGROUND: Traffic impact studies are an important part of the development review and approval process to assist in making land use decisions, such as Official Plan amendments, zoning amendments, site plans, subdivisions and other development reviews. A traffic impact study is required to be completed for proposals that may have a significant impact on traffic and transportation operations within the City of Niagara Falls. In 2002, City Council adopted the "Guidelines for the Preparation of Traffic Impact Studies." These guidelines were distributed to various traffic consultants and are currently being used. Although, for the most part, the guidelines are satisfactory, staff has noted several recurring issues that are not being adequately addressed. Therefore, a revision to the guidelines to further streamline the process has been undertaken. The major emphasis on the updated guidelines includes the review of traffic related issues on a preliminary site plan for developments requiring the completion of a traffic impact study. A preliminary site plan review that is carded out concurrently with a traffic impact study will ensure that best practices have been incorporated from the onset, thus eliminating future site plan modifications that may, in turn, affect the results of a traffic impact study. BACKGROUND: The developers of the Beaver Valley Extension I & II Plans of Subdivision were required to construct a trunk sanitary sewer on Kalar Road in order to provide a suitable outlet for their development. The trunk sewer was designed to receive flows from adjacent properties resulting in some oversizing of the pipes. One of the adjacent properties, Ascot Woods Ext.7 was identified early in the process and separate cost sharing arrangements have been made between the two developers. The other property includes the lands owned by the Province for the possible future extension of Hwy 420. Although their future use of these lands is yet to be determined, the developer of the Beaver Valley Subdivision Ext. I & II has requested the City to implement a cost recovery mechanism, in the event the future highway lands are sold to other development interests. Attached is a plan showing the subject properties. The Development Charges Act, (sections 44 to 57) gives municipalities the authority to enter into a "Front-Ending Agreement" that provides for persons who, in the future, develop land within the area defined in the agreement to pay an amount to reimburse some part of the costs of the work. BACKGROUND: The Niagara Catholic District School Board (NCDSB) is planning the construction ora new parking lot on the north side of Churchill Street opposite Father Hennepin Elementary School to accommodate recent growth and to relieve congestion on the roadway. In addition to the creation of a 28-car new parking lot, the project includes the construction of a new turning circle on Churchill Street that will improve access for emergency vehicles and school bus loading. A concept plan of the proposed layout is attached to this report for your reference. Municipal Works staff received a letter from the NCDSB requesting the City to enter into a Development Agreement for the joint construction of the works and to contribute financially for the upgrades required to Churchill Street. Smaller scale projects of this nature can usually be accommodated within the annual Asphalt Overlay and Road Rehabilitation Program (Account # 12-3-310024-030000). It is assumed that any property acquisition required by the City will take place for nominal consideration. The NCDSB is planning to commence work during the summer of 2006 and is looking for the City's cooperation and funding commitment as soon as possible so that the contract documents, securities and execution of the Development Agreement can take place over the next two to three months. BACKGROUND: At its meeting on October ! 8, 2004, City Council adopted the recommendations of report MW- 2004-156 which authorized the engagement of Associated Engineering (Ont.) Ltd. to complete the Municipal Class Envirom~ental Assessment to identify the preferred alternative for servicing the Garner and Southwest Planning Areas. Based on a review of existing m~d future conditions the following problems/opportunities were identified; · need for sanitary services to accommodate new development projects identified for the Garner and Southwest Planning areas, · desire to connect existing residential, commercial and industrial properties as new development proceeds, · need for cost effective servicing scheme that allows individual properties to develop independently where practical to do so, and, · minimize potential impact to all aspects of the environment. A comprehensive circulation to various agencies and local interest groups was also an integral part of this project. Four alternatives were identified and analyzed based on their estimated costs, flexibility for phased construction and functionality. The recommended alternative (Alternative D) is shown on the attached plan. The estimated cost of the preferred solution is $9.2 million which will be financed entirely from the Development Charges Reserve Fund. BACKGROUND: The City of Niagara Falls proposed to integrate cycling and walking into its public infrastructure system in 1997 through the development of the City's Trails & Bikeways Master Plan. Initially, the Trails & Bikeway Committee was set up in 1998 as an Ad Hoc Committee to the City's Environmental, P lamfing a nd Greening Committee. However, i n 2 001 t he T rails & Bikeway Committee became a separate committee of City Council in which members and a chair were appointed. Since this time, the Niagara Falls Trails & Bikeway Master Plan has been updated. A final version of the Master Plan will be presented to Council by TSH and Associates for January 2006. Trails & Bikeway Committee Mandate: Presently, the Committee's mandate is to advise Community Services Committee and Council on issues regarding Recreation Trails and Bicycle related programs. The Committee will consider ways in which to help promote and develop Recreation Trails and Bikeway routes throughout the City of Niagara Falls. The Committee will assist in the implementation of recommendations contained in the City's Trails and Bikeways Master Plan. Proposed off Road Trail & Pathway Development: The Trails and Bikeways Master Plan proposes the development of numerous off-road trails and pathways. As a result, the Committee is concerned that certain barriers may arise which would prevent these trails fi'on] being developed. One of the key trails identified in the Master Plan was the Millennium Trail. However, because specific sections of that trail were proposed to extend behind residential housing, the trail was not approved to be developed as initially planned. At present, there are approximately four (4) other trails/pathways identified in the Trails & Bikeway Master Plan that would also be situated near residential housing. These trails are as follows: 1. NS&T 2. Downtown CP Rail Trail 3. Deerfield Estates Garner Recreational Trail 4. Mitchell Line (Currently, not owned by the City) These four (4) trails account for an estimated 11.5 kilometres of trails/pathways that would be located near residential housing. Members of the Trails & Bikeway Committee believe similar barriers identified by residents opposing the Millennium Trail throughout the Hydro Corridor w'ill also be apparent with the above trails. Conclusion: As a resuh, the Committee is confused about the future development of trails in Niagara Falls. Although many of Council's plm~ning documents clearlyindicate support for traiI development, there has been little support for any of these developments. At the last Trails & Bikeway Committee meeting, which took place Thursday, October 20, 2005, the Committee passed a motion to suspend all future actions and initiatives until further direction regarding trail development was provided from Council. This motion was carried unanimously among all Committee members. The Committee will consider ways in which to help promote and develop Recreation Trails and Bikeway routes throughout the City of Niagara Falls. The Committee will assist in the implementation of recommendations contained in the City's Trails and Bikeway Master Plan. Membership: The Membership of the Committee will include a wide range of trails and cycling enthusiasts with interest, expertise and experience in these fields. Membership will generally be composed of eight (8) to twelve (12) individuals with one individual being a member of Council. The term of Membership of the Committee will coincide with the Term of City Council. Existing members will be required to submit their intentions to return to the Committee. An advertisement will be placed in the local newspaper for new members if necessary. Members of the Committee will be approved and endorsed by Council Meeting Format: Meetings will be held on a monthly basis, or at the call of the Chair. The agendas and minutes will be prepared by the liaison representative from the Parks, Recreation and Culture. At the first meeting, the Committee will elect a chairperson. Staff Support: The City's Parks, Recreation and Culture liaison will act as Secretary-Treasurer to the Committee, providing professional and administrative support. Work Program: At the first meeting of each calendar year, the Committee will review its Work Program for the upcoming year. The Committee may establish advisory committees to deal with specific areas. 2 TASKS AND RESPONSIBILITIES: Encouragement Strategies · The Committee will promote existing cycling safety and skill courses for all ages. · The Committee will promote cycling and maintenance workshops through programs offered by the Parks, Recreation and Culture. · The Committee will provide support for local walking and cycling groups in the provision of information about trail/bikeway routes, safety and training. · The Committee will initiate a pro-active media campaign to disseminate information about the City's trail and bikeway etiquette. ~ · The Committee will assist the City in the development of a marketing strategy that will be implemented to assist in the phasing of construction of trails and facilities related to the system. · The Committee will assist the City, in conjunction with the Region of Niagara to encourage cycling on existing roads and has the ultimate goal to bring all City residents in the urban area within 1 kilometre of an assigned bicycle route. · The Committee will work with the City and the Niagara Falls, Canada, Visitor and Convention Bureau to set up a marketing campaign which will promote Niagara Falls as a tourist destination for cyclists. · The Committee will liaise with the Region of Niagara, Niagara Parks Commission and adjoining Communities' Bicycling Committees. · The Committee will strive towards the implementation of the recommendations contained in the Trails & Bikeway Master Plan. · The Committee will assist the City to insure the preservation of the former NS&T railway line for future recreation trail use. Education al Strategies · The Committee will promote the use of walking and cycling as a viable transportation mode for all residents. · The Committee will assist the City in assuring access to all destinations provided by the safest feasible routes. 3 · The Committee will encourage the establishment of facilities which promote walking and cycling use for work-based travel. · The Committee will promote special events, such as The Bike Fun Day to encourage all forms of walking and cycling. · The Committee will assist in the publishing of a Trails and Bikeway route map informing residents of routes of special events. Such a map will include tourists attractions and historical sites. · The Committee will assist the City in considering the recommendations of the Transportation Association of Canada regarding the use of in-line skates in the Municipality. Engineering Strategies · The Committee will assist the City in completing an inventory of intersections throughout the network in order to identify bikeway related deficiencies such as lighting, signage, signalization and traffic channelization. · The Committee will be involved regarding access to adjacent municipalities through regular consultation with staff of adjacent jurisdictions. · The Committee will work with the Niagara Parks Commission and develop strategic locations that will connect residents to the Niagara River Recreation Trail. · The Committee will assist the City of Niagara Falls in securing an easement with Ontario Hydro along transmission corridors and power canals. · The Committee will assist the City of Niagara Falls in pursuing the acquisition/lease of the Mitchell line from Ontario Hydro. · The Committee will assist the City of Niagara Falls by reviewing the planning, construction and maintenance of trail and bikeway facilities within the areas identified in the Regional Bicycling Study. · The Committee will assist the City to ensure the maintenance of trails and bikeway routes. · The Committee with the help of the City will monitor physical condition of trails and bikeway routes. 4 Enforcement Strategies · The Committee will review Municipal requirements to ensure provision of bicycle facilities, such as: parking, showers, storage lockers and enforcement of standards. · The Committee will work with the Regional Police to promote good and courteous road behavior through appropriate reinforcement of provincial and municipal regulations and statutes. · The Committee will work with the Regional Police to identi~, and address local and regional trail and bikeway issues. · The Committee will assist the City in signing the trails and bikeway network. · The Committee will encourage Regional Police to actively patrol all on and off-road trails and bikeway facilities.
