This is our most recent financial contribution to the Home For Girls Soccer contruction project. This joint venture between the City of Niagara Falls and NFGSC has most recently seen the construcion of two full size soccer pitches with lighting. The $88,100 contribution was for the purchase and installation of the lights. Other advances made in this joint venture include several mini fields, parking, and the contruction of a park pavillion. These two gentlemen assisted the police in apprehending the man who ran the US /Canada border while being pursued by New York police and who eventually killed a young mother on Victoria Avenue. Ted thinks we should bring them to City Council for recognition. Can this be done on December 5th or 12th please. Lesdow Proposed Townhouse Development Existing Church 1) Council approve the Zoning By -law amendment application for the R4 zone with special provisions as detailed in report PD- 2005 -68 (attached) to permit a 25 -unit townhouse development with a "Holding" (H) provision regarding stormwater servicing and to recognize the existing church; 2) the church site plan agreement be amended prior to the zoning by -law being passed; and 3) staff be authorized to complete any outstanding works on the church property if they are not completed by June 1, 2006 and the cost be billed to the church. BACKGROUND: Prior Council Action Reconsideration Procedure Council originally conducted a public meeting as required under the Planning Act on August 29, 2005 for this application and considered the attached Recommendation Report PD- 2005 -68. Following presentations from staff, area residents and the applicant, Council denied the Zoning By -law amendment application. Council passed a motion on October 17, 2005 to reconsider this decision on the basis of a "Holding" (H) provision for the stormwater servicing of the townhouse site. Staff provided notice of tonight's public meeting for reconsideration in satisfaction of normal Planning Act procedures and to those persons that submitted letters through the earlier process or spoke at the first public meeting. Zoning amendments are requested for two proposed parcels of land with areas of 2.77 acres (1.12 hectares) and 2.1 acres (0.85 hectares). The subject land is located at the southeast corner of Dorchester Road and Frederica Street, south of Highway 420 (see Schedule 1). The property contains the Niagara Working Together to Serve Our Community Clerks Finance Human Resources Information Systems Legal Planning Development December 5, 2005 2 PD- 2005 -96 International Worship Centre and is known municipally as 6846 Frederica Street. The applicant proposes the construction of a 25 -unit townhouse development south of the church on a property to be created through a related severance (B20 /2005/NF). Schedule 2 indicates the proposed configuration of the future properties (Part 1 and Part 2). The details of the proposal are shown on Schedule 3. The north section of the property is currently zoned Institutional (I) while the south portion of the land is zoned Institutional with site specific provisions (I -532). The applicant has requested a site specific Residential Low Density, Grouped Multiple Dwellings (R4) zone to permit the proposed townhouses on Part 1 and a site specific Institutional (I) zone for the existing church on Part 2. A "Holding" (H) provision would be applied to the R4 zone to address stormwater servicing requirements for the townhouse development. Planning Review Staff continues to recommend approval of the Zoning By -law amendments from a land use planning perspective. The complete analysis of the proposal is contained in report PD- 2005 -68 (attached). The following summarizes this review and provides updated information. Proposed Townhouse Development The application for the 25 -unit townhouse project complies with the policies of the City's Official Plan including location, density and compatibility. The proposal does not preclude future development opportunities on the deep residential lots to the south. The requested zoning by -law standards (as modified by staff) are appropriate. The City's Committee of Adjustment granted conditional approval on August 30, 2005 for the severance of the land to create a separate property (Part 1) subject to the existing Institutional (I) zoning provisions. This decision was not appealed. The submitted townhouse proposal would be more compatible and less intensive than a possible nursing home or senior citizen home that could be developed under current zoning. The preservation of the mature trees along the east property boundary shared with Woodland Boulevard residents is a key issue. The applicant's landscape architect provided information indicating that the proposed minimum townhouse dwelling setback of 28 feet (8.5 metres) to the east property line would be acceptable. An arborist will be required to conduct root pruning prior to construction (preferably during the dormant season). Storm sewers are not available on Dorchester Road. Staff concurs with the requested "Holding" (H) provision which will be removed when a stormwater system is approved to allow the development to proceed. This may involve a temporary on -site storage system and connection to the Garden Street sewer if capacity is available, or waiting until the construction of a planned storm sewer in the future. An Environmental Assessment has been completed for this section of Dorchester Road but approval from Council is required before commencing the storm sewer and road design. Existing Church Development The zoning amendment will recognize the proposed lot frontage on Dorchester Road and existing side yard setback to Frederica Street for the church. The Committee of Adjustment granted variances on November 1, 2005 for this reduced frontage and side yard setback and no appeal was submitted. However, the zoning amendment would also extend a 6 metre (19.7 foot) buffer landscaping requirement between the parking area and lot lines over the entire site rather than only the south portion of the property as in the current zoning. The church development must comply with all other standards of the Institutional (I) zone category. The majority of comments received from the public focus on items that were to be completed by the church through a Site Plan Agreement registered on title in 2001. A review of current site conditions indicates outstanding works with respect to the parking lot (layout, islands, paving), landscaping and outdoor garbage containers. Site plan compliance is usually investigated on a complaint basis and these December 5, 2005 3 PD- 2005 -96 issues were only identified through public comments on the rezoning. The normal site plan process requires the submission of securities to ensure the development is completed in accordance with approved plans, however, it has been discovered that securities are not being held for the outstanding items. The City has the option of completing the non complying site works and charging the costs to the owner or applying the costs to property taxes but the asphalt and landscaping cannot be done in the winter. Staff requested the church undertake the required work by November 15, 2005. The church has submitted an undertaking to complete the terms of the site plan by June 1, 2006. In addition, the church pastor has sent a letter indicating that two large recycling bins will be removed shortly and the garbage container will be relocated closer to the church and an enclosure constructed in the future as required by the City. Other site items noted by area residents were fencing and a gravel driveway to Dorchester Road. The construction of new fencing was not shown on the approved site plan but has been constructed by the church. Fence boards should also be installed on the abutting property owner's side and the fence posts extending above the board height should be cut back to comply with municipal standards. The gravel driveway was indicted on the approved site plan, however, additional staff review is required to determine if it should be maintained (asphalt paving would be necessary). Any purchaser of the proposed lot to be severed south of the church would need a discharge of the existing site plan agreement that currently covers the entire property. Therefore, the church site plan will need to be amended and should occur prior to the amending zoning by -law being passed. This gives another opportunity to obtain a security deposit to ensure any outstanding work is done. A full review of the development and any proposed modifications to the approved plan will be undertaken. CONCLUSION: The requested site specific amendments comply with the policies of the Official Plan and are consistent with the Provincial Policy Statement. The townhouse development will add to the range of housing types available in the area and will be designed for compatibility with surrounding uses. A "Holding" provision is required for the townhouses until stormwater servicing is approved. The suitability of the east boundary setback has been confirmed by the applicant's landscape architect. The existing church and proposed lot configuration will be recognized and a buffer landscaping requirement will be applied for the whole site abutting residential uses. The outstanding site plan matters for the church parking lot and landscaping are to be competed by the church in the Spring. The garbage containers will be removed/relocated shortly and additional fence work can be done now. Staff will work with the church to complete the requirements as soon as possible. If the church does not satisfy the terms of the site plan agreement in full by June 1, 2006 as indicated in the submitted undertaking, the City will complete the work and charge the owner. In 2001, Council passed an amending zoning by -law for the south portion of the overall property to allow an addition to the church. The site specific zoning requires a 6 metre (19.7 foot) landscaped buffer strip between the expanded south portion of the parking area and any lot line to improve compatibility with abutting residential properties. A site plan was approved and the addition was constructed. Securities are held by the City to ensure the project is developed in accordance with the approved site plan (the gravel parking area is to be paved and the outside garbage /recycling containers removed). The church is required to undertake this work to comply with the terms of the site plan agreement. The church is maintaining grassed areas for outdoor activities but the balance of the land (Part 1 on Schedule 2) is surplus to their needs. Neighbourhood Involvement The related severance application was deferred at the July 19, 2005 Committee of Adjustment meeting until after the consideration of this zoning amendment application. Staff recommended approval of the application conditional on the necessary zoning amendments. Several area residents attended the Committee meeting and letters of objection were submitted. It was suggested at this meeting that a private covenant on the site restricts the use of the land to church/religious purposes. However, there is no record of any private restrictive covenant registered on title. The applicant held a neighbourhood information meeting at the church on August 2, 2005 that was attended by approximately 30 residents, the church pastor and City Planning staff. The proposal was described by the applicant to contain 1 %2 storey units (some lofts) with garages that would sell in the $250,000.00 range. The end units at Dorchester Road are intended to be designed with side windows to give the appearance of facing the street and decorative metal fencing is to be provided. Issues raised by residents during the meeting included: tree protection; building setbacks; Dorchester Road traffic and widenings; impact on the neighbourhood; why not single- detached dwellings on the site; and no changes have been made to plans shown to residents. Staff listed the uses currently permitted on the property by the Institutional (I) zone. These issues are addressed in this report. Circulation Comments Information on the requested zoning amendment was circulated to City divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: Building By -law Services No objection. Fire Services No objection. The site layout appears satisfactory. Designation of a fire access route is necessary and would prohibit internal roadway parking. Municipal Works Dorchester Road has adequate width and no improvements are planned in this area. Anticipated traffic volumes from the townhouse proposal are relatively minor There are no storm sewers available adjacent to the site. The applicant needs to investigate design options for a stormwater system in consultation with staff. August 29, 2005 3 PD- 2005 -68 Parks, Recreation Culture No objection. Regional Planning The proposal complies with Regional planning policies. Noise attenuation including a 1.8 metre (6 foot) high solid fence along the north property line is recommended due to Highway 420. Regional Public Works The townhouse site design does not comply with the Regional policy for waste collection and private service collection is required. Ministry of Transportation Standard approval requirements for development. Dorchester Road Residents Concerns regarding the impact of the proposal on potential future development of land to the south. Deferral of the application is requested. High Street Resident Objection to the proposal. The development is not in keeping with the area. Notes comments expressed at the neighbourhood meeting. Planning Review Various matters were considered in assessing the application. Based on this analysis, approval is recommended with minor modifications. The review of the amendment is summarized as follows: 1. The proposal complies with the policies of the Official Plan. The City's Official Plan designates the property Residential which permits a variety of housing types and ancillary uses such as the existing church. A compatible mix of dwelling types is promoted by the Plan to provide a full range of housing opportunities throughout the municipality. These principles are consistent with the Provincial Policy Statement. The subject land is located at the periphery of the neighbourhood near Highway 420. Single detached dwellings on large lots abut the site to the east and south. There are single- detached houses as well as an apartment development on the west side of Dorchester Road in the area. This site is a large underutilized property that has direct access to an arterial roadway. This location meets the general criteria of the Official Plan for multiple residential housing. The large properties on Woodland Boulevard and very deep lots to the south are developed at an extremely low residential density of approximately 2.3 units /acre (5.7 units/hectare). The Official Plan permits a maximum density of 10 units /acre (25 units/hectare) for singles and semi detached development. The density of the townhouse proposal is approximately 9 units /acre (22 units/hectare) which is low for multiple unit housing the Plan allows densities for townhouses up to 20 units /acre (50 units/hectare). However, this proposed density is similar to other townhouses approved and constructed in recent years in the City. The gradation of development density between the singles and townhouse site is appropriate. Subject to suitable building setbacks and design details, the townhouse development will be compatible with the surrounding area. The rear portions of Dorchester Road properties to the south have future development potential. Some of these property owners have expressed interest in developing their land as a result of the circulation of this application. Any development proposal would require the coordination of the property owners or a land assembly. The current application does not preclude development options on this land to the south. The internal driveway of the townhouse site could possibly continue to the south or an independent development with access to Dorchester Road (between existing houses) may be feasible. Interested property owners should consult with development professionals and City staff. 2. The Zoning By -law amendment, with minor changes and a "Holding" provision for the townhouse site, is appropriate. Townhouse Rezoning The applicant and church have indicated that several development design options have been considered for the surplus land. Based on land and servicing costs, the applicant has proposed townhouses as a viable development from their perspective. Given the location of the existing church and the dimensions of the land, the provision of the standard public road right -of -way width required for single or semi detached lotting is not possible. The existing site specific Institutional zoning (I -532) on the south portion of the site would permit uses such as a community building, nursing home, church or senior citizen home. These uses could be developed up to 3 storeys in height, side yards (north and south) of 5 metres (16.4 feet), minimal landscaping (5% of lot area) and sizable parking areas located 6 metres (19.7 feet) from the property lines. Generally, these uses would be more intensive and less compatible with the surroundings than the proposed townhouse concept. Site specific zoning provisions are requested to allow the townhouse development. The following chart indicates the recommended amendments to the R4 zone requirements. August 29, 2005 5 PD- 2005 -68 The front yard depth exceeds the typical zoning requirement and reflects the submitted design. The setback of the end unit walls (applicable to the east townhouse block) is acceptable and a greater minimum side yard than required for single- detached homes. The proposed lot coverage is slightly more than the 35% by -law standard. The minor increase in building coverage is offset by substantial landscaped open space (40 compared to approximately 10% of the lot area that would be required in the basic R4 zone. The architectural design of the roof pitch at the central portion of each townhouse grouping necessitates the request for increased building height. The intent of the separation distance between adjoining townhouse walls with windows is for privacy. The recommended separation exceeds the minimum for single- detached houses and the applicant may use privacy glass (Building Code requirements apply). The request for deck projections at the rear of the units in the north and south yards is appropriate and decks would be permitted in the east yard (defined as the "rear" yard of the property in the by -law). The minimum residential standard of a 7.5 metre (24.6 foot) amenity area is provided at the rear of each unit. However, tree protection along the east property line is one of the key issues with this proposal. The applicant prepared a location sketch of the trees along the boundary line and consulted a landscape architect. The large oak trees are in excellent condition and have high aesthetic and environmental value. The focus of the consultant's review was on screening options. A special fence design along the lot line area is recommended rather than an earlier contemplated berm that would impact the trees. The landscape architect indicates that the area within a radius of approximately 9.1 metres (30 feet) from the trees is very sensitive and that construction, grading or excavation is not recommended in this area. An increase to the minimum building setback is therefore warranted at the east boundary. The applicant has agreed to provide a minimum 8.5 metre (27.9 foot) setback and the majority of the foundation is proposed with setbacks over 30 feet based on the current stepped -back architectural design. The landscape architect or an arborist needs to verify that this setback and associated tree saving plan measures will safeguard the trees. Otherwise, a redesign of some units (specifically the wide units #10 and #16) would be necessary to provide a further separation from the east boundary trees. There are currently no storm sewers adjacent to the proposed site. The applicant is responsible for examining stormwater servicing options. The inclusion of a "Holding" (H) provision for the R4 townhouse zone is recommended as permitted under the Planning Act. This "H" designation will be removed when a stormwater system is approved. Church Rezoning With respect to the existing church building and proposed lot configuration (Part 2), the following site specific Institutional (I) zoning standards are recommended: recognize the proposed minimum lot frontage (defined as Dorchester Road) of 24.4 metres (80 feet); recognize the existing legal non conforming exterior side yard width of 6.4 metres (21 feet) to Frederica Street; and extend the requirement for a 6 metre (19.7 foot) landscaped buffer strip between any parking area and the property lines to the east and south abutting residential uses (as specified for the south portion of the site in the 2001 zoning by -law). The number of parking spaces provided satisfies zoning regulations based on the submitted information. 3. Additional Planning Act approvals are necessary. The deferred severance application is scheduled to be considered by the Committee of Adjustment on August 30, 2005. Approval and satisfaction of any conditions (such as a zoning change) is required to create the separate property for the proposed townhouse project. The detailed design issues such as tree preservation, landscaping, fencing, lighting and servicing need to be addressed at a future application stage. These measures will ensure compatibility with the surrounding properties. If the proposal is developed as a "standard" condominium, site plan approval is required prior to the issuance of building permits. Alternatively, a "vacant land" condominium application could be submitted to create individual parcels of land upon which to construct the units in the future. In this case, the design matters would be addressed through conditions of draft plan approval for the condominium. Any interested residents may be involved in these processes. CONCLUSION: The requested site specific amendments comply with the policies of the Official Plan and are consistent with the Provincial Policy Statement. The townhouse development will add to the range of housing types available in the area and will be designed for compatibility with surrounding uses. A "Holding" provision is required for the townhouses until stormwater servicing is approved. The suitability of the east boundary setback needs to be confirmed by a tree expert. The amendment will recognize the existing church and proposed lot configuration and apply buffer landscaping abutting residential uses. Approval of the application is recommended. Property owners to the south on Dorchester Road have requested a deferral to explore possible impacts of this proposal on development opportunities for their land. The applicant wishes the zoning amendment to proceed. Staff is satisfied that the application does not preclude future development to the south. The deferral request is for Council's consideration. In our opinion, the subject site layout for the proposed townhouses/condominiums does not comply with any of the options allowed in the Regional Policy "'Collection of Waste By Way of Entry on Private Property" (Policy PW2.W07). A copy of the above referenced policy may be obtained from the Waste Management Services Division, Public Works Department, 2201 St. David's Road, Thorold. It has been our experience that purchasers of homes in these sites expect that theft waste will be collected by the Region and quickly request that the Region does so, even though the developer has indicated that private collection will be the method of collection. This leaves the Region with the unfavourable situation of having to deal with the affected residents after the fact and the potential to subsequently compromise the Region's policy. Therefore, we cannot support the site plan as submitted with this application and would request that the municipality discuss this matter with the developer, in order to ensure that the plan ultimately complies with our policy. If it is the intention of this development to provide new public services, as a condition of draft plan of approval, we will require the appropriate Certificates of Approval from the Ministry of the Environment. Therefore, as part of the Ministry's Transfer of Review Program, this department will require a detailed set of servicing drawings for our review and approval. Zoning By -Law Amendment Application I wish to express my concern regarding the "second crack" that the Niagara Worship Centre has received at obtaining amendments to zoning bylaws. I was at the meeting on Aug. 29 when several people spoke and presented their prepared comments. I felt greatly encouraged when 6 aldermen along with acting Mayor Kerio voted to deny the Rezoning Application. As reported in Niagara This Week on Wednesday, Oct. 26 2005, Pastor Myles Holmes stated that the decision to deny the application "was based on wrong information He further states in a letter to City Clerk, Dean Iorfida dated Sept. 6, 2005 that "false charges" and "erroneous allegations" were the basis or at least partially responsible for the decision to turn down the Rezoning Application. I would like to use the minutes of the Aug. 29, 2005 meeting, specifically PD- 2005 -68 to revisit and reveal any "false charges, wrong information [or] erroneous allegations" or lack there of. Terry Dale, 5610 Dorchester Road, stated her opinion that a secondary plan should be done for the whole area. She also feels there should be a storm water management plan completed to prevent future problems. Ron Giberson, 5803 High Street, stated that the current site plan had not been adhered to and that the development was not in keeping with the residential nature of the neighbourhood. Don Calaguiro, 5581 Woodland Blvd. Indicated that his street has had flooding problems in the past, provided history of the development and reported that due to the age of the trees and the deep roots, special equipment would be needed to remove them. Mr. Calaguiro outlined what he would like to see: minimum setbacks increased, plantings within 10 feet of the property line not be disturbed, cedar board fencing of appropriate size and coverings be installed, that flooding issues be dealt with and the original cite plan involving building a gym for the students be completed. Richard Ciupa expressed his concerns about not having storm sewers in the area and felt that staff should look at the assembly of all lands not this proposal in isolation. I don't believe any of the above minutes express or insinuate "false charges, wrong information or erroneous allegations Instead, the prevailing themes which emerged were around storm water management, removal or excavation near trees with thin, deep roots, the current site plan which has not been adhered to and finally, a theme of future development opportunities for properties to the South of the Church. Pastor Myles Holmes in his Sept. 6 letter writes that the non compliance with the specific site plan is "alleged [and that] 1) Fencing was completed 2 years ago. 2) Trash has always been contained properly. This is a non issue. 3) The paving of the driveway onto Dorchester has never been a condition of the site plan." Peter J. Lesdow, in his letter to Members of Council dated Sept. 19, 2005 states that upon his "review... only two small items [were] not completed. The first [is] a stoned area where an asphalt strip is to occur along the south of the existing parking lot Is this the same "paving of the driveway onto Dorchester" that Pastor Myles Holmes wrote was "never ...a condition of the site plan The second item Peter J. Lesdow noted is the "introduction of four small curbed islands in the existing parking lot." Pastor Myles Holmes made no mention of this item. The truth of the matter is that the site plan agreement registered on Nov. 20, 2001 has been found to have the following deficiencies, revealed during the site inspection. These deficiencies have been outlined in both a Letter dated Oct. 7, 2005 written to Mr. William Stirling, Trustee of Niagara Worship Centre by Anamika Dilwaria, Planner 2 Ext. 4246 and below: 1) The parking layout for the site does not correspond to the approved site plan. The parking spaces along the northern property line which abuts Frederica Street have not been provided. 2) The parking island has not been landscaped. 3) The southern portion of the parking lot has not been paved. 4) The disabled parking signs tab has not been installed as per City's guidelines. The sign should be permanently installed at the front and centre of the parking stall and mounted at a height of 1.0 metres to 1.5 metres from the ground to the bottom of the sign. 5) The location of disabled parking spaces does not correspond to the approved site plan. 6) The site plan agreement requires garbage to be stored inside the building but the garbage is stored outside and a garbage enclosure has not been provided. Landscaping has not been completed along Frederica Street as shown on the approved site plan. Pastor Myles Holmes wrote that "trash has always been contained properly. This is a non issue Maybe it is non -issue to him but to residents and the good members of council, who included it as an item to be completed on the site plan, it is of some importance! He also wrote that "fencing was completed 2 years ago" but on a personal note, this fencing is one sided, with the good side facing the Church. My husband, Ronald Campaigne made an agreement with Pastor Myles. No, Pastor Myles did not knock at our front door, but on a few occasions, we spoke in our back yard. We stated that we wanted some say in what the fence would look like as well as the construction of it and the materials used. We wanted 6 x 6 posts and stated we would pay the difference. Instead, we got 4 x 4 posts. As part of the negotiation, we also asked for a 10 -foot section be left open so we could install a gate. He promised on both counts but delivered on only one. We even went so far as to remove our own chain -link fence so the Church wouldn't have to do it. When the fence was erected we noticed the posts to be uneven and much higher than the fence boards. We assumed the Church would complete the work and cut the tops of these posts. We waited, and waited until finally, one month ago, we cut them ourselves. Our next door neighbour's fence still has the tops of the posts to be cut down! The fence was also not placed on the property line and now, with the proposed plan, it is slated to be "removed" and relocated by about 10 feet, back onto the area we have professionally landscaped and cared for since 2001. I wonder how long we will have to wait for a new site plan's conditions to be met if the application for rezoning is approved and the development of Mr. Lesdow's project begins Mr. Lesdow's regard for honouring site plan agreements also seems suspect especially after reading his opinion regarding the Church's non compliance with the site plans. He writes, "only two small items [were] not completed ...[and that's] hardly any reason the church should have received such ...criticism, considering other site plan agreement breaches in this city." After such a statement, will he honour site plan agreements after the proposed Rezoning and his development? I am disappointed that Pastor Myles did not attend the Aug. 29, 2005 meeting nor the one held in 2001. Further, I am disappointed that after we, the neighbours presented our case there has been a motion to reconsider this application! Dean Iorfida's memorandum dated October 17, 2005 to Mayor Ted Salci outlines that "the purpose of reconsidering a vote is to permit correction of hasty, ill- advised, or erroneous action, or to take into account added information or a changed situation that has developed since taking of the vote." He also states that "the practice at a staff level has been not to entertain the re- submission of failed applications unless there has been a substantial change to the application." Finally, "the applicant and potential purchaser always have the recourse of appealing council's refusal of the rezoning application to the Ontario Municipal Board, which may be more expeditious If the application had been approved, our only recourse would have been to go to the OMB. Why is the Church not subject to the same recourse now that their application for Rezoning has been denied? At the end of the day, the Church did break promises they made to the city and the neighbours. By breaking these promises the Church did act in bad faith. When you act in bad faith to the city and the neighbours you actually "dupe" the city and the neighbours. Only the neighbours can feel betrayed. The Church cannot express nor deny my feelings. The Church did break our agreement to build using 6 X 6 posts. Pastor Myles' letter outlining 7 false statements, I believe, impelled the council to reconsider the application for Rezoning. I stand by 6 of the 7 statements. I personally do not have knowledge of the 7th. Finally, because I do not have faith that the current site plans will ever be completed, I request at the very least, stronger terms to enforce the new site plan in order to ensure it is properly adhered to and completed. I live directly behind the Niagara Worship Centre. I am not pleased with the Centre's request along with the developer of the townhouse complex) for a variance onto my property. I have just landscaped the back in order to fight the weeds that grow through the current Church fence. The Niagara Worship Centre is not well maintained and I fear giving the city is only giving it more property to neglect. I am also concerned about the traffic on Dorchester Road. It is a road I travel everyday to get to work. The roadway in its current form, can not handle any more vehicles dumping onto it. Proof of the severity of the traffic conditions on Dorchester can be found in the recent Niagara Police Services Board report that named Dorchester and Lundy's Lane the most dangerous intersection in Niagara. I would like to know what the city plans to do to prevent chronic congestion on this road? I am also concerned about the extra burden being placed on the water and sewer lines that service our area. Will the city take full responsibility if there are problems on these lines resulting from the extra 25 units? Not only will there be the extra 25 units, there will be an extra 25 families taking showers, washing clothes, etc. that will add to the volume of water and waste the system will be forced to handle. As we know, the city is grappling with the issue of aging water and sewer systems. Are you prepared to spend the extra money to make sure that system can handle this new development? In closing, will the city assume responsibility if the development causes flooding or any other problems in the Woodland yards? Who will replace the old growth trees that may have to come down if the developer is awarded the variance? Who will I complain to if the Worship Centre continues to neglect the additional property it will be given under the variance? I hope before you approve this application you take all of the aforementioned concerns under consideration. As a Woodland Boulevard homeowner, I take pride in my neighbourhood. It is not that I am anti development, I just want an appropriate development that helps to maintain, not only my property value, but the aesthetic myself and my neighbours have worked so hard to develop. Dear Doug; Pursuant to Zoning By -Law No.79 -200 and your Letter of Notification, I object to the proposed rezoning for a 25 Townhouse development on said lands Part I Plan 59R -8294. I fail to understand the reasons for this matter being before Council. The Applicant was professionally represented (P Lesdow in Trust) at the meeting held on Aug 29, 2005 in Council chambers. It was discussed at great lengths. Council carefully considered the matter and the conclusion was clear: 1. Rezoning to R4 was denied, 7 to 1. 2. The Sewer Use Bylaw was to be ammended (Councilor Campbell's motion). What is the status of the By Law amendment It is clear that the sale of this property is still conditional on rezoning to R4. The Developer's Agent/Partner, P Lesdow stated before Council that the property was overpriced and at $510,000 could only support the Townhouse Proposal. Our neighborhood is not responsible for the financial decisions of others, nor should we be forced to accept rezoning for certain parties to realize large financial gains. We do not want Townhouses in our backyards. I purchased my property for the large lot and the quiet, peaceful, rural setting. I've talked to surrounding residents on the City block bound by Woodland Blvd, High Street, Dorchester Road and Frederica Street and they feel the same way about this!. The message I am getting is that the proposed development is neither in keeping with our neighborhood nor in keeping with the Official Plan. I have been a resident in this neighborhood for 27 years and am disappointed that this development has been re tabled for rezoning approval under the guise of a Holding (H) Provision. The Law directs the Applicant to the OMB not to Council through the backdoor! Our neighborhood is single family, highly desirable and a rival of Rola Woods or Corwin Crescent and we are determined to keep it this way! I trust that Council will support the neighborhood in their concerns and deny this application for rezoning. We had previously attended a meeting of the residents at the Niagara Worship Center and it appeared, after many points were brought forth and discussed, that most of the residents did not find this subdivision objectionable As the owner of my own residence and three other residential houses in the neighbourhood, (Dorchester, Woodland and High Street), I probably have more at stake than any other shareholder. I would like to go on record as being in favor of this development for the following reasons: 1) The land had been zoned "institutional" which would mean that the Church could enlarge their school, or build a senior citizen's home, a half -way house, hostel, or a number of uses that would certainly not add to the value or our area; and would more likely reduce the value of our homes. 2) The question of traffic on Dorchester Road came up at the church meeting. The objectors are not against single family homes (which we're sure would be out of the question for the value of this land). However, we feel that the upscale townhomes that are proposed would attract seniors and/or professional couples who would use their car about a third as much as a typical 4- person/two or three car family would. 3) These townhomes would be in keeping with the city's official plan for land use, and would certainly add more value to our residences than would single family homes. Some very good questions arose at the meeting and were satisfactorily addressed with the possible exception of the setback from Woodland Avenue. The amount promised seemed adequate to us but we are not familiar with the normal residential setback required by the city. 1 It would certainly be nice to leave this property as an orchard but we know that this is not to be. We have always been concerned about what would eventually be developed on this land. When we heard the word "townhouses" we pictured a row of nondescript attached homes, and immediately called Peter Lesdow to view the plans. We were very pleased with the concept, the layout and the landscaping and felt it would be the best use of this land. The only thing we want to be assured of, possibly through a site plan agreement, is that the plans submitted to City Hall are followed exactly, and that the exterior finishes are of a natural stone. Be aware that we have no financial interest in this development, and the investment we have in our own property makes the idea of subdividing it unfeasible. We merely want to do what is best for the quiet enjoyment of our home. Proposed New Car Agency It is recommended that Council approve the Zoning By -law amendment application to permit a new car agency on the subject land subject to the recommended road widening and landscaping provisions outlined in this report. Autoline Toyota (Craig Coutu) has requested a Zoning By -law amendment for a 0.6 hectare (1.6 acre) parcel of land located at the southeast comer of Thorold Stone Road and Carroll Avenue, including properties known as 6030 and 6046 Thorold Stone Road, as shown on Schedule 1. The amendment is requested to permit a new car agency on the land. The land is zoned General Industrial (GI), which does not permit a new car agency. The applicant is requesting the land be rezoned to a site specific Light Industrial (LI) category which permits a new car agency. The applicant is also seeking relief from the road widening, rear yard building setback and landscaping provisions of the LI zone to accommodate the proposed development. This industrial area is in transition from heavier types of industry to light industry and office uses. TRG Insurance has recently relocated to the northwest corner of Thorold Stone Road and Stanley Avenue, east of the subject land. In 1998, Council passed a zoning by -law amendment, rezoning lands at 5900 Thorold Stone Road, east of the subject land, to LI to allow the current General Motors dealership. Additionally, a portion of the Treibacher and Zavitz sites on the north side of Thorold Stone Road was rezoned from GI and Heavy Industry (HI) to LI earlier this year. This transition is reflective of overall market trends to light industry. To the south, there is a major industrial use. To the west, there is a commercial plaza. To the east, there are a number of small properties used for automotive commercial and service uses. Further to the east, there is a new car agency. Thorold Stone Mall lies immediately to the north. Circulation Comments Regional Municipality In terms of land use compatibility and exposure to traffic, the of Niagara proposed automobile dealership is a suitable use for this site. Regional Planning staff is not opposed to the requested rezoning. Municipal Works A road widening is required along the length of the Carroll Avenue frontage. Fire Services City Clerk Parks, Recreation and Culture Planning Review High development standards and adequate landscaping, including a landscape strip separating Thorold Stone Road and the dealer parking lot, should be provided. A 3.0 metre (10 foot) wide road widening along the length of the Thorold Stone Road frontage is requested as the current road allowance is substandard. In addition, a 3.0 metre wide (10 foot) landscaped buffer is recommended to screen vehicles on the site from snow and debris emanating from the road. A sidewalk along the entire frontage of Thorold Stone Road is required. The applicant is required to build the sidewalk or contribute $16,400.00 to its construction. No objections. The new car agency will require a licence as a Public Garage /Automobile Service Station, which includes the sale of vehicles. A landscape plan will be required as part of the site plan process. A reduction in street trees along frontages with new car displays will be reviewed at that time. Placing the land under an LI zone category complies with the Official Plan and is reflective of the current development trends along this stretch of Thorold Stone Road. The following is a summary of Planning staff's analysis of the application. 1. The proposal complies with the intent and the purpose of the Official Plan. The land is designated Industrial in the Official Plan and is intended to be used for a variety of industrial, manufacturing and warehouse type uses. Zoning amendments can be considered to December 5, 2005 3 PD- 2005 -97 address changing market conditions and new development trends subject to certain criteria. The Official Plan also seeks the provision of a gradation of industrial zones, with zones permitting lighter industrial uses located near residential and other sensitive non industrial uses to buffer these uses from heavier industrial uses. The proposal complies with the Official Plan as follows. There is currently significantly more growth in light and prestige type industrial businesses than in heavier types of industries. Rezoning the lands to LI reflects the current market trends. This complementary use does not create any land use conflicts nor will not impact the vitality of industrial lands located to the south of the property. Thorold Stone Road functions as an arterial road and a gateway into the City. The proposed new car agency is a prestigious use that will project a positive image on this gateway. Heavier types of industry that maybe less aesthetically pleasing will continue to be permitted south of the subject land, away from the Thorold Stone Road frontage. Adequate landscaping and good architectural design can be secured through the recommended standards and site plan control to provide a development with high aesthetic qualities that can complement this district. Zoning the lands for light industrial purposes provides a better transition between the heavy industrial uses to the south and the commercial uses to the north. 2. The requested Zoning By -law amendment is appropriate subject to the provision of adequate road widenings and landscaping. The requested LI zone permits a range of light industrial uses and certain automotive commercial uses. Given its location on a significant commercial corridor at the fringe of an industrial area, it is appropriate to rezone the land to a category that permits light industry and limited commercial uses. The applicant has requested a reduction in the rear yard setback from 7.5 metres (24.6 feet) to 6.9 metres (22.8 feet). The industrial use behind the site will not be impacted by the minor reduction in the rear yard setback. The applicant has also requested a reduction in the setback from the original centreline of Thorold Stone Road from 16.76 metres (55 feet) to 10 metres (33 feet), effectively eliminating this road widening reserve. In order to bring Thorold Stone Road to a standard necessary to serve future anticipated traffic and provide the necessary sidewalk for pedestrian safety, the Region needs to acquire a minimum 3.0 metre (10 foot) wide road widening along the length of Thorold Stone Road frontage of the property. The Region's Official Plan does not formally identify this road widening, meaning this widening may need to be expropriated in the future as opposed to dedicated through a development application. However, it is necessary to protect for this road widening. Proposed developments in the area will increase traffic volumes on Thorold Stone Road and may lead to future congestion if the necessary land to improve the road is not provided. Therefore, a 13.1 metre (43 foot) setback from the centreline of Thorold Stone Road should be provided to allow for this widening. On this basis, Regional Planning staff are not opposed to a rezoning to permit the dealership. Thorold Stone Road is one of the major traffic corridors in the City. Therefore, high development standards should be encouraged for the proposed dealership, especially with respect to landscaping along the Thorold Stone Road frontage. Enhanced landscaping along the frontage would provide a "visual break" between the asphalt pavement of the road and that of the dealership parking lot. In addition, we presume that a sidewalk will be constructed beside Thorold Stone Road along the landscape buffer. The Regional Public Works Department has provided comments on the preliminary site plan, including the need for a road widening on Thorold Stone Road and landscape requirements within the Regional road allowance. The provisions of the zoning amendment should take into account the landscaping and road widening requirements. In conclusion, Regional Planning staff are not opposed to the adoption of the proposed zoning amendment subject to provisions that recognize the desirability of enhanced landscaping and a road widening. Based on this analysis, approval is recommended. The review of the amendment is summarized as follows: 1. The proposal complies with the policies of the Official Plan. The City's Official Plan designates the property Residential which permits a variety of housing types. Single- detached homes surround the site. The Graham Street Extension plan of subdivision was designed to incorporate the subject land for future lotting at the end of the street. There are several steps necessary in the planning approval and land assembly process in order to complete the cul -de -sac roadway and create the future lots. The City's Committee of Adjustment granted conditional approval on November 1, 2005 to related severance applications (Files B36/2005/NF, B37/2005/NF B38/2005/NF) for various lot additions affecting these lands. The severances address the encroachment of two dwellings over the existing property line and would place the future subdivision land under one ownership. A request to remove Part Lot Control (Report PD- 2005 -101 on tonight's agenda) would allow the creation of small triangular parcels on the abutting lots to the south which will be combined as part of the future subdivision. The proposed layout and size of the lots shown on the concept plan for the future subdivision will be compatible with the neighbourhood. 2. The requested Zoning By -law amendment is appropriate. The existing R1D zoning of the land requires a minimum lot area of 450 square metres (4,844 square feet) and minimum lot frontage of 15 metres (49.2 feet). The requested change to the R1E classification would permit minimum lot sizes of 370 square metres (3,983 square feet) in area and a minimum 12 metres (39.4 feet) in frontage. The preliminary design of the future pie- shaped lots meet the minimum frontage requirement and exceed the lot area provision of the R1 E zone. The zoning amendment is also needed for by -law compliance of the triangular portions of the subject land that are to form part of the reconfigured Lots 9 and 10 in the subdivision to the south. All existing and future subdivision lots on the street would then be within the same R1E zone category. There are no public meeting or notification requirements for plans of condominium under the Planning Act. However, in accordance with City procedures, Staff provided notice of this Council meeting to consider the application to the building owner for distribution to the tenants. The developer has provided information to the tenants regarding the proposed condominium conversion and improvements to the building. The agent also held a meeting with the tenants on October 12, 2005. Agent: The Larocque Group December 5, 2005 2 PD- 2005 -100 Provincial Landlord and Tenant Legislation The Tenant Protection Act (TPA) came into force in 1998. This act replaced several pieces of legislation including the Landlord and Tenant Act, Rent Control Act and Rental Housing Protection Act (RHPA). Previously, condominium conversion applications required an exemption to the RHPA and municipalities could impose conditions to safeguard tenants. The Tenant Protection Act removed this municipal review function, but contains sections to protect existing tenants in cases of condominium conversions. Tenants can continue to rent their units and have the right of first refusal to purchase a converted unit. Municipal Rental Housing Policies The City's Official Plan states that rental accommodation shall be protected and discourages the conversion of rental units to condominium when the vacancy rate is below three (3) percent. Although tenants' rights are protected by the Provincial TPA, the principle remains that removal of rental units should not adversely affect the supply of affordable rental housing in the municipality. The most current vacancy rate information available from Canada Mortgage and Housing Corporation (CMHC) is from the survey conducted in October 2004 (the 2005 survey information has not been released). The data indicates a vacancy rate of 3.7% for all surveyed apartment units in Niagara Falls. Based on the composition of the apartment building (1 unit bachelor, 26 units 1 bedroom, 45 units 2 bedroom and 8 units 3 bedroom) the weighted average of the vacancy rates is 3.9% utilizing City -wide figures. Relatively low mortgage rates will continue to encourage many tenants to enter the home ownership market which in turn opens up rental apartment units for occupancy. Although it is desirable to maintain existing rental accommodation, the removal of these units should not have an adverse impact on the City's overall rental housing supply. The applicant estimates that selling price ranges for the proposed condominium units will be approximately $75,000 to $85,000 (1- bedroom), $89,000 to $110,000 (2- bedroom) and $115,000 to $125,000 (3- bedroom). These prices for the condominium units would provide additional affordable housing options in the City. Regional Rental Housing Policies The Region's Policy Plan states that Regional Council will not support the conversion of rental housing to condominium ownership if the supply of affordable rental housing will be adversely affected a vacancy rate of three (3) percent or more is considered desirable for a healthy rental market. Regional Planning staff note that throughout the major urban centres of Niagara the vacancy rate is 2.6% for all apartment units which is below the desired threshold. It is acknowledged that the total apartment vacancy rate is 3.7% in Niagara Falls which is the highest in the Region. Regional Planning is satisfied that the proposed conversion should not have a significant impact on apartment vacancy rates in Niagara Falls. Site Assessment This apartment was constructed in 1973 in compliance with Zoning By -law provisions in place at that time and an approved site plan. The condominium conversion process provides the opportunity to achieve site improvements with respect to current development standards. The property is zoned Residential Apartment 5C Density (R5C) through Zoning By -law No. 79 -200. The submitted plans indicate 107 parking spaces and a landscaped area of 37.1% of the apartment site. These figures are December 5, 2005 3 PD- 2005 -100 slightly below the current zoning standards of 112 parking spaces and 40% landscaping. The abutting apartment (6390 Huggins Street) was approved by Council for condominium conversion with conditions in 1995. These same zoning deficiencies for this abutting apartment were addressed through variance approvals in June 2005 and such approval should also be required for this site to formally recognize the existing development. In addition to the exterior building renovations undertaken thus far by the owner and planned landscaping enhancements, closed -board fencing is required along the west and south property boundaries. This is a typical site plan requirement and was indicated (but not built) on the original site plan at the west limit of the land. Consent approval was granted in 1996 for reciprocal access rights over the shared cul -de -sac driveway between the two apartments. The designation of a fire access route along the main driveway may be required. This development is not within a registered plan of subdivision and the City has no record of any parkland dedication of payment. Therefore, cash -in -lieu of parkland dedication is requested as permitted by the Planning Act. CONCLUSION: The proposed conversion of the existing apartment to condominium ownership can be supported. The rights of the current tenants will be safeguarded through the requirements of the Tenant Protection Act. The condominium will provide additional affordable priced units to the housing market. L2R -3E4 To Niagara Regional Council: As a citizen concerned deeply for more role models of leadership in the protection of the environment, I am requesting permission to speak to Niagara Regional Council at your November 24, 2005 meeting, to rename Thorold Stone Road as Peter Grandoni Boulevard. Doing this simple action would be one of the best steps that Niagara Regional Council could take to illustrate to the general public the importance of working to protect our planet's ecology at a time when our vulnerability to the powers of nature becomes ever more apparent. Although a historian and heritage conservationist, I am aware that some changes are important to help us deal better with new realities. This is especially the situation regarding the naming of Thorold Stone Road. In the 19t century, stone roads were unusual highways, meant to distinguish these better paved avenues from rougher, frequently wooden planked corduroy roads. Today, Thorold Stone Road is not a stone road as it was in the 19t century, but an important east -west boulevard, a major element of our regional road network. Road names do change over time. Niagara on the Lake recently made a name change in honour of World War Two veterans. Frequently road changes are necessitated by changes to municipal boundaries. Road naive changes are also made to honour distinguished citizens, who by considerable voluntary service have improved lives It is also reasonable to have name changes when their original name can be so dated from its original purpose as to cause confusion, such as Cement Plant road in Port Colborne. It is now lacking such an industry and actually travels largely through parkland. 2 Thorold Stone Road runs through the heart of the area which Peter Grandoni lived on all his life and strove to pass on to the next generation as ecologically intact as he was born into it. He took no vacations away from this land that he loved so much and put much of his personal income toward efforts to protect it. He went to enormous effort to understand the history of this land, going back to the Battle of Beaverdams, when, when this area was composed of predominately Beechwood forests, the Mohawk Indians defeated invading American armies in the War of 1812. Like the ancient Mohawk warriors, Peter Grandoni had an intense knowledge of the land that began in his early childhood. In a successful submission made to stop a Shriners Creek channelization project, which threatened the Lampman loyalist family cemetery, he gave some indication of his youth. He pleaded that, "Rural children make use of the creek for recreation just as it is, in its natural state. They hike and play along the wooded areas, observing wildlife tracks, birds and nests. They toboggan and sleigh on the hillsides and skate on its pond." In his early efforts to protect Shriners' Creek Peter Grandoni was critical in securing the establishment of the 78 acre Shriners Creek Conservation Area largely a Carolinian forest of native beech, white ash, red oak and American elm. He subsequently played a major role in the removal of 320 acres from the urban boundary of Niagara Falls, after the Ontario Municipal Board accepted his arguments that development here was "offensive to good planning principles." Another achievement was to protect five areas of forest in the Mount Carmel area as the Shriners Creek Park currently maintained by the City of Niagara Falls. It is an impressive eco -park, linked with protected valley lands, with only a few intruding trails and without 3 intensive facilities with negative environmental impacts. It is astonishing to consider the range of initiatives that Peter Grandoni took up to protect the environment. One was that sump pumps be required in new subdivisions, to encourage ground water to percolate into the soil to contribute to groundwater. Another was that the streams in north western Niagara Falls be protected according to Hurricane Hazel standard of flood protection, with regulated fill lines. Two years ago he successfully defended the controversial proposals of the Niagara Peninsula Conservation Authority for the protection of valley lands. Peter Grandoni pioneered in the enforcement of the Niagara Region's tree by -law. These regulations, although stretching back to 1956 in Welland County when passed with the help of Mel Swart, only began to have meaning when he reported suspicious cutting on a golf course. His efforts to protect the Garner Road Forest, are now being recognized by the Niagara Region in its efforts to protect this refuge for three significant rare tree species in an upcoming hearing before the Ontario Municipal Board. One of Peter Grandoni's most important efforts was to protect the rural countryside from illegal dumping, which is poorly documented because of the lack of effort of those concerned about such activities to file reports. In their report, DPD 2213, the Niagara Regional Planning Department commended Peter Grandoni's efforts to protect Beaverdams Creek. They noted that, "only the problems of the western portion of the City of Niagara Falls were documented, thanks mostly to the assistance of Mr. Grandoni. This documentation is now being used by Niagara's planners to draft effective landscape protection by -laws. Having a prominent boulevard named after Peter Grandoni will serve to foster a good 4 role model for citizens. These are desperately needed to help us respond positively to the daunting problems of climate change and the threat to the shrinking bio- diversity of the planet. Obviously, Peter Grandoni was a staunch environmentalist and his tireless support of environmental preservation is to be respected and admired; however, it would be inappropriate to rename Thorold Stone Road for historical and practical purposes. The City has a policy for the naming (and re- naming of streets). Item 8 indicates that when a Street is to be re- named, the number of people to be affected will be an important factor. Names should also give recognition to significant historical events, persons or uses in the area. City Historian Sherman Zavitz reports the following regarding the name Thorold Stone Road: I don't have a year, but certainly the name has been around a long, long time. It was one of the early roads in this area to be stoned and, since it went from Niagara Falls to Thorold, the choice of a name seemed obvious. Although the name does not connote an historical event, the name Thorold Stone Road clearly identifies the historical origin of the roadway Although the Grandoni's were involved in issues surrounding Shriner's Creek, they have more of a connection to garner Road, where their family farm is located. People /Businesses Affected There are over 300 municipal addresses on Thorold Stone Road. As Council is aware, the road is primarily commercial; however, there is a cluster of residences west of Montrose Road. When a street name change is proposed in Niagara Falls, an advertisement is usually posted in the paper. It has been the municipality's experience that the more municipal addresses, the more likelihood of opposition. This opposition is understandable because it becomes the responsibility of the resident or business owner to get all of their personal records changed, at their own expense, when the street name change takes place (i.e., new driver's licences, Provincial business licences etc.). CONCLUSION: Staff can safely assume that there would be substantial opposition to the name change of such a large street; therefore, due to the amount of affected parties and the historical significance, it would be inappropriate to support the re- naming of Thorold Stone Road. If Council wishes to recognize Peter Grandoni, his name could be added to the list of possible names for streets or parks; however, Council should realize that the list is long and street names are traditionally decided upon by the developer of the subdivision. In summary, their proposal consisted of the following: to cover the cost of an appraisal for Glenview Park; to purchase Glenview Neighbourhood Park which is adjacent to their development at the appraised market value; to develop at their expense, a new Neighbourhood Park on 5 acres of City owned property on Buttery Street with the following recreational amenities: toddler and youth play structures, basketball court, benches and tables, asphalt pathways, grass play area and landscaping; to continue to sponsor the new Buttery Street Park by continuing to provide new /improved recreational amenities on an annual basis; to have City Staff maintain the new park site; Working Together to Serve Our Community Municipal Works Fire Services Parks, Recreation Culture Business Development Building By -Law Services December 5, 2005 2 R- 2005 -39 to develop an outdoor, irregularly shaped, refrigerated family skating rink the size of three of our arena surfaces on the Glenview Neighbourhood Park location. Following a brief discussion on their proposal, Members of Council felt that the proposal had merit and directed that staff host a public meeting with the residents in the Glenview Neighbourhood Park community in order to obtain their input. The public meeting was held on Tuesday, June 28, 2005, at the Victoria Branch Public Library. Approximately forty residents (40) were in attendance. The representatives of Ripley's made their presentation to those in attendance and then the community was provided an opportunity to ask questions and provide comments. The majority of speakers were opposed to the proposal and only three (3) favourable comments were heard. In summary, the comments expressed are listed below along with a staff response. The current location of Glenview Park is enjoyed by a number of residents because they can view their children/grandchildren playing in the park from their home. This opportunity would be lost with the proposed park location which would be located a few blocks away. Our Neighbourhood Park Standard is to provide a park within 500 m., and the new park site would meet this criterion. The original owners had stated that additional land, specifically the park would not be required for this development. Ripley's purchased the development from the Great Wolf Lodge and was not aware that any promises were made to the City or the community, by the previous owner, that the park would not be considered for any type of future development. The new proposed park site on Buttery Street was not considered a safe location for a park. There are a number of abandoned industrial sites, it abuts an active railroad line, and the area lacks sidewalks. There are existing parks located adjacent to industry and active railway lines. For reasons of safety, these parks are fenced and staff is not aware of any problems with their location. The new proposed park would also be suitably fenced. Currently, the City is conducting a city -wide Brownfield CIP. Potential will then exist for the private sector investors to redevelop the district in partnership with other government partners once the plan is approved by the Province and incentives are in place. Sidewalks would be included as part of the redevelopment plans. Residents commented on how they originally had fought for the park and therefore have a close attachment to the site. Again, their park would be replaced and it would be slightly larger in size and provide new recreation amenities. Further, this proposal would allow for the development of a larger outdoor skating area which would have benefit to all City residents. The skating area was not viewed as a community facility because it would be too expensive. The representative from Ripley's advised that their current facilities on Clifton Hill offer access to area residents during certain times of the year on a free of charge basis. This would also occur with the ice rink December 5, 2005 3 R- 2005 -39 CONCLUSION: In summary, Ripley's is prepared to pay the City for the existing parkland, develop at their expense, a new park site and also develop a large outdoor skating area which will benefit the entire community. From the comments made at the public meeting, it appears that a number of the residents are resistant to change. The 2006 extension inclu des a 3% increase from their 2005 contract rates and a 1% increase to their administration fees. In 2000, the Request for Proposal process was initiated, whereby, the Canadian Corps of Commissionaires was the successful bidders. Council approved a three -year contract with the Hamilton Office of the Corps. In 2003, 2004 and 2005, Council approved one year extensions to this agreement. Over the past six years, the Hamilton Office has maintained high standards and a consistent turn out of Officers. The Corps also provides customer service training sessions for its Officers and will continue to do so on an ongoing basis. The Canadian Corps of Commissionaires provides parking control services staff, building security staff as well as crossing guard coordination (Corporal position) for the City of Niagara Falls. The City of Niagara Falls in conjunction with the Regional Municipality of Niagara, the Ontario Great Lakes Renewal Foundation and Ryerson University are conducting a study of innovative methods for the treatment of sewer overflows in Niagara Falls at the newly constructed City of Niagara Falls Pilot High Rate Treatment Site. The City's total contribution to this project is approximately 350,000. The site, shown below, is now fully operational and is undergoing testing. Additional results will become available through testing of overflow events in the spring and summer of 2006. R.V. The Young Family Endowment Fund Award was initiated in 1997 by the Niagara Falls Arts Culture Committee. Mr Allister Young donated a 1929 Ford roadster to the Committee and the funds realized from a raffle on the roadster were placed in a trust fund named, The Young Family Endowment Fund. The interest is used for an awards program that assists individuals and organizations in artistic and cultural initiatives. Over the past two years, the Arts Culture Committee have taken on additional fundraisers, specifically a "Niagara Falls Tapestry" Christmas CD in 2003 and a "Spirit of the Falls" CD in 2005. Previous to that, the now defunct Niagara Falls Dance Council also donated funds to the Arts Culture Committee in 2002. The funds realized from these three sources are in Special Purpose Reserve #83. DATED this 23nd day of November, 2005 BETWEEN: BOYS' GIRLS' CLUB OF NIAGARA (hereinafter collectively called the "Owner") and THE CORPORATION OF THE CITY OF NIAGARA FALLS (hereinafter called the "City") OF THE SECOND PART WHEREAS the Owner is the sole registered owner in fee simple of the Lands; AND WHEREAS the Lands include significant natural features containing a Provincially Significant Wetland, which natural features the Owner and the City have agreed to protect, conserve and manage in a sustainable manner; AND WHEREAS the Owner has agreed to grant to the City an easement and to enter into positive, negative and restrictive covenants in respect of the Lands (collectively, the "Conservation Easement in order to effect the conservation, maintenance and restoration of the natural features located on the Lands; AND WHEREAS this Agreement is entered into pursuant to the Conservation Land Act, R.S.O. 1990 Chapter c. 28, as amended; NOW THEREFORE in consideration of the sum of TWO ($2.00) DOLLARS and other good and valuable consideration, the receipt of and sufficiency of which is hereby acknowledged, the Owner does hereby grant and convey to the City, its successors and assigns, a Conservation Easement as hereinafter set out on and over the Lands in perpetuity, which shall run with the Lands and any and all parts thereof. ARTICLE 1— DEFINITIONS OF THE FIRST PART 1. For the purposes of this Agreement, the following words and phrases shall have the following meanings: 1.1 "Agreement" or "this Agreement" means this Agreement and the schedules attached hereto as at the date hereofand as amended from time to time. 1.2 "City" means The Corporation of the City of Niagara Falls. 1.3 "Conservation Body" means a conservation body as defined in the Conservation Land Act. 1.4 "Covenants" mean the covenants set out in Article 4. 1.5 "Easement" means the easement described in Article 5. 1.6 "Lands" means the lands of the Owner containing a Provincially Significant Wetland situate in the City of Niagara Falls, in the Regional Municipality of Niagara, Province of Ontario as described in Schedule "A" attached hereto. ARTICLE 2 PURPOSE 2 1.7 "Owner" means the above named party of the First Part and any person who at any time after registration of this Agreement becomes the registered owner of the Lands or any part thereof or any ownership interest therein, including being a trustee for any beneficial owner of the lands. 1.8 "Provincially Significant Wetland" or "PSW" means a wetland identified as provincially significant by the Ontario Ministry of Natural Resources using evaluation procedures established by the Province of Ontario. 1.9 "Region" means The Regional Municipality of Niagara. 1.10 "Wetland" means lands that are seasonally or permanently covered by shallow water, as well as lands where the water table is close to or at the surface. 2. It is the purpose of this Agreement to ensure that the Lands will be retained in their natural state and managed as to prevent any use of the Lands or activities that will impair or interfere with the significant natural features and functions located on the Lands. ARTICLE 3 REPRESENTATIONS AND WARRANTIES 3.1 The Owner covenants and warrants that the Owner is the legal, beneficial and registered owner of the lands with good title thereto. 3.2 At the Owner's expense, the Owner shall procure and provide to the City any postponement agreements which the City's solicitor considers necessary, acting reasonably, to ensure that this Agreement and any amending agreements thereto shall have priority over all other interest in the Lands. ARTICLE 4 COVENANTS 4.1 In order to provide for the conservation, maintenance and any required remediation of the Lands, the Owner agrees that it shall not undertake, cause or permit any activity, development, construction, placement of buildings or structures, alteration, grading, tree cutting or removal, clearing, grass cutting, planting, filling or removal of earth or stone or dumping of refuse on or within the Lands. 4.2 In the event of breach of or default in the obligations and covenants of the Owner pursuant to the provisions of Article 4.1, the City acting reasonably, may take any action available to it at law, in equity, by statute or under this Agreement provided that the City (unless in the opinion of the City ,because of the nature of the default or other circumstances it is not feasible to delay the notice period) shall first give to the Owner written notice of the default, which notice shall specify the nature of the non compliance and the measures necessary to secure compliance with the terms of this Agreement. The Owner shall have thirty days following receipt of the notice of default to complete the required measures and to rectify the non compliance or default. In the event that the Owner has failed to provide compliance within the thirty day period allowed, the City shall be entitled to enter on to the Lands, in accordance with Article 5.2, to the minimum extent necessary to take those measures reasonably necessary to provide compliance and to remedy the default at the expense of the Owner. Until paid to the City by the Owner, the costs of such remedy incurred by the City shall be a debt owed by the Owner to the City and shall be a charge upon the lands. (b) (b) ARTICLE 7 GENERAL PROVISIONS ARTICLE 5 EASEMENT 3 5.1 The City's employees, agents and contractors, and its or their supplies, equipment, materials, machinery and vehicles, may enter on and have access to the Lands as set out in this Agreement at reasonable times and subject to the notice requirements specified below for the following purposes: (a) inspection, in order to (i) monitor the Lands, (ii) determine compliance with this Agreement; and (iii) determine those measures necessary to ensure compliance with the covenants of this Agreement; and to carry out any measures reasonably required pursuant to section 4.2 of this Agreement. 5.2 Prior to entry or access to the Lands for the purposes identified in Articles 4.2 and 5.1, and in the absence of any mutual agreement otherwise, the City shall provide written notice to the Owner as follows: (a) for the purposes specified in paragraph 5.1(a) at least twenty-four (24) hours prior written notice; and for the purposes specified in paragraph 5.1(b) at least 10 days prior written notice. The notice under this sub paragraph (b) shall describe the nature, scope, design, location, timetable and any other material aspect of the activity proposed. 5.3 Despite anything in this Agreement, the City's employees, agents and contractors may enter on to the Lands without notice at any time in the event that the City determines that there may be an actual or imminent contravention of any part of this Agreement. 5.4 No right of access by the general public to any portion of the Lands is, or is intended to be, conveyed by this Agreement. Box 1023 Niagara Falls, ON L2E 6X5 To the Owner at: Boys' Girls' Club of Niagara 6681 Culp Street Niagara Falls, ON L2G 2C5 7.1 The Owner reserves to itself, and to its successors and assigns, and any Transferee therefrom, all rights accruing from its ownership of the Lands, including the right to engage in, or permit or invite others to engage in, all uses of the Lands that are not expressly prohibited or inconsistent with the terms of this Agreement. 7.2 Nothing contained herein shall be construed to entitle the City or its successors or assigns to bring any action against the Owner, its successors or assigns, or any transferees therefrom, for any injury to or change in the Lands resulting from causes beyond the reasonable control of the Owner or its successors or assigns, or transferees therefrom, including, without 4 limitations, fire, flood and storm, or from any prudent action taken by the Owner under emergency conditions to prevent, abate, or mitigate significant injury to the Lands or to lands abutting thereto resulting from such causes. 7.3 Assignment: The City may unilaterally assign all of its interest in this Agreement to a Conservation Body provided that the City shall provide the Owner with written notice of such assignment. The City shall not be liable to the Owner for any breach or default in the obligations owed to the Owner under this agreement committed after notice of the assignment of this Agreement has been given to the Owner. 7.4 Registration: The City shall register this Agreement and any amending agreements thereto against title to the Lands and the Owner shall execute any document that may be required to allow such registration, all at the Owner's expense. 7.5 Failure to Exercise or Enforce Rights: No failure by the City to require performance by the Owner of any provision of this Agreement shall affect the right of the City thereafter to enforce such obligation and no failure by the Owner to perform any of its rights or obligations hereunder shall be taken as a waiver of such performance or the performance of any other obligation in the future. 7.6 Time of the Essence: Time shall be of the essence of this Agreement and shall be deemed to remain so notwithstanding any extension of any time limit. 7.7 Severabilitv: All provisions of this Agreement including each of the Covenants shall be severable and should any be declared invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected thereby. 7.8 Waiver: The City may in its discretion waive any of the Covenants in whole or in part, but any such waiver shall not prejudice the validity of the other Covenants. 7.9 Joint and Several: Whenever the Owner should be comprised of more than one person, the obligations thereof hereunder shall be joint and several. 7.10 Enurement: The Easement and the Covenants shall be enforceable against the Owner of the Lands and any and all subsequent owners of the Lands and shall run with the Lands in perpetuity or until such time as the City, or its successor or assign, authorizes a release of such restrictions. 7.11 Indemnity: The City and the Owner shall each indemnify and hold harmless the other against any claims arising out of their respective negligent acts or omissions.
