Request to hold fireworks display FX WORX INC requests permission to hold the
annual fireworks display from the Skylon Tower on New Year's Eve.
Background: City By -law 70 -86 stipulates that no person shall within the City of Niagara
Falls set off fireworks unless specifically authorized to do so by City Council.
It should be noted that FX WORX has done the New Year's Eve fireworks for many years.
Recommendation: For the approval of Council.

Request to have an event with liquor at the MacBain Community Centre- for January
7, 2006 event.
Background: Council approved a new Municipal Alcohol Risk Management Policy on
February 14, 2005. The policy sets out which municipal facilities will allow liquor (with a
proper special occasions permit from the Alcohol Gaming Commission of Ontario
(A.G.C.O.)).
The MacBain Community Centre was not listed as one of the municipality facilities to allow
liquor. Nonetheless, an exception was made for the grand opening of the facility. (Council
also approved an exception for the Girls Home for Soccer for the Serbian soccer
tournament)
Staff believe that there may be future requests for use of the MacBain Community Centre
for various special events. As a result, staff will come back in the new year with an
amendment to the policy. In the interim, Council will have to decide whether to allow an
event with liquor to happen at the MacBain Centre on a case by case basis.
Recommendation: That Council give approval for this one off event and that staff come
back in the new year with an amendment to the Municipal Alcohol Risk Management Policy

Further to our conversation, please find attached:
a) Correspondence dated November 22, 2005 initiated by Chris Cristelli intended to
introduce the community to this tournament/fundraiser and /or create an awareness
that it will occur yet again in 2006.
b) Correspondence dated November 30, 2005 generated by Ted McDonnell attesting to
awareness and support of this annual event.
c) email dated December 7 generated by Ted McDonnell advising of approval problem
related to LCBO special occasion permit application for this event.
d) Application for a Special Occasion Permit dated November 28, 2005.
As discussed, this tournament/fundraiser will take place even if there is no approval.
Historically, no permit was required in the Fourth Avenue facility and nourishment and
beer were served in a hospitality room the event proposed this year is identical in this
respect. Limited amounts of beer in a restricted area for restricted hours during the
day.

Niagara Falls Community Policing Re: Graffiti- That Council consider adopting an anti

Background: Attached is a letter from Linda Page, Chairperson of Niagara Falls
Community Policing indicating that graffiti is a growing concern in the community. Her
group is requesting that the City adopt an anti graffiti by -law similar to one in Toronto.
A letter from the Mayor's Youth Advisory Committee indicates that the committee does not
support graffiti at the Skate Park and that they support whatever action is necessary to
remove it.
Recommendation: That the matter be referred to staff.

On behalf of the Niagara Falls Community Policing Committee we would like to inform
you of a growing concern within our community that we have identified as a problem,
namely the increase of graffiti throughout the community.
It is our collective opinion that the best policy is one of ZERO TOLERANCE"
We respectfully request that council consider adopting a anti graffiti by -law comparable
to that of the City of Toronto to help address this growing problem. Many other cities
throughout Canada are adopting by -laws to address these concerns as well.
Our committee, along with dozens of concerned business owners and other community
groups, are fully prepared to participate in the process to implement this new by -law.
We look forward to your favourable response to our proposal.

Re: Graffiti Issue

The Mayor's Youth Advisory Committee have been asked to advise City Staff of their opinion on
graffiti at the Skate Park and whether the City should host a graffiti contest or whether the City should
provide graffiti boards for the youth.
In order to make an informed decision, Constable Joanne Carter of the Niagara Regional Police Service,
was invited to attend the Mayor's Youth Advisory Committee meeting on December 7, 2005.
Constable Joanne Carter is recognized as the "Police Expert" on graffiti. Last year, the NRPS received
a Provincial Award on their success in dealing with graffiti in the Niagara Region. In the presentation,
the NRPS were in support of a zero tolerance approach to graffiti and they strongly support the
execution of Municipal and Regional By -laws as a means to deal with the control of graffiti.
After the presentation and discussion, The Mayor's Youth Advisory Committee decided they are not
in favour of any graffiti contest, or art boards and recommend that the graffiti should be removed from
the Skate Park. The following motion was made by the Mayor's Youth Advisory Committee:
"Mayor's Youth Advisory Committee do not support graffiti at the Skate Park and that they
support whatever action is necessary to remove it

Appointments to the Niagara Transit Commission
RECOMMENDATION:
That Council vote on the slate of applicants to serve the Niagara Transit Commission.
BACKGROUND:
An Act Respecting the City of Niagara Falls sets out the composition of the Transit Commission as
follows:
(1) The Commission is a body corporate and shall consist of five members, as follows:
1. The mayor of the City, during his term of office.
2. Four members appointed by the council of the City, two of whom shall be appointed each
year for a term of two years.
As a result of the above, Council must fill two (2), two year vacancies. It should be noted that all
other appointments made by Council are now made in conjunction with the term of Council.
Voting will be done by secret ballot. Each Council member will be allowed to vote for two (2)
candidates. The two candidates receiving the highest vote totals will be appointed to the two -year
terms. In the event of a tie, a run -off vote(s) may be necessary. Pre printed ballots will be available
to assist in the process.

RECOMMENDATION:
That Brian Smylski be appointed to the vacancy on the Arts Culture Committee.
BACKGROUND:
As the attached letter indicates, Jane Embleton has resigned from the Arts Culture Committee and
Brian Smylski has indicated an interest in becoming a member of this Committee.
In May 2004, Council approved the "Council Appointments Document Among the many
recommendations in the report was the following: that the Arts Culture Committee (and the
Recreation and Trails Bikeway Committee) have between 8 to 12 members. If a member resigns
during the term, they will not be replaced unless the Committee's minimum drops below eight (8)
members. Part of the rationale for this recommendation was so that it would not be necessary to
advertise and hold elections for the filling of single vacancies during the term of the Committee.
Despite the above, staff is recommending that Brian Smylski be appointed to the Arts Culture
Committee. In 2004, all applicants to the Arts Culture Committee were appointed, therefore, no
one who was interested in the Committee is being denied a place, the Committee has endorsed Mr.
Smylski's appointment and there is no need to advertise the vacancy.

construction of storm sewers, watermain and road reconstruction on Park Street from Ontario Avenue

The construction of this storm sewer will provide the storm outlet that is required for the Bridge Street

It is recommended that Council receive for information the attached Municipal Heritage Committee's
Work Program for 2006.
BACKGROUND:
As part of the Municipal Heritage Committee's responsibilities in the Committee's Terms of
Reference, an annual work program is to be established. The 2006 Work Program was developed in
keeping with the recently received Heritage Master Plan.
The work program consists of ten objectives which will prioritize the work to be completed by the
Committee over the next year.
The Municipal Heritage Committee passed a motion to adopt a 2006 Work Program as attached for
Council's approval.
CONCLUSION:
The Committee is seeking the concurrence of City Council on this matter.

Re: MW- 2005 -147 Boyers Creek Drain Extension of Works
Under the Drainage Act
In accordance with the Drainage Act and the City's Consultant Policy, it is recommended that the
City Council:
1. Accept a petition that will be forthcoming from the Town of Fort Erie to extend the scope
of work previously approved by Council.
2. Amend the Consulting Services Agreement with Wiebe Engineering Group Inc. in Welland,
Ontario to include the extended scope of works for the estimated cost of $4,500.00 including
GST.
During the public consultation process, a landowner in the Town of Fort Erie requested an extension
to the scope of work to ensure he would receive direct benefit to relieve a current flooding problem
he is experiencing on his property. In accordance with the Drainage Act, this landowner has
petitioned the Town of Fort Erie for the inclusion of these works in the Boyers Creek Drain Project.
The Town of Fort Erie has given notice that they will be acknowledging receipt of the petition at
their December 12, 2005 meeting and forwarding it onto the City for consideration.
In order to keep the project progressing within the time lines as set out in the Consultant Servicing
Agreement, staff is recommending the extension of these works as petitioned in accordance with the
Drainage Act. Since these works were not included in the scope of work for this project, the
Consultant Services with Wiebe Engineering Group Inc. shall be amended to include these works.
Working Together to Serve Our Community
Municipal Works Fire Services Parks, Recreation Culture Business Development Building By -Law Services

The additional costs for these works will be assessed back to those benefitting landowners.
Funding for the engineering costs of this project is allocated in the Rural Road Drainage
Improvement Account #12 -3- 31000 030000 -R2.

A by -law to authorize the execution of a Subdivision Agreement with Ascot Woods Ltd. respecting
Ascot Woods Extension 7 Subdivision.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. A Subdivision Agreement dated the 14 day of April, 2005 and made between Ascot Woods
Ltd. and The Corporation of the City of Niagara Falls with respect to the lands comprised of Parcel
105 -1 Section 59 Stamford; Part Township Lot 116 Stamford; Part Township Lot 123 Stamford
being Part 4 on 59R -9389, in the City of Niagara Falls, in the Regional Municipality of Niagara
subject to the terms and conditions as described in the Subdivision Agreement, an excerpt of the first
page attached as Appendix "1" and shown on the proposed Plan of Subdivision attached as
Appendix "2" and providing for the payment by the Subdivider of Municipal Works Items as
described in Schedule "C a copy of which Schedule is attached as Appendix "3" and further
providing for the costs of development charges as described in Schedule "F" attached as Appendix
"4" is hereby approved and authorized.
2. The acquisition by and acceptance of a conveyance or conveyances to The Corporation of
the City of Niagara Falls of all required reserve blocks shown on the Plan of Subdivision and all
required road widenings, easements and park lands described in Schedules "G" and "H copies of
which Schedules are attached as Appendices "5" and "6" are hereby approved and authorized.
3. The Mayor and Clerk are hereby authorized to execute the said Subdivision Agreement,
grants to The Corporation of the City of Niagara Falls of any easement required by it and such other
conveyances, agreements and documents which the City Solicitor deems necessary to carry out the
intent of this by -law and the said Subdivision Agreement and to permit registration of the proposed
Plan of Development, and the Clerk is hereby authorized to affix the corporate seal thereto and to
deliver the said Subdivision Agreement, grants of easements, conveyances and other agreements and
documents.

Plan") attached hereto as Schedule "A" and entitled ASCOT WOODS EXTENSION 7
SUBDIVISION, being lands comprising Parcel 105 -1 Section 59- Stamford; Part Township Lot 116
Stamford; Part Township Lot 123 Stamford Part 4 on 59R -9389, now in the City of Niagara Falls,
and more particularly described in Schedule "B" attached hereto, hereinafter called "the lands";
AND WHEREAS in accordance with the conditions imposed by The Regional Municipality of
Niagara, the City requires the Subdivider to enter into this agreement;
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the City

By -law No. 2005-
A By -law to amend and consolidate By -law No. 6661 -1964 and subsequent amendments thereto with
respect to signs in the City of Niagara Falls with a view to enacting a new Sign By -law in 2006.
WHEREAS the Council of The Corporation of the City of Niagara Falls desires to enact a new Sign
By -law;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls desires to engage in
consultation with the public and the sign industry prior to enacting the new Sign By -law in final
form;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls desires to ensure an
orderly transition from the current by -law to the new one;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls desires to use all of
the legislative authority granted to it by the Government of the Province of Ontario;
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. Section 1 of By -law No. 6661, as amended, is amended by adding the following definitions:
"Billboard" means an outdoor sign erected and maintained by a person, company, or business
engaged in the sale or rental of the space on the sign to a clientele which sign is used to
advertise goods, products, services or facilities not available on the property where the sign
is located.
"Official Population" means the total number of residents of the City of Niagara Falls as
determined by the most recent population census completed by the Government of Canada
2. Section 4 of By -law No. 6661, 1964 is amended by adding the following subsections 4(c),
4 (d) and 4(e):
4.(c) Notwithstanding anything contained in this By -law:
No permit to locate, erect or place a temporary sign shall permit the subject
sign to be located for a period of greater than 30 consecutive days.
(ii) No person shall be entitled to more than three permits for a temporary sign
in any calendar year.
(iii) No person may apply for a permit for a temporary sign within 20 days of the
date of the expiration of the last permit for a temporary sign issued to that
person.
4.(d) No permit for a roof sign shall be issued for any premises located outside of the
Clifton Hill District as illustrated in the attached Schedule "C" to this By -law.
4.(e) Notwithstanding anything contained in the By -law, the maximum number of
billboards located in the City ofNiagara Falls shall not exceed the official population
of the City divided by 625 and no permit shall be issued to permit the erection,
display or installation of a billboard that would cause the total number of billboards
in Niagara Falls to exceed this number.
3. This By -law shall cease to have force and effect on June 30, 2006 unless extended by the
Council of The Corporation of the City of Niagara Falls prior to that date.

A by law to adopt, ratify and confirm the actions of City Council at its meeting held on the 12 day
of December, 2005.
WHEREAS it is deemed desirable and expedient that the actions and proceedings of Council as
herein set forth be adopted, ratified and confirmed by by -law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. The actions of the Council at its meeting held on the 12 day of December, 2005 including
all motions, resolutions and other actions taken by the Council at its said meeting, are hereby
adopted, ratified and confirmed as if they were expressly embodied in this by -law, except
where the prior approval of the Ontario Municipal Board or other authority is by law required
or any action required by law to be taken by resolution.
2. Where no individual by -law has been or is passed with respect to the taking of any action
authorized in or with respect to the exercise of any powers by the Council, then this by -law
shall be deemed for all purposes to be the by -law required for approving, authorizing and
taking of any action authorized therein or thereby, or required for the exercise of any powers
thereon by the Council.
3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls are hereby
authorized and directed to do all things necessary to give effect to the said actions of the
Council or to obtain approvals where required, and, except where otherwise provided, the
Mayor and the Clerk are hereby authorized and directed to execute all documents arising
therefrom and necessary on behalf of the Corporation of the City of Niagara Falls and to affix
thereto the corporate seal of the Corporation of the City of Niagara Falls.
