a) MW-2006-48 - Leeming Street Parking Review
Mr. Hutton of 6384 Leeming Street advised Committee that the City is penalizing the residents
that live on Leeming Street by restricting parking on the south side of Leeming Street. Mr.
Hutton recommended trying permit parking and ticketing the students from Stamford Collegiate
who use the street for parking. Mr. Hutton further questioned why the questionnaire did not
include a by-law or additional information informing the residents of the 60 percentile response.
It was ORDERED on the motion of Alderman Diodati and seconded by Mayor Salci that Parking
Permits be implemented for Leeming Street between Highland A venue and Leonard A venue and
that additional information be provided in future questionnaires that go to residents

b) MW-2006-49 - Fern Avenue Parking Review
Mr. Savage of7340 Fern Avenue advised Committee that he disagrees with the recommendation
made in the report with the exception of a corner restriction on the west side of Fern Avenue
between McLeod Road and a point 20 metres south of McLeod Road.
As the report was passed prior to Mr. Savage's attendance, Committee deferred the report in
order to re-invite a member of Niagara Transit to be present during discussions.
It was ORDERED on the motion of Alderman Morocco and Alderman Campbell that report
MW-2006-49 be deferred to the May 29,2006 Community Services Committee meeting.

c) F-2006-23 - Request for Waiver of Development Fees and Related Charges - Islamic

d) MW-2006-S4 - Directional Signage Review Request - Rainbow Motor Inn
It was ORDERED on the motion of Alderman Pietrangelo and seconded by Alderman Diodati
that staff meet the Rainbow Motor fun, Knights fun and Lincoln Motor Inn to discuss the
directional signage on Murray Street.

e) BBS-2006-03 - Glenview Residents Association Property Standards/By-Iaw
Enforcement
Mr. Marcel LaBlanc, Chair ofthe Glenview Residents Association advised Cornmittee that the
residents are trying to clean up their neighbourhood and have submitted 15 properties to Property
Standards at the City and there at still 13 properties remaining since November 2005. Mr.
LaBlanc passed photos to the Committee members taken May 7,2006 which showed various
properties in the Glenview Area with garbage, buildings in disrepair, tires, etc..
Bob Judge, Manager of By-law Services advised Committee that Property Standards is driven by
a complaint system. When a residents submits a concern staff will investigate and determine if
the property is in violation ofthe Property Standards By-law. Once Mr. Judge reviewed the
photos presented by the Glenview Residents Association Committee was advised that though the
properties are not ascetically pleasing they are not in violation of the current property standards
by-law.

Following a brief question and answer period the following motion was made;
It was ORDERED on the motion of Alderman Campbell and seconded by Alderman Kerrio that
staff prepare a report on stricter standards for the Property Standards By-law and a limit on the
number of cars on private property.

f) CAO-2006-0l - Organizational Review
It was ORDERED on the motion of Mayor Saki and seconded by Alderman Morocco that:
a) Council approve the attached Terms of Reference for an Organization Review for

b) Council authorize staff to hire a consultant to undertake an Organizational Review
for the City of Niagara Falls at a cost not to exceed $100,000.00 plus expenses.

Re: Transit Commission
Guy Ungaro on behalf of Norm Puttick advised Comrnittee that his client was looking for the
following frorn the Transit Commission;
1. Policy Manual
2. Procedural By-law
3. Commission members to retract the resolution made and passed at the last Transit
Commission meeting.
Victor Muratori on by half of the Transit Commission advised Committee that when a person
sits as a Board Member, they act through the Board with a resolution of majority. A Board
Member has the right to make inquires and they are there to represent the public and the public
interest. It does not give the individual Board Member the right to interfere with matters that
pertain to the administration of the Corporation. Wherein the administrative staff answers to the
Commission or Board. Question is of proper protocol in the marrner in which to make a request,
which is the position of the resolution.
The City Clerk advised Committee that the Transit Commission should follow the same process
that Council follows that is a follows;
that Commission members can request information from Senior Staff and if that information is
easily accessible staff will provide it. If the request involves a labour intensive activity then the
Commission member should bring that forward to the Commission and have the Commission
vote on it.

2) a "No Standing" at all times restriction be installed on the east side of Fern Avenue
between Cooper Drive and a point 20 metres north of Cooper Drive; and,
3) a "No Parking" at all times restriction be installed on the east side of Fern Avenue
between a point 40 metres south of McLeod Road to a point 20 metres north of
Cooper Drive; and,
4) a corner restriction be installed on the west side of Fern Avenue between McLeod
Road and a point 20 metres south of McLeod Road.
BACKGROUND:
Staffhas been requested to review Fern A venue between McLeod Road and Cooper Drive, in order
to determine the necessity of installing some type of parking restriction on the roadway in the study
area. The concern at this location stems from a lack of manoeuvring space when vehicles are parked
on both sides ofthe roadway. Also, parked vehicles interfere with the transit stop located on the east
side of Fern Avenue immediately south of McLeod Road.

Currently parking is permitted on both sides of the roadway throughout the study portion of Fern
Avenue between McLeod Road and Cooper Drive. Niagara Falls transit buses traverse along the
roadway to McLeod Road in the northbound direction only. There are two bus stops located within
this area, one being near Cooper Drive, the other just south of McLeod Road. The pavement width
of Fern Avenue is 8 metres, and sidewalks are present on both sides of the road, providing
pedestrians a designated right-of-way for travel. Light standards are present on the west side of the
study roadway providing illumination during evening hours.
Staff has conducted observations on Fern Avenue to determine whether a parking problem exists.
Observations revealed several vehicles parked on both sides of the roadway and some are in close
proximity to the bus stops. As this is a transit route with buses travelling north on Fern Avenue and
turning east on McLeod Road, potential conflicts between motor vehicles and transit vehicles were
observed. Staffwas notified that vehicles parking near the transit stop south of McLeod Road force
buses to proceed around the parked vehicle and encroach into the opposite lane of travel. As Fern
A venue is considered the primary entrance off McLeod Road into the subdivision, it is necessary to
ensure unobstructed movement. Also, at times, buses may be forced to double-park while
loading/unloading passengers. Transit staff identified that the Fern Avenue bus stop south of
McLeod Road also serves as a transfer point with buses waiting occasionally for several minutes.
Observations also revealed that on the study portion of Fern Avenue another transit stop is present
on the east side just north of Cooper Drive. This stop is also in close proximity to the intersection
of Fern Avenue @ Cooper Drive. Similar conflicts between vehicles may be experienced at this
location, however, traffic volumes at this intersection are lower than at McLeod Road.
A collision review of the roadway indicates that two collisions were reported on the study portion
of the roadway, within the past three-year period. Both collisions were single motor vehicle
collisions. No transit vehicles were involved in the reported collisions.
Parking questionnaires were delivered to residents on Fern Avenue between McLeod Road and
Cooper Drive. Through the questionnaire, residents had an opportunity to comment on the type of
parking control that would most benefit their situation. The minimum criterion requires at least 60%
of the residents petitioned to respond to the questionnaire delivered. A total of twenty-one (21)
homes were petitioned, of which eleven (11) or 52% of the questionnaires were returned. Thus, a
60% response rate was not achieved.
Although a consensus was not achieved among the residents as to the preferred parking arrangement
on Fern Avenue, given the narrow road width, the fact that Fern Ave is a transit route with stops
located within the study area and due to it being the main entrance off McLeod Road into the
subdivision, it is recommended that parking be restricted on one side. Thus, an east side restriction
is suggested to accommodate the transit stops.
On portions of the roadway, specifically near the transit stations, it is recommended that "No
Standing" restrictions be installed which will prohibit regular vehicles from parking in these
sections, but will allow transit vehicles access. A corner parking restriction is also recommended
on the west side between McLeod Road and a point just south of McLeod Road. The
implementation of these restrictions will ensure that adequate manoeuvring space is available for
motorists as well as maintenance and emergency vehicles, while still allowing on-street parking on
the west side ofthe road. Furthermore, conflicts between transit buses and motor vehicles will also
be minimized near the intersection of Fern Avenue and McLeod Road allowing unobstructed
movement, and transit vehicles will have an unobstructed area for loading/unloading of passengers.

Street between a point just east of Dorchester Road and Depew Avenue
BACKGROUND:
Following the April3t 2006 Council meeting regarding the re-zoning application of properties
5720 Dorchester Road and 6859 High Street (AM-Ol/2006), staff has been requested to review
the parking situation on High Street. The concern involves motorists visiting establishments on
Lundy's Lane but utilizing on-street parking on High Street.
High Street is a local roadway consisting of two travel lanes, one in each direction. The traffic
volumes on the study section are low as the roadway primarily serves to allow access to the
immediate neighbourhood and the church located on the northeast comer of the intersection of
Dorchester Road at High Street. The width of the roadway is 6.5 metres in the study section.
Currently, parking restrictions are present on the south side of High Street between Dorchester
Road and Depew Avenue. The remainder of the study portions of High Street, between Depew
A venue and Woodland Boulevard, remains unrestricted allowing on-street parking on both sides.

One sidewalk is present on the north side of the roadway for pedestrian use, with a boulevard
separating the sidewalk from the travelled portion of the roadway. There are no curbs present on
either side ofthe roadway in the study area. Light standards located on the south side of High
Street provide illumination during evening hours.
Staff has conducted observations on High Street to determine whether a parking problem exists.
Observations revealed vehicles parked on the north side of the roadway during daytime hours.
These vehicles were parked predominantly between Dorchester Road and Depew Avenue.
Several vehicles were also noted parking on High Street between Depew Avenue and Woodland
Boulevard. A collision review has been conducted on High Street to determine whether a
collision problem exists on both study sections between Dorchester Road and Woodland
Boulevard. The review, conducted for the previous three-year period, reveals that a collision
problem does not exist, as no collisions have been reported on the study sections of High Street
in the previous three-year period.
Separate parking questionnaires were delivered to residents of High Street between Dorchester
Road and Depew Avenue, and between Depew Avenue and Woodland Boulevard. Through the
questionnaire, residents had an opportunity to comment on the type of parking control that would
most benefit their situation. A total of six (6) homes were petitioned on High Street between
Depew Avenue and Woodland Boulevard, of which five (5) or 83% ofthe questionnaires were
returned. Of the five questionnaires three (3) (60%) were returned in favour of restricting the
south side at all times. A total of six (6) homes were petitioned on High Street between
Dorchester Road and Depew Avenue, of which four (4) (67%) were returned. Of the four
questionnaires, two (2) (50%) were in favour of implementing an alternative parking revision.
The revision suggested by residents includes 2-hour maximum parking between Dorchester Road
and Depew Avenue.
* Although a questionnaire was not received from the Church (5720 Dorchester Road) a
representative of the area advised the Church also favours 2-hour maximum parking on the north
side of High Street between Dorchester Road and Depew Avenue.
Based on this information, additional parking revisions on the roadway are recommended. Based
on road width a parking restriction is required on the south side of High Street between Depew
Avenue and Woodland Boulevard. This restriction will ensure vehicles are not parked on both
sides interfering with rnaintenance or emergency vehicles. A corner restriction is recomrnended
on the north side of High Street between Dorchester Road and a point just east of Dorchester
Road, to ensure that vehicles do not park too close to the intersection where they may interfere
with vehicles turning through the intersection. Also, a 2-hour maximum parking restriction is
recommended on the north side of High Street between a point just east of Dorchester Road and
Depew A venue, as per request of the residents, in order to limit the time of motorists who do not
reside in the neighbourhood remain parked on the roadway.

Window Boxes of Chippawa has made a road closure request from 8:00 a.m. to noon, June 10, 2006,
on Laura Secord Place. The organizers advised that they are a nonprofit organization whose aim is the
beautification ofChippawa. They have indicated that this is the sixth year of this competition, with soil,
window boxes and plants donated by a local organization. The competition is to encourage "businesses,
residents, seniors and children to beautifY Chippawa." The group has advised that in previous years, this
event was held on the boulevard in front of the Hasty Market on Main Street. This is the first year in
which staffhas been approached by this group.
Although the event is a worthy cause, past practice and previous requests from other user groups have
not been granted. Staff has concerns that a precedent will be set whereby the City will have to fund
special events by other user groups that do not meet the minimum requirements to hold their events on
municipal property.
The Committee's concurrence with the recommendation outlined in this report would be appreciated.

Part of Laura Secord Place - June 10, 2006
On behalf of the Wmdow Boxes of Chippawa organizing committee, I respectfully request pennission for
a temporary closure, to a portion of Laura Secord Place. This will be the sixth year for Wmdow Boxes ofChippawa.
We are a non profit community group. Our competition encourages businesses, residents, seniors and children to
beautify Chippawa, by planing window boxes. In the past two years, we have held a free planting day for children.
The window boxes, soil and plants are provided, for free, by Chippawa Hasty Mart. The children's planting day has
taken place on the grass boulevard, in front of the Hasty Mart.
We believe the northern end ofLaura Secord place offers an ideal location for our event. Laura Secrod Place
is approximately 190 feet long, running from Bridgewater Street to Main Street (see attached map and photos). It
is not a highly travelled street. Two private residences, Chippawa Hasty Mart, Chippawa Branch Library and a
laneway to stores on Curnmington Square are accessed from the street. Our proposal is to block the street at
Bridgewater Street and on the north side of the lanewayto Curnmington Square,.om 8:00 a.m to 12:00 p.m., on
June 10, 2006. This would pennit continued access to the Hasty Mart, library and laneway, while providing a safe
area for the children. Letters of support, from the two private residences are enclosed.
Our completed Application for Road Use Special Events Pennit is enclosed. You will note that we do not
have insurance coverage. As a nonprofit group, it is simply beyond our means. We would ensure that the road is
clearly blocked and properly patrolled to ensure the safety of participants. I have considerable experience with crowd
control and safety, from my career with the fire department and numerous, large charitable activities.
We would appreciate your decision, as soon as reasonably practicable, as we must prepare our promotional
materia1s. If you are unable to support our request, we would appreciate information regarding an appeal to City
Council. I trust that this information is of assistance to you. If you have any questions concerning the foregoing,

RECOMMENDATION:
That the Landscape Design Technician, a contract position in Parks, Recreation & Culture, be made
a permanent position and added to staff complement.
BACKGROUND:
The Landscape Design Technician position was established in 2004 in order to provide AutoCad and
project site inspection assistance. Prior to the establishment ofthis position, staff relied on outside
consultant companies to provide AutoCad drafting assistance.
Due to the increasing number of capital and community parks projects, the costs for consulting
services (at a much higher hourly rate) were identified as those that were becoming cost-prohibitive.
A cost-effective solution was identified, and put in place to respond to the technical requirements
of division projects, as well as improve the efficiency of park development projects.
The inclusion of this contract position has proven that in comparison to the costs incurred for
consulting firms to complete such work that cost savings have been achieved, and a greater number
of projects could then be completed.
The Landscape Design Technician has also served as technical resource working with many division
staff in the area of graphics production work which is a standard component of many special events
and park development marketing and communications. This additional technical assistance reduces
the dependency on outside companies or consultants in this area, and further provides cost savings
and improved efficiencies from completing the work in-house.

Based on the number of projects anticipated and scheduled for 2006 to 2010, the workload in parks
design and development will continue to expand and the creation of a full-time position is now
warranted. Further, funds to include the position as a full time permanent position will not affect
or increase the 2006 budget for Park, Recreation and Culture.
