Civic Recognition - U14 Racquetball Provincial Champion Carter Kolbuc, resident of Niagara Falls, won the U14 Co -Ed double bounce Category at the Ontario Provincial Championship held in Burlington April 5 to 7. Carter is in his first year of playing racquetball. Todd Bright, Carter's coach, addressed Council recognizing Carter's efforts and achievements. 5.2. Niagara Falls Seniors Advisory Committee Members of the Seniors Advisory Committee requested to make a presentation to City Council about activities during Seniors Month in Niagara Falls. The following members of the Seniors Advisory Committee, Eileen Tinio-Hind, Anna Racine and Ewald Kuczera addressed Council. Flag -Raising and Proclamation Request - The Seniors Advisory Committee is requesting Council to approve a flag -raising ceremony within the first month of June at the Rosberg Flag poles and to proclaim the month of June as "Seniors Month." R&C-2024-06 Seniors Advisory Committee - Seniors Month Moved by Councillor Victor Pietrangelo Seconded by Councillor Wayne Campbell THAT Council PROMOTE Senior's month scheduled for the month of June that will feature a variety of engaging activities and events tailored to our senior communities' interests; AND, THAT Council APPROVE a flag -raising ceremony within the first week of June at the Rosberg Flag poles and PROCLAIM the month of June as "Seniors Month." Mayor's Accessibility Advisory Committee The Mayor's Accessibility Advisory Committee has requested to present a letter for Council's support regarding provincial programs and to promote an upcoming region -wide accessibility workshop they are hosting. Speaking on behalf of the Mayor's Accessibility Advisory Committee will be Committee Chairs: Robert (Bob) Romanuk and Ceilidh Allison Corcoran. Flag -Raising and Proclamation Request - The Mayor's Accessibility Advisory Committee is requesting Council to approve a flag -raising ceremony during National Accessibility Awareness month (end of May/beginning of June) and to proclaim the week of May 26, 2024 - June 1, 2024 as "National Accessibility Page 3 of 17 Week." Carried Unanimously 6. FINANCE PUBLIC MEETING 6.1. Public Meeting - Development Charges The City of Niagara Falls Council is holding a public meeting to discuss proposed development charge rates as well as the policies that will be applied throughout the City. Council will be considering the approval of updated development charges by-laws on a date following this public meeting. The Finance Public Meeting commenced at 4:56 PM. Jaclyn Hall, of Hemson Consulting Inc., along with Danielle Tivoli (Consultant) provided a presentation to Council. Councillors were provided an opportunity to ask the Consultants and staff questions pertaining to the Development Charges study. Council heard from the following members of the public wishing to speak to the development charge study. -Doug Birrell, Executive Director of the Niagara Falls Hotel Association, addressed Council citing his concerns with the development charge study asking if some of it can be deferred or if some of it is elective? Asked Council to work with the industry to see how it can be phased in ...... as it affects new builds and renovations. -Mr. Raci, of Niagara Falls, addressed Council, providing a perspective of the struggle millennials would have to pay this when they don't even have a house to live in. The Finance Public Meeting closed at 6:23 PM. 7. PLANNING MATTERS 7.1. Raj Patel, agent, introduced Rob Russell, whom is the Planner from Robert Russell Planning Consultants. Rob provided Council with a brief presentation supporting the application and the recommendations as presented. Councillor Pietrangelo left Chambers at 6:25 PM and returned at 6:33 PM. THAT Council APPROVE the Zoning By-law amendment to rezone the property a site- specific Residential Apartment 5C Density (R5C) Zone to permit 72 stacked townhouse dwelling units within 4 blocks, subject to the regulations outlined in this report. 2. THAT a future internal access connection with the adjacent property to the west be reviewed by the General Manager of Planning, Building & Development as part of the site plan control. 3. THAT the amending zoning by-law include a sunset clause to require the execution of a site plan agreement on title within 3 years of the passing of the zoning by-law. Carried Unanimously (Councillor Thomson declared a conflict). 7.2. PBD-2024-15 AM-2023-030, Zoning By-law Amendment Application 26CD-11-2023-009, Plan of Vacant Land Condiminium 3958 Cardinal Drive Applicant: 12604515 Canada Corporation (Mohanned Sawan) Agent: Joe Lakatos (AJ Lakatos Planning Consultant) Councillor Baldinelli left Chambers at 6:45 PM and returned at 6:49 PM. The Public meeting commenced at 6:46 PM. Nick DeBenedetti, Planner 2, provided an overview of Report PBD-2024-15. Lisha Song & Xiaochong Li, of 7920 Foxe Drive, cited their concerns about this proposed draft plan and zoning by-law amendment, discussing the height and proximity and asked for other options to be considered pertaining to shadow issues. Page 5 of 17 Dina lasobaccio, of 3917 Cardinal Drive, addressed Council citing traffic and speed concerns with this development. Pat Dimarco, resident at corner of Cardinal Drive and Oakridge Drive, asked questions of the development questioning if there were other proposals for this area. Concerned about the high -density in this area. Joe Lakatos, Agent, spoke in support of the recommendations and the conditions as presented by our City planner and addressed the concerns raised pertaining to the shadows; no windows facing the neighbours and no trees. THAT Council APPROVE the Zoning By-law amendment to rezone the property to a site -specific Residential Low Density, Grouped Multiple Dwellings (R4) zone, to allow for the development of 33 townhouse dwelling units within 5 blocks, subject to the regulations outlined in this report; 2. THAT the Plan of Vacant Land Condominium be DRAFT APPROVED subject to the conditions in Appendix A; 3. THAT the Mayor or designate be AUTHORIZED to sign the draft plan as "approved" 20 days after notice of Council's decision has been given as required by the Planning Act, provided no appeals of the decision have been lodged; 4. THAT DRAFT APPROVAL be given for three years, after which approval will lapse unless an extension is requested by the developer and granted by Council; and, 5. THAT the Mayor and City Clerk be AUTHORIZED to execute the Condominium Agreement and any required documents to allow for the future registration of the condominium when all matters are addressed to the satisfaction of the City Solicitor. THAT Council RECEIVE report F-2024-01, 2022 Budget to Actual Variance (unaudited) - Tax Levy Supported Operating Fund for information. 2. THAT Council APPROVE the recommended operating special purpose reserve consolidations (transfers) as outlined in the charts in attachment 14 - Operating Special Purpose Reserve Updates. Carried Unanimously (Councillor Campbell was absent from the vote). 9.2. Council moved to address Item #13.1 on the agenda, as the organizer of the Ukrainian Festival asked to speak to the matter, to promote the upcoming event. F-2024-18 Gale Centre Storm Water Project Capital Budget Amendment Moved by Councillor Lori Lococo Seconded by Councillor Mona Patel THAT Council APPROVE a 2024 Capital Budget Amendment to create STMS 59-24 for the Gale Centre Storm Water Design with a total budget of $60,000 (inclusive of non -recoverable HST), funded by Capital Special Purpose Reserves. In the event that Council determines it is in the best interest of the public to do so, THAT the City enter into an Encroachment Agreement respecting the concrete driveway, Quonset Hut, trailer, fence and miscellaneous materials into Swart Street with Sean Temple and Sharon Marie Temple, the owners of 3858 Garner Road. 2. THAT the City Solicitor and Chief Administrative Officer, or their designate, are authorized to execute the required Encroachment Agreement. 3. THAT the City Solicitor is authorized to register the Encroachment Agreement on title to 3858 Garner Road and the applicable parcel for the affected portion of Swart Street in the Land Registry Office at the owners' expense. MW-2024-17 Schisler Road and Koabel Road Bridge Rehabilitations - Contract Award (2024-552-21) Moved by Councillor Wayne Campbell Seconded by Councillor Mike Strange 1. THAT Council award Request for Tender 2024-552-21, Schisler Road and Koabel Road Bridge Rehabilitations, to the lowest compliant bidder, Rankin Construction Inc., in the amount of $1,143,574.00 + HST. 2. THAT Council approve a 2024 capital budget amendment for the Koabel Road Bridge Rehabilitation project (BC24-21) in the amount of $65,000.00, with $63,856.00 to be funded from OCIF and $1,144.00 Page 8 of 17 from the Capital Special Purpose Reserve. 3. THAT Council approve a 2024 capital budget amendment for the Schisler Road Bridge Rehabilitation project (BC26-21) in the amount of $70,000.00, with $68,768.00 to be funded from OCIF and $1,232.00 from the Capital Special Purpose Reserve. 4. Carried Unanimously 9.7 MW-2024-19 Chippawa Parkway & Dorchester Road Infrastructure Improvements - Cost Sharing Moved by Councillor Victor Pietrangelo Seconded by Councillor Wayne Campbell 1. THAT Staff be directed to enter a cost sharing agreement for local road improvements along Dorchester Road and Chippawa Parkway in conjunction with the Riverfront Development. 2. THAT Staff be directed to coordinate the design, construction, on -going operation and maintenance of the Riverfront Community pumping station with the Riverfront Developer Centennial Homes (Niagara) Inc.in accordance with Regional Policy. 3. THAT the Mayor and City Clerk be authorized to execute all necessary Operational and Maintenance Agreements, Development Agreements and/or Cost sharing Agreements. 4. Brandon Boone, Co-owner & Director of Community & Minor Hockey Engagement, and Chris Gallagher, from the Niagara Falls Minor Hockey Association, and Mike Cressman, of the Niagara Falls Riverhawks, addressed Council regarding Report R&C-2024-05. Frank Pietrangelo, also spoke about the economic impact on the City of Niagara Falls of hosting events/tournaments and expressed his appreciation of the support from the City. Resolution - City of Peterborough - Bill to amend the Ombudsman Act Attached is a resolution from the City of Peterborough requesting a Bill to amend the Ombudsman Act. Recommendation: THAT Council Support the resolution from the City of Peterborough. 11.3. Proclamation Request - National AccessAbility Week and Red Shirt Day Easter Seals Ontario is requesting Council to proclaim May 26, 2024 - June 1, 2024 as "National AccessAbility Week"and to share the declaration on the City's websites and social media outlets; AND THAT Wednesday, May 29, 2024 be recognized as "Red Shirt Day" of Action for Accessibility and Inclusion. Recommendation: THAT Council APPROVE the request. 11.4. Proclamation Request - National Public Works Week On behalf of the many women and men employed to serve the community in the Municipal Works Division, our General Manager of Municipal Works, Erik Nickel, is kindly requesting the City of Niagara Falls proclaim May 19-25, 2024 as National Public Works Week. Recommendation: THAT Council APPROVE the request. Exemption Date & Time: June 1, 2024 By-law allows until 9:00pm Exemption would be until 12 midnight. Additional details: There will be approximately 130 people. The property is around 4 acres, with a good amount of space between the neighbours. The correspondence is regarding the Ontario Auditor General's Value -for -Money Audit of Public Health Ontario released in December 2023. Recommendation: For the Information of Council. 12.2. Niagara Region Correspondence Attached is correspondence sent from the Niagara Region regarding the following: 1. Recommendation: THAT Council accept the presentation made by organizer of the event and that Council Support the Festival by declaring it an event of municipal significance and promotion through the City's social networks. Recommendation: THAT Council APPROVE the request to extend the noise by-law to allow live bands to play at Firemen's Park until 11:00 PM on both nights, August 23, 2024 and August 24, 2024 for the Niagara Irish Festival. RATIFICATION OF IN -CAMERA a) Ratification of In -Camera Moved by Councillor Victor Pietrangelo Seconded by Councillor Mona Patel THAT Council ACCEPT an offer to purchase part of Ferguson Laneway (located between 4473-4478 Ferguson Street and 4499 Ferguson Street), for $70,000.00, subject to entering into a formal Housing Services Rent Supplement Landlord Agreement for a term of 10 years as required by Niagara Regional Housing and the City. Page 14 of 17 THAT the City Solicitor and Chief Administrative Officer, or their designate, is AUTHORIZED to execute all other documentation and take whatever steps necessary to carry out and complete the transaction. THAT Council AUTHORIZES, in principle, the entry into a Lease Agreement with Great Lakes Entertainment Canada Ltd. over a portion of the Ontario Avenue Road Allowance, subject to the following changes directed by Council: • Phase 1 to be completed in 5 years, and Phase 2 to be completed in 3 years. • Site plan application to be submitted in 2 years. • Construction security to be returned if all conditions are met at the end of phase 2. THAT the City Solicitor and the Chief Administrative Officer, or their designate, are AUTHORIZED to execute all documentation and take whatever steps necessary to carry out the above -mentioned recommendation. NOTICE OF MOTION/NEW BUSINESS a) Notice of Motion - Casino Police Unit Councillor Lori Lococo brought forth the following notice of motion: - That Council review the Casino Police Agreement; - That Council be provided statistics of the "additional policing costs caused by the presence of the two casinos"; - That Council be provided the statistics of what "adequate effective staffing and services levels" are - That Council be provided statistics of what "patrol and servicing levels" are in the area; - That Council be provided the quarterly reports for information; - That Staff provide recommendations and possible amendments to the agreement. b) Notice of Motion - Litter in the City Councillor Lori Lococo brought forth the following notice of motion: That staff come back with some options for cleaning up garbage in the city. It could include, but not limited to, more city cleanups, equipment required, frequency, insurance, liability, how the Adopt a Street program works, etc. c) Councillor Pietrangelo assumed the position of Chair at 10:42. Notice of Motion - Parking Optimization Study Mayor Diodati brought forth the following notice of motion: Request for Staff to undertake a parking optimization study that offers an innovative approach to maximize revenue for the City during peak tourist Page 15 of 17 season and special events. It could consider real-time parking availability, modified dynamic pricing and leveraging technology to ensure buy -in from stakeholders and residents. As timing permits, we would look to reap the benefits of this for this -coming tourist season. Mayor Diodati resumed as Chair at 10:45 PM. d) Patio Permits - Application fees Councillor Mike Strange discussed the current patio permit application process. Direction to Staff: To ask Staff to bring a report back to Council investigating the patio permit application process, including the fees charged, and to look at other municipalities in our region to compare the process. 16. MOTIONS 16.1. Procedural By-law - At the Council meeting of March 19, 2024, Councillor Mike Strange brought forth the following motion: Motion: THAT Staff be directed to look for efficiencies in running the Council meetings via updates to the Procedural By-law. (AM-2023-026). 2024- A by-law to amend By-law No. 79-200, to permit the use of the Lands for 29 043. block townhouse dwellings and 84 back-to-back townhouse dwellings, subject to a 3 year sunset clause and to protect certain natural features (AM-2022- 020). 2024- A by-law to prohibit and regulate noise in the City of Niagara Falls. 044. 2024- A by-law to establish Administrative Penalties (Non -Parking) for By -Law No. 045. 2004-105 (as amended by By-law No. 2005-73, By-law No. 2007-28 and By- law No. 2014-155); By -Law No. 2007-41; By -Law No. 2001-31 (as amended by By -Law No. 2021-57 and By-law No. 2021-99). 2024- A by-law to adopt, ratify and confirm the actions of the City Council at its 046. meeting held on the 30th day of April, 2024.
