It was ORDERED on the motion of Mayor Salci and seconded by Alderman Ioannoni that;
1) That the existing "No Parking" restriction on the west side of Fourth Avenue between
Valley Way and Jepson Street be removed;
2) That a permanent "No Parking" at all times restriction be installed on the east side of
Fourth Avenue between Armoury Street and Jepson Street;
3) That a comer parking restriction be installed on the west side of Fourth Avenue between
Valley Way and a point 20 metres south of Valley Way;
4) That a comer parking restriction be installed on the west side of Fourth Avenue between
Jepson Street and a point 20 metres north of Jepson Street; and,
5) That a "No Standing" restriction be installed on the east side of Fourth Avenue between
Valley Way and a point 20 metres south.
d) BBS-2006-06 - Sign Variance, Niagara Falls Optimist Club Morrison Street at
Dorchester Road.
The proponents Mr. Mark and Mr. Maldina advised that they received a permit to construct an
'L' shaped 10' x 40' billboard sign. The proponent produced a building permit which was
submitted to the City Solicitor. The City Solicitor advised Committee that the permit is for 400
sq. ft. total meaning two 10' X 20' billboard signs which was approved by Committee in
December 2005.
The proponents produced email correspondence from the Director of Building & By-law
Services stating, "Most billboards, ground signs and many other types of signs generally have
two sides (back to back) and although it is not noted in our antiquated (1966) sign by-law we
have always considered only one side when dealing with the size and related costs per square
foot." The Manager of By-law Services advised Committee that there was additional information
on that email which states, "Several years ago a enterprising sales exec. for a sign company got
the idea to separate the two panels from the normal back to back and place them in a "V" shape
and capture a whole new sales angle and perspective, plus save some money. They would get
two signs for the price of one (permit fee). There was a great amount of confusion as to how
much of an angle was allowed before it became two signs. We determined that unless the sign
faces were totally parallel to each other they would be considered two signs, any angle separating
the signs would make them two separate panels. This practice was welcomed and accepted by
the sign companies because it was consistent and fair and has worked well for fifteen or twenty
years. "

g) MW-2006-97 - Pavement Management Survey
Alderman Diodati questioned staff if the report included Regional Roads in the City. The
Director of Municipal Works advised the report included City owned roads only but would
request the pavement ratings from the Region on Regional Roads in Niagara Falls.
It was ORDERED on the motion of Alderman Kerrio and seconded by Alderman Ioannoni that
this report be considered for the 2007 Budget.

h) PD-2006-77 - 7565 Lundy's Lane Former Parks, Recreations and Culture Building

report back on the adaptive re-use of the building, including financial implications.

RECOMMENDATIONS:
It is recommended that:

budget;
4) various sidewalk connections in the immediate area of the intersection be included

i) The north side ofRiall Street from St. Paul Avenue to a point 50 metres
west of St. Paul Avenue;
ii) Both sides of Church's Lane from St. Paul Avenue to a point 43 metres
east of St. Paul Avenue;
iii) The east side of St. Paul A venue from a point 5 metres south of Gore
Street to a point 26 metres north ofRiall Street;

8) a "No Standing" restriction be installed on the south side ofRiall Street from St.
Paul A venue to a point 52 metres west of St. Paul Avenue.
BACKGROUND:
At the request of area residents through Honorable Rob Nicholson, Member of Parliament, staff
carried out traffic studies to determine whether a revision to the traffic control is warranted at the
intersection of St. Paul Avenue @ Church's Lane & Riall Street.
St. Paul A venue is classified as an arterial roadway that extends from the City's north limit to
O'Neil Street, which then continues southerly as Portage Road. St. Paul Avenue is a two-lane
roadway separated by a solid yellow centre line. The centre line is offset to the east, providing
northbound motorists with a 3.5 metre lane, while southbound traffic has a 6.5 metre wide lane.
Church's Lane is a two-lane collector roadway that extends west from Whirlpool Road to St.
Paul Avenue. Riall Street is also a two-lane collector roadway that extends west from St. Paul
A venue to Dorchester Road.
The intersection ofSt. Paul Avenue and Church's Lane / Riall Street is configured in an offset
configuration. The centre line ofRiall Street is 24.5 metres north of the centre line of Church's
Lane. Thus, motorists on either Riall Street or Church's Lane intending to carry out a through
movement would first complete a right turn onto St. Paul A venue, followed by a left turn to
continue forward on the secondary roadway. Sidewalks are currently present on all approaches,
except for the east side ofSt. Paul Avenue, north of Church's Lane. Also, a section of sidewalk
is not present on the north side of Riall Street in front of the plaza only, an approximate length of
68 metres. This intersection is supervised by a school crossing guard on the south side of
Church's Lane during the morning and afternoon. The guard assists elementary pupils to four
schools in the immediate area (Martha Cullimore, Mary Ward, Prince Philip, Victoria). Up to 20
students normally use this crossing per session. Niagara Transit buses also pass through this
intersection each way for their Stamford route, which utilizes Riall Street and Church's Lane.
A traffic count was carried out in mid-September, following the commencement of the new
school year to capture traffic volumes that would traverse this area on a typical work/school day.
The minimum requirements for the provincial traffic signal warrant, which takes into account
total traffic volumes, traffic from the main street, delay to crossing traffic and pedestrians, and
collision history indicate that the warrants have been satisfied. Therefore, staff is recommending
that traffic control signals be installed at the intersection ofSt. Paul Avenue and Church's Lane /
Riall Street and that $150,000 for the installation of the signals be included for consideration in
the 2007 budget.
Given that this intersection is in an offset configuration and currently supervised by a school
crossing guard, on the south side of Church's Lane, the following safety measures will be
implemented:
1. A "No Right Turn on Red" restriction will be installed facing motorists in each
direction. This type of restriction is primarily used at multiple-phase traffic signal
operations to eliminate confusion amongst motorists are unsure as to who has the
right-of-way when turning movements are carried out;

2. Motorists on Church's Lane and Riall Street would proceed under separate signal
phases to ensure a conflict-free protected movement;
3. "Stop Here on Red Signal" signs be posted facing St. Paul A venue motorists at
the designated stop locations;
4. Countdown pedestrian signals be included in the signal installation;
5. Implementation of stopping and standing prohibitions on all approaches of the
intersection;
6. New concrete sidewalk construction to link existing pedestrian facilities to the
proposed crosswalks be included for consideration in the 2007 budget on:
i) the north side ofRiall Street adjacent to the plaza; a continuous sidewalk
exists west of this commercial development;
ii) a short section on the east side of St. Paul A venue from the proposed
northerly crosswalk to Church's Lane;
iii) extending from the sidewalk on the west side of St. Paul A venue to the
existing school crosswalk; and,
iv) relocating the existing transit stop on Riall Street slightly to the west, away
from the catch basin and augmenting it with a concrete platform.
A copy of this report has been distributed to the Honorable Rob Nicholson, Member of
Parliament, Niagara Transit, all property owners within 100 metres of the intersection and the
four Principals for the area schools mentioned earlier for their information.
Committee's concurrence with the recommendations outlined in this report would be
appreciated.

RECOMMENDATION:
That Council authorizes staff to continue with the preparation of the final design and contract
documents using in-house resources for the extension of a sanitary sewer on Gamer Road
(McGarry-McLeod) sufficient to address the potential health risks identified by the Regional
Niagara Public Health Department; and further,
That staffbe directed to implement these works in accordance with Ontario Regulation 119/03,
Municipal Act, 2001 (formerly the Local Improvement Act).
BACKGROUND:
Municipal Works staff has been working with Regional Niagara Public Health inspectors to
address defective septic systems located on various private properties on the east side of Gamer
Road between McLeod Road and McGarry Drive. We have recently received a letter dated,
September 18,2006 (see attached) that confirms the results of their field surveys from October
2005.
Municipal Works staff has commenced the preliminary engineering design in order to calculate an
appropriate construction cost estimate that will be used during discussions with the affected
property owners. As new development in the Gamer neighbourhood continues to expand the
potential health risk will increase and it is important to address this matter with a permanent
solution. The subject properties are currently situated within the Urban Area and Urban Service
Area Boundaries and have access to the municipal water supply.

At this time the individual assessments have not been calculated and it will be necessary for the
municipality to prepare a proper notice to the benefiting landowners of its intention to pass a
Local Improvement Charges By-Law.
Staffis seeking authorization to proceed with the next steps of this project including the
engagement of the affected landowners.
Given the minor scope but important nature of this matter your favourable consideration of this
recommendation would be appreciated.

RECOMMENDATION:
It is recommended that this report be received for the information of Committee.
BACKGROUND:
This report is further to Council's motion for staff to investigate the signal timing on Thorold
Stone Road during the night to provide alternating red/amber flashers and forward the findings to
the Region for their review and reprogramming. Given that Thorold Stone Road is a Regional
road, Staff requested input from the Region on their policy for night time flash mode operations
at signalized nodes.
All ten (10) traffic signals along Thorold Stone Road from Thorold Townline Road to Stanley
A venue operate as fully actuated signals with detection provided on all approaches to each
intersection. This allows for the signal controller to react to existing traffic conditions and
provide green time where necessary according to traffic demand. This type of operation provides
the best use of green time and minimizes delays for all vehicles at each location. During off peak
and night time hours the signal will rest in east/west green for Thorold Stone Road and not
change unless a vehicle or pedestrian is detected north or southbound at one of the cross streets.
The signal will then change to green for north/south traffic until the vehicles have cleared or it
reaches its maximum green time.
Another issue arising with night time flash operation is the colours displayed during flash mode.
The Region has adopted the practice of four way RED flash rather than red for one street and
amber for the other. This is being done by municipalities throughout the province for safety
purposes. The intersection basically reverts back to a four-way stop intersection so there is no
confusion as to who has the right of way. This is also done for the safety of repair crews who are

working at the intersection while it is in this fail safe mode. The signal may go into flash for a
number of reasons including malfunctioning equipment or poor power supply. If the controller
has been programmed to flash red for all directions during these conditions, it will also have to
flash red during a night time flash operation. This would mean that all signals would then
operate as all way stops during the night and all traffic on Thorold Stone Road would have to
come to a stop at each intersection, regardless of the activity on the opposing street.
Reports issued by The Ministry of Transportation Ontario Traffic Conference and the Institute of
Transportation Engineers recommend NOT using night time flash operation primarily because of
the safety concerns and driver confusion of right-of-way. This operation has been used in the
past on one way streets or on low volume roads in some municipalities outside the Region of
Niagara. The City also utilizes the same philosophy as the Region.
Therefore, no changes are recommended to the existing traffic signals on Thorold Stone Road.
Committee's concurrence with the recommendation outlined in this report would be appreciated.
