HomeMy WebLinkAbout12-12-2024 - In Camera The City of Niagara Falls, Ontario Resolution December 12th, 2024 Approved by: Kira Dolch, General Manager of Planning Building and Development WHEREAS delegated authority was granted by Council to the General Manager of Planning, Building and Development or their designate for minor Zoning By-law Amendment applications in accordance with By-law No. 2023-107 and By-law No. 2023-108; and WHEREAS subsection 34(13) of the Planning Act, 1990 R.S.O requires written notice of the public meeting to be given to prescribed persons and public bodies, in the prescribed manner, and accompanied by the prescribed information; and WHEREAS notice was given to the prescribed persons and public bodies, in the prescribed manner, for the public meeting held by the General Manager of Planning, Building and Development on October 30th, 2024, to consider a minor Zoning By-law Amendment application by Empire (Grand Niagara) Project GP Inc. ("the applicant") to permit the use of lands located in the Grand Niagara Draft Plan of Subdivision for an office, private community building, a maximum of six model homes, and detached dwellings, and to guide the development of back-to-back townhouse dwellings; and WHEREAS the General Manager of Planning, Building and Development approved the recommendations of Report No. PBDD-2024-14 on October 30th, 2024; and WHEREAS since that time, it was identified by the applicant that an additional zone is desirable for the purpose of accommodating the proposed model homes; and WHEREAS the proposed change to By-law No. 2024-108 does not alter the number of model homes that are proposed or increase the area of land that is to be occupied by model homes; and WHEREAS notwithstanding the requirement for the written notice of a public meeting, subsection 34(17) of the Planning Act, 1990 R.S.O allows a municipality to deem such requested changes minor and determine that no further notice is required to be given by passing a resolution; and WHEREAS City Staff and the applicant request that the General Manager of Planning, Building and Development considers passing a resolution that would deem the giving of further notice as final and that no further notice is required to be given; and WHEREAS the General Manager of Planning, Building and Development determined that the proposed change to By-law No. 2024-108 is minor and does not require further notice to be given. THEREFORE, BE IT RESOLVED that subject to subsection 34(17) of the Planning Act, 1990 R.S.O the General Manager of Planning, Building and Development deems the change to By-law No. 2024-108 minor and exempts the requirement for further written notice.
