On Jan 15 the Mayors CAO's and Business Development staff from the cities of Niagara Falls, Welland,
St. Catharines and Fort Erie met to review the roles and responsibilities of the local BDD staff vs NETCO.
The meeting was held to discuss how we can ensure that duplication doesn't occur. The group discussed
how we can work more efficiently together and create synergies that benefit our municipalities and Region.
A meeting is being planned with the above noted reps and the Regional Chair and NETCO staff to
develop strategies on how we can be more effective and efficient in our service delivery.

The topic will be correction of duplication of services City and Niagara
Region.
The estimated overpayment of taxes to NIAGARA REGION is $100 million. The CITY of NIAGARA FALLS
TAXPAYERS pay $25 MILLION towards this outrage!!! Norm PUTTICK accepts the challenge to reverse this
FISCAL. IMBALANCE by sending back ("upload") to the PROVINCIAL GOVERNMENT the 100% cost of
•SOCIAL SERVICES and HOUSING.
DUPLICATION of Services between the City of Niagara Falls and the REGION MUST STOP! This will bring more

I have tried as a citizen to change the system and have been REBUFFED. Now I ask for your VOTE to make.

Premier Dalton McGuinty has forwarded a copy of your e -mails of September 24 and April 28,
2006, with regard to municipal restructuring and funding.
As Minister of Municipal Affairs and Housing, it is my responsibility to help ensure that all
Ontarians enjoy the security that comes from living in financially viable and sustainable
municipalities that deliver the services expected from local government.
I understand that residents in some municipalities continue to have concerns about the
governance structures of their municipalities. Let me say once more that I am willing to consider
a restructuring proposal that contemplates an alternative governance structure, provided that the
following criteria are met:
approval and submission of the proposal by local council or the appropriate councils
(in two -tier municipalities);
demonstrated property -tax fairness for all residents; and
demonstrated fiscal self- sustainability for all proposed new municipalities.
As you can appreciate, the decision to change a municipality's structure is an extremely complex
and important undertaking. Therefore, any restructuring proposal would need to clearly
demonstrate a detailed level of analysis that is supported by substantive evidence and
consultation, which such an issue warrants.
Ontario
That being said, restructuring is not this government's priority, and there is no provincial funding
available for municipal restructuring. The costs of developing and implementing a proposal
would therefore be borne by the municipality.

The McGuinty government has made it a priority to work in partnership with the municipal
sector and has taken major steps forward with significant new investments in Ontario's
municipalities.
For example, the 2006 Ontario Budget provided the Region of Niagara and lower -tier
municipalities that form the Region with various funding through the Ontario Municipal
Partnership Fund (OMPF), Move Ontario, and the Ontario gas -tax rebate program.
The Province is building on its partnerships with municipalities by launching a joint review
aimed at improving the delivery and funding of municipal services for Ontario families
including housing, health and social services. The Provincial Municipal Fiscal and Service
Delivery Review will be conducted by both orders of government, and a public report will be
released in the spring of 2008.
Thank you for bringing your concerns to the attention of the government.

councillor.

The Council for the Regional Municipality of Niagara has the ability to direct its Chief Administrative
Officer (CAO) to initiate a review of the services within the jurisdiction of the Region. Similarly, each
lower -tier council within the Region has this authority with respect to its own CAO.
In addition, sections 188 through 193 of the Municipal Act, 2001 provide municipalities with the
authority to transfer powers between upper- and lower -tier municipalities. These transfers may
achieve the desired efficiency of services and perhaps eliminate some of the duplication you have
identified. However, the decision to transfer powers can be a complex process that should be
undertaken with due diligence at both the regional and local level.

Attached is a copy of a document which was forwarded to me by Patrick Gedge of NEDC outlining the
individual responsibilities of each of our organizations. We have been trying to figure out how we could
work together and without duplication (with some success), but we never really put pen to paper on the
subject. Thanks to your inquiries and questions, we have finally done so. Your questioning of our collective
and individual processes also highlights the importance of the Ontario Ministry of Tourism Destination
Development mandate in that there must be a concerted effort on the part of ALL of the municipalities and
the Region as a whole to ensure that the Tourism Industry in Niagara thrives and grows. Working together
is the only way we can accomplish this. I am pleased to tell you that Patrick and I are now meeting on a
regular basis (almost weekly) to discuss plans and initiatives. It has been many years since there has
been this level of cooperation between the two organizations and I have every confidence that this will
flourish especially under the new Destination Development Strategy currently being developed.
I have also attached a copy of the Destination Development Org Chart for your information. It includes the
names of the people serving on each of the individual committees as you can see Niagara Falls is very
well represented.

I could certainly raise these issues at our area CAO meetings. I'm not sure there will be a huge appetite to
once again go down the 'amalgamation' path.
My concern is that the prospect of the Economic Development review and the Governance review at this
time will undo much of the hard work of the last term to build a more collaborative 'one voice' atmosphere
with area municipalities. I also think we need to let Council's Strategic Planning process for the new term
unfold further before introducing these potentially divisive proposals. We also need to consider the
significant efforts already underway in conjunction with area municipalities to achieve better efficiency and
service delivery these include the Planning Review,a review of Transportation Roads) Water
Wastewater and an internal review of our Payroll /Human Resources areas) To be very candid the
Economic Development function is relatively small in comparison to some of the others. We also have to
be sensitive to our capacity to undergo a number of significant reviews in parallel. The potentially negative
impacts on day to day service delivery and workplace culture cannot be underestimated!
This is not to say these aren't worthy of further review It is more a matter of timing and process.
In the alternative you may wish to take a more staged approach and ask for some information regarding
the Economic Development functions to better inform any future decisions regarding a major review. For
example as I mentioned earlier some comparisons with other like sized Regions /Municipalities of
budget resources programs offered, and an outline of the respective roles of the region and local
programs will provide some better perspective on the degree of duplication service levels and level of
investment and performance in the combined economic development functions in Niagara As well, by
raising these issues during the Council planning sessions they can be framed as strategic initiatives for
the new term to achieve more cost effective and integrated service delivery with our local municipal
partners.They can also be introduced as a vehicle to potentially support a more effective execution of the
recently developed Economic Growth Strategy another major effort in conjunction with area
municipalities and the local private sector
The introduction of Notices of Motion without the appropriate background now could prove both
counterproductive and divisive. The approach needs to be sensitive to both the current fragile state of
Niagara's economy and the burden of Niagara taxpayers.

The Council for the Regional Municipality of Niagara has the ability to direct its Chief Administrative Officer
(CAO) to initiate a review of the services within the jurisdiction of the Region. Similarly, each lower -tier
council within the Region has this authority with respect to its own CAO.
In addition, sections 188 through 193 of the Municipal Act, 2001 provide municipalities with the authority to
transfer powers between upper- and lower -tier municipalities. These transfers may achieve the desired
efficiency of services and perhaps eliminate some of the duplication you have identified. However, the
decision to transfer powers can be a complex process that should be undertaken with due diligence at
both the regional and local level.

RECOMMENDATION:
1. That Council approve the Zoning By -law amendment application to permit the floor
area of Niagara Square to be increased as anticipated by the City's Official Plan, a
reduced parking standard, an increased lot coverage and reduced building setbacks
to McLeod Road, subject to the modifications outlined in this report.
2. That the amending by -law include a holding provision (H) to remain in place until a
development agreement is executed with the applicant, securing the appropriate
share of off -site roadway improvement costs as determined by an ongoing functional
corridor study for McLeod Road.
BACKGROUND:
PD- 2007 -08
The amendment is requested for 7555 Montrose Road (Niagara Square) which is a 22.3
hectare (55 acre) parcel of land, as shown on Schedule 1. The amendment is requested to
permit a proposed expansion of the shopping centre, including a new Canadian Tire store
as well as several other smaller commercial buildings, as shown on Schedules 2 and 3.
The land is zoned Planned Shopping Centre Commercial (SC -331) which permits a
maximum gross leasable floor area (GLFA) of 44,150 square metres (475,242 sq. ft.). The
maximum GLFA is proposed to be increased to 50,000 square metres (538,213 sq. ft.) to
reflect the maximum floor area permitted by the Official Plan and to accommodate the

proposed development. The applicant is also requesting site specific provisions to be
applied to the lands to reduce the minimum parking standard to one (1) space per 20
square metres (215 sq. ft.) of GLFA, increase the building coverage from 25% to 35
reduce the minimum building setback to the property boundary adjacent to McLeod Road
from 18 metres (59 feet) to 3 metres (10 feet) and reduce the minimum building setback
to the original street centreline of McLeod Road from 34.76 metres (114 feet) to 19.5
metres.
Surrounding Land Uses
The Niagara Square shopping centre and Cineplex Odeon cinemas are located on the
land. Industrial uses lie to the west and south of the land. Vacant land and commercial
uses lie to the northeast, bordering the QEW. Vacant lands (intended for a significant
major commercial development) and the McBain Community Centre lie to the north.
Circulation Comments
Regional Municipality of Niagara The proposed amendment to increase the
floor area conforms with the City's Official
Plan (Amendment No. 60).
Municipal Works
There are no concerns with the requested
changes to the parking and lot coverage
standards. However, in exchange, the City
should secure increased landscaping on the
periphery of the site.
Construction of the proposed Canadian Tire
store will result in the loss of a woodlot.
Efforts should be made to retain or
transplant trees within increased landscape
strips along adjacent streets. A replanting
program using native species would also be
appropriate.
The current southbound right -in entrance
into the site from Montrose Road should be
converted into a full signalized intersection
to ensure proper access.
Adequate underground services exist to
accommodate the development.
A reduction in the parking standard from one
(1) space per 18 square metres of GLFA to
one (1) space per 25 square metres of
GLFA has been adequately demonstrated in
a traffic and parking study submitted by the
applicant.

A 1.52 metre (5 foot) road widening is
sought along the entire length of the
McLeod Road frontage of the property to
protect for future transportation corridor
improvements identified in the Region of
Niagara's Arterial Road System Plan report.
All required building permits to be obtained
prior to the commencement of construction.
All buildings to be located outside the 14
metre setback from the QEW.
Building and Land Use Permits to be
obtained from the MTO prior to construction.
At the site plan stage, review of stormwater
management and site grading will be
completed.
MTO has reviewed the traffic and parking
study and requests modifications to
benchmark traffic numbers to ensure
conformity with MTO standards. In addition,
the report should consider additional
development (subject to an Official Plan
amendment) at the southeast corner of
McLeod Road and the QEW.
There is an easement in favour of the City
over a portion of the property to the east of
the existing shopping centre.
No objections.
Approval of the application will implement the maximum GLFA established by the Official
Plan. Subject to the modifications outlined in this report, the other requested changes to
the existing provisions are acceptable. The following is Planning staff's analysis of this
application.
1. The proposal complies with the intent and the purpose of the Official Plan.
The land is designated Major Commercial and is located within the Niagara Square
Retail District. In order to strengthen the District and ensure it's function as the
City's regional retail shopping destination, Council adopted Official Plan Amendment
No. 60 (OPA No. 60), permitting Niagara Square to expand to 50,000 square
metres.

This District is intended to be anchored by Niagara Square and to be supported by
free standing box outlets and other multiple groupings of medium and smaller retail
outlets.
The proposal conforms to the Official Plan as follows:
Increasing the GLFA cap in the Zoning By -law to 50,000 square metres will
match the maximum GLFA cap contained in the Official Plan.
The addition of a large retail store (Canadian Tire) will provide an additional
anchor for this shopping centre and should assist in strengthening this node's
role as a regional shopping destination.
The balance of the additional floor space will provide for other retail, restaurant
and commercial outlets that will reinforce this node's regional function.
The Official Plan also seeks to retain existing tree cover, where possible, and
requires a tree study where significant woodlots are affected by development
proposals. An existing woodlot will be removed by the proposed Canadian Tire
store development. The Region has indicated that trees in this woodlot should be
saved where possible in landscape strips along the property boundary, or a
replanting plan using native species should be implemented. A tree study,
completed by the applicant, indicated that most of the trees were in poor condition
and that there was no potential of relocating trees.
After further discussions with City and Regional staff, the site plan was modified to
save a significant tree near the corner of McLeod Road and Pin Oak Drive. A
planting plan, incorporating native species around the oak tree and on a wider
landscape strip north of the Canadian Tire building, should be secured through the
site plan approval process.
2. The requested zoning is appropriate.
The requested change to the current SC -331 zoning of the property will permit a
maximum GLFA of 50,000 square metres (538,213 sq. ft.) for the entire
development, consistent with the cap contained in the Official Plan. In addition, the
following requested or recommended changes are appropriate.
A reduction in the parking requirements to one (1) parking space per 20
square metres of GLFA will provide adequate parking for existing and future
uses. Although an even lower parking standard (one space per 25 square
metres or 259 square feet of GLFA) was demonstrated in the applicant's
parking study, the applicant has opted to proceed with a more conservative
standard.
As the amount of required parking is being reduced, the requested increase
in building lot coverage from 25% to 35% can be considered. The site is large
enough to accommodate a higher intensity of development while maintaining
adequate traffic circulation and good urban design. Provided landscaping and
building setbacks are provided as recommended in this report, this increase
is acceptable.

Staff recommends a minimum 15% of the land be provided as landscaped
open space, and the landscape strip along McLeod Road and Montrose Road
adjacent to the Canadian Tire development be increased to 6 metres (19.7
feet). A minimum landscaped open space coverage of 15% and a 6 metre
wide landscaping strip are requirements for other developments in the area,
including the commercial lands on the north side of McLeod Road and the
McBain Community Centre, and is needed to buffer the large parking area
from adjacent streets and provide room for snow storage.
Staff also recommends a provision be added to the amending by -law to treat
the entire Niagara Square as one lot. This will allow individual parcels to be
severed in the future without creating zoning issues.
In addition to the foregoing, the application requests a reduction in the building
setback to McLeod Road from 18 metres (60 feet) to 3 metres (10 feet). Staff
recommends this setback be increased to 6 metres (19.7 feet) after the 1.5 metre
(5 foot) road widening is taken for the following reasons:
An 18 metre yard setback is required to ensure the large buildings typically
built on SC zoned lands do not adversely impact surrounding streets and
properties. SC zoned lands on the north side of McLeod Road are required
to be set back 12 to 18 metres (40 to 60 feet) from this street. Ideally, the
Canadian Tire store would be set back a similar distance, however, to avoid
conflicts with the access driveway between this store and the Cineplex
Theatres, a reduced setback of 6 metres is recommended.
The Canadian Tire garden centre (located adjacent to McLeod Road) is an
accessory open storage use that normally is not complementary to the
streetscape nor is it engaging to passersby and therefore should be located
in a less visible spot. The applicant is not willing to relocate the garden centre
and therefore it should be screened by dense plantings to provide for a
pleasing streetscape. The recommended 6. metre building setback would
accommodate the recommended landscape strip and a proposed landscape
strip and allow for a dense landscaping screen.
A 6 metre landscape strip would provide greater opportunities to replace native
species and trees that will have to be removed for the project to proceed.
3. A hold provision is recommended until traffic matters are dealt with.
Due to the significant current and pending development applications along McLeod
Road, The Ministry of Transportation (MTO) and the Region anticipate that the
increase in traffic will necessitate significant improvements to McLeod Road and its
associated intersections and bridges. A coordinated approach to road
improvements is necessary due to the multiple jurisdictions and infrastructure
ownership. Although the applicant has submitted a traffic study that identifies lane
improvements and signalization of intersections adjacent to the site, it is anticipated
that additional potentially expensive improvements will be needed along the
corridor, due to the cumulative effects of traffic increase from each development.
To ensure the City is not burdened by the cost of these improvements, it is
necessary to arrange a cost sharing agreement with the affected developers.

Staff has met with representatives of MTO and the Region, who concur that the
McLeod Road functional study currently being conducted by the Region incorporate
traffic generation from each proposed development and recommend the overall
infrastructure needs. As these improvements are necessitated by new
developments, the associated costs should be shared among the developers.
Therefore, the MTO and the Region have requested that the additional floor space
proposed on Niagara Square be placed under a hold provision until cost sharing
agreements are executed.
To ensure the applicant is not unduly delayed by a lengthy corridor study time
period, it is recommended the cost sharing development agreement allow the option
of binding the applicant to paying his share of costs prior to completion of the
functional study.
CONCLUSION:
1. The requested amendment can be supported for the following reasons:
it implements the maximum floor area cap of 50,000 square metres (538,213
sq. ft.) of GLFA established by the Official Plan for Niagara Square; and
the addition of the Canadian Tire Store, along with the additional floor areas,
will help to strengthen the Niagara Square node and assist in its function as a
regional shopping destination.
2. Increasing the proposed building setback from McLeod Road from 3 metres to 6
metres (19.7 feet) will be more consistent with surrounding development and
provide room to effectively screen the garden centre.
3. A hold provision is recommended to be placed on the land until cost sharing for
road improvements are determined and secured through the appropriate
development agreements.

This application proposes revisions to the Planned Shopping Centre Commercial (SC) zoning
on the Niagara Square lands to increase the Maximum Gross Leaseable Floor Area (GLFA)
from 44,150 square metres to 50,000 square metres and to modify the parking and the lot
coverage requirements. These revisions would facilitate the development of a new 8,696
square metre store in the northwest corner of the site. The proposed store would be separate
from the existing mall structure.
Amendment No. 60 to the Niagara Fails Official Plan which was approved in 2005 permits the
development of Niagara Square as a regional shopping centre containing approximately 50,000
square metres of gross leasable floor area. The proposed revision to the zoning by -law to
increase the leasable floor area conforms with Official Plan Amendment No. 80.
The proposed revisions would also reduce the parking requirements for the shopping centre.
No traffic /parking study has been submitted to this Department to justify the reduced parking
standards. However, if the City is satisfied that the reduced parking standards will be adequate,
we would have no objection to this revision.
Regional Planning staff are not opposed to the proposed increase in lot coverage. However, as
a trade -off we would encourage enhanced landscaping, especially around the perimeter of the
shopping centre and landscaping details throughout the parking lots to minimize the "sea of
asphalt° appearance.

Regional Planning staff, in a letter dated March 1, 2006 provided comments on the above
rezoning proposal to allow an expansion of the retail floor space at Niagara Square. In that
letter, we indicated that we were not opposed to the rezoning because the proposed expansion
conformed with the approved Official Plan Amendment No. 60.
Since our March 1S letter, it has come to our attention that the site of the proposed store
contains a small woodiot. This woodlot was identified by the City's woodlot inventory that was
completed in the 1990's. The woodiot is also shown on the Region's electronic mapping
system. However, the Region's Core Natural Heritage map recently adopted as part of
Regional Policy Plan Amendment 187 does not identify the woodlot site as part of the Core
Natural Heritage System. Notwithstanding the Core Natural Heritage map, the site does contain
a woodlot and as such may satisfy the definition of a woodiot under the Region's Tree
Conservation By -law. As a result, a Tree Saving Plan prepared by a qualified consultant should
be submitted to the City as part of the approval process. The Plan should include an inventory
of the woodiot that identifies any significant tree species, assesses the overall health of the
woodiot and evaluates any connections to adjacent natural heritage areas. It is expected that
this inventory would form the basis of any recommendations in the Tree Saving Plan.

Further to your recent circulation of a Tree Preservation Plan prepared by Terraplan Landscape
Architects Inc., the following comments are provided for your consideration.
The plan provides extensive details on the inventory of existing trees on the site including those
that have been planted as part of the landscaping provided for the existing Niagara Square
development. The Region's Tree and Forest Conservation By -law, however, is intended to
address development that may affect natural woodlands that form part of the natural heritage
system. In this regard, the woodlot that requires consideration for tree preservation is located at
the southeast comer of Pin Oak Drive and McLeod Road where the new Canadian Tire store is
being proposed. Unfortunately there does not appear to be any efforts for tree preservation
provided as all existing trees will be removed. The Region's Tree and Forest Conservation By-
law stipulates that development through a site plan agreement is exempt from the By -law where
a Tree Saving Plan is approved and included in the agreement. The definition of a Tree Saving
Plan" with minimum requirements is attached for your information.
While it may be necessary to remove most of the forested area, there should be efforts made to
retain existing trees either through increased landscaped strips along McLeod.Road. and[or.Pin
Oak Drive or through transplanting trees within these areas. Further, a replanting program
using native species would also be appropriate. This would more closely reflect the intent of the
Region's Tree and Forest Conservation By -law.

1.32 "Total Basal Area" means the sum of the Basal Areas of individual trees;
1.33 "Tree" or "Trees" means any living species of woody perennial plant,
inducting its root system, which has reached or can reach a height of at
least 4.5 meters at physiological maturity;
1.34 "Tree Marker" means a person certified to mark trees as a result of
successfully completing the Ministry of Natural Resources Tree Marker
course; or a Registered Professional Forester; or a member in good
standing of the Ontario Professional Foresters Association;
1.35 Zrreei ..Saving Plan' means a plan, prepared for the purpose of protecting
ana- reserving trees on properties where development or disturbance of
the natural forest cover is to occur. Such plans shall attempt to retain as
many trees as possible and as a minimum shall indude all of the
following:

1.35.I a statement indicating that the plan conforms to the

1.36 Wildlife" means all wild mammals, binds, reptiles, amphibians, fishes,

with a density of at least:
1.37.a 1,000 trees, of any size, per hectare;
1.37.b 750 trees, measuring over five (5) centimetres in di-
ameter at DBH, per hectare;
1.37.c 500 trees, measuring over twelve (12) centimetres, in
diameter at DBH, per hectare; or
1.37.d 250 trees, measuring over twenty (20) centimetres, in
diameter at DBH, per hectare;
but does not include:
1.37.f a cultivated fruit or nut orchard;
1.37.g a plantation established for the purpose of producing
Christmas trees and which is being actively managed
and harvested for the purposes for which It was
planted, except that this does not refer to plantations
that have ceased being managed or harvested for their
ilitind OM or
1.37.h a bona fide tree nurser* that ls being actively managed
and harvested for the purposes for which it was

Further to your circulation received January 9 2007 the Ministry has reviewed the above
noted application in accordance with the requirements under the Ministry's Public
Transportation and Highway Improvement Act. We provide the following comments:
In general, the applicant should be aware that future development of these lands will
require Ministry review and approval. All proposed permanent buildings and structures both
above and below ground, utilities, frontage roads, fire routes, essential parking, and stormwater
management ponds and associated berms, must be set back 14.0 metres from the Highway QEW
property line.
The applicant will be required to submit a full scale (1:500) site plan a site servicing and
grading plan and a detailed stormwater management plan and report indicating the changes in
drainage run -off caused by the development, and the intended treatment of this calculated runoff
as it impacts on the Highway QEW Right -of -way, The applicant will also be required to submit a
Traffic Impact Study indicating the existing and future projected traffic volumes and patterns as
it impacts the Highway QEW/Montrose Road Interchange. The Ministry will provide more
detailed comments when a formal site plan is submitted.
This land is within the Ministry's area of Permit Control and the applicant should be made
aware that Ministry building/land -use permits will be required prior to any grading and
construction on these lands. Separate building/land -use permits are required for each stormwater
management pond serving this subdivision. Sign permits may be required as well. Permits must
be obtained from Mr. David Brown, Permits Officer (416) 235 -4081, at the above captioned

Families of children with congenital and acquired heart disease, adults with congenital heart defects, and
the professionals who work with them are joining forces to have February 7 -14th proclaimed as
"Congenital Heart Defect Awareness Week."
As a resident of Niagara Falls, I am for the second year, requesting that you help us reach our goal by
making an executive proclamation declaring this special week in February.
I am the parent of a nearly 3 year old child, Kristopher Wilson, born with a Congenital Heart Defect called
critical aortic stenosis. He has undergone 2 valvuloplasty procedures so far and will endure many, many
more procedures throughout his entire life, including open heart surgery, unless of course medical
advances are made, and minimally invasive techiques are made available to repair his heart defect.

I would be extremely proud if my city would participate in making February 7 -14th a special week to
recognize people born with heart defects, to remember loved ones who lost their battle to CHD, and to
honor the dedicated health professionals who work with us. I have included a rough draft of what I
imagine a proclamation would look like., or statistics that you might include in one.
I would be most grateful if you could sign the proclamation as soon as possible so that we can recognize
this in the month of February. Congenital Heart Defects are the number one cause of death under the age
of one and the number one birth defect. Your honouring of this event, and reading at council meeting, thus
airing on cable 10, will have a profound impact on thousands of families and individuals. I thank you for

WHEREAS, Congenital Heart Defects are the most frequently occurring birth defect and the leading
cause of birth defect related deaths worldwide; and
WHEREAS, Families across Canada are facing the challenges, hardships and uncertainties of raising
children with Congenital Heart Defects; and
WHEREAS, Currently one of every 85 children is born with a Congenital Heart Defect and one of every
250 adults has a Congenital Heart Defect; and
WHEREAS, Some Congenital Heart Defects are not diagnosed until months or years after birth; and
WHEREAS, Undiagnosed Congenital Heart conditions cause many cases of sudden cardiac death in
young athletes; and
WHEREAS, Despite these statistics, newborns and young athletes are not routinely screened for
Congenital Heart Defects; and
WHEREAS, A disproportionately small amount of funding is available for Congenital Heart Defect
research and support; and
WHEREAS, Congenital Heart Defect Awareness Week provides an opportunity for families whose lives
have been affected to celebrate life and to remember loved ones lost, to honor dedicated health
professionals, and to meet others and know they are not alone; and
WHEREAS, The establishment of Congenital Heart Defect Awareness Week will also provide the
opportunity to share experience and information with the public and the media, in order to raise public
awareness about Congenital Heart Defects;
THEREFORE, Be it resolved by Mayor Ted Salci of Niagara Falls, that February 7 -14, 2007, be
proclaimed as Congenital Heart Defect Awareness Week and encourages all citizens to increase

RE: Request for Exemption Under Noise Control By -law 2004 -105
Staff has received the attached request for an exemption under its Noise Control By -law
from the contractors working on improvements to Highway 405.
As is custom in major repairs to 400 series highways, construction is lengthy and usually
takes place overnight. Nighttime construction minimizes traffic impacts on the community.
The Noise Control By -law (2004 -105) prohibits construction 7:00 p.m. and 7:00 a.m.
during the week days and between 7:00 p.m. and 9:00 a.m. on weekends and statutory
holidays.
Section 7 of the noise by -law does allow for an application for an exemption under the
by -law, however, such an exemption is not to be in excess of six (6) months. The
construction in question is slated from June 2007 to November 2008.
Council faced a similar situation prior to work commencing on the Niagara Tunnel Project.
The solution was to amend the by -law. Report CD- 2005 -07, pertaining to the Niagara
Tunnel Project, states:
Currently, Schedule 4 of the noise by -law exempts the following:
4. Incidental noise from any activity of the City or the Regional Municipality of Niagara,
their employees, agents or contractors, associated with the construction, repair,
performance or maintenance of essential municipal services.
It would seem reasonable to include Ontario Power Generation and ,even, Niagara Falls
Hydro under this section of the by -law. Unfortunately, staff did not contemplate this at the
time of drafting the by -law.
Staff is proposing an amendment to the Noise Control By -law that will exempt the superior
levels of government their agents or contractors that are engaged in the construction,
repair, performance or maintenance of an essential public service.
RECOMMENDATION: That Council approve the amendment to Noise Control By -law
(2004 -105) listed under the by -law section of the agenda.

Highway 405 Improvements
From QEW to the Queenston Lewiston Border Crossing
Noise By -Law Exemption
We have been retained by the Ministry of Transportation (MTO) to undertake the detail design
for the improvements for. Highway 405 from QEW to the Queenston- Lewiston Border Crossing.
Subject to confirmation of project funding, the MTO intends to tender this work to begin in
June 2007 and will continue until November 2008. In addition, the Contractor's operations will
be restricted in the Contract by traffic constraints that will limit the Contractor's ability to utilize
some access points to off -peak periods only.
It is anticipated that, in order to meet the above construction schedule under the operational
constraints, the Contractor may choose to carry out some work at night. We, therefore, would
request an exemption to the City of Niagara Falls Noise Control By -Law for this work.
The construction at night will generally include embankment repairs on the
Highway 405 /Stanley Avenue W -N /S Ramp. Other night works on the Highway 405, within the
limits of the City of Niagara Falls, also include the following activities:

0 Structural bridge rehabilitations at St. Paul Avenue twin overpass (eastbound
and westbound structures)

That the Council vote on the various citizen appointments for advisory committees and
boards.
BACKGROUND:
As mentioned in CD- 2007 -03 from the January 22n agenda, advertisements were placed
in the Niagara Falls Review for appointments to various citizen appointments. Council is
requested to vote on these appointments in the matter established at the last meeting.
The appointments for the successful applicants will take effect immediately, with the
exception of the Committee of Adjustment. In Tight of a Committee of Adjustment meeting
scheduled for February 6', those appointments will not take effect until the appointments
by -law has formally been passed at the next Council meeting.
Appointments for the Niagara District Airport have been advertised and applications
received. The agreement for the Niagara District Airport states that a nominating
committee will scrutinize the applications and determine a short list based on experience
and other factors, interview short list applicants and forward the recommendations of the
Nominating Committee to Council; therefore, th appointments for the Niagara District
Airport Commission will occur at a subsequent meeting.
A package of the application of the various applicants has been included in the Council
package.

the respective Councils after considering the recommendation of the Commission.
c) A Nominating Committee consisting of the Airport Liaison Committee, together with the
respective Council representatives of the Commission shall be responsible for reviewing
a list of candidates submitted by respective clerks of each municipality pursuant to a
process outlined herein. The seven additional members shall be appointed for a term of
four years by Council of each municipality unless for such lesser period as may be
determined by the appointing Council. The parties agree that the members shall continue
to hold office until their successors are appointed. The process for determining
prospective members of the Commission shall be as follows:
i) Each Municipality will advertise in the local newspaper, and the City Clerk will
receive applications for open positions on the Commission before the end of
December.
11) The City Clerk of each Municipality will forward the applications to the Nominating
Committee of the Commission. The Nominating Committee will scrutinize the
applications and determine a short list based on the expertise, experience, industry
knowledge, business experience or background in financial, legal, accounting
and /or marketing experience and overall beneficial participation on the Commission,
in consultation with the respective Council representative of the Commission
iii) The Nominating Committee will interview the applicants on the short list and present
their recommendations, to the Commission for approval.
iv) The Commission will forward its recommendations, together with reasons for their
selection, of proposed candidates to each of the respective municipalities for their
consideration in making the necessary appointments. Council shall not be required
to appoint those recommended by the Commission. Appointments will be made by
the appropriate Municipality.
d) For the purpose of providing continuity, the Commission may recommend the term of
appointment to respective Councils, when submitting a list of recommended additional
members. The Commission's suggested term for the appointment of recommended
members shall ensure the necessary continuity of experienced members on the
Commission. Notwithstanding the four year term, nothing shall prevent the reappointment

BACKGROUND:

F- 2007 -04
The Corporation of the City of Niagara Falls requires an interim tax levy. This requirement
is necessary because of two factors. Firstly, the Corporation requires operating funds so
as to meet its financial obligations. In addition to the requirement for its own operating
needs, the Corporation must also meet its statutory obligations for collecting taxes on
behalf of the Region of Niagara and the local school boards. The statutory requirement
of the City is to provide quarterly payments to both the Region of Niagara and the local
school boards.
Both of these factors necessitate the interim tax levy. Failure to provide an interim tax levy
will lead to increased borrowing by the Corporation and will result in increased interest
expenses. An interim tax levy is required to ensure the provision of the required funds to
minimize borrowing costs.
The authority to collect this interim tax levy is prescribed in section 317 of the Municipal
Act. The interim tax levy is subject to the following rules:
1. The amount levied on a property shall not exceed the prescribed percentage, or 50
percent if no percentage is prescribed, of the total amount of taxes for municipal
and school purposes levied on the property for the previous year.
2. The percentage used in the levy may be different for different classes but must be
the same for all prope ies in a property class.

3. Allows the municipality to use an entire years taxes for a property in the calculation
of the interim tax levy in the situation that a full year was not charged in the previous
year.
Staff has developed the interim tax levy based on these rules and has determined that the
amount due for the interim levy for each property will not exceed 50% of the annualized
assessment used in determining the 2006 City tax levy.
The due dates for this interim tax levy are in accordance with the new Municipal Act. The
interim bill will be due on two dates. As per the regulations outlined in the new Municipal
Act, property owners must be provided 21 days notice before payment. The due dates are
consistent with the regulation and will be February 28, 2007 and April 30, 2007. In 2006,
these dates were February 28, 2006 and April 28, 2006.
An interim levying by -law is required to establish the amount of the interim levy. This has
been prepared and appears on this evening's Council Agenda for passage.

RECOMMENDATION:
That Council authorize staff to proceed to permanently close Part 2 on Reference Plan
59R -9107 being a portion of an unused road allowance "road located west of Stanley
Avenue and northwest of Portage Road.

Part 2 as shown on Reference Plan 59R -9107 is a small strip of land located west of
Stanley Avenue and northwest of Portage Road, as shown hatched on Attachment "1
This road is approximately 358.2 square meters in area.
Legal Services has received a request from 1251600 Ontario Limited to permanently close
the road and convey it to them so that it can be incorporated into their future development.
The request was received November 23, 2006, and was circulated to all City departments,
the result of which was that Staff had no objections to the road being permanently closed,
declared surplus and conveyed to 1251600 Ontario Limited. The first step in proceeding
to sale, given that this is an open road, is to permanently close the road, with any
declaration of surplus or sale to follow the registration of that closure. As such, it is our
recommendation that the road be permanently closed.

1. That Council proclaim the week of February 19 to February 25, 2007 as Heritage
Week in the City of Niagara Falls as recommended by the Municipal Heritage
Committee.
2 That Council adopt the attached listing of heritage properties within the City as the
Register of Heritage Properties.
Since 1974, Heritage Canada has recognized the third Monday in February as
Heritage Day. In 1985, the Province of Ontario expanded this program to become
Heritage Week due to Ontario's rich and diverse heritage. The theme for Heritage
Week comes from the Heritage Canada Foundation.
This year's theme is "Places for People Our Heritage of the Everyday The
Municipal Heritage Committee adopted the following motion:
"That Council proclaim the week of February 19 to February 25, 2007
as Heritage Week in the City of Niagara Falls
A proclamation is included in tonight's Council package agenda. Various activities
are being organized to celebrate Heritage Week including a three day display
February 16, 17 and 18, 2007 at Niagara Square to kick off Heritage Week
celebrations.

2. Municipal Register of Heritage Properties
Recent amendments to the Ontario Heritage Act require a municipality to keep a
register of properties of cultural heritage value and interest. This register is to
contain all designated properties and may also contain all properties believed to be
of cultural heritage value and interest to the community. The register provides an
open and accessible database ensuring information about our built and cultural
heritage is available to all.
Since the inception of the Municipal Heritage Committee (formerly LACAC) in the
late 1970s, an Inventory of Heritage Resource Properties has been maintained as
a registry. The registry is updated on a regular basis. To reflect changes in the
Heritage Act and Provincial direction, this inventory should be adopted as the
Register of Heritage Properties. The register is available on the City's website. A
hard copy is attached for Council's information.

RECOMMENDATION:
1. That the changes to the 2006 Cemetery Fees, as specified in the attached
Cemetery Fee Schedule, be approved effective March 1, 2007.
2. That following City Council's approval, the 2007 Cemetery Fee Schedule be
forwarded to the Ministry of Consumer and Commercial Relations, Cemeteries
Branch, for review and approval.
In reviewing the recommended annual cemetery rates, a comparison with the fees of other
cemeteries, including municipal, and private operators is undertaken. Approximately ten
municipal cemeteries were surveyed recently to compare prices, including municipal
cemeteries within the Niagara Region and a number of municipal cemeteries outside the
region including Brampton, Oakville, Kitchener and Owen Sound.
The recommended fees, as attached, reflect a 3.% overall increase for lot sales,
interments and cemetery surcharges. Stamford Green Columbarium (cremation niches)
fees reflect an increase of 8 consistent with the business plan to ensure these
columbarium prices are increased, incrementally, overa five- yeartime line to be in line with
the Fairview columbarium fees.

That the unit prices submitted by the lowest tender Baiocco Construction Corp. be
accepted and that the Mayor and City Clerk be authorized to execute the necessary
agreement.
The Tender Opening Committee, in the presence of the City Clerk, Mr. Dean Iorfida,
opened tenders on Tuesday, January 30, 2007 at 1:30 p.m. for the above noted
contract.
Tender documents were picked up by thirteen (13) Contractors and three (3) bids were
received.
Listed below is a summary of the totaled prices, excluding GST, received from the
Contractors.
1. Baiocco Construction Corp. St. Catharines $3,284,480.00
2. FCM Construction Ltd. Oakville $3,600,000.00
3. V. Gibbons Contracting Ltd. Fort Erie $5,176,135.47 (corrected)
The lowest tender was received from Baiocco Construction Corp. in the amount of
$3,284,480.00. This contractor has previously performed similar type projects for the
City. We are therefore of the opinion, that this contractor is capable of successfully
undertaking this project.
The engineer's estimate forr this contract was $2,299,365.00.

Construction Limited for Part 1 on Reference Plan 59R -9460.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. A Transfer from The Corporation of the City of Niagara Falls to W.S. Walters Construction
Limited, in the form attached hereto, providing for the return of a catch basin to W.S. Walters
Construction Limited of Part 1 on Reference Plan 59R -9460, is hereby approved and authorized.
2. The receipt of a Grant of Easement from W.S. Walters Construction Limited to The
Corporation of the City of Niagara Falls, in the form attached hereto, providing for an easement to
the City for the purpose of providing the City with access to the catch basin over Part 1 on Reference
Plan 59R -9460, is hereby granted to The Corporation of the City of Niagara Falls by W.S. Walters
Construction Limited, in consideration for the Transfer that is approved and authorized as outlined
in 1 above.
3. The Mayor and Clerk are hereby authorized to execute the Transfer and all other
documents that may be required for the purpose of carrying out the intent of this by -law.
4. The City Solicitor is hereby authorized to take all necessary steps to carry out the intent of
this by -law.
5. The Clerk is hereby authorized to affix the corporate seal thereto and to deliver such
documents.

This is an easement in gross.
The Transferor hereby transfers, sells, grants and conveys in perpetuity to the Transferee, its
successors, assigns, servants, agents, contractors and workmen, a free and unencumbered easement
upon, under, along, over, across and /or through the lands described as Parcel 187 -1 Section 59M-
129; Lot 187 Plan 59M -129 Niagara Falls being Part 1 on Reference Plan 59R -9460, together with
Part Township Lot 87 Stamford, Parts 8 10 on 59R -1881 as in ST55093 ST55050, together with
Part Township Lot 98 Stamford, Part 11 on 59R -1881 as in R0215177, in the City of Niagara Falls,
hereinafter referred to as the Easement Lands, to enter, lay, construct, install, operate, maintain,
inspect, alter, repair or replace any such municipal services or surface drainage works, including all
other works as required by the Transferee "the Works together with all appurtenances,
attachments, apparatus, appliances, markers, fixtures and equipment which the Transferee may deem
necessary or convenient thereto for the Works together with a right to enter to the Transferee, its
successors, assigns, servants, employees, agents, contractors and workmen for ingress and egress at
any time and from time to time over, along and upon the Transferor's lands abutting the Easement
Lands on foot and or with vehicles, supplies, machinery and equipment necessary or incidental to
the exercise and enjoyment of the easement hereby transferred.
The Transferee shall have the right at any time and from time to time to remove any boulder or rock
and to sever, fell, remove or control the growth of any roots, trees, stumps, brush or other vegetation
on or under the Easement Lands.
The Transferor covenants to keep the land clear of all brush, trees and other obstructions save and
except for the Works constructed together with all appurtenances, attachments, apparatus,
appliances, markers, fixtures and equipment as may be necessary for the use of the easement.
The Transferor shall have the right to use and enjoy the surface of the Easement Lands except that
such use and enjoyment shall not interfere with the rights of the Transferee hereunder. Without
limiting the generality of the foregoing, the Transferor shall not, without the prior written consent
of the Transferee, place, erect or permit the erection on the Easement Lands any building, structure,
fence foundation, pavement or other obstruction of any nature whatsoever so as to obstruct, hinder
or prevent the exercise and enjoyment by the Transferee of its right hereunder. Should any such
obstruction or hindrance be placed upon the Easement Lands the Transferee, in addition to its other
rights, may enter and remove same and shall not thereby render itself liable in damages to the
Transferor.
Notwithstanding any rule of law or equity, the Works constructed by the Transferee together with
all appurtenances, attachments, apparatus, appliances, markers, fixtures and equipment shall be
deemed to be the property of the Transferee even though the same may have become annexed or
affixed to the Easement Lands.
The Transferee shall have the absolute and unfettered right to assign or transfer its rights hereunder
in whole or in part to another government body or agency or to a utility company and shall not be
bound to give notice thereof to any party.
The Transferor shall have the right to assign or transfer its rights hereunder in whole or in part upon
giving notice to the Transferee and obtaining consent from the Transferee.
The Transferor covenants that:
I. subject to the foregoing it has the right to convey this easement and right to enter to the
Transferee;
ii. the Transferee shall have quiet enjoyment of the rights, easement and right hereby
transferred;
iii. the Transferee or its successors and assigns will execute such further assurances or this
easement and do such other acts (at the Transferee's expense) as maybe reasonably required;
and
iv. the Transferor has not done, omitted or permitted anything whereby the Easement Lands is
or may be encumbered (except as the records of the Land Registry Office disclose).
This transfer shall extend to, be binding upon and enure to the benefit of the respective heirs,

A by -law to authorize the execution of an Amendment to the Licence Agreement with The Niagara
Parks Commission respecting the installation of a sign on the railroad bridge located on McLeod
Road at Marineland Parkway, Niagara Falls.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. An Amendment to the Licence Agreement dated the 12 day of July, 2004 and made between
The Niagara Parks Commission as Licensee and The Corporation of the City of Niagara Falls
as City, and in particular, an amendment to the size of the signs and the commencement of
the term of the Agreement, as attached hereto, is hereby approved and authorized.
2. The Mayor and Clerk are hereby authorized to execute the said Amendment to the Licence
Agreement.
3. The Clerk is hereby authorized to affix the corporate seal thereto and to deliver the said
Amendment to the Licence Agreement.

THE NIAGARA PARKS COMMISSION
Hereinafter referred to as the "Licensee"
OF THE FIRST PART;
and
THE CORPORATION OF THE CITY OF NIAGARA FALLS
Hereinafter referred to as the "City"
OF THE SECOND PART.
WHEREAS this Agreement is supplemental to an Agreement (the "Agreement dated the 12 day
of July, 2004, and made between the City and the Licensee, whereby the City granted to the
Licensee, a Licence for the use of certain space on the lands owned by the City for an advertising
display sign as described in the Agreement, for a term of five (5) years commencing the 12th day of
July, 2004;
AND WHEREAS the parties intend to vary certain provisions of the Agreement in the manner set
out below.
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the mutual
covenants, conditions and agreements herein contained, the parties agree as follows:
1. The provisions of the Agreement are amended as of the 1s day of December, 2006, in the
following manner:
(a) Paragraph 1.2 of the Agreement is deleted and the following is inserted in lieu
thereof:
The City grants to the Licensee, and the Licensee accepts, a limited, non exclusive
right to use the applicable portion of the Lands as designated by the City (the "Site
for the installation and maintenance, at the Licensee's sole cost and expense, of one
(1) two -sign structure (each of the two signs being 4'.3" x 20' in size) designed for
advertising and direction purposes, more specifically the advertising of the Niagara
Falls Great Gorge Adventure; identifying Access to Falls Parking and Shuttle; and
providing directions to the Rapids View Parking only, (the "Sign on the Lands.
(b) Paragraph 2.1 of the Agreement is deleted and the following is inserted in lieu
thereof:

The term of this Agreement (the "Term shall be for a period of five (5) years
commencing on the 12t day of July, 2005 (the "Commencement Date and
terminating on the 11 day of July, 2010.
(c) Paragraph 2.2 (a) of the Agreement is deleted and the following is inserted in lieu
thereof:
For the first, second and third years of the term of this Agreement, the sum of
SEVEN THOUSAND AND FIVE HUNDRED DOLLARS ($7,500.00), payable
on the 12t day of July, 2007; and
(d) Paragraph 2.2 (b) of the Agreement is deleted and the following is inserted in lieu
thereof:
For the fourth and fifth years of the term of this Agreement, the sum of TWO
THOUSAND AND FIVE HUNDRED DOLLARS ($2,500.00) per annum, payable
on the 12t days of July, 2008 and 2009.
2. The Agreement, as amended, shall continue in full force and the covenants, conditions and
provisions contained in the Agreement, in all other respects, are confirmed.

attested by the hands of their proper signing Officers and the said signing Officers certify that they

a local municipality, before the adoption of the estimates for the year, pass a by -law levying amounts
on the assessment in each property class in the local municipality, rateable for local municipal
purposes.

A by -law to adopt, ratify and confirm the actions of City Council at its meeting held on the 5th day
of February, 2007.
WHEREAS it is deemed desirable and expedient that the actions and proceedings of Council as
herein set forth be adopted, ratified and confirmed by by -law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. The actions of the Council at its meeting held on the 5th day of February, 2007 including all
motions, resolutions and other actions taken by the Council at its said meeting, are hereby
adopted, ratified and confirmed as if they were expressly embodied in this by -law, except
where the prior approval of the Ontario Municipal Board or other authority is by law required
or any action required by law to be taken by resolution.
2. Where no individual by -law has been or is passed with respect to the taking of any action
authorized in or with respect to the exercise of any powers by the Council, then this by -law
shall be deemed for all purposes to be the by -law required for approving, authorizing and
taking of any action authorized therein or thereby, or required for the exercise of any powers
thereon by the Council.
3. The Mayor and the proper officers of the Corporation of the City ofNiagara Falls are hereby
authorized and directed to do all things necessary to give effect to the said actions of the
Council or to obtain approvals where required, and, except where otherwise provided, the
Mayor and the Clerk are hereby authorized and directed to execute all documents arising
therefrom and necessary on behalf of the Corporation of the City ofNiagara Falls and to affix
thereto the corporate seal of the Corporation of the City of Niagara Falls.

CITY OF NIAGARA FALLS
By -law No. 2007
A by -law to amend By -law No. 2004- 105, being a by -law to prohibit and regulate noise in the City
of Niagara Falls.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. By -law 2004 -105 is amended by deleting section 4 under Schedule 4 and replacing it with
the following:
4. Incidental noise from any activity of the City, Regional Municipality of Niagara,
Ontario Power Generation, Niagara Falls Hydro Inc. or the Provincial or Federal
levels of government, their employees, agents or contractors, associated with the
construction, repair, performance or maintenance of essential public services.
2. By -law 2005 -073 is hereby repealed.
3. That this by -law shall come into force on the day upon which it is passed.

CITY OF NIAGARA FALLS
By -law No. 2007
A by -law to adopt, ratify and confirm the actions of City Council at its meeting held on the 5th day
of February, 2007.
WHEREAS it is deemed desirable and expedient that the actions and proceedings of Council as
herein set forth be adopted, ratified and confirmed by by -law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. The actions of the Council at its meeting held on the 5t day of February, 2007 including all
motions, resolutions and other actions taken by the Council at its said meeting, are hereby
adopted, ratified and confirmed as if they were expressly embodied in this by -law, except
where the prior approval of the Ontario Municipal Board or other authority is by law required
or any action required by law to be taken by resolution.
2. Where no individual by -law has been or is passed with respect to the taking of any action
authorized in or with respect to the exercise of any powers by the Council, then this by -law
shall be deemed for all purposes to be the by -law required for approving, authorizing and
taking of any action authorized therein or thereby, or required for the exercise of any powers
thereon by the Council.
3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls are hereby
authorized and directed to do all things necessary to give effect to the said actions of the
'Council or to obtain approvals where required, and, except where otherwise provided, the
Mayor and the Clerk are hereby authorized and directed to execute all documents arising
therefrom and necessary on behalf of the Corporation of the City of Niagara Falls and to affix
thereto the corporate seal of the Corporation of the City of Niagara Falls.
