e) MW-2007-11 - Corwin Avenue Traffic Operations Review
It was ORDERED on the motion of Councillor Thomson and seconded by Councillor Fisher that;
a parking restriction be implemented on the west side of Corwin Avenue between Lundy's Lane
and a point 75 metres south of Lundy's Lane;
1. A heavy vehicle restriction be implemented on Corwin Avenue between Lundy's Lane
and Stokes Street;
2. A heavy vehicle restriction be implemented on Stokes Street between Corwin Crescent
and the eastern limit of Stokes Street; and,
3. A "no right turn" restriction be implemented facing outbound motorists at the future
commercial development via Corwin Avenue.

b) Councillor Fisher requested that staff investigate the Clean Yard By-law being instituted
in Niagara-on-the-Lake. The Director of Municipal Works advised that the City already
has such by-laws in place and would provide Council with the information.
c) It was ORDERED on the motion of Councillor Wing and seconded by Councillor Kerrio
that staff request that the Region of Niagara reduce the speed limit on Bigger Road from
Montrose ,Road to Moyer Road to 60 km/h and that staff request additional speed limit
enforcement from the Niagara Regional Police.

Sign By-law Variance
RECOMMENDATION:
That the Committee deny the variance request.
BACKGROUND:
The Committee may recall that a similar request (BBS-2006-09 attached) was denied at
the December 11, 2006 meeting. The applicant is again requesting that this proposal be
treated as the rebuilding of the first party signs at this location. This construction cannot
be considered a rebuilding project as the former signs on this building were Fascia and/or
Wall signs and were removed some time ago. The proposed sign is a free standing
Billboard.
Planning and Development staff has reviewed the request by Vann Media Group to erect
a sign at 5440 Stanley Avenue. Staff cannot support the request for the following reasons:
1. The subject lands are designated Tourist Commercial in the Official Plan. Roberts
Street is included as part of the open space system of the tourist area as a
tree-lined boulevard. This concept is further elaborated on in the Streetscape
Master Plan which states that Roberts Street is to act as a gateway and parkway as
it is one of the first impressions a visitor to Canada will have upon entry to the
country. These concepts have been acted upon with the construction of the
greenspace along Roberts Street as a three-way partnership between the City, the
Region and the Niagara Parks Commission. A sign of the magnitude proposed
would not be consistent with the vision of this area. An open space area should be
devoid of large-scale signage and other visual distractions.

2. The request is for the "rebuilding of the first party sign". Staff would disagree with
this notion; the proposal is to construct a new sign on the property. The applicant
has provided a visual impact study of the sign. The study demonstrates clearly that
the sign is a billboard and will have a deleterious visual impact on the area.
3. Planning has been working together with Municipal Works and Legal Services to
develop a new comprehensive sign by-law. The proposed sign, which should be
considered a billboard, does not comply in several. respects with the proposed
by-law. Specifically:
· billboards are not to be permitted on lands designated Tourist Commercial;
· the area of the billboard exceeds the maximum permitted;
· there is to be a separation of at least 300 metres between billboards;
· the billboard exceeds the maximum height permitted; and
· the by-law only permits a certain number of billboards within the City.
Although the revised Billboard has been considerably reduced in size from the previous
application, it is still a Billboard that exceeds the maximum allowable height, is within 200
feet of an Open Space area, requires a minimum of 1000 feet separation from another
Billboard and is not permitted on lands designated Tourist Commercial.
Notwithstanding Council's decision on the proposal to vary the Sign By-law, a sign permit
cannot be issued until this proponent obtains approval from the Ministry of Transportation
and the Regional Municipality of Niagara.

"Aside from regulatory signs, the intent of the Roberts Street Streetscape Master plan was
to provide a park like/ gateway presence into the Falls. This, in part, is accomplished by
not permitting the construction of a Billboard and permanent advertising ground signs
within the landscape area. As such we do not support this application, since it is not in
keeping with the intent of the Master Plans."
Niagara Parks Commission
The Niagara Parks Commission are a "main partner in the Roberts Street property" along
with the Region and concur with their comments.

" City staff do not agree with the contention that this sign is a continuation of the signs that
were painted on the walls of the building in the past, for at least three reasons. There is
no evidence that a permit was granted for these signs. The use of these signs has been
voluntarily discontinued by the property owner, and the proposed sign is completely
different in concept and impact than the previous signs. Paint on a wall is not the same
thing as a structure on a roof."
"The issue of whether or not this sign is a billboard is a red herring. It does not matter what
type of sign this is. It still requires the approval of Council and is too big for this location."

BRIEF DESCRIPTION OF THE SUBJECT PROPERTY: The subject property is
located on the east side of Stanley Avenue and just south of Hwy #420 in the central
sector of Niagara Falls. The site is level to all boundaries and is improved \1'lith a 2-storey
building. Landscaping is minimal and consists of sod and a paved parking area with

BACKGROUND:
Council will recall that this location was used as a private tourist inforIJ:lation bqoth for many years
and has been vacant the past few years. Previously, the bUildirig had several:signs, all of which met
the by-law requirements at the time. The signs have subsequen~ly been removed, however; Vann
Media Group, with its current request, has provided photo evidence of how they once appeared.
Staff is of the opinion that the owners are proposing a large billboard sign, however, the sign permit .
application submitted by the proponent requeSts a ground sign. Staff feels that regardless of how ' the
sign is classified, this proposal greatly exceeds the requirements of the sign by-law.

2. The request is for the "rebuilding of the first party sign". Staff would disagree with this
notion; the proposal is to construct a new sign on the property. The applicant has not
provided any justification for the sign nor any demonstration of its visual impacts.
3. Planning has been working together with Mlinicipal Works and Legal Services to develop
a new, comprehensive sign by-Iawo The proposed sign, which should be considered a
billboard, does not comply in several respects with the-proposed by-law. Specifically:
billboards are not to be permitted on lands designated Tourist Commercial;
the area of the billboard exceeds the maximum permitted;
there is to be a'separation of at least 300 metres between billboards;
the billboard exceeds the maximum height permitted; and
the by-law only permits a certain number of billboards within the City.

The site is improved with a 2-storey building, estimated to be ::22 years in age. The main
floor is wide open and was formerly used as a tourist information centre. There is a two
2-piece washrooms, a small ticket booth and another small office. The 2nd floor contains
two offices and a kitchen area.
The building was designed to serve a specific tourist commercial related use and the
building condition was in severe disrepair, broken windows, boarded up walls and
windows and taxes were three years in arrears.

Wesley Place - Parking Review
RECOMMENDATION:
That the existing "no parking" restriction on the southwest side of Wesley Place be
extended to Eastwood Crescent and Epworth Circle.
BACKGROUND:
Staff has conducted a parking review of Wesley Place at the request of an area
resident to determine whether revisions to the existing parking control are required.
Concerns were raised with motorists parking on the road, obstructing vehicle passage
and deteriorating boulevards.
Wesley Place extends a length of 67 metres and contains either front or side yard
flankages to four residences. The driveway to each home is via Wesley Place. At this
time, there is a "no parking" restriction on the entire northeast side and on the
southwest side from a point 29 metres northwest of Eastwood Crescent to a point 47
metres northwest of Eastwood Crescent. Based on the narrow 6.6 metre road width, it
is recommended thata parking restriction be installed on both sides of the roadway.
This is to ensuresafetyand unimpeded road width for emergency and maintenance
personnel. Both homeowners where the extension of the parking prohibitions will
