As per Schedule 6 By-law No. 2001-31 Every person who carries on the business of a bill poster, advertising sign
painter, bulletin board painter, sign poster, sign installer, or bill distributor within the Municipality shall obatin a
licence and pay an annual licence fee in accordance with schedule 1 to this By - law.
Ken Feren (Feren Sign Systems) had a business IIicence in 1999, 2000, 2001, 2004 & 2005, His licence has
expired on Dec 31/05 . The licence fee is 100.00

On behalf of the Niagara Falls Family Literacy Event Planning Committee, it is with great pleasure that we invite you to
attend the fourth annual Niagara Falls Family Literacy Event 011 April 14, 2007,.
Over the last three years, this free event for families has gained recognition in the community asa wonderful celebration 01
literacy lor our youngest readers. It is an interactive day that is designed to engage the emergent reader through innovative
art, music, and storytelling.
The theme of this year's event is Move it, Shape it, Read it! It will feature renowned children's author and illustrator
Barbara Reid, who will be present to provide readings 01 her award-winning and captivating books. There will also be live
musical Elntertainment, creative activities, a book sale, and Iree swimming following the event. Each family will receive a
free bQO.k and take home bag full of literacy resources and activities.
The event is scheduled Irom 10:00-1:00 PM and will be held at the MacBaln Community Centre, 7150 Montrose Road,
Niagara Falls.
We hope that you join us in this celebration of literacy to encourage a love of reading in the children of Niagara Falls. Please
indicate your intention to attend by March 20, 2007 by contacting lnge Saczkowski at isaczkow@niagarafalls.library.on.ca.

We are the land use planning consultants for Modern Corporation, the owners of industrial
properties located at 1919, 1959 and 2025 Fruitland Parkway, and 1985 Stanley Avenue.
These properties are part of an established employment area that is located immediately to
the north of the lands subject to this application.
We understand that a Public Meeting of City Council is scheduled for Monday April 2nd to
consider applications filed on behalf of 1251600 Ontario Limited for properties located
along Portage Road and Stanley Avenue. Based on available information, it is clear that
these applications would permit introduction of sensitive land uses in close proximity to
existing industrial uses which raises concerns of potential land use conflicts with the
established employment uses including Modern Corporation.
The properties of Modern Corporation are part of the Fruitland Parkway industrial
subdivision that includes a mix of industrial uses. The operations at the Modern facility
include significant heavy truck movements associated with their waste management
division. This truck traffic occurs throughout dClytlme hours and includes early mornings and
evenings.
The Ministry of the Environment "D" series Land U.se Planning (;uidelines provide guidance
where new sensitive land Uses are, being planned in proximity to industrial land uses.
Guideline D-6, Compatibility Between Industrial Facilities ClndSeositive I..and Uses, outlines
recommendations for potential Influence areas, areas within which there is an
acknowledged potential for adverse effects on sensitive uses created by industrial
operations.
Based on our familiarity with the existing uses within the Fruitland Parkway industrial area, it
Is our opinion that these uses exhibit characteristics of Class Ii Industrial operations. The

MOE Guidelines identify a minimum influence <lrea of 300 metres whereaclverse effects are
likely to occur. Where sensitive land uses are being proposed within this area, the MOE
Guidelines require the identification of potenti.al adverse 'effects associated with the eXisting
uses and a comprehensive assessment ofpotentialconfIicts.
It is our opinion that the approval ofthesubject applications is inappropriate and could have
a prejudiCial impact on th<l existing industrial op<lrations within the Fruitland industrial
subdivision including the Modern Facility. The proposai to permit residential land uses
within the established influence area may lead to land use conflicts and may further restrict
the ability of the existing uses to continue and possibly expand their op<lrations within the
context of the current m unicipalland use planning framework.
It is our recommendation that the sUl:ijectClpplicatlons be modified toelimin<lteany new
resldentiai uses within 300 metres of the southerly limit of the Fruitland Properties.
Alternatively, the proponents must demonstrClte to the satisfaction of the abutting industrial
owners that all aspects of the existing operations have be,en comprehensively analyzed and
all appropriate mitigation measures are integrated with the planning approvals.
In summary, it is our opinion that the consideration of the subject applications is premature
pending modifications to the proposed development, or alternatively, the completion
additional te,chnical studies to the satisfaction of the abutting irdus;trial property owners.
We would request that City Council defer oonsideration of the app1icatlons until such time as
the applicants have responded to these concerns.
We would request that this written submission be added to the formal record forthe Public
Meeting, and further, we be prOVided with written notifiCation ofthe outcome of the Public
Meeting inciuding a copy of the meeting minutes.

With more than 925 members, Wellspring Niagara Cancer Support Foundation provides free
psychological, social, emotional and informational SLipport to cancer patients and their loved ones.
Our centre provides a safe, comforting and home-like environment where patients and families can
turn when they are coping with cancer. Wellspring has made progress in responding to the need
for supportive cancer care in Niagara. Sinoe opening our doors in June 2001, demand for our
programs and our membership has consistently grown and as of January 31, 2007, Wellspring
Niagara has registered over 12,120 prograM attendanoes end CLlrrentiy provides 22 free supportive
care programs. We are also proud to welcome and host other free canoer-related programs suoh
as the Look Good Feel Betler™ program, the New Voice Club of Niagara which offers support to
laryngectomy patients and their families and most recently the Healing Journey Program, a support
. program for patients and caregivers.
As a not-for.profit, oharitable organization, Wellspring Niagara indepepdemly raises dollars to

53% of my rental groups were US citizens
41 % of my rental groups were Canadian citizens ( mostly Ontarians)
6% of my rental groups were European citizens
With reference to the number of days rented, clearly the majority were from the USA,
predominantly Ohio, NY and Massachusetts. While the recent report on tourism cited a
decrease in Americans visiting, most of my guests and inquiries have been American.

My name is Peter Kikkert and I live at 7710 Ridge Rd. in Niagara Falls. I own the
property across from Mr. Nitransky and since he's owned 14380 Montrose Rd. I have had
no complaints. My barn is located northwest of Mr. Nitransky's dwelling. I currently am
not farming chickens and have no plans to do so in the future. I do have a small herd of
cows which always stay in the barn as I have no paddocks across from 14380 Montrose
Rd. I use the land there for growing hay. Mr. Nitransky has given me his home and cell
phone numbers and encouraged me to caJl if there are any problems. I have no objections
to Mr. Nitransky's rezoning plans.

Dear Landowner:
As you are probably aware, you live within or adjacent to a unique area - the Willoughby
Marsh. The Willoughby Marsh Conservation Area is part of the larger Willoughby Marsh
Area of Natural and Scientific Interest (ANSI). Willoughby Marsh contributes significantly
to local water quality and function because it is central to the headwaters of Tee Creek,
Ussher's Creek, Lyons Creek and Black Creek. Enclosed is a map for your reference.
Because of the uniqueness of this area, the Niagara Peninsula Conservation Authority, in
partnership with the Ministry of Natural Resources and with financial support from the
Government of Canada Habitat Stewardship Program for Species at Risk, has recently
been conducting field searches in the Willoughby Marsh Conservation Area in an attempt
to locate new populations of the very rare Spoon-leaved Moss (Bryoandersonia illecebra).
The Spoon-leaved Moss is a provincially Endangered species, known from only three
locations within the province of Ontario; in Essex and Elgin Counties and near Weiland in
the Region of Niagara. These three sites are essential to the survival of this species in
Canada and to maintaining diversity and overall environmental health. Please see the
enclosed Spoon-leaved Moss Fact Sheet and Species at Risk postcard for more
information.
We ask for your assistance in protecting this species and its sensitive habitat by
ensuring no vehicular use, tree cutting or draining on Conservation Area lands and
by reporting any instances such activities which would negatively affect this area. If you
suspect you have Spoon-leaved moss on your land, you may wish to consider limiting
such activities in order to support suitable habitat for this very rare species. In addition,
you may be eligible for up to 100% property tax relief under the Conservation Land Tax
Incentive Program (CL TIP) on those portions of your property containing the provincially
significant Willoughby Marsh wetland and Area of Natural and Scientific Interest. This
program now includes all areas of Spoon-leaved Moss habitat as well.
As a final note, the Niagara Peninsula Conservation Authority and its partners are
conducting a Natural Areas Inventory (NAI) of the Region of Niagara and Haldimand
County over the next 3 years. You will be receiving more information about the NAI

Spoon-leaved Moss
Status: Spoon-leaved moss
(Bryoandersonia illecebra) is both
nationally (COSEWIC) and provincially
(OMNRI COSSARO) designated as
Endangered, and exists at only three
locations within the province of Ontario; in
Essex, Elgin and Weiland Counties. The
continued protection of these three sites is
essential to the survival of this species in
Canada and for overall diversity and
environmental health.
Features: The spoon-leaved moss
(Bryoandersonia illecebra), so-named
because its leaves are concave, is a
bryophyte and lacks a vascular (water and
mineral transport) system. This species
reproduces by spores (not seeds) .
Spores germinate in moist substrate and
eventually produce the leafy stage that we
are most familiar with, the gametophyte,
which will produce sperm and eggs. Because there are separate male and female plants, moisture is essential to
allow the sperm to swim to an egg-bearing plant. The fertilized egg grows into a sporophyte filled with tiny spores
that disperse in the air.
Range: The spoon-leaved moss occurs in eastern North America, ranging from Texas and Florida, north to New
York and Ontario. I n Ontario, it is known currently from two sites in southwestern Ontario and a site near Weiland
in the Niagara region.

Threats: The spoon-leaved moss is at the northern edge of its range in Ontario, and therefore may never have
been common or widespread here. Historically, it is known from at least eight sites in Ontario, and it has
disappeared or significantly declined at five sites. It grows in humid deciduous forest and does not disperse easily
(Doubt, 2003). This type of habitat has declined significantly in southern Ontario due to intensifying urbanization,
industrial development and agriculture (Doubt, 2003). The remaining forests are often fragmented and small,
resulting in less suitable habitat and increased disturbance.
Protection: Spoon-leaved moss is currently protected through compatible land uses of healthy forests where
current populations exist. Two of the three known populations in Ontario are on public land; one is managed by
Ontario Ministry of Natural Resources and the other by the Niagara Peninsula Conservation Authority. The third
site is located on private land but is in the Cedar Creek ANSI (Area of Natural and Scientific Interest), where it can
receive some protection through stewardship initiatives. In total, the known populations cover less than 14m'.
Current research initiatives to characterize the existing patches of spoon-leaved moss and the surrounding
habitat, as well as surveys to find additional populations, are underway. It is anticipated that this information will
help to ensure the continued protection of this species and will further its recovery in Southern Ontario.

RE: Letter of Agreement between Her Majesty the Queen in right of the
Province of Ontario, represented by the Minister of Transportation for
the Province of Ontario (the "Ministry") and the City of Niagara Falls (the
"Municipality") Related to Funding Provided by the Province of Ontario
(the "Province") to the Municipality under the Ontario Bus Replacement
Program (this "Letter of Agreement")
This Letter of Agreement is in response to the Municipality's request to the Ministry
for funding, under the Ontario Bus Replacement Program (the "OBRP"), with regard
to the replacement of transit buses.
In recognition of municipalities' need to replace aging transit buses to support the
development of strong communities, increase public transportation reliability, reduce
municipal operating costs, and invest in the renewal of transportation systems, the
Ministry has created the OBRP under which the Ministry will be providing funds,
under certain conditions, to municipalities towards the capital costs of replacing
transit buses.
Any funding from the Ministry to the Municipality will be provided in accordance with
the terms and conditions set out in this Letter of Agreement and the Ontario Bus
Replacement Program (OBRP) - 2007 Guidelines and Requirements (the
"Guidelines and Requirements").

In consideration of the mutual covenants and agreements contained in this Letter of
Agreement and the Guidelines and Requirements, which have been reviewed and
are understood by the Municipality and are hereby incorporated by reference, and
other good and valuable consideration (the receipt of which is hereby
acknowledged), the Ministry and the Municipality covenant and agree as follows:
1. The Ministry agrees to provide OBRP funding to the Municipality up to a
maximum amount of $285,709 in accordance with and subject to the
terms set out in this Letter of Agreement and the Guidelines and
Requirements, payable after April 1 , 2007 upon receipt of this signed
Letter of Agreement and related authorizing municipal by-law, a certified
copy of a binding agreement between the Municipality or a transit
operator, as applicable, and a manufacturer of transit buses for the
purchase of such transit buses to be delivered in 2007, and, where
applicable, a binding operating agreement between the Municipality and a
transit operator.
2. Despite Section 1, the Municipality understands and agrees that any
amount payable under this Letter of Agreement may be subject, at the
Minister's sole discretion, to adjustment for consistency with the
agreements described in Section 1, and any other adjustments as set out
in the Guidelines and Requirements, including those related to annual
appropriations of funds by the Legislative Assembly of Ontario.
3. The Municipality understands and agrees that the funding provided under
this Letter of Agreement represents the full extent of the Ministry's and
Province's financial contribution under the OBRP and that no additional
funds will be provided by the Province, including the Ministry, for such
purposes to the Municipality for the year 2007.
4. The Municipality hereby consents to the execution by the Ministry of this
Letter of Agreement by means of an electronic signature.
If the Municipality is satisfied with and accepts the terms and conditions of this Letter
of Agreement, please secure the required signatures for the four enclosed copies of
this Letter of Agreement and return two fully signed copies to the Transit Policy and
Programs Office, 2nd Floor, Building B, 1201 Wilson Avenue, Downsview, ON, M3M
1J8 for the Ministry's records.

Once the Ministry has received the signed copies of this Letter of Agreement and
the related authorizing municipal by-law, and the certified copies of the agreements
set out in Section 1, the Ministry may, in accordance with the OBRP, make
