February 19, 2001
Council met on Monday, February 19, 2001 at 6:00 p.m. for the purpose of
considering Regular Business matters. All members of Council, were present. Alderman
Ken Feren offered the Opening Prayer.
Alderman Craitor indicated a pecuniary interest from the February 12, 2001 Council
meeting on Cheque No. 257879 because a family member is employed by the Region.
His Worship Mayor Thomson congratulated and presented tokens of appreciation
to Frank Dancevic for his outstanding achievements in National Junior Tennis and the
prestigious Australian Open; and to Kevin (Buck) Miller for his outstanding achievement
in the Ontario Cup Series Road Racing Cycling Championship, and thanked them for their
contributions to the community; and thanked Mike Glatt of IGA for his continued support
of many athletes in the City of Niagara Falls.
Mr. Sherman Zavitz, Official City Historian, introduced Jim Mitchinson, and Inge
Saczkowski of the Niagara Falls Heritage Week Committee who provided information on
the various undertakings of the Committee for Heritage Week including a Heritage Tour
and Special Exhibits on February 22, 2001; and requested that Council proclaim February
18 25, 2001 as Heritage Week in the City of Niagara Falls.
Mr. Jack Gibbons, Chair, Ontario Clean Air Alliance, provided information on the
Nanticoke and Lambton coal -fired generation stations and expressed concerns about the
emission of nitrogen oxides and other air pollutants from these stations, and requested that
a letter be written to the Federal and Provincial Ministry of the Environment calling for an
environmental assessment of the plans for the Nanticoke and Lambton coal fired power
generation station which would look at the alternative, and further expanding the
generation capacity of the Sir Adam Beck generators in Niagara Falls and switching these
coal fired stations to natural gas, and that a copy of the correspondence be sent to the
Member of Parliament for this riding.

COMMUNICATIONS
Communication No. 45 -Jenny Morgenthau, Executive Director, The Fresh Air Fund
Re: Proclamation. The communication requests that Council proclaim March 20, 2001
as "Fresh Air Fund Day" in Niagara Falls.
ORDERED on the motion of Alderman Feren, seconded by Alderman Pietrangelo that the
request be approved. Carried Unanimously.
Communication No. 46 Cheryl Miclette, AMCT, Town Clerk, Town of Pelham Re:
Mobility Niagara. The communication requests Council's support for the Mobility Niagara
Program and consideration of a financial contribution, which would allow for the
reinstatement of this program, during the City's 2001 Budget deliberations.
ORDERED on the motion of Alderman Craitor, seconded by Alderman Hendershot that the
mutter be referred to Staff. Carried Unanimously.
Communication No. 47 Ann Mulvale, President, AMO Re: 2001 AMO Annual
Conference. The communication advises that the 2001 Annual Conference will be held
from August 19 22, 2001 at the Fairmount Royal York Hotel in Toronto, and that
registration before the Early Bird deadline could save AMO members more than 30% off
the on -site fee.
ORDERED on the motion of Alderman Hendershot, seconded by Alderman Feren that the
correspondence be received and filed. Carried Unanimously.
Communication No. 48 Kathy VanKnotsenburg, Canadian Red Cross Re:
Proclamation. The communication requests that the month of March be proclaimed as
Red Cross Month in Niagara Falls and that the Red Cross Flag be flown at City Hall during
the month of March in recognition of same.
ORDERED on the motion of Alderman Volpatti, seconded by Alderman Feren that the
request be approved. Carried Unanimously.
REPORTS
MW- 2001 -18 Chief Administrative Officer Re: Agreement with the Province to
construct a Storm Trunk Sewer across Highway 420. The report recommends that the
City of Niagara Falls proceed with the construction of the first phase of a new Trunk Storm
Sewer from the existing drop shaft on Valley Way southerly along Stanley Avenue; and
Staff prepare an agreement with the Province for Council's approval to construct the Storm
Sewer across Highway 420.
OIRDERED on the motion of Alderman Feren, seconded by Alderman Craitor that the
report be received and adopted. Carried Unanimously.
MW- 2001 -19 Chief Administrative Officer Re: Contract #2001 -16, T.V. Inspection
of Sewers. The report recommends that the unit prices submitted by the low tendered,
Trans -Video Inspection Ltd., be accepted and the by -law be passed.
ORDERED on the motion of Alderman Pietrangelo, seconded by Alderman Fisher that the
report be received and adopted. Carried Unanimously.

R- 2001 -06 Chief Administrative Officer Re: The Supply and Installation of Fitness
Play Equipment and Landscape Materials for Chippawa Lions Park. The report
recommends that Quotation #3 -2001 for the Supply and Installation of Fitness Play
Equipment and Landscape Materials for Chippawa Lions Park be awarded to Landscape
Florida of Niagara -On- The -Lake, Ontario at the bid price of $19,474.00 (including taxes).
ORDERED on the motion of Alderman Fisher, seconded by Alderman loannoni that the
report be received and adopted. Carried Unanimously.

PD- 2001 -20 Chief Administrative Officer Re: Matters Arising from the Local
Architectural Conservation Advisory Committee (L.A.C.A.C.). The report recommends
that council proclaim the week of February 18 to February 25, 2001 as Heritage Week in
the City of Niagara Falls; that Staff be authorized to initiate proceedings to designate the
following under Part IV of the Ontario Heritage Act: a) The Stamford Oak Tree, Portage
Road and b) The Copper Beech Tree, Drummond Hill Cemetery; that the dedication of the
Heritage Plaque at Buchner House, 6172 Buchner Place, be held May 5, 2001 (May 26,
2001 raindate).
ORDERED on the motion of Alderman Wing, seconded by Alderman Feren that the report
be received and adopted. Carried Unanimously.

Proclamation February 18 25, 2001 as Heritage Week; and Heritage Tour including
Special Exhibits on February 22, 2001.
ORDERED on the motion of Alderman Wing, seconded by Alderman Fisher that the report
be received and adopted. Carried Unanimously.
RATIFICATION OF CORPORATE SERVICES COMMITTEE MATTERS
ORDERED on the motion of Alderman Campbell, seconded by Alderman Feren that the
actions taken in Corporate Services Committee, earlier this evening, be approved:
1. Adoption of the February 12, 2001 minutes;
2. That the presentation from the Home for Girls Soccer Committee be received for
information;
3. That a family rate of $7.00 per visit for up to six immediate family members be
established for arenas for the 2001 -2002 season and that a report be brought forth
in a year's time to evaluate this policy.
4. That Report F- 2001 -17 re: Donations and Grants under $1,000 be received for
information.
5. That Report F- 2001 -18 re: Aldermanic Expense Allowance be deferred and that a
Report be prepared to address the Committee's discussion.

ORDERED on the motion of Alderman Pietrangelo, seconded by Alderman Feren, that
leave be granted to introduce the following by -laws, and the by -laws be read a first time:
2001 -42 A by -law to authorize the execution of an agreement with Trans -Video
Inspection Limited respecting T. V. Inspection of sewers from March 2001
to December 19, 2003.
2001 -43 A by -law to authorize the execution of an agreement with Noelle Sinclair and
Kerrie Sinclair respecting "Roosevelt Condominium

OIRDERED on the motion of Alderman Pietrangelo, seconded by Alderman Feren, that the
by -laws be now read a second and third time:
200142 A by -law to authorize the execution of an agreement with Trans -Video

2001 -43 A by -law to authorize the execution of an agreement with Noelle Sinclair and

Ontario Crime Commission
NEW BUSINESS
Alderman loannoni referred to an advertisement in the newspapers advising that
M.P.P. Bart Mayes and London M.P.P. Frank Mazzilli of the Ontario Crime Commission
are holding a Body Rub Parlour Roaming Council on Body Rub Parlours and extended an
invitation to Council to attend at the Sheraton Fallsview on February 20 from 10:00 a.m.
to 12:00 noon. His Worship Mayor Thomson and Ray Kallio, City Solicitor, will be in
attendance and will make a presentation on behalf of Council.

Boys Girls Triathlon

Alderman Pietrangelo reminded Council that the Boys and Girls Triathlon will be
held on Saturday, February 24 from 10:00 a.m. to 2:00 p.m. and thanked everyone for
their support.
Minor Hockey
Alderman Federow, on behalf of the Committee addressing concerns on Minor
Hockey, advised that another meeting was held and at that time, concerns were brought
forward and that minutes are available for everyone's perusal.
Retirement Homes
L.A.C.A.C.
Alderman Puttick referred to Retirement Homes that belong to ORCA. and his
Committee is aiming to set the standard for those that belong to ORCA. Along with
Regional Councillors, the Committee is hoping to bring back, in a month, a resolution to re-
activate our By -law on Retirement Homes which will be region -wide. They would like
legislation passed that would give municipalities the right to do inspections for the Care
section.
Alderman Wing thanked L.A.C.A.C. for successful display at Niagara Square and
commended her Committee of Jim Mitchinson, Frances Corfield and Kathy Powell.
Liquor Licence
READ AND ADOPTED,

Alderman Wing referred to correspondence in the Handout, from the City of Windsor
who are requesting our support for a resolution for an amendment to the Liquor Licence
Act, to put the Onus back on the applicant to prove that they should get the licence as
opposed to the present situation where the public are required to prove that it is not in the
public's interest and requested that Council support this position.
ORDERED on the motion of Alderman Wing, seconded byAlderman loannoni that the
resolution be supported. The motion Carried with Aldermen Hendershot, Feren, Fisher
and Puttick voting against the motion and all others voting in favour.
ORDERED on the motion of Alderman Feren, seconded by Alderman Hendershot, that the
meeting be adjourned. Carried Unanimously.
