Industrial Assessment - Verbal Update
The Revenue Supervisor advised that Canadian Niagara Power had a Current Value
Assessment last year of 24.2 million, however, this year the roll was returned with a value of
5.5 million. OPAC has advised that this value is under appeal and will be brought back to the
same as last year. Effective in 2001, power dams will be exempt from property taxes for
municipal and education purposes. Canadian Niagara Power will fall under Bill 140for
treatment of power dams and itwill be exempt. The municipality wiil be compensated annually
for the loss of municipal property tax revenue associated with this change.

industrial assessment be received.

COMMUNICATIONS
On March 19tn, 2001, CiO, Council approved the application for the Niagara Falls Life Centre
to be used as a "Special Residence, Temporary Shelter.' The Centre has requested that the
Corporate Services Committee consider reimbursing the application fees of $1,050 ($750 to
permit the dwelling to be used as a Special Residence and $300 to have the amending By-law
presented to Council). The Centre is a non-profit organization and funding is provided by
private donations, local businesses and churches within the community.
MOVED by Alderman Volpatti, seconded by Alderman Craitor, that the application fees
in the amount of $1,050 be reimbursed to the Niagara Falls Life Centre.

RECOMMENDATION:
It is recommended that the Committee consider the proposals contained in this report to
tmprove the efficiency of the site plan approval process and to streamline the admmistratmn
of current procedures.
BACKGROUND:
Recently, due to the increase in development in the City, staff involved with site plan applications
have experienced inefficiencies with the current site plan approval process. As a result, the
developer has experienced longer processing times which affect the issuance of building perm/ts.
Currently, the process is split into two parts. First, technical processing by Planning, Municipal
Works, Building, Parks, Recreation and Culture, and Fire Services occurs prior to Council
approval. Second, the administrative processing by Legal occurs after Council's approval.
Building permits are only issued after the site plan agreement is registered on title. Staff have
investigated the procedures used in other municipalities and have identified several ways to
streamline and improve the efficiency of the process which will result in better service delivery to
the development community.
A STREAMLINED PROCESS:
In considering improvements to the current approval process, it is worth noting that site plan
approval is the last step of the planning process. Land use issues, land division and variances have
all been dealt with earlier all tkrough public process. However, site planning is essentially the
implementation stage of the planning process. It is in site planning where Official Plan pohcies,
Zoning By-law provisions and design guidelines are instituted through building and parking
arrangements, landscaping and servicing. In order to expedite the site plan approval process, the
following efficiency measures are proposed which are consistent with several other municipalities.

Simultaneous Plan Review and Agreement Preparation
It is proposed to have agreements prepared while technical review is taking place. By
shifting the agreement preparation to early in the process, together with a requirement of
a complete application with all the supporting legal information, it would improve upon
the efficiency of the process and a more timely issuance of building permits.
Clearance of Conditions Prior to Agreement Registration
By making a requirement that an applicant satisfy conditions of approval prior to the
registration of the agreement, the onus is on the applicant to clear these conditions quickly
so that he may obtain a building permit. Thus, once the agreement is registered, staffno
longer have to spend time during construction of the development and after, trying to have
the applicant resolve these matters.
Delegation of Approval Authority
The current site plan control by-law provides for a partial delegation of authority. Small
developments (those under 6,000 square feet) are subject to approval by the Planning
Director. This process has worked well with applications being processed simply and
efficiently. Similar benefits could be achieved if this process is expanded to large-scale
development. Legislative authority for the delegation of site plan approval to a staff
member is provided for within section 41 of the Planning Act. It is being suggested that
the Director of Planning and Development have the authority for approval. This would
only be granted once other departments have satisfactorily reviewed the plans and
conditions of approval successfully negotiated with the developer.
Several municipalities have delegated authority. These include: Barrie, S amia, Brampton,
Mississauga, North Bay, Sudbury, Timmins, Stoney Creek, Brantford, Cambridge,
Oshawa, Burlington, and Windsor. These municipalities have done so in the interests of
simplifying their approval processes and making them more efficient.
Council should note that in instances where the developer is not willing to comply with
Council's policies, for example the dedication of a road widening or granting of an
easement, the application will be forwarded to Council for consideration. In this way, the
applicant and staffhave the opportunity to make a presentation to Council which will make
a decision. In order to keep Council informed as to which applications have been approved
under the delegated system, a monthly report would be submitted.
CONCLUSION:
In conclusion, the proposed process should make site plan approval more efficient and streamlined
while guaranteeing that conditions of approval are met in a timely manner. The development
community should realize an improved level of service from the proposed process. The goal is to

provide a seamless approval process from the time of site plan application to the issuance of
building permits. Should the Committee endorse this proposal, staff will proceed with the
necessary amendments to the site plan control bydaw and policy.
