At the April 20, 2009 Community Services Committee the following motion was adopted:
1. That staff work with the property owners to develop a compromise, with the City
paying for the stone work and the property owners paying for the ironwork, and
2. That staff report back to Council.
Members will recall, the wall with iron fence currently rests on the road allowance of St.
Paul Avenue. The wall and fence is a listed heritage feature in the designating by-law of
the adjacent Oswald House, but technically is not designated because it is not on the same
property. The structure is considered to be a liability due to its condition and location on
City property.
In order to commence talks with the owners of the Oswald house, it was necessary to
determine the exact portion of road allowance to be closed. Thus a draft reference plan
was created and approved by Municipal Works and is now ready to be deposited at the
Registry Office. It will be necessary to close that portion of the road allowance and transfer
the lands to the owners before moving the wall to this location.
Staff have consulted with the owners and they have agreed, in principle, to the transfer of
lands and the proposed new location of the fence; to assume responsibility for the cost of
the restoration of the iron work ~as well as the future care and maintenance of the fence.

A request for quotes was issued by the City for the removal and relocation of the stone wall
to the new location in order to determine the costs to the City. The following quotes were
received:
Cedar Springs Landscape Group Ltd. - $27,500.00
Rempel Masonry Restoration Inc. - $25,000.00
It is anticipated that the funding would come from the Municipal Heritage Committee's
Designated Property Grant program and the Municipal Works New Sidewalk Construction
account.
AL~ERNA~aVES:
In the event the Committee does not wish to authorize the expenditure of funds on the
preservation of this heritage wall, two alternatives could be considered.
1. Do nothing - this option would leave the wall in its current location and condition.
This carries with it a continued risk to the City that someone could be injured should
the wall fall over while someone is next to it.
2. Remove the wall - this option would have the stone and iron work removed from the
City road allowance, thus removing any liability. The stone and iron work could be
re-used either in a municipal project (to be determined) or sold to a private
individual. It would result in the loss of a heritage feature from a prominent corner
in the City.
COt~CL~JSION:
Staff was directed to work out a compromise with the owners. The owners have expressed
their willingness to see the fence preserved and will assume responsibility to restore the
iron work and long term maintenance if the Committee recommends and Council approves
the above-noted expenditure. The closure of the road allowance, transfer of lands and
relocation of the wall could all be achieved by this fall. This would have the effect of
preserving a heritage feature in the City that is associated with the private property and
removing a public liability. Municipal Heritage Committee has previously advised Council
of its support for the retention of the wall and iron fence.

That City staff provide assistance to the Region, Cytec and Canadian Niagara Hotels
(CNH) to ensure the completion of the Thorold Stone Road Extension.
BACKCROIDND:
As a result of the need for a Record of Site Condition, the Thorold Stone Road Extension
will not be completed in time forthe Gale Centre opening. As there are a number of issues
that need to be addressed between the Region, Cytec and Canadian Niagara Hotels City
staff should provide assistance in order to ensure the completion of this project.
On Monday, July 20, 2009 City staff met with the Region, Cytec and Canadian Niagara
Hotels who have a lease on the Cytec lands, to discuss the extension of Thorold Stone
Road. The purpose of the meeting was to provide a status of the project to date and the
steps that need to be taken to advance the project. A copy of a letter from the Region
outlining their position on this issue is attached as Attachment `A'.
The Region indicated that the Environmental Assessment has been completed and
approved and that funding was in place in the Regional Capital Budget to proceed with the
first phase of the project which would extend Thorold Stone Road to the easterly limit of
the Gale Centre site. Regional staff has had a number of internal meetings in regard to the
project and specifically concerns with respect to the level of contamination on the lands
needed to extend the road. As a result of the discussion Regional staff has confirmed the
need for the project however in order for it to proceed a Record of Site Condition will be
required to be carried out by the owner, Cytec, before the Region proceeds with the
acquisition of the lands. It should be noted that the Record of Site Condition is required
in order to change the use from industrial purposes to a road use.
Cytec staff indicated their suqport of the road project. However, they would have to

in order to complete the Record of Site Condition. Based on the work carried out in order
to complete the Record of Site Condition for the Gale Centre project, Cytec estimated that
the necessary work would take 15 to 18 months to complete.
Canadian Niagara Hotels as the lease holders on the property need to release their interest
in the lands needed for the road extension in order to allow the sale of the lands to the
Region. CNH is supportive of the project subject to a number of issues that need to be
resolved between CNH and Cytec.
Based on the above it is clear that the Thorold Stone Extension will not be completed in
time forthe June 2010 opening of the Gale Centre. Although Council has recently passed
a resolution forwarded to the Region expressing the need for the extension, it should be
noted that the Cytec site was selected without the knowledge of the road extension
proceeding. In report R.-2005-57 entitled Selection of the Preferred Site for the Arena
Complex Development Project, November 7, 2005 it states that, "the site can potentially
be accessed from at least two points including Stanley Avenue and also from Fourth
Avenue." Further on April 11, 2007, report CAO-2007-06 entitled Response to Issues
Raised by Unite Here Proposed Arena Complex Site, it stated that, "the Region has agreed
to improve the Stanley Avenue/Thorold Stone Road intersection and extend Thorold Stone
Road to serve the site. "The Region moved this project forward because of the selection
of the Cytec site for the arena development project."
Staff has investigated the possibility of constructing a temporary access from Stanley
Avenue to the Gale Centre site. In order to avoid Cytec lands and hence the completion
of a Record of Site Condition, a driveway would have to be constructed completely on the
Palmer Avenue Park site. This would require further investigation related to a traffic and
safety assessment and park use and an agreement would be required with Ontario Power
Generation in order to cross their lands.
Staff is recommending that access via Fourth Avenue be used as the main entrance as an
interim measure until the extension of Thorold Stone Road is completed. Niagara Region
would be requested to optimize the traffic signal timing at the intersection of Fourth Avenue
and Bridge Street, and/or incorporate additional phasing, i.e., left turn phase to
satisfactorily accommodate the additional traffic. Once the Thorold Stone Road access is
completed, Fourth Avenue would revert to its intended secondary access. As Fourth
Avenue is primarily residential in nature, it is suggested that the residents be notified that
Fourth Avenue is to be used as the main access during construction of the Thorold Stone
Road extension.
IMPLICATIONS
Staffin
Although the extension of Thorold Stone Road is a Regional Project, City staff will continue
to monitor and assist the parties to ensure that the project is completed in order to provide
a new primary access for the Gale Centre.
Financial
As indicated in the 2009 Capital Works Budget the City has budgeted approximately $1.79
million for the Thorold Stone Road Extension to pay for sidewalks, storm sewers,
watermains and sanitary sewers. This expenditure is earmarked for 2010. It should be

noted that the Record fo Site Condition may result in additional expenses that are
unknown at this time. The impact if any will be reported to Council when it is known.
CI~Y STRATEGIC COMMITIVIENT
The Thorold Stone Road Extension project falls under the Arena Complex Development
Project as identified in the 2007 Niagara Falls City Council Strategic Priority. It is further
reinforced by the resolution passed by Council on June 29, 2009 requesting the Region to
proceed with the project.

extension of Thorolcl Stone Road in time for tlze Spring 2010 opening of the Gale Centre", has
been forwarded to the undersigned for response.
We wish to advise that Regional Niagara has been actively working with Cytec Canada Limited
and its leasee, Falls Community Development (FCD), in an effort to move this project forward.
On July 20t" we met with representatives from both parties to discuss the validity and benefit of
constructing the roadway extension, establish recognition of responsibility for the risk
assessment/remediation, identify the financial implications involved with remediation, review
property acquisition options and agree on a contingency plan for the arena access in the event
that the roadway extension is postponed. The outcome is optimistic; however, a number of
particulars relative to the existing lease agreement, risk assessment process including the need
for a site specific development proposal (plan), and recognition of responsibility need to be
investigated and addressed prior to proceeding with the project. The following is a brief
synopsis of the points discussed:
• Currently the risk assessment has been suspended by the owner (Cytec) pending
submission of site specific development proposal from the Developer (FCD)
• Cytec to investigate possibility of undertaking risk assessment on the proposed road
extension alignment only
• Cytec and FCD to review implication(s) on existing lease arrangements relative to the
release of any portion of the land holdings

• Cytec, FCD, City, and Region will meet to discuss implications (costs, risk and
liabilities) resulting from recommendation(s) outlined in the Risk Assessment and

• It was agreed that should the project be delayed and/or postponed, Fourth Avenue will be
utilized by the City as the alternative access to the new arena site
Barring any unforeseen circumstances, Niagara Region is confident that these obstacles can be
overcome and that the required property acquisition and actual construction of the project will
move forward. However, we understand that review and approval of the Risk Assessment by the
Ministry of the Environment is a lengthy process. Therefore, we probably will be unable to
complete the road construction prior to June of next year.
We trust that the information provided assists in keeping City Council informed of our efforts to
move this project forward. As we proceed with the above-mentioned next steps, we will update

In response to a concern from an area resident, Staff has carried out a parking review on
Forest Glen Drive and on Glenoaks Avenue. The concern stems from parents and
guardians parking their vehicles on both sides of each street as they wait for their children
to be dismissed from St. Vincent de Paul Schaol.
Forest Glen Drive is a residential roadway that extends in an east/west direction between

Oakridge Drive and a point approximately 25 metres west of Glenoaks Avenue. The
roadway is approximately 250 metres in length, 9.5 metres in width and consists of a grass
boulevard and a concrete sidewalk on both sides. Glenoaks Avenue is a residential
roadway that extends two blocks in a north/south direction between Forest Glen Drive and
Thorold Stone Road. The roadway is approximately 165 metres in length, 8.5 metres in
width, and consists of a grass boulevard and a concrete sidewalk on both sides. The area
consists of predominantly single family residential dwellings. There is a five-storey
condominium building on the north side of Forest Glen Drive, which has 77 dwelling units.
Construction of the second building is underway which will include 76 condominium units.
There will be adequate on-site parking according to the Zoning By-law. St. Vincent de Paul
School is located on Kalar Road north of Thorold Stone Road. A pedestrian access gate
is present at the rear of the school that leads to the western limit of Forest Glen Drive.
There are a number of parking restrictions in the study area. Parking is restricted on the
north side of Forest Glen Drive between a point 70 metres east of Glenoaks Avenue and
a point 125 metres west of Glenoaks Avenue. Parking is restricted between the hours of
8:00 a.m. and 4:30 p.m., Monday to Friday, on the south side of Forest Glen Drive between
Glenoaks Avenue and a point 85 metres east of Glenoaks Avenue.
Parking is restricted on the east side of Glenoaks Avenue between Forest Glen Drive and
Thorold Stone Road. Parking is restricted between the hours of 8:00 a.m. and 4:30 p.m.,
Monday to Friday, on the west side of Glenoaks Avenue between Forest Glen Drive and
~ Thorold Stone Road.
The above restrictions were implemented in an attempt to discourage motorists from
parking their vehicles on both sides of each roadway and impeding bidirectional traffic.
Concerns have once again risen regarding the parking situation on Forest Glen Drive and
on Glenoaks Avenue, particularly in the afternoon when there are several parents and
guardians parking on the aforementioned roads waiting for their children.
Observations in the study area reveal that during the time when children are dismissed from
school, motorists predominantly park their vehicles on the west side of Glenoaks Avenue
and on the north side of Forest Glen Drive. It was however noted that vehicles were parked
on both sides of each road. This causes the road width to be reduced to one lane of travel.
Construction trucks were observed travelling on Glenoaks Avenue as part of the second
phase construction of Mansions of Forest Glen.
Observations at the school parking facility reveal that there is insufficient space available
on the property which leads to overflow parking on adjacent residential streets. Parking
Control Staff frequently occasions the area and issue tickets to those parked/stopped
illegally in order to assist with the above concerns. However, it is virtually impossible for the
officers to be stationed at St. Vincent de Paul school, given that there are numerous other
schools and locations they must attend to. The current school enrolment is beyond the
initial student and staff projections, which the current parking lot capacity is based upon.
In fact, the enrolment is approaching the estimated full build out of the site, as identified in
the traffic study prepared for the school during the planning stage. The report identified that
upon full build out, additional parking should be made available, and a"future parking lot"
was accounted for and illustrated on the school site plan. Given the existing traffic
conditions around the school property, it is evident that this additional parking is now
required. Staff has met with and made a formal written request to the school board to
provide the additional eighteen (18) parking spaces in the southeast corner off the school
property, as per the approved site plan. A response has not been received from the school

board with respect to their intention on expanding the parking area, as of yet.
Area residents were provided with a questionnaire which gave them the opportunity to
comment on the parking control that would most benefit their needs. The number of
responses received was below the statistical requirement and there was no clear consensus
as to the preferred parking regulations.
However, based on the technical assessment, it is recommended that the parking regulation
be modified to provide for a"No Stopping, 8:00 a.m. to 4:30 p.m., Monday to Friday,
Excluding Holidays" zone on the south side of Forest Glen Drive between Glenoaks Avenue
and Oakridge Drive. The existing parking restriction on the south side of Forest Glen Drive
is recommended to be removed. These proposed changes will ensure that motorists will
not be able to legally stop their vehicles on the south side of Forest Glen Drive during the
school hours, regardless of duration. Parents and guardians would still be able to park their
vehicles on the north side of Forest Glen Drive, notwithstanding the existing parking
restriction encompassing the access to 8111 Forest Glen Drive, which will be maintained
to ensure adequate visibility to motorists entering Forest Glen Drive. The proposed
stopping restriction will ensure adequate two-way traffic movement and emergency access
on Forest Glen Drive.
Similarly, it is recommended that the existing parking restrictions on Glenoaks Avenue are
replaced with a"No Stopping, 8:00 a.m. to 4:30 p.m., Monday to Friday, Excluding Holidays"
zone be implemented on the east side of Glenoaks Avenue between Forest Glen Drive and
Thorold Stone Road. This will allow parents and guardians to park their vehicles on the
west side of the roadway where majority of parking activity is already taking place, while
maintaining two-way traffic and emergency access.
Staff has been continually working with the school to improve safety for vehicular and
pedestrian traffic during the drop off/pickup times, as well as improving the efficiency of the
Kiss & Ride operation. School officials were previously requested ~to issue a newsletter to
parents requesting their compliance with parking restrictions on adjacent roads and to
ensure that their children utilize the available sidewalks en route to/from the school.

Thank you for arranging the meeting between yourself, your colleagues at the school and the
School Board, and with City Staff on December 17, 200$, regarding traffic operations in vicinity
of St. Vincent de Pau] Catholic Elementary SchooL
During our meeting, the group discussed the following traffic safety concerns:
- Parents and guardians parking on both sides of Forest Glen Drive, Glenoaks Avenue and
Vegter Court, particularly at school dismissal. This creates a safety concern as parked
vehicles will impede emergency vehicle operators responding to distress calls, as well as
increasing the collision potential caused by reduced visibility and congestion.
- School children walking on the roads in between parked vehicles to access their
guardian's vehicle. This was noted particularly at dismissal, and is considered a
significant safety concem.
- Parents may prefer to park their vehicle adjacent to the school property on Kalar Road for
their convenience, even though there is a stopping restriction posted on the east side of
Kalar Road abutting the school. This situation forces northbound motorists to drive in the
southbound lane, which increases the head on collision potential. Parents and guardians
should personally escort all children across the road, rather than just waiting in their
vehicle and observing their children as they cross the road without assistance.
Enforcement officers frequently occasion the area and issue tickets to those parked or stopped
illegally in order to assist with the above concerns. However, as you can appreciate, it is virtually
impossible for the officers to be stationed at St, Vincent de Paul school, given that there are

area residents. We will also ensure that the school is given the opportunity to participate in the
parking study by providing us your comments and/or concerns via a questionnaire that will be
delivered to you.
As discussed, we respectfully request that the school issue a newsletter to parents requesting their
compliance with the parking restrictions on adjacent roads, use the Kiss & Ride program
established at the front of the school and request their children to use the sidewalks rather than
walk on the road between parked vehicles. When parking on the street, parents should also be
encouraged to personally escort their children across the street promoting a"Safety Over
Convenience" philosophy. In the meantime, we will continue to deploy Enforcement officers
regularly to the area.
I trust that the above summarizes our discussions, and reiterates the safely concerns in the
vicinity of St. Vincent de Paul school. Should you wish to discuss these issues or others, please

3. That a"No Stopping, 8:00 a.m. to 4:00 p.m., Nlonday to Friday, Excluding Holidays,
September 1 S'to June 30'"" zone be implemented on the outer bulb of the Kelly Drive
and Heikoop Crescent junction.
That "No Stopping" be implemented from 8:00 am - 10:00am and 2:00 pm - 4:00 on both

Heikoop) on both sides.
In response to a concern from an area resident, Staff has carried out a parking review on
Kelly Drive and Heikoop Crescent between Greenfield Crescent and Parkside Road. The
concern stems from parents and guardians parking their vehicles on both sides of the study
roadway as they wait for their children to be dismissed from Loretto Catholic and Kate S.
Durdan Elementary Schools.
Kelly Drive is a residential roadway that extends in a north/south direction between
Greenfield Crescent and Heikoop Crescent. The roadway is 10 metres in width and the
road cross-section consists of a curb and gutter, a grass boulevard and a concrete sidewalk
on the east side only. Heikoop Crescent is a local roadway that extends in an east/west
direction between Parkside Road and Kelly Drive. The roadway is 10 metres in width, and
the road cross-section consists of a curb and gutter, a grass boulevard and a concrete
sidewalk on the north sid.e~ oniy. The area study consists of single family residential

dwellings, with the majority of residents can fit at least four vehicles on their property.
Loretto Catholic Elementary School and Kate S. Durdan Public Elementary School are
located to the north of Heikoop Crescent. There is a walkway from the school playground
onto Heikoop Crescent. Currently there are no daytime parking restrictions on either
roadway.
Observations in the study area reveal that during school arrival and dismissal times,
motorists predominantly park their vehicles on the north/east side of the study roadways.
Several motorists were also observed to park their vehicle on the south/west side. This
causes the road width to be reduced to one lane of travel and considerably reduces visibility
for motorists vacating their driveways as well as motorists travelling around the curve at the
junction of Kelly Drive at Heikoop Crescent. Motorists were also observed parking on the
outer bulb of the Heikoop Crescent at Kelly Drive junction blocking driveways.
Observations at the school parking facility reveal that there is insufFicient space available
on the property which leads to overflow parking on adjacent residential streets. There are
24 visitor parking spaces, with approximately 15 spaces available in the Kiss and Ride lane.
As a result, motorists may be prone to utilize Heikoop Crescent and Kelly Drive during start
and dismissal hours, parking for periods up to, and beyond 30 minutes. Observations at
the City parking facility located to the north of the school property revealed that very few
motorists utilize this parking area. There is enough space in this parking lot to
accommodafie all the vehicles observed parked on Kelly Drive and Heikoop Crescent.
Area residents were provided with a questionnaire which gave them the opportunity to ~
comment on the parking control that would most benefit their needs. The number of
responses received was below the statistical requirement of 60%.
Based on the technical assessment, it is recommended that a"No Stopping, 8:00 a.m. to
4:00 p.m., Monday to Friday, Excluding Holidays, September 1St to June 30th" zone be
installed on the south/west side of Heikoop Crescent and Kelly Drive, as well as the outer
bulb where the two study roadways intersect. These proposed changes will ensure that
motorists will not be able to legally stop their vehicles on the south side of Heikoop Crescent
and the west side of Kelly Drive during school hours, regardless of duration. Parents and
guardians as well as local residents would still be able to park their vehicles on the north
and east side of Heikoop Crescent and Kelly Drive.
The proposed stopping restriction will ensure adequate two-way traffic movement and
emergency access on Heikoop Crescent and Kelly Drive is maintained. It will also alleviate
visibility concerns caused by vehicles parked near the intersection of Kelly Drive at Heikoop
Crescent. With parking permitted on the north/east side, students will not be required to
cross the road when entering or alighting vehicles. The stopping prohibition around the
outer bulb will prevent motorists from blocking driveways where front yard space is typically
reduced for pie-shaped lots.
Finally, the administrators of the Loretto Catholic and Kate S. Durdan Elementary Schools
will be requested to advise parents/guardians picking up and dropping off their children to
park in the City parking lot located north of the schools property. Alternatively, there is a
second parking lot behind the school accessible via Parkside Road that can also be utilized
by parents dropping off and picking up their children.
