This letter was not sent to the Niagara Health System (NHS) and the NHS only became aware of this letter on September 28th as a result of your Council package being posted publicly on your website. The letter contains a number of inaccuracies that we feel compelled to write to clarify for the record, responding individually to separate points within the letter written by Drs. Dobrovolskis and Speight. As context for our response, we will first explain why the NHS is making changes to the Greater Niagara General (GNG) Emergency Department (ED). Why is the Niagara Health System making changes to the GNG Emergency Room? The changes that the NHS is implementing are designed to improve the patient experience and reduce wait times. The NHS Is adding more hours of physician coverage so that more doctors see more patients more quickly. This will mean shorter wait times for patients, better care and improved patient satisfaction. The NHS is committed to providing ongoing quality care in the GNG Emergency Room (ER). Currently, the GNG ER is covered by only 6 full -time physicians. On a daily basis, one of these physicians works a 10 hour day shift and one of them works a 14 hour night shift to provide 24 hour a day service, 365 days a year. The NHS was receiving an increasing number of patient complaints about wait times and treatment at the GNG ER. The wait times and number of patients leaving without being seen by an ER physician due to long wait times exceeds provincial benchmarks. Attempts to work with the GNG ER physicians in the past to change the model of care and physician coverage at the GNG ER were unsuccessful which prompted the NHS to commission the Hay Group Health Care Consulting to provide a third party expert, independent review of the operations of the GNG ER In comparison to best practice across Canada. The implications of staffing models such as those at Greater Niagara General have been shown in the literature to both adversely affect physician wellness, and the quality of patient care. implications for patient care which have been documented to occur as a consequence of physician stress and burnout include, amongst other phenomena: Becoming argumentative and impatient Procrastination and neglect of patient care needs increasing hostility Absenteeism from the workplace Decreased tolerance In addition, attitudes such as blaming and helplessness and ambivalence and risk taking have also been reported and may also adversely impact the quality of patient care /' The major recommendation of the third party expert review was to increase the hours of physician coverage at the GNG ER to improve quality care, patient satisfaction and to reduce wait times. Hours of physician coverage are defined as the number of physicians providing care within the ER department during a 24 hour period. The change being proposed, when fully implemented, would result in having 14 full -time Emergency physicians in the GNG ER. This means the same volume of patients would now be seen by 14 physicians, rather than six. This would mean that two ER physicians would be on duty at the same time in the ER providing care. Since, under the current fee for service payment model, the GNG Site ER physicians are paid for each patient they see, this change in the schedule would mean an individual physician would see fewer patients in a shift than under the current model and potentially earn less income. However, it is important to note that the changed model in physician coverage will still provide the GNG ER physicians a similar income to other physicians in the province. Furthermore, the new model of physician coverage will be more attractive to new physicians coming to Niagara because it will improve their quality of work life and is considered best practice. The goal of the Niagara Health System, based on this external expert review, is to increase hours of physician coverage and improve the patient experience. It Is not about cost savings — the NHS does not pay the physicians. NHS Response to Open Letter Statement 1 - The Greater Niagara General Hospital Emergency Physician Group has been one of the most constant and reliable groups in Canadian emergency services, provided dedicated and quality care for the citizens of the Niagara Region for over twenty -five years. We have the distinction in the Niagara region of haling the lowest wait times, best patient satisfaction rates and service to the citizens of Niagara. NHS Response: There is no report that the NHS is aware of that would evaluate the constancy and reliability of the GNG ER physician group against the rest of Canada. The GNG ER has historically been Mayor Ted Said September 30, 2009 Page 3 staffed by six physicians. Although the authors of the letter to Council recently resigned, the NHS has recently recruited two new members to the GNG ER physician group. Three of the existing six physicians joined the NHS prior to 2000; three have joined within the last three years. The NHS acknowledges the Group's past service to GNG and would have expected the Group to manage any disagreement regarding the provision of ER services in a manner that reflected the dedication to the residents of Niagara expressed in the Open Letter. The NHS does have access to reports that benchmark ER wail times, left without being seen rates and patient satisfaction rates to peer hospitals. The GNG ER department is performing worse than provincial benchmarks in all three indicators. Hospitals are expected to benchmark provincially against standards. The physicians in the GNG ER have been focused on their performance compared to other NHS sites versus best practice in the province and with peers. The Hay report comments 'it is disconcerting that rather than cooperating and collaborating in establishing common policies, procedures, protocols, care maps, etc. in an effort to ensure the quality of care received in any of the Niagara Health System's sites is appropriate and of the highest possible quality, one group (the GNG ER physicians) has set itself up in competition with others in the system." The Hay report states `during our interview process, it also became clear that those working at the Niagara Health System (NHS) GNG site emergency department interpret their performance in the context of other hospitals in the NHS and the attitude Is one of "competition " as opposed to collaboration, cooperation and consensus building across the system". The Hay report recommends "on a go forward basis, it will be essential for the Niagara Health System to ensure that a culture of a single institution with common policies, procedures, clinical objectives and standards unfolds. The hospital should strive to ensure that performance in all emergency departments is compared not with internal peers but with external standards." NHS 24/7 ER sites are not meeting provincial benchmarks primarily In the area of wait times and left without being seen rates; however, all NHS sites have actively been engaging in quality Improvement initiatives to achieve these benchmarks. The NHS has a number of initiatives underway to Improve its performance against provincial benchmarks such as additional hours of physician coverage, a fast track area and medical directives. These are the same initiatives that the NHS is now implementing at the GNG ER. Statement 2 - The Department has been under constant attack by its own administration on a professional and personal level. NHS Response: • The NHS receives and investigates complaints by patients and staff, tracks trends and does its best to address the issues, whether they are specific to a member of the professional staff or systemic. • On occasion, where there are significant matters relating to the delivery of care that need to be managed, the NHS, like other public hospitals, seeks independent, expert, external assistance to research the issues and make recommendations. • independent reviews are used by all kinds of organizations in a broad range of circumstances, including for quality assurance. Mayor Ted Sabi September 30, 2009 Page 4 • The GNG ER underwent an independent expert review in the Spring of 2009 by Hay Consulting and the report on the review was not entirely favourable to the operations of the GNG ER. • The NHS does not consider either commissioning an independent expert review or addressing issues that could impact health care as an attack, but as acting responsibly to discharge its mandate of ensuring quality care to the residents of Niagara. Statement 3 - The agenda of the NHS administration is unclear, even after the token dismissal of the former chief of staff and the promise of transparency, accountability and cooperation with the medical staff, the NHS has only become more entrenched in a restructuring plan that Is covert and kept hidden from the public as well as the staff of the NHS. NHS Response: • The mandate of the NHS administration is to provide the best care and the best patient experience possible within the resources available, which it believes implementing the recommendations will achieve. • The report of the independent expert review of the GNG ER was provided to the physicians at GNG when it was received in May 2009 and the physicians have had an opportunity to voice their views. • In accordance with NHS commitment to transparency and accountability the report is posted on the NHS' website and we urge all stakeholders to read it so as to better understand the concerns about the GNG ER and the recommendations made to address those concerns. Statement 4 — During this same time, the emergency doctors of the GNGH have been frustrated by bed closures, cuts to nursing and practical nursing staff, sudden and unexplained closure of services such as pediatrics, obstetrics and mental health without warning or explanation. The GNGH Is dying a stow death by cuts that will transfer the bulk of services away from our hospital and the people it serves to other facilities in locations that do not serve the community's Interests. NHS Response: The Hospital Improvement Plan (HIP) identifies 90 bed closures as well as other service delivery changes over the next four years at all of the sites of the NHS. The HIP is posted on the NHS website. In 2009/10, there are no permanent bed closures planned at the GNG site, unlike at other sites of the NHS. There have been times that, due to lack of either nursing or physician resources, beds have temporarily been closed in order that safe care could be provided to our patients. Sometimes these closures are in fact on short notice and beyond the control of the NHS — Le. if a physician suddenly takes ill or can no longer participate in an on call rotation or similarly if a nurse must take a sick leave or a leave of absence — the NHS must respond quickly to close beds to meet the staffing resources available. This can happen at any one of our sites and has over the last few years, particularly in the area of obstetrics and paediatrics. There continues to be concern among the GNGH physicians regarding the changes in clinical service delivery outlined in the Hospital Improvement Plan and as the NHS previously committed, we will work through these concerns as the HIP Is implemented. The Memorandum of Understanding (MOU) reached between the NHS and the physicians at both the Port Colborne and Fort Erie sites are evidence of solutions that can be reached when both parties collectively have the will to work together in the best interests of patient care. Mayor Ted Salci September 30, 2009 Page 5 Statement 5 - Over the last one and half years, the NHS has kept a private for - profit physician temporary agency on retainer, at a cost of $20,000 per month. This company would provide physicians at significant cost to the NHS to replace the current emergency physicians in the event that physicians would not comply with NHS restructuring. NHS Response: • The NHS uses the services of two organizations that provide temporary emergency physician services in order to keep ERs open as do a long list of other hospitals in the province. These organizations provide services to hospitals on a transitional basis while recruitment Is underway. • One provider is Health Force Ontario which is a government agency that provides trained ER physicians to hospitals who require coverage while recruitment efforts are underway. • The other provider is Med - Emerg, a public company for which a number of NHS physicians work - one of the authors of the Open Letter worked for Med -Emerg before joining the medical staff. Some physicians who reside in Niagara choose to provide their services to the NHS through Med Emerg rather than directly, which means that they are not bound by the requirements Imposed on members of the Medical Staff (participating in call and training physicians, for example). • The NHS pays a monthly administrative fee to Med -Emerg for billing and other services, which is not $20,000, in fact, it is far less. • NHS is bound by a confidentiality clause in its agreement with Med - Emerg. Statement 6 — The latest blow to the emergency department physicians is the demand to dismantle a stable schedule for our emergency doctors and bring in contract physicians by September 15 2009, this despite no proof of benefit and great cost to the region. The real issues of bed and nursing staff shortages are being ignored. Staffing more physicians per shift might appear to reduce wait times in the emergency department but in practice will not be effective. The long wait times do not currently result from the number of available doctors but, are due to the number of patients that are held In the department waiting for a bed to be admitted into. The staffing model in use by the emergency physicians has provided stability in emergency room physician coverage unrivaled in the region, and continuity of care. Over the past years the NHS administration have out nurses and closed beds, increasing the patient wait times. Adding more doctors will not solve this Issue unless additional beds and nursing support are also made available. The emergency physicians have been given an ultimatum to sign on to the new model or leave and be replaced by temporary agency doctors. Agency doctors and their private for - profit company are guaranteed payment and "top-ups"; there is little Incentive for them to reduce waft times. The current physicians do not bill the NHS and, have no top -ups or extra fees. They bill the Ministry of Health only for the services they provide, no service charges or administrative costs and, create no extra financial burden for the regional health care budget. NHS Response: • The NHS Is not unlike many other hospitals in the province that have limited resources, rising costs and must realign service provision and costs within available resources. • The NHS has been very successful in recruiting and retaining nurses. The vacancy rate for nurses is below the LNIN and provincial average; the NHS retention rate exceeds the provincial average. • Unlike nurses, physicians are not employees of the Hospital. Mayor Ted Salci September 30, 2009 Page 8 • Although the physician staffing at the GNG ER has been stable, the number of complaints has been increasing and the performance on indicators of wait times, left without being seen and patient satisfaction was not meeting provincial benchmarks. • Over the last few years, attempts at working with the physicians to move the GNG ER to best practice have been unsuccessful over the last few years (physician shifting, fast track area, medical directives, etc). Similar improvements had successfully been implemented at the Welland and St Catharines sites of the NHS. • The NHS commissioned a third party expert review to Identify where improvements could be made. • In discussion with the former site Chief of ER, an agreed upon date of September 15 was reached. The physicians working at the GNG ER have the opportunity to work the same number (or more) total hours under this new model. • Some of the physicians have chosen to leave rather than to work under this new model - that is their choice and we respect that. For the doctors remaining, the model being introduced will not Impact hours that are available to them to work. • The GNG ED Physician Group, as previously constituted, chose to get paid on a fee -per- service basis, which means they bill OHIP for every service they provide to a patient. • Over 90% of the EDs in the province have moved away from fee - for - service to an Alternate Funding Arrangement (AFA) model under which ER physicians are paid a fixed annual income, regardless of how many patients they treat. This model Is currently being used at the Welland, Port Colborne and Fort Ede sites of the NHS. • The model of compensation chosen, either the fee- for - service or the ED AFA, is a choice between the physicians and the Ministry of Health and Long -Term Care. • The ED AFA model ensures an appropriate level of income for physicians despite bed and patient flow pressures being experienced across the province. • Most physicians now graduating from medical school and wanting to practice emergency medicine: a) prefer to work in an ED AFA to have predictable earnings; and b) prefer shorter shifts of 8 to 10 hours. • Typically, moving from a fee - for - service remuneration model to an ED AFA funding model will result In similar or enhanced funding to ED physicians. • The NHS asked the independent reviewers to examine this issue and they found that even if the NHS were to fully implement the recommendations in the Report, the GNG ER physicians would earn a comparable income to other ER physicians in the province. • Significantly, the new model of physician coverage will be more attractive to physicians coming to Niagara because it will improve their work/life balance and is consistent with best practices followed in other ERs. • The changes that the NHS is introducing do not involve a plan to staff the GNG ER with temporary physicians. • The use of temporary physician services has been made necessary during the transition, in part as a result of decisions made by GNG ER physicians to leave, which the NHS understands and accepts. • The NHS does not want to lose physicians, however we recognize that despite our best efforts to work with the GNG ER, the changes being implemented will not be acceptable to every member of the Department. • If a physician chooses not to work in the new coverage model, that is his choice and as stated, we respect it, although we cannot continue to work under a model that Is not in line with best practices because it benefits a physician or even a small group of physicians. Mayor Ted Salci September 30, 2009 Page 7 • The NHS expects physicians to honour their professional and ethical commitment to put patient interests first, which in relation to the GNG ER, means working with the NHS to effect a smooth transition by giving fair notice and avoiding a disruption to the delivery of ER services. • The NHS has a mandate and responsibility to ensure the continuity of ER services at the GNG site and because of choices made by physicians, must look to temporary assistance from agencies such as Health Force Ontario or Med- Emerg. At the same time, the NHS will continue with active recruitment efforts. • There is no indication that staffing more physicians per shift will not be effective in reducing wait times for reasons that include the fact that not all ER patients need to be admitted to the hospital. Statement 7 —We are also faced with uncertainty as to what kind of hospital Greater Niagara General will be in the next months. Unexpected closures of pediatrics, obstetrics and gynecology, and psychiatry have left the emergency physicians scrambling to find places for patients In other hospitals, far from their homes in Niagara. With other reductions in services patients languish in stretchers in the emergency room often for days and to help reduce the burgeoning $110 million dollar deficit of the NHS. NHS Response: • The NHS has offered to meet with the GNG site physicians to address any concerns regarding uncertainty of services. • The NHS treats and maintains the majority of Niagara patients in Niagara. The NHS Is unaware of any instances where patients were transferred outside of Niagara, far away from their homes, for care, except in those cases where the services required are for services not currently offered In Niagara, i.e. tertiary • The NHS does at times experience bed pressures which results in patients being admitted to stretchers in the ER awaiting a bed on an inpatient ward. Although this is not ideal or preferred, the patients continue to receive the care they require in the ER. The pressures experienced by NHS are not uncommon across the province at other hospitals. Statement 8 — Despite our long record of service to the community, our record of performance above the benchmarks within the Niagara Health System, lowest level of complaints and shortest wait times and the dedication of the Emergency Physicians of the Greater Niagara General Hospital, the Niagara Health System administration appears committed to the dismantling of our hospital emergency department. NHS Response: • NHS is not dismantling the ER, but renewing it and bringing its operations into line with best practice for the benefit of our patients and physicians • The NHS cannot refuse to follow best practice to benefit one or even a group of ED physicians • Each physician has to make his own decision and the authors of the Open Letter have done so — with very little notice to the NHS — and without explanation of why the implementation plan their Group proposed for roll -out on September 15 is no longer acceptable • The performance of the GNG ER is not in line with provincial benchmarks and has great opportunity of improvement. With regards to the GNGH Emergency Department, we are in the process of implementing a number of changes including increasing the number of hours in which physicians provide coverage in the emergency department. We are planning to increase medical coverage in the emergency department by an additional 10 hours per day. The intention of this change is to reduce patient wait times and improve patient satisfaction. Change is never easy and we are currently working through issues with physicians at the site. At the time of this writing, we have received a formal notice from a GNGH emergency department physician who has decided to move on to other opportunities, and we can confirm that we have also recruited two new physicians into the emergency department and are actively recruiting for more. As well, we recently appointed Dr. Doug Munkley as Interim Site Chief of the GNGH ED, and have launched a recruitment process for the permanent site chief. Similarly, we are working through issues of concern expressed by nursing staff regarding staffing levels. Although we received additional operating funds in relation to the construction of the new emergency department, our ability to retain those funds was dependent upon achieving additional patient visits in the department which has not happened. This could be due to a number of factors, including either an increase in community -based walk -in clinics, or increased access to primary care. Therefore, because we cannot retain this money, we must alter staffing patterns accordingly. However, it is important to note that the staffing levels that remain in the department are comparable to other similar sized emergency departments, with similar numbers and types of patients. Mr. Dean Iodide August 21, 2009 Page 2 On the issue of the paediatrics unit, although the program is developing a feasibility study on the potential to move to two sites prior to the consolidation in the new hospital facility in St. Catharines by 2012/13, this feasibility study has not yet been completed and will be reviewed by the NHS Senior Executive and Board. Through the past several months, we have been hosting a significant number of community education sessions in the communities of Wainfleet, Port Colborne and Fort Erie with respect to the conversion of their 24 hour a day /seven day a week ED's to 24/7 Urgent Care Centres (UCC's). BACKGROUND Proposal His Worship Mayor Ted Salci and Members of the Municipal Council City of Niagara Falls, Ontario Planning & Development PD- 2009 -80 PD- 2009 -80 26CD -11- 2009 -03, Draft Plan of Condominium (Conversion) 3401 & 3421 Weinbrenner Road, East of Willoughby Drive Owner: Weinbrenner Place Inc. (Vincenzo Butera) The applicant proposes to convert the existing 70 -unit rental apartment building complex (2 buildings with 35 units each) to a condominium. The plan of condominium subdivision will permit the individual ownership of each unit with the common areas (e.g., hallways, October 19, 2009 ANALYSIS /RATIONALE - 2 - PD- 2009 -80 driveways and open space) shared by the condominium corporation. There is no new construction proposed. The property is on the north side of Weinbrenner Road, east of Willoughby Drive, as shown on Schedule 1. The building layout, open space and parking /driveway areas are illustrated on Schedule 2. There are no public meeting or notification requirements forcondominium conversion applications underthe Planning Act. However, in accordance with City procedures, Staff provided notice on October 5, 2009 to all tenants occupying the units about tonight's Council meeting as a courtesy. The owner's solicitor has also advised the tenants regarding the proposed conversion. Security of Tenure - Provincial Landlord and Tenant Legislation The Residential Tenancies Act (2006) is the Provincial legislation applicable to all landlord and tenant matters. This Act contains specific sections to protect existing tenants in cases of condominium conversions. Tenants cannot be evicted due to a conversion and have the right of first refusal to purchase a converted unit. Rents cannot be increased based on the conversion to condominium ownership and are regulated by Provincial guidelines. On this basis, there will potentially be no loss of rental units. Municipal and Regional Rental Housing Policies The City's Official Plan states that rental accommodation shall be protected and discourages the conversion of rental units to condominiums when the vacancy rate is below 3 %. Although tenants' rights are protected by Provincial legislation, the removal of rental units should not adversely affect the supply of affordable rental housing. The Region's Policy Plan states that Regional Council will not support the conversion of rental housing to condominium ownership if the supply of affordable rental housing will be adversely affected and considers a vacancy rate of 3% or more desirable for a healthy rental market. The Canada Mortgage and Housing Corporation (CMHC) survey from October2008 is the most current information available and indicates a vacancy rate of 5.2% for all apartment units in Niagara Falls. This overall municipal rate has increased from 3.2% in 2007. The subject site is located outside of the City "core" defined by CHMC and the apartment vacancy rate in this non -core area is 4.1%. The data indicates vacancy rates in this area of 3.7% for both one and two bedroom units and of 8.2% for three bedroom units. All of these CMHC figures exceed the Official Plan 3% vacancy rate threshold. Therefore, the removal of these apartment units should not have an adverse impact on the City's overall rental housing supply. The vacancy rate throughout the major urban centres of Niagara is 4.3% for all apartment units in October 2008 (an increase over the 4.0% figure last year). On this basis, the Region is not opposed to the conversion of these apartment units. The buildings contain 12 one - bedroom units, 34 two- bedroom units and 24 three - bedroom units. The applicant estimates that the selling prices for the proposed condominiums will be approximately $90,000.00 (one bedroom), $100,000.00 (two bedroom) and $110,000.00 (three bedroom) which would provide ownership of affordable housing. October 19, 2009 - 3 - PD- 2009 -80 Site Assessment The apartment buildings were constructed in 1972 -73 in compliance with zoning by -law provisions in place at that time. There are no City records with respect to any site plan approval. The property is currently zoned Residential Apartment 5B Density (R5B) in accordance with Zoning By -law No. 79 -200. Although compatibility with the surrounding properties has been established over the years, the condominium conversion process provides the opportunity to achieve site improvements in keeping with current development standards and to formally recognize acceptable zoning by -law deficiencies. The development satisfies lot size requirements and exceeds minimum parking space standards of the zoning by -law. The City's Committee of Adjustment granted approval on September 1, 2009 (File A- 2009 -021) to zoning variances for front yard depth, building height and roofed -over porch projections in the front yard - no appeals were received and the decision is final. Municipal Works requires the applicant to provide site servicing information regarding weeping tile flows and downspout outlets. If these discharge to the sanitary sewer they must be disconnected. The formal designation of a fire access route though the site is requested as a condition. Several garbage bins and recycling containers are located at the north limit of the parking lot. A proper enclosure is required to screen the garbage /recycling area. The development currently receives waste collection service through the Region's contractor. The land is within a registered plan from 1956 and all parkland requirements were addressed through the initial subdivision process. CITY'S STRATEGIC COMMITMENT Council's priority is to strengthen and promote economic development in the City. Condominium conversion usually results in building upgrades and reinvestment in existing properties. EXECUTIVE SUMMARY The Zoning amendment is proposed to facilitate the sale and reuse of the subject property. The application can be approved for the following reasons: The proposed Tourist Commercial zone implements the Tourist Commercial designation of the property and is consistent with the zoning in effect on the other properties at the Lundy's Lane /Montrose Road intersection. Adding offices to the list of permitted uses will diversify the range of uses that can be established. BACKGROUND The amendment is proposed for City -owned property known municipally as 7565 Lundy's Lane (see Schedule 1). The building on the property was constructed in 1915, and was originally a school. The property was used as police substation and jail by Stamford Township in the 1950's. After closure as a police substation, the building was used by the City's Engineering Field Crew, then the City Planning Department and finally the Parks, Recreation & Culture office. The City is in the process of selling this property and proposes to change the zoning of the property to allow this building to be used for tourist commercial and office purposes to facilitate the sale of this property. • October 19, 2009 - 2 - PD- 2009 -74 The subject land is currently zoned Open Space (OS). The zoning of the land is proposed to be changed to a site specific Tourist Commercial (TC) zone to allow the property to be used for commercial purposes including offices. On the April 6, 2009 meeting, Council directed that this property to be appraised, put on the open market with a reserved bid, with notice of the future intent to designate the property under the Ontario Heritage Act. This recommendation is based on the Municipal Heritage Committee's (MHC) motion that they be involved in future discussions involving the building and consideration be given to designating the building and property A Statement of Cultural Heritage Value, being the basis of MHC's motion, is attached as Appendix 1. A local businessman, Mr. Felix Pingue, has expressed an interest in purchasing the property and making minor repairs to facilitate its use for offices. Surrounding Land Uses The Lundy's Lane Cemetery lies to the north and east of the land. A variety of commercial uses geared towards tourists and residents, including motels, hotels, restaurants and retail stores, lie to the west, south and south -east of the land. Circulation Comments Information regarding the proposed Zoning By -law amendment was circulated to City divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: Municipal Works and Transportation Services No Objections. Parks, Recreation and Culture ANALYSIS /RATIONALE Supports the rezoning application. A 1.5 metre (4.9 feet) landscaped open space strip will be installed along the north and east property lines to buffer the adjacent cemetery and associated wrought iron fence. The land is designated Tourist Commercial by the Official Plan and is part of the Lundy's Lane Tourist District. Lands in this District are intended to be developed with a wide range of small to medium scale commercial uses to serve residents and tourists. The proposed Tourist Commercial zone, with an office as an additional use, will reflect the designation of the property and provide services to residents and tourists. Zoning Request The proposed site specific Tourist Commercial (TC) zone will provide for a range of uses that will be compatible with other development along Lundy's Lane. The addition of an office as a permitted use will provide a use that can be readily accommodated in the existing building and will therefore provide an opportunity to preserve this building. The existing building conforms with TC zone regulations. The provision of parking and loading will depend on the use, however there appears to be ample lot area to do so. A 1.5 metre (4.9 feet) wide landscape strip is to be installed by the City where necessary October 19, 2009 - 3 - PD- 2009 -74 along the north and east property lines prior to its sale to buffer the adjacent cemetery from the subject land's parking area. The amending by -law will require this landscape strip to ensure it remains. The standards in the TC zone will ensure that any additions to the building will be compatible with other developments along Lundy's Lane. CITY'S STRATEGIC COMMITMENT The amendment will allow the site to be sold and used for commercial purposes which supports Council's strategic priority of strengthening and promoting economic development in the City. Although it has been used as a school, police station and municipal offices, its minor alterations have not detracted from its prominent position on the corner of Lundy's Lane and Montrose Road. The site has cultural heritage significance to the City of Niagara Falls through its association with the early settlers (Greens and Lundy's) and with the "Old Red Meeting House ", the Methodist meeting house which once stood on the site as well as its adjacent cemetery (now Lundy's Lane Cemetery) still located east of this structure. The site was also the location of three early Stamford Township schools. The building was constructed in 1915 and is the last remaining rural two room school of that era. Features such as the high stone foundation, brick comer quoins, portico entrance with a simple pediment supported by short wooden columns on brick piers, windows on stone sills topped with brick voussoirs and large contrasting key stones, projecting eaves supported by scroll brackets and hipped roof are all typical elements of this style. It also displays unique design features such as the paired side windows with segmental arches above and a recessed front entry. The building has been altered to suit its uses as the Stamford Township Police Department and Court from 1953 to 1972 and more recently as an art gallery and office space for the City's Parks, Recreation and Culture division. The cultural heritage value and interest of this property is contained in the 1915 Edwardian Classical style school. The OPP has made a request through the Region for dedication of the Garden City Skyway, the QEW overpass at Niagara Street in St. Catharines and the McLeod Road overpass in Niagara Falls. For the dedication to take place both the upper tier and lower tier municipalities have to agree to the request. The Region has deferred a decision to get input from the affected lower tier municipalities. With regard to the McLeod Road overpass, the proposal would see the overpass dedicated to Constable Michael Gula, who was tragically struck by a motorist on April 2, 1996 while tending to an incident on the QEW near McLeod Road. Similar to the dedications of Highway 420 or the 405, staff sees such a dedication as largely ceremonial. If the McLeod Road overpass is dedicated, it would mean the installation of signage recognizing Constable Gula. Arguably, the overpass would still be commonly referred to as the McLeod Road overpass. Regional Council at its meeting on July 30, 2009 referred the attached communications (Appendix I) regarding bridge dedications for Fallen Police Officers to the Regional Clerk for a report on the protocol for the dedication of roads and bridges. In reviewing this matter, the Regional Clerk determined that the report back on this matter should be submitted through the Integrated Community Planning and Public Works Committee. It is the norm that requests of this nature be dealt with first at the Standing Committee level prior to consideration at Regional Council. The purpose of this report is to provide further background with respect to the requests received from the Niagara Detachment of the Ontario Provincial Police for setters of support for bridge dedications for three fallen police officers. 1 REPORT The attached policy (Appendix 11) from the Ministry of Transportation (MTO) outlines the process followed with respect to requests for the dedication of bridges on provincial highways in memory of police officers that have died in the line of duty. Upon approval of requests under this policy, bridge dedication signs are to be installed in all directions of travel.. The policy followed by MTO also requires the written consent from the local municipality and the regional municipality in which the signs are to be installed. There is no regional policy in place to provide guidance on the matters which should be considered when a bridge dedication request is received pursuant to the provisions of the Highway Memorials for Fallen Police Officers Act. Regional Council, could if it so wishes, provide direction for the development of criteria for the consideration of such requests. Along the rest of Queen Street, we see smaller areas designated for the Latin, Greek, Italian, Serbian and other cultural groups. Each area will be distinct in providing ethnic food and entertainment. We will enlist the aid of the Folk Arts Association in St Catharines to help us work with the local clubs to promote the event to their members over the next few months. Epidermolysis Bullosa (EB) is a group of genetic disorders characterized by exceptionally fragile skin and chronic, painful wounds and blisters caused by the slightest trauma, even normal day- to-day activities. The disease affects people of both genders and every ethnicity. As many as 500,000 people (constituents) worldwide suffer from some form of EB. It is often disabling and life- threatening, requiring daily wound care similar to that of severe bum patients. There is no cure, but there is something about the word "incurable" that is contrary to the indomitable nature of people living with EB. In terms of awareness and knowledge, there is an unfortunate gap between what is and what should be. Changing this is vital to the future of EB research and universal patient support. The EB community is determined to lead a movement to fundamentally change its experiences and expectations — to speak with one voice in our relentless quest for effective treatments and a cure for all types of EB. Your proclamation will serve to support the continuing work of EB charities as a critical link in the effective delivery of healthcare to EB patients around the globe. The Mayor and Clerk are the traditional signing authorities for the municipality. Recently, staff has encountered facility agreements when booking information booths at public buildings, such as Niagara Square. Because such agreements do not involve any financial consideration, requiring a Council report and/ or execution by -law seems to be excessive; therefore, it is proposed that Divisional Directors be given the authority to sign non - monetary booking agreements. The Mayor and Clerk are the traditional signing authorities for the municipality. The Mayor and Clerk can only sign, or execute, legal agreements if they have been authorized by Council to do so, either by by -law or an approved Council report that is ratified through the passing of the confirmatory by -law. For the most part, it is appropriate for all agreements to come before Council for approval; however, staff has recently been asked to sign agreements related to their presence at facilities in the community. These agreements can best be described as facility booking agreements that do not involve any direct monetary value and ensure that the municipality has appropriate insurance when renting the facility. Niagara Square, for example, has an agreement it requests outside groups to sign (see an attached sample). The municipality has regularly hosted information booths at the Square for events like Professional Engineering Week and Fire Prevention Week. In addition, the Arts & Culture Wall of Fame event is also held at the mall. Traditionally, such agreements should come before Council to authorize the execution of the agreement by the Mayor and Clerk. Often the booking agreement is an after thought and a formal report to Council is not possible because of timing or would seem like "overkill" in light of the lack of a quantum related to the agreement. To date, either the renter has waived the requirement or staff may have, over the years, inappropriately signed such agreements without the authority to do so. October 19, 2009 - 2 - CD- 2009 -14 ANALYSIS /RATIONALE Section 270 (1)(6) of the Municipal Act 2009 ( "The Act "), as amended, allows a municipality to adopt policies with respect to the delegation of Council's legislative and administrative authority. The purpose of this policy is to set out the scope of the powers and duties which Council may delegate its legislative and administrative authority and to establish principles governing such delegation. In compliance with the Act, Council adopted the attached policy (200.46), which requires staff to bring forward any delegation of authority in a report for Council's consideration. With regard to these booking and licence agreements, it is proposed that they be delegated to the appropriate Director of the division renting the space at the public facility. For example, the Fire Chief would sign the agreement if the Fire Department was using Niagara Square for Fire Prevention Week. Such a delegation should only occur if there is no fee related to the facility rental. The Director will also be responsible for notifying the City's insurer of the proposed event. The rationale for delegating this authority to staff is that the agreements are minor in nature, they do not involve any financial consideration, and allowing staff the signing authority will expedite such agreements. FINANCIAUSTAFFING /LEGAL IMPLICATIONS As indicated, the agreements do not involve financial consideration. Legal Services is in agreement with the delegation for these minor matters. CITY'S STRATEGIC COMMITMENT The Corporation should be encouraged to engage in information sessions and booths at public places within the community. Delegating the authority to staff will remove some "red tape" that seems unnecessary. EXECUTIVE SUMMARY The City of Niagara Falls continues to exhibit increased tax receivables due to the slowdown in the economy. Tax receivables as a percentage of taxes billed has increased from 16.0% to 16.3% with $47.9 million in taxes outstanding as of September 30, 2009. Of this, $26.1 million is in arrears and $21.7 million will become due in October. The City's finance staff has had success in resolving 90% of properties subject to registration for 2009. Lastly, forty properties are scheduled for tax sale in the next year, including twenty scheduled for November 4, 2009. BACKGROUND This report is being provided as part of the monthly financial reporting to Council by staff. It is also submitted to our banking institution for compliance with our banking agreement. ANALYSIS /RATIONALE F- 2009 -53 October 19, 2009 The tax collection for 2009 lags behind the collection history in 2008. This is consistent with historical trends in taxation years when the economy has slowed. Table 1 shows that taxes outstanding at September 30, 2009 were $47.9 million with $26.1 million being in arrears and $21.7 million being due on the final installment date in October. This represents an increase from $47.2 million total and $25.2 million in arrears for the same period in 2008. Finance staff continues to actively pursue property owners in arrears. The percentage of taxes outstanding to taxes billed in 2009 was 16.3 % versus 16.0% in 2008. This indicates that although tax receivables have grown, it is relatively the same percentage to tax billed increases. Table 2 provides the breakdown of outstanding taxes - total by assessment class. Consistent with previous months, the majority of outstanding taxes are for residential and commercial properties. At the present time, with final tax billing completed, the ratios of uncollected taxes by property class has remained virtually the same. October 19, 2009 -2 - F- 2009 -53 Finance staff takes specific collection actions for properties that are subject to registration. These action steps have been outlined in previous reports. At January 1, 2009, 264 properties were subject to registration. Table 3 summarizes the progress of these actions after nine months of activity. This table shows 90% of the tax accounts have paid in full or have made payment arrangements. During September, seven accounts were paid in full. Finance staff continues to make every effort to have accounts paid in order to avoid the registration process and the associated costs related to that process. Table 4 identifies the properties and associated tax arrears scheduled for tax sales in the future. During the month of September, three properties were redeemed. The outstanding taxes for registered properties represent 5.2% of the total outstanding taxes at month end. As Table 4 also indicates there is a tax sales date scheduled for November 2009. On November 4, 2009, 20 properties are being sold for tax sale. Advertisements have been placed in the local newspapers and in the Ontario Gazette. Information is also available on the City's website at www.niagarafalls.ca /taxsales and at www.ontariotaxsales.ca. FINANCIAL/STAFFING /LEGAL IMPLICATIONS Tax arrears as a percentage of taxes billed in a year is a performance measure that stakeholders utilize to analyse an organization's financial strengths. Niagara Falls, due to its high reliance on commercial assessment, is traditionally higher compared to municipalities of similar size. The municipality has a record of full collection and earns significant penalty revenues to offset the higher measure. EXECUTIVE SUMMARY Property owners are able to seek remedy from property assessments that are not accurate due to errors in preparation of the Assessment Roll or due to changes in specific circumstances. These remedies are available by virtue of s.357 and s.358 of The Municipal Act, 2001. This report is provided to Council periodically during the fiscal year to attain Council approval of the changes afforded under these sections. Adjustments totalling $649,808.28 are being recommended in this report with allocations to be made to City, Regional and School board revenue. The City's allowance for tax write - offs has been budgeted and will be adequate to account for the City's proportionate share of approximately $195,000. BACKGROUND This report is the second report this year in relation to s.357 and s.358 reductions. The Municipal Property Assessment Corporation has confirmed that the subject properties were assessed incorrectly in that these properties; had structures that had been demolished or removed, were damaged or razed by fire, have ceased to be liable at the rate it was taxed, became exempt, or a transposition, typographical, or clerical error was made. EXECUTIVE SUMMARY Upon circulation of the request to release the above - mentioned Agreement to various City departments, Staff confirms that the Agreement is no longer required and may be released from the title of the Subject Lands, at no cost to the City. BACKGROUND In 1967 the City entered into a Site Plan Agreement with the then owner of the Subject Lands. The Subject Lands are currently the Zellers Plaza. The Agreement provides that the covenants contained therein bind the Subject Lands for a period of twenty years from the date of the Agreement, being October 16, 1967. As the twenty -year period has long since expired, the covenants contained in the Agreement are no longer in force. The City has received a request from Barbara C. EXECUTIVE SUMMARY L- 2009 -31 The retaining wall and sidewalk on the north side of Murray Street are located partially on neighbouring privately owned lands. The proposed Agreement would formalize the owner's permission to the location of the retaining wall and sidewalk. BACKGROUND In 2003, the City constructed certain works including a retaining wall and sidewalk which were intended to be located within the Murray Street road allowance. During the course of construction, it was determined that the appearance and functionality of the works would be improved if the retaining walls were set back farther from the traveled portion of the roadway than as was originally proposed. Permission for the placement of these encroachments was obtained from persons who Staff understood to be representatives of the owners of the neighbouring lands. In the case of the north side of Murray Street, it turned out that the person who purported to be a representative of the owner was, in fact, the representative of a tenant of the owner. (The lands in question are owned by Sainovich Realty Limited -the Gruyich family- and are subject to a 99 year Lease in favour of 656508 Ontario Limited - the Yerich family.) The owner has no objection to the arrangement and the purpose of this Agreement is to formalize the permission of the owner to the location of the retaining wall and sidewalk. ANALYSIS /RATIONALE An argument could be made that given the terms of the Lease, the permission of the owner October 19, 2009 is not required. However, Staff sees no reason to make such an argument and recommends that Council execute this Agreement to acknowledge the owner's residual interest in the subject lands. Quotations and Tenders for New Equipment were opened by the Tender Opening Committee on their respective days received. A summary of bids is attached for Council's information. After a complete review of the specifications submitted from all bidders for quotations and tenders, it was found that the lowest bidders from each, with the exception of bidders for T10 -2009, meets the specifications as outlined in the quotation and tender documents. This matter is being brought to your attention so that the City can receive delivery by the end of November 2009. It is recommended that the quotation from Evergreen Farm & Garden Ltd. for Q43 -2009 be accepted for the purchase of a Tractor with Tiger Mower and the tender from The Shop Industrial be accepted for the purchase of a Sidewalk Plow Sander. October 19, 2009 Tenders for a Front End Loader were opened by the Tender Opening Committee on September 10, 2009 and September 24, 2009 respectively. After a complete review of the specifications submitted from all bidders for Tender T10-2009, it was found that the lowest bidder, Top Lift Enterprises of Stoney Creek, ON, did not meet specifications as outlined in the tender documents. It should be noted that staff did test drive this front end loader and specified problems with ground clearance, visibility, and steering sensitivity. Therefore, it is recommended that the second lowest bidder, Wajax Equipment, meeting all requirements of the tender specifications, be awarded this tender. Upon reviewing the specifications submitted from all bidders for Tender T12 -2009 it was found that the lowest bidder, Holder of North America Inc. of Greely, ON did not meet specifications with required horsepower and adaptability of accessories to current equipment. Therefore, it is recommended that the second lowest bidder, Work Equipment be awarded this tender. EXECUTIVE SUMMARY BACKGROUND MW- 2009 -81 October 19, 2009 On July 20, 2009, City Council adopted the recommendations set out in report MW- 2009-51 which authorized the engagement of the consulting firm Delcan Corporation to complete the engineering design and obtain all necessary approvals from the relevant agencies. The report contained a phasing plan and proposed construction schedule that would generally meet the funding criteria established in the Infrastructure Stimulus Fund program announced by the Federal and Provincial Governments. The City received notice that the application was successful and staff and consulting team has acquired all necessary approvals to commence the first phase of the project. Tenders for this contract were opened on Tuesday, October 13, 2009 and the lowest bid of $2,849,101.86 received from Nexterra Substructures is being recommended for acceptance. The Tender Opening Committee, in the presence of the City Clerk's representatives Mr. Ray Miller, Manager of Supply & Services and Mr. Bill Matson, Manager of Clerk's Services opened tenders on Thursday, October 13, 2009 at 1:30 p.m. for the above noted contract. Tender documents were picked up by twelve (12) Contractors and five (5) bids were received. Listed below is a summary of the totaled tendered prices, excluding GST, received from the Contractors. Funding for this phase of the project will be derived from the following sources; Infrastructure Stimulus Fund (2/3) Region of Niagara CSO Program Transfer from Operating Total Funding This expenditure represents the first phase of additional works that will be funded over a two -year period. The entire project is estimated to cost $4,280,000. The second phase will be completed prior to March 31, 2011. ANALYSIS /RATIONALE The lowest tender was received from Nexterra Substructures in the amount of $2,849,101.86. This contractor has performed similar type projects in the City. We are of the opinion that this contractor is capable of successfully undertaking this project. The Engineer's estimate for this project was $3,000,000.00. Analysis of the number and the content of the bids received indicates fairly strong competition at this time for capital projects of this type and size. Timing of tenders for construction, when the planned schedule permits, can play an important role in how competitive the market will be, based on prospective bidders work loads. CITY'S STRATEGIC COMMITMENT Implementation of the Capital Project meets the intent of Council's Strategic Priorities to establish infrastructure investment priorities, and to strengthen and promote economic development within the City. EXECUTIVE SUMMARY His Worship Mayor Ted Salci and Members of the Municipal Council City of Niagara Falls, Ontario Transportation Services BACKGROUND TS- 2009 -40 Beck Road Bridge Weight Restriction TS- 2009 -40 October 19, 2009 The weight restriction will prohibit vehicles more than 12 tonnes from travelling across the bridge on Beck Road. Ellis Engineering has recently completed a structural inspection of the Beck Road bridge crossing Lyons Creek, which is located 200 metres south of Lyons Creek Road. The assessment resulted in the recommendation to post a maximum load limit of 12 tonnes. ANALYSIS /RATIONALE Currently there is no weight restriction to cross the Beck Road bridge. However, given the results of the recent assessment of the integrity of the structure, Ellis Engineering has stated that a weight restriction is required. The analysis was carried out as part of the 2009 Municipal Bridge Appraisal - Rehabilitation /Replacement report. Upon the approval of the by -law, regulatory signs will be posted at each end of the bridge identifying the weight restriction. Furthermore, advance signs will be installed at the nearest intersections prior to the bridge. The signs are regulatory in nature, and would be enforceable by the Niagara Regional Police. FINANCIAL /STAFFING /LEGAL IMPLICATIONS The installation of the signs is carried out by Transportation Services staff. The labour and material costs are accounted for in the Approved 2009 General Purposes Budget. Cost studies estimate that the cost to manufacture and install the signs is approximately $500. THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS: 1. The Lands that are the subject of and affected by the provisions of this by -law are described in Schedule 1 of this by -law and shall be referred to in this by -law as the "Lands ". Schedule 1 is a part of this by -law. 2. The purpose of this by -law is to amend the provisions of By -law No. 395, 1966, to prohibit the use of the Lands in a manner that would otherwise be permitted by that by -law. In the case of any conflict between a specific provision of this by -law and any existing provision of By -law No. 395, 1966, the provisions of this by -law are to prevail. 3. Notwithstanding any provision of By -law No. 395, 1966 to the contrary, the following uses shall be the permitted uses on and of the Lands. 4. The permitted uses of the Lands shall be the uses permitted by the Rural zone except for a single - family dwelling. 5. All applicable regulations set out in By -law No. 395, 1966 shall continue to apply to govern the permitted uses on the Lands. 6. No person shall use the Lands for a use that is not a permitted use. 7. No person shall use the Lands in a manner that is contrary to the regulations. 8. The provisions of this By -law shall be shown on Schedule "A" of By -law No. 395, 1966 by labelling the Lands as being subject to By -law No. 2009- . Passed this nineteenth day of October, 2009. No person shall use the Lands for a use that is not a permitted use. 8. No person shall use the Lands in a manner that is contrary to the regulations. 9. WHEREAS By -law 2009 -146 authorized the Mayor and Chief Administrative Officer to execute the agreement between Her Majesty the Queen in right of the Province of Ontario, as represented by the Minister of Energy and Infrastructure and the Minister of Agriculture, Food and Rural Affairs, and the Corporation of the City of Niagara Falls, for the Drummond Road project approved the second intake of the Infrastructure Stimulus Fund (ISF); and WHEREAS in September 2009, the senior levels of government announced that the Revitalization of the Downtown Streetscape project was approved for infrastructure funding; and WHEREAS Ministry officials have requested that the original agreement for infrastructure funding be amended to reflect both successful submissions: the Drummond Road project and the Revitalization of the Downtown Streetscape project.
