Doing it as a nine - year -old is remarkable. « Back That's what Niagara Falls native Justin DiCienzo will be doing this weekend at a PGA Golf Club Invitational in Port St. Lucie, Fla. The St. Vincent de Paul student will be one of 40 nine - year -olds from around the world challenging for supremacy in that age group. He is one of only two Canadians who met the scoring requirements and qualified to receive an invitation to the two -day tournament. A practice round is set for Friday and the event is scheduled for Saturday and Sunday. "I'm really excited to go there and play and beat their butts," a smiling DiCienzo said this week. He prepared for the tournament by "chipping, putting and going with my instructor. And just going to Legends (on the Niagara golf course) every day," he said. DiCienzo was invited based on his performances in six recent qualifying toumaments in Finger Lakes, Cleveland and Canton, Ohio. He placed in the Top 3 for five of the six qualifying tournaments with scores that ranged from 40 to 42 — well below the 44 on a par 36, nine -hole cut off. The top three finishers in this weekend's tournament will receive an invitation to the 2010 U.S. Kids World Championships at Pinehurst, N.C. Aug. 5 to 7. "He was jumping up and down," DiCienzo's father, Michael, said when told of the invitation that came about four weeks ago. "He's been working really hard, doing a lot of toumaments and shooting really well." DiCienzo started golfing when he was six, but this is his first year in competitive toumaments. The Grade 4 student is a member of the Canadian Junior Golf Association Golf Tour and the U.S. Kids Golf Tour. DiCienzo's golfing talent was discovered by his father three years ago, when the boy found a club in a park near his home and started swinging it "really well." "I got a bunch of balls and he started cracking 'em," said Michael DiCienzo. "I said, 'Oh my goodness.' I got him lessons and got him training, and he hasn't looked back since." EXECUTIVE SUMMARY The Zoning By -law amendment can be approved for the following reasons: • The uses comply with the Official Plan and are in an area where small scale accommodations may be considered. The residential character of each dwelling will not be affected by the proposed use for short term accommodation. BACKGROUND Proposal PD- 2009 -100 Provided no more than (3) bedrooms are contained in each dwelling and at least one complying parking space is provided for each dwelling, the use of the properties will be compatible with adjacent dwellings and will not cause any adverse parking problems. An amendment is requested for 4901 and 4907 Ontario Avenue (see Schedule 1) which have lot areas of 557 square metres (6000 square feet) and 246 square metres (2651 square feet) respectively. The applicant is requesting that the two existing dwellings on the lands be permitted to be used as cottage rental dwellings (rented to tourists for accommodation for 28 days or less). Schedules 2 and 3 show existing dwellings on the properties. The subject properties are zoned Residential Single Family and Two Family (R2) which does not permit the dwellings to be used as cottage rental dwellings. The R2 zoning is requested to be amended site specifically to permit each property to be used as a cottage rental dwelling. • December 14, 2009 - 2 - PD- 2009 -100 Site Conditions and Surrounding Land Uses Both properties are two- storey, single detached dwellings. While the parking area on 4901 Ontario Avenue can provide at least two (2) parking spaces in tandem that conform to required dimensions, the two parking spaces on 4907 Ontario Avenue are substandard in length (about 4.5 metres or 15 feet versus the required 6 metres or 19.7 feet). A variety of housing types surround the subject properties to the north, south and west of the subject lands. Land to the east is being developed for the Olympic Torch Run Legacy Trail. Circulation Comments Information regarding the proposed Zoning By -Jaw amendment was circulated to City divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: ANALYSIS Regional Municipality of Niagara No objection from a Regional or Provincial perspective. Building and By -law Services No comments to date. Municipal Works, Fire Services, Legal Services, Transportation Services No objections. Public The submissions of two neighbours are included in tonight's agenda. One objects to the proposal noting concerns about parking. The other is supportive of the proposal. Neighbourhood Open House A neighbourhood open house was held on November 10, 2009. Three (3) neighbours attended. One neighbour expressed concerns about the cottage rental dwellings, including the enforcement of the proposed regulation that limits the rental to one group of travellers per cottage, and the potential of parking demand spilling off the properties and onto surrounding streets due to one of the properties not having a full sized parking space. Provincial Policy & Regional Policy Plan The subject properties are located within the Urban Area Boundary and within the Built Up Area. A range of residential uses are permitted in these locations. The proposal does not affect any Provincial or Regional interests. December 14, 2009 - 3 - PD- 2009 -100 Official Plan The properties are designated Residential in the Official Plan. While residential dwellings are intended to be the predominant use under this designation, small scale tourists accommodations such as bed and breakfast accommodations may also be permitted by a zoning by -law amendment. The establishment of such accommodations are to be carefully regulated as to their location, size and traffic generation in order to minimize potential disturbances to adjacent properties and to protect the character and identity of the overall neighbourhood. The proposed cottage rental dwellings conform to the Official Plan as follows: The location is appropriate for accommodations. The subject properties are adjacent to an area that is zoned for bed and breakfast accommodations, across from the new recreational trail and within walking distance of the downtown and tourist area. Zoning Cottage rental dwellings are an alternative form of accommodation that are similar in scale and function to bed and breakfast accommodations that may also be considered in residential areas. The residential character of the dwellings and the properties will be maintained because no changes are proposed to either dwelling. The cottage rental dwellings are not expected to generate any more traffic or parking demand than a typical single detached dwelling because each will be rented to a separate group of travellers. The cottage rental dwellings will be compatible with the surrounding residences provided the amending by -law limits each dwelling to three (3) bedrooms. As the Ontario Building Code limits occupancy to two (2) persons per bedroom, the total occupancy of each cottage would be limited to six (6) persons. To ensure by -law standards are met at least one of the parking spaces at 4907 Ontario Avenue will have to be enlarged to 6 metres (19.7 feet) long. This change would ensure that the same amount of parking to be provided for a single detached dwelling is provided for the cottages, and will alleviate concerns that required parking may spill off of the properties and onto surrounding streets. This improvement should be finalized before the passage of the amending by -law. CITY'S STRATEGIC COMMITMENT Cottage rental dwellings provide alternative accommodations for tourists which supports Council's strategic priority of strengthening and promoting economic development in the City. There Is not enough room for a single vehicle to park in the drive way at a 90 angle to the road without the vehicle being an city owned property. The drive way between the two houses is extremely tight and the house itself is sitting on the edge of the property line with very little room to spare. Due to the fact that the house is too close to the road, the drive way is too small to accomodate a vehicle in a normal parking manor, and there is limited green space available, this application should not even be considered. In order for this application to be considered there should be a proper side yard set back, a proper front yard set back, and proper parking, which in todays standards is 2 parking spots per single family house. Why would this tiny house and property be considered to be upgraded to a cottage rental, which Is the next best thing to a hotel There is insufficient parking,inadequate green space, and the house is encroaching on the front yard and . side yards set back, This house has single family status and it should remain that way. Everything about this application is wrong. Also please note that there is no street parking allowed on Ontario Avenue. This would be a very poor planning and zoning decision. Please could you forward this to Mr. Alex Herlovitch, Director of Planning and Development I unfortunately will be unable to attend the Dec 14, 2009 meeting as 1 will be out of province. EXECUTIVE SUMMARY The proposed amendment is requested to allow the construction of a semi - detached dwelling. The Official Plan supports the provision of a compatible mix of dwelling units so that a variety of housing types are available in each neighbourhood. The Zoning By -law amendment can be approved for the following reasons: The subject land satisfies City's zoning standards for a semi - detached dwelling. The proposed dwelling will be compatible with the surrounding land uses which are a mix of single and semi- detached dwellings and apartments. BACKGROUND Proposal A zoning amendment is requested for a 913 square metre (0.22 acres) parcel of land as shown on Schedulel. The land is the former Ethel Street road allowance which was recently sold by the City. The land is currently zoned Residential Single Family 1D Density (R1 D), by Zoning By -law 79 -200, which only permits a one family detached dwelling. The zoning of the land is requested to be changed to Residential Single Family and Two Family (R2) which would permit a semi - detached dwelling to be built. Please refer to Schedule 2 and 3 for further details. Site Conditions and Surrounding Land Uses The land is currently vacant. The surrounding area is a mix of single, semi - detached and apartment dwellings. Properties to the north, south and east of the subject land are single detached dwellings, while a place of worship (Serbian Orthodox Church) exists to the west and apartment dwellings exist south of Charnwood Avenue. December 14, 2009 - 2 - PD- 2009 -98 Circulation Comments Information regarding the proposed Zoning By -law amendment was circulated to City Divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: • Regional Municipality of Niagara ANALYSIS The proposal complies with Provincial Policy Statement. The proposed zoning would facilitate intensification by permitting the development of a property to higher density than what it is currently permitted. This will make efficient use of existing serviced land and help contribute to intensification targets established by Provincial and Regional Policies. Regional staff requests that the City follow up with previous road widening request and ensure the necessary widening is provided to the Region. (Note: This can be addressed as a condition of a future severance application.) Municipal Works A detailed site servicing and grading plan shall be submitted by the owner prior to the construction for review /acceptance by Engineering Services. Parks, Recreation and Culture Cash -in -lieu of parkland payment will be required when lands are severed. Boulevard trees must be provided as per City Development Standards. Transportation Services, Fire Services and Legal Services No objection. Public Open House To assist the public in understanding the proposed development a public open house was held on November 10, 2009. Staff provided an overview of the proposed development and addressed the residents' concerns regarding the number of dwellings, building height, parking, etc. The neighbour to the north of the subject land attended the open house and was supportive of the proposed development. Provincial Policy & Regional Policy Plan Provincial policies direct growth to built -up and settlement areas and support intensification. The proposal would assist in reaching intensification targets established by Provincial and Regional policies and would result in a more efficient use of land and existing infrastructure. December 14, 2009 - 3 - PD- 2009 -98 Official Plan The subject land and the surrounding properties are designated Residential in the Official Plan. The predominant use of land in areas designated Residential is dwelling units of all types catering to a wide range of households. The policies of the plan direct the provision of a compatible mix of dwelling types in all planning districts so that a variety of housing types will be available to different age groups, household sizes and incomes. The subject land is located in a neighbourhood which has a mix of dwelling types. The proposed semi- detached dwelling will be similar to other dwelling units in the neighbourhood in terms of density, building mass, setbacks and appearance. Zoning By -law The subject land and surrounding lots were zoned R1 D in 1979 to reflect the size and use of the surrounding lots for single family detached dwellings. The owner is requesting the zoning of the former road allowance to be changed to the Residential Single Family and Two family (R2) zone to permit the construction of a semi - detached dwelling. The subject land is 5 metres (16 ft.) wider than the abutting lots and complies with the R2 zone regulations for a semi - detached dwelling. The Region requires the semi- detached dwelling to be accessed via a mutual driveway to reduce the number of access points along Montrose Road which functions as an arterial road. The site plan submitted with the application shows a combined driveway for both dwelling units in compliance with the Region's requirements. CITY'S STRATEGIC COMMITMENT This application does not specifically impact on any of Council's strategic priorities, however, the proposal would provide a compatible housing form in the neighbourhood and represent an efficient use of urban residential land. ACORD 25 (2001108) Niagara,Falls REPORT TO: His Worship Mayor Ted Salci and Members of the Municipal Council City of Niagara Falls, Ontario SUBMITTED BY: Chief Administrative Officer SUBJECT: CAO- 2009 -02 Administration of the Bob Gale Recreation Fund RECOMMENDATION EXECUTIVE SUMMARY BACKGROUND CAO- 2009 -02 December 14, 2009 1) That Council authorize the Mayor and Clerk to sign The Novation Agreement allowing Gale's Gas Bars Limited (GGBL) to donate directly to the Niagara Community Foundation (NCF), and 2) That future annual distributions flow from the Niagara Community Foundation to the Bob Gale Recreation Fund. In January 2008, Bob Gale Jr., the proprietor of Gale's Gas Bars Limited, made a generous $1.25 million commitment toward the construction of the four pad arena complex, now known as the Gale Centre, scheduled to open in 2010. Mr. Gale designated one million dollars of the donation toward financing the construction of the facility, and $250,000 to a fund that will provide financial assistance for individuals who, due to financial constraints, are unable to participate in active and healthy lifestyle pursuits. The $250,000 designated to enable disadvantaged individuals to participate in recreation and leisure programs and activities will be invested through the Niagara Community Foundation, where the money will be put into a permanent, income - earning endowment fund. Funds for the endowment will be provided in years 2016 and 2017 of Mr. Gale's donation. To facilitate acceptance of Mr. Gale's donation and the creation of the recreation fund, the City entered into an agreement with Gale's Gas Bars Limited. The attached Novation Agreement replaces the Corporation of the City of Niagara Falls with Gale's Gas Bars Limited (GGBL) as donor in regard to $250,000 pledged to the Niagara Community Foundation (NCF). The donation will be held in perpetuity in a fund called the Bob Gale Recreation Fund (BGRF) by the NCF with annual earnings of the fund distributed to Niagara Falls residents participating in sports, recreation and cultural programs who are in need of financial assistance. December 14, 2009 - 2 - CAO- 2009 -02 ANALYSIS /RATIONALE The annual earnings of the fund can only flow from the NCF to another organization with the ability to issue charitable donation receipts. Since there was no qualifying organization directly associated with the BGRF at the time of the pledge to donate in 2008, the City stepped in as the qualifying organization to administer the annual distributions (on behalf of GGBL and the BGRF). The BGRF subsequently obtained charitable status in August 2009, thus removing the need for the City to remain as the donor and qualifying organization of record. The Novation Agreement now allows GGBL to donate directly to the NCF (instead of the City) with future annual distributions flowing from the NCF to the BGRF. The City will no longer have any responsibility in regards to the administration of the funds donated by GGBL and it streamlines the flow of funds from the original donor to the eventual recipient of the donation. CD- 2009 -16 Niagaraflalls December 14, 2009 That the fee of $500 /year for the panels on the Stanley Avenue Business Park Association sign be added to the Fees and Charges booklet; and That staff be authorized to invoice the businesses in the Stanley Avenue Business Park Association that are present on the sign panels. Staff has worked with the Stanley Avenue Business Park Association to improve signage at the business park. The latest sign was erected in 2007. The new sign allows for the advertisement of four individual businesses from the park. The association members agreed to a $500 annual fee for the right to advertise and other agreed upon terms. Staff has grappled with an efficient and non - onerous method to impose the annual fee. Formal agreements were proposed but appear to be unnecessary red tape. It is necessary for Council to formally approve any new fee. If approved, the fee will be included in the City's Fee and Charges booklet, which is updated biannually. In 2005, Council approved a motion that Staff work with the Stanley Avenue Business Park Association (SABPA) to look at ways to improve the Stanley Avenue Business Park Association sign and that Micron be allowed to have their sign put up in the interim while Staff and the Stanley Avenue Business Park Association review signage in the business park. A new sign was erected in 2007 that allowed for four (4) businesses to be highlighted in individual panels at the bottom of the sign (see photo). The SABPA determined which businesses would have space on the individual panels and a fee of $500 /year would be paid by the respective businesses. If a business no longer wants the space or vacates the business park, the panel will be available and requests will be reviewed by the SABPA. December 14, 2009 - 2 - CD- 2009 -16 ANALYSIS /RATIONALE Section 391(1)(a) of the Municipal Act authorizes a municipality to impose fees and charges on persons for the use of its property including property under its control. The SABPA sign is City property. Although a sign panel agreement was contemplated, staff feels that entering into such formal agreements, on an annual basis, for such a nominal fee is inefficient. Unfortunately, the municipality does not have a fee for advertising signage, per se, that is comparable with what is being offered in the business park. Staff is proposing that the simple solution is to invoice the respective businesses and add the fee under the Business Development section of the Fees and Charges booklet. FINANCIAL /STAFFING /LEGAL IMPLICATIONS The municipality has the legal authority under the Municipal Act to charge fees on the advertising panels of the SABPA sign. Because his is a new fee, it needs to be approved by Council and recognized in our fees and charges booklet, which is updated twice a year. The nominal fee does provide additional revenues that have not been collected to date, despite the sign being in place for over two years. Also, the fees will help offset maintenance of the sign. CITY'S STRATEGIC COMMITMENT Identify and evaluate alternative sources of revenue. Continue to monitor and improve the efficiency of the organization. EXECUTIVE SUMMARY His Worship Mayor Ted Salci Members of the Municipal Council City of Niagara Falls, Ontario Community Services Department MW- 2009 -87 Tender #2009 - 233 -09 Union Marsh Municipal Drain Improvements and Consultant Fee Amendment MW- 2009 -87 December 14, 2009 City Council adopted a strategy in 1987 to address chronic flooding problems in the rural area utilizing the Drainage Act. The Union Marsh Drain Petition was filed with the City Clerk in 2003 and accepted by Council (see MW- 2009 -51). After numerous meetings with the Niagara Peninsula Conservation Authority (NPCA) and the Department of Fisheries and Oceans (DFO), the City has received their mandatory permits and the project can now progress to construction. City Council authorized staff to enter into a Consultant Servicing Agreement with K.Smart Associates in 2003 (MW- 2003 -98) and laterwith L. Campbell and Associates in 2008 (MW- 2008-69) in order to complete the drain improvement design and secure permits for its subsequent construction in accordance to the Drainage Act. Although the process is clearly defined in legislation, various processes within the Act encountered setbacks that required further investigation and review which resulted in additional time commitment by the Consultants. December 14, 2009 - MW- 2009 -87 Tenders for this project were opened on Tuesday, December 8, 2009 and the lowest bid of $67,529.95 received from CRL Campbell Construction is being recommended for acceptance. This project is included in the 2009 Capital Budget. BACKGROUND The City filed a petition requesting the City to address chronic flooding conditions over rural roads in 2003. A consultant was appointed by the City, K.Smart Associates, in 2003 to complete the design process, attend the required public meetings and obtain the necessary permits to allow the construction for the improvements of the Union Marsh Municipal Drain in accordance with the Drainage Act. At the Report Consideration meeting in April 2006 (MW- 2006 -38) landowners were objecting to the payment of their assessed costs and requested Council to review alternate options which Council then directed to staff. An information report (MW- 2006 -47) was provided to Council summarizing the effects of the City paying the landowner's assessments. The Report Consideration meeting was reconvened in July 2007 with Council approving the payment of the landowner's assessment from City funds. The Court of Revision was held in November 2007 with no appeals and the by -law given third reading and the report was adopted. Subsequent meetings with NPCA and DFO resulted in numerous concerns regarding wetland protection, species at risk and erosion. This required further investigation and design review in an attempt to satisfy the agency requirements. After multiple meetings with these agencies and all efforts to reach an agreement proved futile, the City resorted to appointing an environmental consultant, L. Campbell and Associates to the project in an effort to assist in addressing the agency's concerns and acquiring the approvals necessary to carry out the improvement works on the Union Marsh Drain (MW- 2008-69). Further meetings with the environmental agencies subsequently resulted in securing the required permits necessary to progress to construction. The Tender Opening Committee, in the presence of Ray Miller, Manager of Supply and Services and Dean lorfida, City Clerk opened tenders on Tuesday, December 8, 2009 at 1:30 p.m. for the subject contract. Tender documents were picked up by seven (7) contractors and three (3) bids were received. Listed below is a summary of the totaled tendered prices excluding GST, received from the Contractors. The contractor has performed similar type projects for the City. We are of the opinion that this contractor is capable of successfully undertaking this project. December 14, 2009 The Engineer's estimate for this project was $94,500. Timing of the construction is totally reliant on the time restrictions provided by the environmental agencies to allow improvements to the watercourse. Construction is expected to commence in mid /late January and is scheduled to be completed within thirty (30) working days. The additional consulting fees were a direct result of additional site investigation, design review and meetings required to adopt the Engineers Report and obtain the required permits from the NPCA and DFO. They also reflect additional permit requirements that include monitoring and reporting the effects of the construction on the environment on an annual basis until December 2012. FINANCIAL /LEGAL IMPLICATIONS The Union Marsh Municipal Improvement Project in the amount of $226,988 is included in the approved Municipal Works Capital Budget for 2009. The recommended expenditure for the amount of $67,529.95 from account #12-3-310002-030000. The final approval for improvement works for the NPCA and DFO resulted in a significant reduction in the length of drain construction once the sensitive areas were removed from the work area. Therefore, it is expected that the current project funding will be adequate to pay the additional consulting fees on this project with no budget increase necessary. COMMITMENT TO COUNCIL PRIORITIES Implementation of the Capital Project meets the intent of Council's Strategic Priorities to establish infrastructure investment priorities, and to strengthen and promote economic development within the City. GST is not shown in the report since the municipality receives a rebate of the GST paid therefore it does not form part of the final cost of the drain. When I filed the report in February 2006 I also submitted a memo dated February 15, 2006 indicating that the work on the Union Marsh Drain 2006 exceeded the scope of the work as outlined in the request for proposal and in the proposal I had submitted. The proposal submitted did not provide for work upstream of Bossert Road on the West Branch and upstream of Sodom Road on the East Branch. As outlined in the February 15, 2006 memo the increased cost for the work included in the report upstream of the two road crossings noted was $7,700. The basis for this amount is detailed in the February 15 memo. The memo also noted that analysis was required on two farm culverts. Review of farm culverts was not identified in the proposal as there was no way to determine what farm culverts would be involved until after an on -site meeting with the owners and the examination of the drain was completed. The February 15 memo indicated that the additional cost for the culvert analysis was $3,000. The following invoice was submitted after the report consideration meeting before council was reconvened in July 2007 and included for the preparation of Addendum 1 dated July 24, 2007 which amended the original report as directed by Council at the report consideration meeting on July 9. Invoice has been paid In a memo dated June 13, 2007 I outlined a new fee schedule that would apply to services provided after the adoption of the report by Council and the Court of Revision. Following the adoption of the Union Marsh Drain 2006 report as amended by Addendum 1 we then began what turned out to be a very length process to get approval from Fisheries and Oceans Canada (DFO) and from the Niagara Peninsula Conservation Authority (NPCA). The cost associated with this approval process is outlined in detail in the attached table which covers the period November 7, 2007 to October 310, 2009. Total from table is $12,507.04 By the end of October all environmental approvals had been obtained. In November we worked on the tender document. The table attached identifies the engineering cost for the preparation of the tender document. Total from table is $2,586.49. The final table attached is a projection for engineering cost in 2010 for the Construction phase of the Union Marsh Drain 2006. Some of this cost may be expended in December 2009. This estimate of $14,510 is for contract administration, construction inspection, final inspection and grant application. Report estimate for construction administration and inspection in Addendum I was $15,500. I have also included an estimate ($2,000) for the further report addendum that will be required to delete the remaining West Branch work and possibly to delete some of the work on the Main Drain between Willoughby and Miller Road depending on inspection monitoring following construction. That Council pass a motion that the change to conditions is minor, and therefore, formal written notice of the change to conditions is not required in accordance with subsection 51(47) of the Planning Act. EXECUTIVE SUMMARY The proposed change to the conditions of approval and modification to the existing draft plan of condominium can be supported based on the following: • the changes are minor and required, in part, to address a new zoning by -law; and • the revised conditions of approval will address all zoning, site plan and development requirements for the existing apartment building. BACKGROUND Existing Approval Council adopted the recommendations of Report PD- 2009 -73 on September 28, 2009 for a proposed draft plan of condominium (standard) of an existing 5- storey apartment building containing 64 units at 6515 McLeod Road ( Bellagio). The condominium approval also applies to the abutting two properties to the east containing single- detached dwellings (6473 & 6483 McLeod Road) and this land is to be developed for another apartment (maximum 8 units) in the future. Draft plan approval was effective October 20, 2009 and is subject to various conditions. The project was constructed and evaluated on the basis of the zoning approval in place at the time (R5B -813 zone, site specific By -law No.2008 -29 and variances) that applied to all three parcels. Through the condominium review process, the applicant determined that it was more feasible for the existing apartment building and future apartment building to December 14, 2009 - 2 - PD- 2009 -102 function independently rather than as a combined development as originally intended. Therefore, the owner submitted a Zoning By -law Amendment application (AM- 2009 -019) to change the zoning of the land to provide a separate by -law to recognize the existing apartment building and a separate by -law to recognize the existing approval for a future apartment building. This change would permit more flexibility for the timing of development and facilitate the registration of a condominium plan at 6515 McLeod Road. In this regard, Council approved Report PD- 2009 -88 and passed Zoning By -law Nos. 2009 -174 (Bellagio, R5C -887) and 2009 -175 (future apartment, R5A -888) on November 16, 2009. No residents spoke at the public meeting and there were no letters submitted to the City on the application. There were no appeals filed by the last day for appeal (December8, 2009) and the by -laws are now final. Proposal The applicant needs to modify the existing approval and conditions for the draft plan of condominium to apply only to the 6515 McLeod Road parcel, in part, as a result of the zoning by -law amendment. The subject land is located on the north side of McLeod Road, west of Dell Avenue, as shown on Schedule 1. The revised draft plan is illustrated on Schedule 2. Modification Process Council has the authority under subsection 51(44) of the Planning Act to change the conditions of approval for a draft plan of subdivision /condominium. This process does not require a public meeting. Since the Region has conditions of approval for the original plan, staff circulated the revised draft plan to the Region for comment. Furthermore, the Region also has the right to appeal the condominium at any time prior to final approval if there were concerns. The City is not required to give notice of the changes, if in Council's opinion, the change to conditions is minor. ANALYSIS Revised Conditions of Approval Administrative changes are required to modify two of the existing conditions, delete two conditions and also include one new condition of draft plan approval. The revised conditions of approval are listed in the Appendix. The description of the subject land is changed to 6515 McLeod Road only and a new plan is provided. A condition related to boulevard tree planting is adjusted based on the frontage of the existing development. Condition #4 (final zoning variance approval) is no longer necessary since the new zoning by -law (2009 -174) is now in effect. The original Condition #5 required the removal of two existing dwellings (6473 & 6483 McLeod Road) to satisfy zoning and site plan provisions. This condition can now be deleted as these abutting parcels are to be excluded from the draft plan. The existing Site Plan Agreement covers the combined development on the three properties for two apartment buildings. A new condition is added for an amendment to the site plan to separate 6515 McLeod Road from the future development and include changes to the parking layout and landscaping (the developer has submitted a revised site plan that is under review). The original Regional conditions are unchanged and the Region indicates no objection to the modification to draft plan approval. December 14, 2009 - 3 - PD- 2009 -102 Dating back to the initial rezoning for the apartment use in 2000, area residents expressed traffic concerns and requested that a traffic light be installed at the McLeod Road/Wilson Crescent intersection. The applicant (Felix Pingue) offered a voluntary contribution of $25,000 toward traffic signals. However, traffic lights were not required by the Region as a condition of the site plan approval. Currently, a Class Environmental Assessment (EA) is underway for McLeod Road to consider any improvement requirements. The Region has indicated (see attached e-mail) that the EA will determine whether or not traffic signal lights are required at the intersection. The Region does not require any security from the developer. Therefore, no condition for a security deposit should be imposed since this is not requested by the responsible authority. CITY'S STRATEGIC COMMITMENT Council's priority is to strengthen and promote economic development in the City. The requested changes will facilitate the registration of a new apartment condominium. That the yield sign facing northbound motorists on Donlee Drive at Chorozy Street (east intersection) be replaced with a stop sign; and, 2. That a stop sign be installed facing northbound motorists on Kevin Drive at Donlee Drive. EXECUTIVE SUMMARY A stop sign is warranted facing northbound motorists on Donlee Drive at Chorozy Street (east intersection) and facing northbound motorists on Kevin Drive at Donlee Drive as there are inadequate sight lines at the intersections to maintain the existing right -of -way rule and yield control, respectively. BACKGROUND Staff has been requested to review the area comprising of Donlee Drive, Chorozy Street and Kevin Drive to determine whether a revision to the intersection controls are warranted. Chorozy Street is a collector roadway that extends between Montrose Road and Preston Avenue. Sidewalks and boulevards are present on both sides of the roadway. Donlee Drive is a crescent - shaped local road, connecting with Chorozy Street at two junctions. A sidewalk and boulevard are present on the entire inside perimeter of the road. The outside perimeter contains a sidewalk and boulevard between the eastern junction of Chorozy Street and Kevin Drive. Kevin Drive is also a local road which extends southerly from Donlee Drive to Alpine Drive. ANALYSIS /RATIONALE Technical studies have been carried out at the two study intersections to determine whether the existing intersection control is adequate to allocating the right -of -way amongst motorists. The studies include observations and visibility studies, as well as a collision review. December 14, 2009 -2- TS- 2009 -50 Study results indicate that a stop control is warranted facing northbound motorists on Donlee Drive at Chorozy Street (east intersection) and facing northbound motorists on Kevin Drive at Donlee Drive. The visibility triangle requirement for an uncontrolled intersection is not met thus warranting the additional controls. This is common in developed residential areas with buildings and fencing normally constructed within the visibility clear zone. At uncontrolled intersections, this triangle is intended to provide motorists with adequate visibility to view approaching vehicles and therefore be able to react appropriately. A collision review revealed that no collisions have been reported at either intersection, or any of the roads extending from the intersection in the previous three -year period. Staff conducted an additional visibility study with simulating the presence of a stop sign to ensure this traffic control will be adequate. The results indicate that motorists will be provided with sight lines exceeding the minimum suggested guidelines for safe intersection operation. FINANCIAL /STAFFING /LEGAL IMPLICATIONS The installation of all signs is carried out by Transportation Services staff. The labour and material costs are accounted for in the Approved 2009 General Purposes Budget. Cost studies estimate that the cost to install the new signs is approximately $280. Schedule 1 is a part of this by -law. 2. The Lands shall be identified as three parcels, known as Parcels LI -875, LI -876 and P -877. 3. The purpose of this by -law is to amend the provisions of By -law No. 79 -200, to permit the use of the Lands in a manner that would otherwise be prohibited by that by -law. In the case of any conflict between a specific provision of this by -law and any existing provision of By- law No. 79 -200, the provisions of this by -law are to prevail. 4. Notwithstanding any provision of By -law No. 79 -200 to the contrary, the following uses and regulations shall be the permitted uses and regulations governing the permitted uses on and of the Lands. 5. "Garden centre" means a lot, building or structure or part thereof, used for the wholesale and retail sale of trees, shrubs, plants, soil, landscaping supplies, garden ornaments, fertilizers and similar materials. "Production and data processing establishment" means a building or part thereof used for the production or reproduction of film, tape, digital media and records; data processing industries; and binding and related industries with similar impacts. 11. All other applicable regulations set out in By -law No. 79 -200 shall continue to apply to govern the permitted uses on the Lands, with all necessary changes in detail. 13. No person shall use the Lands in a manner that is contrary to the regulations. 14. The provisions of this By -law shall be shown on Sheet D3 of Schedule "A" of By -law No. 79 -200 by redesignating the Lands from GI, in part, and R2, in part, to LI and numbered 875, in part; from GI -453, in part, LI, in part, and LI -526, in part, to LI and numbered 876, in part; and from LI, in part, to P and numbered 877, in part. 15. THIS NOVATION AGREEMENT made the fourteenth day of December, 2009. BETWEEN: THE CORPORATION OF THE CITY OF NIAGARA FALLS, (Her einafter referred to as the "City ") and - NIAGARA COMMUNITY FOUNDATION, a corporation without share capital, incorporated under the Canada Corporations Act and registered as a charity under the Income Tax Act (Canada) (Hereinafter referred to as the "Foundation ") - and - GALE'S GAS BARS LIMITED, a corporation incorporated under the laws of the Province of Ontario (Hereinafter referred to as the "New Donor ") OF THE FIRST PART; OF THE SECOND PART; OF THE THIRD PART. WHEREAS the City and the Foundation entered in a donor fund agreement (the "Agreement ") dated September 8th, 2008 whereby the City, as Donor, and the Foundation agreed to the terms upon which a fund of money (the "Fund ") pledged by the City and to be known as the Bob Gale Recreation Fund was to be administered by the Foundation; AND WHEREAS the New Donor has agreed to make the balance of pledged donations to the Fund in the place and stead of the City; AND WHEREAS the parties wish to clarify the status of the Agreement in light of the involvement of the New Donor; 2 NOW THEREFORE THIS NOVATION WITNESSES: 1. The New Donor agrees to stand in the place and stead of the City for purposes of the Agreement. 2. The City agrees that it cedes to the New Donor the position of Donor under the Agreement and that it will take no further role with respect to the Agreement. 3. The Foundation agrees that it will henceforth look exclusively to the New Donor as Donor under the Agreement in the place and stead of the City. 4. The actions of the Council at its meeting held on the 14 day of December, 2009 including all motions, resolutions and other actions taken by the Council at its said meeting, are hereby adopted, ratified and confirmed as if they were expressly embodied in this by -law, except where the prior approval of the Ontario Municipal Board or other authority is by law required or any action required by law to be taken by resolution. 2. Where no individual by -law has been or is passed with respect to the taking of any action authorized in or with respect to the exercise of any powers by the Council, then this by -law shall be deemed for all purposes to be the by -law required for approving, authorizing and taking of any action authorized therein or thereby, or required for the exercise of any powers thereon by the Council. 3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls are hereby authorized and directed to do all things necessary to give effect to the said actions of the Council or to obtain approvals where required, and, except where otherwise provided, the Mayor and the Clerk are hereby authorized and directed to execute all documents arising therefrom and necessary on behalf of the Corporation of the City of Niagara Falls and to affix thereto the corporate seal of the Corporation of the City of Niagara Falls.
