Your letter .of July 13, 200.9, addressed to .Kevin Bain, Regional .Clerk, pertaining W. .City
Council's Resolution No. 28 - "That Regional Staff be respectfully requested to expedite the
extension of Thorold Stone Road in time for the Spring 2DI0 opening of the Gale Centre", has
been forwarded to the undersigned for response.
We wish to advise that Regional Niagara has been actively working with Cytec Canada Limited
and its leasee, Falls Community Development (FCD), in an effort to move this project forward.
On July 20th we met with representatives from both parties to discuss the validity and benefit of
conshucting the roadway extension, establish recognition of responsibility for the risk
assessment/remediation, identify the financial implications involved with remediation, review
property acquisition options and agree on a contingency plan for the arena access in the event
that the roadway extension is postponed. The outcome is optimistic; however, a number of
particulars relative to the existing lease agreement, risk assessment process including the need
for a site specific development proposal (plan), and recognition of responsibility need to be
investigated and addressed prior to proceeding with the project. The following is a brief
synopsis of the points discussed:.
• Currently the risk assessment has been suspended by the owner (Cytec) pending
submission of site specific development proposal from the Developer (FCD)
• Cytec to investigate possibility of undertaking risk assessment on the proposed road
extension alignment only
• Cytec and FCD to review implication(s) on existing lease arrangements relative to the
release of any portion of the land holdings

Cyteo, FCD, City, and Region will meet to discuss implications (costs, risk and
liabilities) resulting from recommendation(s) outlined in the Risk Assessment and
accompanying Certificate of Property Use
• It was agreed that should the project be delayed and/or postponed, Fourth Avenue will be
utilized by the City as the alternative access to the new arena site
Barring any unforeseen circumstances, Niagara Region is confident that these obstacles can be
overcome and that the required property acquisition and actual construction of the project will
move forward. However, we understand that review and approval of the Risk Assessment by the
Ministry of the Environment is a lengthy process. Therefore, we probably will be unable to
complete the road construction prior to June of next year.
We trust that the information provided assists in keeping City Council informed of our efforts to
move this project forward. As we proceed with the above-mentioned next steps, we will update
City Council of our progress through your engineering department. Should you, however,.
require any additional information or clarification, please do not hesitate to contact the
undersigned.

Dean: After discussions among senior staff, it has been decided that this report and by-law must be pulled. The proposed
agreement that I received at 10 o'clock this morning differed in many ways from the draft that I had approved on July 5, 2009.
These changes were not disclosed in the covering a-mail of today's date. I had Sheila go through the agreement for me and she has
discovered approximately 30 such changes. Some of these I can live with some I cannot recommend. As far as I am aware none of
them have ever been seen by the Region.
In these arcumstances, it is not advisable to present the agreement to the Council.

By-law No. 2009 -133
A by-law to amend By-law No. 2002-081, being a by-law to appoint City employees, agents and
third parties for the enforcement of provincial or municipal by-laws.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. By-law No. 2002-081 is amended by deleting Schedule "A" and Schedule "A" attached
hereto shall be inserted in lieu thereof.
2. By-law No. 2002-081 is amended by deleting Schedule "B" and Schedule "B" attached
hereto shall be inserted in lieu thereof.
3. By-IawNo. 2002-081 is amended by deleting Schedule "C"and Schedule "C"attached hereto
shall be inserted in lieu thereof.
4. By-law No. 2002-081 is amended by deleting Schedule "D1"and Schedule "Dl" attached
hereto shall be inserted in lieu thereof.
5. That By-laws 2007-217, 2009-34 and 2009-83 be hereby repealed.
6. This by-law shall come into force upon passing.
