The team went undefeated (4-0) for the tournament. During the preliminary rounds, Niagara Falls defeated Tilsonburg Hoopdawgs 30-2 and the London Gold Medal Team 23-12. In the medal round, the third- seeded Red Raiders upset the top-seed Toronto York Silver Knights 16-15 with a thrilling come from behind flurry in the last two minutes to propel them into the championship game against Sarnia. The victory game finished 17-8 over the Sarnia Huron Lakers, giving the Niagara Palls Red Raiders the provincial championship. Leading team scorers over the weekend were the four Red-Raider co-captains: Tori DiDomenico 24, Olivia Buchanan 22, Harley Matovic 21 and Alicia Cuviello with 11. Other top scorers included Katie Caughill 9, Molly Bowron 4, and Madison Hart14. The entire team played outstanding defence all weekend, limiting the competition to just nine points per game. The Ontario championship was the remarkable turnaround fox the Niagara Falls team which started the year by losing their first seven games. However, by early February the team gained some confidence with several impressive victories over higher ranked opponents, and finished the season strong with eight consecutive wins. (Mario Chan) Proposed Semi-Detached Dwelling RECOMMENDATION That Council approve the application to rezone the land to a site specific Residential Single Family and Two Family (R2) zone to permit the land to be used as asemi-detached dwelling, subject to the regulations addressed in this report. EXECUTIVE SUMMARY The applicant has requested a zoning amendment to permit asemi-detached dwelling to be constructed on the property. This request can be supported because: the proposal represents a modest intensification of use as supported by Provincial policies; the dwelling is supported by the Official Plan in that it is a form of low density housing that is compatible with surrounding development; and, the dwelling will be compatible with surrounding dwelling in terms of form, massing and setbacks in compliance with the recommended zoning regulations. BACKGROUND Proposal An amendment is requested fora 648 square metre (6975 square foot) parcel of land known as 6226 Giovina Drive (see Schedule 1) at the corner of St. Paul Avenue. The applicant is requesting asemi-detached dwelling be permitted on the land. The property is zoned Residential Single Family 1C Density (R1C) which only permits detached dwellings. The applicant is requesting the property be rezoned to Residential Single Family and Two Family (R2) which permits semi-detached dwellings. Site specific regulations are requested to reduce the required lot frontage fora semi-detached dwelling from 20 metres (65.6 feet) to 19.9 metres (65.3 feet) to recognize the existing lot frontage and increase the maximum driveway width from 8 metres (26.2 feet) to 9 metres (29.5 feet). Refer to the attached Schedules 2, 3 and 4 for further detail. April 26, 2010 - 2 - PD-201035 The applicant originally submitted a different design for the semi-detached dwelling, with each unit having a double car garage and entrances on the sides of the dwelling. In response to concerns raised by neighbours at the first neighbourhood open house held on February 1, 2010, the applicant changed one of the double car garages to a single car garage, reduced the width of the driveway, placed the entrances on the front and exterior side of the dwelling changed the architecture to make it appear more like a single detached dwelling. Surrounding Land Uses This lot is bounded by single detached dwellings to the north, west and south. A mix of uses, including townhouses, commercial and industrial uses, lie to the east of the property along the east side of St. Paul Avenue. Circulation Comments Information regarding the proposed Zoning By-law Amendment was circulated to City divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: Regional Municipality of Niagara No objections. The proposed semi-detached dwelling will contribute to intensification in the urban area, will make efficient use of serviced land and infrastructure and will enhance the range of housing for the neighbourhood. The proposal is in keeping with Provincial and Regional policies for intensification. Transportation Services No objections. No concerns with the increase in driveway width. Municipal Works No objections. Service laterals to be provided to the property in accordance with City standards. Parks and Recreation, Legal Services, Fire Services No objections. Cash in Lieu of Parkland dedication and the planting of boulevard trees in accordance with City standards to be secured if a severance application is pursued. Surrounding Neighbours Letters of objection have been received and are on the Council Agenda for consideration. Some of the concerns raised are compatibility with surrounding properties, devaluation of surrounding properties, and a lack of green space on the property. April 26, 2010 _3 _ Neighbourhood Open House PD-201035 Two neighbourhood open houses were held to get input from the public. One open house was held on first one on February 1, 2010 to review the original proposal. The second open house was held on March 22, 2010, to review the revised proposal. At the first meeting neighbours voiced concerns about the width of the driveway, the lack of area for snow clearance and the orientation of the entrances on the sides of the dwelling. At both meetings the neighbours voiced objections to the proposal noting concerns with compatibility with the neighbourhood and impacts on surrounding property values. ANALYSIS Provincial Policy Statement The Planning Act requires City planning decisions to comply with Provincial Policy. The Provincial Policy Statement directs municipalities to facilitate different forms of residential intensification and encourages a mix of housing types. The proposed two unit dwelling is a form of residential intensification promoted by the Province. Official Plan The property is designated Residential in the Official Plan which permits a range of housing types. Low density forms of housing such as single detached, semi- detached, duplex, and triplex dwellings provide the majority of residential accommodation in the City. New residential development is to be integrated to achieve compatibility and sensitivity with the surrounding development. Development of vacant lands with compatible housing that is more intensive than surrounding development is also encouraged. The proposed semi-detached dwelling complies with the Official Plan as follows: The dwelling is a form of housing that is promoted by the Official Plan as low density. This lot is located at the edge of the residential neighbourhood adjacent to and arterial road. Asemi-detached dwelling provides a transition from the townhouses on the east side of St. Paul Avenue and the single detached dwellings along Giovina Drive. The revised design is compatible with the neighbourhood in terms of massing, setbacks and appearance. The dwelling is consistent with surrounding properties in terms of coverage, setbacks and height. The semi detached dwelling has been designed to look like a single detached dwelling which should be complementaryto existing single detached dwellings on the street. Municipal services and surrounding roads can supportthe additional dwelling unit. April 26, 2010 - 4 - 3. Zoning By-law PD-2010-35 The requested R2 zoning permits semi-detached dwellings. The proposed dwelling meets R2 standards in terms of building height, setbacks and coverage. To ensure the dwelling is compatiblewith surrounding single detached dwellings, the amending by-law should contain provisions that secure the proposed appearance. In this regard the following standards are proposed: Each dwelling unit is to have a garage; the easterly dwelling unit may have a double car garage. The westerly unit is to be limited to a single car garage that is to be staggered back to reduce the garage's massing. The entrances to the dwelling units are to be located with one facing onto Giovina Drive and one facing onto St. Paul Avenue to give the appearance of a single detached dwelling from Giovina Drive. The driveway is to have a maximum width of 9 metres. Although this is a slight increase over the maximum 8 metre width permitted for driveways in the requested zone, the driveway would still be less than 50% of the lot width, leaving ample room for landscaping and snow storage. As driveways along Giovina Drive generally have widths close to 8 metres, the 1 metre increase in width should not be easily detected nor alter the character of the neighbourhood. As the R2 zone requires a corner lot size of 20 metres to accommodate a semi-detached dowelling, the application also requests a 0.1 metre (4 inch) reduction in lot frontage to locate the dwelling on the subject lot. This reduction will not impact on the surrounding neighbourhood. FINANCIAL IMPLICATIONS The proposed dwelling will generate development charge contributions for the City. CITY'S STRATEGIC COMMITMENT The proposed dwelling complies with the City's Official Plan in terms of its residential policies. Thsfollowigg are my comments regarding the application: Seven years ago before l purchased my home, I inquired at The City of Niagara Falls Development Division regarding the possible use of the empty lot next to the home I was to purchase. I was told that the current zoning would only allow construction of a single family dwelling and according to the minimum standards setin place by the developer. The requested increase of the driveway with 10 78% of the lot. frohtage is excessive. Removal of a Holding (H) Symbol RECOMMENDATION That Council pass the by-law appearing on tonight's agenda to lift the holding (H) symbol from the subject lands zoned Residential Single Family 1 D Density(R1 D-804), Residential Mixed (R3-805) and Residential Apartment 5F Density (R5F-806). EXECUTIVE SUMMARY To address the provisions of the holding (H) symbol the applicant has submitted the necessary studies which demonstrate the proposed residential uses will not be adversely impacted by surrounding development. Necessary warning clauses with respect to noise have been inserted into the condominium subdivision agreement. As the requirements of the holding provisions have been met to the satisfaction of the City and the Region of Niagara, the (H) symbol can be lifted. BACKGROUND Proposal In 2007, Council approved Official Plan Amendment No. 81 and Zoning By-law No. 2007- 236 to permit the development of a residential community referred to as Thundering Waters Village on the lands (see Schedule 1). In accordance with the Zoning By-law the City subsequently draft approved a plan of vacant land condominium in July, 2008, to create lots for 85 single detached dwellings and 31 townhouse units as well as block of land for a future condominium apartment dwelling. Zoning By-law No. 2007-236 placed a holding (H) symbol on the land to prevent its development until the land owner or developer had submitted a further assessment of industrial operations in the vicinity and a noise and vibration analysis with appropriate mitigation measures determined and implemented to the satisfaction of the Regional Municipality of Niagara and the City through the necessary condominium agreement. These measures have been satisfactorily included in the draft condominium agreements to be executed by the landowner and the City. The landowner is requesting the H symbol be lifted to permit the development to proceed. April 26, 2010 _2 _ Circulation Comments PD-201034 The Planning Act requires notice of the lifting of an H symbol be provided to landowners affected by the H symbol and any members of the public or agencies that have submitted a written request for notice of the lifting of the H symbol. In accordance with these regulations, information regarding the lifting of the H symbol was circulated to the Regional Municipality of Niagara and the landowner. The following summarizes the comments received to date: Regional Municipality of Niagara The applicant has submitted a study to assess the impact of nearby industrial uses to the Region's satisfaction and a warning clause with respect to noise has been inserted into the condominium agreement. The Region has no further concerns with respect to land use compatibility and no objections to the removal of the (H) symbol. ANALYSIS The (H) symbol was placed on the lands to ensure there are no adverse noise or air emission impacts on the proposed residences from surrounding industries. To address the (H) symbol provisions, the applicant submitted a Sensitive Land Use Study (Senes Consultants, September 2008). This study concluded there were no air quality impacts from the existing surrounding industries on the proposed residential uses. The study also concluded that while these industries generate noise that may be audible to residents in the development, these noise levels are within Ministry of the Environment guidelines. A warning clause with respect to audible noise levels was recommended by this study to placed in Agreements of Purchase and Sale Agreements. This warning clause has been inserted as a requirement in the condominium agreement at the request of the Region. There are no further measures to be implemented on this matter, therefore the (H) symbol can be lifted. CITY'S STRATEGIC COMMITMENT Removal of the H symbol will allow the development, as approved by Council and permitted by the Official Plan, to proceed. FINANCIAL IMPLICATIONS The proposed development will generate development charge and parkland dedication contributions for the City. YYhgt is the Ride For Dad? The Ride For Dad is an annual fundraiserthat sees riders raise money through pledges for prostate cancer research and education. The day starts out with a police-escorted ride through the host community acid continues on to be a full day of riding. The event brings together motorcycle enthusiasts, members of the community, members of the local police service and community leaders. YPhyprostate cancer? Prostate cancer affects an alarming number of people -and their families. The disease hits men mostly over 40 years of age. It is estimated that there are over one million cases of prostate Dancer in Canada; however, -as little as 20% of cases have-been diagnosed, leaving an estimated 80% not yet detected. Astonishingly, one in seven men will be affected by prostate cancer in their lifetime, making prostate cancer the second leading cause of cancer death amongst men in Canada. EXECUTIVE SUMMARY The City of Niagara Falls exhibits an increase in taxes collected. Tax receivables as a percentage of taxes billed decreased from 23.1 % in 2009 to 22.8% in 2010. Taxes outstanding as of March 31, 2010 was $17.6 million. The City's finance staff has had success in resolving 76% of properties that are subject to registration for 2010, however, there are currently twenty-eight properties scheduled for tax sale in the next two years. BACKGROUND This report is being provided as part of the monthly financial reporting to Council by staff. It is also submitted to our banking institution for compliance with our banking agreement. ANALYSIS/RATIONALE The tax collection for 2010 improved during the month of March. Table 1 shows that taxes outstanding at March 31, 2010 are $17.6 million. That same amount, $17.6 million was in arrears for the same period in 2009. Finance staff continues to actively pursue property owners in arrears. The percentage of taxes outstanding to taxes billed in 2010 is 22.8 versus 23.1 % in 2009. Table 2 provides the breakdown of outstanding taxes -total by assessment class. Consistent with previous months, the majority of outstanding taxes are for residential and commercial properties. The ratios of uncollected taxes by property class has remained virtually the same. Finance stafftakes specific collection actions for properties that are subject to registration. These action steps have been outlined in previous reports. At January 1, 2010, 405 properties were subject to registration. Table 3 summarizes the progress of these actions after three months of activity. This table shows 76% of the tax accounts or 308 properties have been paid in full or the owners have made suitable payment arrangements. During March, five accounts were paid in full. Table 4 identifies the properties and associated tax arrears scheduled for tax sales in the future. During the month of March, four registered properties were redeemed. The outstanding taxes for registered properties represent 1.7% of the total outstanding taxes at month end. FINANCIAL/STAFFING/LEGAL IMPLICATIONS Tax arrears as a percentage of taxes billed in a year is a performance measure that stakeholders utilize to analyse an organization's financial strengths. Niagara Falls, due to its high reliance on commercial assessment, is traditionally higher compared to municipalities of similar size. The percentage of taxes outstanding to taxes billed as at March 31, 2010 is 22.8 %. The municipality has a record of full collection and earns significant penalty revenues to offset the higher measure. Appeals have been received and the applicants have been notified that the respective matters will be considered by City Council this evening. The Municipal Property Assessment Corporation has confirmed that the subject properties were assessed incorrectly in that these properties; had structures that had been demolished or removed, were damaged or razed by fire, have ceased to be liable at the rate it was taxed, became exempt, or a transposition, typographical, or clerical error was made. EXECUTIVE SUMMARY The City of Niagara Falls is responsible for billing and collecting property taxes on all assessable properties within the municipality. These annual billings include the annual taxes for the City, for the Region of Niagara and for the appropriate local school boards. The .City is charged with the responsibility of collecting said amounts. From time to time the City is faced with the situation where tax collection options have been exhausted. Tax write offs totalling $229,523 are being recommended in this report with allocations to be made to City, Regional and School board revenue. The City's allowance for tax write offs has been budgeted and will be adequate to account for the City's proportionate share of $149,348. BACKGROUND During 2009, The City's Finance Division conducted a number of tax sales. Tax sales are conducted as the final step after all other collection actions have been exhausted. As a part of the tax collection procedures, staff continues to actively pursue delinquent property owners who fail to pay the taxes for their property. In most cases, the property owner will pay the balance owing but in some cases a tax sale is required to resolve the outstanding taxes. Tax sales in 2009 relate to properties that were registered in 2008. During 2009, 20 properties were scheduled for tax sales. Of this, one was paid in full before sale, 11 were paid as a result of the sale and eight resulted in a failed tax sale. A failed tax sale is one in which no bidders provide a submission for the tendered price amount. The failed tax sale properties will become the City's property in 2010. ANALYSIS/RATIONALE Section 354 (2) and 354 (3) of The Municipa! Act, 2001 provides for the Treasurer of a local municipality to remove unpaid taxes from the tax roll and may write off taxes after an unsuccessful tax sale. April 26, 2010 - 2 - F-2010-22 Section 354 (2) of The Municipal Act states that "The Treasurer of a local municipality shall remove unpaid taxes from the tax roll if, (a) the council of the local municipality, on the recommendation ofthe treasurer, writes off the taxes as uncollectible, or (b) the taxes are no longer payable as a result of tax relief under section 319, 345, 357, 358, 362, 364, 365, 365.1 or 365.2 or a decision of any court". Section 354 (3) of The Municipal Act states that "A local municipality mayonlywrite off taxes under clause (2) after an unsuccessful tax sale under PART XI and may at that point write off the taxes whether or not the property vests in the municipality under that Part". Since City properties are not subject to property taxation, the City must write off taxes owing. Similarly, the Region and School Board taxes are written off and adjusted in the year end reconciliation with those bodies. Therefore, the properties listed in Table 1 should be written off. FINANCIALISTAFFING/LEGAL IMPLICATIONS As stated, from time to time, staff will identify amounts that cannot be collected. The 2010 General Purposes Budget includes an allowance for taxes that are deemed uncollectible. Table 1 identifies an amount of $229,523 to be written off, includes amounts for the City, Region and School Boards. The actual City portion is $149,348. The balance of $80,175 will be recovered from the Region and the School Boards. Once the property taxes are written off, staff will be able to vest the properties to avoid future taxation. EXECUTIVE SUMMARY The Low Income Seniors' Water Rebate has been included in the City's water budget since 2004. The budget for 2010 is $80,000. Similar to last year, staff will take applications commencing June 1, 2010 with the application period ending October 31, 2010. Applications are available at City Hall or on-line. BACKGROUND In the determination of the 2010 Municipal Utility Budget, City Council approved the Low Income Seniors' Water Rebate for the 2010 year. This rebate provides qualifying seniors a rebate of $100. City staff will take applications from seniors that may qualify starting June 1, 2010. Applications will be available in the Finance Division. The City will be notifying the general public through an information card in the upcoming water and sewer bills, as well as through newspaper advertising. FINANCIAL IMPLICATIONS The budget expenditure approved for the 2010 Utility budget was $80,000. In 2009, the actual rebates approved was $63,150 while in 2008, the cost was $64,170. That CH2M Hill be directly appointed to complete the Class Environmental Assessment for the Chippawa Sewer Flooding Relief Analysis for an upset limit of $56,770.00. 2. That the Mayor and City Clerk be authorized to execute the necessary Consultant Services Agreement. EXECUTIVE SUMMARY The Chippawa area residents have experienced regular basement flooding occurrences due to surcharged sewers during heavy rainfall events. While a number of studies have been completed to identify potential solutions some additional investigation following the Schedule "B" Municipal Class Environmental Assessment process is needed. This study will focus on in-line storage modifications and new storage tanks that could be added at strategic locations to prevent peak wet weather flows from surcharging the sewer system. BACKGROUND The residents of Chippawa are prone to basement flooding during heavy rainfall events due to the surcharging of the sanitary sewers. During these events, City staff perform emergency pumping of the flows out of the system in an effort to reduce the flooding occurrences. CH2M Hill has been conducting an analysis of the system using hydraulic modelling to determine the causes of the flooding and develop options to resolve the problem. The model has identified potential "bottlenecks" in the system. In order to satisfy the EA requirements it will be necessary to examine all alternatives, assess financial and environmental impacts and engage the Public in finalizing the best solution. ANALYSIS/RATIONALE Given the consulting firm's knowledge ofthe sewer model and the hydraulic characteristics of the Chippawa system staff are recommending direct appointment. April 26, 2010 _2_ FINANCIAL IMPLICATIONS MW-2010-22 The proposed budget for this project is outlined in the attached work plan. The estimated cost of $59,770 complies with the current policy for direct appointments. The 2010 Capital Budget included funding in the amount of $600,000 for related studies and physical improvements that will come from the study recommendations. This project is listed as "Cattell Drive Sewer Diversion and Storage Capacity Modifications." LEGAL IMPLICATIONS The Consultant will be required to enter into a Consultant Services Agreement with the City. The project is anticipated to be completed within four (4) months. CITY'S STRATEGIC COMMITMENT The recommendation is consistent with Council's Strategic Priorities to esfabiish infrastructure investment priorities and to continue to monitor the efficiency of the organizafion. Current Assignment Basement flooding caused by surcharged sanitary sewers has been a recurring concern in the City of Niagara Falls (City)'s Chippawa area. The City currently uses emergency pumping at several locations within Chippawa to alleviate such flooding where possible. CH2M HILL has been conducting a study to determine the causes and potential remedial options to eliminate basement flooding. The current study's objectives are to determine the areas in Chippawa that aze contributing excessive wet weather flows to the sewer system, identify major constraint areas in the system, and develop alternatives that, when implemented, would alleviate the flooding problem. Potential solutions include a combination of in-line and off-line storage facilities, and sewer pipe replacement to increase conveyance capacity. The City would now like to advance the recommended options by completing the required Class EA work. Class Environmental Assessment Workplan The proposed recommendations, including both in-line storage and new storage tanks, are projects that would be categorized under Schedule B of the Municipal Class EA; accordingly, we propose the following Work Plan to complete the Schedule B requirements. Schedule B Class EA Work Plan Tasks Task 1 -Initiate Class EA (Phase 1) June-July, 2010 This task requires the development of a Problem/Opportunity Statement. The current work has essentially established the problem statement with rationale as follows: In order to alleviate the recurring concern with basement flooding in the Chippawa area, the Cih/ of Niagara Falls wishes to identify a preferred solution through a Class Environmental Assessment Study. In addition to the problem statement, Phase 1 of the Class EA process includes assembling pertinent study information. Cost opinions will be developed for each alternative and pertinent archeological and planning information will be collected for consideration during the evaluation process. Background information will be carried forward from the current project including the modelling work undertaken to identify areas of concern. The relevant Government Review Agencies will be notified of the City's intent to undertake the Schedule B Class EA. In our experience, providing the Agencies with early notification will yield early comments that we can then adopt into our Work Plan. Task 2 -Evaluate Alternative Solutions (Phase 2) June -July, 2010 For each area of concern, a long list of alternative solutions has been developed and discussed with the City. We will document a brief description of each alternative solution to facilitate the evaluation exercise. Preliminary Evaluation Criteria have also been developed az1d discussed with the City. We propose to use this as a starting point to develop a comprehensive set of criteria consistent with the Class EA requirements that will consider the technical, natural, social and economic enviromnents. We anticipate a minimal effort to enhance the evaluation criteria. We will present the proposed evaluation to the City for review and comment and will revise, as needed, based on the comments received. Our team will undertake a preliminary evaluation of alternative solutions. We believe that we have gained valuable knowledge in working with the City to-date and will apply that COPYRIGHT 2010 BY CH2M HILL, INC. • COMPANY CONFIDENTIAL Mr. Bob Darrall Page 3 April 8, 2010 knowledge to the evaluation using the confirmed criteria. We wi(1 then meet with the City to review and discuss the preliminary evaluation results. During that meeting we will be prepared to discuss impact ratings and, through discussion, revise ratings to reflect the expertise of the group. We expect that the outcome of that meeting will be a completed evaluation with identified recommended solutions or each area of concern. Task 3 -Consultation Efforts July -August, 2010 For this relatively uncomplicated Schedule B study, we propose to meet the consultation requirements efficiently and constructively. As consultation in Phase 1 is discretionary, we have limited the activity to initiating consultation with the Review Agencies. For Schedule B projects, the required point of consultation occurs after alternatives are evaluated and a solution is recommended. We propose to prepare for and attend a Public Information Centre (PIC) to present the Problem Statement and rationale, the long list of alternatives, and the evaluation results including the recommended solution for each area of concern. The scope of effort will include the following tasks: • We will prepare display panels to present the study information in non-technical terms. The display will be supplemented with a 4-page colour Information Brief and a Comment Sheet that will be available for PIC visitors. • Our PM ,Class EA Lead, and Engineering Technical Lead will attend the PIC and will supervise the sign-in table and discuss project information ti~ith visitors. • Following the PIC, we will prepare a brief technical memorandum to summarize the PIC, including key observations, comments, question and concerns raised and how the PIC has informed the study recommendations. Task 4 -Confirm Preferred Solution July -August, 2010 Following the PIC we will confirm the preferred solutions for each area of concern with the City. We will also confirm and document the potential impacts and mitigation measures proposed to minimize impacts of the preferred solution. An implementation schedule will be generated for the preferred solution. Task 5 -Class EA Documentation and Review Period August -September, 2010 We will prepare a Schedule B Class EA Report to document the decision-making process including consultation activities and outcomes. We anticipate this report to be a concise, compact document. We will provide an electronic Draft Report to the City to facilitate easy review and request that one set of consolidated comments be provided. The Final Report will reflect the City's comments. We will provide 3 hard copies and one electronic (PDF) copy of the Final Schedule Class EA Report, We will prepare a Notice of Completion and provide that to the City for publication. We will send the Notice of Completion to the Review Agencies participating in the study and to those who signed in at the PIC. Assuming there are no outstanding concerns at the end of the review period, the City can proceed with project implementation. Proposed Fee Estimate and Schedule Our proposed budget is based on the Work Plan presented herein and our knowledge gained through our current work with the City. We are prepared to complete the Schedule B Class EA study for total fees of $56,770 in accordance with our time/task matrix attached. This budget is based upon the scope of work schedule and assumptions described herein. Any changes to the work plan or unforeseen circumstances may necessitate adjustment of the project budget and schedule. Changes to the work plan will be made only with the prior written authorization of the City. Our team is prepared to commence work immediately upon receiving approval from the City. We anticipate that the Schedule B Class EA will be completed 4 months from the start of work. Assuming starting in June, we anticipate completion in September. However, if time delays occur during the process, such as comments received during the review period that require significant effort to address, completion may be delayed. That the Agricultural Society of Upper Canada work together with the Downtown BIA to formulate a community garden that is satisfactory to both parties for the Valley Way parkette site. 3. An agreement be prepared which will outline the responsibilities of the Agricultural Society of Upper Canada for the proposed community garden sites. EXECUTIVE SUMMARY An opportunity exists to utilize portions of City land in the Downtown area which is proposed for use as community gardens. The Agricultural Society of Upper Canada has proposed the use of three City properties and they are prepared to carry out all of the work associated with the gardens. The Society has recognized a need to assist residents in the Downtown area by providing education and instruction on how to grow fruit and vegetable gardens and help provide produce to meet the needs of growing families. BACKGROUND The Agricultural Society of Upper Canada approached the City with a request to utilize some of the existing City properties in the Downtown area to grow various fruit trees and vegetables. A list of potential sites was discussed with the Society and they indicated a desire to utilize three sites that are shown in the appendices attached to this report. City staff are not recommending the use of the Park Street site because of potential environmental concerns. The Society will take on the responsibility of creating the gardens and maintaining them in cooperation with the interested people living in the Downtown area. The Downtown BIA has advised that they want to be assured that the garden proposed for Valley Way and Queen Street meets their beatification efforts within the Downtown core. This report recommends that both groups meet and come up with a plan that satisfies both parties. The Agricultural Society of Upper Canada is a not for profit group which has a mandate to serve the community as a resource and to address the education and interest of sustainability through agriculture. The implementation of the community gardens proposal in the Downtown area is within this mandate. April 26, 2010 _2 _ ANALYSIS/RATIONALE PD-2010-31 As noted, the Agricultural Society of Upper Canada has indicated its interest in three properties (see Appendix 1). The first area is along Park Street (Appendix 2) where they would like to design a raised bed for full mobility access and plant fruit trees, berry bushes and vegetables. It is this site that is along the former CP rail line and staff cannot recommend the use of this site due to environmental concerns. Should an environmental review be carried out stating the site is safe for the use of planting a garden, it could be reconsidered at a later date. A second area involves utilizing a small portion of Ellis Park (Appendix 3) at Ontario Avenue and Ellis Street. They would like to involve schools and cultural clubs, as well as private households, at this location. The third location is Valley Way and Queen Street (Appendix 4) behind the gazebo which is planned as a herb and berry garden. The Society hopes to involve schools and the Native People Community at this location. The Agricultural Society of Upper Canada will meet with the Downtown BIA on this site. The exact boundaries of each of the garden areas will be identified and staked in the field before any work occurs. An agreement will be necessary between the City and the ASUC. The ASUC would be responsible for the care and maintenance of the City property while in use and carry sufficient insurance. The agreement would also provide for the restoration of the lands to original condition upon termination of the agreement. FINANCIAL IMPLICATIONS The use of the two recommended properties are to be provided to the ASUC without remuneration to the City. All the work related to the gardens will be carried out by the Agricultural Society of Upper Canada. The Society has, however, requested an opportunity to utilize City water, if it is available, and any excess soil from City projects. Staff is working with the Parks and Operations Division to see if any assistance regarding the above request can be provided. If water cannot be provided, the Society is prepared to utilize rain barrels and/or obtain water from the City's water depot at Stanley Avenue and Chippawa Creek Road. CITY'S STRATEGIC COMMITMENT The intent of the community gardens program is to educate students and local residents on the production of food. By utilizing property in the Downtown area, it will assist those people in most need. There is a sense of bringing people together and will provide direct benefits to the local residents. CITY OF NIAGARA FALLS By-law No. 2010 - A by-law to prohibit the connection of Weeping Tile (foundation drains) to the sanitary sewer system. WHEREAS sections 8, 9, 10 and 11 ofthe Aunicipal Act, 2001 provide The Corporation ofthe City of Niagara Falls with the power and authority Co construct, maintain and regulate a storm water collection system; AND WHEREAS sections 8, 9, 10 and I 1 of the Municipal Act, 2001 provide The Corporation of the City of Niagara Falls with the power and authority to construct, maintain and regulate a sanitary sewage collection system; AND WHEREAS Part XIV of the Municipal Act, 2001 provides that the Council of a municipality may pass by-laws providing penalties for contravention of by-laws and for the enforcement of those by-laws by other means; ANll WHEREAS in the year 1999 the City ofNiagara Falls entered into certain agreements with the Province of Ontario as represented by the Ministry of the );nvironment concerning the gradual replacement of combined sewers by the City; AND WHEREAS the immediate replacement of all the combined sewers located in the City of Niagara Falls is simply beyond the fiscal capacity of the City; AND WHEREAS combined sewers were atone time the accepted standard for municipal sewage disposal systems; AND WHEREAS experience and the application of science have demonstrated over the years that combined sewers are not capable of providing performance to modern standards; AND WHEREAS the City is making every effort to improve the operations of its sewer system; AND WHEREAS the disconnection of private storm water collection systems such as building drains includes, without limiting the generality of the foregoing, building foundation weeping tiles; AND WHEREAS with reasonable application of science, storm water can be dispersed such that it will not enter the City's sewer system at a rate Chat will overload Yhat system; AND WHEREAS the purpose of this by-law is to improve the environmental and hydraulic performance of the City's sewer systems for the greater benefit of the residents of the City; AND WHEREAS the City'sNiagaraFalls Pollution Control Plan identifies the need to mitigate wet weather impacts to the City sewer systems and the environment through City wide source control initiatives; 2- THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS: 1. Definitions L 1 The following terms shall mean the following in this by-law: (a) "City" means The Corporation of the City of Niagara Falls; (b) "City Cotmcil" means Municipal Council of The Corporation of the City of Niagara Falls; (c) "City Sewer" means a sewer under the control of the City; (d) "combined sewer" means a sewer intended to function simultaneously as a storm sewer and a sanitary sewer; (e) "Director" means the Director of Municipal Works for The Corporation of the City of Niagara Falls, or the person duly authorized to act in his or her stead; (f) "down spout" means a pipe or system of pipes inside or outside a building that conveys storm water from a roof of a building or structure to an unproved place of discharge; (g) "sanitary sewage" means human waste and water intentionally contaminated by human activity other than water contaminated in a manner prohibited by law; (h) "sanitary sewer" means a sewer for the collection and conveyance of sewage and to which storm, surface and ground water are not intentionally admitted; (i) "sewage" means any one or combination of sanitary wastewater, non-domestic or water borne waste from any premises, together with such ground surface and storm water which are not intentionally admitted; (j) "storm sewer" means a sewer designed and intended for the collection and conveyance of uncontaminated water, including storm water, drainage of uncontaminated water from land or from a watercourse, or any of them; (k) "storm water" means water that originates from precipitation in any form and includes the run off caused by melting snow. 3- 2. Administration and Enforcement 2.1 The Director shall be responsible for the administration and enforcement of this by-law. 2.2 The Director shall be permitted at al] reasonable times to enter upon any lands and into any building or other structure, except land or premises lawfully being used as a dwelling, for the purpose of observation, measurement, inspection, sampling and testing, to ascertain if the provisions of this by-law are being complied with. 2.3 No person shall hinder, prevent or obstruct, or attempt to hinder, prevent or obstruct the Director from so doing. 3. Storm Water and Sewage Separation 3.1 No person shall connect or cause or permit the connection of any roof water leader, eaves trough, down spout or building foundation drain, including without limiting the generality of the foregoing, the weeping the of a foundation drain, directly or indirectly to a sanitary sewer or combined sewer. 3.2 The Director may, at any time, disconnect or cause to be disconnected, any roof water leader, eaves trough, down spout, or building foundation drain including, without limiting the generality of the foregoing, the weeping file of a foundation drain from any sanitary or combined sewer. The cost of such entry and disconnection may be added to the tax roll and collected in accordance with all of the relevant provisions of the Municipal Act, 2001. 3.3 The Director may order the owner of any building, land or other real property to disconnect any roof water leader, eaves trough, down spout or building foundation drain including, without limiting the generality of the foregoing, the weeping the of a foundation drain from any sanitary or combined sewer. The cost of such entry and disconnection may be added to the tax roll and collected in accordance with all of the relevant provisions of the Municipal Act, 2001. 3.4 The Director and persons acting under his instruction may exercise any and all power and authority available to them at law including, without in any way limiting the generality ofthe foregoing, any power and authority available by virtue of the common law and provisions of the Municipal Act, 2001, the Environmental Protection Act, and the Provincaal Offences Act and any successor legislation thereto. No Change to Other Law 4,1 Nothing in this by-law shall be so construed as to permit any action and, without limiting in any way the generality of the foregoing, any discharge of any substance which by the provisions of any applicable Act, regulation or by-law is otherwise prohibited. -~- 5. Severabilily 5.1 If any section or sections of this by-law, or parts thereof, is or are found by any CourC or tribunal to be illegal or beyond the power of the City's Council to enact, such section or sections or parts thereof shall be deemed to be severable and all other sections or parts of this by-law shall be deemed to be separate and independent therefrom and to be enacted as such. Offence 6. I Any person who contravenes any provision ofthis by-law is guilty of an offence and is liable to a fine of not more than $10,000, upon conviction of a first offence, and not more than $25,000 for any subsequent offence under this by-law. 6.2 Any person who fails to comply with an Order of the Director issued pursuant to section 3 is guilty of an offence and is liable to a fine of not more than $10,000 upon conviction of a first offence, and not more than $25,000 for any subsequent offence. 6.3 Notwithstanding subsection 6.1, where a corporation is convicted of an offence under this by-law, the maximum penalty that maybe imposed upon the corporation is $50,000 for the first offence, and not more than $100,000 for any subsequent offence. NOW TIIEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS PPNACTS AS FOLLOWS: The actions of the Council at its meeting held on the 26°' day of April, 2010 including all motions, resolutions and other actions taken by the Council at its said meeting, are hereby adopted, ratified and confirmed as if they were expressly embodied in this by-faw, except where the prior approval of the Ontario Municipal Board or other authority is by law required or any action required by law to be taken by resolution. Where no individual by-law has been or is passed with respect to the taking of any action authorized in or with respect to the exercise of any powers by the Council, then this by-law shall be deemed for all purposes to be the by-law required for approving, authorizing and taking of any action authorized therein or thereby, or required for the exercise of any powers thereon by the Council. 3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls are hereby authorized and directed to do all things necessary to give effect to the said actions of the Council or to obtain approvals where required, and, except where otherwise provided, the Mayor and the Cierk are hereby authorized and directed to execute all documents arising therefrom and uecessary on behalf of the Corporation of the City ofNiagara Falls and to affix thereto the corporate seal of the Corporation of the-City ofNiagara Falls.
