The team won five consecutive games including two wins over top seed Guelph CYO to win their first provincial gold medal. In the final against the London Titans, Ally Baldassarro and Natalie Johns led the Raiders with 14 and 11 points respectively en route to a 36 -29 victory. Kara Rosenkranz, Rachel Vanoosten and Julia Pasco were dominant on the boards, while Ashley Nejeru, Courtney Santin, Allison Mussari and Briar Olah played exceptional defence and made timely steals. A single loss would have eliminated the team from the competition. These determined young ladies battled extremely hard and were crowned worthy champions. The Red Raiders Midget Girls have played together for four years with most of the same members. Two years ago, the girls placed third at the Provincials. The 2009 -2010 year began very slowly with injuries to two key players, however, over the last four tournaments, they placed fourth, third and second and Provincial Gold in succession. Coach Jim Baldassarro noted that "the girls are true ambassadors for the City of Niagara Falls as they display good sportsmanship and an excellent work ethic. Their greatest strength is the closeness among team members. A total team effort was required to win the Provincial Gold and the girls succeeded by winning five straight games ". Proposed Group Home RECOMMENDATION That Council approve the Zoning By -law amendment application to permit the property to be used as a municipally licensed group home for up to 17 persons, subject to the provision of one on -site parking space. EXECUTIVE SUMMARY A Zoning By -law amendment application has been received to permit the property to be used for a group home for up to 17 persons. The application can be supported for the following reasons: • The Official Plan permits surplus commercial lands to be considered for residential development. • The proposed group home is an appropriate transitional use between the commercial area to the south and the residential area to the north. • The building is existing and has achieved a degree of compatibility. The group home is not expected to have a negative impact on the adjacent land uses. • The provision of one on -site parking space recognizes the amount of parking historically available, will ensure a parking space is available for staff and should be sufficient for a group home. • The group home will provide necessary housing and services for people with mental health issues who have been released from treatment. The group home will be licensed by the City and both the facility and residents will be monitored by Niagara Region Public Health and mental health agencies. BACKGROUND Proposal The amendment is requested for a 470 square metre (5,061 square foot) parcel of land known as 5823 Temperance Avenue (see Schedule 1). Schedule 2 shows a site plan of the property while Schedule 3 shows floor plans. The lands are currently zoned General Commercial (GC) by By -law No. 79 -200 which does not allow the proposed group home. May 31, 2010 - 2 - PD- 2010 -41 The applicant is requesting the GC zoning be amended to site specifically add a group home for up to17 persons to the list of permitted uses. Further site specific regulations are requested to recognize the existing siting of the building and to allow the use to have only one parking space. This application was deferred by Council at it's February 22, 2010 meeting as there were a number of questions regarding the operation and who regulates the use. The applicant has provided further details on the function of the group home and a more detailed notice was circulated to neighbours. Neighbourhood Open House Two neighbourhood open houses were held to inform area property owners about the application. The first open house was held on January 18, 2010. The second to present additional information was held on April 27, 2010 following the deferral of the application by Council. No members of the public attended either meeting. Circulation Comments Information regarding the proposed Zoning By -law amendment was circulated to City divisions, the Region, agencies and the public for comment. The following summarizes the comments received to date: • Regional Municipality of Niagara No objections from a Provincial or Regional perspective. The proposal represents an opportunity for intensification that makes efficient use of land and infrastructure. The applicant has submitted an Phase 1 Environmental Site Assessment for the building which found no evidence of contamination. Regional staff is satisfied site contamination concerns have been addressed. Niagara Region Public Health is mandated to inspect group homes. The subject group home would be inspected 3 times a year for food safety and once a year for maintenance safety by Regional staff (correspondence attached). • Building Services A Change of Use Building Permit will be required. The applicant has provided drawings that indicate the existing building could be renovated in accordance with the Ontario Building Code. Orders have been issued with respect to starting construction without a permit. • Fire Services Fire Services has advised the building was the site of two intentionally set fires in October 2009. They also noted numerous violations of the Ontario Fire Code. As a result, Fire Services applied to the Ontario Fire Marshall for an "order to close ". The Fire Marshall agreed and the owner was required to immediately close the building and relocate the occupants. The violations to the Ontario Fire Code will have to be resolved as part of the building permit process. The Fire Services staff are working together with the owner on these matters. May 31, 2010 - 3 - PD- 2010 -41 • Transportation Services - The provision of one parking space for the use is acceptable. This space is intended for the one full -time employee on the site. Residents are to be notified that there is no parking available for them. • Legal Services, Municipal Works - No objections. ANALYSIS Site Conditions and Surrounding Land Uses The existing building occupies the majority of the property. It was formerly used as a place of worship, a warehouse, a ceramic art centre and a silk screen production facility at various times. The front yard and adjacent boulevard are paved and have historically been used as a parking area with vehicles partially encroaching the City's right -of -way. Lands to the south, southeast and southwest are mainly used for commercial purposes, including automotive repair shops, restaurants and a car wash. Lands to the north, northeast and northwest are used for residential purposes. Official Plan The land is designated Tourist Commercial in the City's Official Plan and is part of the Clifton Hill Tourist Subdistrict. Lands under this designation are intended to be developed for a variety of tourist oriented uses. Commercially designated lands can be considered for residential uses (including group homes) where such lands are in excess of demand. The lands north of the subject property are designated residential and intended to be developed primarily for housing. The proposed use complies with the Official Plan as follows: - The land is surplus to the City's commercial needs. The property is located at the boundary between commercial and residential areas. - The small size of the property and it's lack of on -site parking limits the parcel's potential for a commercial use. The proposed group home is an alternative use that can be accommodated on the site. - The proposed group home is a type of residential use that provides an appropriate transition between the commercial uses along Ferry Street and more sensitive residential uses to the north. Given the parking and servicing requirements associated with commercial uses, the proposal provides a better transition between commercial and residential uses than if the building were adapted to another commercial use. - The building has existed in it's current form for a considerable period of time and a degree of compatibility has been achieved with surrounding residential uses in terms of massing, scale and setbacks. - The group home should generate Tess traffic and parking demands than a commercial use. There should be no traffic impacts on commercial areas to the south or the residential area to the north. The applicant has demonstrated a single parking spot can be provided on the property. May 31, 2010 - 4 - PD- 2010 -41 Zoning By -law The applicant has requested a group home be site specifically added to the list of permitted uses under the property's GC zone. The group home is intended to accommodate up to 17 residents, which is an increase over the maximum of 10 persons permitted in the City's definition of group home. The facility is intended to provide transitional housing and prepare individuals for independent living. Further information on the proposed group home was provided by the applicant. The group home is intended to serve individuals with mental health issues, including those with acquired brain injury. The individuals are those discharged from hospital or referred to the group home by the Canadian Mental Health Association or Community Health Centre who are ready for transitional living. The facility is intended to serve residents who do not need the same level of assistance or programming that individuals in a more traditional Group Home, serving persons with more severe disabilities, may require. They will be provided with such services as meals, recreational facilities and driven to medical appointments. One full time staff person per shift will serve the facility, assisted by the group home's directors. Additional staff will include a cook to prepare meals and cleaning staff. The applicant has indicated more staff will be hired as necessary. This type of facility is not a group home licensed by the Province. The definition of Group Home in the City's Zoning By -law includes a residence for the accommodation of people who by reason of their mental health require a group living environment for their well being. The proposed facility can be viewed as a form of transitional housing, with the occupants eventually seeking their own personal living accommodations. The definition for this site specific group home will require that the residence be subject to a municipal licence. Site specific provisions are also required to recognize the existing rear yard depth (1.6 metres) and side yard width (2.2 metres on the north side and 1.0 metre on the south side) of the existing building. As these are long standing site conditions, this is acceptable. As seen in Schedule 3, the building can be modified to accommodate 17 persons and one legal parking space can be provided on the site. The current parking standard for group homes (1 parking space) is based on the needs of smaller scale group homes that have been historically accommodated in single detached dwellings. Governing /Licensing of Group Home The proposed group home provides accommodation to individuals who require supervised living, but is not a type that is licensed or regulated under a Provincial or Federal Statute. Should Council approve the application, the applicant will be required to obtain a licence under the City's "Second Level Lodging House" By -law, passed in 2001. Regulations with respect to the operation, staffing and facilities are included in this by -law. The proposed group home complies with this by -law in terms of physical space and washroom facilities required to accommodate 17 residents. Inspection of Group Home The Regional Health Office has responded to the owner indicating that they are mandated under the Ontario Public Health Standards to inspect Group Homes. As noted under the Regional Niagara comments, they will be inspecting the facility on a regular basis. It is also understood that residents would be visited by social workers or medical professionals from hospitals or Canadian Mental Health Association to monitor residents. May 31, 2010 - 5 - PD- 2010 -41 CITY'S STRATEGIC COMMITMENT The proposed use would provide a service for those people facing mental health challenges. The City's Official Plan recognizes that group homes provide needed housing for particular individuals based upon their mental, emotional or social status. The plan encourages the provision for dwellings of all types that meets the need for a wide range of households. We have formed an `ad hoc' community volunteer group, which I have been selected to Chair due to my prior experience as the founder and current Chairman of the Chippawa Dockowners Association (CDOA). During the formation of the CDOA we gained knowledge in; maintenance requirements, dock scantlings, upland and crown land agreements and risk management within the jurisdiction. The CDOA was formed as a non - profit corporation charged with providing; licencing for use, maintenance and insurance for the Ontario Power Generation lands along the Creek. We have provided these services uninterrupted, since our formation in 1992. I did so at the request of our group of concerned citizens who are part of an effort to "Save the docks" and have them returned to a suitable location in the Welland River at Chippawa. I have 35 years experience in carpentry and related construction skills, and have a small renovation business. I offer the following assessment acknowledging that I have no engineering or other such degree or education. This is simply the opinion of a skilled carpenter. u 3:, R'+ 1 The 11 pieces of the dock were pilled 5 high as shown in the photograph above, making it difficult to examine each component closely. Each section is 14 to 16 feet in length. The dock is made entirely of pressure treated 2 X lumber. There seemed very little weather or age related damage to the structures, but there was some obvious damage to the long sides of the various pieces, the sides exposed to boat traffic. The damage was caused when boats bumped or rubbed against the material. Further wear and tear could be slowed or stopped by attaching a buffer device such as a dock bumper along the length of the dock. The joists and other framing are in excellent condition, remaining straight and true with little evidence of twisting or cupping. The floorboards are generally in good condition, but a few should be replaced because of splintering, which would be unsafe for barefooted swimmers etc. The screws used to secure the deck boards, at least the ones I could see, are rusting and will eventually give out. This will take a few years, but eventually they need to be replaced by galvanized deck screws. s c ficOuLE -Z ffi R 2 f ° 3 P f • " e c The docks various pieces were constructed with galvanized lag bolts and heavy duty screws used to secure the frame or skeleton on the dock. Large plastic floats are securely attached to this frame, and allows the dock to float in the water. The floats are in excellent condition. The separate wooden sections of the dock are joined together with 3/4 each thick rods that connect to a u bolt on the opposite deck, much like the cars of a train connect. There is some rust on some of the metallic pieces, but not so much as to cause concern in its performance. 4 1 s a s -' � 4.. k �C `".» ms s. ! �. This picture also shows that 2x4's used as boat tie offs have come off some sections, (lowest section in this picture) leaving only the wooden spacers. This floating dock was VERY well constructed. Consider applying chemical treatment to increase water resistance to the wood. This deck treatment is recommended for pressure treated decks every few years. The dock is out of the water, so now would be a good time, and it may add years to the life and appearance of the dock. - replacement of splintered deck boards - replace wooden tie off system with galvanized tie off cleats or rings. - replace deck screws as appropriate. -add bumper protection along docks length. These Docks are an invaluable asset not only to our Water Patrol Program; they are also needed by the Niagara Falls Fire Dept., Niagara Regional Police Marine Unit, Canada Customs and Immigration as we collectively respond to the needs of the residents and visitors to our community, both on land and water. Our Water Patrol uses these docks as a place to not only monitor water traffic and swimmers, but as a visible location for the public to know where to locate us in the event they require our services. We also use the dock to tie up while responding to first aid emergencies and debark swimmers that have been assisted on the water, whether or not they require transfer to other emergency service personnel. We often meet EMS or other emergency responders at the dock for patient transfer. Boats and boaters in difficulty, unless members of the Boat Club, are also towed to this location. Whatever the final decision on the reinstallation of the docks and the location which may be conditional on construction progress, all emergency response personnel who aid swimmers and boaters on the Welland River will need to coordinate response efforts and transfer points. Confusion causes delay, and could have a negative impact on prompt response times thereby jeopardizing the health am! well being of those who rely on our water and park lands during the summer season. The members of the Niagara Parks Police Service marine unit have worked with the Niagara Regional Police marine / USR unit since 2000. During this time, the docks have been a great asset to marine patrol units in conducting enforcement duties, safety initiatives and public relations work. Members patrolling the vicinity of the upper Niagara River find the docks to be the only practical place to stop during fowl weather when not near the Miller's Creek Marina. It also allows us to enforce the speed limit in the Welland River and conduct safety equipment inspections, to stop and inform youth of dangers associated with jumping off the bridge, to permit the residence and visitors to board our boats and ask questions or to give children a tour, and to simply take a break during our twelve hour shifts. The Underwater Search and Recovery Team (Dive) of the Niagara Regional Police have use the docks several times as a convenient and safe entry location during dive calls in the area. It is a welcome stop for the St.John's Ambulance river patrol who use the docks after many trips down and up the river on a hot summer day. As with us, it gives them a place to rest and still be present and be visible to the public. The docks have become a well known location in Chippawa for all and an asset to some of the businesses nearby. The members of the marine unit and officers on the road, frequently stop and speak with individuals on the dock whether it is related to suspicious circumstances, inspecting fishing licenses, or warn people of the strong currents in the area. Leaving the docks out this year will be a hindrance to our way of doing business on the Welland River. Please consider retuming them to either the same location or possibly to the north shore as we feel this too is a viable location. The members of the Niagara Parks Police / Marine Unit are willing to assist in `looking after' the docks and report any damage, etc to the Chippawa Public Dock Committee representative(s). (see attached) I talked to Cathy Crabbe about the approved height in the by- law and mentioned that if the family wanted a higher monument than what was allowed, they would have to write to Council. Cathy agreed and passed on this information to the family. The family then went to Councilor Wayne Thomson. Wayne has called me a couple of times on the subject. Wayne prefers to work this out without going to Council and thinks that because there are already huge monument in the cemetery (from decades ago) that we should be able to allow oversized monuments and charge the families for the extra height. This is contrary to our by -law . The monument height can be a risk mgmt issue as the higher they are the more conducive they are to falling over. It is also an aesthetic issue as an oversized monument overpowers all other monuments around it. EXECUTIVE SUMMARY This report is prepared monthly to provide Council with an update on the City's property tax receivables. During April the outstanding taxes increased compared to 2009. This is a reversal of previous months in 2010 wherein outstanding taxes were lower than the comparative month in 2009. During April, tax receivables as a percentage of taxes billed have increased from 39.2% in 2009 to 42.6% in 2010. Taxes outstanding as of April 30, 2010 was $32.9 million. The City's finance staff has had continued success in resolving 77% of properties that are subject to registration for 2010. There are currently nineteen properties scheduled for tax sale in the next two years. On May 3, 2010 the City held a tax sale in which 100% of properties scheduled for tax sale were resolved, as five properties were sold and two properties were redeemed by the owner. BACKGROUND This report is being provided as part of the monthly financial reporting to Council by staff. It is also submitted to our banking institution for compliance with our banking agreement. ANALYSIS /RATIONALE The tax collection for 2010 Zags behind the collection history in 2009. This is consistent with historical trends in taxation years when the economy has slowed. Table 1 shows that taxes outstanding at April 30, 2010 are $32.9 million. This represents an increase from $29.9 million in arrears for the same period in 2009. Finance staff continues to actively pursue property owners in arrears. Table 2 provides the breakdown of outstanding taxes - total by assessment class. Consistent with previous months, the majority of outstanding taxes are for residential and commercial properties. The ratios of uncollected taxes by property class has remained virtually the same from the prior year. Finance staff takes specific collection actions for properties that are subject to registration. These action steps have been outlined in previous reports. At January 1, 2010, 405 properties were subject to registration. Table 3 summarizes the progress of these actions after four months of activity. This table shows 77% of the tax accounts or 313 properties May 31, 2010 - 2 - F- 2010 -33 t arrangements. Finance staff continues to make every effort to have accounts paid in order to avoid the registration process and the associated costs related to that process. The outstanding taxes for registered properties represent 2.4% of the total outstanding taxes at month end. FINANCIAL /STAFFING /LEGAL IMPLICATIONS Tax arrears as a percentage of taxes billed in a year is a performance measure that stakeholders utilize to analyse an organization's financial strengths. Niagara Falls, due to its high reliance on commercial assessment, is traditionally higher compared to municipalities of similar size. The percentage of taxes outstanding to taxes billed as at April 30, 2010 is 42.6 % which is an increase from 2009's value of 39.2 %. The municipality has a record of full collection and earns significant penalty revenues to offset the higher measure. On May 3, 2010, seven properties were scheduled for tax sales. Of these, two were redeemed prior to sale, the remaining five properties were sold for taxes. EXECUTIVE SUMMARY The due dates for final tax billing must be approved by Council pursuant to the Municipal Act. The City has established that due dates for the non - capped property classes be June 30 and September 30. The due dates for the capped classes are August 31 and October 29 due to the additional calculations required for these billing. BACKGROUND The City of Niagara Falls is responsible for billing and collecting property taxes on all assessable properties within the municipality. These annual billings include the annual taxes for the City, for the Region of Niagara and for the appropriate local school boards. Due dates for property taxes are set to coincide with the quarterly levy payments made to the Region and the school boards. FINANCIAL /STAFFING /LEGAL IMPLICATIONS Due to the additional calculations required to prepare the 2010 Final Tax Notices for the Commercial, Industrial and Multi- residential property classes, all assessment classes cannot be billed at the same time. Staff is therefore recommending that the Final Tax Notice Due Datesforthe Residential, Pipeline, Farmland and Managed Forest Assessment Classes be set as June 30 and September 30. Once the additional calculations for the remaining classes have been determined then final tax notice due dates for the Commercial, Industrial, and Multi- residential property classes will be presented for Council's consideration. BACKGROUND In 1989 the City entered into a Site Plan Agreement with the Owner. The terms of the subject 1989 Site Plan Agreement were completed many years ago. EXECUTIVE SUMMARY The reconfigured sidewalk on St. Paul Avenue and Stone Gate will serve to provide a pedestrian linkage between the community and this subdivision. Residents in this development overwhelmingly support the sidewalk reconfiguration. BACKGROUND Staff received a request from the developer to construct sidewalks on St. Paul Avenue and Stone Gate in exchange for sidewalks that were to be constructed within the subdivision in accordance to the Subdivision Agreement. A questionnaire was sent to all residents within the subdivision requesting their input on the matter which will assist in forming staff's recommendation. A public meeting was held onMay 18, 2010 as well to discuss the matter and respond to any other development related matters with the Developer in attendance. The neighbourhood response was overwhelmingly in favour of the sidewalk re- configuration. ANALYSIS AND RATIONALE The Neighbourhoods of St. David's subdivision has been developed slowly over the past ten years and as a result part of the final features such as boulevard restoration, street trees, top asphalt and sidewalks have been deferred in order to coincide with the building construction. In some cases, landscaping and driveways have already been established by private homeowners. These areas would have to be disrupted in order to install the sidewalks along the interior road system. While this subdivision has interconnected pedestrian links to the Bruce Trail system and the adjacent subdivision (Calaguiro Estates) the road system serves local residents only. May 31, 2010 -2- MW- 2010 -33 By extending the sidewalk from the northerly entrance of the development (Stone Gate) along the west side of St. Paul Avenue to Mountain Road pedestrians can avoid having to travel along the roadside of a heavily travelled Regional Road. At the Public Information Centre residents reviewed the issue of the need for a left turn land for this development. Staff would note that this request has been made of the Region previously and denied on the basis cannot meet the traffic warrants. Since that time additional traffic patterns have occurred resulting in the need to revisit this matter. FINANCIAULEGAL IMPLICATIONS The Developer has provided security for these works in the form of a letter of credit. Once the matter is addressed to the City's satisfaction, the security will be returned to the Developer subject to the terms as set out in the Subdividers Agreement. COMMITMENT TO COUNCIL PRIORITIES Implementation of the sidewalk re- configuration meets the intent of Council's Strategic Priorities to establish infrastructure investment priorities and to strengthen and promote economic development within the City. The subdivision started to be developed in 1997 and approximately 150 homes have been built and occupied. To date no concrete sidewalks have been constructed. We propose the following: "That all internal sidewalks of the subdivision be eliminated. In lieu we propose to construct a sidewalk to municipal standards starting from the Northwest corner of Mountain Road and St. Paul Avenue continuing North along St. Paul Avenue to Stonegate. We would continue the sidewalk along the south side of Stonegate to Stonehaven." We propose the above reconfiguration for the following reasons: 1. The construction of the internal sidewalks would damage the mature landscaping of the residents. 2. To -date no residents of the subdivision have requested that sidewalks be constructed. 3. The Neighbouring subdivision does not have sidewalks and this would be in keeping with the neighbourhood. 4. The proposed sidewalk along St. Paul Avenue would provide linkage for the residents to the newly constructed sidewalk along Mountain Road. This would provide continuous linkage from the park area in the NSD subdivision to the Fireman's Park at the corner of Mountain Road and Dorchester. This would also provide improved linkage for the area residents to the gravel walkway further down St. Paul Avenue that links with a trail that eventually connects with the Bruce Trail. P.O. EXECUTIVE SUMMARY The Downtown BIA has requested through the Downtown Steering Committee that Council approve the designation of the Downtown area as a Tourist District to enable them to obtain signage along the QEW promoting the Downtown as an arts and entertainment area. The positive redevelopment that has occurred in the Downtown over the past couple of years makes the area a good candidate under the Canadian TODS Program. BACKGROUND The Downtown BIA has been actively promoting the Downtown area as a place to visit, shop and see entertainment. In fact, recent magazines including Niagara Today and Westjet Travel Magazine have contained recent articles promoting Downtown Niagara Falls as a place to visit. As part of the Downtown BIA's promotional strategy, they approached the Provincial TODS Office about the possibility of signage along the QEW. The result was that the BIA would be eligible for signage if the City was to provide a resolution designating the Downtown as a Tourist District. Staff carried out a followup with Mr. Randy Nichols, Operations Manager under the TODS Program, and he confirmed that his office would accept a resolution from City Council designating the Downtown as a Tourist District in orderforthe BIA to proceed with obtaining signage along the QEW. This item was brought forward to the Downtown Steering Committee on March 22, 2010 and the Committee supported the request for a resolution from City Council. May 31, 2010 - 2 - PD- 2010 -43 ANALYSIS /RATIONALE The Downtown is located between the tourist travelled routes along Victoria Avenue and River Road. The Downtown is also serviced by an intercity bus service which brings many visitors to the Downtown area. GO Train is introducing a bike train and promoting day trips for Toronto area residents to Niagara Falls and the surrounding area. Via Rail has had a bicycle service on weekends as well. The Downtown is now directly linked to the tourist core by the new Olympic pedestrian trail. Over the past two years, with more than 20 new businesses, the Downtown area has achieved an arts and entertainment feel and tourists are visiting the Downtown. The signage under the TODS Program will encourage increased visitation. A resolution to designate the Downtown as a Tourist District is on tonight's agenda. FINANCIAL IMPLICATIONS There are no financial impacts to the City as the signage will be paid for by the Downtown BIA. WHEREAS pursuant to Section 39 of the Planning Act, the Council of a local municipality may, in a by -law passed under Section 34 of the Planning Act, authorize the temporary use of land for any purpose set out therein that is otherwise prohibited by the by -law; AND WHEREAS the Council of the Corporation of the City of Niagara Falls deems it desirable to enact such a by -law. THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS: 1. The Lands that are the subject of and affected by the provisions of this by -law are described in Schedule 1 of this by -law and shall be referred to in this by -law as the "Lands ". Schedule 1 is a part of this by -law. 2. The purpose of this by -law is to amend the provisions of By -law No. 395, 1966, to permit the use of the Lands in a manner that would otherwise be prohibited by that by -law. In the case of any conflict between a specific provision of this by -law and any existing provision of By -law No. 395, 1966, the provisions of this by -law are to prevail. 3. Notwithstanding any provision of By -law No. 395, 1966 to the contrary, the following uses and regulations shall be the permitted uses and regulations governing the permitted uses on and of the Lands. 4. The permitted uses shall be: (a) The uses permitted in a Rural zone (b) A machine shop 5. The regulations governing the permitted uses shall be: (a) Maximum duration of a 3 years from the date of passage of this zoning machine shop by -law (b) Maximum floor area of a 335 square metres machine shop (c) The balance of regulations specified for a Rural use -2- 6. All other applicable regulations set out in By -law No. 395, 1966 shall continue to apply to govern the permitted uses on the Lands, with all necessary changes in detail. 7. WHEREAS the Municipal Act R.S.O. 1990, cM.45, Section 210, paragraph 80, authorizes the Council of local municipalities to pass by -laws regarding and regulating, inter alia, the draining of any private lands; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS; Section 1 - Definitions Definitions of words and phrases used in this by -law that are not included in this section shall have the same meanings which are commonly assigned to them in the context in which they are used in the Ontario Building Code and other provincial or municipal legislation respecting plumbing and drainage. 1.1 "Area Drain" means a catch basin or catch basin/manhole that receives storm water run -off from lands and discharges to a system of piping which is not connected to a building. 1.2 "City" means the Corporation of the City of Niagara Falls. 1.3 "Public Storm Lateral" means that part of a Storm Water Disposal of Storm Water Management System that is situated within the public road allowance between the property line and the connection to the Municipal storm sewer into which it discharges. 1.4 "Storm Water" means water that is discharged from a surface as a result of rainfall, snow melt or snowfall. 1.5 "Storm Water Disposal System" means a system for disposal of storm water including drainage piping, catch basins, manholes, area drains, used to drain private lands. 1.6 "Storm Water Management System" means a Storm Water Disposal System that has been professionally designed, constructed and maintained such that the rate run -off from specific blocks of land or lots is controlled to discharged into a Municipal Storm Drainage Facility at a reduced flow rate. -2- Section 2 - General Requirements 2.1 All storm water run -off from private lands as a result of the development of those lands shall discharge to Storm Water Disposal System or Storm Water Management to a municipal storm sewer so as not to cause ponding or flooding and so as not to adversely affect any building or adjacent property where applicable. 2.2 No Storm Water Disposal System shall be connected to a sanitary sewer or sanitary drain. 2.3 Materials used in the construction and installation of a Storm Water Disposal System shall comply with the requirements of all applicable legislation respecting storm drainage systems and current municipal standards. 2.4 Every Storm Water Disposal System or Storm Water Management System shall be designed and constructed in accordance with the Guidelines for the Design of Storm Sewers issued by the Environmental Approvals and Project Engineering Branch of the Ministry of the Environment and any amendments thereto. Section 3 - Permits 3.1 No person shall install or cause to be installed any drainage piping, catch basins, manholes area drains or other appurtenances comprising a Storm Water Disposal System or Storm Water Management System without the consultation of Municipal Works staff. 3.2 No person shall install a Storm Water Disposal System or Storm Water Management System or cause a Storm Water Disposal System or Storm Water Management System to be installed except in accordance with municipal works staff consultation. 3.4 Two copies of the plans, drawings and specifications of a Storm Water Disposal System or Storm Water Management System may be submitted to city staff for each application and, except as otherwise required by city staff shall contain the following details; (a) the location of all catch basins and manholes including rim and invert elevations; (b) size, location and grade of all piping; (c) the location and invert elevation of all connections; (d) ground elevations; (e) curbs, walkways, swales, ditches and other features that may affect drainage. 3.5 City staff shall not allow connections to municipal sewer where; (a) the proposed installation contravenes this by -law or any other applicable law; (b) no city staff consultation; -3- (c) any fees due are unpaid. Section 4 - Inspection 4.1 Municipal Works staff shall be notified by the landowner or his representative when the installation of all piping that is part of a Storm Water Drainage or Storm Water Management System is completed to the property line. Section 5 - Private Catch Basins and Manholes 5.1 Catch basins, manholes, area drains and drainage piping shall be installed in accordance with the applicable standards of the City. 5.2 Catch basins or area drains shall not be used as manholes. 5.3 Every catch basin or area drain shall connect to a Storm Water Disposal or Storm Water Management System by means of a branch connection. 5.4 Catch basins and area drains located in the rear yards of private lands, used to drain run -off from adjacent properties shall be maintained by the owner of the land on which the drain is installed. 5.5 Storm water run -off from paved areas, including ramps and loading areas shall be directed to discharge to a catch basin that connects to a Storm Water Disposal System or Storm Water Management System by means of a branch connection. 5.6 Where a catch basin or area drain is installed in a ramped driveway, the installation shall conform to current applicable standards of the City. Section 6 - Storm Water Run -off from Roofs 6.1 Except as otherwise permitted, run -off from roof areas shall be discharged to splash pads at ground level at least one metre from the building. 6.2 Notwithstanding 5.1 no storm water shall discharge on any hard paved surface where significant vehicular or pedestrian traffic is expected. 6.3 The discharge from any roof shall not adversely affect any adjoining property or cause erosion. -4- Section 7 - Maintenance 7.1 Every Storm Water Disposal System and Storm Water Management System shall be maintained to be free of leaks, sand, grit, debris, ice and snow. Section 8 - Penalty & Violations 8.1 Every person who contravenes this by -law is guilty of an offence and upon conviction is liable to a fine of not more than $5,000. DEAN IORFIDA, CITY CLERK R. T. The actions of the Council at its meeting held on the 31s day of May, 2010 including all motions, resolutions and other actions taken by the Council at its said meeting, are hereby adopted, ratified and confirmed as if they were expressly embodied in this by -law, except where the prior approval of the Ontario Municipal Board or other authority is by law required or any action required by law to be taken by resolution. 2. Where no individual by -law has been or is passed with respect to the taking of any action authorized in or with respect to the exercise of any powers by the Council, then this by -law shall be deemed for all purposes to be the by -law required for approving, authorizing and taking of any action authorized therein or thereby, or required for the exercise of any powers thereon by the Council. 3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls are hereby authorized and directed to do all things necessary to give effect to the said actions of the Council or to obtain approvals where required, and, except where otherwise provided, the Mayor and the Clerk are hereby authorized and directed to execute all documents arising therefrom and necessary on behalf of the Corporation of the City of Niagara Falls and to affix thereto the corporate seal of the Corporation of the City of Niagara Falls.
