Niagara Falls Ministerial Association. Re: City Prayer Service. advising that
1) they wish to have a large scale preyer service at the Niagara Fails Memorial
Arena and are looking for financial backing; 2) requesting to hold monthly early
moming preyer sessions at the Niagara Falls Memorlal Arena at the LaMareh Room;
and 3) requesting to hold a procession on Good Friday leaving from either the
Optimist Club or Zellers parking lot to St. Andrews United Church.
RECOMMENDATION: Refer to staff.
The Regional Municipality of Niagara, Office of the Regional Chair - Re:
Municipal Representative. requesting that Council appoint a local Council
representative to assist in the next phase in the development of a Transportation
Strategy for Niagara.
RECOMMENDATION: For the consideration of Council.
The Regional Municipality of Niagara, Office of the Regional Chair - Re:
Proposed Smart Growth Management Councils - requesting that Council formally
endorse a resolution opposed to Smart Growth Management Councils.
RECOMMENDATION: That the request be endorsed.
The Corporation of the Town of Pelham - Re: Disposal of Regional Waste
Materials - requesting that Council support a resolution to the Region calling for
support of altemative methods for the disposal of Regional waste mate#als, such as
incineration as proposed by American Re-Fuels.
RECOMMENDATION: For the consideration of Council.
Ontario Pharmacists' Association - Re: Proclamation - requesting that Council
proclaim the week of March 4 - 10, 2002 as "Pharmacy Awareness Week" in the City
of Niagara Falls.
RECOMMENDATION: That the request be approved subject to established policy.
The Optimist Club of Niagara Falls - Re: Maintenance Grant - requesting that
their maintenance grant be increased from $20,000 to $40,000.
RECOMMENDATION: Refer to staff.
City of Kingston - Re: Halt of Bill 130 - The Community Care Access
Corporations Act, 2002- requesting Council support of a resolution requesting the
Provincial Govemment to halt passage of Bill 130 and to hold public consultations
and committee hearings to receive public input into any plans for re-organizing long
term health care.
RECOMMENDATIONS: That the request be supported.

RESOLUTIONS
That the Council of the City of Niagara Falls opposes the creation of a Ministry-
mandated Smart Growth Management Council for Niagara.
That the Council of the Corporation of the City of Niagara Falls reaffirms the passing
of By-law No. 2001-286, a by-law to permit the conversion of the existing building to
an apartment dwelling containing not more than 25 units on a portion of the land and
the development of 11 on-street townhouses on the balance of the site or on-street
townhouses on the entire property located at 6365 Drummond Road.

Catholic Episcopal Corporation forthe Diocese of St. Catharines, In Canada

The Niagara Falls Ministerial is desiring to host a large scale city prayer sa~ige to be held in the
Niagara Falls Memorial Arena in the fall months o£.20t32, perhaps near the~gnd, otr ~,The
purpose of the Prayer is to unite the Claistian Church in Niagara Falls to pray for our city. We want
to pray for protection over our city, as we can sec how important that has become since September
11th. We want to pray for the Mayor's office and for all those who lead our city. We are convinced
that as the church comes together to pray, the city will see a blessing in many ways. There are cities
around the world such as Cali Columbia, who have seen a reduction of drug trafficking and
homicides as a direcl result of the church coming together to pray, and we believe that all though our
cities needs may be different, we can see positive results happen here as well. We are,lo~kingto the
city for support in the use of the Niagara Falls Memorial Arena as well as financial backing to lmst
this event. At this point we do not have dollar figures, but there will be the aeed~foran adequate
sound system, lighting and a large stage, as well as advertising costs.
We believe that this is a venture that the entire city will he blessed by and so we seek your support
and cooperation in this event.
In order to begin to prepare the city for this event, we are looking to h~,ce amonthty ea~,ty mo~
prayer, where pastors and their congregations and leaders of the city could join together to begin to
pray for the city in advance of the large prayer event in fall, therefore we are ~ thc ~ofthe
Le Marsh Hall in the public D~m~ry. We would need use of this room from 6 a.m.- 8 a,m. on the
designated morning. Thank you for your consideration in this matter
The Niagara Falls Ministerial Association is holding their second cay wide Good Friday service and
are looking to add a procession this year through the streets of Niagara Falls finishing ak S~ Andrews
United Church. We are looking to begin either at the Optimist Park or the Zellers parking lot on
Morrison street and then to proceed from there to St Andrews church. We are looking for permission
from the city as to having the procession dom,n~Morrison Street from Dorchester to Stanley Ave.

Transportation Strategy - Niagara Region
I am writing to invite your Council to appoint a municipal representative to assist in
the next phase in the development of a Transportation Strategy for Niagara.
Background
Regional Council approved the establishment of a Steering Committee to oversee
the development of a transportation strategy for Niagara Region in August of 2000.
The Steering Committee was charged with developing an overall direction and
policy framework for guiding integrated decisions on transportation initiatives,
operations and expenditures across the Niagara Region.
Since it was established, the Steering Committee has overseen an extensive public
consultation process to obtain input on the transportation strategy for Niagara.
The Steering Committee held public meetings, conducted special focus group
sessions, distributed questionnaires, hosted an interactive web-site, received
written submissions and conducted a public opinion survey in order to get input on
the overall strategic vision for transportation in Niagara. Input was received from
the public, transportation operators and other stakeholder groups throughout the
Region. The input was compiled to form the basis of the transportation vision for
Niagara.

Concerns with Respect to Proposed
Smart Growth Management Councils
URGENT
Thc window of opportunity for comment on the provincial government's concept of Smart
Growth Management Councils is swifdy drawing to a dose, On behMf of Regional Council, I
would like to urge that you express your concern about thi~ proposal.
Our Smart Growth Comm~lnity Steering Committee has reviewed the underlying principles of
this concept and has the following concerns:
· The Committee does not wish to see another authority level created that could result m
potential impediment to locally defined growth directions - indeed, the Committee stressed
its position that its mandate is to be Niagara's Usmart growth management cotmcil".
* The prospect of where Niagara would be compmtmentzlized in such aa organizational
cons~a-uct was also a source of concern - geographic-based lines may be arbitrary_ Niagara
]:Las mean~no~ll connections to Hamilton, Italdimand, the Southwest (including Waterloo
Region, Guelph, London, etc.) as well as the GTA.
· ()ne item that does not appear to be in the suggested model is that, as a border area,
Niagara has a need to regularly connect to our friends in Western New York. With our Bi-
National Forum efforts, we've been cooperating positively on matters of common interest.
The Committee is certain that this concern would apply to other border commtmities as
well.
It is oM view that Niagara mtmicipalities can play an important role ia piloting smart grow~
applications as has been recently evidenced at our Smarter Niagara Summit on November 29,
I would ask that you place this memo and the attached resolution before your Council this
week. I will place it before Regional Council on December 20. I would urge you to express
your Cotmcfl's opposition on Smart Growth Council to the Minister of Municipal Affairs and
Hom;ing prior to the end of the year.

WHEREAS all Regional waste materials are currently being diverted
to various Regional landfill facilities;
AN[) WHEREAS alternate methods are available, namely, American Re-
Fuels;
AN[) WHEREAS currently all waste is being buried at the Regional
landfill sites and the leachate and other contaminants are all
deposited through the soils at the Regional landfill sites to
possibly contaminate the aquifer it would seem prudent that instead
of contaminating our soil that we utilize incineration as an
alternative method;
AN[) WHEREAS American Re-Fuels ts eager to engage in a 6 month trial
with Regional Niagara for its waste;
AND WHEREAS it has been scientifically proven that incineration is
far less hazardous to the environment than burying all contaminants
in a landfill site;
NOW THEREFORE BE IT RESOLVED THAT The Corporation of the Town of
PeLham hereby requests the Regional Municipality of Niagara to act,
with haste, to negotiate a contract price per tonne with American
Re-Fuels for the diversion of waste through incineration at the
earliest possible opportunity;
AND FURTHER THAT this resolution be circulated to all area
municipalities and the Regional Municipality of Niagara for their
support.

Th/s will confn'm that at the regular meeting of City Council held on November 20, 2001, the following Motion (5),
was approved:

WHEREAS well managed and adequately funded home health care is a growing need in our community,
and;
WHEREAS the provincial government has recently introduced Bill 130, The Community Care Access
Corporations Act, 2001, which would dramatically change the governance of Community Care Access
Centres, giving the minister of Health and Long Term Care unprecedented powers which includes the
appointment of board members and executive directors, and;
WHEREAS this bill may receive third reading and Royal Assent by mid-December, without public
consultation having taken place, and;
WHEREAS direct community control of services will be lost while public concerns are being raised over the
need for increased funding of home care which is provided at less than one-tenth the cost of long term care
facility placement.
NOW THEREFORE BE IT RESOLVED THAT the City of Kingston calls on the provincial government to halt
passage of Bill 130 and to hold public consultations and committee hearings to receive public input into any
plans for re-organizing long term health care.

The lowest tender was received from Centennial Construction in the amount of $1,587,874.50
Although the contractor has completed sewer work previously within the City, they had not
completed work at this depth. However they have completed deep work within the City of

This report is provided for the information of Council.
Background:
At (he Council meeting of December 3, 2001, staffwas directed to provide a report on the details
of the Crime Prevention and Tourism Safety Conference, specifically with regard to staff
resources utilized to host the Conference.
The Conference was hosted in Niagara Falls for the past two years under the leadership of
Alderman Carolyrm Ioannoni. A Steering Committee was established with representatives from
the Chamber of Commerce, Niagara Falls Tour/sm, Niagara Regional Police Services Board,
Niagara Regional Police, Niagara Parks Commission, Casino Niagara Security and City staff.
Thc three-day event included such topics as Fraud & Counterfeiting, Physical Security,
Computer Crime Fraud, etc. Copies of the Conference programs for the past two years are
attached~ Also attached is a summary of registrants, local and out-of-town, who participated.
In 2:001, the Conference generated approximately $17,000 in sponsorship and $13,000 in
regiistration fees. The actual conference expenditures were approximately $20,000 which
allowed for a donation of approximately $10,000 to be directed to Niagara Falls Community
Policing. Approximately $6,000 was donated to Niagara Falls Community Policing in 2000.
While there were no City funds allocated to this event, significant stafftime was provided. Staff
assi[sted in the areas of planning, organization, registration, technical audio visual support,
clerical support, etc. Total staff time involved adds to approximately 31 staff working days, or
approxfmately $6,500 - $7,500.

At the November 12, 2001 meeting of Council, Alderman Campbell requested information on a
program provided by the Town of Yort Eric to improve facades of downtown buildings. Staffhas
had the opportunity to investigate this matter.
OVERVIEW:
The Fort Erie Bridgeburg Station Facade Improvement Program is a municipal initiative. The
Council has allocated a total of $60,000 from its Waterfront and Tourism Reserve Fund. The Town
set aside $20,000 in 2001 and $20,000 for 2002. Fort Erie has established its program under Section
28 of the Planning Act which allows municipalities to make grants or loans within Community
Improvement Areas.
The program provides that owners may receive up to $3,000 per year for restoration and
improvements to the street face of the building. The owner must spend a matching amount. The
work done on the building must be consistent with the BIA Streetscaping Master Plan. Professional
fees are also an eligible item for funding. The improvements to the buildings are to be substantial
and have a significant impact on aesthetics. The intent of the program is to encourage restoration
and improvement leading to economic development of the downtown core.

Improvement Manual for Queen Street. A number of businesses updated their storefronts at that

RECOMMENDATION:
It is recommended that Council reaffirm, by resolution, the passing of By-law No. 2001-266.
BACKGROUND:
The City has received an appeal to Zoning By-law No. 2001-266 from Luigi DeLisio, a solicitor for
Mr. and Mrs. Mignelli and residents of Murray and Ash Streets. The by-law affects the
redevelopment of 6365 Drummond Road (see Schedule 1) and would permit the conversion of the
existing building to an apartment dwelling containing not more than 25 units on a portion of the land
and the construction of 11 on-street to/vnhouse units on the balance of the land or the construction
of on-street townhouses on the entire property.
The reasons for the appeal are concerns over increased density, the type of apartment proposed and
the !increase in traffic. The Notice of Appeal (see attached) also includes concerns regarding the
appearance of the existing building after the conversion, that the apartments can be built without the
townhouses and tenancy of the proposed apartment.
The City is required by the Planning Act to forward the appeal to the Board within 15 days of the
last day of appeal. The Board requires that Council's position be submitted with the appeal.
However, in this case, as the documents have already been sent to the Board, this report and
resolution will follow under separate cover.
CONCLUSION:
Council passed By-law No. 2001-266 in accordance with the requirements of the Planning Act and
based on staff's recommendations, comments from agencies and individuals and submissions made
at the public meeting.

OBJECTION:
The area residents defined above object to the change to the zoning of the land at
6365 Drummond Road from a mixed Residential Mixed (R3-529) zone to a site specific
Residential Apartment 5B Density (R5B-558) and site specific Residential Mixed (R3-557)
zone. The by-law permits the conversion of the existing building into 25, one and two-
bedroom apartment units and the construction of 11 on-street townhouse dwelling units Or
on-street townhouses on the entire property. The area residents object to the change in
zoning.
The concern by the residents is that of increased density, the type of apartment
dwelling proposed and the increased traffic in an area already under heavy traffic
restrictions.
REASONS:
The neighbourhood is primarily single home residential. It is an older neighbourhood
with houses that have been upgraded by the residents. The residents are concerned that:

as an "eye-sore";
the apartment units may be built without the townhouse unit;s being built;
the traffic in the area would be increased to a level beyond that which the roads

bachelor apartments may attract tenants that are transient and not concerned with
the appearance of the building thus impacting on the appearance of the area;
the apartment building concept is not appropriate for the area.
The above should be considered as our Notice of Appeal.

RECOMMENDATION:
That, in the absence of an adopted 2002 Current Budget, City Council approve the following:
1. City departments be allowed to incur costs to a level of 30% of the departmental expenditure
budget of the prior year.
2. New capital items deemed essential by a department be approved by City Council prior to
purchase.
3. That this policy be communicated to all Commissions, Boards and Agencies, and that City
contributions not exceed a monthly pro rata share of the prior year's support.
BACKGROUND:
The 2002 Budget schedule provides for consideration of the 2002 Budget in March 2002.
Expenditures without budget appropriations should not take place without the approval of City
Council. The City, however, is an ongoing entity and must, of'necessity, incur costs. To allow for
these expenditures, the Municipal Act RSO, 1990 (Section 370) authorizes Council to pass an
interim levy by-law before the adoption of the estimates for the year.
Since consideration of the 2002 budget is anticipated in March, most departments, boards and
agencies should be able to operate with an interim spending approval of approximately 30% of the
2001 budget. If Council approval of the budget is not achieved by the end of March, a further report
with an amended interim spending authority will be submitted.

BACKGROUND:
Part I on Reference Plan No. 59R-7442, located on the south side of North Street, was conveyed to
the City for road widening purposes as a condition of site plan approval. The subject land is shown
hatched on the plan attached. Staffrecommends the subject road widening be established as a public
highway to form part of North Street.

consent. The subject land is shown hatched on the plan attached. Staff recommends the subject road
widenings be established as a public highway to form part of Crowland Avenue.
Part 2 on Reference Plan No. 59R-8162 is a daylighting triangle, located at the comer of Lamont
Avenue and Main Street, conveyed to the City as a condition of rezoning approval. It is shown
hatched on the plan attached. Staff recommends the subject land be established as a public highway
to form part of Lamont Avenue.
Part I on Reference Plan No. 59R-9072, located on the east side of Kalar Road, was conveyed to the
City for road widening purposes as a result of the settlement of an appeal to the O.M.B.. The
subject land is shown hatched on the plan attached. Staff recommends the subject road widening
be established as a public highway to form paxt of Kaiar Road.
Part 1 on Reference Plan No. 59R-11403, located at the comer of First Avenue and Bridge Street,
was conveyed to the City for a daylighting triangle. The subject land is shown hatched on the plan
attached. Staff recommends the subject daylighting triangle be established as a public highway to
form part of First Avenue.

RECOMMENDATION:
That Council release George Litnewski and Anne Litnewski, their successors and assigns, being the
owners of land municipally described as 2347 Mewbum Road, from the requirements and provisions
of a Cost Share Agreement dated April 11, 1994 and that the Mayor and Clerk be authorized to
execute any documents necessary for the purpose of releasing the parties and terminating the
agreement.
BACKGROUND:
In 11994 George and Anna Litnewski entered into an agreement with the City for the purpose of
sharing the cost of construction and installation of a 12 inch watermain in front of their property
located on Mewbum Road.

Since financial obligations, with respect to this agreement, have been met to the satisfaction of the

WHEREAS the Provincial Government has proposed the creation of Smart Growth
Management Councils; and
WHEREAS Niagara has established its own Smarter Niagara Steering Committee (i.e. the
Co~xanittee) with cross-community representation; and
WHEREAS the Ministry of Municipal Affairs and Housing (i.e. the Ministry) has determined
that it would conduct only limited consultation with a select few representatives from Niagara
on the form and function of the proposed Smart Growth Management Councils; and
WItEREAS the Committee and individual representatives from Niagara have repeatedly
advised the ministry that there is no need to establish the Smart Growth Management Councils;
and
WttEREAS the Ministry is proposing to establish the Smart Growth Management Councils
despite the failure to establish need; and
WItEREAS Niagara has already established meaningful linkages for coordinating Smart
Growth directions in Ontario and in Western New York;
NOW THEREFORE BE IT RESOLVED THAT the Council of the City of Niagara Falls
opposes the creation of a Ministry-mandated Smart Growth Management Council for Niagara.
