Diodati and Members of the Municipal Council City of Niagara Falls SUBMITTED BY: Finance Department SUBJECT: F- 2012 -27 Niagara Falls Soccer Club Indoor Facility Update RECOMMENDATION That the City's funding assistance for the proposed Indoor Soccer Facility be withdrawn. EXECUTIVE SUMMARY The City of Niagara Falls had previously committed to provide funding assistance to the Niagara Falls Soccer Club's proposed indoor soccer facility. This funding included a contribution of $1 million toward the construction costs, the waiving of building and development charge fees of $405,490 and capital improvements of $174,000. As a condition of establishing an agreement with the City, the Club was required to provide documentation to the satisfaction of the City that all project financing has been secured and mortgage arrangements are in place. At the time of this report, this information has not been provided. In addition, the City faces significant capital reinvestment requirements in its existing infrastructure. This project would require the use of funding otherwise required to meet these reinvestment needs. Tonight's agenda includes the 2012 Capital Budget. This project nor the associated infrastructure improvement requests have not been included in the budget. As a result, staff recommend that Council withdraw its proposed funding support. BACKGROUND On June 13, 2011, Council approved report MW- 2011 -25, which outlined the City's collaboration in the proposed facility. In August 2011, Council provided staff with conditions on establishing an agreement for its collaboration with the organization (CAO- 2011-04). In addition, Council requested that the details be provided on the tendering process for the project to ensure its compliance with municipal practices. At present, the documentation requested regarding financing has not met the conditions of the latter report. Specifically, condition 7, requires that the organization provide documentation to the satisfaction of the City that all project financing has been secured and mortgage arrangements are in place. Originally, staff received a discussion paper from a potential financial institution, however, the document included municipal guarantees of the project's debt obligation. Staff advised the group that guarantees were not part of the Council motion. Staff requested that funding documentation be provided without municipal guarantees. To date, this has not been received. May 29, 2012 - 2 - F- 2012 -27 FINANCIAL IMPLICATIONS Municipal staff in many departments have worked with the proponents of the organization in attempt to ensure the project's viability. As Council knows, staff face numerous capital reinvestment requirements. In fact, capital reinvestment needs exceed available funding as was evidenced by staff's efforts in compiling a 10 -year needs estimate. The 2012 Capital Budget proposed this evening is a composite of municipal priorities and project readiness. This project was approved in principle last summer, but since the required funding documentation is not ready, staff did not include it in this year's Capital Budget. That the City support the Niagara Falls Soccer Club proposal in principle; and, 2. EXECUTIVE SUMMARY At its meeting on February 28, 2011, City Council received a presentation from the Niagara Falls Soccer Club (NFSC) outlining their plans to construct a new $4 million dollar indoor soccer facility on lands they have recently acquired on Swayze Drive. Council directed staff to meet with the proponents to clarify the terms of their proposed 50 -50 partnership with the City and to confirm the club's intentions with their current facility located at E.E. Mitchelson Park. Staff met with the proponents to finalize the specifics of the NFSC's request and received a letter which is attached to this report for your reference. The proposed indoor facility has not been identified in the Recreation Strategic Plan nor has any funding been set aside in the five year Capital Forecast for this project. Council is aware of the growing financial challenges of trying to fund those projects which already have been identified as needs in the short term. By advancing this project the City is committing to a project that would be delaying an identified project or if added on prior commitments may result in an increase in debt and /or tax levy increase. Staff respect the efforts of the proponents and their vision but cannot recommend the City make a financial commitment. Instead, we are proposing to provide in -kind services and technical support. Staff are also recommending that we assist the NFSC in obtaining third party funding through the P3 Canada Fund in an effort to address the funding challenges associated with the project. BACKGROUND The Niagara Falls Soccer Club is working towards providing an indoor facility where local soccer players can train, practice and play year round. Their goal is to continue to develop MW- 2011 -25 -2- June 13, 2011 elite local players and to enhance the skill level of new players. Local players currently travel to Stoney Creek and facilities located in New York state to train during the off season. Ontario communities such as Stoney Creek, Oakville and Vaughan have indoor soccer facilities. The facilities range from privately built and owned to municipal private /public partnerships. The Club is in the process of conducting a Capital Campaign to increase awareness of their project and fund raising opportunities. The executive has presented their proposal to local business to promote naming and sponsorship opportunities for the new indoor soccer facility. Local sport organizations including Greater Niagara Baseball Association (GNBA), Niagara Falls Minor Football have confirmed they support and are interested in using space at the new facility as listed in attachment #2. Other local sport organizations Niagara Regional Athletics and Niagara Falls Lightning gymnastics have inquired about the project and future opportunities. ANALYSIS /RATIONALE Playing Field Re- location Request NFSC are currently based at the E.E. Mitchelson Park clubhouse. With the proposed new facility at Swayze Drive, they are requesting that the M.F. Ker Park ball diamonds be switched with E.E. Michelson Park soccer fields, thereby allowing NFSC easier access to soccer fields from their new home base. E.E. Mitchelson Park consists of four soccer pitches and a lit senior pitch /football field shared with St Paul High School. An informal ball diamond is also shared with Notre Dame Public School. A Hydro corridor runs through the center of the park. M.F. Ker Park consists of four senior ball diamonds (one lit) as well as a soccer /football field. GNBA and Mens Fastball are the major users of the ball diamonds. Staff are recommending the fields stay status quo. There is minimal city owned property at E.E. Mitchelson Park, due to the soccer /football field being half on St Paul High School property, as well the informal ball diamond located partially on Notre Dame School property. The Hydro wires located at E. E. Mitchelson would not be conducive to ball play. Even with adequate property, the switching of fields between M.F. Ker and E.E. Mitchelson would not be feasible due to the costs involved to construct all new fields at both parks. There is also limited parking at E.E. Mitchelson Park. The new fields would require a two year re- building time in order to allow the turf time to mature. The current users at both parks would not be able to use the playing fields during this re- construction period. Hydro Corridor Lease The NFSC requested that additional parking be located to the south of their proposed complex on Hydro land and that the City pay the annual license fee if applicable. The City leases Hydro property from Sinnicks Avenue to Swayze Drive for parking at MF Ker Park. The annual license fee is $7,980. Additional parking on the hydro lands north of Swayze will result in an increase in the annual license fee of approximately $2,000. The actual fee would be calculated according to the size of hydro lands that would be used for parking. MW- 2011 -25 NFSC Proposal -3- June 13, 2011 The NFSC proposes to construct a 4287 square metre indoor soccer facility on a 1.3 hectare site located on the north side of Swayze Drive, between Stanley Avenue and Heritage Drive. The site was recently declared surplus by the City and sold by public auction. The site is bounded by an active Canadian National Railway line to the east, and an Ontario Hydro corridor to the west. The northerly third of the site is a wooded valley that must be preserved and buffered. The subject lands are zoned Open Space (OS) in accordance with Zoning By -law No. 79- 200, as amended. While the indoor soccer facility is a permitted use, the proposal requires relief from a number of zoning regulations. For example, the building is proposed within 6 metres of the front lot line, whereas the standard front yard setback is 10 metres. Further, the building is proposed within 6 metres and 9 metres of the side lot lines, whereas interior side yard setbacks of 10 metres are required. Additional departures include a lot coverage of 34 %, whereas 10% is permitted: a building height of 14.63 metres, whereas 10 metres is permitted: and the provision of 65 on -site parking spaces, whereas 107 on -site parking spaces are required. One option to provide the required number of parking spaces would be for the club to enter into a long term lease with Hydro One to provide the balance of the required parking spaces. Entering into a long -term lease to provide the balance of parking in the park across the street is another option, but raises a number of safety issues. A zoning amendment would be required to allow the various departures from the standard provisions of the OS zone and to "marry" the subject site with the land to be used for the balance of the required parking. The City of Niagara Falls Strategic Plan for the Provision of Parks, Recreation, Arts & Culture reviewed the City's outdoor playing fields and indoor facilities to determine future indoor and outdoor facility needs. Facility needs were determined on actual use, anticipated future use and broader activity trends. Outdoor sport facilities determined the following: . City should not provide any additional baseball or softball diamonds City should provide five (5) additional soccer fields, one for present need and four (4) for future needs (P. Cummings: one (1) soccer and one (1) multi purpose — 2012) City should provide one (1) football field (MF Ker Park, 2012) City should provide two (2) rugby fields (one (1) multi purpose — P. Cummings — 2012) City should accommodate emerging sports interests on outdoor multi - purpose and artificial turf fields City should consider providing outdoor artificial turf facility examining possible partnership opportunities (Kalar Road Sports Complex, 2008) As stated in the Strategic Plan there is support and demand for outdoor artificial turf fields. The Recreation & Culture department does support the future development of an artificial turf field at E.E. Mitchelson field #1. The cost of the new field could be shared by the Niagara Falls Soccer Club, the Niagara Catholic District School Board (St. Paul) and the City of Niagara Falls. MW- 2011 -25 FINANCIAL IMPLICATIONS -4- June 13, 2011 The total facility cost is approximately 3.8 to 4 million dollars. If the City partnered 50/50 on this facility the contribution would be approximately two million dollars. This project was not budgeted in the 2011 Capital budget and the City does not have the funds to partner nor has it the City's practice to partner on private facilities. If City Council approved funding for this project it would have to borrow the money defer an approved 2011 capital project or commit funding from the 2012 Capital Budget. If significant City dollars are contributed to this project, staff recommend the facility and land become City owned with the facility operation and maintenance the responsibility of the Niagara Falls Soccer Club. The existing Niagara Falls Soccer Club clubhouse is located at E.E. Mitchelson Park on City property and is a City owned building. The E.E. Mitchelson Community Clubhouse and athletic field development was completed in 1994. The City and Niagara Falls Soccer Club each contributed $260,000.00 (50% of costs) towards the project. The City can consider waiving of its development charge fees, site plan processing fees and building permit fees. The Niagara Falls Soccer Club can apply to register their Club to become a registered charity. If the Club has registered charity status or if City owned property they are exempt from paying City property taxes. CITY'S STRATEGIC COMMITMENT The City of Niagara Falls' Strategic Plan for the Provision of Parks, Recreation, Arts and Culture does not support the City building an indoor turf facility. Financial Stability is a strategic priority that directs staff to ensure resources are focused on core City programs and services. To partner with the Niagara Falls Soccer Club and invest approximately two million in a private recreation facility does not adhere to the City's financial priorities. LIST OF ATTACHMENTS 1. Diodati and Members of the Municipal Council City of Niagara Falls SUBMITTED BY: Chief Administrative Officer CAO- 2011 -04 August 15, 2011 SUBJECT: CAO- 2011 -04 Niagara Falls Soccer Club Indoor Facility - Project Update RECOMMENDATION That staff be directed to proceed with the preparation of the Agreement between the Niagara Falls Soccer Club (Club) and the City of Niagara Falls (City), in accordance with the provisions contained in the report. EXECUTIVE SUMMARY At its June 1 3th meeting, City Council approved a $1 million contribution to the development of Niagara Falls Soccer Club's proposed soccer facility, along with the waiving of certain municipal fees. At the same meeting, Council endorsed staff making an application to the federal government intake of P3 applications. Council approved contribution to the project in two manners. Firstly, Council approved the waiving of fees associated with the development as well as serving extensions required. These changes are identified as outlined on Appendix "A ". Secondly, Council approved an advance of $1 million during construction. This advance is refundable based on a successful result of the City's P3 application. At the present time, staff has not received notice of whether the application has been approved. It should be noted, that should the application not be approved, the advance would become a grant to the project. Staff has outlined funding options for Council should this materialize. This report provides an update of the status planning and site servicing issues. Staff indicates that a public meeting regarding zoning matters on this project will be necessary later this year. In addition, staff is working with Club officials to complete an agreement for the funding of the facility and the conditions regarding the advancement of construction financing. Council's consideration of this agreement will be provided in conjunction with the planning application; however, the following are the details that will formulate the basis of the agreement. 1) Council will advance the $1 million contribution only at such time as funding under the Federal Government P3 application has been determined. 2) Council will require that, in the event the $1 million is provided to the Club, a charge be placed on title for 20 years, requiring a prorated repayment to the City, should the property be sold. August 15, 2011 - 2 - CAO- 2011 -04 3) The Club will have sole responsibility for total the cost of operations, maintenance of the building and any future capital improvements to the building and parking areas. 4) The Club will be responsible for the payment of property taxes, subject to a final determination by MPAC related to the Club's charitable status. 5) The $1 million payment will be advanced to the Club in stages to coincide with the progress of the construction (i.e., 25% at permit issuance, 25% at building being enclosed, 25% at substantial completion, 25% at occupancy). 6. The signing of the agreement and forwarding of any monies is subject to the final approval of all planning and zoning processes required by the Club on this site. 7 The advance of any funds is subject to the Club providing documentation to the satisfaction of the City that all project financing has been secured and mortgage arrangements are in place. BACKGROUND This report is provided to Council as an update of the project status of the Niagara Falls Soccer Club Indoor Facility. Since Council approved a City contribution of a $1 million advance in conjunction with the waiving of certain fees, staff has been meeting with officials of the Club to ensure the project progresses. Staff has applied for a P3 grant under the Federal Infrastructure Program and the success of that application is not known at this time. It is anticipated that the decision on this application will be known later in the year. Staff in various departments has contributed to this report. The original staff report, MW- 2011 -25 has been attached. ANALYSIS /RATIONALE Staff from various departments is involved in this project. This section updates Council on each area. Planning The final application form for rezoning has been submitted by Niagara Falls Soccer Club. The application will address a reduction from prescribed building setbacks and to accommodate off -site parking. Planning, Building and Development has requested further revisions to the preliminary site drawing necessary to accompany the zoning amendment application. The revisions should address a need for a further 37 parking spaces (to meet prescribed parking ratios) and a shift in the location of the westerly driveway. The addition of 37 parking spaces will necessitate a larger land area within Ker Park which could affect the outfield of the ball diamonds and will necessitate the cutting of some trees (removal of trees could be met by public opposition and will not be known until the public meeting). A traffic study to support the rezoning is yet to be submitted. A tree survey has been submitted to address the woodlot at the north end of the soccer club property; Planning is waiting for the Conservation Authority to confirm whether this study addresses the NPCA interests or whether further information (scoped study) is necessary. Drawings to complete the Site Plan Application process showing turning movements for garbage trucks have not yet been received; the landscape plan for the site plan application has been promised for a later date and will be needed in order to complete the processing of this application. August 15, 2011 - 3 - CAO- 2011 -04 While it is recognized, everyone is working within a compressed time frame for processing, Planning will still require approximately three (3) weeks to schedule and hold a neighbourhood meeting with the public and a further five (5) weeks to give statutory notice of the Public Meeting before City Council, secure the comments of all agencies and departments and prepare a report. An early October Council date would be difficult to achieve given the outstanding matters mentioned. Recreation & Culture The Club is currently based at the E.E. Mitchelson Park clubhouse. With the proposed new facility at Swayze Drive, they are requesting that the M.F. Ker Park ball diamonds be switched with E.E. Mitchelson Park soccer fields, thereby allowing the Club easier access to soccer fields from their new home base. E.E. Mitchelson Park consists of four soccer pitches and a lit senior pitch /football field shared with St Paul High School. An informal ball diamond is also shared with Notre Dame Public School. A Hydro corridor runs through the centre of the park. M.F. Ker Park consists of four senior ball diamonds (one lit) as well as a soccer /football field. GNBA and Mens Fastball are the major users of the ball diamonds. Staff is recommending the fields stay status quo. There is minimal city -owned property at E.E. Mitchelson Park, due to the soccer /football field being half on St Paul High School property, as well the informal ball diamond located partially on Notre Dame School property. The Hydro wires located at E.E. Mitchelson would not be conducive to ball play. Even with adequate property, the switching of fields between M.F. Ker and E.E. Mitchelson would not be feasible due to the costs involved to construct all new fields at both parks. There is also limited parking at E.E. Mitchelson Park. The new fields would require a two - year rebuilding time in order to allow the turf time to mature. The current users at both parks would not be able to use the playing fields during this reconstructing period. Municipal Works The detailed concerns from a Municipal Works and Parks perspective are being dealt with through the Site Plan Review process. Staff is currently reviewing the preliminary proponent submission of the Site Plan, Site Grading and Servicing Plan, and Site Lighting Plan. Their detailed comments with respect to the review will be forthcoming. In general, the following items have been identified as considerations with respect to the proposed development: 1. The proposed use of and modifications to the existing adjacent to the Ker Park Parking Lot for off -site parking purposes must be assessed to determine the potential impacts on operations at the Ker Park Ball Diamonds. Also significant improvements to the parking lot would be needed to address condition, lighting, safety, access, drainage, and pedestrian and vehicle movement to and from the proposed facility. Responsibility for Winter Maintenance of the improved parking lot will be the responsibility of the Club, as it is currently closed during the winter months. The capital costs of the lighting and parking lot and the responsibility of operational costs will be determined in a future agreement with the Club. August 15, 2011 - 4 - CAO- 2011 -04 2. In terms of servicing requirements, there will be a requirement to extend some existing municipal servicing along Swayze Drive to the proposed development. The existing watermain will need to be extended across the frontage, along with provision of a new sidewalk and streetlighting enhancements. FINANCIAL /STAFFING /LEGAL IMPLICATIONS On June 13, 2011, Council approved contributions to this project in two areas. First, Council approved waiving of applicable fees, including City development charges along with site servicing charges normally charged in projects of this nature. Staff has worked with the Club officials and has determined that the costs amount to an estimated $579,490. The various charges are listed in Appendix A. It should be noted that the waiving of the Regional development charges is a decision of Regional Council and that soccer club officials will be petitioning the Region in this regard. The second area of contribution was a $1 million payment by the City to the Niagara Falls Soccer Club for the construction of the facility should the P3 application not be approved by the Federal Government. This advance will coincide with an application by the City to the Federal Stimulus Initiative (P3). If the application is successful, the City's contribution would be limited to the forfeiture of applicable fees and charges listed in Appendix A. If, however, the application is not successful, the advance of $1 million would be considered a grant to the project. Once the status of the application is known, staff will report to Council and seek direction on the funding source. The options in funding include three options: i) debenture issue ii) an increase in the 2012 General Purposes Budget contribution to capital of $1 million to $5.9 million from $4.9 million iii) the use of the capital /operating reserve for the full amount Staff will recommend to Council the optimal funding source once a decision on the P3 application is received and when Council has considered its 10 -year Capital Needs Plan. Staff has met with Club officials and has received 2008 -2010 audited Financial Statements, a project construction budget, a projected 2012 operating income statement for the proposed facility and an indication from officials that construction financing and long term financing of the facility is being finalized with its lending institution. It is understood by the group that property taxes would be charged on the facility unless the group was to receive exempt status by MPAC under the applicable legislation of the Assessment Act of Ontario. Soccer Club Officials have indicated they are awaiting confirmation from CRA on the club's charitable status. Finally, Club officials understand that a formal agreement with the City is required to clarify the advancement of money, including timing through construction. Likewise, it is understood that should the City's P3 application not be approved and the City's $1 million advance becomes a grant, that the City would require a lien on title for this amount for an agreed term similar to other projects, notably the Boy's and Girl's Club. We have been working with other historical organizations in promoting the event. The Niagara Falls 1812 Committee has approved our event and we are able to use their logo in our promotions. We will celebrate the 100th anniversary of the bells in 2012.The bells have been silent for five years due to the age and deterioration of materials used in chiming. We have been working for over two years to raise $65,442.00 to install new clappers on the bells and a new chiming system that will allow the bells to be chimed manually or by computer. The 100th anniversary falls in the same year as the Bicentennial of the War of 1812 and we will celebrate both at the event. The music of the bells is a community instrument to be played daily and on special days such as Canada Day and Remembrance Day. The bells chimed to celebrate the end of two World Wars and the coronation of Queen Elizabeth who celebrates her Diamond Jubilee this year. Christ Church bells are the only ten bell chime in the city. We are requesting the closure of Zimmerman Avenue from River Road to Morrison Street. The street closure will benefit the event planned as we are looking forward to a good turnout. We cannot afford the fee required as we have limited funds for the event. The event has an International aspect in celebrating 200 years of peace between Canada and the United States. Mayor Paul Dystra of Niagara Falls, New York, Mayor James Diodati, Hon. Rob Nicholson MP, Kim Craitor MPP and Janice Thomson will speak at the event. We have made arrangements with a church in Niagara Falls, New York to ring their bells with our bells. EXECUTIVE SUMMARY A complaint was received by the Ombudsman Ontario, the de facto closed meeting investigator for the municipality, regarding the closed meeting of October 4, 2011. Due to the nature of the complaint, the Ombudsman's Office reviewed the December 12, 2011 and January 24, 2012 closed meetings, which were related to the same topic. The Ombudsman's office has provided suggestions on best practices for closed meetings, which staff has started to implement. Ombudsman Ontario will not be pursuing a further review of the complaint. BACKGROUND The Municipal Statute Law Act passed by the Provincial government in late 2006, saw a number of amendments to the Municipal Act pertaining to openness and transparency. Section 239.1 of the Municipal Act required municipalities to appoint a closed meeting investigator. If a municipality chose not to directly appoint a closed meeting investigator, the Provincial Ombudsman's office would perform the role of the closed meeting investigator. Although Niagara Falls City Council, like many municipalities, originally hired LAS (Local Authority Services Ltd.)to perform this service, in 2008, the Council passed a motion to terminate the arrangement. As a result, any complaints on closed meeting matters for Niagara Falls City Council are handled by Ombudsman Ontario. Ombudsman Ontario has a simple form for closed meeting complaints which asks the complainant to identify the Council or board in question and why the complainant believes the meeting should not have been closed to the public. Ombudsman Ontario will informally try to resolve the complaint. If an informal resolution is not possible, an investigation will be launched. Complainants' identities are kept anonymous. ANALYSIS /RATIONALE Ombudsman Ontario received a complaint regarding the Council's closed meeting session for October, 3, 2011. Through the discussions with the Early Resolution Officer, a review was also undertaken of the closed meeting sessions for December 12, 2011 and January 24, 2012, which had related subject matter. May 29, 2012 - 2 - CD- 2012 -05 The Ombudsman's Office has concluded that the Council was not incorrect in going In Camera for the three sessions, however, they have provided some best practices suggestions for the future. Staff has begun to implement these best practices or will do so in the future: ✓ Staff have already begun to incorporate the resolutions to go In Camera into the Council minutes (cf. April 24, 2012 minutes). ✓ The closed meeting resolutions and committee schedule will be scanned as part of the Council agenda and highlighted on the Council meeting page of the City's website. ✓ The Closed Meeting /ln Camera minutes will note the staff that are present at the session. ✓ Staff will bring forward amendments to the Standing Rules of Council By -law (89- 155, as amended) to reflect Council's In Camera procedures. ✓ Staff will be more cognizant of rising and reporting on substantive matters emanating from the Closed Meeting sessions. The complaint alleged that the meeting was improperly closed to the public and a decision was reached in the meeting to ban a member of the public from future council meetings. As you know, the Municipal Act requires that all meetings of Council, local boards, and committees of council are open to the public, with limited exceptions. Our Office is the closed meeting investigator for the City of Niagara. In reviewing the complaint, our Office spoke with you and reviewed the agenda and minutes for the October 3 closed meeting as well as the December 12, 2011, and January 24, 2012 closed meetings in which the same matter was discussed. In addition, our Office reviewed the relevant By -Laws, procedures, and sections of the Municipal Act, 2001 (the Act). October 3, 2011 meeting According to the City's Procedure By -Law (No. 89 -155) Council meetings are held at 6:00 p.m. on the dates confirmed in the Schedule available on the City's website. Based on the information provided, Council held a closed meeting at 5:00 p.m. on Monday October 3, 2011 prior to the regular meeting of council. The Agenda for the October 3, 2011 meeting did not indicate that a closed meeting was scheduled for 5:00 p.m. You explained that Council's practice is to pass a resolution to hold a closed meeting and announce it at the Committee of the Whole meetings, which are public meetings that typically take place approximately one hour prior to the closed meeting and the following regular meeting of Council. When the resolution is passed to hold a closed meeting it is added to the Agenda package, which can be over 100 pages in length. The Agenda package is distributed to Council, staff, and some members of the media. The exception cited in the written resolution for holding the in- camera meeting on October 3 was to seek advice that is subject to solicitor- client privilege pursuant to s. 239 (2) (f) of the Municipal Act. While the public meeting minutes for October 3, 2011 mention that a closed meeting was held at 5:00 p.m., the minutes do not provide any information about the nature of the topic(s) discussed in closed session or the exception under the Act authorizing the in- camera meeting. According to the Minutes of the in- camera meeting, the matter considered involved security concerns about a member of the public. You advised that the Solicitor was present at the meeting and Council sought his advice about what action to take to address the issue. The in- camera minutes do not specifically mention that the Solicitor was present but indicates, "All present ". The minutes show that Council voted on whether or not to direct the Solicitor to take certain legal action to address security concerns, which was defeated. According to the Minutes, the vote was taken under s. 239 (6) (b) which states, ....a meeting may closed to the public during a vote if, ... Ombudsman ONTARIO (b) the vote is for a procedural matter or for giving directions or instructions to officers, employees or agents of the municipality, .... December 12, 2011 and January 24, 2012 The information provided indicates that Council also met on December 12, 2011 and January 24, 2012 to discuss the security matter mentioned above. Notice of the closed meeting was provided in the same manner as the October 3, 2011 meeting - a resolution was passed and announced at the Committee of the Whole meeting held just prior to the closed session and the regular meeting of Council. The written resolution was then included in the Agenda package. For both the December 12 and January 24 closed meetings, the exception cited for holding the discussion in camera was, "security of the property of the municipality" pursuant to s. 239 (2) (a) of the Act. You said that the meeting was also closed in order to seek advice subject to solicitor - client privilege and that the City Solicitor was present at these meetings. The publicly available minutes for the December 12, 2011 meeting do not mention that a closed meeting took place. While the January 24, 2012 minutes confirm that Council held a closed meeting at 4:00 p.m. prior to the regular Council meeting, they do not provide any information about the nature of the in- camera session or the exception authorizing the closed meeting, Councillors voted again at the December 12 and January 24 meetings about whether to direct the Solicitor to take certain action. A confidential report outlining recommended actions was considered at the January 24 meeting and Council voted to approve certain security measures but did not report back on that particular issue in the public meeting that followed. Findings and Procedural Recommendations As discussed, although the security issue described appears to be a topic Ombudsman O N T A R I O appropriate for in- camera discussion, we identified a number of procedural issues and provided some suggestions regarding best practices for future meetings. Under the Municipal Act, the Municipality's Procedure By -Law "shall provide for public notice of meetings." Although you advised that the City's practice is to provide notice of Council meetings by posting an agenda on the website on the Wednesday or Thursday prior the Council meeting, the agenda document that is posted does not include notice of the closed meeting. The first public notice of the closed meeting occurs during the Committee of the Whole meeting approximately one hour prior to the closed session. Given the City's practices, the public would have to be present at the Committee of the Whole meeting in order to be aware that a closed meeting is to be held later that day. While the Municipal Act does not specify the content of public notice, our Office suggested that the agenda that is posted on the City's website include advance notice of closed meetings, the exception under which the meeting is being closed, and the general nature of the matter to be discussed. The Ombudsman has suggested that, in order to provide for public notice, items only be added to an agenda after it is posted to the public in limited and urgent circumstances and then, only after procedural formalities have been observed. Since the City's Procedural By -Law did not include the City's closed meeting procedures, including a public notice provision, Council should consider amending the Procedure By -Law to include this information. Further, in the interest of transparency, we suggested that the open meeting minutes confirm not only that the closed meeting was held but the nature of the closed meeting and the exception cited for closing the meeting to the public. Council should generally also rise and report publicly after the completion of each closed meeting and indicate that in the public minutes. With respect to the December 12, 2011 closed meeting, the public minutes do not make any reference to the closed meeting. 0) Ombudsman ONTARI0 Under the Municipal Act, meetings may be closed to the public if matters to be discussed involve security of the property of the municipality. Although the Act does not define 'security of the property', the Information and Privacy Commissioner has considered the meaning of the term and in a 2009 decision' which stated in part, In my view, 'security of the property of the municipality' should be interpreted in accordance with its plain meaning, which is the protection of property from physical loss or damage (such as vandalism or theft) and the protection of public safety in relation to the property. During our discussion you agreed that the subject matter discussed in the closed meetings did not involve security of the property and that the more appropriate exception would have been "personal matter about an identifiable individual" (s. 239 (2) (b)) and /or "to seek advice that is subject to solicitor client privilege" (s. 239 (2) (f). As noted, voting is prohibited in closed meetings unless the meeting is appropriately closed under an exception under the Act and "the vote is for a procedural matter or for giving directions or instructions to officers, employees or agents of the municipality..." In regard to the votes taken in the October 3, 2011, December 12, 2011, and the January 24, 2012 closed meetings, they are described as votes to direct the City Solicitor to take certain legal action and /or direction to staff. However, the January 24, 2012 in- camera minutes indicate that Council considered a number of security measures and voted to implement a number of those options. Although staff would be involved in the implementation, the underlying decision to adopt those measures may be viewed as substantive in nature and, therefore, more appropriate for the public meeting. EXECUTIVE SUMMARY The municipality must have the annual tax rates approved prior to providing rate payers with final tax bills. The 2012 General Purposes Budget was approved on March 27, 2012. The annual general levy of $54,074,717 was approved at this time. The City's tax rates included in this report reflect the approved general levy. The regional, school and waste management rates have been provided by the responsible level of government and are also included in the schedule. BACKGROUND The Regional Municipality of Niagara has approved the 2012 tax ratios and tax rates. In addition, the Province of Ontario has established educational tax rates for 2012. The City is now in the position to establish its tax rates and to proceed with the Final 2012 Billing for the non - capped property classes. This report provides for Council, the City's 2012 property tax rates. FINANCIAL /STAFFING /LEGAL IMPLICATIONS The 2012 tax levy is $54,074,717 ($51,277,139 for 2011). The General taxation portion of this total levy is $46,923,400 ($44,495,798 for 2011); the Urban Service Area taxation portion is $7,151,317 ($6,781,341 for 2011). Corresponding tax rates based on these levies are provided in Table 1. The effective tax rates are 0.03% lower than the rates approved for 2011. The Region of Niagara provides waste management services for the residents of Niagara Falls. The Region has provided the costs of this service for 2012 to the City. The annual cost used to determine the rates for 2012 is $6,707,715 ($6,707,348 for 2011). To fund this expense, the City collects the taxes from the residents using a separate tax rate. Table 2 provides a comparison of the waste management tax rates used in 2011 to the recommended rates for 2012. May 29, 2012 - 2 - F- 2012 -23 The Appropriations and Levying By -law is prepared for Council's adoption, should Council approve the recommendation. This By -law authorizes the preparation and sending of Final Tax Notices. Appendix A of the By -law shows the summary of tax rates for each classification and for all levies. EXECUTIVE SUMMARY The due dates for final tax billing must be approved by Council pursuant to the Municipal Act. The City has established that due dates for the non - capped property classes are June 29 and September 28. The due dates for the capped classes are August 31 and October 31 due to the additional calculations required for these billings. BACKGROUND The City of Niagara Falls is responsible for billing and collecting property taxes on all assessable properties within the municipality. These annual billings include the annual taxes for the City, for the Region of Niagara and for the appropriate local school boards. Due dates for property taxes are set to coincide with the quarterly levy payments made to the Region and the school boards. FINANCIAL /STAFFING /LEGAL IMPLICATIONS Due to the additional calculations required to prepare the 2012 Final Tax Notices for the Commercial, Industrial and Multi- residential property classes, all assessment classes cannot be billed at the same time. Staff is therefore recommending that the Final Tax Notice Due Dates for the Residential, Pipeline, Farmland and Managed Forest Assessment Classes be set as June 29 and September 28. Once the additional calculations for the remaining classes have been determined then final tax notice due dates for the Commercial, Industrial, and Multi- residential property classes will be presented for Council's consideration. EXECUTIVE SUMMARY This report is prepared monthly to provide Council with an update on the City's property tax receivables. Outstanding taxes as of April 30, 2012 were $28.9 million compared to $31.1 million in 2011. During April, tax receivables as a percentage of taxes billed decreased from 39.2% in 2011 to 36.1% in 2012. The City's finance staff has had continued success in resolving properties that are subject to registration for 2012. At this stage, 70.7% of properties have developed payment arrangements or have paid in full. There are currently sixteen properties scheduled for tax sale in the next two years. BACKGROUND This report is being provided as part of the monthly financial reporting to Council by staff. It is also submitted to our banking institution for compliance with our banking agreement. ANALYSIS /RATIONALE Tax collection for 2012 improved during the month of April. Table 1 shows that taxes outstanding at April 30, 2012 are $28.9 million. This represents a decrease from $31.1 million in arrears for the same period in 2011. Finance staff continues to actively pursue property owners in arrears. Table 2 provides the breakdown of outstanding taxes by assessment class. The majority of outstanding taxes are for residential and commercial properties. The chart shows that the taxes owing from the commercial property class have decreased from a year ago, whereas the residential property class has increased. Finance staff takes specific collection actions for properties that are subject to registration. These action steps have been outlined in previous reports. At January 1, 2012, 403 properties were subject to registration. Table 3 summarizes the progress of these actions after four months of activity. This table shows 70.7% of the tax accounts or 285 properties have been paid in full or the owners have made suitable payment arrangements. During April, eleven accounts were paid in full. In addition, the number of accounts with suitable payment arrangements including full payments increased from 66.5% (March) to 70.7% (April). May 29, 2012 -2- F- 2012 -25 Finance staff continues to make every effort to have accounts paid in order to avoid the registration process and the associated costs related to that process. Table 4 identifies the properties and associated tax arrears scheduled for tax sales in the future. During the month of April, three registered properties were redeemed. The outstanding taxes for registered properties represent 2.6% of the total outstanding taxes at month end. FINANCIAL /STAFFING /LEGAL IMPLICATIONS Tax arrears as a percentage of taxes billed in a year is a performance measure that stakeholders utilize to analyse an organization's financial strengths. Niagara Falls, due to its high reliance on commercial assessment, is traditionally higher compared to municipalities of similar size. The percentage of taxes outstanding to taxes billed as at April 30, 2012 is 36.1 % which is a decrease from 2011's value of 39.2 %. The municipality has a record of full collection and earns significant penalty revenues to offset the higher measure. That the City of Niagara Falls recognize the portions of the trail route for the Laura Secord Commemorative Walk through Niagara Falls as the Laura Secord Commemorative Trail. 2. That capital budget of $8,500 for trail improvements be established. EXECUTIVE SUMMARY The Laura Secord Commemorative Walk and Trail are part of the bicentennial celebrations for the War of 1812. Approval of the recommendations is needed to support the establishment of the 4km Niagara Falls section of the proposed 32km Laura Secord Commemorative Walk and Trail. A capital budget of $8,500 is required for necessary improvements to the section of trail within Mewburn Park. The improvements will be undertaken by City operational staff, and contractors in partnership with Habitat for Humanity and Unilever PLC. BACKGROUND The Friends of Laura Secord approached Mayor Diodati for the support of the City of Niagara Falls through a letter dated December 8, 2011 regarding the proposed Laura Secord Commemorative Walk and Trail. See attachment #1. This matter was referred to City staff for follow -up. As part of the bicentennial celebrations of the War of 1812, The Friends of Laura Secord are in the process of organizing the Laura Secord Commemorative Walk on June 22, 2013. The 32km long Laura Secord Commemorative Walk will closely recreate the June 22, 1813 - journey of Laura Secord from the Secord homestead in Queenston to the Decew House in Thorold. See attachment #2 and #3. To allow for the Laura Secord Commemorative Walk event and establish a legacy, the Friends of Laura Secord are endeavouring to establish a permanent family - friendly hiking trail along the commemorative walk route. The planned hiking trail travels through four (4) municipalities are dependent upon the facilitation of partnerships, as well as numerous private and public stakeholders. The portion of the proposed hiking trail within the City of May 29, 2012 - 2 - MW- 2012 -27 Niagara Falls is approximately 4km long and skirts the north City boundary. The proposed Niagara Falls section of the hiking trail generally follows the existing Bruce Trail extending from St. Paul Avenue travelling west through Firemen's Park, Mountain Road Landfill Site, Mewburn Park and across the QEW Pedestrian Bridge to Warner Road. See attachment #3. On May 9, 2012, City staff was contacted by Habitat for Humanity in partnership with Unilever PLC to see if we had any potential community -based projects for a volunteer build project. The Mewburn Park section of the Laura Secord Trail was identified as a prime candidate for this volunteer build project. ANALYSIS /RATIONALE The Friends of Laura Secord are requesting the participation of the City of Niagara Falls in the Laura Secord Commemorative Walk and Trail through trail naming and trail improvements. The Friends of Laura Secord are requesting that the City of Niagara Falls name the portions of the proposed trail on City lands the "Laura Secord Commemorative Trail ". The Friends of Laura Secord have identified trail improvements that are needed for the section of the trail through Mewburn Park. As an undeveloped park, Mewburn Park has numerous drainage ditches along with trail rutting from ATV trespassing. To resolve these issues and create a safe hiking trail, five (5) drainage culverts are needed as well as site grading and other standard trail amenities. On June 19, 2012, rain or shine, Unilever PLC has committed to approximately 160 staff member volunteers to assist in the development of the Laura Secord Trail. The work being undertaken includes the following: spreading of soil and gravel on the trails, planting of trees, establishing seating areas and a general clean -up of the area. City staff and contractors will undertake some preparation works (including culvert and material placement) prior to the June 19th build day to ensure a successful project. Early the next morning, Laura left her wounded husband and young children and walked through enemy lines and dangerous terrain to warn the British and their aboriginal allies of this impending attack by American forces. After many hours of difficult travel on an exceptionally hot and humid day, she encountered an encampment of native allies who escorted her to DeCew House. The commanding officer, Lt. James Fitzgibbon, positioned his small contingent of troops and allied aboriginal forces at a strategic interception point along the route, and secured the surrender of nearly 60o American troops at the decisive Battle of 13eaver Danis. Without Laura Secord's bold contribution, Canada may not have existed as a nation today. Nearly 200 years ago, a young mother left her home early one morning and walked not only into history butinto the collective hearts of many who share the pride for this national heroine who risked her life in the defense of Canada. That the tender from Stevensville Lawn Services Inc. (Stevensville) for the Victoria Promenade Landscape Improvements in the amount of $222,015.00 (excluding HST) be approved. 2. Staff is recommending Contract # 2012 - 281 -12 Victoria Promenade Landscape Improvements be awarded to the low bidder, Stevensville Lawn Service Inc. The contract value is within budget forecasts. Timing of this construction work is critical to the Victoria Avenue BIA. As a result staff has advanced this project before the 2012 capital budget approval to ensure construction is completed with minimal impact on the 2012 peak tourist season. Site lighting improvements to the Victoria Promenade have been accounted for as part of the project budget. Due to design requirements as well as an anticipated lengthy lead time for ordering site lighting fixtures, it was determined to be advantageous to tender this work separately this summer for fall 2012 construction. This will ensure the least amount of impact along Victoria Avenue during the peak tourist season. May 29, 2012 BACKGROUND - 2 - MW- 2012 -31 The Victoria Promenade is an approximately 400m long recreational pathway that runs along the east boulevard of Victoria Avenue from Bender Street to Clifton Hill. The pathway was first constructed in 2003 and has recently been identified on the 2011 Transportation Master Plan as an important off a road bicycle route. Currently the Victoria Promenade has come under a great deal of stress from pathway users as a victim of it's own success. People heavily use the Victoria Promenade during peak tourist times to walk between destinations as well as by local residents for recreational purposes. Through this use the Victoria Promenade has experienced the following issues: large dirt areas due to foot traffic on certain grass areas, worn out benches and landscape beds with damaged plants. In addition, there are some isolated ponding and pavement settling that requires attention. To address these issues, City staff worked with representatives of the Victoria Avenue BIA to strike an action plan for the refurbishment of the Victoria Promenade. The plan that resulted includes the following works; refurbishment of existing plant beds, strategic expansion of plant beds to direct pedestrian traffic, expansion of paving areas to address pedestrian desire lines, turf improvements, additional benches, new picnic tables, bike racks and an irrigation system. In addition to these planned works, the design for the refurbishment of the Victoria Promenade will also include pedestrian bollard lighting with decorative tree lighting. ANALYSIS /RATIONALE One of the key aspects of the Victoria Promenade landscape improvements is the timing works and the potential negative impact on Victoria Avenue businesses during the peak tourist season. To address this issue, City staff has proposed to fast track this project before the final approval of the 2012 Capital Budget to ensure that construction can commence in June 2012 with a significant portion of the work completed prior to the peak tourist season. To accommodate this proposed time -line the design, supply and installation of lighting systems had to be deferred from the contract. The lighting systems would have delayed the design and construction works significantly. Pending capital budget approval, City staff will complete the design for the lighting systems and tender this work in the summer for fall 2012 construction - after the peak tourist season. A tender call was issued for the Victoria Promenade on May 8, 2012 with the closing on May 22, 2012. Three (3) bidders responded to the call as listed on Attachment #2. Staff completed a thorough review of each bid and found the bid submitted by Stevensville Lawn Service Inc. for the amount of $222,015.00 (excluding HST) was the lowest bid and met all necessary requirements. EXECUTIVE SUMMARY The Downtown has lost a number of businesses over the past couple of years. New residents living downtown is seen as a critical factor in supporting and keeping commercial uses. As a measure to help stimulate residential development and economic recovery within the Downtown, the Downtown BIA has suggested that the Residential Loan Program be changed to a Residential Grant Program. This program change is intended to encourage the renovation of older vacant apartments that have come under serious disrepair and vacant floor space above businesses in the Downtown. Staff recommends that there be a cap of $150,000 or 20 units in 2012 and a further $150,000 or 20 units in 2013. BACKGROUND On October 19, 2009, Council deferred part of Report PD- 2009 -63 recommending a change to the financial incentive programs for the Downtown which would have allowed Residential Grants along Queen Street and Erie Avenue. A further report was contemplated that would have seen a third party provide funding to cover the portion of May 29, 2012 - 2 - PD- 2012 -20 funds from the City. This latter proposal never proceeded to Council for their consideration. The Residential Loan Program has been available for seven years and only four applications have been approved within the Downtown area. As noted previously, the Downtown has lost a number of businesses over the past couple of years. It will be difficult to entice quality businesses to return to Downtown without generating more pedestrian traffic as many businesses are simply not sustainable with the limited amount of foot traffic now being experienced. Council has supported a number of initiatives in the past that have improved the appearance of Downtown. Not only have we seen a number of new facades and commercial building improvements, there has been almost $2.3 million of government funding provided to improve underground services, streetscaping with new sidewalks and street furnishings, decorated arches, historic street and building signs. It is expected that the streetscaping will be completed by early summer of this year. ANALYSIS Staff monitors the number of applications received under the financial incentive programs on an ongoing basis and works with landowners within the CIP areas encouraging the carrying out of improvements on their property. The intent of the financial incentive programs is to stimulate redevelopment and private sector investment. If certain programs are not working, Staff feels there is an obligation to advise Council and to propose changes to programs to meet the objectives of the Community Improvement Plan. There is a considerable amount of underutilized floor space above commercial buildings in the Downtown area. Through the proposed program change, it is hopeful that older apartments in disrepair will be improved and vacant space will be constructed with new residential apartments. The recommended program requirements for the change from a residential loan to a residential grant is as follows: 1. Grants will be paid to the landowner, only after all work is completed and all receipts are submitted to the satisfaction of the City. 2. Tenants are not eligible to receive the grant. 3. There be only one application accepted from each property owner (ie. Units which are served by a common doorway and interior hallway). 4. The landowner must spend a minimum of $10,000 per unit to be eligible for 50% grant (ie. $5,000 split between the City and Region). The maximum Grant will be $15,000 split with the Region (necessitating an expenditure of $30,000). 5. Ineligible items will include interior painting, cleaning, labour carried out by the owner, minor repairs such as patching holes in drywall, replacement of faucets, shower heads, appliances, etc. 6. Replacement windows should be applied for through the Commercial Building Facade program. May 29, 2012 - 3 - PD- 2012 -20 When contacting other municipalities that have CIP programs, we found there to be a mix of municipalities who provided residential grants and those that provide residential loans. We acknowledge that grants are easier to administer and are more attractive to landowners. The City of St. Catharines has a residential grant program and they have approved almost 200 new residential housing units in their downtown. If there are 40 improved and /or new apartments over the next year and a half in the Downtown, it would have a positive impact on the economy of the Downtown. FINANCIAL IMPLICATIONS At present, there are three CIP programs, Downtown, Historic Drummondville and City Wide. The latter program is specific to Brownfield rehabilitation while the other two are specific to these urban areas. The incentive programs were established to encourage redevelopment and reinvestment in the areas. As indicated, the residential grant program for Downtown CIP has not been widely utilized since inception and other incentives are being considered. At the inception of the CIP programs, there was a budget allotment in the General Purposes Budget for each CIP. In 2010, the annual budget allotment was eliminated during budget deliberations since the annual expenditures on the programs were not being fully utilized. The annual unspent amount was transferred in each year to a specific special purpose reserve for each program. Since that time, there has been no additional CIP money approved and the incentives have been funded from these reserves. At the time that the funding was eliminated from the budget, Council also directed staff to consolidate the three reserves into one fund. However, the Main and Ferry BIA requested that their portion of reserve be used to acquire the Serbian Cultural Centre as part of the redevelopment of the Sylvia Place Market as well as remain available for incentive programs. The Main and Ferry BIA believe that a new Market would be a catalyst for the economic rejuvenation of the Historic Drummondville area. The City has recently purchased this building and have fully utilized the portion of the reserve dedicated to this CIP. In fact, during 2011 Council approved a transfer of $50,000 from the City Wide CIP to the Historical Drummondville CIP to fund approved incentive programs. On the other hand, the Downtown BIA has not made requests to dedicate its available funding in the reserve for any land or building acquisitions. Rather the BIA feels that by encouraging more people to live and work Downtown, a positive economic impact will result for the area and City. It is their belief that a change to a grant program from a loan program will provide the initiative for this and are in support of staff's recommendation. The projected annual grant program of $150,000 for 2012 and 2013 can be accommodated in the remaining reserve of approximately $600,000. A further positive of this change is that the Niagara Region has recently enhanced its financial incentives programs and based on a Residential Grant of $15,000, they would contribute 50% or $7,500 per residential unit. CITY'S STRATEGIC COMMITMENT The Downtown has undergone considerable change over the past few years. The BIA has proposed a change to the residential loan program to a grant program to help stimulate new residential development in the Downtown. Such development would have a positive May 29, 2012 - 4 - PD- 2012 -20 impact by increasing the number of residents living in the Downtown. Additional residents will strengthen and promote economic development within the Downtown which satisfies one of Council's strategic priorities. EXECUTIVE SUMMARY In 2011 the new Boys' and Girls' Club opened its new facility on McLeod Road and, as a result, no longer requires the use of the building and land located at 6681 Culp Street which was decommissioned as of July 31, 2011. The City is now in a position to declare the subject land surplus to the City's needs in anticipation of the sale of same in the future. It is the City's intention to demolish the existing building and market the property as an entire parcel. Money has been included in the 2012 capital budget to demolish the building. BACKGROUND The subject land is slightly irregular in shape but best described as rectangular and has a frontage of 362.2 feet on the north side of Culp Street and a depth of 152.3 feet which is also frontage on the west side of Carlton Avenue, is zoned R1 E and has full services. The subject land was appraised in 2011 at a value of $370,000.00. Since the City has no use for this property, it should be declared surplus and placed on the City's surplus property list for sale in the future. Based on the above, Staff is recommending that the subject land be declared surplus and offered for sale, once the demolition of the building has taken place. Public notice of the declaration of surplus and sale was given in the May 19, 2012, issue of the Niagara Falls Review in accordance with the City's By -law No. 2003 -02.
