RESOLUTIONS
1 . Therefore be it resolved that:
(1) The Staff of the City of Niagara Falls shall appeal the assessments of the properties listed in
Schedule "A" as attached to this Resolution of Council; and
(2) The Staff of the City of Niagara Falls are hereby directed to take whatever action is required
to prepare, present and argue the City's case with respect to the assessment of the properties
listed in Schedule "A" as attached to this Resolution of Council before the Assessment
Review Board, including, without limiting the generality of the foregoing, the retention of legal
counsel and qualified experts in the appraisal of real property

WHEREAS the only time a meeting or part of a meeting may be closed to the public if the subject
matter falls under one of the exceptions under s. 239(2) of the Municipal Act, 2001.
THEREFORE BE IT RESOLVED THAT on Tuesday, March 26, 2013 Niagara Falls Council
will go into a closed meeting to consider a matters that fall under the subject matter of 239(2)(c),
proposed or pending disposition of City lands related to Part 4 on Reference Plan 59R-783,Palmer
Avenue,the unopened Somerville Road allowance between Niagara River Parkway and Willoughby
Drive and 6681 Culp Street and a proposed pending acquisition by the municipality related to lands
between Fourth Avenue and Stanley Avenue. Council will also consider a matter a matter that falls
under the subject matter of 239(2)(d), labour relations.

Subject: Niagara Falls Art Gallery - Fee for Service Grant
Mayor Jim Diodati and Members of City Council:
As you begin discussions around Fee for Service budgets, I hope that you will consider the needs of Niagara
Falls' residents—needs beyond the basics of roads, sewers, and other infrastructure, and beyond even the
budgets for libraries, museums, and sports that are all supported in our City.
As noted in more than one City-funded study of the community's needs, arts and culture are an equally
important part of any vibrant, healthy city and Niagara Falls should not be the exception. The Niagara Falls Art
Gallery, primarily self-supporting, uses the City's small but essential grant to help deliver a range of arts
services to residents of all ages. The Gallery also helps to balance our City's reputation by offering a cultural
experience that is appreciated not only by residents but by also visitors to our City.
I would like to trust that my local government will share my concern for a balanced lifestyle and for
opportunities to satisfy residents' interests in arts and culture. Please protect the Niagara Falls Art Gallery's
2013 Fee for Service grant.

How shortsighted and disheartening that some members of City
Council feel that a paltry $27 , 000 should be denied the Niagara
Falls Art Gallery , which provides a valuable and welcome service
to the residents of the City of Niagara Falls . Of course , roads
and sewers and infrastructure are indispensably necessary for a
properly functioning municipality and these , and other hard
services , must be maintained , improved and expanded . But a
community is made up of more than just steel and concrete . Such
services as sports programmes and facilities , support services
for the needy , libraries , museums , venues for and the encouragement
of theatre , arts and culture , add a certain quality of life for
residents (and visitors) .
It is difficult to measure , quantify and demonstrate , in cold
hard figures , the value and benefit of such services and amenities
in a municipality . Yet , other cities and towns encourage and
support these activities in tangible ways because they feel that
their residents deserve and need such services -- some of the
benefits that entice them to choose to live in a particular city
or town .
No one will deny , for example , the worth of organized sports
programmes and facilities for the good of our youth , or that it
is a human and humane obligation to help those in want and gtress .
Access to the arts and culture adds a certain qualitative
dimension to one ' s life ( and to the City) , elusive though it is
to define precisely . Many municipalities feel that they are
obligated to provide services , similar to those provided in the
City of Niagara Falls under the label "fee for services , " because
they are considered to be needed , for the greater good of the
semi residents and are funded through annual department budget
allocations . Yet , in Niagara Falls , these services are made to
sound as unnnecessary , hardly needed or barely tolerable , that
they are , or have to be provided by outsiders .
The Niagara Falls Art Gallery ' s request is very small in comparison
to the City ' s overall annual budget . The Gallery earns the vast
portion of the funds needed for its annual ongoing operations . In
its collection of artworks , the Gallery owns and displays (within
very limited exhibit spaces ) two significant art collections (the
renowned Kurelek Collection , the largest in Canada , and a large
collection of Niagara art -- surely the City of Niagara Falls
should feature such a collection , for Niagara Falls is the most
pictorially represented natural wonder , in oil and watercolour ,
in engraving and photograph -- after all , millions come each year
to gaze and marvel at the grand and mighty Niagara . Why should
they not also view an exhibit of Niagara art -- and to marvel how
well artists have succeeded in capturing the essence of Niagara
Falls ) . Artworks of Niagara Falls are found in major galleries
and the City of Niagara Falls has a major and growing collection ,
here , at the Niagara Falls Art Gallery , available for the
enjoyment and edification of residents and visitors .
As for the popularity of the range and quality of the art
programmes for children and adults in the Gallery and in the
schools , the number of participants and the favourable comments
speak volumes .
It has been my privilege to serve as President , and to continue
on the Board . The Niagara Falls Art Gallery -- its collections ,
programmes and dedicated staff are an outstanding asset to the
City -- to all its residents and visitors -- and should be warmly
applauded and supported .

MEE After speaking with a number of other Clifton Hill BIA members, other BIA's, City
BRI KCITY Councilors, and local sign manufacturing companies, I am requesting that the proposed new
�` sign by-law going before Council tomorrow evening, be deferred until City staff and local
„ businesses can work together to fine tune the new by-law.

current form will only create more confusion, aggravation and paperwork and will not meet

I have just reviewed a copy of the email between yourself and Charlie Burland, I am surprised that the sign by-law is
proceeding to council tomorrow.
Having participated at a meeting with the planning staff January 25, 2013 I had discussed several items of concern within
a draft sign by-law.John Barnsley and Peggy Boyle said they would consider the items and update the proposed by-law.
Further to this meeting I had emailed Peggy about status on by-law update and requested a copy once complete. Peggy
responded on March 5th that the by-law should be complete shortly and would forward a copy.
At this time I have not received a copy of the final by-law and would request that council allow for appropriate industry
review.

Re: The Victoria Street Armoury
Dear City Council Members,
At a meeting last Friday the future role of the Niagara Veterans Association
in respects to the Victoria Street Armoury was discussed. In attendance was
the President of the Navy League of Canada (Niagara). It was unanimously
decided that because of the need for the majority of the space and because of
the fact that the building would be occupied by the Navy League of Canada
(Niagara) the majority of the time that they should be the leaseholders of the
building and we, the Niagara Veterans Association, would become their sub-
tenants for a smaller portion of the building. It is for this reason we would
like to amend our proposal to reflect this wish. Although the Niagara
Veterans Association will not ne the leaseholder of the Armoury we will,
however support the Navy League of Canada (Niagara) in any way we can.
As we were the initiators or the bid for the building's leasehold originally we
will continue the act in an assisting role helping to facilitate and
coordinating things between the City and Navy League of Canada (Niagara).
They are a great organization doing wonderful things for our City's youth
and we are proud to be there offering any assistance that they require of us.
I truly hope that you will see the logic behind this change and will continue
to support this request for the lease of the building.

Dear Carmen:
I have been asked on behalf of the Board of Directors of St John Ambulance Niagara
Falls, to advise the City that our organization is very interested in working with the City
towards the transfer of the building to St John Ambulance Niagara Falls Branch. As we
have discussed, our organization has found our home in this old Firehall since 1972 and it
is commonly referred to as the St John Hall. Many building improvement projects have
been successfully completely including replacement of all floors, windows, painting, new
energy efficient lighting, etc, and allowed us to complete the accessibility of the building
to accommodate the hire of a qualified person who is physically disabled. As the Chair-
A-Van office is also located in this building, we felt it was imperative to accommodate
the needs of the over 1,200 members of the Chair-A-Van program as they come in to
purchase tickets, etc. We have kept the building in good repair and have made necessary
repairs including the replacement of the roof top furnace and air conditioner units. The
only repair currently required is the repair and/or replacement of the roof which has been,
as I understand it, on the City Capital Plan for 2012/13.
In addition to the Chair-A-Van Program, the building is home to many St John programs
including Medical First Responders, Youth Program, Therapy Dog Program, Search &
Rescue Niagara, and the Water Patrol Program. We also allow other community groups
to use our building on a regular basis, at no cost, including Accappella Niagara, and the
Kentucky Colonels have found their home here for several years. The building also
allows us to provide first aid training which is a primary source of revenue to support our
programs and essential community services.
We would be happy to participate in further discussions with senior staff, as we work
towards this goal.

promulgated pursuant to that Act or replacement legislation for the
issuance of Conditional Building Permits.
3.4.7 Fees payable at the time of the application shall be in accordance
with the permit fee structure adopted by the City and shall be paid
prior to the City accepting any sign permit application for
processing.
3.5 Signs for Which a Permit is Not Required
3.5.1 No permit is required for the following types of signs:
(a) Signs to be located on lands that lie within an area that is
under the jurisdiction of the Regional Municipality of Niagara,
the Niagara Escarpment Commission or the Ministry of
Transportation. Notwithstanding the foregoing, signs shall
comply with the minimum requirements of the Ontario Building
Code and, where applicable, building permits shall be
obtained.
(b) Official signs or signs pertaining exclusively to public safety;
(c) Flags of corporations, nations, and educational or religious
organizations provided not more than three (3) flags are
located at one (1) premise;
(d) A poster affixed to a community bulletin board in
accordance with the provisions of this By-law;
(e) A sign containing the name and address of a resident or
occupant, provided the sign is not more than 0.2 square

uniformity plan where signs are proposed for more than one (1)
occupancy or tenant.
3.4.5 Where a sign is proposed to be located on lands that lie within an
area that is under the jurisdiction of The Niagara Parks Commission,
approval for the proposed sign from The Niagara Parks
Commission shall be obtained prior to making application for a
permit.
3.4.6 Notwithstanding section 3.4.5 if the Chief Building Official believes
unreasonable delays in the process would occur he may issue a
conditional sign permit following as closely as possible the rules and
procedures of the Building Code Act, 1992, S.O. 1992, c. 23, any
replacement legislation of that Act and any regulations
promulgated pursuant to that Act or replacement legislation for the
issuance of Conditional Building Permits.

3.4.2 The applicant shall file with the City an application for a permit on
the prescribed form.
3.4.3 The applicant for a permit shall provide to the City:
(a) A completed application in the form prescribed by the City;
(b) The written authorization of the owner where the applicant is
not the owner of the property or building where the sign is to
be erected;
(c) A drawing showing the location and dimensions of all existing
and proposed signs, and identifying the materials of which the
proposed sign is to be constructed;
(d) A site plan showing the location of the sign in relationship to
other buildings and structures, the street, and the boundaries
of the property upon which the sign is proposed to be erected;
(e) Sufficient information for the Chief Building Official to
determine that the sign has been designed and will be
constructed in compliance with the applicable structural and
fire prevention provisions of the Ontario Building Code.
(f) The Chief Building Official or his/her designate may, if
deemed necessary, require that the sign and its supporting
structure to be designed by an Architect or Professional
Engineer registered in Ontario and the erection of any such
sign must be reviewed during construction by the Architect
or Professional Engineer and certified as being erected in
compliance with the design drawings and specifications.
The following signs, in all instances, must be designed by an
Architect or Professional Engineer registered in Ontario and
the erection of any such sign must be reviewed during
construction by the Architect or Engineer and certified as
being erected in compliance with the drawings and
specifications:
(i) a ground sign exceeding 7.5m in height
(ii) a projecting sign weighing more than 115kg
(iii) a projecting sign attached to a parapet
3.4.4 An application for a fascia sign for a building or property containing
more than one (1) occupancy or tenant shall include a sign

By-law No.2013 -
A by-law to designate Lots 1, 2, 65-69 (inclusive), 78, 79, 128-131(inclusive) and 140-144
(inclusive), Registered Plan 59M-388, not be subject to part-lot control.
WHEREAS subsection 50(7)of the Planning Act, R.S.O. 1990,provides, in part, that the council
of a local municipality may by by-law designate lands that would otherwise be subject to part-lot
control, not be subject to such part-lot control;
AND WHEREAS such by-laws are required under subsection 50(7.1) of the Planning Act to be
approved by the appropriate approval authority,that being the Regional Municipality of Niagara as
per subsection 51(5) of the Planning Act, subsequently delegated to the City of Niagara Falls by
Regional Municipality of Niagara By-law No. 8819-97;
AND WHEREAS the said lands are zoned by By-law No. 2009-51 to permit the erection of one
family detached dwellings thereon;
AND WHEREAS the owner of the said lands proposes to divide Lots 1, 2, 65-69 (inclusive), 78,
79, 128-131(inclusive) and 140-144 (inclusive) into 36 parcels to be sold separately;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls deems it expedient
to designate that the said land not be subject to part-lot control.
THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS
AS FOLLOWS:
1. That subsection 50(5) of the Planning Act, R.S.O. 1990, not apply to Lots 1, 2, 65-69
(inclusive), 78, 79, 128-131(inclusive) and 140-144(inclusive), Registered Plan 59M-388,
in the City of Niagara Falls, in the Regional Municipality of Niagara.
2. This by-law shall remain in full force and effect for three years from the date of passage of
this by-law, after which time this by-law shall expire and be deemed to be repealed and of
no effect.
