I am also requesting further notice or decision concerning this application. Could you please clarify the appeal process. Under the current Zoning By-Law or future Site Plan process could the City of Niagara Falls request Riocan remove existing parking spaces and increase the landscaping width buffer at the east limit of their commercial public property. The existing landscaping width along the east perimeter of the said commercial property (6777 Morrison St) does not effectively buffer the public parking area from our residential properties. However, the following City policy states: The parking area shall also have a landscaped perimeter of a depth and intensity that at maturity effectively buffers the parking area from adjacent uses and streets. One could argue, the existing landscaping width along the east perimeter of the said commercial property (6777 Morrison St) does not effectively buffer the parking area from our residential properties. The new +/- 7 ft high board on board fence constructed in 2011 did improve the situation. But, I understand Riocan may be constructing two future commercial retail building(s) closer to our residential properties. Could the City of Niagara Falls under a future site plan process insist Riocan improve or increase the landscape perimeter. I'm sending you a combined response to your questions, however these are different files. My apologies for not sending a response sooner — we were waiting for information regarding the Minor Variance application from the applicant, which we didn't receive until today. 1. OPA #113 — This amendment provides policies for the introduction of residential uses within the node and does not impact on existing policies or regulations. That is to say, lands within the node can continue to develop under current zoning but should any developer apply to change the zoning of a parcel of land to permit residential uses, the policies of OPA #113 would prevail, once approved. 2 The attached schedule illustrates the potential building heights and densities that could be developed for residential uses. You will see that heights of the RioCan lands to the west of your property are limited to 2-3 storeys — less than what is permitted under the current zoning and consistent with the building heights of the surrounding neighbourhoods. Increased landscaping, while not specified in OPA #113, is addressed in the following policy: The parking area shall also have a landscaped perimeter of a depth and intensity that at maturity effectively buffers the parking area from adjacent uses and streets. 2. The timing of the two meetings is coincidental. The notice for OPA #113 was published and circulated on September 20th, whereas the notice for the Minor Variance application was circulated on September 30th. The two files are unrelated and deal with completely different planning matters. 3. With respect to the Minor Variance application, your questions have been addressed below: What is the size of the current building compared to the proposed 3,809 sq. metre new building? The current Zellers building is approximately 9,360 sq m. Will the new building be the same(set back)distance from our residential properties or significantly closer? The proposed building subject to this minor variance is setback further than the existing Zellers. The proposed LA Fitness is intended to be setback approximately 108 metres. The current vacant Zellers is setback 91.5 metres. I do note that there are other buildings shown on the site, but they are conceptual at this time and not subject to this application. Where will the Garbage containers be located inside the building or outside in proper enclosures? Garbage containers for the proposed building will be located on the west side of the building in proper enclosures. The enclosures will be built with the same materials as the building itself(i.e. masonry) Where will any new truck drop off bays be located. The proposed building subject to this application shows the new truck drop off bays, they are located at the west side of the building beside the garbage enclosures. Loading requirements of any future buildings will be reviewed once a formal application is submitted. I trust this information will address your comments. My residential property abuts the subject commercial property(6777 Morrison St). We residents have been putting up with parking lot sweeping (dust)/snow plowing at all hours of the night, garbage, idling buses/trucks and excessive pedestrian/vehicle noise from the Riocan property for many years. Also, in the past we have had large stock piles of snow placed adjacent to our common fence line,which could cause drainage problems for our residential properties. Please see attached photo of one particular questionable activity,which I am not sure the absentee property owner (Riocan) was aware of. If the Riocan property is re-developed/re-zoned, I would prefer to see maximum of 2 stories permitted. I would prefer to see an increased buffer green space constructed adjacent to our residential properties. This property has too much unused parking which promote many other public activities. I have a few questions: What is the size of the current building compared to the proposed 3,809 sq. metre new building? Will the new building be the same (set back) distance from our residential properties or significantly closer? Where will the Garbage containers be located inside the building or outside in proper enclosures? Where will any new truck drop off bays be located? Can an individual be included in the site plan process? Thank you for hearing my concerns. The Capital Funding Program The$100 million dollar program is dedicated funding for municipal roads, bridges, water and wastewater projects where the primary objective is to address urgent and long term public health and safety issues. Projects must be identified as priorities in municipal Asset Management Plans.The share of Provincial Funding that may be requested is flexible up to a maximum of 90%of eligible project costs or$2 million, whichever is lower.The Expression of Interest (EOI) must be submitted by November 1st, 2013 and include a Council Resolution supporting the submission.There does not appear to be a limit on the number of projects to be submitted by a municipality. If the project passes the pre-screening process, municipalities will be asked to submit a detailed application with the final decisions to be announced in February 2014. The eligibility guidelines follow the Municipal Infrastructure Investment Initiative (MITI) program. Our Projects You may recall that Council approved the recommendations in report MW-2012-64 on December 11, 2012 (attached), which advanced the Kalar Rd. (Rideau to Beaverdams) project for the first round of the MIII program. At that time we also considered reconstructing Ailanthus Avenue and Robinson Street. As you know, Ailanthus Avenue is now nearing completion having been able to fund the project entirely within our own means.The Kalar Rd. project is also nearing completion however it has had to be downscaled in scope (from Rideau to Lundy's Lane) in order to fit the limitations of the Capital Budget.The second phase (Lundy's Lane to Beaverdams Rd.) is still a priority for this municipality from an asset management perspective and appears to fit the project eligibility requirements quite well. It should also be noted that the engineering phase for the Robinson Street project (Main to Stanley) is well underway and would also meet the eligibility requirements particularly as it pertains to the planned sewer separation in this area. Accordingly, it would be appropriate to resubmit the Kalar Rd. (Phase 2) and Robinson Street projects as they continue to be infrastructure priorities for us.The estimated project costs are; • Kalar Rd. Reconstruction—Phase 2(Lundy's Lane to Beaverdams Rd.) $4,225,000 • Robinson St. (Main St.to Stanley Ave.) $2,300,000 Regrettably, I have only provided the first project to you for inclusion in the Council agenda package and perhaps it would be prudent to draft a similar resolution for the Robinson Street (Main St.to Stanley Ave.) project should Council wish to include it in our EOI submission. WHEREAS pursuant to the Building Code Act, 1992, S.O. 1992, c. 23, as amended, the Lieutenant Governor in Council has established a Building Code which is in force throughout Ontario; AND WHEREAS Section 7 of the Building Code Act, 1992, S.O. 1992, c. 23, as amended, empowers Council to pass by-laws respecting construction, demolition, change of use, transfer of permits, inspections, and the setting and refunding of fees; AND WHEREAS subsection 8(3) of the Building Code Act, 1992, S.O. 1992, c. 23, as amended, permits a Chief Building Official to issue a Conditional Building Permit in circumstances and subject to the conditions listed in that subsection; AND WHEREAS article 8(3)(c) of the Building Code Act, 1992, S.O. 1992, c. 23, as amended, sets out that the applicant or such other person as the Chief Building Official determines, must enter into a form of agreement which is described in that article and commonly known as a Conditional Building Permit Agreement; AND WHEREAS the Council of the City of Niagara Falls deems it to be in the public interest that the Chief Building Official have the authority to execute Conditional Building Permit Agreements on behalf of the City of Niagara Falls; THE COUNCIL OF THE CORPORATION OF THE CITY OF NIAGARA FALLS ENACTS AS FOLLOWS: 1.
