Diodati and Members of the Municipal Council SUBMITTED BY: Office of the Administrator SUBJECT: CAO-2014-02 Niagara Falls Family Physician Recruitment Program RECOMMENDATION It is recommended that this report be filed for information purposes, and that the proposed Family Physician Recruitment Program budget be referred to 2014 budget deliberations. EXECUTIVE SUMMARY Since 2000, the City of Niagara Falls has managed a Family Physician Recruitment program in response to the shortage of family physicians in Ontario and, in particular, in Niagara Falls. This has included: • Staff support for recruitment and retention efforts as an added responsibility to the Manager of Strategic & Corporate Initiatives portfolio since 2002, • Funding to assist family physicians with relocation costs, and financial assistance with the costs of furnishings and equipment, with a five-year return of service stipulation, for the establishment of a new practice • Support of medical education and retention efforts Family physicians are independent professionals who have the ability to practice in any location of their choosing. Strong primary health care is a cornerstone of any vibrant growing community, as it attracts new families, business, and new economic development. If a community cannot attract and retain doctors, it will have a difficult time attracting and retaining business (Wier, 2012). BACKGROUND How the Niagara Falls Family Physician Recruitment Program is facilitated City staff serves as the relocation resource for the physician, providing information about City of Niagara Falls practice opportunities, spousal employment, municipal CAO-2014-02 February 11, 2014 incentives, schools, real estate, churches, sporting and cultural opportunities, and any other community or relocation information physician may request. Niagara Falls City staff work in conjunction with the Regional Municipality of Niagara's Physician Recruiter, who is the contact for family physicians interested in working in the Niagara Region, and who refers family physicians to the local communities. The Regional Recruiter is also responsible for reviewing the physician's licensure and eligibility to practice, and coordinates quarterly meetings of the municipal physician recruitment program representatives. Staff also confers with the City's Physician Recruitment Program physician advisor, Dr. David Dec, who provides guidance and assists with Niagara Falls physician familiarization tours. For a number of years, Niagara Falls had a physician recruitment committee that focused primarily on retention activities, as recruitment was minimal due to the Ontario- wide shortage of physicians. For the past four years, with activity and dollars committed almost exclusively to recruitment, the model changed to best utilize limited staff resources. Only one municipality in the Region still has a physician recruitment committee in place — Port Colborne, where the emphasis is on community health promotion. Several communities in the Region had, or have, contract physician recruiters. City Council approves the Family Physician Recruitment program funding each year through the capital budget process. The level of funding has remained fairly consistent over the last several years, although it is difficult to predict physician interest in the community. Gaps in locating new physicians have been as long as three years, but we have also secured three doctors in one year. In some cases we work with a physician for several years in advance of their coming to the City. Therefore, some flexibility is required to accommodate opportunities for new recruits. Medical Education The City of Niagara Falls also participates in medical education in several ways and for several reasons. For seven out of the last ten years we have participated in Rural Medicine Week. Rural Medicine Week is organized by the Rural Ontario Medical Program (ROMP) in conjunction with select communities throughout South-Central Ontario. Pre-clerkship medical students are provided with a "snapshot" of what it is like to practice medicine in CAO-2014-02 February 11, 2014 the host community. Through a variety of organized clinical rotations, trainees are briefly exposed to and learn more about several specialties on a one-on-one basis with physicians. In addition, social events are coordinated so that the student becomes aware of the extra-curricular opportunities available in the City. Approximately half of the City's family physicians and many specialists participate in the training as well as some of the organized social events. It is an excellent opportunity for the students, and provides exposure to Niagara Falls. The physician preceptors enjoy the opportunity to teach and are invigorated by the experience. The City also supports and attends events in cooperation with the McMaster University - Michael G. DeGroote School of Medicine Niagara Campus at Brock University. This includes participation in orientation day activities for new students and organizing meet & greet opportunities to connect local doctors with final year medical residents. Niagara Falls was fortunate to have one of these new doctors join a local practice in 2013. ANALYSIS/RATIONALE Our Record In 2001, 34 family physicians served the City of Niagara Falls. At that time, the Ministry of Health and Long-Term Care's Underserviced Area Program (UAP) identified that Niagara Falls was underserviced by 22 family physicians, and noted that a full complement of family physicians for the City would be 56. In 2010, the Ontario government revised the UAP to serve only remote communities, putting an end to the availability of incentive and tuition grants to doctors who agreed to practice in previously designated locations. With a total population of 82,997, the City has an estimated 13,670 people without a family physician. The physician count includes doctors at the Community Health Centre (CHC). CAO-2014-02 February 11, 2014 The City has been successful in attracting international medical graduates and expatriate Canadian physicians, as well as those the relocating here due to personal ties to the region. Quality of life, attractive practice opportunities, clinical facilities are also key factors that influence a prospect's decision to practice in the community. Since 2002, we have recruited 11 physicians through the Family Physician Recruitment program. In addition, six other family physicians joined turn-key practices (including the CHC) and no assistance was accessed in those cases. Over the same period, the City has also lost 12 family physicians to retirement, relocation or death, and the City's population has grown. This means that if the City had not been recruiting, we could possibly have 6 fewer doctors today than we had when we started recruiting in 2001. In Niagara Falls, our physician complement is relatively older, with 30% of our family physicians over the age of 60, and 15% of total physicians over 70 years of age. This may result in several thousand Niagara Falls residents losing their family physician in the near term. CAO-2014-02 February 11, 2014 Succession planning is an issue for retirement age physicians. It is often the case that little lead time to recruit a replacement for a retiring physician is given, when it can often take months or even years to locate a replacement. Closing the doors on a practice without a succession plan in place has a huge impact on the community. Older retiring physician tend to have much larger independent practices than those desired by today's young professionals and it often requires two recruited physicians to assume the patient volume. However, most retiring doctor's practices aren't that appealing to new recruits who prefer Ontario's newer more collaborative primary care models. In general, physician working patterns continue to change. With the tendency to place greater emphasis on personal/family commitments, younger physicians working less than the previous generation, and those physicians opting for non-traditional smaller practices, the situation will only worsen. Couple the aforementioned with an aging population, rising rates of chronic disease and other health trends, the need is evident for sustaining a concerted recruitment program to respond to the health care needs of Niagara Falls residents. There is also the issue of choice. Residents should have the option to choose a doctor who they feel comfortable will give them the best primary health care, rather than be forced to go to the one doctor in the City who is currently taking patients. Healthy competition means raising the bar. CITY OF NIAGARA FALLS STRATEGIC COMMITMENT Under the Council's 2011 — 2014 Healthy and Safe Community strategic priority, the City's commitment is to advocate for and facilitate improved health care delivery in Niagara Falls by attracting new primary care physicians to serve our residents. FINANCIAL AND STAFFING IMPLICATIONS The Incentive Program Several municipalities across Niagara have established recruitment incentive programs. Financial incentives range from a $5,000 allowance for moving expenses to $70,000 packages that includes cash bonuses. The City of Niagara Falls currently offers an incentive of $30,000, plus moving expenses up to $5,000. The incentive is offered through an agreement (attached) authorized by City Council for a return of service. The agreement states that a physician must establish a full-time medical practice in the City of Niagara Falls for a period of at least CAO-2014-02 February 11, 2014 five years to receive the incentive, and that all furnishings and equipment, received through the program remain the property of the City of Niagara Falls. Furnishings include items such as waiting room chairs and furniture, and office desks and chairs. Equipment includes items such as exam room tables and medical equipment, computer and telephone technology, and medical supplies. Purchase of furnishings and equipment may be done by the City for the physician or by the physician directly, who provides receipts for reimbursement. This may result in issuance of several smaller cheques to accommodate the physician's cash flow. Return on Investment The most obvious return on investment is the provision of City of Niagara Falls residents with primary health care and access to continuity of care. In addition to the health care services they provide, family physicians are significant generators of economic activity contributing to the fiscal viability of the communities they serve as highly educated consumers, and employers. A recent case study conducted in Windsor/Essex that examined the contributions of physician recruitment to economic development, estimated that for every dollar spent on physician recruitment in the region, $198.54 was generated in the regional economy — a significant return on investment (A. Lauzon and C. McCordic). The American Academy of Family Physician's Robert Graham Centre (2007) estimated the impact of one family physician on the community was $904,696 on average. If we apply that figure to physicians recruited through the Niagara Falls program since 2002, this would amount to a $9,951,656 impact on the economy. 2014 Budget Request Dr. Karl Stobbe, the Regional Assistant Dean for the Niagara Campus, Michael G. DeGroote School of Medicine at McMaster University is currently working on a plan to help address the implications of the aging demographics of Niagara family physicians, and provide guidance to municipalities in planning for the impact of this trend. For 2014, a budget of $40,000 is recommended to accommodate the recruitment of one family physician, and to support education/retention activities. Should funds remain at the end of the year, it is requested that they be transferred to a reserve account in preparation for future recruitment needs. CAO-2014-02 February 11, 2014 Conclusion Given the ongoing family physician supply issues, the physician to patient ratios in the community, and the age profile of current practicing family physicians, it is recommended that the City of Niagara Falls Family Physician Recruitment Program be continued. WHEREAS the City is a city in the Regional Municipality of Niagara operating pursuant to the Municipal Act, 2001 (Ontario), and the regulations thereunder; AND WHEREAS the City wishes to provide incentives to physicians demonstrating a commitment to practicing medicine in the City of Niagara Falls; AND WHEREAS the Physician wishes to make a commitment to practicing medicine in the City; AND WHEREAS THE PARTIES WISH TO ENTER INTO A WRITTEN AGREEMENT SETTING OUT THE TERMS OF THEIR ARRANGEMENT, as follows: DESCRIPTION OF INCENTIVES 1. Subject to the terms and conditions herein, the City agrees to provide certain incentives to the licenced Physician in anticipation of the Physician establishing a full time family medical practice in the City of Niagara Falls, and in no event later than MONTH DAY, 201X. 2. For the purposes of this Agreement, the incentives ("Incentives") shall include the following: (a) the cost of reasonable expenses related to practicing in and relocating to Ontario, up to a maximum value of AMOUNT dollars in Canadian funds ($AMOUNT.00) (b) office and examination room(s) furnishings to be located at ADDRESS, Niagara Falls, Ontario, up to a value of AMOUNT Dollars ($AMOUNT.00). REPAYMENT OF INCENTIVES 3. The Incentives listed in subsection 2(b) above shall be left in the office and examination rooms on the Physician's departure from the practice in the City of Niagara Falls and the Incentives listed in subsection 2 (a) above shall be repaid by the Physician to City on the following terms: (1) If the Physician engages in the practice of medicine in the City by MONTH DAY, 201x, and continues to do so for a period of at least five (5) years following the commencement of such practice, the Physician shall not be required to repay any of the Incentives contemplated by this Agreement. (2) If, however, the Physician does not maintain or regularly or actively engage in the practice of medicine in the City by MONTH DAY,201X, and for the duration of the times set out in subsection 3(1) above, the Physician shall be required to repay the Incentives set out in subsection 2 (a) above on a prorated basis, forthwith upon demand for such repayment being made, in writing, by the City. (2) Any amounts that may be required to be repaid by the Physician to the City under subsection 3(2) above, shall accrue interest as of the date that the funds were advanced, compounded annually at 3.5% per annum, and shall be due and payable upon the date that a written demand for repayment of the amounts set out in subsection 3(1) above is made by the City. (3) Notwithstanding anything contained in section 3, in the event the Physician elects to continue practice at another location in the City of Niagara Falls, Ontario, the Physician may transfer the furnishings described in this Agreement to that location, provided always that the Physician must practice medicine in the City of Niagara Falls for a period of at least five (5) years following commencement of practicing medicine and provided always that the furnishings shall forever remain the property of the City of Niagara Falls. NOTICE OF INTENTION TO CEASE PRACTICING IN THE CITY L The Physician agrees to provide the City with no less than three (3) months working notice of his intention to cease carrying on the practice of medicine in the City. Such notice shall be in writing and shall be delivered to the City in accordance with the Notice Provisions of this Agreement. SOURCE OF FUNDING FOR INCENTIVES 5. The monies required to fund the Incentives shall be provided 100%from the City, and shall be paid by the City to the Physician at such times as are required by this Agreement. REPRESENTATIONS AND WARRANTIES OF THE PHYSICIAN 6. The Physician hereby acknowledges that the City is relying on the following representations and warranties that he has made in connection with this Agreement and which representations and warranties form the basis for the City entering into such an Agreement with the Physician: (1) The Physician is a member in good standing with the College of Physicians and Surgeons of Ontario. (2) The Physician has not accepted any other Incentives of a similar nature to those referenced by or set out in this Agreement, from any other party, and has not committed himself to practice medicine on a full time basis in any area outside of the City. NOTICE 7. EXECUTIVE SUMMARY The fees charged for the use of recreation facilities provide offsetting revenue for the tax payer subsidized cost of operating community facilities. The annual operating costs of recreation facilities (i.e.,arenas) generally increase each year as result of the increased costs of utilities, maintenance, as well as annual adjustments to wages. Staff recommends a 3% increase for spring and summer ice rates. As part of the annual process of reviewing the rates and fees, staff completed a review of existing rates in neighbouring municipalities. The draft rates have been emailed to facility user groups and the Recreation Committee. The Coronation Centre Advisory Committee approves the $1.00 increase to the Centre membership rate. The membership rate is reviewed every five years. Following the last review, the membership approved $1.00 increase per year. BACKGROUND Rates and fees have been established based on the user, i.e., adult groups, youth groups, and non-residents. In addition, rates have also been further segmented based on an understanding of demand into prime and non-prime rates. In general, the rates charged users for ice rates, floor space and the membership fees at the Coronation Centre do not generate adequate revenue to cover the full cost of operations of these facilities, and as a result the residual costs are offset by other revenue streams including the property tax levy. Thus these reasonable rate increases are required to minimize impacts on the levy. The program/tournament coordinators request their ice rates and ice allocation be confirmed prior to July to allow them to promote and plan for their tournaments and programs. In order to accommodate the ice user requests, the rates need to be confirmed in advance of the annual corporate July 1, 2014 rates and fees report. EXECUTIVE SUMMARY Pinewood Homes (Niagara) Ltd. has applied to amend Zoning By-law No. 79-200 for the lands known as 4328 Dorchester Road. Staff recommend the amendment subject to a number of additional regulations for the following reasons: • the proposal conforms with the Official Plan's policies regarding the location of medium density housing and represents an acceptable form of infill development; • the height and setbacks of the proposal are compatible with the surrounding housing in the neighbourhood; and • the surrounding streets are capable of accommodating the traffic generated by this proposal. BACKGROUND Proposal A Zoning By-law amendment is requested for a 1841 square metre (0.45 acre) parcel of land known as 4328 Dorchester Road, as shown on Schedule 1. The amendment is requested to permit the development of 5 on-street dwelling units. Schedule 2 shows details of the project. The land is currently zoned Residential Single Family 1C Density (R1C), in accordance with Zoning By-law No. 79-200, which only permits single detached dwellings. The zoning of the land is requested to be changed to the Residential Mixed (R3) zone, with site specific interior side yard width and lot coverage requirements, and to permit required parking spaces to be provided in tandem. The R3 zone permits on-street townhouse dwellings. February 11, 2014 -2 - PBD-2014-13 Site Conditions and Surrounding Land Uses The subject land is located at the signalized intersection of an arterial and local road. It is occupied by a single detached dwelling which is proposed to be demolished. Several mature trees exist on the land. The land is surrounded primarily by single detached dwellings. A place of worship is located to the south, on the west side of Dorchester Road. Circulation Comments Information regarding the proposed Zoning By-law amendment was circulated to City divisions, the Region, agencies and the public for comments. The following summarizes the comments received to date: • Regional Municipality of Niagara No objections from a Regional or Provincial perspective. The proposed townhouse development will more efficiently use the land and will provide housing choice for the neighbourhood. • Municipal Works, Parks Design No objections to the rezoning. A site servicing/grading plan will be required to ensure abutting lands are not adversely impacted by drainage. A 1.8 metre high wood fence should also be provided between the subject land and abutting single detached dwellings. • Transportation Services No objections to the rezoning. The intersection of Dorchester Road and Freeman Street is operating at an acceptable level of service and the modest traffic generated by this development is not expected to reduce the level of service. Staff is not aware of any collision problems that have been cited. The proposed driveways for the development have adequate separation from the intersection. - A 7 metre by 7 metre daylight triangle will be required at the corner of Dorchester Road and Freeman Street if the land is subject to future lot creation. • Fire Services, Legal Services, Niagara Falls Transit - No objections to the rezoning. Neighbourhood Open House A neighbourhood open house was held on January 7, 2014. No neighbours attended the open house to hear about the proposal or to ask questions. Four letters of objection have been submitted by surrounding residents and are included in tonight's agenda. Three of the letters express concerns about potential traffic impacts and traffic safety issues surrounding the Dorchester Road/Freeman Street intersection. The fourth letter expresses concerns about the form of development in relation to the surrounding development and suggests the development be reduced to four (4) units. February 11, 2014 - 3 - PBD-2014-13 ANALYSIS 1. Provincial Policy Statement and Growth Plan The subject lands are located in the built-up area of the City. By the year 2015, Provincial policies require 40% of all residential development in the City to occur through intensification within the built-up area. The proposed infill development is an example of the form of land use intensification required in the built-up area. 2. Official Plan The subject land is designated Residential in the City's Official Plan. Residential land is primarily intended to be developed for housing. The land can be considered for medium density housing up to 50 units per hectare because it is located adjacent to an arterial road. The proposed on-street townhouses are a form of medium density housing. The City's Growth Management Policies (OPA No. 94) permits on-street townhouse dwellings, up to a density of 40 units per hectare, on an infill basis on Residentially designated lands. OPA No. 94 was adopted by Council and was approved by the Ontario Municipal Board on January 28, 2014. As this application was submitted prior to this date it is to be reviewed under the policies originally in force, however the application has also been reviewed to determine compliance with Council's current intent under OPA No. 94. The project conforms with both the City's Official Plan and Growth Management Policies as follows: The density of the project at 27 units per hectare is below the maximum density permitted for the site and is only modestly above the maximum density expected for single detached housing. On-street townhousing is an acceptable form of infill development. The proposed low-rise, bungalow style on-street townhouse dwellings (See Schedule 3- Floor Plan) would be compatible with the existing housing in the neighbourhood. To be in keeping with the established built form, the applicant has provided a set back at the same distance from the street as the existing dwelling to the east. - The adjacent roads are capable of accommodating the traffic expected to be generated by the proposal. The subject property is located adjacent to the signalized intersection of Dorchester Road and Freeman Street, providing convenient access to the City's arterial road system. - The additional units on this property are transit supportive under Smart Growth Principles. 3. Zoning By-law The Residential Single Family 1C Density (R1 C) zoning of the land, which only permits single detached dwellings, is requested to be changed to the Residential Mixed (R3) zone which permits on-street townhouse dwellings. The applicant has also requested February 11, 2014 -4 - PBD-2014-13 the following modifications to the standard R3 regulations to facilitate the project: Required Proposed Minimum Interior Side Yard Width 3 metres 1.2 metres Minimum Lot Coverage 40% 45% Parking requirements 1.4 spaces/unit 1.4 spaces/unit in tandem (one in an attached garage) The requested modifications are minor, reasonable and supportable. The reduction to the interior side yard width is the same standard required for detached dwellings in the R1C Zone and is a compatible standard within the neighbourhood. As the project meets all other property setbacks and minimum landscaped open space, the minor increase in lot coverage should not be noticeable. Two tandem parking spaces are proposed per unit (1 in the garage and 1 in the driveway). This is acceptable and typical of dwelling units with driveways directly accessible from streets. The proposed dwellings provide a front yard depth along Freeman Street of 7.5 metres. This respects the front yard depth of the abutting dwelling to the east. Although not requested in the application, staff recommend the amending by-law include a minimum front yard depth requirement of 7.5 metres rather than the standard 6 metres. Although the units will front onto Freeman Street, by definition, By-law No. 79-200 establishes the Dorchester Road frontage of the property as the front lot line because it is the narrowest. To avoid any confusion and to reflect the orientation of the project, it is recommended the amending by-law deem the Freeman Street frontage of the property to be the front lot line. Parks Design staff recommend the requirement of a 1.8 metre high wood fence along the rear and interior side lot lines (east and north)to maintain the privacy of the existing single detached dwellings on the adjacent lots. To ensure the sight lines of vehicles exiting the driveways of adjacent single detached lots are not affected, no fencing would be required where the lot lines abut the front yards of the adjacent dwellings. Appropriate fencing will be required in the implementing zoning by-law. 4. Site Servicing and Grading Municipal Works has requested a site servicing and grading plan be submitted at the Building Permit stage to ensure adjacent properties are not adversely impacted by overland drainage. CITY'S STRATEGIC COMMITMENT The proposal is supported by the Well Planned City strategic priority in that it provides for infill development that occurs in an orderly and efficient manner to take advantage of existing infrastructure. My late husband, Frank Pascunni, and I purchased our home on Freeman Street twenty-six years ago. We fell in love with this unique area because it feels as if we are in the country, while still having the convenience of being in the city. The properties in this area are beautiful and it has been a great subdivision to raise our children and now my grandchildren. The corner in question (Dorchester Road and Freeman Street) has seen numerous traffic accidents over the years and some of them have been fatal. In recent years there has been an increase in traffic and congestion on Freeman and Dorchester. I believe rezoning this area would jeopardize people's safety, especially the safety of the children going to and from school. Often times the school buses will use Freeman Street as a route to get to Dorchester road. 1 feel that rezoning this area will bring in more traffic and more accidents. Public safety is top priority and that is why I would like you to please reconsider rezoning our area. I have reviewed the plans for the proposed redevelopment for this parcel of land and am quite concerned. The potential rezoning of the property is not at all in accordance to the existing homes in the area. All the surrounding homes are bungalow/raised bungalow style homes while the proposed development consists of five `simulated' 2 story townhouse style units. All existing properties in this neighbourhood have large open lots with adequate clearance on each side of the lot. However, the proposed redevelopment has only a 4' clearance on the East side, far too minimal and not in harmony to the surrounding homes. I am very troubled about the scale of the building; the footprint is more than 3 times the size of the current building, with `simulated' two floors makes this 6 times larger than the existing building!! It is far too big for this site and should be scaled back to no larger than 4 units. The proposed buildings will occupy greater than 60% of the lot space, while all surrounding home occupy 30% to 40%; again not typical of the existing and surrounding homes. I have met with and spoken to many residents in the immediate area, all of whom remain opposed to the planned development. Redevelopment is fine. However, we are not in favour of this type of redevelopment. We desire that you keep the zoning in accordance to low density residential. This proposed rezoning plainly shows that the current projected development is not achieving the high quality and sustainable development which our neighbourhood and city deserve. The project, as currently proposed,seems out of proportion to the lot and is not consistent with existing area homes. I strongly urge that this plan is reject. BACKGROUND Proposal The applicant has applied to subdivide 13.173 hectares (32.55 acres) of land, known as 7913 Kalar Road (see Schedule 1). The plan proposes 225 lots for single detached dwellings, four blocks for on-street townhouse dwellings (20 units), one block for a future apartment building (50 units) and a block for a walkway. Schedule 2 shows the design of the proposed plan of subdivision. The applicant has also applied to amend the zoning of the subject lands to provide the necessary regulations to guide the development and uses of the lands. The subject lands are currently zoned Light Industrial (LI) in accordance with Zoning By-law No. 79-200. The applicant proposes to rezone Lots 1 to 224 and Blocks 225 to 228 as Residential mixed (R3) with site-specific provisions. Block 229 is to be rezoned to Residential Apartment Density 5A (R5A) with site-specific provisions and Block 230 is to be zoned Open Space (OS) with site-specific provisions. As part of the application, the City is proposing to change the zoning of the City-owned lands containing Warren Creek and a stormwater management pond to Environmental Protection Area (EPA). The City is also proposing to rezone a portion of the abutting Hyrdo Corridor and additional lands owned by the applicant from LI to Development Holding (DH) to better reflect their intended use and eliminate potential land use conflicts. The developer has been advised of this. Surrounding Land Uses The subject lands are currently used for agriculture. The rechanneled portion of Warren Creek bisects the subject lands in the centre of the proposed subdivision. There is also an exsiting stormwater management pond adjacent to the rechanneled Warren Creek. February 11, 2014 - 3 - PBD-2014-12 To the north are additional lands owned by the developer (to be developed in a future phase), a Hydro Corridor owned by the Province of Ontario (Hydro One Networks Inc.) and a residential subdivision (Warren Woods Phases 1 and 2), which is under construction. To the south is a Provincially Significant Wetland (PSW). To the east is farmland. Circulation Comments • Regional Municipality of Niagara (the Region) No objections. The Region provided several conditions to address standard development requirements. These conditions have been incorporated into Appendix A. • Niagara Peninsula Conservation Authority (NPCA) No objections. The NPCA advises that it does not support the construction of any trail system within required buffers of Provincially Significant Wetlands (PSW). The walkway (Block 230) is not within any buffer lands and the rechanneled portion of Warren Creek is not considered a PSW. The NPCA provided several conditions to address their interests, including the road crossing of the rechanneled Warren Creek. • Fire Services Fire Services has concerns with the proposed street pattern at the north end of the subdivision, specifically the lack of connections between Streets E, F, and G as well as Butternut Boulevard. The Developer has advsied that Butternut Boulevard will be extended north over the rechanneled portion of Warren Creek and Hydro Corridor to connect with the existing portion of Butternut Boulevard as part of construction of this subdivision. A condition has been included in Appendix A requiring the developer to provide temporary streets to connect Streets F and G and to connect Street E with Butternut Boulevard. The temporary streets would revert to lots in a future phase of the subdivision. The developer is agreeable to this condition. Additional conditions have been included in Appendix A to address standard Fire Services requirements such as sufficient water supply and road widths. • Hydro One No objections. Hydro One provided several conditions pertaining to development in proximity to their Corridor as well as crossing over it with roads and servicing infrastructure. • Municipal Works, Transportation Services, Parks Design, Enbridge Gas, Bell Canada, and Canada Post No objections. Requested conditions included in Appendix A. February 11, 2014 -4- PBD-2014-12 Neighbourhood Open House A neighbourhood open house was held on January 8, 2014. No one from the public attended. ANALYSIS/RATIONALE 1 . Provincial Policy Statement and Growth Plan The applications are consistent with the Growth Plan and Provincial Policy Statements as follows: • the applications involve development of land within the urban boundary and a Greenfield area; • the proposed subdivision is calculated to achieve 59 people per hectare which exceeds the Growth Plan target of 50 people/jobs per hectare for Greenfield development; • the proposed subdvision contributes to the City's short term and long term supply of building lots; and • the proposed development maintains appropriate setbacks from the rechanneled Warren Creek. Therefore, Planning staff considers the applications to be consistent with the Provincial Growth Plan and Provincial Policy Statements. 2. Garner South Secondary Plan The subject lands are located within the Garner South Secondary Plan area. The Plan provides details on how land is to be developed. The Plan is part of the City's Official Plan. The lands are designated Low Density Residential, in part, Medium Density Residential, in part, and Environmental Protection Area, in part. The applications conform to the Secondary Plan as follows: • the subdivision has an overall density of 22 units per hectare (the low density portion is 19 units per hectare which is above the 16 units per hectare requirement for low density residential - the medium density portion is 51 units per hectare, which is above the 50 units per hectare requirement for medium density residential); • the subdivision provides a variety of lot sizes, which contributes to the variety of housing options in the City; • the subdivision will contribute to a future trail and open space system by providing a connection to the rechanneled Warren Creek; and • the subdivision provides streets that can connect with the streets in Warren Woods Phases 1 and 2 to the north and will facilitate connections with future subdivisions. February 11, 2014 - 5 - PBD-2014-12 Therefore, Planning staff consider the applications to conform with the Secondary Plan. 3. Zoning By-law Amendment The subject lands are currently zoned LI in accordance with Zoning By-law No. 79- 200. The zoning of Lots 1 to 224 and Blocks 225 to228 is requested to be changed to the R3 zone with several site-specific provisions. Driveway 50% or 8 m. 60% of lot frontage 60% of lot Width (whichever is lesser) frontage February 11, 2014 -6 - PBD-2014-12 The requested amendments can be supported for the following reasons: • the regulations for single detached dwellings will facilitate compact form and provide a variety of housing options; • a lot coverage regulation for the single detached and townhouse dwellings is unnecessary because the development of the compact lots and blocks will be adequately addressed by building setbacks; • 2 storey dwellings with steeply pitched roofs are acceptable; and • the building setbacks maintian adequate separation distances between dwellings and the street. The applicant is requesting Block 229 to be rezoned from LI to R5A with a site-specific provision for a maximum lot area of 192 square metres per dwelling unit to permit an apartment building with a minimum of 50 dwelling units. Note that the minimum lot area will have to be changed to avoid a conflict. A minimum lot area of 133 sqaure metres per unit should be used which would allow a maximum density of 75 units per hectare. This is consistent with the maximum density permitted under the Garner South Secondary Plan and will ensure that Block 229 is developed as intensely as required by the Secondary Plan. The applicant is also requesting Block 230 to be rezoned to OS with site-specific provisions for a minimum lot area of 620 square metres, a minimum lot frontage of 8 metres and the elimination of setbacks for a gazebo or similar landscape structure. The City concurently proposes to rezone the re-channeled Warren Creek to EPA and some additional lands owned by the applicant to DH. These amendments can be supported because: • the regulations for the OS zone will reflect that Block 230 is intended to serve as a walkway and gateway to the trail; • the EPA zone will recognize the watercourse as an important feature that should be protected; and • the DH zone will help prevent the introduction of incompatible uses on lands immediately abutting the proposed subdivision. 4. Subdivision Design and Conditions of Approval The proposed subdivision is the third phase of development in this planned community. The proposed subdivision will be connected to the phases currently under construction by extending Butternut Boulevard north over the rechanneled portion of Warren Creek and across the Hydro Corridor. The applicant will have to design the Creek crossing to City standards and satisfy all legal requirements of Hydro for crossing the Corridor, at his expense. Butternut Boulevard will have to be constructed in its entirety from Brown Road to Phase 1 at such a time as the portion between Warren Creek and the Hydro Corridor is constructed to ensure access does not exceed more than 150 metres in length. Conditions have been included to address these matters. The road pattern in the proposed subdivision generally provides good movement of traffic with multiple connections to Brown Road. Transportation Services has no February 11, 2014 -7 - PBD-2014-12 objections to this, but will require a traffic study that examines the impact of all future phases of Warren Woods on the road system. These matters are addressed in the conditions of draft approval. Fire Services has expressed concerns about the lack of connectivity of Streets E, F, and G. The developer intends to extend these streets in a future plan of the subdivision. Until such time, a temporary connection between these streets will be required to ensure proper emergency access. A condition has been added to address this issue. Parkland dedication will be taken for this subdivision as cash-in-lieu in accrodance with the Planning Act (minus credit for Block 230). The applicant is proposing to erect a gazebo on Block 230 and donate it to the City. This donation will not count towards the parkland dedication requirement. Appropriate conditions have been included to address this matter. The balance of the conditions in Appendix A are standard conditions of draft plan approval and include the dedication of necessary road widenings and daylight triangles, installation of municipal services, provision of utilities to the subdivision and the naming of streets to the satisfaction of the City. FINANCIAL IMPLICATIONS The proposed development will generate development charge contributions and property tax revenue for the City. There are no other financial implications. CITY'S STRATEGIC COMMITMENT The proposed subdivision complies with the City's Official Plan. Approval applies to the Warren Woods Estates Phase 3 Draft Plan of Subdivision prepared by Upper Canada Consultants, dated October 24, 2013, showing 224 lots for single detached dwellings, 4 blocks for on-street townhouse dwellings, one block for an apartment building and one block for a walkway. 2. The developer enter into a registered Subdivision Agreement with the City to satisfy all requirements, financial and otherwise, related to the development of the subject lands. Note: Should any other body wish to have its conditions included in the Subdivision Agreement, they may be required to become party to the Subdivision Agreement for the purpose of enforcing such conditions. 3. The developer submit a Solicitor's Certificate of Ownership for the subdivision lands to the City Solicitor prior to the preparation of the Subdivision Agreement. 4. The subdivision be designed and constructed in accordance with City standards which, in part, includes the following: (a) roadways and sidewalks to municipal requirements; (b) dedication of a 3 metre road widening along the frontage of Kalar Road (Block 231 on the draft plan) and Brown Road (Block 231 on the draft plan) as a public highway; (c) dedication of a daylighting triangle with 12 metre legs at the intersection of Brown Road and Kalar Road (northwest corner); (d) dedication of daylighting triangles with 7 metre legs at the intersection of Brown Road and Butternut Boulevard; (e) dedication of daylighting triangles with 5 metre legs for all remaining intersections on the draft plan; (f) dedication of all road allowances to the City as public highway to the City's satisfaction; (g) all streets named to the City's satisfaction; (h) provision of water distribution, sanitary sewer and storm sewer systems in accordance with the Ministry of the Environment and the City Engineering Standards Manual as amended; (i) sump pump discharges directed to the storm sewer and all rainwater leaders outlet to grade and be directed to the front/rear yards; (j) provision of an overland stormwater flow route, designed and constructed in accordance with the City Engineering Standards Manual as amended; and (k) application of the City's Lot Grading and Drainage Policy in accordance with the City Engineering Standards Manual as amended. 5. The developer grant the City and public utility companies any easements required to service the subdivision. 9. The developer provide tender documents and digital data, in accordance with the Niagara Peninsula Standard Contract Document format and Regional and City CAD standards, to the City in compliance with current PSAB requirements. 10. The developer pay the required fees for Engineering Inspection and Administration for the subdivision. 11. The developer submit a landscape plan showing details of fencing, entry features (if any), trails, and any other landscape features to the satisfaction of the City's Landscape Architect. 12. The developer submit a plan for Block 230 that shows details of any proposed gazebo or similar landscape feature to the satisfaction of the City's Landscape Architect. Note that any gazebo donated to the City under the City's Park Donation Program shall not be credited towards the provision of parkland dedication or cash- in-lieu thereof. 13. The developer provide a 1.5 metre high black vinyl chain link fence (or other standard approved by the City) along the rear lot line of Lots 1-39, 134-154, and 209-224 (all inclusive); Blocks 225, 226, and 229; along the interior side lot lines of Block 230, to the satisfaction of the City. 14. The developer provide a 1.8 metre high board on board fence along the rear lot line of Blocks 227 and 228 and the common lot line between Blocks 226 and 229, to the satisfaction of the City. 15. The developer accommodate the provision of one boulevard tree per lot and two boulevard trees per corner lot and pay to the City $300 per tree for this provision, in accordance with City policy. 16. The developer pay the City cash-in-lieu of parkland dedication in the amount equal to 5% of the appraised value of the lands to be subdivided as determined by a qualified appraiser, to the satisfaction of the City. 17. The developer submit a traffic impact study that evaluates the traffic impact of the entire Warren Woods Subdivision by phase to the satisfaction of Transportation Services. 18. The developer provide speed control devices in the subdivision to the satisfaction of Transportation Services. 19. The developer provide 0.3 metre reserves along the Brown Road frontage of Lots 1 (Block 232 on the draft plan), 133 and 112 (Block 233 on the draft plan), 111 and 89 (Block 234 on the draft plan), 88 and 66 (Block 235 on the draft plan), 65 and 48 (Block 236 on the draft plan), 47 and Block 227 (Block 237 on the draft plan) and Block 229 (Block 238 on the draft plan). February 11, 2014 - 12 - PBD-2014-12 20. The developer provide temporary roads connecting Streets F and G and Street E with Butternut Boulevard to the satisfaction of the City. 21. The developer demonstrate to Fire Services' satisfaction that adequate water supply for fire fighting purposes is available and accessible with sufficient volume and flow to facilitate fire fighting operations prior to obtaining Building Permits. 22. That parking restrictions be imposed to Fire Services satisfaction prohibiting parking on one side of the road where the asphalt width is less than 8 metres and on one side of the road within residential culde-sacs. 23. The developer shall extend Butternut Boulevard over the rechanneld portion of Warren Creek and over the Hydro Corrior to connect with Butternut Boulevard in Phase 1 of the Warren Woods Subdivision prior to the issuance of any Building Permits for this subdivision. Wording shall be placed in the Subdivision Agreement to this effect. 24. The developer submit servicing plans to Municipal Works and Fire Services for review. Note that the Municipal Works Department is responsible for final approval of said servicing plans. 25. The developer receive final approval of the Zoning By-law amendment to provide land use regulations to guide the development of the subdivision. 26. The developer provide three calculated plans and a letter prepared by an Ontario Land Surveyor to Planning, Building & Development confirming that all lots and blocks comply with the Zoning By-law. 27. The developer provide five copies of the pre-registration plan to Planning, Building & Development and a letter stating how all the conditions imposed have been or are to be fulfilled. 28. The developer is hereby advised that prior to commencing any work within the Plan, the developer must confirm that sufficient wire-line communication/ telecommunication infrastructure is currently available within the proposed subdivision to provide communication/telecommunication service to the proposed subdivision. In the event that such infrastructure is not available, the developer is hereby advised that the developer may be required to pay for the connection to and/or extension of the existing communication/telecommunication infrastructure. If the developer elects not to pay for such connection to and/or extension of the existing communication/telecommunication infrastructure, the developer shall be required to demonstrate to the municipality that sufficient alternative communication/telecommunication facilities are available within the proposed development to enable, at a minimum, the effective delivery of communication/ telecommunication services for emergency management services (ie. 911 Emergency Services). 29. That the developer agree, in the Subdivision Agreement, in words satisfactory to Bell Canada, to grant to Bell Canada any easements that may be required for telecommunication services. Easements may be required subject to final servicing decisions. In the event of any conflict with existing Bell Canada facilities or easements, the developer shall be responsible for the relocation of such facilities or easements. February 11, 2014 - 13 - PBD-2014-12 30. The developer will consult with Canada Post to determine suitable permanent locations for the Community Mail Boxes (CMB). The developer will then indicate these locations on the appropriate servicing plans. 31. The developer agree in the Subdivision Agreement, in words satisfactory to Canada Post, to grant to Canada Post any easements that may be required for the installation of CMBs on private property. 32. The developer include in all offers of purchase and sale, a statement that advises the prospective purchaser that mail will be delivered via a Community Mail Box CMB, and that the developer will be responsible for officially notifying affected homeowners of any established easements granted to Canada Post to permit access to CMBs. 33. The developer satisfy all requirements of Canada Post regarding concrete pads for CMBs, temporary CMBs, walkways to CMBs, curb depressions for wheelchair access, informing potential homeowners of CMB locations, timing of construction and identification of CMBs and related works on engineering servicing drawings. 34. The following wording be added to the subdivision agreement: "2124487 Ontario Ltd. covenants and agrees to provide the City of Niagara Falls with evidence that satisfactory arrangements, financial or otherwise, have been made with Canada Post Corporation for the installation of Community Mail Boxes (CMB) as required by Canada Post Corporation and as shown on the approved engineering design drawings/draft plan, at the time of sidewalk and/or curb installation. The developer further covenants and agrees to provide notice to prospective purchasers of the locations of CMBs and that home/business mail delivery will be provided via CMB, provided 2124487 Ontario Ltd. has paid for the activation and equipment installation of the CMBs." 35. The developer contact Enbridge Gas Distribution's Customer Connections Department by emailing salesarea80 @enbridge.com for service and meter installation details and to ensure all gas piping is installed prior to the commencement of site landscaping (including , but not limited to: tree planting, silva cells, and/or soil trenches) and/or asphalt paving. 36. The developer provide Enbridge Gas Distribution the City approved road cross- sections showing all utilities in the proposed configuration. 37. The developer grade all streets to final elevation prior to installation of the gas lines and provide Enbridge Gas Distribution Inc. with the necessary field survey information required for installation of gas lines. 38. The developer provide Enbridge Gas Distribution with the necessary easements if any gas lines need to be installed outside of the proposed road allowances. 39. The developer provide a 3 metre by 3 metre exclusive use location for a pressure reducing regulator station. The regulator station cannot project into the municipal road allowance. The final size and location of the regulator station will be confirmed by Enbridge Gas Distrubution's Customer Service Department. February 11, 2014 - 14- PBD-2014-12 40. Prior to final approval, copies of the lot grading and drainage plan, showing existing and final grades, must be submitted to Hydro One Networks Inc. (HONI) in triplicate for review and approval. Drainage must be controlled and directed away from the Ontario Infrastructure & Lands Corporation (OILC)/HONI tranmission corridor. 41. Temporary fencing must be installed along the edge of the tranmission corridor, at the developer's expense, prior to the start of construction. 42. Permanenet 1.5 metre high fencing must be installed along the mutual property line, at the developer's expense, after construction is completed. 43. The OILC/HONI tranmission corridor is not to be used without the express permission of HONI on behalf of OILC. During construction there will be no storage of materials or mounding of earth, snow or other debris on the tranmission corridor. The developer will be responsible for restoration of any damage to the transmission corridor or HONI facilities thereon resulting from construction of the subdvision. 44. HONI's letter of January 29, 2014 and the conditions contained therein, should in no way be construed as permission for or an endorsement of proposed location(s) for any road crossing(s) contemplated for the proposed development. This permission may be specifically granted by OILC under separate agreement(s). Proposals for any secondary land use including road crossings on the tranmission corridor are processed through the Provincial Secondary Land use Program (PSLUP). HONI, as OILC's service provider, will review detailed engineering plans for such proposals separately, in order to obtain final approval. Should future approval for a road crossing be granted, the subdivider shall then make arrangements satisfactory to OILC/HONI for the dedication and tranfer of the proposed road allowance directly to the City of Niagara Falls. Access to and road construction on the OILC/HONI tranmission corridor is not to occur until the legal transfer(s) of lands or interest are completed. 45. The costs of any relocations or revisions to HONI facilities that are necessary to accommodate this subdivision will be borne by the developer. 46. If the proposed development is within proximity to a Tranmission or Distribution station, the following applies: (a) The developer hereby confirms and agrees that every agreement of purchase and sale heretofore and hereafter entered into by the developer with any purchaser(s) of any lot/unit or proposed lot/unit in the subdivision contains the following notice/warning provisions (or clauses substantially similar thereto in all respects), namely: "Each lot/unit purchaser and/or lessee specifically acknowledges and agrees that the development of the lands upon which this subdivision is being (or has been) constructed, will be (or has been) undertaken and completed in accordance with any requirements that may be imposed from time to time by any Governmental authority, and that the proximity of this subdivision to facilities, installations and/or equipment owned and/or operated by HONI may result in noise, vibration, electro-magnetic interference and stray current transmissions (hereinafter collectively referred to as the"Interferences")to this subdivision, and despite the inclusion of control features within this subdivision, Interferences from the aforementioned sources may, occasionally interfere with some activities of the occupants in this subdivision. Nothwithstanding the above, each unit purchaser and/or lesee agrees to indemnify and save February 11, 2014 - 15 - PBD-2014-12 harmless HONI, from and against all claims, losses, judgments or actions arising or resulting from any and all of the interferences. In addition, it is expressly acknowledged and agreed that HONI does not, and will not, accept any responsibility or liability for any of the Interferences in respect of this subdivision and/or its occupants. Furthermore, there may be alterations and/or expansions by HONI to its facilities notwithstanding the inclusion of any noise and vibration attenuating measures in the design of the subdivision. HONI will not be responsible for any complaints or claims of any kind howsoever arising from use, expansion and/or alterations of such facilities and/or operations on, over or under its transformer station. Furthermore, each lot/unit Purchaser and/or lessee acknowledges and agrees that an electro-magnetic, stray current and noise-warning/vibration clause similar to the foregoing shall be inserted into any succeeding or subsequent sales agreement, lease or sublease, and that this requirement shall be binding not only on the Purchaser hereunder but also upon the Purchaser's respective heirs, estate trustees, successors and permitted assigns, and shall not cease or terminate on the closing of this purchase and sale transaction with the Vendor/Declarant." (b) The developer covenants and agrees that so long as the City does not object thereto, the language set out in Condition 46(a) hereof (or language substantially similar thereto) shall also be included in the Subdivision Agreement entered into by the developer with the City of Niagara Falls to be registered on title of the subdivision. 47. The developer is advised that the tranmission lines abutting this subdivision operate at 500,000, 230,000 or 115,000 volts. Section 188 - Proximity- of the Regulations for Construction Projects in the Ocupational Health and Safety Act, require that no object be brought closer than 6 metres (20 feet) to an energized 500 kV conductor. The distance for 230 kV conductors is 4.5 metres (15 feet) and for 115kV conductors is 3 metres (10 feet). It is the developer's responsibility to be aware, and to make all personnel on site aware, that all equipment and personnel must come no closer than the distances specitifed in the Act. They should also be aware that the conductors can rise and lower without warning, depending on the electical demand placed on the line. 48. The developer provide a letter of credit, or an accetable alternative, and enter into a legal agreement for the water and wastewater portion of the Regional Development Charges within 12 months of Draft Plan Approval (or Extension)of the plan of subdivision, unless evidence of a complete Ministry of the Environment application for servicing has been made within this time, to the satisfaction of the Niagara Region Public Works Department (Development Services Division). 49. Prior to final approval for registration of this plan of subdivision, the developer submit the design drawings (with calculations) for the sanitary and storm drainage systems required to service this development and obtain Ministry of the Environment Environmental Compliance Approval under the Transfer of Review Program to the satisfaction of the Niagara Region Public Works Department (Development Services Division). 50. That the developer receive acceptance from the Ministry of Tourism, Culture and Sport for the archaeological assessment report titled "Stage 1 and 2 Archaeological Asessment of the Warren Woods Property" prepared by Archaeological Services Inc., dated January 2007. No demolition, grading or other soil disturbances shall take place on the subject property prior to the issuance of a letter from the Ministry of Tourism, Culture and Sport through the Niagara Region Public Works Departement (Development Services Division), confirming that all archaeological resource concerns have met licensing and resource conservation requirements. 52. That the following clause be included in the Subdivision Agreement between the developer and the City of Niagara Falls: "Should deeply buried archaeological remains/resources be found on the property during construction/grading activities, the Heritage Operations Unit of the Ministry of Tourism, Culture and Sport in London (519-675-7742) and the developer's archaeology consultant shall be notified immediately. In the event that human remains are encountered during construction/grading, the developer must immediately notify the police or coroner, the Registrar of Cemeteries of the Ministry of Consumer Services in Toronto (416-326-8392), the Ministry of Tourism, Culture and Sport, and the developer's archaeology consultant." 53. That detailed sedimentation and erosion control plans be submitted to the NPCA for review and approval. All sediment and erosion control measures shall be maintained in good condition for the duration of construction until all disturbed surfaces have been stabilized. Libertarians advocate individual liberty through free markets, property rights, limited government, and voluntary associations. We believe that the role of government should be confined to creating the conditions where businesses and individuals can voluntarily interact knowing that the law protects their rights. Building hospitals and post secondary schools, improving commuter train service, running casinos and airports, are all business ventures that properly should be in the realm of private enterprise. Unfortunately, all of these are monopolies of government and as such, are subject to the whims of politicians who are primarily interested in getting re-elected. So they use their incumbency to buy votes. At the same time these same politicians tend to ignore vital infrastructure in their own community. As your letter indicates, every municipality is suffering "infrastructure deficits". So what sort of assistance would you expect from other jurisdictions? It seems to me infrastructure sustainability is your Council's primary responsibility, as the Niagara Falls 2011-2014 Strategic Priority document indicates. If elected, the immediate goal of a Libertarian government would be to reduce spending so that it falls well below the level of revenues. Once that has been achieved, Libertarians would reduce provincial income tax tier rates, as well as the HST, and gasoline taxes. Corporate taxes would be reduced then eliminated. All those measures taken together would let people keep more of their earnings, encourage investment, and allow the creation of thousands of jobs in the Niagara region while making the whole of Ontario an economic gateway zone for Canada. EXECUTIVE SUMMARY The application can be supported for the following reasons: • the application was supported in 2013 for the installation of a sprinkler system in the building as the funding will assist in improving the safety of the building; and • the extension of the approval for 1 year will allow the new owner some time to arrange for financing of the sprinkler system. BACKGROUND In May of 2013, City Council approved an application for funding under the Commercial Building Improvement Grant Program in the amount of $10,000 for the installation of a sprinkler system at 4238-4240 Bridge Street. The approval for CB&FIG-2013-004 is set to expire in May 2014. The property, which now houses a paint ball facility and 18 residential units, has recently been sold and the new owner has requested an extension to the approval of the grant. The extension would provide the new owners some additional needed time to arrange finances for the installment of the sprinkler system, estimated at approximately at $35,000. The installation of the sprinkler system is not a requirement of the City. February 11, 2014 -2 - PBD-2014-14 The Grant Incentive Programs under the CIP were intended to assist in the rehabilitation and renovation of the Downtown in a timely fashion and included an expiration deadline of 1 year from the date of approval. In this way funds allocated by the City for improvements can be put into action in the short term where needed rather than be tied up for unspecified amounts of time. The requested extension illustrates a commitment by the new property owner to continue to improve the structure even though the recent purchase of the property has not left them in the financial position of installing the sprinkler system before May of this year. In consideration of this, Planning staff can support an extension of one year to May 30, 2015. If further time is needed by the new owner, a new application can be made after May 2015, subject to the availability of funds by the City without additional cost to the owner since there is no fee for Grant Incentive Program applications. All of the requirements of the incentive program including the requirement for permits and an agreement must be satisfied as per the original approval. FINANCIAL IMPLICATIONS The extension of the approved grant will have no further financial implications on the unencumbered balance for the Downtown CIP Special Reserve. CITY'S STRATEGIC COMMITMENT The approval of the application will satisfy Council's strategic priority by implementing the financial incentive programs within the Downtown CIP and will assist in the ongoing revitalization of the Downtown area. W. Palmer Park. EXECUTIVE SUMMARY Niagara Girls Minor Softball Association has requested the opportunity to utilize part of the storage building at C. W. Palmer Memorial Park to store their equipment. In the past, the equipment had been stored at the Optimist Park Youth Building. BACKGROUND Niagara Girls Minor Softball Association utilized the ball diamonds and storage facility at Optimist Park. With the removal of the ball diamonds at Optimist Park the organization will be allocated diamonds at C.W. Palmer Memorial Park and at the Patrick Cummings Memorial Sport Complex. C. W. Palmer Memorial Park storage facility was utilized by an adult slo-pitch league from 2000 - 2005 at no cost. ANALYSIS/RATIONALE At the present time, the storage building at C.W. Palmer Memorial Park is vacant. The use of the building permits the Association to store its equipment at no cost compared to paying for a storage facility. The City's practice has been to charge no fee for such licensing agreements when the would be licencee is a local non-profit sports organization. The PRC Strategic Plan Update (2013) recommended additional ball diamonds and an outdoor building with storage be built in the next five years at Patrick Cummings Memorial Sport Complex. The plan is to have the new diamonds and facility built by the 2019 spring/summer ball season. EXECUTIVE SUMMARY The existing "No Parking Except by Disabled Permit" restriction was established when the Boys and Girls Club was operating at 6681 Culp Street. Now that the former building has been demolished and housing is proposed for the remnant lands, the disabled parking zone is no longer required. BACKGROUND Carlton Avenue is a 7.5 metre wide local roadway. It consists of an asphalt boulevard and concrete sidewalks on both sides. In November 2008 a "No Parking Except by Disabled Permit" restriction was installed on the west side of Carlton Avenue between Culp Street and a point 54 metres north of Culp Street when the Boys and Girls Club of Niagara occupied the lands on the northwest corner of Carlton Avenue and Culp Street. The remainder of the west side is restricted to parking except by permit, allowing local residents in possession of a parking permit to park on the roadway. A permit parking restriction also encompasses the entire east side of Carlton Avenue between Culp Street and Barker Street. The existing "No Parking Except by Disabled Permit" restriction was installed as a result of a request by the Boys and Girls Club administrator to accommodate persons with disabilities close to their entrance. The Boys and Girls Club of Niagara closed the facility located on Carlton Avenue in 2011, shifting operations to the newly constructed facility located on McLeod Road. The area is being redeveloped with low density residential dwellings. ANALYSIS/RATIONALE The relocation of the Boys and Girls Club facility from Carlton Avenue to McLeod Road removes the need for the "No Parking Except by Disabled Permit" restriction. The change February 11, 2014 -2- TS-2014-06 in parking control will increase the on-street parking capacity for local residents. FINANCIAL/STAFFING/LEGAL IMPLICATIONS The modification of the signs will be carried out by Transportation Services staff. The labour and material cost has been accounted for in the 2014 General Purposes Budget. The estimated cost to replace the signs is approximately $150. EXECUTIVE SUMMARY Left turn prohibitions are warranted at the Optimist Square into and out of the Dorchester Road access and the eastern Morrison Street access. The same restriction is in place for the Zehr's driveway on the west side of Dorchester Road, south of Morrison Street. BACKGROUND Site plan approval was recently granted to allow for the construction of a commercial plaza on the northwest corner of Dorchester Road and Morrison Street. Three accesses are proposed to the development - one on Dorchester Road and two on Morrison Street. During the site plan process, Transportation Staff identified that the proposed Dorchester Road access and the eastern Morrison Street access had to be limited to right-in-right-out movements, given their proximity to the signalized intersection. The developer incorporated this condition into the site design by including an island at both accesses. The western Morrison Street driveway will allow for all movements. This driveway is directly opposite the Adam's Centre access near the Boston Pizza. ANALYSIS/RATIONALE Although the design of the channelized triangular islands will clearly discourage left turn movements, drivers may attempt to carry out left turns as centre medians do not exist along Morrison Street and Dorchester Road adjacent to these driveways. Turn prohibitions can only be enforced when regulatory signs as prescribed by the Highway Traffic Act are present. Accordingly, Staff is recommending that left turn prohibition signs along with strategically placed "Do Not Enter" and "$85.00 Fine" signs be installed at the two aforementioned accesses. EXECUTIVE SUMMARY The City of Niagara Falls has been petitioned by the Town of Fort Erie to be the initiating municipality to provide an outlet for a roadway within their jurisdiction which is the St. John's Marsh Drain tributary area in Niagara Falls. Pursuant to Section 8 of the Drainage Act, the City shall by by-law or resolution appoint an engineer to make an examination of the site. BACKGROUND Willow Road, which is under the jurisdiction of the Town of Fort Erie, also represents the municipal boundary between Fort Erie and Niagara Falls. The existing watercourse flows north easterly from Fort Erie into Niagara Falls and outlets into St. John's Marsh Drain headwaters. St. Johns Marsh Drain was initially constructed in 1948 by the Town of Willoughby (Niagara Falls) in partnership withe the Town of Bertie (Fort Erie) and has had minimal maintenance over the years. ANALYSIS/RATIONALE With this petition the Town of Fort Erie is requesting the City of Niagara Falls to investigate the requirement for the improvement of the St. John's Marsh Drain which affects Willow Road drainage. Once drains are established, it is incumbent on the local municipality to complete regular maintenance that ensures it performs as expected. FINANCIAL/STAFFING/LEGAL IMPLICATIONS All project costs levied to the City will be included in our assessment schedule forms as part of the Drainage Engineers Report. Costs assessed to the landowners for benefit and outlet will be invoiced to the residents once construction is completed. Since there are no City of Niagara Falls road allowances benefiting from the project, there will be no assessments levied to the City. EXECUTIVE SUMMARY Last Fall, Municipal Works staff informed Council of the need to commence engineering investigations to remediate significant damage to the Buttrey Street Sewer Outfall and engaged the services of Hatch Mott MacDonald to complete the design phase. This work is now complete and the necessary repairs have been estimated to cost between $300,000 to $500,000 depending on the weather conditions. This work needs to be done in the area of the Niagara Parks Commission's White Water Walk Attraction, which is closed for the season but is scheduled for re-opening Easter weekend. As a result the City's contract needs to be completed by April 4, 2014 as the NPC requires two weeks to complete rock scaling and boardwalk restoration before re-opening the attraction to the public. Municipal Works staff are working on a fast track schedule and in order to provide the contractor with a five week construction window. The contract award process needs to be shortened. Staff are seeking authorization to; 1. Seek pre-approval of this Capital Project up to a maximum limit of $500,000. 2. Authorize staff to issue, award and initiate the construction contract with the successful contractor having met the prescribed qualifications criteria as evaluated by the project team. 3. Execute the necessary contract documentation. February 11, 2014 -2 - MW-2014-08 Staff have been working cooperatively with NPC staff to complete the emergency repairs in a timely manner. There will, however be some disruption to the WEGO service and access restrictions to the properties in the immediate area including detours and temporary closures on River Road during this period. BACKGROUND At its meeting on November 26, 2013, City Council adopted the recommendations set out in report MW-2013-59 (see attachment 1). Through the investigations completed by the consulting engineer, Hatch Mott Macdonald, it was determined that the outfall required urgent attention due to the volume of water expected to be discharged during wet weather storm events and the safe operation of the boardwalk which traverses the outfall structure. ANALYSIS/RATIONALE The available construction window creates a challenge from the perspective of timing and funding. Approval of the City's Capital Budget is not expected until later this Spring. Pre-approval of this spending (up to a maximum of $500,000) is manageable, given the emergency nature of this work. The construction schedule is necessary to minimize the impact on businesses in this area, including the White Water Walk attraction. Staff will be co- ordinating detour routes, business signage and transit changes as soon as possible. While the project is expected to be completed within a five week period, it will be challenging to mitigate the impacts of weather especially at this time of year. The construction contract will include penalties (liquidated damages) for work completed after the April 4, 2014 deadline. Since time is of the essence, it is critical that the contractor selected has the resources (i.e. manpower and equipment) and experience to work on this type of project. For this reason staff are requesting that price be only one of the criteria used to select the successful bidder. The tender process to be followed will use an evaluation based on the following criteria; Price (30%) Delivery (20%) Qualifications/Experience of Staff (30%) Health & Safety Standards (10%) Subcontractor Experience (10%) February 11, 2014 -3 - MW-2014-08 The project schedule is tentatively set out as follows: February 11, 2014 Council Pre-Approval/Tender will be issured February 14, 2014 Mandatory Site Inspection Meeting February 25, 2014 Tender Close/Evaluation/Award March 3, 2014 Commence Construction April 4, 2014 Complete Construction FINANCIAL IMPLICATIONS This project was intended to be considered as part of the 2014 Capital Budget deliberations, however, given the urgent nature of the project the funding should be committed at the actual tendered amount up to $500,000. If the tendered prices received exceed this amount an additional report will be brought back to Council for their consideration. Attached is the Capital Project Budget Worksheet for the construction work with funding provided from the 2014 capital funding in the wastewater budget. It is acknowledged that the City's Purchasing Policy has been slightly modified to emphasize the importance of relevant project experience and available resources. While the tender price is a significant factor, it is more important that the impact of this construction on the affected area businesses is mitigated by selecting the most capable Contractor. EXECUTIVE SUMMARY On October 21, 2013, City staff were contacted by the Parks Commission and were informed that there had been significant damage to a storm sewer outfall at the bottom of the gorge near Buttrey Street. It is believed that this damaged occurred during the storm events in July and August 2013. On October 25, 2013, City and Parks Commission staff conducted a site visit to assess the damage to the storm sewer outfall. Upon review, it was found that the structural integrity of the outfall has been significantly compromised. The damage that has occurred is concerning as the board walk for the White Water Walk passes directly over this outfall and uses the top of the structure to support the board walk. Temporary measures have been taken to ensure the board walk is structurally stable. City staff are looking to engage the services of Hatch Mott MacDonald to investigate the cause of the damage and find a solution. The purpose of this report is to commence the engineering design immediately so that remedial repairs or replacement of this outlet structure can be tendered and completed before the re-opening of the attraction in the Spring of 2014. The design work outlined in this report is an addition to the 2013 Capital Budget with funding of$90,000 provided from the Sewer Capital Reserve account. November 26, 2013 -2 - MW-2013-59 BACKGROUND The original storm outfall was constructed in the 1920's and was designed as a sewer outlet to the Niagara River. This outfall drained the area of Niagara Falls known as Silver Town. Over the years as the sewer network was separated and expanded additional connections have been made to the outfall. In its current configuration, the outfall still drains Silver Town and is the overflow for both the Muddy Run pumping station and the High Rate Treatment Facility. On October 21, 2013, City staff were contacted by the Parks Commission and were informed that there had been significant damage to a storm sewer outfall at the bottom of the gorge near Buttrey Street. It is believed that this damaged occurred during the storm events in July and August 2013. On October 25, 2013, City and Parks Commission staff conducted a site visit to assess the damage to the storm sewer outfall. Upon review, it was found that the structural integrity of the outfall has been significantly compromised. City, Parks Commission and Hatt Mott MacDonald staff, conducted a second site visit on November 8, 2013. During this visit it was determined that along with being displaced, there has also been significant structural damage to the north side of the structure. At some point, a chamber was added to the end of the outfall to direct the flows underground to the river. It is believed this was done to keep any of the sewer debris/odour out of the site of the public visiting the White Water Walk. This can be seen in Figure 5.0. j Al , # r .�q, ca.I. This was due to a combination of storm flows from Silver Town and the overflow from the Muddy Run pump station and the High Rate Treatment Facility. The new chamber that was added to the outfall would have restricted the flow, causing the system to back up. There are two possible causes that will be investigated to determine if they contributed to the damage done to the outfall. The first possible cause is, air became trapped in the sewer system and was put under extreme pressure due to the large flows. The structure was not able to withstand the increasing pressures and the resulting structural damage occurred. The second possibility, is that the damage was caused by the immense pressure created when the storm water backed up the vertical shaft of the outfall (approximately 80 m). The structure was not able to withstand the increasing pressure and the resulting structural damage occurred. In its current condition the outfall is not structurally sound and does not convey water as it was intended. Should another large storm event occur, further damage will be done which may result in a catastrophic structural failure of the outfall. A structural failure of the outfall structure will result in structural damage to the board walk above. If this was to occur while the White Water Walk was in operation, there could be injury to the public. The timeline for this project has been accelerated due to the outfall's location under the board walk. Hatch Mott MacDonald is looking at a two phase approach. Emergency repairs will be completed early in 2014 to make the outfall safe. This will allow the White Water Walk to open in spring 2014. The permanent solution will be designed in 2014 and constructed between November 2014 and April 2015. ANALYSIS/RATIONALE The City of Niagara Falls does not have a Structural Engineer in their current staff complement. The outfall is located on the slope of the gorge between the vertical face and the river. The area is very rocky and covered with trees, making the working conditions extremely difficult. Special consideration will have to be given to the constructability of any proposed solutions. The window of time to complete the design and implementation of the repairs is very limited and requires immediate action to meet the April 2014 deadline. It is for these reasons that City staff are recommending retaining Hatch Mott MacDonald as the consultant for this project. FINANCIAL IMPLICATIONS This project is required due to an in year incident that was not foreseen at the time that the 2013 capital budget was approved. Hatch Mott MacDonald has submitted a proposal for $90,000 for the review and design of this project. Attached is a capital Project Budget November 26, 2013 -6 - MW-2013-59 Sheet for the design work. Staff recommend the expenditure be funded by the Capital reserve for sewers. Once the design work is completed, the construction phase of the project will be considered during the 2014 Capital Budget deliberations.
