A by-law to appoint an Acting City Clerk.
WHEREAS s. 228 of the Municipal Act sets out the duties of the clerk for the municipality;
and
WHEREAS s. 228 (4) of the Municipal Act allows the Clerk to delegate his power and
duties in writing to any person, other than a member of Council.

South End Leash-Free Dog Park Project Update

RECOMMENDATION
That Council endorse the procedure for advancing this project through the construction
process as outlined in this report.
EXECUTIVE SUMMARY
City Council approved funding in the 2017 Capital Budget for a new leash—free dog park
to be located in the south end of the City based on the success and popularity of the
facility constructed at Firemen's Park. Staff has commenced negotiations with the
Niagara Falls Humane Society (NFHS) to locate this park on their property at 6025
Chippawa Parkway and are currently finalizing the terms of an Agreement that will set out
the respective responsibilities of each party.
The purpose of this report is to provide Council with an update on the status of the project
and of Staff's intentions to proceed with construction in accordance with the purchasing
policy to an upset limit of the approved budget of$375,000. The Agreement with NFHS is
expected to be available for Council's consideration at its meeting on August 22"d, 2017.
BACKGROUND
Staff has been working with representatives from the NFHS to study opportunities for
operational efficiencies and synergy created by locating a leash-free dog park on the
Humane Society property. The popularity of a similar facility at Firemen's Park has led to
a number of inquiries from dog owners in the south end of the City's urban area. The
proposed layout for the new dog park is shown in Attachment #1. The project includes
fencing, improved parking, site preparation, tree removal (primarily ash trees), signage
and security lighting.
ANALYSIS/RATIONALE
Typically construction projects of this nature are advanced through the Public Tender

process and awarded to a general contractor. Given the timing of the project and
expected market conditions staff believe there is better value and a better chance of
completing the work this Fall by assigning the work in smaller sub-contracts (i.e, site
works, paving, forestry, fencing, electrical, etc.). Quotations for each segment of the
project will be undertaken.
The scope of the work can be tailored to fit within the approved budget of $375,000.
FINANCIAL/STAFFING/LEGAL IMPLICATIONS
Capital funding for this project was approved in the 2017 Budget. Staff are currently
discussing responsibilities for operational issues and maintenance and are estimating
that the addition of this park will require an annual increase of $30,000-$40,000 in the
Municipal Works General Purposes budget.
CITY'S STRATEGIC COMMITMENT
The recommendation is consistent with Council's Strategic Priority to promote a vibrant,
sustainable city that supports an active, connected and creative community.

By-law No. 2017 - 91
A by-law to adopt, ratify and confirm the actions of City Council at its special meeting
held on the 20th day of July, 2017.
WHEREAS it is deemed desirable and expedient that the actions and proceedings of
Council as herein set forth be adopted, ratified and confirmed by by-law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. The actions of the Council at its special meeting held on the 20th day of July,
2017 including all motions, resolutions and other actions taken by the Council at
its said meeting, are hereby adopted, ratified and confirmed as if they were
expressly embodied in this by-law, except where the prior approval of the Ontario
Municipal Board or other authority is by law required or any action required by
law to be taken by resolution.
2. Where no individual by-law has been or is passed with respect to the taking of
any action authorized in or with respect to the exercise of any powers by the
Council, then this by-law shall be deemed for all purposes to be the by-law
required for approving, authorizing and taking of any action authorized therein or
thereby, or required for the exercise of any powers thereon by the Council.
3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls
are hereby authorized and directed to do all things necessary to give effect to the
said actions of the Council or to obtain approvals where required, and, except
where otherwise provided, the Mayor and the Clerk are hereby authorized and
directed to execute all documents arising therefrom and necessary on behalf of
the Corporation of the City of Niagara Falls and to affix thereto the corporate seal
of the Corporation of the City of Niagara Falls.
