Grassy Brook Road / Crowland Avenue Road Closure
Residents Meeting - May 20, 2003. Issues and Discussion
RECOMMENDATION:
That the City of Niagara Falls proceeds to stop up and close portions of Grassy Brook Road and
Crowland Avenue Road as set out in recommendations in report L-2003-33 subject to the
additional considerations described in this report.
BACKGROUND:
At its meeting held on April 28, 2003, the Niagara Falls City Council considered a request from the
Developer of the proposed Grand Niagara Resort to close portions of Grassy Brook Road and
Crowland Avenue in order to facilitate the design and construction of their world-class project on
the subject lands.
A number of residents in attendance at the meeting spoke against the closures resulting in Council's
decision to defer the closure until the developer could arrange a meeting with the residents to
resolve some of their concerns.
On Tuesday, May 20, 2003 the residents were given the opportunity to meet the developers and their
consultants review their concerns and obtain more information about the resort proposal. The issues
raised at this meeting can be summarized as follows:
1. What are the impacts on the existing road system resulting from the new development?
2. What consideration has been given to Grassy Brook Road residents for the convenience of

having to drive around the resort?
What procedures does the City have to follow in order to legally close roads?
Why would the City close the roads without the benefit of an approved site plan?
Have emergency services staff had the opportunity to review the impacts of the proposed
road closure?
Can the resort proposed be redesigned to accommodate a public road through it? (I.e.,
existing or modified alignment of Grassy Brook Road)
Can the residents review the Traffic Impact Studies (original plus addendum reports)?
Will the "Dead End" roads have proper turning cimles to accommodate school buses,
snowploughs, garbage and recycling tracks?
Are there any plans to upgrade the signalized intersection at Bigger Road/Montrose Road?
Are there any plans to upgrade Morris Road so that it will have sufficient width, turning
radii, and structural capacity to handle the increased volume of traffic that will be directed
to it?
11. Are the environmental impacts of the Golf Course/Resort being taken into consideration?
12.
Will there be an opportunity for the public to view the site plan for the resort and make
comments for Council/staff's consideration.
13.
Can the primary entrance to the resort be relocated offthe Crowland Avenue Road allowance
so that it doesn't impact the Facca Property?
14.
Can the unopened road allowance (the one closed at the April 28, 2003 meeting of Council)
be used as an entrance to the resort?
In addition to these questions a number of comments regarding poor notification of the residents
meeting, lack of input from the neighbours on site plan details and perceived inconvenience was
expressed.
One important common consideration however was that the residents had NO OBJECTION to the
golf course/resort complex being constructed in this area.
STAFF COMMENTS:
The Grand Niagara Resort is a project that is truly unique to Niagara Falls and staff acknowledges
that the finished product will be the result of balancing a number of environmental, financial and
social impacts. The process is more evolutionary than predetermined because as constraints are
identified at each level of the planning process the design must be adjusted. In this particular case,

we may not have all of the answers to the questions before we are asked to proceed. At issue is
whether the roads should be closed first then the site plan developed or vice versa.
The current version of the Site Plan has factored in the various constraints, setbacks and servicing
objectives, but in order for this plan to be finalized a decision regarding the closure of the roads is
necessary. Staff report L-2003-24 (page 2, 2nd to last paragraph) confirms that the transfer of the
road allowances in question would only take place just prior to the registration of the site plan
agreement. This gives Council the opportunity to consider the final closure of the roads if the Site
Plan is not satisfactory. At this point, the developer is seeking direction as to whether they should
proceed on the assumption the roads can be closed or whether they should downscale their project
and design around the public roadways.
Given the sensitivity of the impacts and the mutual interests in developing a world-class resort
complex in this area, staff is recommending that we proceed with the road closure as originally
contemplated and involve the residents in the Site Plan Review Process to address the concerns they
have raised. This would involve some additional meetings with the developer as the various
components of the project come on line.
It is our opinion that issues # 1,2,5,6,7,8,9,10,11,12,13,and 14 can be addressed through the site plan
agreement. Issue number three (3) regarding the road closure process has indeed been properly
pursued under the authority of the Municipal Act. Issue number four (4) asks the question as to
whether the site plan agreement should be negotiated before the road closure. In effect that is exactly
what is being done.
Accordingly, staff is asking to confirm the recommendation set out in report L-2003-33 with the
only point of clarification that the residents be invited to participate in the final site plan process
regarding the resort component of the project and that Council give final approval to the Site Plan
and corresponding agreement at the appropriate time.

Grand Niagara Resort Inc. (''Grand Niagara") is thc owner of the lands hatched on Schedule "B"
attached. GNR Development Corporation ("GNR"), the developer for Grand Niagara Resort Inc.,
recently submitted an Application to the Planning Deptuhaent for Site Plan Approval to develop an
18 hole golf course on 352 acres of land, abutting Parcels A, B, C and D. Grand Niagara wishes
to purchase the closed roads, so as to complete a land assembly and incorporate the Parcels as part
of a master plan to develop the golf course.
Timing of thc tramfer of Pamels A, B and D will take plato jast prior to the registration of the Site
Plan Agreement so that these Parcels can be incorporated into thc development plans. Parcel C will
be transfenv. A at the time that the Regional and local Official Plan Amendment Applications are
finalized.

Thank you for meeting with our group of representatives on Friday, May 9.
Our Serbian comm,mity has a proposal to remember its most brilliant son, Nikola
Tesla, who had a close,affiliation with Niagara Falls and left an important mark on the
Niagara Fall~ Power Company. Nikola Tesla, the son of a Serbian Orthodox priest, died
on January 7, 1943 - 60 years ago.
Tesla's connection with Niagara Falls began at the Adam Beck Generating
Station where his alternating current system was first applied with the 5000 horsepower
generators of the Niagara Falls Power Company. Tesla received many awards and much
recognition during his lifetime and posthumously. Many books, articles and videos have
recorded his achievements. On the occasion of the 2000 millennium Tesla was named
one of the most influential men of the 20* century for his enormous contribution to
humanity.
On the occasion of the 60th anniversary of Tesla's death our community would
humbly ask the Niagara Falls City Council to:
· proclaim July 10 (his birthday) Nikola Tesla Day in Niagara Falls.
· accept a small presentation to the City/Parks Commission, an artistic flamed
lithograph of Tesla, and some books for the library.

Like Adam Beck, Robert Moses
was known on his home turf as
a man who got things done· More
than any other, he had shaped
New York City and much of New
York State, building bridges,
expressways, and parks, often
by bulldozing all opposition. He
was Governor Tom Dewey's
obvious choice as energy czar,
charged with building a huge new
powerplant on the American
side of the Niagara River.
Political squabbling held up
the job for eight years. (In the
meantime Ontario began and
completed Beck 2 across the
river.) Moses also found himself
in an unseemly battle with the
Tuscarora Indians, who didn't
want him to take a big chunk of
their reservation for a reservoir.
Moses was obliged to settle for
much less than he wanted, but
once the haggling was over, he
finished the job. Moses was less
interested in the powerplant
than in the parkway he built along
the Niagara gorge. Both plant
and parkway now bear his name.

Nikola Tesla
In the 1890s he was the most celebrated
scientist on earth, the Serbian genius who
made the long-distance transmission of
Niagara Falls power possible through
the use of alternating current. He
worked that out in i~is head while reciting
Goethe's Faust during a stroll through
a Budapest park. His photographic
memory made it unnecessary for him to
draw a blueprint or write anything down.
He "saw" his inventions in his mind.
Incredibly sensitive (he could hear a
watch ticking three rooms away), he
could speak eight languages without an
accent. His interest in the potential of
water power began in childhood. In
America he worked briefly for Thomas
Edison, but the inventor scorned his
theories. George Westinghouse was
more farsighted. He bought up Tesla's
patents, won the "Battle of the Currents,"
and gained the contract to light the 1893
Columbian Exposition. Today the tesla,
a unit of magnetic induction, honours the
name of the man who made it all possible.

Dear Mayor Thomson & City Council:
The Victoria Centre BIA has been working on obtaining TODS signage for the last
several months. We have been informed that the city does not recognize us as an
individual area, we are in fact included as part of Clifton Hill, (even though we meet
TODS requirements for a 'tourist cluster') and therefore we cannot have our own
signage.
Directional signage for Clit~on Hill area does not apply to Victoria - Centre, and does not
direct traffic into our area. I am advised by TODS that travelers are directed from
highway 420 down to Falls Ave & up Clifton Hill.
The problem is Clit~on Hill does not consider Victoria - Centre as part of their area and
rightly so. We are not part of their BIA. We have our own identity and focus, our own
strengths and needs. We have separate representation on committees, ie: Parking &
Traffic. Most importantly Victoria - Centre is a separate and individual BIA with its own
boundaries and its own budget. We are considered as a separate entity in all areas except
where it involves bringing visitors into our area, the lifeblood of our existence.
Victoria - Centre Business ImProvement Area requests from you to have a separate
designation which will allow us to fully perform in the best interest of our members and
not be restricted by the actions of another area.

RECOMMENDATION:
REFER TO STAFF TO LOOK INTO THE ISSUES AND CONCERNS EXPRESSED.
BACKGROUND:
As a result of concerns raised by Mr. Babel of Fatima Court report MW-2002-152 - Removal of
Islands from Cul de Sacs was prese~lted to Committee and recommended that the islands not be
removed. The motion adopted by the Committee at that time was that the report be received and
filed.
Since the filing of the report, additional correspondence has been received, from Mr. Don Sorley and
Mr. Babel. In regards to Mr. Babel's concerns the matter has been reviewed with operations staff
and they have indicated that even with the removal of the island the current snow plow operation
would not be affected. The controlling factor as to whether a truck and plow are used or a front end
loader is the outside radius of the cul de sac. Accordingly, the changes proposed by Mr. Babel would
not have the desired effect of improving the winter maintenance operations. What would be required
is a change in the routing of the front end loaders so that the cul de sac is done sooner or additional
equipment be hired in order to have cul de sacs plowed more quickly.
As indicated in Mr. Sorely's letter he and his neighbours are interested in maintaining the cul de sac
with funds being provided by the City for materials such as fuel for lawn mowers, water and
fertilizer. This would be similar to the Mount Carmel Association where the local residents have
adopted the park. Currently the City carries out minimal maintenance on cul de sacs in that the City
only provides grass cutting every three to four weeks. It is estimated that the cost to provide the

necessary materials for this cul de sac, which is quit large at 5,000 sq. ft. a typical 50 ft. x 100 ft.
building lot, would be in the order of $150 to $200. If all of the residents abutting a cul de sac
containing an island were to participate in the program, it is estimated that the cost would be
approximately $25,000 per year. Accordingly, it is staff's recommendation that the City implement
an, "Adopt a Cul de Sac Program," in order to better maintain the islands and help beautify the City.

BACKGROUN D:
A request was mede that the City of Niagara Falls consider removing islands from Cul de Sacs.
Traditionally complaints received about islands have to do with the maintenance of the grass and
cutting of weeds. In 2002 the Service Center has logged only seven complaints of this nature.
Staffhas reviewed these requests and have the following comments:
Based on our current GIS data there are more than 100 Cul de Sacs which contain islands.
The cost of removing an island will vary depending on which services are located there.
Many islands contain hydrants and hydro poles. The cost of relocating these services can be
in excess of $15,000 plus the restoration of the island.
Niagara Falls Hydro has expressed concern about removing the islands and not the poles. If
we were to place bollards around the poles there would be a maintenance cost. These areas
would have to be cleaned by hand.
Prior to relocating the hydro poles and hydrants, a meeting would have to be held with the
local residents to find a new acceptable location. These services would now have to be
placed in fi'ont ofa resident's home.

Now that the winter weather has subsided and our fi'ustmtions have
diminished, I wish to remind you of the concerns that my family and the
Babel family experience during the winter due to the rather large cul-de-sac
that was constructed on Fatima Court. Aesthetically it looks great;
pragmatically it raises the following safety concerns:
A) Parking: When entertaining guests, parking is a definite problem
especially in the winter
B) Snow Ploughing: The large plough cannot get by and consequently
Fatima Court is not ploughed until late in the day. By that time,
we have already been stuck in the snow and required assistance to
get out.
C) Emergency: Most importantly, in case of emergency, an
ambulance or fire truck would fmd it virtually impossible to reach
our home to save a life if stormy conditions existed and a large
amount of snow had accumulated in the court.
For these reasons we ask that consideration be given to downsiz~,
the cul-de-sac so that snow ploughing can effectively take plac~j-
thereby, ehmlnatlng a possible forthcoming situation of liabi

Let me emphasize that this is not an issue where majority in the court roles.
Rather, it is a safety concern for two families that are adversely affected
during the winter months. Moreover, let's not forget that tree democracy is

That the cost sharing breakdown described in this report for the proposed construction of
Weinbrenner Road in conjunction with the development of the Williams Plan of Subdivision be
approved.
BACKGROUND:
At its meeting held on May 12, 2003 the Niagara Falls City Council approved minor modifications
to the Williams Plan of Subdivision that will create 42 new residential lots on the south side of
Weinbrenner Road wh'lch is presently an unopened road allowance.
This project provides the City of Niagara Falls with the opportunity to advance the construction of
significant municipal infrastructure that has been planned to be located in this road allowance when
the development proceeds.
In particular, a trunk sanitary relief sewer, trunk storm sewers and control facilities, and a new east-
west collector road can now be implemented.

In 1999, the City identified a portion of the cost of this infrastructure as being a growth-related
capital cost that would be funded from Development Charges collected across the City. The servicing
costs were intended to be shared as follows:

Based on actual tendered prices received by the developer for this project, the proposed cost sharing
would be as follows:

Note that the current design does not include the pmv~sion of traffic calming measures on the future
Weinbrelmer Road. These costs are directly attributable to the traffic demand caused by the new

expect to finalize this design over the next six weeks so that the area residents can be invited to
review the proposed works and be incorporated into this construction contract later this summer.
A report to City Council in this regard will be forthcoming.
In conclusion, Municipal Works staff are asking for Council direction to include the foregoing cost
sharing arrangement in the Williams Subdivision Agreement given the significant opportunity and
financial benefits this project will bring to the City and the Chippawa area in particular.

Chippawa Flood Relief Review Assessment
RECOMMENDATION:
In accordance with the City's Consultant Selection Policy, it is recommended that the City of
Niagara Falls enter into a Consulting Services Agreement with CH2MHill Canada to update the
analysis of past flood relief measures and recent sewer replacements in Chippawa for a total cost of
$ 31,554 exclusive of taxes.
BACKGROUND:
Over the past twenty five years, City Engineering staff have committed significant capital funds
toward providing an acceptable level of protection against basement flooding for the residents of
Chippawa.
These measures employed include but are not limited to:
1)
Construction of wet weather storage facilities at four separate locations throughout
the village of Chippawa at an approximate replacement cost in today's dollars of
$ 2,000,000.
2)
Front Street sewer replacement and pump station decommissioning in 2002 at a
cost of approximately $ 2,100,000.
3)
Various engineering studies aimed at reducing flooding and preventing overflows
to both the Niagara and Welland Rivers.
4)
The disconnection of approximately thirty homes with weeping tiles connected to
the sanitary sewer system via the Residential Flood Relief Program.
The individual efforts of both present and past Engineering Staff have by all accounts been
successful in providing a degree of control over the chronic flooding in Chippawa. In recent years

residential development pressure has increased substantially in the South West sector of the town.
City staffnow wishes to gauge the effectiveness of all the flood relief measures put in place to date
as a whole, City staff now believes a detailed study of past relief measures, specifically the four
storage facilities mentioned above, in the context of the new development that is occurring, needs
to be performed. Some of the storage facilities now appear to be no longer needed due to the
significant alterations made to the system in a somewhat piece-meal fashion in the past.
Opportunities exist to decommission some of the facilities thereby reducing their operating and
maintenance costs and fleeing up land for infill development. The proposed study and analysis will
encompass all past flood relief measures and efforts and offer recommendations in the area of the
remaining develop able capacity of the system as well as an overall optimization of the entire
sanitary sewer system.
Mr Phillip Cheung of Ch2m Hill Canada has been retained on several occasions by Staff to provide
detailed analysis of the Chippawa and Niagara Falls sewer systems and as a result is familiar with
the geometry and hydraulics of both. His familiarity with the systems mentioned will negate the
learning curve associated with the foundation work for the assessment and will reduce consulting
costs overall.
The proposed study will be funded through the Development Charges portion of the Engineering
Studies account.
Recommendation
Council's concurrence with the above recommendation is requested.

utilizing the criteria as set out by the Drainage Superintendents Associations of Ontario. The criteria

BACKGROUND:
City Council on March l 7, 2003, approved a recommendation to decrease the set fine from $15.00
to $10.00 in the Queen Street and Main Street Business Improvement Areas. To facilitate this, two
new schedules have been prepared to identify the specific geographic areas concerned.
The text of Parking and Traffic By-law 89-2000 and Municipal Parking Lot By-law 96-50 will be
amended to refer violations to these new schedules.

RECOMMENDATION:
It is recommended that Totten Sims Hubicki Associates, of St. Catharines be awarded the
Engineering Consultant's contract to prepare a comprehensive Park Master Plan and Traffic Report
for the new Patrick Cummings Memorial Sports Complex in the amount of $32,600.00 including
all applicable taxes.
BACKGROUND:
As part of this year's Capital Projects approved by Council, Staff was directed to complete Phase
I of the new Patrick Cummings Memorial Sports Complex. Staffrequires an engineering consultant
to assist with the Park Master Plan which includes a storm water management report.
Two prices were received from local Engineering Consulting firms as follows:
1. Upper Canada Consultants Limited of St. Catharines, ON $49,851.30
Totten Sims Hubicki Associates of St. Catharines, ON $32,600.00
(Price includes a Traffic Study in the amount of $8,000.00)
On Wednesday, May 7, 2003, at the Public Meeting held at the Chippawa Willoughby Memorial
Arena, the residents requested that a Traffic Study be conducted to assist with the design of the new
Patrick Cummings Memorial Sports Complex. Staff will be incorporating this Traffic Study within
the Terms of Reference for the Park Master Plan.

BACKGROUND:
This tender includes the installation of electrical conduits for future parking lot lights and automatic
irrigation system as part of Phase 2. The Landscape Development Contract for the Kalar Road Community
Sports Park 'Home For Girls Soccer' (Phase 2) is presently underway with the completion of the remainder
of the site, which includes parking areas, main access roadway, one (1) intermediate soccer pitch and
various landscape amenities.
The tender was advertised in the Niagara Falls Review, a copy sent to the Niagara Construction
Association for viewing and was available on the City of Niagara Falls internet web site. Fourteen (14)
companies picked up the tender packages and two (2) bid proposals were received by the Clerk's
Department. The tender opening occurred in the presence of the Manager of Supply & Services and the
City Clerk on Monday, May 26, 2003.

Revenue Funds, as attached to the report.
BACKGROUND:
On December 9, 1996, Council approved the Corporate Services Committee's recommendation for
investment policies. The policies are based on the enabling legislation of the Municipal Act and/or
the Trustees Act. These policies govern the investment strategies of revenue funds, reserve funds
and trust funds of the Corporation. Investment Policy Statements for each of the above-noted funds
contains Purpose, Objective, Asset Mix and Limitations.
Since February 3, 1997, Scotia Investment Management Ltd. (now Scotia Cassels) has managed the
City's invested funds in accordance with the City' s investment policies. Schedule "B" shows the Fee
Schedule for the payment for the investment management services. Report F-2003-29 shows the
investment performance for the 2002 year.
On December 5, 1997, the Minister of Finance issued Regulation 438/97 that amended the prior
legislation governing eligible investments. In compliance to Regulation 438/97, Staff prepared
amended investment policies for Trust Funds, Reserve Funds and Revenue Funds. The changes
included the limits of eligible investments, the minimum rating for eligible investments and the
reporting requirements to Council concerning such investments. The amended policies were
approved on April 6, 1998.

On September 20, 2002, the Minister of Finance issued a new Regulation 265/02 that again amended
prior legislation governing eligible investments. The following are highlights of this regulation.
Investments
The new regulation expands the existing range of investments to include highly-rated
asset-backed securities and highly-rated commercial paper and promissory notes. In order for
a municipality to invest directly in either of these new investment products, the municipality's
long-term debt obligations must be rated a minimum of AA(low) by DBRS, Aa3 by Moody's
or AA- by Standard and Poor's.
Commercial paper is a short-term, unsecured negotiable promissory note issued in the open
market. It represents a general obligation of an issuing entity.
Asset-backed securities allow an investor to purchase a pool of financial assets issued by an
individual issuer. The most common types 'of pooled assets are residential mortgages,
automobile loans, credit card receivables, equipment leases export receivables and other
receivables.
Annual Statement
An annual statement of investment policies and goals is a requirement for municipalities. The
preparation of this statement must consider:
The municipality's risk tolerance and the preservation of its capital;
The municipality's need for a diversified portfolio of investments;
Obtaining legal advice and financial advice with respect to the proposed investment policy.
In discussion with Scotia Cassels, and in compliance to Regulation 265/02, Staff has prepared
amended investment policies for Trust Funds, Reserve Funds and Revenue Funds for the Council's
consideration and approval. Scotia Cassels has also undertaken to provide enhanced servicing
functions as outlined in Schedule "A".

Servicing Agreement
The following is an undertaking by Scotia Cassels' to provide the requested client servicing functions
as outlined below:
Scotia Cassels' will deliver a Quarterly Investment Review (QIR) report to The City of Niagara
Falls. Such reports should include a summary of market value, accrued income, realized and
unrealized gains along with commentaries on market conditions during the quarter, performance
relative to the benchmark and Cassles' strategy for the upcoming quarter.
Scotia Cassels' will do its best to deliver the Quarterly Investment Reviews by the 25th day in the
month following the quart, er end month.
Scotia Cassels' shall deliver portfolio valuations (a listing of security holdings with no
commentaries) on a monthly basis within five business days following month end.
Scotia Cassels' Portfolio Manager or the Head of Institutional Client Services shall meet with
representatives of The City of Niagara Falls on a regular basis (a minimum of three times in any
calendar year) to review performance and strategy.
Scotia Cassels shall provide a quarterly Compliance Certificate indicating its adherence to The City
of Niagara Falls' investment policy on a quarterly basis.
Scotia Cassels' will transact in the wholesale market and will obtain a reasonable number of
quotation from pre-approved list of brokers prior to investing.
Scotia Cassels' will liquidate the most suitable short-term investments to provide The City of
Niagara Falls access to cash on the same day basis.
Scotia Cassels' will automatically re-invest interest income or capital gains within established
parameters while reducing the amount of cash held to a satisfactory minimum.
Cash held in custody account and is not invested shall earn an interest rate that is consistent with
market practice. (Currently Scotia Trust pays 2% on such cash deposits).
Scotia Cassels shall review investment regulations (such as the Ontario Municipal Act) from time
to time and advise The City of Niagara Falls of any recommended changes to improve on the
existing investment policy. Similarly, it is expected that region will advise Scotia Cassels' of any
changes that might impact the investment policy being used and amend such policy when required.

BACKGROUND:
Reserve Funds
On January 1, 2002, the opening balance in this investment account was $11,301,295. In accordance
with our investment policy, the funds were invested in Government treasury bills, Government and
Canadian Corporate issues of bonds, bankers' acceptance, term deposits and similar investments.
On October 3, 2002, $3,000,000 was transferred from the reserve fund bank account to the
investment account.
As at December 31, 2002, the investment account was $14,977,976 and had an overall income of
approximately $713,373. Total interest income was $687,100, realized capital gain was $106,535
and unrealized capital loss was ($80,262). Management fees of $36,692 were paid to Scotia Cassels
for their services.

On January 1, 2002, the opening balance in this investment account was $1,689,347. In accordance
with our investment policy, the funds were invested in Government treasurybills, Government and
Canadian Corporate issues of bonds, bankers' acceptance, term deposits and similar investments.

$146,538. Total interest income was $98,439, realized capital gain was $10,247 and unrealized

RECOMMENDATION:
That Council approve the following recommendations:
The reimbursable kilometrage rate payable to City employees who use their personal
automobiles on City business, be established at $0.397 per kilometre, effective July 1,2003.
2. The reimbursable kilometrage rate continue to be reviewed on an annual basis.
BACKGROUND:
This report presents the annual review of the reimbursable rate per kilometre for employees who use
their personal vehicles on behalf of the City. This annual review is used to account for the changes
in costs so as to ensure equity in the reimbursable rate. The Canadian Automobile Association
methodology, used in their publication "Driving Costs", has been used to arrive at the reimbursable
rate. Both fixed costs and variable costs were determined and incorporated in the calculation of the
kilometrage rate.
Fixed costs refer to annual vehicle costs such as depreciation, financing (interest), insurance
premium, license and registration fees and taxes. Variable costs represent the day to day expenses
of operating the vehicle and include such factors as gasoline, tire wear and maintenance.
The yearly insurance premium is a major cost item. The City's insurance broker was contacted for
the costs of insurance coverage. Coverage was obtained assuming a typical married person over the
age of 25 with a clean driving record.

Financing cost is based on an average automobile loan rate of approximately 6.5%.
Total fixed costs amounted to $6,360 for the year ($6,408/year for 2002). Variable costs relating to
fuel and maintenance amounted to $0.132 per kilometre ($0.122/km for 2002). (See Appendix I.)
The resulting kilometrage reimbursable rate is $0.397 per kilometre. This represents an increase of
$0.018 over the present rate of $0.389.
Table 1 attached provides a summary of kilometrage rates paid in other municipalities.
Conclusion:
It is therefore recommended that the reimbursable kilometrage rate payable to the City employees
who use their personal automobiles on City business be established at $0.397 per kilometre effective
July 1, 2003.

RECOMMENDATION:
That Council approve a rate of 5.5% be applied to the portion of the cost of local improvements
that have been paid by property owners and are thus being financed by the City.
BACKGROUND:
The local improvements for Sanitary & Sewers, Watermain & Road Reconstruction, Curb &
Gutters, Drainage Course No. 6 and Four Mile Creek Drain on Lyon's Parkway, Toby Crescent
and Collins Drive, Montrose Road from Young Road to Carl Road and Two Branches in the
Town of Niagara-on-the-Lake have been completed. The sum of $352,941.72, representing the
unpaid balance of the owner's portion, remains to be financed over a ten-year period. An interest
rate of 5.5% is recommended, which represents the present selling rate often-year debentures.
Should Council approve the recommendation, a by-law has been prepared and is available for
Council's adoption this evening.

That execution of an Application to Amend the Register and documents necessary for the purpose
of releasing and terminating an Agreement made between Robert Douglas Gale and The Corporation
of the City of Niagara Falls, for Lots 7 and 8 on Plan 160 and an Agreement made between George
Bastedo, the Owner and The Corporation of the City of Niagara Falls for lands known as Lot 7 on
Plan 160 is hereby approved and authorized.
BACKGROUND:
In 1960 the City entered into an Agreement between Robert Douglas Gale for the property known
as Lots 7 and 8 on Plan 160.
In 1965 the City entered into an Agreement between George Bastedo for the property known as Lot
7 on Plan 160.
These Agreements provide that the covenants contained therein bind the property for building
restrictions that are no longer required. Italia Gilberti, solicitor for 1238838 Ontario Limited, the
present owner of the subject lands, has requested that the Agreements be released.

WHEREAS the Provincial government introduced the Ontario Transit Renewal Program in 2002;
and
WltEREAS the program creates a partnership that will assist municipalities in replacing and
refurbishing existing transit fleets; and
WHEREAS Niagara Transit requires a bus replacement program for its aging fleet; and
WHEREAS the Corporation of the City of Niagara Falls is entitled to 1/a of replacement and
refurbishment costs under the Ontario Transit Renewal Program.
NOW THEREFORE BE IT RESOLVED THAT pursuant to the Ontario Transit Renewal
Program, the Council of the Corporation of the City of Niagara Falls hereby requests payment of
