It was a pleasure to have met with you on Fdday, May 23"d and have the opportunity to
introduce the proposed First Annual Niagara Falls Multicultural Festival. We aro excited
at the possibility of hosting our event in your beautiful city. What a groat opportunity to
launch this inaugural Festival dudng the celebratory times of the 100th Anniversary of
Niagara Falls! We look forward to this being the first Multicultural Festival, of many moro
years of tradition to follow.
We have years of experience behind planning this type of community event and you can
be confident that we will oversee the operations of the festival from start to finish.
It would be our pleasure to have the opportunity to make a presentation to both yourself
and members of the Niagara Falls City Council on Monday July 146~. We would review
details of our proposal as previously discussed with you. We would bdng 'life' to our
Festival presentation with the presence of a live Caribbean Costumed dancer supported
by a colourful power point presentation.
We look forward to speaking with your support staff to co-ordinate details of time,
location, availability of a pro-presentation prep room.

RECOMMENDATIONS:
The following report is provided to Council with the following recommendations:
1. That Council receive the report for information.
That Council approve the schedule of naming opportunities for Capital Campaign donations
including the requirement that any naming of the Community Centre building must be
approved by Council.
BACKGROUND:
Community Centre Status Report R-2002-17 included six recommendations that were approved by
Council at its April 22, 2002, meeting. The sixth recommendation required that Council be provided
regular reports on the status of the Community Centre project. This written report, and concurrent
verbal presentation by the Architectural Team and other project participants will update Council on
the status and progress of the Niagara Falls Community Centre project. As an ongoing follow-up
to the report and direction of the April 22, 2002, "Moving Forward Plan", this report will review key
elements in the ongoing development of this project.
THE PARTNERSHIP PROCESS:
An important principle endorsed by Council is the need to develop a Community Centre that delivers
a variety of services to all the citizens of the City. This principle supports the need to establish
partnerships and alliances with different agencies to ensure that the Community Centre provides

programming and service opportunities for children, youth and adults. Over the past year, the
partnership has evolved to include:

The YMCA of Niagara
Senior Citizens
Heart Niagara
Big Brothers and Big Sisters of Niagara
The City of Niagara Falls
The Memorandum of Understanding (MOU) forms the framework to govern the partners in their
further development of a Partnership Agreement in 2004. It is this Partnership Agreement that will
detail the policies, procedures and organizational responsibilities necessary to manage and operate
the new Centre.
In September 2002, the Steering Committee issued several public notices inviting proposals fi.om
community service groups to provide services in the NFCC. Heart Niagara and the Big Brothers/Big
Sisters of Niagara Falls are valued additions, diversifying the range of services and citizens that will
be served in this unique Centre. As community-based, nonprofit organizations, their participation
does not include a direct contribution to the capital costs. A lease arrangement will be developed
that recognizes the organizations' ability to pay and their participation in fund-raising activities in
the Capital Campaign.
The Steering Committee also invited proposals fi.om the private sector to deliver health services and
food services fi.om the new Centre. The Steering Committee was seeking the involvement of private
proponents who would require a minimum of dedicated programming space, but who could deliver
valued services that would contribute to the total spectrum and diversity of services that the Centre
could offer the community. The Steering Committee is currently negotiating with a local
physiotherapist clinic and a local food service provider to develop a mutually beneficial leasing
arrangement with the NFCC.
SITE PREPARATION:
The Steering Committee developed a long term neighbourhood plan that includes both the East (i.e.,
Community Centre site) and the West side properties. The proposed plan considered more than one
hundred (100) acres of unused properties and was presented to Council in earlier status reports.
The City invited a public private partnership to assist the City with the preparation of the site.
Because of the close relationship of this 23-acre parcel of land with the 77-acre City-owned property
on the West side of Montrose Road, it was felt that there may be an opportunity to find a number of
efficiencies in site preparation to prepare the Community Centre site in a more cost effective manner.
Council endorsed the recommendation of Report MW-2003-40 (February 17, 2003) to partner with
Integrated Municipal Services (IMS) on the development of the Community Centre site. The IMS
approach to the preparation of these two sites included several major components.
Preparation and grading of the Community Centre site (East Side property) including the
removal of excess spoils from the East Side to the West Side. This work would include
cleating, grubbing, and tree removal.

Clearing, grubbing and removing trees on the West Side to allow material from the East Side
to be deposited and graded.
The harvesting of commercially valuable rock from the South section of the West Side
property.
The further grading and shaping of the West Side property to establish 25-30 acres of
commercially valuable land suitable for future sale and/or development.
The site preparation work commenced on April 7, 2003, with tree cleating and grubbing operations
on both the East Side and in the northwest areas of the West Side property.
Grading and soil removal commenced on April 17, 2003. This work has involved moving materials
fi.om the East Side to the West Side of Montrose Road. IMS received a permit from the Niagara
Region to establish a crossing on Montrose Road to move equipment and material with the use of
flag men.
As of July 4, 2003, the preparation of the Community Centre property is approximately 50%
completed with the removal of 156,780 m3 of excess soils. Work will continue on the East side
through the remainder of the summer. Although the Spring weather caused some delays to the
preparation work, it is anticipated that the site will be fully prepared for the start of construction in
the Fall of 2003. The development work being done by the City on the highly visible intersection
has stimulated a number of enquiries from the private sector regarding future development
possibilities of the West side property. The IMS proposal also encompassed a proposal for IMS to
complete a market feasibility study for the West side property. This work is progressing
satisfactorily.
The site preparation work in the area of the Skate Park has been completed. The construction of this
new facility is expected to commence the week of July 14, 2003, with a projected completion date
of late September 2003. Although the Skate Park and the Community Centre are separate projects,
they are obviously closely linked, and both project management teams are working closely to co-
ordinate construction schedules.
Work on the West side property will continue through the remainder of 2003 and into 2004. Work
completed to date includes:
1) Clearing of trees and grubbing of all areas formed by the former dump site.
2)
Capping of the dump site on a North to South pattern as per Council's
direction.
IMS will initiate rock harvesting in the southern 20-25 acres of this property at the conclusion of the
site preparation work on the East side. The original IMS proposal estimated approximately 140,000
tonnes of aggregate quality rock could be harvested fi.om this area. Since the original proposal,
there have been several expressions of interest in larger landscape rock that can be harvested from
this site. IMS will pursue all of these additional opportunities for the sale of resources from the site.

DESIGN PROCESS:
The Conceptual Design of the Community Centre is complete and has been reviewed by all partners,
stakeholder groups such as the Mayor's Disability Advisory Committee, and the public through two
Open Houses held on November 13, 2002, and March 26, 2003. The Conceptual Design outlines
the basic floor plan of the facility identifying component features, the floor space of each feature and
the relationships of features to each other. To review, the major components of the Community
Centre include:

CAPITAL CAMPAIGN:
The YMCA is providing leadership and resources to the Capital Campaign with the support and
participation of the other partners. The campaign headquarters are at the YMCA's Fourth Avenue
facility and the YMCA has allocated senior and experienced staff to ensure its success.

The capital campaign is a significant project actively providing necessary capital for the construction
of the Centre. The campaign has set a goal of raising $2 to $3 million in the community. The
partners have initiated their various "Family Campaigns". The family campaign is a fund-raising
campaign within each respective organization. A successful family campaign is important to
demonstrate the soliciting organization's commitment to the achievement of the campaign goal.
The partners have also commenced the "Quiet Phase" of the capital campaign. This phase of the
campaign is where the partners usually raise the significant portion of the campaign goal from a
group of select donors. A successful campaign has many important elements, much of which the
campaign leadership has already developed and put into place.
One of the key incentive pieces for a capital campaign is the development of a donor recognition
policy which outlines key principles and procedures governing the manner in which donors are
recognized, acknowledged, and thanked for their generous commitment to the project. Some of the
key principles are:
All donors will be permanently recognized within the facility
via a "donor wall," the nature of which will fit with the
architectural design of the building;
· Donors will be recognized according to established gift levels.
Donors making significant gifts will also have naming opportunities within the facility. Each area
of the facility will have established donation levels that would allow that portion of the facility to
be named in recognition of the donor. The recognition and corresponding signage would follow
defined guidelines. Each of the areas has an established gift contribution (ranging from $50,000 to
$1,500,000) that would afford the donor a naming opportunity. Following is a proposed chart of
gift levels and corresponding naming opportunities.

Typically, opportunities also extend to the naming of the entire facility. Given the nature of
ownership and sources of capital contribution to the Niagara Falls Community Centre, the Steering
Committee is recommending that final endorsement of building naming opportunities be referred
to City Council for consideration.
COMMUNICATIONS:
Communications support for this important civic project is a key element in the ongoing
development of the project. In addition to staffresources, the Steering Conunittee has also utilized
community volunteers to assist with providing valued input and resources into communications
initiatives. One of these initiatives was the publishing of an insert on the NFCC project and its
partnering organizations in the Niagara Falls Review on Tuesday, July 9, 2003. The Steering
Committee will continue to utilize these resources in a consultive role through the duration of the
project. Future initiatives will include additional Open Houses, Ground Breaking Ceremonies,
Tours, Opening Ceremonies, key media releases, broadcasts and presentations to communitygroups.
CONCLUSION:
The Niagara Falls Community Centre project is currently entering an important and much anticipated

phase of its development. Within the next four (4) months, a number of exciting developments and
changes will begin to transform this property into the exciting Community Centre that it will
become. The site will be leveled and graded in preparation of building the future Community Centre
and adjacent parklands. Construction of the Skate Park will be completed and it is anticipated that
this new facility will be available for use by the Fall of 2003. The NFCC project will be tendered
for construction and it is expected that the groundbreaking on this much overdue facility will also
be in the Fall of 2003.

As Council is aware, the City has engaged Totten Sims Hubicki to can'y out a Functional Design
Study for the Grand Boulevard between Victoria Avenue and Murray Street. The study will be
completed in the next three weeks and there will be a formal presentation at the August 11, 2003
Committee meeting.
The study will present the fmdings of the Traffic Analysis, that was carried out regarding the
purposed road, cross section of the boulevard and as well the various issues and costs associated with
carrying out the work.
Accordingly, it is Staff's suggestion that any decision regarding the Grand Boulevard be deferred
until this presentation is made to Council as well as the various stakeholders. Council should also
be aware that in addition to the opposition to the Official Plan and the Grand Boulevard, Staff has
received several calls in support of the Grand Boulevard.

ongoing implementation of the City's new Official Plan (OPA No. 26). My client operates the
Skylon Tower, Holiday Inn By The Falls and C.-~cade Inn and also owrm a parcel of undeveloped
land north of Roblnson Street and inumed!ately west of the former railway lands.
1t has come to my client's attention that presentations may be made to you at the Council Meeting
on Monday, July 14, 2003 or some date therca2~er from the Victoria Avenue Busings Improvement
Association that the Grand Boulevard, az described in OPA 26, should be reconsidered or cancelled.
The Grand Boulevard concept, as defined and described in OPA 26, is a vital and central component
to the long term planning policy of the City of Niagara Falls. The development of this concept and
policy and the enactment of OPA 26 followed a long, extensive and sometimes difficult public
process with input from a broad spectrum of interested parties and stakeholders. It is fundamentally
contrary to the integflty of official plan process mad to the efforts that were made by thc City and by
all parties that any group or stakeholder would now propose to amend the policy to exclude
i~nportant concepts, especially in a piecemeal manner.
As expected, parties rely upon the process and upon the policies to make important business
decisions. The development and existence of the Grand Boulevard policy has been a key component
in my client's ongoing planning and business decision initiatives. In addition, the Grand Boulevard
policy cannot simply be segmented or cancelled since the policy is so integral to numerous other
planning policies and concepts contained within OPA 26.

Dear Mr. Iorfida:
On behaif of the City of Niagara Fails who through Niagara Fails Tourism has received sufficient
funding to host additional fireworks throughout the summer, The Niagara Parks Commission and
sponsors request permission to carry out fireworks every evening throughout July and August for
the summer of 2003. The fireworks will be launched in the Niagara Gorge between the Maid of
the Mist Steamship Company and the Ontario Power Station at the new approvai fireworks
launch site. Approvals are being sought from the Niagara Fails Fire Protection and Safety
Department, Maid of the Mist, Ontario Power Generation and the Niagara Falls Illumination
Board. The display dates and times are as follows:
7 minute shows Every evening Monday through Sunday in July and August over
above the approved Fridays and Sundays.
The displays will be instailed and fired by the pyrotechnicai experts from David Whyasll
International Fireworks, Inc., Kenilworth, Ontario. They are familiar with the site and have been
extended for a 4t~ year.
The City of Niagara Falls is listed as co-insured with liability coverage for $5,000,000.00. A
Certificate of Insurance for the additional shows will be sent to the City Clerk beginning July 2nd
and proof of insurance for the additional dates will be sent within the next 7 days directly to you
by David Whysall, Speciaity Pyrotechnics 2003.

I have attached my previous email to the mayor for reference.
Since this email was forwarded to another party a decision was not made to my dilemma.
I would like to address council on this issue at the next council meeting. I would also like to know the
results of e-poll or phone poll about the daily fireworks. Please let me know about these items.
Dear Mayor Thomson:
I was just informed today by the Niagara Parks Commission that fireworks will be set off every single
night at 10:00 pm until Labour Day. This information has disappointed me greatly. I was inquiring at the
Parks Commission about whose decision it was to do this and Sarah Wood at the Parks Commission
informed me that aldermen were polled two weeks ago and approved it.
Several months ago council approved fireworks on Friday and Sunday nights. As you already know I
have two small children. My children go to bed before nine o'clock and unfortunately awake at ten
o'oclock on those nights thinking that it is thundering. I know that you realize how hard it is to get kids to
bed once they have been scared. When I went to inquire at the Niagara Parks I was thinking about asking
them to scale back to Friday nights only. At least on Fridays we do not have to get up to go to work and
can afford to sleep in a little.
When I found out that it will be every night, I really thought about myself first then I started to think about
those people who are in the same situation as me who live even closer to the fireworks, and then those
people who are seniors who go to bed early. Then I asked several friends and neighbours and they told
me about the effects of the fireworks on their dogs and cats, Then someone reminded me about the birds
and the major effect on those birds who are flying in the area that could be killed or go deaf. There is also
the effects on the environment, the smoke and chemicals that are released into the air and water must
have a negative effect on the air we breathe and the water we draw from. Then I was informed by the
Parks Commission that the taxpayers are paying for these additional displays of fireworks. I cannot
support this initiative to bring tourists to our great city.
I am asking you to re-poll the council members to reconsider this decision and just have fireworks on
Friday nights only. If you are looking to spend the extra money have a free concert on a Friday night in the
park and then set off the fireworks. Please let me know of your decision.

First of all, the fireworks program is heavily funded by locaI tourism
operators and, recently, has received some investment from the Province of
Ontario through the SARS Recovery Program announced by Premier Eves several
months ago. There are no City of Niagara falls tax dollars invested in the
program!!!
The Falls Fireworks program has broad tourism industry support with more
than 28 Iocal businesses contributing. The program is designed to be short
(7 minutes) and staged early to result in as littte impact as possible on
local residents.
The Faits Fireworks program will finish on Labour Day Weekend to ensure that
during the school year, there is no impact on families.

Proposed Museum with Off-Site Parking
RECOMMENDATION:
1 ) It is recommended that Council approve the requested amendments for building height and lot coverage for
a proposed museum at 5709 Victoria Avenue conditional upon a 1 O-foot stepback being provided at the 40-foot
level; and approve the request for off-site parking with a site plan agreement to be done in a timely fashion,
providing for road widening dedication & landscape improvements; with additional underground servicing &
paving, if required, to be over a maximum 5-year period and further, that the applicant work with the BCVA
to alleviate their concerns.
2)
BACKGROUND:
The amendment is requested for two parcels of land as shown on Schedule 1. First, a new building for Ripley's Believe
It or Not museum is proposed to be built at 5709 Victoria Avenue, shown as Parcel 1. Second, the applicant is proposing
to provide all of the parking off-site on Parcel 1 off-site on Parcel 2. Details are shown on Schedules 2 and 3.
Both parcels are currently zoned Tourist Commercial (TC). The applicant is request'rog site specific provisions to permit
an increase in lot coverage fi'om 70% to 85% and build'rog height fi.om 40 feet to 75 feet on Parcel I and to permit
required parking to be provided off-site on Parcel 2.
Surrounding Land Uses
The land uses surrounding Parcel 1 are a variety of tourist commercial uses comprised of souvenir stores, restaurants,
attractions and hotels. A municipal parking lot abuts the property to the west. Parcel 2 has similar tourist uses to the
east. South of Parcel 2 is the parking lot for the Quality Inn

on Ferry Street, to the north a restaurant and to the west, a branch of the British Canadian Veterans
Association and the former St. Ann's elementary school which is now an adult learning centre.
Circulation Comments
The application was circulated to City departments, government agencies and the public for
comment. Comments received to date are noted below.

Planning Review
Modifications to the building are required in order to comply with the built form
guidelines.
Parcels 1 and 2 are designated Tourist Commercial in the Official Plan and are within the
Clifton subdistrict. The proposed museum, Ripley's Believe It or Not, is an attraction that
will add to the mixture of pedestrian-scale tourist-servicing uses encouraged for this area.
The building's proposed height of 75 feet (equivalent to seven storeys) is well within the
Height Strategy (13 to 30 storeys) of the Official Plan. However, the Design Criteria for
High Rise Buildings states that buildings are to be stepped back 10 feet above the fourth
storey or at about 40 feet in order to maintain the pedestrian scale. Discussions with the
architect have disclosed that the stepback form can be accommodated with the current
building design with a 75-foot building height. Apparently, an alternate building design is
also being developed with a 50-foot building height which will provide a street level height
of 35 feet that is in compliance with the Design Criteria.

The Criteria als0 states that buildings up to the fourth storey can be built with no setback.
The proposed building is to have a lot coverage of 85%. The additional coverage will
eliminate some parking spaces that are now provided on-site. While the elimination of on-
site parking generally not desirable, in this instance the parking to be eliminated is not readily
accessible, as access can only be gained from the abutting municipal parking lot. Because
of this, patrons cannot use the parking in a practical sense. Therefore, the proposed increase
in lot coverage is reasonable.
2. Staff cannot support the request for off-site parking.
The subject development is in a cash-in-lieu of parking area where developments contribute
money to the City to provide parking instead of providing it. There are four cash-in-lieu
areas within the City: Victoria Avenue/Clifton Hill, Main & Ferry, downtown and in
Chippawa. All of these areas share a similar urban form in that buildings are built to the
street front on small lots with little space available for on-site parking. These areas were also
developed prior to the establishment of municipal parking regulations. Thus, the Planning
Act provides municipalities the opportunity to obtain cash-in-lieu of parking as a stimulus
for redevelopment and revitalization projects in that on-site parking does not have to be
provided.
The City's cash-in-lieu of parking policy provides for a system for obtaining cash-in-lieu.
In this instance, the current restaurant would require 30 parking spaces; three spaces are
provided on site and 27 spaces are legal non-conforming. These 27 spaces are essentially a
credit to the property. The proposal requires 37 spaces and will eliminate the three on-site
spaces. Given the credit of 27 spaces, the net increase in parking is 10 spaces, of which cash-
in-lieu would be required.
However, the applicant is proposing to provide the parking off-site on lands located at the
southwest comer of Magdalen Street and Ellen Avenue. The parking lot is about 1 ½ blocks
from the proposed attraction. Because it is well removed, the parking lot will not provide
parking in a practical sense for the attraction as patrons will not know of its location.
Moreover, the attraction will almost solely be patronized by walk-by traffic. Utilization of
cash-in-lieu better serves the public interest in that municipal parking lots can be developed
in strategic locations to service visitors. Off-site parking contradicts the cash-in-lieu policy
of the City and would not support the City's efforts to provide municipal parking in this area.
Accordingly, it is recommended that Council require the payment of cash-in-lieu instead of
the applicant's request for off-site parking.
However, should Council approve the request for off-site parking, a site plan agreement is
recommended to secure the required road widenings and landscaping. The applicant has
stated that he does not wish to enter into a site plan agreement as the parking lot has existed
for about 10 years and that he will provide an undertaking to dedicate a road widening on
Ellen Avenue and to landscape along Magdalen Street. Site plan agreements are standard
practice for any development and are obtained in order to provide the City with long-term
assurance that a project will be developed and maintained in accordance with the plans. To
not require a site plan agreement would set a dangerous precedent.
As noted above, Municipal Works requires road widenings along both Ellen Avenue and
Magdalen Street plus a daylight triangle. Obtaining appropriate road widenings is imperative

to the long-term functioning of the road network. Moreover, both street frontages of the
parking lot will have to be landscaped in order to provide screening in keeping with the
policies of the Official Plan. At least 7 feet of landscaping, comprised of an ornamental
fence or masonry wall, street trees and other plantings will be required in accordance with
the Streetscape Master Plan.
CONCLUSION:
In conclusion, the requested amendments for building height and lot coverage can be supported if
the building is designed to provide a stepback form at the 40-foot height. The request to provide off-
site parking cannot, however, be supported as the proposed attraction is within a cash-in-lieu of
parking area and parking should be provided in this manner as it better serves the public interest.
The parking lot to be used for parking is well removed from the attraction and will not provide
practical parking.
Should the request for off-site parking be approved, the applicant should be required to enter into
a site plan agreement.

This application proposes to amend the City's Zoning By-law to accommodate the construction
a new three storey building for the Ripley's Believe It or Not museum at 5709 Victoria Avenue.
Proposed zoning changes include an increase in lot coverage and building height and the partial
provision of required parking off-site at 5823 Ellen Avenue.
These lands are within the Niagara Falls Urban Area Boundary according to the Regional Policy
Plan and designated Tourist Commercial in the City's Official Plan. The proposed building
represents a more intensified use of this property that in turn generates a greater need for
parking. Parking should be provided on-site wherever possible or in close proximity to the use it
is intended to serve. The alternative location being proposed in this instance is over 350 metres
(1,150 feet) away which may be more appropriate for employee parking rather than museum
patrons. Further, it is our understanding that the Ellen Avenue parking lot may currently serve
another nearby commercial use. If the City is favourably considering the provision of off-site
parking for the museum, it should be satisfied that the location is appropriate and that the site
can adequately accommodate the required amount of parking.
Regional Planning staff would not be opposed to the approval of the proposed Zoning By-law
amendment from either a Regional or Provincial planning perspective.

BACKGROHND:
The amendment is requested for a vacant 3.5 acre parcel on the east side of Mears Crescent shown
on Schedule 1. The subject parcel was recently approved to be severed from 8333 Willoughby Drive
(the former King George V School) by the City's Committee of Adjustment (B17/2003/NF). The
amendment is requested to permit the development of a 32 unit townhouse project. Details are
shown on Schedule 2.
The land is currently zoned Institutional (1). The applicant is requesting a site specific Residential
Low Density, Grouped Multiple Dwellings (R4) zone with provisions to permit the development of
the proposed townhouse.
Surrounding Land Uses
The subject lands are surrounded by residential and institutional land uses.

Planning Analysis
1. The proposed development complies with the Residential policies of the Official Plan.
The lands are designated Residential in the Official Plan. The Residential policies of the
Plan encourage intensification of land use through infilling and the provision of a mix of
housing to cater to a wide range of households. Infilling is to be designed to achieve
compatibility and sensitivity in terms of density, height gradation, building mass and
arrangement, setbacks and appearance.
The subject lands are currently underutilized and are to be created through severance
from the former King George V school lands on Willoughby Drive. The consent
application has been appealed to the Ontario Municipal Board ("the Board"). The
size and configuration of the parcel are such that it is not possible to subdivide the
land into building lots. Development for a low density multi-unit development is
appropriate.

The applicant proposes to construct 32 townhouse units within eight blocks of
between two and five units each. The density of the development is 11 units/ac (21
units/ha) which is the density of most neighbourhoods with 40 to 50 foot lot
frontages and is well below the 20 units/ac (50 units/ha) maximum prescribed by the
Official Plan for townhouse developments.
The Official Plan states that townhouses should be located primarily on collector or
major collector roads. This is to assist in decreasing the infiltration of traffic into
neighbourhoods. As the proposed development has a density equivalent to that of a
subdivision of singles or semi's, the traffic generation can be accommodated by the
mad system.
Building heights for the development are to be one and two storeys and are thus in
keeping with the building heights of the surrounding area.
The townhouse units are to be built within eight blocks of two and five units in each.
Adequate separation distance has also been provided together with 25-foot rear yards
and 10-foot side yards. The development, shown on Schedule 2, has been designed
such that the buildings will not appear overly massive and will be in scale with the
surrounding area. Setbacks provide either the minimum requirements or exceed that
of single detached dwelling zone regulations.
The applicant's architect has advised that the development is to be built to appear
similar to Kingsbridge Court on Main Street. This, combined with attached garages
and 43% landscaping, should serve to help integrate the development into the area.
2. The requested amendment is essentially a reduction in development potential.
The lands are currently zoned institutional (I). The I zone permits a variety of uses including
a community building, nursing home, hospital and a private club. There are no density
regulations governing development. Landscape requirements are only 5% of the lot area.
As such, the lands could be developed much more intensely when compared to what is
proposed. Moreover, the amending by-law will be tailored specifically for this proposal
which will not permit any other form of development.
3. The proposal supports the principles of Smart Growth.
Smart Growth promotes the redevelopment of lands and intensification of underutilized
parcels in order to foster a more compact urban form which makes better use of infrastructure
and services. The subject lands are currently part of a school/day care which are surplus to
its needs, and thus make an opportunity to create a development site. The proposal provides
a reasonable use of the lands with a different housing style than is currently available in the
immediate area and will utilize the existing infrastructure and services.
4. A site specific R4 zone is appropriate.
The applicant is requesting that a site specific R4 zone be applied to the lands. Such a
zoning is appropriate as the amending by-law will permit only the proposed townhouse
development. Specific regulations will be included to require attached garages and control
density, setbacks, parking and landscaping.

It is recommended that Council withhold any approval of the amending by-law until
the Board has ruled on the consent application.
As noted above, the associated consent application has been appealed to the Board. Should
Council approve this application, approval of the by-law should be withheld until the Board
has dealt with the consent. In this way, if the consent is denied by the Board, the applicant
will have to revise both applications in order to proceed. Approval of the consent is
necessary in order to implement the zoning.
CONCLUSION:
In conclusion, the requested amendment can be recommended for approval because:

We are writing regarding the proposed townhouse complex that is to be built on Mears
Crescent in Chippawa. We are not against a development on this property what bothers
us Is the large number of units and their height. As well, we hope the water/sewer
situation in Chippawa has been addressed by the developer. Due to the large number of
flooded basements we have had over the years.
We would like to compromise and propose a reduced number of units all of only one
story, which matches the height of the current houses on Menrs, Welland and Bell
Crescents.
We realize that the developer would not make as much money per unit, but if they were
better quality he would make more per unit.
Kingsbridge Village is a good examplie of what would be appropriate to this
neighborhood.
The type of housing proposed would be more appropriate to Willoughby Drive.

Status Report - Parking and Sidewalk Caf6 Issues
RECOMMENDATION:
It is recommended that Council receive this report for information purposes.
BACKGROUND:
Council, at its meeting on June 16, 2003, requested that staff look into parking conditions at Danny O's
at 6383 Drummond Road. There has been a history of concerns and complaints about this property located
at the southwest comer of Drummond and Murray Streets, including traffic concerns, noise and
disruptions. Currently, the liquor license has been revoked for the property and the establishment appears
to have been closed.
This report is to provide a status of issues regarding this property, including parking, the sidewalk caf6,
and building permits, and indicate a course of action if a business, under a new liquor license, is
established here.
Parking Concerns
The parking stalls accessed directly from Murray Street are deficient in size and could only accommodate
medium sized vehicles. Ifa large vehicle such as a track or van were to park here, it will extend onto city
road allowance and block the public sidewalk.
At an April 2001 on-site meeting with staff and the owner, this situation was discussed. It was agreed that
angled parking stalls would be striped in this parking area, signs would be posted indicating that large
vehicles are to be parked across the street to avoid vehicles overhanging the sidewalk and City Staff
would patrol and issue tickets for vehicles overhanging the sidewalk.
To date, the owner has complied with the first two conditions indicated above. Furthermore, Traffic
Services has indicated that since 2001, they have not received formal complaints about vehicles
overhanging the sidewalk and have not issued any tickets.
This situation will continue to be monitored by staff. If vehicles overhanging the sidewalk becomes a
problem, options such as relocating the sidewalk to the curb face at the owner's cost will be investigated.

Building Permits
Records indicate that canopies on the north and east elevations, a cantilevered floor system and an
overhead door on the north elevation were constructed without a building permit. In 2001, an order to
comply was issued. This order has not been complied with, nor has he applied for a building permit. The
owner has the option of removing this construction or seeking appropriate building permits.
Staff will continue to follow up with these outstanding building concerns. No new liquor license should
be entertained, or sidewalk caf6 agreement entered into until the building matters have been dealt with to
the satisfaction of the Building and By-law Services Section.
Sidewalk Caf6
The existing deck is situated on the road allowance.
When Drummond Road was under Regional jurisdiction, an encroachment agreement was issued to permit
the existing deck to be used as a sidewalk caf6. Since this time, the jurisdiction of this road has been
delegated to the City. Although, a sidewalk caf6 application was applied for in 2001, a sidewalk caf6
agreement was never executed.
Prior to re-licensing this caf6, a new Sidewalk Caf6 application would need to be submitted and a new
agreement executed. The agreement would require liability insurance for the caf6 that would provide
protection for the City, would permit the City to require removal o fthe caf6 if it becomes a safety risk and
would prohibit operation between 11 p.m. and 8:00 a.m. in accordance with the Sidewalk Caf6 Guidelines.
Staffwill follow up with the owner, indicating that a new application will need to be submitted or the caf6
removed. No liquor license will be endorsed by the City until one of these two actions happens.
CONCLUSION:
Staff will follow up with the owner or a new owner/operator regarding the outstanding issues indicated
above.

RECOMMENDATION:
It is recommended that Council endorse the actions of the June 18, 2003 meeting of the

BACKGROUND:
The Environmental Planning & Greening Committee dealt with a number of items in their recent
meeting and wish to highlight the following items requiring Council's endorsement.
1. Municipal Tree By-Law
The Environmental Planning and Greening Committee (EP&G) encourages the protection and
enhancement of the environment and the conservation of natural resources. At their recent meeting,
the EP&G Committee reviewed a draft copy of the Municipal Tree By-Law with Staff and the
following recommendation was made:
That the draft Municipal Tree By-Law be referred to Staff for further changes and once the
changes have been made, forwarded to Council.

2. Proposed Industrial Storage, North of the Current Extension of Oakwood Drive
The Environmental Planning & Greening Committee is aware of the proposed development for
industrial storage, north of the current extension of Oakwood Drive. The EP&G Committee is
concerned with preserving trees along the border of the Millennium Trail and woodlot protection in
the second phase of development.
A motion was made to encourage Senior Staff to work with the developer to encourage the
saving of trees and to ensure that a proper landscaping buffer strip be provided on the
developer's property along the fence line adjacent to the Millennium Trail.
Council's endorsement of the above would be appreciated.

RECOMMENDATION:
That Council approve the CD Fund-Raising Proposal.
BACKGROUND:
The Members of the Arts & Culture Conunission wish to undertake a fund-raising initiative in order
to increase the City's Young Family Endowment Fund. The project entails the production,
marketing and distribution of a Christmas CD which will showcase local talent. Approximately
$21,000 is currently in The Young Family Endowment Fund and each year about $900 in interest
is generated and used for arts related grants. In order to increase the amount of the annual grants,
the Commission plans to build up the principal sum of the Fund. By so doing, greater interest will
be generated each year thereby allowing larger arts related grants to be distributed to local
individuals and organizations.

Funds are available within the Arts & Culture Commission's reserve to cover the initial expenses.
The reserve fund will be replenished l~om the sale of the CD's.
Mr. Rick Rose, a local musician, has expertise in recording and CD production and has worked
closely with a few of the members of the Commission to develop the proposal. He has also agreed
to coordinate the project on a volunteer basis. This fund- raising project is in keeping with the Arts
& Culture Commission's mandate to promote an awareness and appreciation of the arts and to the
support of local talent.
Members of the Arts & Culture Commission would appreciate Council's support of this worthwhile
project.

RECOMMENDATION:
It is recommended that Council approve the purchase of 70 sets of ISI Self-Contained Breathing
Apparatus (SCBA) units along with spare air bottles, Rapid Intervention Team Rescue Bags and
maintenance software at a total cost of $496,548.00.
BACKGROUND:
The Self-Contained Breathing Apparatus (SCBA) being used by the members of the fire service is
at the point of requiring replacement. Many of the SCBA units are beyond their expected useful
service life. The frequency of and the costs of maintenance have been on the rise. The Nationai Fire
Protection Association (NFPA) amended the standard for SCBA in February of this year to provide
for additional features designed for the safety of firefighters while working in SCBA.
The SCBA that are available on the market have the same basic functionality. The differences occur
in less tangible areas than functionality or appearance and are in more user def'med areas such as
comfort, fit, visibility, donning and doffing ease, effectiveness of Heads Up Display, etc.
An SCBA Evaluation Committee of members was established to develop a method to evaiuate the
SCBA that was on the market. The Committee was comprised of the two Assistant Chiefs, the
President of the Association, two members of the Joint Heaith and Safety Committee, the Director
of Training, the Training Officer and one of the current SCBA Technicians. The method of
evaluation was determined to be a two-step process. First, the six most predominant suppliers of
SCBA in the fire service market were asked to make a presentation'to the Committee to give a full
demonstration and explanation of their product and their company. There was a set of pre-

determined issues that each was asked to address during the course of their presentation. On the
basis of the presentations, there was a short list of four suppliers who were asked to supply demo
SCBA for further comprehensive evaluation. This second evaluation was performed by a sub-
committee of four firefighters with a range of experience. A set of job related performance tests
were developed and each of the firefighters was asked to rate each SCBA on the basis of its
performance during the tests. The tests included such things as donning and doffing, on air and pre-
entry, harnessed security and chopping, hoses roll, ladder climb, search and rescue, communications,
cylinder change, extreme temperature, peak load performance and overall assessment. The manner
of evaluation was reviewed with the Manager of Supply and Services and determined to be
appropriate. The IS self-contained Breathing Apparatus proved to be the overwhelming choice of
the Committee and the evaluators.
The replacement of SBA was identified and approved in the 2003 capital budget on the basis of
being split more than 2003 and 2004. The 2003 budget provides for partial debenturing; however,
in reviewing this matter with the Director of Finance, additional borrowing at this time will take
advantage of special terms of payment and delivery.
It is recommended that Council approve the purchase oflSI Self-Contained Breathing Apparatus in
the amount of $496,548.00, including taxes, subject to financing terms and arrangements suitable
to the Director of Finance.

RECOMMENDATION:
That this Report be received for the information of Council.
BACKGROUND:
On July 12, 1999, Council enacted By-law No. 99-144 which established a new schedule of
development charges, commencing on August 2, 1999.
Section 18(a) of the above By-law stipulates that the charges shall be indexed annually, on August
1, thereafter without further amendment to the By-law in accordance with the StatsCan Quarterly
Construction Price Statistics Catalogue and this has been applied each year since 1999.
The above index has increased by 3.1% fi.om 2002 to 2003 and the City Development Charges have
been adjusted accordingly and are shown in the attached table.

RECOMMENDATION:
It is recommended that staff be authorized to enter into an Agreement of Partnership with
Integrated Municipal Services (IMS) as per costs included in attached Schedule "C."
BACKGROUND:
At the Community Services Committee meeting on February 17, 2003 Committee approved report
MW-2003-40 - Site Preparation and Enhancement of the McLeod Road Properties Proposed
Community Centre and Skate Park Development. Staff was directed to prepare an agreement of
partnership with Integrated Municipal Services (IMS) to complete the site enhancements on the East
and West side Montrose Road.
Questions have been asked with respect to the revenue sharing for the reclaiming of the rock on the
west site. As part of the proposal submitted by IMS they proposed that the revenues be split on a
fifty/fifty (50/50) basis for the stone that was sold. It should be noted in the other proposal received
from Rankin Construction they indicated that reclaiming of the rock was to risky and not cost
effective. Accordingly, they did not propose any revenue sharing.
It is Staff's opinion that the proposal put forward by IMS is best for the City as they will be assuming
the risk, they have the expertise in crushing the rock and ensuring that the stone meets applicable
standards. In addition IMS through Walker Industhes has the Sale Staff in place to market the
material. The City does not have the resources to handle the rock reclamation and it's sale.
Council should also be aware that expenses have been incurred for work on the west side, that being
the cleating of the trees and the erection of the silt fence. These costs are in the order of $300,000
with the payment being deferred to a later date.

PAYMENT PROVISIONS AND OPTIONS
The parties hereto agree that, subject to the provisions of this Agreement, the City shall pay IMS for
all Work performed pursuant to this Agreement, as follows:
The City shall pay IMS a mobilization fee of Three Hundred Thousand Dollars
($300,000.00), which fee shall be due and payable by the City upon receipt of an invoice
submitted by IMS;
Any and all revenue generated from the recovery of aggregate from the East Site and West
Site will be shared with the City on a 50/50 basis and the City's proportionate share will be
applied as a credit in favour of the City, in reduction of the total monies owing by the City
to IMS; and
In the event that any corporations affiliated with [MS are retained as subcontractors for any
Work contemplated herein, the total monies owing to such affiliated corporation shall be
credited in reduction of the total monies owing by the City to l/viS.
In the event that the City defers any decision with respect to the development of the West
Site, the City shall pay [MS in full for all Work completed, subject to substantial completion
of the Work.

Development Charges Update Study
Consultant Engagement - C.N. Watson Associates
RECOMMENDATION:
It is recommended that C.N. Watson Associates be engaged by the City of Niagara Falls to
complete the update of the Development Charges Background Report at a cost of $49,700.00
plus GST.
BACKGROUND:
At its meeting on June 16, 2003, Council adopted the recommendation outlined in report
MW-2003-107 directing staff to invite a proposal from C.N. Watson Associates to complete an
update of the City's Development Charges Background Report and new by-law.
Staff has met with the consultant to discuss the work program and fee schedule which is attached
for your reference. The financing for this project will come from the Development Charges Reserve.
The project will be coordinated by Municipal Works staffusing a steering committee approach with
representatives from each department. Your consideration of this recommendation is important to
allow staffto commence the work plan this month.

Consulting Services for the Bridge and Culvert Inspections
RECOMMENDATION:
It in accordance with the City's Consultant Selection Policy, it is recommended that the City of
Niagara Falls enter into a Consulting Services Agreement with Ellis Engineering Inc. for the
Inspections of Bridges and Culverts for the upset limit of $30,000.00, excluding GST.
BACKGROUND:
The City of Niagara Falls is planning to update the Bridge and Culvert appraisals that were last
completed in 1994. This work will provide the City with the necessary tools to plan any necessary
work and provide funding allocations in the appropriate y~ars for planned works. The Consultant
will carry out the work through the Fall and provide final documents in December.
As per the City's Consultant Selection Policy, direct appointment for Consultants up to $60,000.00,
Ellis Engineering Inc. has been selected to complete this work. Ellis Engineering Inc. has carried out
similar work for other Municipalities and has completed work for the City of Niagara Falls in the
past. Staff is therefore recommending that they be retained for this work.

Highway 420/QEW, Structure # 7 Replacement,
Toronto Bound Traffic
RECOMMENDATION:
It is recommended that this report be received and filed.
BACKGROUND:
On Wednesday July 9, 2003, the Ministry of Transportation indicated that Bridge # 7, Niagara Falls
to Toronto bound traffic will be demolished and the deck will be rebuilt. Attached is a plan showing
the location of this structure. This is a result of greater deterioration than originally suspected. The
Bridge is deemed unsafe by the Ministry and work must commence immediately. It is expected that
the demolition will commence on July 22, 2003. Once the scheduling and method of demolition and
construction are finalized a further report will be submitted to Council.
The MTO will work with the City on closures and detours prior to the actual work taking place.
A further report will be made to Council at their meeting of August 11, 2003.

RECOMMENDATION:
That Council receive and file this report for information purposes.
BACKGROUND:
A few weeks ago, Parks, Recreation & Culture staff received an inquiry from BeT Construction
asking if the City would be interested in accepting fill material from the construction of the
QEW/Sand Plant Hill widening project at the City's nearby Mewbum Road property. This 92-acre
property, which is located west of the City's former landfill, forms part of the Mountain Road
Recreation Area and an amendment was approved a couple of years ago by the Regional
Municipality of Niagara for this site to be used for outdoor sports field use. One of the needs for the
eventual recreation use of this site is for the grades to be elevated and thus the need for fill material.
The opportunity presented by BeT construction will greatly assist the City in preparing the Mewbum
site for outdoor sports field use.
The widening of the QEW at Sand Plant Hill will occur over a three-year period with most of the
depositing of fill occurring over the first two years. BeT estimates that about 100,000 cubic metres
of material will be deposited, of which 20,000 cubic metres will be top soil. Most of the fill material
is sand. BeT construction has stated that they are prepared to strip the top soil from the Mewbum
site and stock pile it for final grading use. The material will be placed at the southerly portion of the
site closest to Mountain Road. BeT is hopeful to utilize the former landfill weight station building
as an office and contact has been made with the Niagara Region who now owns the former landfill
site.

As Council will recall, a couple of months ago, a proposal was supported involving the temporary
use of the Mewbum Road site by a model airplane club. Staff has informed the flying club of the
fill material being offered to the City and therefore, they will have to search for another site. The
flying club was initially made aware of the City's long term plans for the recreational use of the site
and the need for fill.
The Mewburn Road site is located within the Niagara Escarpment Control Area and the placement
of fill will require a development permit from the Niagara Escarpment Commission. The
Commission has been made aware of the opportunity for the City to accept fill for the site and it is
hopeful that approval could be granted in short order. City Engineering staff is assisting in the
preparation ofnecessaryplans and the contacting of other agencies including the Ministry of Natural
Resources, the Niagara Peninsula Conservation Authority and Ministry of Environment.
Conclusion
The opportunity to accept fill material for the Mewburn Road site is an excellent one and one that
will greatly assist in the eventual development of the City's Mewbum Road site for active sports
field use.

RECOMMENDATION:
That Council authorize the purchase and installation of office furniture for the Fire Prevention Office
from Mayhew and Associates of Burlington at a total cost of $23,248.90 plus taxes.
BACKGROUND:
The current Fire Prevention Office furniture, with the exception of the desk chairs, ranges in age
from 15 to 40 years old. Office environment and work space needs for the efficient performance of
the employees' work have changed considerably. With the addition of two new staffpositions in
2001, the space for each Fire Prevention Officer has been reduced. The older furniture is larger and
bulkier and requires more space. There is little or no space available at each work station to store
reference material. Some current work stations have little or no drawer space. Some of the desks
which the Fire Prevention Officers use are old secretary's desks and are not suitable for the
requirements of the modem day job. Unfortunately, the bidders have advised us that the existing
furniture and dividers, etc. have no value based on their age, condition and appearance.
Our recommendation is to purchase from Mayhew and Associates, based on:
· The furniture has extra storage space for reference material and filing as required.
· The furniture provides storage with locks for sensitive material as required.
· The furniture will provide larger work surfaces to suit office requirements.
· Our experience indicates that Steelcase is a durable, sturdy product.
· Meets the requirement of all office staff.

BACKGROUND:
At its meeting of April 7, 2003, Council authorized Staffto commence proceedings to permanently
close Parcels A, the Unnamed Road Allowance and Parcels B, C and D which are opened road
allowances. A copy of report L-2003-24 is attached as Appendix "1".
At its meeting of April 28, 2003, Report L-2003-33, attached as Appendix "2" was deferred until
such time as the concerns of residents could be addressed by staff and the developer. However, staff
received authorization to proceed with the closing of the Unnamed Road Allowance.
On April 11, 2003, Canadian Pacific Railway expressed an interest in purchasing the portion of the
Unnamed Road Allowance where its railway line crosses over.
On May 20, 2003, staff and the developer met with the residents to resolve their concerns.
At its meeting of June 2, 2003, Report MW-2003-103, attached as Appendix "3" Council resolved
that the recommendation to proceed to stop up and close portions of Grassy Brook Road and
Crowland Avenue as set out in recommendations in report L-2003-33, be denied.
As such, in order to carry out the procedure with respect to the sale of the Unnamed Road
Allowance, it is necessary to pass the recommendations as set out on the previous page, to declare
the lands surplus and offer for sale, accordingly.
Timing of the transfer of the Unnamed Road Allowance will take place just prior to the registration
of the Site Plan Agreement so that the Unnamed Road Allowance can be incorporated into the
development plans.

That the City of Niagara Falls proceeds to stop up and close portions of Grassy Brook Road and
Crowland Avenue Road as set out in recommendations in report L-2003-33 subject to the
additional considerations described in this report.
BACKGROUND:
At its meeting held on April 28, 2003, the Niagara Falls City Council considered a request from thc
D,veloper of the proposed Grand Niagara Resort to close portions of Grassy Brook Road and
Crowland Avenue in order to facilitate the design and construction of their world-class project on
the subject lands.
A number of residents in attcndanee at thc meeting spoke against thc closures resulting in Council's
decision to defer thc closure until the developer could arrange a meeting with the residents to
resolve some of their concerns.
On Tuesday, May 20, 2003 the residents were given the opportunity to meet the developers and their
consultants review their concerns and obtain more information about the resort proposal. The issues
raised at this meeting can be summarized as follows:
1. What are the impacts on the existing road system resulting from the new development?
2. What consideration has been given to Grassy Brook Road residents for the convenience of

having to drive around the resort?
3. What procedures does the City have to follow in order to legally close roads?
4. Why would the City close the roads without the benefit of an approved site plan?
Have emergency services staff had the opportunity to review the impacts of the proposed
road closure?

Can the rasort proposed be redesigned to accommodate a public road through it? (I.e.,
existing or modified alignment of Grassy Brook Road)
7. Can the residents review the Traffic Impact Studies (original plus addendum reports)?
Will the "Dead End" roads have proper turning cimles to accommodate school buses,
snowploughs, garbage and recycling trucks?
9. Are there any plans to upgrade the signalized intersection at Bigger Road/Montrosc Road?
10.
Are there any plans to upgrade Morals Road so that it will have sufficient width, turning
radii, and structural capacity to handle the increased volume of traffic that will be directed
to it?
11. Are the environmental impacts of the Golf Course/Resort being taken into consideration?
12.
Will there be an opportunity for the public to view the site plan for the resort and make
comments for Council/staff's consideration.
13.
Can the primary entrance to the resort be relocated of f the Crowland Avenue Road allowance
so that it doesn't impact the Facca Property?
14.
Can the unopened road allowance (the one closed at the April 28, 2003 meeting of Council)
be used as an entrance to the resort?
In addition to these questions a number of comments regarding poor notification of the residents
meeting, lack of input fi-om the neighbours on site plan de~ails and perceived inconvenience was
expressed.
One important common consideration however was that the residents had NO OBJECTION to the
golf course/resort complex being constructed in this area.
STAFF COMMENTS:
The Grand Niagara Resort is a project that is truly unique to Niagara Falls and staff acknowledges
that the finished product will be the result of balancing a number of environmental, financial and
social impacts. The process is more evolutionary than predetermined because as constraints are
identified at each level of the planning process the design must be adjusted, in this particular case,

we may not have all of the answers to the questions before we are asked to proceed. At issue is
whether the roads should be closed first then the site plan developed or vice versa.
The current version of the Site Plan has factored in the various constraints, setbacks and servicing
objectives, but in order for this plan to be finalized a decision regarding the closure of the roads is
necessary. Staff report L-2003-24 (page 2, 2~ to last paragraph) confirms that the transfer of the
road allowances in question would only take place just prior to the registration of the site plan
agreement. This gives Council the opportunity to consider the final closure of the roads if the Site
Plan is not satisfactory. At this point, the developer is seeking direction as to whether they should
proceed on the assumption the roads can be closed or whether they should downscale their project
and design around the public roadways.
Given the sensitivity of the hnpacts and the mutual interests in developing a world-class resort
complex in this urea, staff is recommending that we proceed with the road closure as originally
contemplated and involve the residents in the Site Plan Review process to address the concerns they
have raised. This would involve some additional meetings with the developer as the various
components of the project come on line.
It is our opinion that issue~ # 1,2,5,6,7,8,9,10,11,12,13,and 14 can be addressed through the site plan
agreement. Issue number three (3) regarding the road closure process has indeed been properly
pursued under the authority of the Municipal Act. Issue number four (4) asks the question as to
whether the site plan agreement should be negotiated before the road closure. In effect that is exactly
what is being done.
Accordingly, staff is asking to confirm the recommendation set out in report L-2003-33 with the
only point of clarification that the residents be invited to participate in the final site plan process
regarding the resort component of the project and that Council give final approval to the Site Plan
and corresponding agreement at the appropriate time.

RECOMMENDATION:
That a road widening, being Part 1 on Reference Plan 59R-7271 attached as Schedule "A", be
established as a public highway, to be known as Fallsview Boulevard.
BACKGROUND:
As a condition of site plan approval, 876891 Ontario Limited conveyed a road widening to the City.
The subject lands are located on the west side of Fallsview Boulevard and shown hatched on the plan
attached. Staff is now recommending that the subject lands be dedicated as a public highway to form
part of Fallsview Boulevard.
