Carried Unanimously b) 2018- 28 A by-law to appoint an Acting City Clerk. 2 CALL TO ORDER a) 0 Canada sung by Juliet Ryan. b) ORDERED on the motion of Councillor Pietrangelo, seconded by Councillor Campbell that Dave Smith be permitted to address Council. Carried Unanimously Dave Smith recited a poem. 3 ADOPTION OF MINUTES a) Council Minutes of February 27, 2018 ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by Councillor Mike Strange that the minutes be approved as amended, Page 1 of 14 Councillor Campbell to appear as absent on the minutes of February 27, 2018. Carried Unanimously 4 DISCLOSURES OF PECUNIARY INTEREST Disclosures of pecuniary interest and a brief explanation thereof will be made for the current Council Meeting at this time. a) Councillor Campbell indicated a pecuniary interest to cheque number 41308, made out to the Katy Marie Campbell foundation and to report F- 2018-08. b) Councillor Craitor indicated a pecuniary interest to cheque number 413046 made payable to himself. c) Mayor Diodati indicated a pecuniary interest to cheque number 413231, made payable to himself. 5 OUTSTANDING ITEMS a) Winter Festival of Lights ORDERED on the motion of Councillor Wayne Campbell, Seconded by Councillor Victor Pietrangelo to reconsider the motion regarding the WFOL funding on February 27, 2018. Motion Carried with Councillor loannoni opposed ORDERED on the motion of Councillor Mike Strange, Seconded by Councillor Wayne Campbell to allow Tina Myers to address Council. Carved Unanimously b) Tina Myers, Winter Festival of Lights addressed Council and outlined the importance of the additional funds. ORDERED on the motion of Councillor Wayne Campbell, Seconded by Councillor Victor Pietrangelo that Council approve the funding request of $400,000 for the WFOL. Motion Carved with Councillor loannoni opposed and Councillor Kerno declaring a conflict. Motion Defeated d) Communication - Niagara Peninsula Conservation Authority - Supplementary comments re: 8960 Willoughby Drive, Legends Estates. ORDERED on the motion of Councillor Carolynn loannoni, Seconded by Councillor Mike Strange that the communication be received as information. Carried Unanimously ORDERED on the motion of Councillor Carolynn loannoni, Seconded by Councillor Joyce Morocco that all the correspondence regarding the Willoughby Drive application be received and made part of the public record. Carried Unanimously 6 MAYOR'S REPORTS, ANNOUNCEMENTS a) Mayor Diodati extended condolences to Platoon Chief Pete Methner on the loss of his mother Mary Lou Methner, Shen Armstrong on the passing of her grandmother Eunice Bates. Mayor Diodati informed Council of the recent events: Big Brother s Big Sisters Bowl for Kid's Sake; Opening of the new Community Health Centre; Boys and Girls Club of Niagara's 20th Annual Sweep for Kids Bonspeil; Good Nature'd Health opening on Lundy's Lane and the annual State of the City Address. The next meeting of Council will be April 10, 2018. 7 DEPUTATIONS/PRESENTATIONS a) A Dav of 1000 Musicians Paul Brockwell, SCVFA informed Council about an all day event planned at Fireman's Park on July 21, 2018 and requested Council and City Council March 27, 2018 Page 3 of 14 staff's assistance with advertising, website promotion and use of the Gale Center for parking. ORDERED on the motion of Councillor Wayne Campbell, Seconded by Councillor Victor Pietrangelo that Council support the event and refer the list of requests to staff to assist. Carried Unanimously b) Niagara Falls Elvis Festival Dino Fazio informed Council of the 2nd Annual Niagara Falls Elvis Festival taking place April 20-22 2018 at the Greg Frewin Theatre and requested the month of April 2018 be proclaimed " Niagara Falls Elvis Festival Month' in the City of Niagara Falls. ORDERED on the motion of Councillor Kim Craitor, Seconded by Councillor Victor Pietrangelo that Council support the Festival and proclaim the month of April as "Niagara Falls Elvis Festival Month" in the City of Niagara Falls. Carried Unanimously 8 BUDGET a) Councillor Pietrangelo chaired the budget meeting. Todd Harrison provided Council with a power point presentation on the Operating Budget. ORDERED on the motion of Councillor Joyce Morocco, Seconded by Councillor Mike Strange that Council approve the operating budget with option 2 be approved. Motion Carried with Councillor loannoni and Kerrio opposed 9 PLANNING MATTERS a) Public Meeting Official Plan Amendment No. 115 Zoning By-law Amendment Nos. 2012-014 & 2018-002 Accessory Dwelling Units Background Report: PBD-2018-16 City Council March 27, 2018 Page 4 of 14 Alex Herlovitch, Director of Planning and Development provided Council with background on the application. Brian Keenan, 3813 Potter Heights, is in support of accessory dwelling units but not having the owner mandatory in the residence. Marion Figueroa, Niagara Falls resident, in support of the accessory dwelling units, she believes it will help alleviate the financial burden of many Niagara falls home owners. Jane Serluca, Niagara on the Lake, in favour of application and feels it creates affordable living. The Public Meting was Closed. ORDERED on the motion of Councillor Joyce Morocco, Seconded by Councillor Carolynn loannoni that the report be approved with a friendly amendment, that one of the units must be owner occupied. Motion Carried with Councillor Kerno declaring a conflict. b) Public Meeting Official Plan Amendment No. 125 Transit Station Secondary Plan Adoption of the Secondary Plan Background Report: PBD-2018-17 Alex Herlovitch, Director of Planning and Development provided Council with background on the application. The Public Meeting was Closed. ORDERED on the motion of Councillor Wayne Campbell, Seconded by Councillor Mike Strange that the report be approved as recommended. Carried Unanimously 10 REPORTS a) BDD-2018-002 - Association of Municipalities of Ontario Request City Council March 27, 2018 Page 5 of 14 for Proposal to Host Annual General Meeting, Conference, and Trade Show The report is recommended for the Information of Council. ORDERED on the motion of Councillor Wayne Thomson, Seconded by Councillor Joyce Morocco that City staff work with the Convention Centre staff to submit a proposal to host as many of the upcoming AMO Conferences as possible (2021, 2022, 2023 and 2024). Carried Unanimously b) F-2018-08 2017 Sleep Cheap Event and WonderFalls Pass The report is recommended for the information of council. ORDERED on the motion of Councillor Mike Strange, Seconded by Councillor Wayne Campbell that the report be approved as recommended. Carried Unanimously c) F-2018-09 - Annual Statement of Remuneration The report is recommended for the information of Municipal Council. ORDERED on the motion of Councillor Joyce Morocco, Seconded by Councillor Wayne Thomson that the report be approved as recommended. Carried Unanimously d) F-2018-10 - Municipal Accounts The report recommends that Council approve the municipal accounts totaling $8,592,524.86 for the period February 10, 2018 to March 11, 2018. ORDERED on the motion of Councillor Wayne Thomson, Seconded by Councillor Kim Craitor that the report be approved as recommended. Carried Unanimously L-2018-02 - Main and Ferry BIA, Request to Change Method of Raising Revenue The report is recommended for the Information of Council. ORDERED on the motion of Councillor Carolynn loannoni, Seconded by Councillor Wayne Campbell that the report be approved as recommended. Carried Unanimously MW-2018-03 Assumption of Various Subdivisions The report recommends the following 1. That City Council formally assume Garner Village and Fernwood Estates (Phase 2) Subdivisions; and 2. Council authorize the assumption of Warren Woods (Phases 1 & 2), Miller Road Estates North, and Chippawa West (Phase 2, Stages 1 & 1A) Subdivisions subject to the completion of outstanding works to be finalized by December 31, 2018. ORDERED on the motion of Councillor Wayne Thomson, Seconded by Councillor Carolynn loannoni that recommendation # 1 be approved and # 2 be a direction to staff. Carried Unanimously h) MW-2018-04 - Drinking Water System Summary Report and Overview The report is recommended to be received and filed. Carried Unanimously i) MW-2018-05 2018 Waterfront Investment Program Millennium Trail Section 5 J) The report recommends that Staff be authorized to submit an application to the Niagara Region to fund the Millennium Trail Section 5 project under the Waterfront Investment Program. ORDERED on the motion of Councillor Wayne Thomson, Seconded by Councillor Kim Craitor that the report be approved as recommended. Carried Unanimously R&C-2018-07 Naming and Renaming of Parks — Dan O'Connor and Don Ede Applications The report is recommended that Council approve the Recreation Committee recommendation to not support the application requests for park naming in honour of Dan O'Connor and Don Ede. ORDERED on the motion of Councillor Joyce Morocco, Seconded by Councillor Wayne Campbell that the applications of Dan O'Connor and Don Ede be submitted for reconsideration of street naming; and if still deemed inappropriate for naming, that Council then be provided with an explanation. Carried Unanimously k) TS-2018-09 Canadian Corps of Commissionaires Contract Renewal The report recommends the following: 1.That Council approve a one (1) year extension to the Canadian Corps of Commissionaires (Hamilton) contract for the supply of Parking Control Services and Building Security Services; and; 2)That the Mayor and City Clerk be authorized to execute the necessary agreement. Carried Unanimously 11 COMMUNICATIONS AND COMMENTS OF THE CITY CLERK a) Victim Services Niagara - Dinner and Comedy Show: request for funding by purchasing a table ($100 a ticket or $1000 table of 10) for their event on May 3, 2018. RECOMMENDATION: For the Consideration of Council ORDERED on the motion of Councillor Carolynn loannoni, Seconded by Councillor Kim Craitor that Council support the event with the purchase of a table. Motion Carried with Councillor Thomson declaring a conflict. b) Garage Sale at the Gale: Fundraiser for the Activity Subsidy Fund 2018 - request Council's support for the Recreation Committee to host fundraising event; consent to an Early bird fee of $20.00 until April 30 and a regular fee of $25.00 starting May 1 per vendor space; consent to a fee of $100 per sorporate vendors ( Max. 10); and to waive all municipal licensing fees associated with the event, including and Specific Location Daily Sales Licence fees. RECOMMENDATION: For the Consideration of Council ORDERED on the motion of Councillor Mike Strange, Seconded by Councillor Victor Pietrangelo that the communication be approved. Carried Unanimously c) Niagara Falls Downtown BIA - 90 Minute Parking Queen Street and adjoining side streets RECOMMENDATION: For the Consideration of Council ORDERED on the motion of Councillor Carolynn loannoni, Seconded by Councillor Wayne Thomson that the communication be be approved. Carried Unanimously City Council March 27, 2018 Page 9 of 14 City Council March 27, 2018 d) Autism Ontario - requesting that Council proclaim Apnl 2, 2018 as " World Autism Awareness Day" and that the Autism Ontario flag be raised on Tuesday Apnl 3, 2018 ( due to Easter Monday being a holiday). RECOMMENDATION: For the Approval of Council ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by Councillor Carolynn loannoni that April 2, 2018 be proclaimed as "World Autism Autism Awareness Day" in the City of Niagara Falls. Carried Unanimously e) Poetry City Challenge 2018 RECOMMENDATION: For the Information of Council ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by Councillor Vince Kerrio that the communication be approved. Carried Unanimously g) Councillor Morocco exited Chambers Regional Correspondence - re: Niagara Regional Housing Property Tax Exemption Analysis RECOMMENDATION: For the Information of Council ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by Councillor Mike Strange that the information be received and referred to staff. Carried Unanimously Ontario Chapter, Canadian Public Works Association - Request the week of May 20-26, 2018 be proclaimed as "National Public Works Week" in the City of Niagara Falls. RECOMMENDATION: For the Approval of Council ORDERED on the motion of Councillor Vince Kerrio, Seconded by Councillor Wayne Campbell that the week of May 20-26, 2018 be proclaimed as " National Public Works Week" in the City of Niagara Falls. Carried Unanimously k) Norm Puttick — Requesting Council's support in asking the Regional Municipality of Niagara for a review of the 2000 Berkeley consultant report on Governance in Niagara. Carried Unanimously 12 RATIFICATION OF IN CAMERA MATTERS a) In Camera meeting of March 27, 2018 ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by Councillor Kim Craitor that the following matter be approved. HR-2018-01 - Fire Arbitration Award That Council receive the following information on the recent Fire interest arbitration award for consideration in the 2018 operational budget; That Council officially ratify the recent Fire interest arbitration award consisting of a 7.57% wage increase over three years, including some benefit enhancements outlined herein and the 25 hour shift schedule starting in 2019. Carried Unanimously 13 BY-LAWS The City Clerk will advise of any additional by-laws or amendments to the by- law listed for Council consideration.
