Road (McLeod Road to Westwood Street) Consultant Engagement

Engineering Ltd. be engaged to complete the Class Environmental Assessment for the reconstruction
of Kalar Road from McLeod Road to Westwood Street in accordance with their proposal dated

PARKING IN GREENWAY ESTATES*.
At its meeting July 14, 2003 thc Commtkn. ity St~'r3rice$ Committee considered report MW-2003-
131 and adopted the staff recomme~tdation to use the remaining securities to complete the
outstanding Class ~T[ works including the top layer of asphalt, the planting of street trees and the
construction of sidewalks.
The meeting was also atteaded by a group of r~sidents some of whom expressed their preference
to have the proposed sidewalks deleted or limited to one side of the road. Staff was directed to
meet with the residents in o~ter to examine ali reasonable options and agreed to undertake the
following:
I. Investigate with the City's Parks, Recreation and Catture stiff the po~dblli~ of constructing s wtlkwsy along the east-
west Hydro coFfldor which lies just noFth of thb subdivision.

A notice was distributed to each residence thanks to the coordination and efforts of Mr. Wayne
Rudy, Mr. Roy Little and Mrs. Vesna Pew. They were also helpful in conducting a poll which
concluded that a majority of property owners did not want sidewalks. The resident's concerns
and recommendations are also provided. Both documents are attached for your reference.
Municipal Works staff has completed their review and has concluded that the construction of
sidewalks in this development as per the original design should be approved for the following
reasons:
the possibility of constructing a walkway along the Hydro corridor is not likely to be
realized in the immediate future given some of the financial and ownership constraints
involved.
a review of the available traffic volumes and accident history in this area shows that this
section of Chamwood Avenue functions as a collector road for a number of local streets
in the WestlaneFWestwood neighbourhood. In the last three years there have been two
collisions, both during the winter months.
without sidewalks pedestrians will have to share the roadway with moving vehicles which
poses a significant safety risk to both. The restriction of on-street parking too at least one
side of the roadway would be necessary to, at least, provide better visibility.
the Community Mail Box location near the entrance to the subdivision needs to be
accessible to all existing and future residents of the subdivision regardless of their
physical abilities or limitations.
In addition to these conclusions Municipal Works staff would also like to point out to the
Committee that:
once the new Community Centre is completed, we should expect an increase in both
pedestrian and vehicular activity along this section of Chamwood Avenue. These
sidewalks serve the community and not just the adjacent homes.
Chamwood Avenue (the north section) has continuous sidewalks on both sides of the
roadway in its entirety and the subdivision design is simply an extension of this standard.
the standard sidewalk location provides for a distance of 1.5m between the property line
and the sidewalk. The homes built in this subdivision have an R2 zoning which requires
them to be set back 6m from the property line. This allows a total length of 7.5m (24.5 fi)
with which to park vehicles without encroaching over the sidewalk.
the sidewalk construction will include complete restoration of all boulevard areas
including the driveways that have been constructed in the interim period.
the current bylaw restricts all overnight on-street parking. However those residents who
qualify will be granted parking permits. Options are available to residents who have
unique parking requirements.
In conclusion Municipal Works staff believes that the safety of the public is best served by
constructing the sidewalks in the proper design location.
Please note that the top coat of asphalt has already been placed and the street tree issue will be
referred to the next available Environmental Planning and Greening Committee for their
consideration.

RESIDENTS' CONCERNS:
The addition of a sidewalk will shorten existing driveways causing
residents to park more vehicles on the road. Most of the homes have
between 24 cars. With more cars on the road there is a growing concern
about the safety of the children tiding bicycles, scooters, and skateboards
among the parked cars.
2. With the short length of our lots a sidewalk will bring pedestrians almost
to our front doors.
3. The addition of a sidewalk will tear apart many finished driveways
(paved, concrete, interlocking brick).
4. Some of the residents would rather not have a tree because of their small
lots.
RESIDENTS' RECOMMENDATIONS:
1. That council make a motion in favour of the majority of the residents for
NO sidewalks.
2. That council make a motion allowing the residents the option of having a
tree or not having a tree planted at their curbside
BACKGROUND
In an eight year period the development of Chamwood Avenue has been a slow
process. The location of sidewalks has always been in question because of the
financial situation of the developer. Depending on what year you moved in and
who you spoke with at City Hall, the allocated side for the sidewalks changed. This
has posed a dilemma for the many residents who have spent thousands of dollars
putting in driveways believing that the sidewalks were going on the opposite side of
the street. Others had city workers come and mark their property to show them
where the future sidewalks were going to be later finding out fi:om neighbours that
the side had changed. The recent designation for a sidewalk is the longest side,
which is the south side. 100% of the people petitioned on the south side DO NOT
want a sidewalk. When petitioning both sides of the street there was 1 resident on
the north side who would like a sidewalk.
In the same petition residents stated their preferences regarding curbside trees.
Some of the residents would rather not have a tree planted because of their small
front yards.
A few home were not petitioned. With these homes we have placed their addresses
voting in favour of the majority regarding sidewalks and voting IN favour of a tree
at the curbside. These home are listed below and the reason for not being included
on the petition.

Please be advised that the Development Section staff in the Municipal Works department
are working to address the matters that your resident's group brought to the Community
Services Committee at its meeting on July 14, 2003.
Recently, we have met with Mr. Wayne Rudy, Mr. Roy Little, and Mrs. Vesna Pew to
discuss the results of their recent neighbourhood poll which shows that the majority of
residents do not want to have the sidewalks that were originally planned for this
development constructed.
We have also met with Mrs. Maria Silverstrone who asked that we consider her
cimumstances given the proximity of her property to the Community Mail Box.
It is impodant that decisions such as these are made with proper consideration for the
safety of all residents.
From the Municipal Works staff perspective, the roadway design was approved with
sidewalks on both sides of Charnwood Avenue because the read functions as a minor
collector road for the neighbourhood. The previous phases of development north of the
Hydro Corridor had provided for sidewalks on both sides of the roadway and it was logical
to extend this standard when Charnwood Avenue was extended through Greenway
Estates. As a result, it is reasonable to assume that your section of Charnwood Avenue
will experience traffic generated from other points of origin in the neighbourhood as well
as those propeties within your immediate plan of subdivision.
Part of the residents' justification for not including sidewalks is the problem that, in order
to avoid encroachment over the sidewalk, more care will have to be parked on the
roadway.
Our concern is that by eliminating the opportunity to use a sidewalk, pedestrians have no
option but to use the roadway. While there is considerably less risk on roadways that
service only the immediate properties, I think you can agree that this section of Charnwood
Avenue will eventually have increasing volumes of "non-resident" traffic, (especially when
the new Community Centre is open). We should be anticipating these public safety risks
in our decision.

Although our intention was to present a report to the Community Services Committee on
September 8, 2003, we would like some additional time to share the results of our
investigation with you before we finalize our report. This may require a delay of two weeks,
(maximum).

MW-2003-158 - Dorchester Road Curbing between
Thorold Stone Road and Waterloo Drive
RECOMMENDATION:
It is recommended that the installation of curbing on Dorchester Road be included in the 2004 budget
deliberations.
BACKGROUND:
At the August 11, 2003 Community Services Committee meeting Committee heard a deputation by
a Mr. Redekop who resides at 3855 Dorchester Road. Mr. Redekop requested that curbing be
installed on the westside of Dorchester Road opposite Isaac Street. Mr. Redekop concerns are that
the boulevard is paved up to the sidewalk and when cars are stopped to make a left onto Isaac Street
traffic goes around the vehicles close to the sidewalk. Accordingly, Mr. Redekop has requested the
curbing in order to ensure that vehicles do not encroach upon the sidewalk. In addition to reviewing
this matter Committee requested that staff investigate the installation of curbing at Omhard Park
School and Mary Ward School.
Staff reviewed two options for curb installation this included pouting permanent concrete curbing
which would involve excavating the existing asphalt boulevard, placing the permanent curb and
restoration works. The second option was the installation of precast curbing along with interlock
brick similar to the construction of the chicanes in the downtown area and the parking lot adjacent
to City Hall. The cost to carry out the work in the various areas for the various options is listed
below.

If the precast curbing is installed at the bus loading zones in front of the schools, the school buses
will not be able to fully pull offthe south bound lane on Dorchester Road. Accordingly, it is staff's
recommendation that the precast curbing at the bus loading zones would not be installed which
would result in a $15,000 reduction of the precast cost in front of both of the schools. The poured
curb can still be installed at the school bus loading zones as less room is required for this installation
as opposed to the precast curb.
In addition to the above staffhave received phone calls from other residents along Dorchester Road
requesting that curbing be installed in front of their homes.
As there is no funding in this year's budget for the above works, should Committee wish to consider
the installation of the curbing at the above locations, this should be forwarded onto the 2004 budget
deliberations.
Committee's concurrence with the above recommendations would be appreciated.

Streetlight Pole Banner Request - Vann Media Inc.
RECOMMENDATION:
It is recommended that:
1)
the installation of banners on the streetlight poles along Hiram Street between
Falls Avenue and River Road and along Falls Avenue between Hiram Street and
Highway 420 (Newman Hill), to advertise the opening of the New Aviary, be
approved for a period of four months, subject to approvals from other mad
authorities;
2)
Staffdevelops a policy for the placement of banners on streetlight poles within
the municipal fight-of-way and report back to the Community Services
Committee within a 4-month period; and,
3)
no other banner installations be considered, until such time, as a policy for the
placement of banners on streetlight poles, within the municipal right-of-way, has
been approved by Council.
BACKGROUND:
Vann Media Inc. has requested approval to install banners, to advertise the New Avbu3' Tourist
Attraction located on thc comer of Hiram Street and River Road, on several streetlight poles
along Hiram Street between Falls Avenue and River Road and along Falls Avenue between
Hiram Street and Highway 420 (Roberts Street), for a one year period.
Currently, there is no poUcy for the placement of banners on streetlight poles within the City's
right-of-way. Traditionally, we do allow BIA's to install banners within their own areas, to
advertise the BIA area, not to advertise individual busin~ses.

A cursory review of banner installations in other City's located in Canada and the U.S.A. has
revealed the following:

that streetlight pole banners are generally installed to promote BIA associations,
cultural or civic events or activities of general public interest;
they are erected for short durations, usually 30 to 120 days
they are not used to advertise local businesses
there are permit fees and space rental fees associated with each installation
This installation is viewed as a short duration Grand Opening Event associated with this new
tourist attraction. Therefore, staff is recommending the installation of Banners on the streetlight
poles along Hiram Street and Falls Avenue, to advertise the opening of the Aviary, be approved
for a period of four months, subject to approvals fi.om other road authorities (i.e., MTO and
NPC). This would allow staff time to develop policies of future installations.
Finally, banners should be utilised to enhance the City's visual attractiveness, style and
sophistication as well as reinforce the City's image and promote the City as a destination for
visitation. Therefore, it is important to carefully review all of the issues (including road safety)
pertaining to the placement of banners on streetlight poles within the municipal right-of-way and
develop a policy pertaining the placement of these types of signs.
The Committee's concurrence with the recommendations outlined in this report would be
appreciated.

Garner Estates Subdivision
RECOMMENDATION:
It is reconunended that Municipal Works staff arrange for the installation of sidewalks in the
Garner Estates Plan of Subdivision in accordance with the original subdivision design.
BACKGROUND:
The construction of new homes in Phases I and II of the Garner Estates Subdivision have advanced
to the stage where the developer, River Realty Development (1976) Inc., is now required to complete
their obligations with respect to the remaining Class I1/works. This includes the planting of street
trees, top coat of asphalt and construction of the sidewalks.
Recently the developer notified residents of their intentions to commence the sidewalk construction
and mobilized their contractor. Municipal Works staff received a number of calls asking us to
reconsider the alignment of the sidewalk. On Tuesday, September 9, 2003, staff received an E-Mail
message and attached petition requesting the City to alter the sidewalk location so that it would be
adjacent to the curb instead of the standard alignment which is 1.2 meters in from the propen'y line.
A typical cross section of the streets is attached to this report for your reference.
In response to this request the Director of Municipal Works ordered the developer to postpone the
work until this matter could be resolved. Attached is his correspondence and the subsequent reply
from the developer noting that they would be looking to the City to cover any costs associated with
the temporary re-mobilization of the contractor.

At issue with the residents is the location of the sidewalks and not necessarily the need for them.
Garner Estates is part of the Garner Neighbourhood Secondary Plan which has provisions for
elementary and secondary schools, a senior's home and a major sports facility. The objective in the
design of the street system was to allow the residents of this neighbourhood to access each of these
features without having to depend on the use of a vehicle if possible. An off road trail along the
stormwater management facilities is also part of this design. Sidewalks in this community will play
an important role and it is important that pedestrian safety is not jeopardized in the interest of
convenience.
Homes in this subdivision are built to comply with the provisions of the R1E zoning which reqmre
the front yard setback to be a minimum of 6 meters. This setback when added to the 1.2 meters offset
distance designed for the sidewalk leaves a total of 7.2 meters (23.5 feet) in which to park. The
zoning bylaw considers the garage to be a parking space (although many residents are not using the
garage for vehicle storage).
The residents are concerned that the proposed sidewalk, although located in the public road
allowance, is too intrusive and won't allow them to park multiple or larger vehicles without
encroaching over the sidewalk. They would prefer a "curb-face" sidewalk location similar to what
you may find in the commercial areas of our City. By constructing the sidewalk closer to the road
there is physically more space in which to park vehicles (although technically vehicles are prohibited
from parking in the City's boulevard even if it is part of the homeowner's driveway).
Municipal Works staffis sympathetic to the residents request however we believe that the sidewalks
should be constructed in the location in which they were designed for the following reasons:
construction of a curb-face sidewalk will require the relocation of a number of transformer
vaults (at $5,000 each) and streetlight poles (at $1,000 each) for which the developer cannot
be held financially responsible. Extra costs associated with this request could exceed
$30,000.
sidewalks set back off the curb allow for a higher degree of pedestrian safety, allow adequate
room for snow storage during winter maintenance.

on-street to encroach onto the sidewalk.

Pouring of Sidewalks in the Garner Estates Subdivision Phase One
Hello Mr Dujlovic and Mr Holman
As per the telephone conversation between Mr Holman and I this afternoon, I submit the following request
on behalf of the residents of the Gardner Estates Subdivision.
We formally request that the City of Niagara Falls cease and desist the excavation for the sidewalks. It
should be noted that a trench for the sidewalks has been dug in front of five properties, two of which are
vacant lots.
Further, we formally request that the City alter the plan for this Subdivision to pour the sidewalks adjacent
to the street curb. Thirty six residents of Phase One of this subdivision have signed the petition requesting
the change.
The original version of this petition will be hand delivered to your office this week and a copy will be
emailed to your attention tomorrow.

As you are aware, the Region in Partnership with Walker Industries has relocated Mountain Road,
north of Thorold Stone Road.
The portion of Mountain Road that ran northeasterly from Townline Road, opposite the Region's
services yard, has been closed and deeded to Walker Industries in lieu of the new right of way, further
south.
Since the portion of Townline Road north of the Diversion no longer serves a Regional Road function,
other than it provides access to our service yard and traffic centre, we are requesting Thorold and/or
Niagara Falls to consider the take over of jurisdiction from the Region. A similar report has gone to
Thorold as the subject road is a boundary road.
I have included a sketch showing the subject portion outlined in yellow.
Our Transportation Division is prepared to make arrangements with the city(s) for winter maintenance
of the said portion, if such an arrangement would be of assistance to your municipality.

RECOMMENDATION:
It is recommended that The City of Niagara Falls assume the easterly portion of Thorold Townline
Road.
BACKGROUND:
The City of Thorold and The City of Niagara Falls received a letter from The Regional Municipality
of Niagara (Region) requesting that the local area Municipalities consider taking over jurisdiction
of Thorold Townline Road as it no longer served a Regional function.
Attached is a letter from The City of Thorold to the Region which indicates that The City of Thorold
is willing to assume the westerly portion of Townline Road as per the attached sketch.
Currently, the section of Thorold Townline Road north of the old Mountain Road has split
jurisdiction with The City of Thorold responsible for the western portion and The City of Niagara
Falls responsible for the easterly portion.
Accordingly, based on the above it is staff's recommendation that The City of Niagara Falls assume
the easterly portion of Thorold Townline Road as shown.

BACKGROUND:
The applicants are proposing to construct two wall signs in keeping with their standard advertising
program which are larger than permitted by the Sign By-law. The signs are 177 square feet and 163
square feet in area, whereas the by-law permits a maximum of 25% of the wall area to a maximum
of 150 square feet. The proposal is in keeping with other advertising in the complex and appears to
be minor in nature.

RECOMMENDATION:
To direct Staff to prepare a Management Agreement with the Old St. John's Stamford Heritage
Association for the maintenance, operation and administration of the Stamford Green Heritage
Columbarium
BACKGROUND:
The members of the Old St. John's Stamford Heritage Association have approached Staffwith a
proposal to have the City increase their involvement at the Stamford Green Heritage Columbarium.
The Columbarium was established in 1989 and is situated in the Old St. John's Church on Portage
Road. The City's Cemetery Staff has provided administrative assistance to the Association for the
past decade.
The Association is requesting that the City take over the operation, maintenance and administration
of the Columbarium, while they maintain the ownership of the old church which is a heritage
building. Through their continued ownership, the Association will be able to apply for heritage
funds, as well as continue their fundraising initiatives. The Association would also act in an
advisory capacity to the Staff in aspects pertaining to the City's involvement.
The Stamford Columbarium financial status is in good standing with approximately $83,500 in
revenue and $26,500 held in a perpetuity trust fund account. Some minor enhancements are required
to the building and the issue of accessibility will have to be addressed. Due to the heritage nature
of the old church building, approval from the local Municipal Heritage Committee (formerly
LACAC) and Ontario Heritage Foundation will be required prior to any work taking place. The
Columbarium funds will be used to pay for any repairs or enhancements to the building. It is
expected that the Stamford Columbarium will generate enough funds to pay for future enhancements
to the interior and exterior building, including the addition of new niche walls. The Management

City Staff has met with the Association members on a preliminary basis to discuss the potential
partnership and will continue to work together to prepare a Management Agreement that would be
amicable to both parties. The Finance and Legal Departments will be involved in the discussions
and preparation of the final document.
A letter from the Association is attached indicating their interest in a potential partnership.

Dear Ms Kon:
Our Association restored the Old St. John's Church on Portage Road and have operated it as the
Stamford Green Heritage Columbarium since 1989. Over the years we have provided a service to
our community in the form of cremation n/ches. The colmbarim has a capacity for 882 niches and
of these over 200 niches have been sold.
Our members are very dedicated to the preservation of this heritage building and to the service we
provide to the conmmnity. However, we find that the dayto day operation of what is essentially a
Cemetery takes away from our commitment to the preservation of an heritage building.
It is therefore our desire to enter into an agreement with the City whereby the City's Cemeteries
' Section would take over the operation, maintenance and administration of the Columbarinm and our
Association will continue to own the heritage building and act in an advisory capacity to the
Cemeteries 'Section in aspects pertaining to their involvement. We believe that this arrangement
would be mutuallybeneficial to the City and our Association as well as the citizens of Niagara Falls.
The Old St/John's Church was built in 1825 and has a significant heritage role in our community.
It is therefore our intent to play an active role in the upkeep of this building through accessing
govemment funding as well as our own fundraising initiatives. We wish to work closely with City
staff to ensure the old church continues to meet all of the heritage regulations.
On June 3~a our Association met with you and your staff to discuss /he preliminary issues
surrounding the potential partnership between our Association and the City. We understand that
Council's approval to this proposal is required prior to an agreement being drawn. We look forward
to learriing the results of our proposal and bringing this management agreement to fruition at the
earliest possible convenience.

develop an indoor soccer facility on the Kalar Road Soccer Complex site.
BACKGROUND:
Over the past year or so, the Niagara Falls Girls Soccer Club and Parks, Recreation & Culture have
received interest fi:om three different development groups who indicated an interest in a
public/private parmership to construct an indoor soccer facility on the Home for Girls Soccer site
along Kalar Road. The second phase of the development has recently been completed and the Club
is looking forward to the grand opening of the facility in May of 2004.
Phase 1 development involved the construction of two senior pitches in 2002. Phase 2 development
has recently been completed and involved the construction of an entrance road, parking areas, two
mini soccer pitches and landscaping. The development of the site is complimented with one senior
pitch and two intermediate pitches located on the joint school board lands to the south, which have
been in use for the past two seasons. A plan illustrating the site development and proposed area for
the indoor soccer complex is attached.
The growth of youth soccer has increased dramatically in the City in recent years. In 2003, the
number of registrations for the Girls Soccer Club was approximately 1,600 while the Boys Soccer
Club had approximately 1,400 registrants. We understand that a number of local players do play
indoor soccer during the fall and winter months in other locations within the Niagara Region and
New York State. There is also use of some local gyms for soccer tryouts and general training during
the off season. There has been interest in developing an indoor soccer facility in the City for a

number of years to satisfy local needs. The Committee may recall a proposal received from Soccer
Magic a few years ago to develop an indoor facility on the City's Mewburn Road property.
In order to be impartial, the Girls Soccer Club was requested to take a lead role in determining a
desired parmer. Terms of Reference were developed by staff with input fi.om the Girls Soccer Club
and each of the three groups that had expressed an interest were invited to submit detailed proposals.
Proposals were received from two of the three development groups and they were the Cuviello and
Sacco Group and the James Douglas Copperlen Development Group.
The two development groups made presentations to the Selection Steering Committee during the
latter part of August. The Girls Soccer Club received input fi.om the Boys Soccer Club on the two
proposals. Following an analysis of the proposals, both the Girls and Boys Soccer Clubs selected
the James Douglas Copperlen Development Group as the preferred group to work out an agreement.
Some of the key considerations that favoured the preferred group were as follows:
- a lower hourly usage cost and more desirable hours for use;
- no rental charge to Girls Soccer for administrative space within the facility; and
- intention to pay all required permit and servicing fees.
With the selection of the preferred development group, the Girls Soccer Club would like to begin
negotiations and develop an agreement with the group that would detail their use within the proposed
building. The City will also require an agreement with the development group to address the
responsibilities and expectations of the developer.
The development group is well aware of its requirements in order to see the development become
reality and these include, rezoning of the land, a traffic study, a drainage study and the payment of
various development fees, including development charges.
Conclusion
Council's support to allow the Girls Soccer Club to negotiate with James Douglas Copperlen
Development regarding community access and services would be appreciated. Staff would then
proceed to negotiate an agreement with the developer. Members of Council will be kept apprised
of the progress of negotiations of both agreements.

Further to our meeting with members of the Parks and Recreation Department relative to
proposals being outlined by the "Copperlen Marketing Group" and "Cuviello and Sacco",
we wish to outline the position oftbe Niagara Falls Boys Soccer Club.
Both proposals offer excellent indoor Soccer facilities, which meet the needs and
requirements of our club. We have been pushing for an indoor soccer facility for many
years and we are hopeful that one of these proposals eventually becomes a reality. While
we fully endorse both proposals, the Copperlan proposal offers a number of additional
benefits due to the additional mini soccer fields included and of course a preferential
rental rote of $135 per hour for the entire large field versus $125 per hour for ~ field
utilization on the Sacco property. In addition, the Copperlan proposal offers a home for
Girls soccer, which we fully support.
