By-law 89-155, as amended, states that:
No special meeting of the Council shall be called unless the Clerk has
provided to each member of Council, notification by telephone or in
writing, of the special meeting, at least forty-eight hours in advance of
the date on which the special meeting is to be held. Such notification

That the Mayor and Clerk be authorized to execute the required Amending
Encroachment Agreement.
EXECUTIVE SUMMARY
The Encroacher has requested that it be allowed to amend the existing Encroachment
Agreement dated September 12,2016 (the “2016 Agreement”)as a result of a change
in location and size of eavestroughs on Main Street and Willoughby Drive.
BACKGROUND
1515435 Ontario Limited (the “Dec|arant”)and the City entered into an Encroachment
Agreement dated September 12,2016 for stairs and eavestroughs from the sidewalk to
the building known municipally as 3710 Main Street and attached as Scheduie “B”.
The Encroacher was formed by way of registration of Niagara South Standard

Declarant,the Encroacher assumed the 2016 Agreement.
A request has been received from the Encroacher to permit a change in the size and
location of the current encroachment for the eavestrough as shown in Schedule “A”to
this Report.

the 2016 Agreement and Amending Encroachment Agreement,which consent shall not
be unreasonably withheld.
The City is planning on replacing the watermain/water service to the building.There will
be reconstruction of the sidewalk from the road to the building face.At the request of

repair or maintenance of utility infrastructure deemed reasonably necessary by the City
or such utility company,and the Encroacher covenants and agrees that such removal
expense.”

The Encroacher is required to provide the necessary insurance,as well as
provide for the cost of the registration of the Amending Encroachment
Agreement.

History of the "Man-A—MileRelay Race”
This classic began in 1922 with two teams competing for bragging rights only (Niagara Falls and St.
Catharines).Over the years,the event has grown to include municipal teams from Thorold,Welland,
Pelham,Grimsby,Niagara—On—The—Lake,Fort Erie,Port Colborne,etc.Prizes and awards in various
categories were added for (male,female,mixed teams,family etc.)
1992 was the inaugural year for high school teams to compete,with St.Catharines Collegiate defeating
Grimsby Secondary School.in 1993,a beautiful trophy was donated to the high school cause,thus
making the high school entry official.
In 1995,two families competed (Long and Gallina)creating that division.In 1996,three families (The
Long Family,Family Gallina and the Gallina Family)participated.A boys’soccer team competed in 1999.
In 2002,Fairview Louth Church and Burtnik Karatejoined us in the open category.
The new Man—A~MileCommittee has run the event for the past several years,seeing unprecedented
growth in many categories.
Team Make-up
Each team is made up of 14 runners.Each team receives 14 T~shirts.Each runner will run
approximately one mile along the scenic Niagara Parkway.The race begins on the trail in front of Fort
George in Niagara—On—The—Lakeand continues into Niagara Falls to finish up with the anchor runner
completing the race at Oakes Park track running one and a half laps.
Teams are awarded start times according to the type of team.For example,an all—fema|e team would
start the race before a mixed team,which would start before an alI—maleteam.Municipal teams start at
various times according to size of the municipality they represent.The option to start all the teams at
once may be considered therefore,all starting runners must be at the start at 9:00 am.
The course is well marshalled and all mile markers are clear and easy to find.When entered,each team
receives a detailed instruction sheet of where each runner is to be.As stated earlier,each team
member must read and sign the attached waiver/releaseform to compete in this event.Anyone under
18 years must have a parent or guardians signature.
Special Note:
The anchor runner must attach the racing bib to the front of their shirt.Please identify your
team so that your team's time is properly recorded.Please keep the timing area clear.
Important!Remember to:return the baton to the timer.

Man—A-MileBaton Exchange Points
All starting and exchange points will be marked with an orange cone and a runner number.If
by chance the cone is missing,there will be a white spray paint mark on the path.All reference
points begin from the starting point.Drive North on the Niagara Parkway for the starting
locations.
Starting Location #1 ~Start at Fort George.Parking is available at Fort George (off of Queens
Parade).Continue up the waterfront trail (Ricardo St.)to the Start.
Now you will be heading South on the Parkway for the rest of the exchange points.
Exchange Point #2 -Just South of East West Line.On the Niagara Parkway you will drive by the
McFarlane House at 15927 Niagara Parkway and continue to drive past a small ball diamond on
your left,you are looking for the second parking lot on the left past this point.The runner will
find the exchange point on the path/trail left of the parking lot.
Exchange Point #3 -Across from Walkers Fruit Market.The fruit market is located just past
Line 1.The runner will find the exchange point on the path/trail directly across from the first
flagpole at the market on the other side of the road.

Exchange Point #4 -Just before Line #3.You should see the Inniskillen sign and the 2"dexit to
Service Road 66.The runner will find the exchange point just prior to the bridge,on the
path/trail.
Exchange Point #5 -Parking lot on the left ‘Lustpast 15248 Niagara Parkway.The runner will
find the exchange point on the path/trail just right of the parking lot of a picnic table.Across
the road you will see Tregunno Farms.
Exchange Point #6 -Just after Line 6 at 14930 Niagara Parkway.The runner will find the
exchange point on the path/trail.
Exchange Point #7 —In front of the River Brink Art Museum.The runner will find the exchange
point in front of the art gallery River Bank Gallery where the path meets Queenston Street (just
at the sharp turn).The runner will run down the side of Queenston Street,turning left on
Walnut,Right on Princess,Right on Dumfries and then left again back on Queenston.Follow up
the hill and around the bend past the historic Mackenzie Printery Museum.At the top of the
hill,the marshall will allow the runner to carefully cross the Parkway,turn right on York Road
briefly and then cross over to the trail on the left side of the road.

Exchange Point #8 —N.P.C.Trail,located on York Road on the left just to the right of the
Niagara Parkway.This runner is expected to run up Queenston Hill and continue to cross the
road to the path/trail.The runner will find the exchange point just inside the path/trail off of
York Road and for vehicles dropping off,they must turn around and continue on the Parkway,
left on the turn around.There is ample parking in the corner of York Road and the Parkway.
Exchange Point #9 —N.P.C.Trail under Queenston-Lewiston Bridge.The runner will find the
exchange point on the path/trail,left ofthe road.
Exchange Point #10 —N.P.C.Trailjust before double hydro towers on the left hand side of the
g The runner will find the exchange point on the path/trail at this point.This runner will
cross over the road into the Butterfly Conservatory parking lot when the trail ends.The runner
will run through the parking lot to re-connect to the path/trail on the right side.
Exchange Point #11 —Across from the Glen parking lot.The runner will find the exchange
point on the path/trail just before the Totem Pole and wood carving park sign.This path/trail
will end on the right side and the runner must cross over the road and continue on the left side
and run through the parking lot to re-connect to the path/trail.
Exchange Point #12 —Parking lot on the left just past WhimzoolGold &Restaurant.The
runner will find the exchange point on the path/trail to the left of the parking lot,across from
the first picnic table just before a white park sign.The runner must cross Victoria Ave at the
traffic lights and run on the right hand side of the road until they reach Lococo’s.
Exchage Point #13 -Just before the railway track crossing on Victoria Ave between C.N.
building and Lococo’s.An adult runner is preferred.The runner will find exchange point at
Lococo’s at Furgeson St on the sidewalk.The runner will turn right onto Valleyway and then
right onto Morrison St at the Niagara Falls Review Building.
Exchange Point #14 —Morrison Street just before Homewood.The runner will find the
exchange point on the sidewalk before Homewood.This runner will cross Stanley at the lights,
run past Oakes Park to the turn-around point then back to Oakes Park to complete one and a
half laps of the track to the finish.
Timing and Placement
Note:The last or anchor runner must be wearing a race bib on the front of his/her shirt as they
cross the finish line.The race baton must be returned to the timer and the team name must be
verbally stated to the timer for that team to receive a time.

By-law No. 2018- 116
A by-law to adopt, ratify and confirm the actions of City Council at its Special meeting
held on the 17th day of September, 2018.
WHEREAS it is deemed desirable and expedient that the actions and proceedings of
Council as herein set forth be adopted, ratified and confirmed by by-law.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
1. The actions of the Council at its Special meeting held on the 17th day of
September, 2018 including all motions, resolutions and other actions taken by
the Council at its said meeting, are hereby adopted, ratified and confirmed as if
they were expressly embodied in this by-law, except where the prior approval of
the Ontario Municipal Board or other authority is by law required or any action
required by law to be taken by resolution.
2. Where no individual by-law has been or is passed with respect to the taking of
any action authorized in or with respect to the exercise of any powers by the
Council, then this by-law shall be deemed for all purposes to be the by-law
required for approving, authorizing and taking of any action authorized therein or
thereby, or required for the exercise of any powers thereon by the Council.
3. The Mayor and the proper officers of the Corporation of the City of Niagara Falls
are hereby authorized and directed to do all things necessary to give effect to the
said actions of the Council or to obtain approvals where required, and, e xcept
where otherwise provided, the Mayor and the Clerk are hereby authorized and
directed to execute all documents arising therefrom and necessary on behalf of
the Corporation of the City of Niagara Falls and to affix thereto the corporate seal
of the Corporation of the City of Niagara Falls.
