BACKGROUND: The Committee will recall that at the meeting of September 22, 2003, this request was referred back to staff to obtain additional visual information. The proposed billboard sign itself is approximately 16 feet high by 32 feet wide and will exceed the maximum allowable height by 9 feet. The applicant, Mr. Giuseppe Macera indicated that the additional height was required to alleviate any potential snow load weight to the roof of his building as the billboard in its permitted location would be adjacent to the eaves which are 12 feet above grade as shown in Diagram 1. To support Mr. Macera's proposal a letter provided by a Professional Engineer who has recommended that the bottom of the billboard sign be placed 3 feet above the eaves to allow the wind to clear any drifted snow load condition as shown in Diagram 2. The recommendation of the engineer places the sign at an elevation which does not conform to the sign by-law. It should also be noted that a sign permit from the Region will also be required; however, the Region will typically go along with what the Municipality decides. BACKGROUND: At the September 22, 2003 Community Services Committee meeting, Council deferred a decision to realign the proposed sidewalks in the Garner Estates Phase I & II requested by a number of homeowners pending the receipt of additional information regarding extra costs. Municipal Works Staff met with the developer, contractor and engineering consultant to discuss the Council's directive and have obtained the following information for Council's consideration. 1. EXTRA COSTS The contractor has identified that the cost of removing the granular material previously installed, replacing the topsoil and sod would cost $3,795.00. More significantly, the "curb face" sidewalk construction will require the installation of dowels into the back of the existing semi-mountable curb. Normal "curb face" sidewalk is typically supported by a 50-mm support edge located at the back of the curb or poured continuously in a monolithic (one-piece) manner. This design prevents differential settlement between the curb and the walkway. Working Together to Serve Our Community Municipal Works · Fire Services · Parks, Recreation & Culture · Business Development · Building & By-Law Services October 6, 2003 - 2 - MW-2003-180 In Garner Estates the semi-mountable curb was built without the 50-mm support edge and as a result the "curb face" sidewalk will have to be physically tied into the curbing with dowels drilled in every 600 mm. The contractor has estimated this cost to be $19,200.00. The contractor has also indicated that delays in this construction now require the concrete to be heated and protected from frost with burlap and insulation blankets. These costs total $1,920.00 and $7,200.00 respectively. Municipal Works staff recognizes that the heating and protection costs are an extra expense that can be avoided if the sidewalk installation is deferred to next Spring/Summer and therefore should be developer's expense if he still wants to proceed now. 2. SAFETY CONCERNS Report MW-2003-170 discusses the need to properly provide for pedestrian activity in this area because of the institutional and recreational uses in the neighbourhood. Curb face sidewalk design should only be used where property constraints limit the options for providing a safe buffer between vehicular and pedestrian activities. The Ontarians with Disabilities Act requires Municipalities to make accessibility a consideration in the subdivision approval process. The City's Disability Advisory Committee has endorsed the Accessibility Guidelines prepared by the City of Guelph (June 2001). Municipal Works staff believe that policy 2.1.2 (walk width) would be jeopardized by constructing a curb face sidewalk at a couple of the light pole/transformer locations. In conclusion, the additional costs and substandard safety conditions that will result from constructing a curb face sidewalk are the basis for staff recommending that we follow the original design. The current sidewalk policy is under review as directed by the Committee at the last meeting. Although curb face sidewalks are an acceptable alternative when properly accommodated in the subdivision design, staff is concerned that the revised location requested by some of the residents will eventually lead to operational issues involving on-street parking restrictions and snow clearing complaints. BACKGROUND: The construction of new homes in Phases I and II of the Garner Estates Subdivision have advanced to the stage where the developer, River Realty Development (1976) Inc., is now required to complete their obligations with respect to the remaining Class Ill works. This includes the planting of street trees, top coat of asphalt and construction of the sidewalks. Recently the developer notified residents of their intentions to commence the sidewalk construction and mobilized their contractor, Municipal Works staff, received a number of calls asking us to reconsider the alignment of the sidewalk. On Tuesdayl September 9, 2003, staff received an E-Mail message and attached petition requesting the City to alter the sidewalk location so that it would be adjacent to the curb instead of the standard alignment which is 1.2 meters in from the property line. A typical cross section of the streets is attached to this report for your reference. In response to this request the Director of Municipal Works ordered the developer to postpone the work until this matter could be resolved. Attached is his correspondence and the subsequent reply from the developer noting that they would be looking to the City to cover any costs associated with the temporary re-mobilization of the contractor. The standards are based on a variety of sources: the National Building Code (for Federal Buildings), the Canadian Standards Association and the Americans with Disabilities Act. These respective pieces of legislation are considered to have higher standards than any applicable law in Ontario (OBC, Ontafians with Disabilities Act etc.). The Ontarians with Disabilities Act does not have specific requirements for sidewalks. The legislation states the following: Municipalities will also be required to make accessibility a consideration in the subdivision approval process. There are no guidelines as to what is a sufficient sidewalk width or ramping requirements. BACKGROUND: On June 2, 2003, City Council was presented with report MW-2003-101 (attached) which was referred back to staff for further review. Following the Council meeting the Fire Department sent out an aerial truck to the court and as indicated in the attached email they managed to negotiate the cul-de-sac with only one small correction. In addition an email was received from Marianne Babel regarding the difficulties a school bus had in negotiating the cul-de-sac due to cars parked in the court. It is estimated that the cost to down size the island in the cul-de-sac in order to allow for a wider road would cost in the order of $11,000.00. As indicated in the previous reports the controlling factor, the ability of a larger vehicle negotiating the cul-de-sac, is the outside radius. Although widening of the road way would provide some benefit, large vehicles would still have some difficulty in maneuvering through the cul-de-sac when vehicles are parked. Accordingly, it is stafffs recommendation that if Committee decides to proceed with the widening of the road that parking restrictions be implemented in the bulb. BACKGROUND: As a result of concerns raised by Mr. Babel of Fatima Court report MW-2002-152 - Removal of Islands from Cul de Sacs was preserlted to Committee and recommended that the islands not be removed. The motion adopted by the Committee at that time was that the report be received and filed. Since thc filing of the report, additional correspondence has been received, fi.om Mr. Don Sorley and Mr. Babel. In regards to Mr. Babel's concerns the matter has been reviewed with operations staff and they have indicated that even with the removal of the island the current snow plow operation would not be affected. The controlling factor as to whether a truck and plow are used or a front end loader is the outside radius of the col de sac. Accordingly, the changes proposed by Mr. Babel would not have the desired effect of improving the winter maintenance operations. What wouldbe required is a change in the routing of the fi'ont end loaders so that the cul de sac is done sooner or additional equipment be hired in order to have cul de sacs plowed more quickly. As indicated in Mr. S orely's letter he and his neighbours are interested in maintaining the cul de sac with funds being provided by the City for materials such as fuel for lawn mowers, water and fertilizer. This would be similar to the Mount Cannel Association where the local residents have adopted the park. Currently the City carries out minimal maintenance on cul de sacs in that the City only provides grass cutting every three to four weeks. If all of the residents abutting a cul de sac containing an island were to participate in the program, it is estimated that the cost would be approximately $25,000 per year. Accordingly, it is staff's recommendation that the City implement an, "Adopt a Cul de Sac Program," in order to better maintain the islands and help beautify the City. Traditionally complaints received about islands have to do with the ma~ntensnce of the Faas and cutting o£weeds. In 2002 the Service Center has lo.ed only seven complaints of this nature. Staffhss reviewed those requests and hnve the following comments: Based on our current GIS data there are more than 100 Cul ds Sacs which contain islands. The cost of removing an island will vary depending on which services are located there. Many islands contain hydrarda and hydro poles. The cost of relocating these services can be in excess of $15,000 plus the restoration of the island. Niagara Falls Hydro ha~ expressad concern about removing the islands and not the poles. If we were to place bollards around the poles there wonld be a maintenance cost. These areas would have to be cleaned by hand. Prior to relocating thc hydro poles and hydrants, a me~ting would have to be held with the local residents to find a new acceptable location. These services would now have to be placed in front ofa rasident's home. L__ Ca~ (~1 8128 F~ C~ ~ ~an P~ge~ ~d~n V~ffi Dear Mayor Thomson and Members of Council: May 22, 2003 Now that the winter weather has subsided and our frustrations have diminished, I wish to remind you of the concerns that my family and the Babel family experience during the winter due to the rather large cul-de-sac that was constructed on Fatima Court. Aesthetically it looks great; pragmatically it raises the following safety concerns: A)Parking: When entertaining guests, parking is a definite problem especially in the winter B) Snow Ploughing: The large plough cannot get by and consequently Fatima Court is not ploughed until late in the day. By that time, we have already been stuck in the snow and required assistance to get out. C) Emergency: Most importantly, in case of emergency, an ambulance or fu-e truck would find it virtually impossible to reach our home to save a life if stormy conditions existed and a large amount of snow had accumulated in the court. BACKGROUND: In March of this year, Council considered a report which highlighted development options for Phase 2 of the Millennium Trail south of McLeod Road. Council reaffirmed a position of support for the location of the proposed trail along the west side of the Power Canal. With the reaffirmation of the trail on the west side of the Power Canal, there will be the necessity of a pedestrian bridge. This bridge will provide a connection with the southerly portion of Dorchester Road and Chippawa Parkway. This connection will eventually link the Millennium Trail to the Village of Chippawa and the Niagara River Parkway. A plan showing a location of the trail and proposed pedestrian bridge is attached. At the previous Council meeting in March, a local resident suggested that the City examine the use of a railway bridge that crosses the Welland River. This crossing is approximately 2 kilometers to the south adjacent to Baden Powell Park near Montrose Road. It was hoped that the use of the railway bridge would save the cost of a pedestrian bridge. Staff examined the use of the railway bridge, which had one of the two sets of rail tracks removed a couple of years ago. This rail line is still an active line serving the Stanley Avenue Business Park and although the Canadian Pacific Railway indicated that they would consider options for utilization of the rail bridge, this route deviates considerably from planned route and would increase costs considerably due to the costs of additional trail and security fencing as well as improvements to the railway corridor. Parks, Recreation & Culture will be requesting funds for Phase 2 of the Millennium Trail as part of the 2004 Capital Budget. This will also include the testing of soil for the bridge abutments. With the approval of this report, staff will proceed with the completion of the Terms of Reference for the pedestrian bridge and obtain quotes to complete the design drawings. It is hoped that design drawings will be completed in the Spring of 2004.
