RECOMMENDATION:
It is recommended that the City develop a policy for sign encroachments into the Municipal right-of-
way.
BACKGROUND:
The Committee may recall that the Legal Department retained Outdoor Opportunities Incorporated
with respect to advertising on Municipal properties. As part oftheir assignment they were requested
to provide comments as to the rates that could be charged for signs encroaching into the City's right-
of-way. One example that they examined was the Hulk and Spiderman signs at the comer of Clifton
Hill and Falls Avenue which was recently approved.
In the opinion of Outdoor Opportunities Incorporated these signs, due to their extreme
encroachment, should be treated as off premise advertising devises. Based on rates comparable to
those being paid by the outdoor advertising industry, these two signs alone could generate fees close
to $20,000 annually.
Although Municipal Works staff continues to have concerns with respect to these encroachments
in particular over the road portion, it is recommended that the City develop a policy with respect to
the encroachments that would cover such issues as annual fees, insurance, content etc.

Furthermore, it is recommended that:

BACKGROUND:
In response to a request, staff carried out an intersection control review at the intersection of
Marshall Road and Ort Road. The concern at this location stems from a confusion as to whom
has the right-of-way amongst motorists at this intersection.
The intersection of Marshall Road and Ort Road is located in a rural area, in the southern part of
Niagara Falls. This intersection consists of an "offset" confignration consisting of a north and a
south intersection, with a spacing of approximately 300 metres between the intersections, and
unusual characteristics present at both. At both intersections, Marshall Road consists of a
"straight" section and a "curve" section, intersecting in a "tee" confignration with Ort Road.
Therefore, Marshall Road intersects with Ort Road four (4) times (twice at each intersection).
Furthermore, the "straight section" and the "curve section" of Marshall Road converge at the
north and the south intersection. Therefore, a total of six (6) areas where a conflict may develop
amongst converging/opposing motorists, are present at the study location*.
At the southern intersection, Ort Road is unpaved south of Marshall Road (curve section).
Furthermore, at the southern intersection, the "straight section" of Marshall Road is also unpaved
between the "curve section" of Marshall Road and Ort Road*.

Observation made in the study area reveal that a stop sign is present at the southern intersection
of Marshall Road and art Road, facing northbound motorists on Ort Road at Marshall Road
(straight section). Furthermore, a stop sign is present at the northern intersection of Marshall
Road and Ort Road, facing southbound motorists on Ort Road at Marshall Road (straight
section). A yield sign is present at the northern intersection of Marshall Road and Ort Road,
facing southbound motorists on Ort Road at Marshall Road (curve section). Traffic control
devices are currently not present at the remaining three (3) areas where a conflict may develop.
A review of the collision files reveals that no collisions have been reported in the study area
during the previous three year period.
The predominant traffic pattern in the study area is Marshall Road via the curves. Therefore, it is
recommended that motorists on Marshall Road (curve sections) have the right-of-way at this
location. The "straight section" of Marshall Road terminates at Ort Road, at both intersections.

Typically motorists on a through road have the right-of-way rather than those travelling on the
road that terminates at the intersection. Therefore, it is recommended that motorists on Ort Road
have the right-of-way at both "tee" intersections with Marshall Road.
The proposed intersection controls at both intersections of Marshall Road and art Road will
adequately allocate the right-of-way amongst all conflicting traffic movements. The existing stop
signs on art Road are recommended to be removed as motorists will no longer be required to
stop at both locations. Staff is of opinion that if the recommendations are adopted, the safety of
motorists will be maximized, and the existing confusion amongst motorists will be addressed.
The Committee's concurrence with the recommendations outlined in this report would be
appreciated.

RECOMMENDATION:
That the Committee recommends the approval ofthe sign by-law variance to Council.
BACKGROUND:
The owners are proposing a large static display which depicts a toppled over building with a gorilla
standing on the spire. The building is a false facade, and the spire and the gorilla are a three-
dimensional replica that extends over the municipal sidewalk approximately 15 feet and is
approximately 36 feet high. The sign by-law permits advertising signs to extend into the municipal
property a maximum of 1 0 feet with a maximum height of25 feet. This type of signage is in keeping
with the general appearance of the area. The proposal, if approved will require an encroachment
agreement along with insurance, building and sign permits and all applicable fees.

RECOMMENDATION:
It is recommended that the City of Niagara Falls adopt the recommendations outlined in the
Shriner's Creek Study (October 2003) and further that the City authorizes the Niagara Peninsula
Conservation Authority to commence the detailed design phase for the reconstruction of Dam"A"
(located north of Thorold Stone Road and west of Kalar Rd.) at a cost of$ 25,000.
BACKGROUND:
The Niagara Peninsula Conservation Authority (NPCA) and the City of Niagara Falls has recently
completed a study of the Shriner's Creek watershed in an effort to respond to a number ofinquiries
from local residents regarding;
upstream changes in the flow regime that have caused significant deterioration ofthe
watercourse,
the inability ofthe detention facilities to control minor storm events, and
the condition of the water quality and the possibility of impacts of sanitary sewer
overflows into the system.
An examination ofthe existing watershed conditions including urban servicing, terrestrial habitats,
aquatic habitat, stream geomorphology and extensive water sampling were completed over a 18-
month period.
A public meeting was held on April 4, 2002 at Cardinal Newman School to involve the public in the
review of the background material and contribute their thoughts regarding possible solutions.

The preferred concept selected represents a long term strategy to not only protect but to improve
the quality of the water and vegetation along Shriner's Creek. The recommendations can be
summarized as follows;
1.
Protection - small scale enhancements such as the removal of invasive tree species,
additional plant materials, minor modifications to storm sewer outlets and routine inspections
to remove debris and litter.
Pond Retrofits - excavation and shaping of ponds A and B are required to create more
capacity for storage and to augment the base flow through typical summer drought
conditions. Modifications to the structures to allow fish to migrate upstream without barriers
at all times are needed. The wetlands need to be designed to provide habitat for waterfowl,
amphibians and reptiles to optimize the cleansing of the stored water. Pond C requires only
small scale enhancements and modifications to permit fish passage through the structure.
Stream Channels - minor excavation to re-establish the meandering pattern of the channel
plus the planting of native riparian vegetation along the banks are needed to provide shade
to cool the water surface.
Floodolains - a floodplain designation should be established that is 2m wider than the belt
width of the stream. Within this floodplain only native shrubs and trees should be planted
to stabilize the soil, shade water surfaces and provide a wildlife habitat.
Forest Cover - unproductive land within the watershed should be replanted with native trees
to corrnect fÌagmented forest areas.
Delta Marsh - adjustment ofthe outlet control to maintain a relatively static water level will
provide better habitat for aquatic plants, fish and wildlife.
Water Onalitv - a continuous sampling program will be required to monitor the quality of
Shriner's Creek and to remain in compliance with the City's combined sewer overflow
objectives.

These recommendations can be implemented over a longer term (5-15 years. However, staff is
recommending that the City commence the detailed design for the modifications to pond A over the
next couple of months so that accurate estimates for construction costs can be determined and
scheduled in the capital forecast.
The NPCA has submitted a proposal dated September l2~003, (attached) outlining a work program
using their staff and some outside resources to complete this design in a timely and cost-effective
marrner. The total cost oftheir services would be $25,000 (excluding taxes) which can be funded
fÌom the Expansion and Renewal Fund. This Fund was established prior to the Development Charges
Bylaw and was built up largely fÌom contributions fÌom developers building in the Shriner's Creek
watershed ( i.e., Mount Carmel Subdivision). It would be appropriate to use any remaining funds
fÌom this account to finance this cost.
Accordingly, staff is recommending that the City engage the services of the NPCA to complete the
design work for Pond A in accordance with the study recommendations and their design proposal.

Dear Mr. Holman;
As per your letter of August 22, 2003 to the Niagara Peninsula Conservation Authority
(NPCA) in regards to the Shriner's Creek Study (draft) and it's associated construction
recommendations, the NPCA has undertaken various actions to advance the project:
1)
The NPCA confirms that the City's recommended wording of Section 5.2 has
been relayed to the project consultant Totten Sims Hubicki. The NPCA
expects that the Shriner's Creek Study will be quickly finalized. Copies of the
report will then be sent to the City in order that Council may formally endorse
the Study's recommendations.
2)
The NPCA and the City have identified the existing NPCA owned stormwater
management quantity control facility Dam 'A' as the first site to be
reconstructed as per the Shriner's Creek Study recommendations.
The NPCA has solicited the consulting services of Limnoterra (Dr. John
Planck, principal) in order to provide biological and ecological
recommendations for the project. Limnoterra will charge on a time basis as
required up to a limit of $10,000.
The NPCA has also solicited proposals to obtain a topographic survey of the
site from 3 local surveying firms. The topographic survey will be used as the
base from which the detailed design will evolve. While all the quotes have not
yet been received, it is expected that the cost of commissioning a topographic
survey will not exceed $5,000.
Finally, in order to keep project costs to a minimum, the NPCA is proposing to
utilize in-house staff to provide the engineering and drafting services
necessary to finalize the detailed design and to obtain all the required agency
approvals. Approximately $7,500 in NPCA staff time and resources is
anticipated to be directed toward this project.
The NPCA also recommends including a $2,500 contingency fund to the
project in order to cover any unforeseen eventualities. Therefore, the total
estimated budget for the detailed design of Dam 'A' is $25,000 (excluding
taxes).

The NPCA (with the City as a partner) is currently pursuing various funding
opportunities and programs (such as the SuperBuild) in order to contribute to
the financing of this project.
The NPCA trusts that the City will find these arrangements satisfactory and will bring
them forward to City Council for approval. The NPCA looks forward to continuing to
work the City of Niagara Falls on this interesting and environmentally important

Attend the World Weightlifting Championships
RECOMMENDATION:
That Council consider the request for funding to assist Jason MacLean who will be attending the
World Weightlifting Championship in Vancouver, British Columbia, November 16-22,2003.
THAT THE COMMITTEE GRANT JASON MACLEAN $1,000.00 TO ASSIST IN FUNDING HIS
BACKGROUND: ATTENDANCE AT THE WORLD WEIGHTLIFTING CHAMPIONSHIP IN BRITISH
COLUMBIA.
Jason MacLean is employed as the City's Health & Wellness Coordinator working out of the Parks,
Recreation & Culture Office. He will be competing at the WorId Weightlifting Championships from
November 16- 22, 2003, in Vancouver, British Columbia, in the hopes of earning an opportunity
to compete at the Olympic Games in Greece next summer.
Jason has competed in a number of qualifying tournaments in recent months to reach the World
Championships. He finished first at the Ontario Championships held in February, 2003, in Toronto.
In August 2003, he finished second in the Canadian National Championships in Ottawa which
earned him a chance to compete as part of the Canadian National Team at the World Championships.
At the WorId Championships he will compete against athletes from more than 60 countries in a bid
to attend the Olympic Games.
Jason recently made an application to the Recreation Commission for funding assistance.
Unfortunately, his application was denied as he does not satisfy the eligibility criteria for funding.
The Recreation Commission was very supportive of his efforts and referred his request to Council
for their consideration-
