5. MAYOR'S REPORTS, ANNOUNCEMENTS
a) Mayor Diodati extended condolences on the passing of Mary Florence
Vittie, mother of Janet Vittie of our I.S. Department.
b) Mayor Diodati acknowledged Councillor Victor Pietrangelo's Birthday on
Thursday, October 24th.
c) Mayor Diodati recognized and congratulated the candidates running for
the recent Federal Election. He extended contgratulations to Tony
Baldinelli, Niagara Falls' new M.P. stating that it takes a lot to put
yourself out there in the public - well done to all who ran in the Niagara
Falls' riding and who wanted to represent the people of our community,
including our own Member of Council, Mike Strange.
Mayor Diodati extended congratulations to our Federal Government and
Prime Minister Trudeau/minority government.
Also extended gratitude to Niagara Falls' long-time representative, Rob
Nicholson for his many years of service in our community.
d) Mayor Diodati recognized Lou Ferringno as he was recognized as an
honourary firefighter and honourary Mayor at a recent event for actively
promoting his anti -bullying messages.
e) Mayor Diodati discussed the 16th Annual Sleep Cheap Charities
Reap mentioning the following:

Seniors Advisory Committee - Goals and Priorities
Wendy McPherson, Chair Person of the Seniors Advisory Committee
(SAC) made a brief presentation to update Council on the committee's
latest achievements and explained their future goals and priorities.
The report recommends that Council approve the goals and priorities for
the Seniors Advisory Committee (SAC).

Fee Waiver Applications
Knights of Columbus & Niagara Catholic Foundation and
Project Share of Niagara Falls
The report recommends the following:
That Council approve the Fee Waiver Applications for:
1. Knights of Columbus & Niagara Catholic Foundation for the
"Flying Fathers Hockey Game" in the amount of $494.90 for the
waiver of the 2 hour ice rental fee.
2. Project Share of Niagara Falls Inc., in the amount of $515.84 for
the waiver of the building permit fee associated with their
renovations.

8.2. FS -2019-03
Fire Department Station 7 Staffing
The report recommends the following:
To staff Station 7 with one crew of four (4) full-time firefighters
including one (1) captain. As an interim measure until staffing
levels can be phased back in by 2023 one (1) firefighter's position
from Station 1 shall be relocated to Station 7; thus, reducing
Aerial 1 to one (1) captain and two (2) firefighters.
2. Approve the implementation of a 3 -year staffing plan for the Fire
Department at an annual cost, including wages, benefits and
personal protective equipment of:

3. That the Fire Chief continues to monitor fire risks, response
times, etc. and that any changes requiring further staffing
recommendations be reported to Council for consideration.

Councillor Mike Strange to staff Station 7 with the hiring of eight (8)
additional full-time firefighters in 2021 and four (4) additional full-time
firefighters in 2022, and that the Fire Chief continues to monitor fire
risks, response times, etc. and that any changes requiring further
staffing recommendations be reported to Council for consideration.

to as the "Subject Lands", and, as shown in red on the attached

2. That the closure of Upper's Lane be conditional on the owner of
10200 Upper's Lane arranging for a new address assignment for
its property using Thorold Townline Road as access.

style telecommunication tower proposal at 11713 Willoughby
Drive at this time; and
2. would reconsider concurrence for the construction of a 30m tall
monopole style telecommunication tower proposal at 11713 Willoughby
Drive after April 30, 2020 should construction not be completed for a
previously supported 60m tower at 3516 Marshall Road.

WHEREAS the intent of the 2 -year waiting period is to provide greater
control to municipalities, prevent zoning provisions that Council
determines to be appropriate from being reversed or altered through the
minor variance process for 2 years, and to increase stability by affording
municipalities the ability to implement site specific zoning by-laws; and
WHEREAS notwithstanding the 2 -year waiting period for minor
variances, subsection 45(1.4) of the Planning Act, 1990 R.S.O. provides
municipalities the ability to permit privately -initiated applications for
minor variances by passing a resolution; and
WHEREAS Tom Vattovaz requested Council to consider passing a
resolution that would permit him to file an application to the City's
Committee of Adjustment in regards to applicant -initiated site specific
By-law No. 2018-98 that was passed by Council in August of 2018; and
WHEREAS Council determined that a minor variance that would permit
Tom Vattovaz to vary the regulations for a minimum interior side yard
width on the west side and a minimum landscape open space strip
along the front lot line, does not undermine Council's original intention
when it passed By-law No. 2018-98.
ORDERED on the motion of Councillor Wayne Thomson, Seconded by
Councillor Vince Kerrio that subject to subsection 45(1.4) of the
Planning Act, 1990 R.S.0, Council consents to an exemption to the 2 -
year waiting period for minor variances and thereby allows Tom

a) Resolution -School Bus Safety -Stop arm technology
WHEREAS distracted drivers continue to be the major cause of traffic
accidents and fatalities throughout Ontario; and
WHEREASschool children loading and unloading on school buses
continue to be the most vulnerable to distracted drivers; and
WHEREAS Bill 174, adopted by the Province of Ontario in December
2017 includes school bus camera legislation; and
WHEREAS as a result of adopting Bill 174, the Ministry

ORDERED on the motion of Councillor Vince Kerrio, Seconded by
Councillor Wayne Campbell that Niagara Region Council direct staff to
generate a report to be returned to Council by the last week of
November, 2019 that addresses the Province's request that
municipalities:
• Identify the preferred technology Niagara Region would like to
use
• Identify the method of procurement Niagara Region would utilize
in order to acquire and implement the needed equipment, with
feedback from all Niagara School Boards (DSBN/NCDSB/CSV/
CSC), bus carrier (LASTS) and school bus camera technology
partners
• Identify options that would allow Niagara Region to enter in to an
agreement with the Province and school bus technology vendor
• Identify the framework for the set up for enforcement and the
processing of offence notices complete with funding options and
opportunities
• That fines be reviewed and possibly be increased as a deterrent.
• AND FURTHER that a copy of this resolution be sent to all Local
Area Municipalities within Niagara.

1. That Council approves staff to submit applications for the Investing in

Blackburn Parkway
Intersection Control Review & Speed Limit Review
The report recommends the following:
1. That a stop sign is installed facing westbound traffic on Blackburn
Parkway at Heartland Forest Road.
2. That the speed limit on Blackburn Parkway between Montrose Road and
Heartland Forest Road be set at 60 km/h.

Proclamation Request -Respiratory Therapists Week
Niagara Health is requesting the week of October 20-26, 2019 as
Respiratory Therapists Week. This week-long celebration serves to
recognize respiratory therapists (RTs); educate the public about the
varied roles of respiratory care and responsibilities of RTs; and to
increase the recognition of the significant contribution made by RTs who
are responsible for the well-being of individuals who suffer from asthma,
COPD (emphysema) and other respiratory illnesses within the
community and in hospital settings.
RECOMMENDATION: That Council approve the request.

ORDERED on the motion of Councillor Wayne Thomson, Seconded by
Councillor Lori Lococo that the proposed closing, surplus declaration
and sale of Upper's Lane and unopened road allowance between
Beechwood Road and Thorold Townline Road was discussed. The

ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Vince Kerrio that staff report back on the possibility of the City
opting out of the Regional Waste Collection service and explore the
costs to supply the base -line level of service of the City providing
garbage and recycling collection, including exploring cost saving options
such as only picking up on one side of the street.

c) International Students
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Vince Kerrio that staff report back to Council on whether or
not there is a liability issue for the City for the international students
living long-term in hotel/motel rooms in Niagara Falls.

d) Grass -Cutting - By-law Enforcement
ORDERED on the motion of Councillor Victor Pietrangelo, Seconded by
Councillor Wayne Thomson that staff report back on the grass cutting
process involved with by-law enforcement including the particulars
