A by-law to permanently close part of a highway.
WHEREAS Section 34 of the Municipal Act, 2001, provides, in part, that the council of every
municipality may pass by-laws to permanently close any highway;
AND WHEREAS the Council of The Corporation of the City of Niagara Falls now deems it
expedient to pass this by-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF
NIAGARA FALLS ENACTS AS FOLLOWS:
That Part of Lane, Plan 997, Town of Niagara Falls lying between Victoria Avenue and
Acheson Avenue (formerly Brydges Street) and Leader Lane and Ferguson Street, in the City
of Niagara Falls, in the Regional Municipality of Niagara, is hereby permanently closed.
The Mayor and Clerk are hereby authorized to execute all documents that may be required
for the purpose of carrying out the intent of this by-law and the Clerk is hereby authorized
to affix the corporate seal thereto and to deliver such documents.

surplus and offered for sale to the abutting owners as set out in Schedule "B" attached, for
nominal consideration, without the necessity of an appraisal.
That the abutting owners as set out in Schedule "B" attached, pay for all costs associated
with the sale including the cost of a reference plan.

BACKGROUND:
Report L-2001-54, a copy of which is attached as Appendix "1" was presented to Council on
September 10, 2001 authorizing Staff to proceed with the closing of the southerly 150 feet of a
laneway located between Leader Lane and Ferguson Street.
As the subject lands are being sold by way of a grant, an appraisal is not required. Disposing of the
subject lands will relieve the City of all maintenance, plowing and potential liability. It should be
noted that presently the subject lands only serve the abutting owners.
The abutting owners listed in Schedule "B" agree to pay for any and all costs associated with the
transfer of these lands.
Staffhas no objections to conveying the subject lands and recommends that the subject lands should
be offered for sale.

REPORT:
The subject lancway is 16 feet in width and is located at thc rear of homes fronting on Victoria
Avenue and Acheson Strut between Leader Lane and Ferguson Street. It is shown in heavy outline
on the plan attached. In the past, it has been the City's policy to authorize the closing and
conveyance of laneways in this area only if all of the laneway could be conveyed to the abutting
owners, at no cost to the City. This would eliminate the problem of landlocked portions of the
laneway being retained by the City.
In 1993 a requcst was made to close this lancway. Since many of the abutting owners were
unwilling to share in the cost to close and convey the laneway, the request was denied. Earlier this
year the same request was made. We received 9 replies in favour of closing and purchasing thc
laneway. Responses have been noted on the plan attached. Since not all of the owners are in
agreement staffcannot recommend the closing and conveyance of the entire laneway. The owners
at thc most southerly end of thc laneway have requested that thc City consider closing and conveying
only the most southerly 150 feet of the laneway. For maintenance purposes, the City could still

access the remainder ofthe laneway from Leader Lane. Staffwould have no objection to closing
this portion of the laneway.

RECOMMENDATION:
That Staff be authorized to commence proceedings to permanently close the laneway between May
Avenue and Buttrey Street being part of Plan 997, PIN 64269-0344 (subject land). A copy of the
subject land is shown hatched on Schedule "A" attached to this report.
BACKGROUND:
Staff received requests from various abutting owners to permanently close the laneway and convey
same to the abutting owners. The subject land is a laneway which is "L" shaped and approximately
16 feet in width and 240 feet in length. The subject land is located at the rear of homes fronting May
Avenue, Terrace Avenue and Buttrey Street. Permanently closing and disposing of the subject land
will relieve the City of all maintenance, plowing and potential liability. It should be noted that
presently the subject land only serves the abutting owners. The abutting owners agree to pay for any
and all costs associated with the transfer of the subject land.

Dear .Mayor Ted Salci,
I am writing to request a proclamation for "Marriage Checkup Week" on February 9-14, 2004.
During that week our association is conducting a public awareness campaign to promote healthy
marriages through annual checkups. Marriage checkups are designed to strengthen and protect
marriages by helping couples of all ages and descriptions examine their relationships on a regular
basis. We would like annual marriage checkups to become as routine as annual medical
checkups. We know you will agree that healthy marriages and healthy families are the lifeblood
of the community.
During Valentine's week members of our non-profit association will offer free one-hour marriage
checkups to the public as a conununity service. The marriage checkup helps identify the unique
strengths as well as the potential trouble spots in a relationship. Couples sit down with a trained
Marriage and Family Therapist who can help prevent small problems from becoming more
serious ones. It is our association's way of saying "Happy Valentine's Day" to Niagara Falls.
Our publicity materials will feature a cross-section of couples, young, old, same-sex, and
members of diverse cultural and racial groups. Niagara Falls is the home of many rich traditions
and varied communities. Our aim is to promote healthy marriages and prevent the painful
breakdown of marriages across the board.
We ask that you support our public awareness campaign by issuing a proclamation that
February 9-14, 2004, is "Marriage Checkup Week". Thank you for your kind consideration of
our request.

Dear Mayor Salci,
As you know, gambling has become much more accessible across Ontario in recent years.
This form of recreation has opened up new leisure opportunities for many of our citizens and
generated much needed revenues for provincial and municipal governments. Unfortunately,
the expansion of gambling has led to the growth of problem gambling as well. There are
currently over 350,000 individuals in Ontado with moderate to severe gambling problems.
Fodunately, the govemments that benefit from gambling revenues have recognized the
importance of addressing the problems related to gambling through research, treatment and
prevention programs. I am writing to you today to seek your support for a new problem
gambling awareness program that is being piloted in selected communities across Ontario.
Within Limits Responsible Gambling Awareness Week is a pilot program funded by the
Ministry of Health and Long-Term Care and organized by the Responsible Gambling Council.
It is supported by various stakeholders in the community including Niagara Alcohol & Drug
Assessment Service, Niagara Regional Police, WARM 0Nomen's Addiction Recovery and
Mediation), Delta Monte Carlo Bingo, Casino Niagara, Fort Erie Racetrack and the Ontario
Lottery and Gaming Corporation.
Within Limits Responsible Gambling Awareness Week was developed to:
*Promote safe gambling practices among Ontarians who gamble to minimize gambling
related problems
*Ensure that Ontadans have the information, skills and encouragement to reduce their dsk
that they will develop a gambling problem with special attention to those at increased risk
*Ensure that those with gambling problems know that services and supports are available
and where to get help

Appointments to the Niagara Transit Commission
RECOMMENDATION:
That Council vote on the slate of applicants to serve the Niagara Transit Commission.
BACKGROUND:
As mentioned in a report on appointments to various committees that this writer prepared last month
(cf CD-2003-22), it is necessary to go ahead with appointments to the Niagara Transit Commission.
Traditionally, in January, the Commission comes before Council for their annual financial request.
In light of the recent municipal election, there are only two sitting Commission members: His
Worship Ted Salci, who remms as a member because of his position as Mayor and Lou Stranges,
who is half way through his two year appointment. There are three vacancies. One vacancy has
occurred due to the election of Jim Diodati to Council (Alderman Diodati was halfway through his
two year term,.). An Act Respecting the City of Niagara Falls sets out the composition of the Transit
Commission as follows:
(1) The Commission is a body corporate and shall consist of five members, as follows:
1. The mayor of the City, during his term of office.
2. Four members appointed by the council of the City, two of whom shall be appointed each
year for a term of two years.
As a result of the above, Council must fill two (2), two year vacancies and one (1) individual to fill
in for the rerriainder of the term vacated by Alderman Diodati.

Voting will be done by secret ballot. Each Council member will be allowed to vote for three (3)
candidates. The two candidates receiving the highest vote totals will be appointed to the two-year
terms, with the third place vote getter filling the one-year vacancy. In the event of a tie vot.e for third
place, a mn off vote will take place. Also, it is foreseeable that there could be a tie for second place,
in which case a mn off would occur to determine who is appointed to the two-year term versus the
one-year term.
Pre-printed ballots will be available to assist in the process. A list of candidates is attached. The set
of applications have been provided in your agenda package.
Finally, the appointment will be formally ratified by by-law at the next Council meeting.

Amendment to the Cash-in-Lieu

It is recommended that the Cash-in-Lieu Agreement between the City of Niagara Falls and Gupta
Souvenirs Ltd be amended to reflect the option for carrying out a Parking Demand Analysis.
BACKGROUND:
Council at its October 20, 2003 meeting, directed staff to review Gupta Souvenirs parking
requirements as defined in the cash-in-lieu agreement to include the provision for a Parking
Demand Analysis.
In 2003, the applicant had entered into a cash-in-lieu agreement with the City for a total of 20
parking spacing for which the applicant was not able to provide on-site. Calculations for the
cash-in-lieu contribution is based on zoning by-law requirements. The objective of a parking
demand analysis is to demonstrate the actual parking requirements a development needs to
operate effectively, which may on occasion differ from the zoning by-law. The analysis is
prepared on a site specific basis and includes a review of various factors including, but not
limited to, the size of the development, the use(s) within the building, the location and patronage.
Under the auspices of the City, Totten Sims Hubicki has substantiated a reduction to the Gupta
Souvenir property from 20 spaces to 11 cash-in-lieu spaces. However, given that the study was
completed during the off peak season, the field analysis component was not carried out which
resulted in conservative standards to be used. Thus, Mr. Gupta has requested that the study be
enhanced to include a detailed assessment of parking and tourist behaviour during the peak
summer season. Mr. Gupta has provided sufficient funding to carry out the necessary studies.

Staff will be requesting the consultant to further refine the recently completed Parking Demand
Analysis in July 2004 to include activity during the peak tourist season. Should the results
warrant a further reduction to the parking requirement less than the 11 spots recently assessed, it
is suggested that Gupta Souvenirs be refunded any overpayment from the 2004 cash-in-lieu
contribution paid in January 2004.
Furthermore, an amendment to the Cash-in-Lieu agreement that was originally executed January
2003, between the City and Gupta Souvenirs to include the option for the completion of a
Parking Demand Analysis is required.
Council's concurrence with the recommendations outlined in this report would be appreciated.

RECOMMENDATIONS:
It is recommended that By-law 89-2000 is amended to reflect regulations pertaining to parking
control restrictions and intersection traffic control devices according to various subdivision
agreements.
BACKGROUND:
Within the City of Niagara Falls, various subdivisions have recently been completed or are in the
process of completion in particular, Garner Estates, Williams Subdivision, Beaver Valley,
Brookfield Court, Graham Street Extension and Orchard Grove West. On several streets it is
necessary to install parking restrictions, as per the conditions in the subdivision agreement.
Furthermore, traffic control signs are also required at several locations to ensure that motorists
have the right-of-way allocated within the intersection. Therefore, staff is recommending that the
following regulations be implemented and the appropriate signs installed.
1) Parking be restricted at all times on:
a) the northeast side of Graham Street from Delta Drive to the northern limit
b) both sides of Beaver Valley Way from Beaverdams Road to Beaverton Boulevard
c) both sides of Cuviello Court from Clare Crescent to the northern limit
d) the north side of Mullen Court from West Lane to the eastern limit
2) A stop sign be installed on:
a) Graham Street at Delta Drive facing eastbound motorists
b) Cuviello Court at Clare Crescent facing southbound motorists

To allow the City lands west of the Mountain Road Landfill Site, the future Mountain Road Sports
Park, to be developed for recreational purposes, the Ministry o fEnvironment Certificate of Approval
for the Mountain Road Landfill site requires that clean earth fill be placed on these lands to provide
adequate cover over the ground water table. In October 2002, the City received the approval of the
Niagara Escarpment Commission to place clean earth fill to the required contours.
Since the Mountain Road landfill site closed on October 31, 2000, City of Niagara Falls contracts
has stipulated that the contractors must dispose of all clean earth fill from City projects at a private
dump site. At times, contractors had problems locating acceptable dump site locations. This has
resulted in Contractors adding these additional tracking costs and dump site grading costs to the unit
costs tendered. Therefore, some of the cost to grade the Mewburn Road site will be offset by savings
on City road, sewer and watermain contracts, for the disposal of the clean fill material. The Mewburn
Road Sports Park site will allow the City to dispose of clean earth from the City's projects until the
fall of 2005.
In the past, developing the Mewburn Road site has proven to be not financially feasible or timely,

due to the cost and time to fill the site. Once the fill has been placed and graded, the Mewburn Road
Sports Park site can be developed.
This project is scheduled to commence on January 27, 2004 and all works completed by October 28,
2005.

RECOMMENDATION:
That Council authorize the purchase of a telephone and radio system voice recorder from Cartel
Communications Systems at a cost of $36,900.00 plus taxes including delivery, installation and
training.
BACKGROUND:
For the past 35 years Fire Services has been recording its telephone calls to the dispatch center. This
allows us to confirm addresses and conversations in regard to all forms of emergency calls and legal
liabilities. Our current voice logger is outdated and has undergone a number of repairs. Its usable
service life has been reached and it is no longer able to serve our needs. It is used to tape all
incoming calls and radio channels to the Fire Services Communications Center from the City as well
as the Town of Lincoln which purchases dispatching services from us.
A request for proposals was originally circulated to three major voice logger manufacturers. Three
companies responded to the RFP with quotes. All companies included one (1) year parts and labor
warranty. All companies included instant recall equipment. Fire Services is recommending Cartel
Communications Systems based on Cartel being the provider of our new radio interoperability
platform, plus:
additional equipment for downloading the information and calls for long term record storage
or court purposes is built into this unit;
rack mountable format required for space saving purposes;
expandable taping capabilities are included;
equipment is readily adaptable to our radio system;
no annual licence fees regardless of the number of listeners;
24/7 on site service (Cartel is the only company which provides this service);

RECOMMENDATION:
That a road widening, being Part 1 on 59R-12028 attached as Schedule "A", be established as a
public highway, to be known as and to form part of Slater Avenue.
BACKGROUND:
As a condition of Site Plan Approval, Kraft Canada Inc. conveyed a road widening to the City. The
subject lands are located on the east side of Slater Avenue and shown in heavy outline on the plan
attached. Staffis now recommending that the subject lands be dedicated as a public highway to be
known as and to form part of Slater Avenue.
