WHEREAS all meetings of Council are to be open to the public; and
WHEREAS the only time a meeting or part of a meeting may be closed to the public is if the
subject matter falls under one of the exceptions under s. 239(2) of the Municipal Act, 2001.
WHEREAS on July 20, 2020 Niagara Falls City Council will be holding a Closed Meeting as
permitted under s. 239 (2)(f) of the Municipal Act for advice that is subject to solicitor-client
privilege, including communications necessary for that purpose.
WHEREAS s. 239(8) of the Act requires that the record required by subsection 239(7)
shall be made by the Clerk of the Corporation in the case of a meeting of council; and
WHEREAS s.228(4)of the Act permits the Clerk the discretionary authority to delegate in
writing to any person, other than a member of council, any of the clerks powers and duties
under the Act;
THEREFORE BE IT RESOLVED that on July 20, 2020 at 2:00 p.m., Niagara Falls City Council
will go into a closed meeting, to consider matters that fall under 239 (2)(f) of the Municipal Act to
discuss an issue regarding patio licensing.
FURTHER BE IT RESOLVED THAT on July 20, 2020 the City Clerk, Bill Matson,
delegates his authority in his absence to the CAO, Ken Todd; and
FURTHER BE IT RESOLVED THAT the CAO will record without note or comment all
recommendations to Council emanating from the Closed Meeting; and
AND The Seal of the Corporation be hereto affixed.
